HomeMy WebLinkAbout2005-07-05 P & Z CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION JULY 5, 2005 Pursuant to due call and notice thereof, the Planning and Zoning Commission held their regularly scheduled meeting on July 5, 2005, at 6:30 p. m. COUNCIL: Council Member Terway STAFF: Mr.Larson I. CALLTOORDER 1.Roll Call The meeting was called to order at 6:45 p.m. II. APPEARANCES None. III. PUBLIC HEARING(S) rd 1.Mr. Rick Carlson, Hunter’s Crossing 3 Addition Chair Hanson opened the public hearing at 6:33 p.m. Mr. Rick Carlson appeared before the Commission and reviewed the plat for Hunter’s rd Crossing 3 Addition noting he has added 7 more lots than the original plan has for a total of 44 lots. Mr. Carlson indicated he has approval subject to some conditions from Rice Creek Watershed District. Page 1 of 6 City of Centerville Planning& Zoning Commission July 5, 2005 Meeting Minutes City Administrator Larson asked if Mr. Carlson owns any additional property or if this development includes all of his property. Mr. Carlson indicated that he has included all developable property that he owns. There were no public comments. Motion by Commissioner Klennert Hunt, seconded by Commissioner Hanzal, to close the public hearing. All in favor. Motion carried unanimously. Chair Hanson closed the public hearing. Mr. Carlson indicated that he intends to complete grading as soon as possible once approvals are in place. Motion by Commissioner Klennert Hunt, seconded by Commissioner Wright, to rd approve the preliminary plat for PUD of Hunter’s Crossing 3 Addition. All in favor. Motion carried unanimously. IV. OLD BUSINESS 1.Inspection of Rental Units – Ordinance #38 City Administrator Larson indicated that the City does not conduct inspections and, at the last meeting, it was discussed whether the City should do inspections or eliminate the Ordinance. He then said that he has discussed inspection with Staff and it should be fairly manageable. Staff and the Commission discussed potential parameters for inspections and agreed that decisions would need to be made as to what Staff would be looking for as minimum passing qualifications for the annual inspection. Council Liaison Terway left at 6:45 p.m. 2.Continued Review of Ordinances Ordinance #41 – No changes needed. Ordinance #42 – No changes needed. Ordinance #43 – Replaced by Ordinance #51. Ordinance #44-A – No changes needed other than correction of typographical errors. Ordinance #45 – During codification this will be combined with all others regarding water and sewer. Page 2 of 5 City of Centerville Planning& Zoning Commission July 5, 2005 Meeting Minutes Ordinance #45 – A – This Ordinance was adopted when City went to remote reading of meters Ordinance #46 – City Administrator Larson suggested abandoning this Ordinance and adding a more general statementconcerning weight restrictions. He then suggested going to a 5-ton limit with few exceptions by permit. City Administrator Larson suggested outlawing parking of semis or big trucks in neighborhoods. Commissioner Love indicated he would have an issue not allowing owners to park trucks at home. The Commission suggested that a 7-ton limit would be easier on residents. Ordinance #47 – Hanson asked if Staff updated the cross-reference. Mr. Larson indicated Staff would be looking into this reference during the codification. Ordinance #48 – No changes needed. Commissioner Wright said that there are statistics that prove that mailbox theft is more prevalent when boxes are clustered. The Commission asked Staff to look into whether the postal service requires clustering of mailboxes. Ordinance #49 – No Changes needed. Chair Hanson suggested stating in the Ordinance to refer to the snowmobile ordinance. Mr. Larson suggested deleting the reference to snowmobiles entirely and the Commission agreed. Ordinance #50 – No changes needed. Ordinance #51 – No changes needed. Ordinance #52 – No changes needed. Ordinance #53 – No changes needed. The Commission discussed adding personal services to the list of not allowed. Ordinance #54 – No changes needed. Commissioner Wood asked Staff to look into commercial properties not being actively used or kept up to see what can be done to improve the aesthetics. NEW BUSINESS 1.St. Paul Regional Board of Water Utilities – Private Homeowners Purchase of Shoreline Strips City Administrator Larson indicated that the St. Paul Water Board is making strips of land down to the water available for purchase by the homeowners subject to conditions. He then said that the Commission needs to decide whether to look at each of these or if they qualify under exceptions because it is an addition to the property. Commissioner Hanzal asked if they look at the setback from the water whether they look at the property line or the water line. City Administrator Larson indicated that there are Ordinances that look at setback from the ordinary high water mark as well as regular zoning requirements whichever is more restrictive. The Commission discussed the matter and agreed that the Commission did not need to see each of these individually. Motion by Commissioner Hanzal, seconded by Commissioner Love to make the determination that it is not necessary for these parcels to come before the Commission individually if it meets the exception section of the Subdivision Ordinance, Section 2105-01. All in favor. Motion carried. VI. DISCUSSIONITEMS Chair Hanson asked for an update on the Rehbein dirt mining operation for NPDES compliance. City Administrator Larson said that 90% of the operation is in Centerville and there are clearly some violations over there. He then said that would be difficult to control dirt blowing but the City could require silt fencing. He further indicated that the property is under purchase agreement for a different use sometime next year. Commissioner Wood indicated he was asked to bring up the dog ordinance and the required time to remove the waste. He then said that there are about 28 piles of dog waste in the back yard of a specific residence and it smells. Staff agreed to look into the situation. VII.CONSIDERATION OF MINUTES 1. June 7, 2005 Planning and Zoning Meeting Minutes Page 4 of 5 City of Centerville Planning& Zoning Commission July 5, 2005 Meeting Minutes Commissioner Klennert Hunt requested the following change: On Page 5, change weight to width. Chair Hanson asked to amend the language slightly concerning the Rehbein property to indicate he was interested in Staff looking into compliance with NPDES permit requirements. Motion by Commissioner Hunt, seconded by Commissioner Wood to approve the Minutes of June 7, 2005, as amended. All in favor. Motion carried unanimously. VIII. ADJOURNMENT Motion by Commissioner Hanzal, seconded by Commissioner Love to Adjourn the July 5, 2005 Planning Commission Meeting at 8:35 p.m. All in favor. Motion carried unanimously.
