PUBLIC HEARING(S) Open Forum Julie Reiman, 7174 Brian Drive - Suestions Concerning Communication with Residents Julie Reiman appeared to state that she could not get timely answers to her email from Council Members regarding the right-of--way issue regarding her property. She stated that email should not go unanswered by the people making decisions for the City. She added that she also contacted City Finance Director Meyer on August 8, but did not receive a response from him until this afternoon, August 15. At that time, he only responded with 2 short sentences, stating that the City has $8,055,596 in long-term debt, and she should call if she had any further questions. She also requested information from Mayor Capra on July 23, and did not receive a response until August 12. She stated that these behaviors should be addressed, and there should be some protocol for City Council Members and City Staff to answer messages from citizens in a timely manner. Laura Powers, 7173 Brian Drive -Concern about Representation Laura Powers stated that she has served on the City Council and has lived in Centerville since 1992. She stated that there is a Petition, with over 500 citizen signatures, requesting that the City step back and reassess the 2009 Road Project. She stated that one Page 1 of 9 City of Centerville City Council Meeting August 13, 2008 Councilmember questioned the validity of some of the signatures. Ms. Powers stated that she objects to allegations regarding that and regarding some of the volunteers who handed out the information. Ms. Powers added that Public Officials are elected to serve the people who elected them to office, so they should listen to the citizens' concerns and display demeanor. Since this began, other issues are coming forward and causing much stress, so it is turning into a power struggle. She quoted that the City has over $8,000,000 in long- term debt, and this project would add another $7.8 million. Ms. Power also stated that she objected to the bike plan to go back into Mill Road. Mr. Charles Reinhardt, 1723 Meadow Lane Mr. Reinhardt stated that, in July, someone called the City to say he was chasing ducks. He stated that he was at Veterans Camp at that time, and that he is also 100% disabled. He stated that his daughter did bring some baby ducks home from school for a school project at one time, but there was a 2-month span between when her daughter had the ducks and when the complaints surfaced. In March, Mr. Reinhardt received a letter from the City regarding dog poop. He stated that it was frozen in the snow, and he could not get it out. Mr. Reinhardt also stated that he has a situation in his back yard with 8 neighbors. He requested that one person from the County be present as a mediator when this is addressed. Mayor Capra recommended that Mr. Reinhardt talk to Karen Skepper, who handles HRA. City Administrator Larson could provide Mr. Reimhardt with Ms. Skepper's contact information. III. APPROVAL OF AGENDA Mayor Capra made the following corrections to the August 13, 2008, City Council Meeting Agenda: In Item 1 of Consent Agenda, she added Pg. 23 a. In Item 4 of New Business, she replaced Page 68 with Page 68a. She added Item 5 Claudia Comstock to New Business Motion made by Council Member Paar, seconded by Council Member Broussard-Vickers, to approve the August 13, 2008, City Council Meeting Agenda, as amended. All in favor. Motion passed unanimously. IV. APPROVAL OF MINUTES 1. July 23, 2008, City Council Meeting Minutes Councilmember Broussard-Vickers made the following changes to the July 23, 2008, City Council Meeting Minutes: Page 2 of 9 City of Centerville City Council Meeting August 13, 2008 On Page 2, under Approval of Minutes, the phrase in Paragraph 2 should read, "Councilmember Broussard-Vickers wanted our financing adjusted so no payment would exceed $100 per month (if possible)." On Page 4, Paragraph 5 under Item 2, delete the phrase, "but believed that Ms. Fruth is on vacation." On Page 7, in the Motion for Item 4 of New Business, regarding the downtown engineering improvements, Councilmember Broussard-Vickers had abstained. Change last two sentences from "All in favor. Motion carried unanimously (5/0)," to "Council Member Broussard-Vickers abstained. Motion carried (4/1)." Motion made by Council Member Broussard-Vickers, seconded by Council Member Lee, to approve the July 23, 2008, City Council Meeting Minutes, as amended. All in favor. Motion carried unanimously. 2. July 23, 2008, City Council Work Session Meeting Minutes Motion made by Council Member Lee, seconded by Council Member Paar, to approve the July 23, 2008, City Council Work Session Meeting Minutes as presented. Pulled for Discussion -Kelly's Request for Temporary Event Permit & Temporary Enlargement of Serving Alcohol on Premise (Au u.~ st 16, 2008 Councilmember Broussard-Vickers expressed concern regarding Kelly's diagram, with the note stating that all gates in the outdoor area would be bolted shut. She recommended that they should be required to keep at least one gate open on each side and have them staffed. Councilmember Broussard-Vickers stated if that issue was resolved, she would support approval of the request. Mayor Capra inquired whether the temporary serving of alcohol outdoors would be a problem. Councilmember Lee replied that the mixed drinks are usually sold inside. Only the beer would be sold outside. Legal Counsel Spector stated that the City Council has the authority to approve this request. Motion made by Council Member Broussard-Vickers, seconded by Council Member Lee, to approve Kelly's request for temporary event permit and temporary enlargement of serving alcohol on premise (August 16, 2008), with the modification that at least one gate would be left open on each side and staffed. All in favor. Motion passed unanimously. VL AWARDS/PRESENTATIONS/APPEARANCES Police Update Sgt. Pat Aldridge provided the Council with an update of the police activities. Some of the highlights were: - The police apprehended the Skate Park vandal and the suspects responsible for the vehicle thefts. - The National Night Out was very successful. Centerville had 5 parties that were a good size. The gathering at Willow Circle doubled in size from last year, with over 100 people in attendance. Sgt. Aldridge stated that those who put the Willow Circle event together did an outstanding job. - Minnesota's Little League Baseball Championship was held in Circle Pines. - The police have new ticket writers in their squad, and the speed trailer is being used. - There were 8 forfeitures sold at the last auction, for a total of $4,000. - Problem orientated policing experience - It will be more intense and will have better documentation. - There were 180 traffic stops, but only 10% were ticketed. The police are being lenient right now because of the new speed changes. - There were 2 DWI arrests -One of which was with a stolen vehicle. - Sgt. Aldridge worked the Street Dance, which was uneventful. Page 4 of 9 City of Centerville City Council Meeting August 13, 2008 Mayor Capra stated that she talked to Commission Sivarajah. She pointed out that the signs that are orange, with black lettering, indicate that there is an "automatic" double fine in that area. VII. OLD BUSINESS L Ms. Cathy Fruth (7384 Old Mill Road) -Driveway Issue - (Old Mill Road Improvements) - (Tabled from Previous Meeting Mayor Capra inquired whether there were any updates on Ms. Fruth's driveway issue. City Administrator Larson replied that the last they heard was that she needed time to decide whether any of the Counsel's suggested solutions were acceptable. He added that no one has heard back from her. City Engineer Statz stated that Ms. Fruth's neighbor, Mr. Fischer`s, driveway was recompacted and touched up a little. He recommended sending Ms. Fruth a letter stating that, unless the City Council hears otherwise, they will assume this issue is settled. The City would then go ahead and do touchups work. Motion was made by Council Member Lee, seconded by Council Member Broussard- Vickers, to send a letter to Ms. Fruth, stating that, unless the City Council hears otherwise, they will assume this issue is settled. All in favor. Motion passed unanimously. 2. Approve Joint Settlement Agreement -Sheehy Condemnation City Administrator Larson stated that he had received an update from City Attorney Glaser that the settlement amount was still at $ 201,500, but that some of the language in the Agreement had been changed. Motion made by Council Member Lee, seconded by Council Member Paar, to reaffirm the approval of the Joint Settlement Agreement with Sheehy Condemnation. Council Member Broussard-Vickers abstained. Motion carried (4/1). VIII. NEW BUSINESS 1. Request for Reduction of Security (Letter of Credit) for Clearwater Creek Estates Development - to $146,890, and Request for Refund of the $10,000 Escrow Deposit Mayor Capra requested that this issued be deferred to City Engineer Statz and City Administrator Larson. City Administrator Larson stated that he is all right with it, as long as there are no outstanding charges or bills. Page 5 of 9 City of Centerville City Council Meeting August 13, 2008 Motion made by Council Member Lakso, seconded by Council Member Lee, to approve the request for reduction of security (Letter of Credit) for Clearwater Creek Estates Development - to $146,890, and request for refund of the $10,000 escrow, contingent on there being no outstanding bills. All in favor. Motion passed unanimously. 2. Res. #08-022 -Proclaiming Constitution Week (September 17-23, 2008 Mayor Capra announced that this signifies the 225th Anniversary of the drafting of the Constitution. Motion by Council Member Broussard-Vickers, seconded by Council Member Paar, to approve Res. #08-022 -Proclaiming Constitution Week (September 17-23, 2008). All in favor. Motion carried unanimously. 3. Res. #08-023 - Proclaiming October, 2008, to be Domestic Violence Awareness Month Mayor Capra reported that this request was sent by Alexandra House, Inc., and this is something that is done every year. Motion by Council Member Paar, seconded by Council Member Broussard-Vickers, to approve Res. #08-023 -Proclaiming October, 2008, to be Domestic Violence Awareness Month. All in favor. Motion carried unanimously. 4. Parks & Recreation Committee Requesting Funds Not to Exceed $1,500 for Advertising the 2009 Festival of the Lakes 8K Run Councilmember Lee stated that he has a notation from City Finance Director Meyer that the money is in the fund, and there is money left in the budget. He stated that the Parks & Recreation Committee members believe the cost would be more than recouped with the runners' entry fees. Councilmember Lee stated that it is very important to work quickly on this. Motion by Council Member Lee, seconded by Council Member Lakso, to approve funds for the Parks & Recreation Committee, not to exceed $1,500, for advertising the 2009 Festival of the Lakes 8K Run. All in favor. Motion carried unanimously. 5. Claudia Comstock -Request for a Crosswalk and Si.~ns by the Trail Crossing on Centerville Road Mayor Capra reported that Claudia Comstock, age 7, came into the City Hall today, August 13, 2008. She brought in a picture of the trail crossing on Centerville Road, by former Mayor Wilharber's house. Ms. Comstock drew a picture by the trail, and stated that there should be a crosswalk and signs to make the crossing safer. She stated that her grandmother's car got hit by a bike at that location, and provided a picture of the damage Page 6 of 9 City of Centerville City Council Meeting August 13, 2008 done to her grandmother's car. Ms. Comstock made a $33 donation from her allowance money. Her brother made a $17 donation. Mayor Capra stated that the Council would deposit the donations from Ms. Comstock and her brother into the City's account, and then send a letter regarding Ms. Comstock's issue, along with a check in the amount of the donations, to the County. Mayor Capra stated that she had thanked Ms. Comstock for making an effort to change an unsafe situation. Councilmember Lee stated that he was impressed that Ms. Comstock would do that. Mayor Capra stated that they would send a letter to Commissioner Sivarajah, the Council's Representative for their area, with a request that they respond to Ms. Comstock. Councilmember Broussard-Vickers suggested that the Council also send a letter to Ms. Comstock, thanking her and telling her what action was taken by the City Council. Motion by Council Member Broussard-Vickers, seconded by Council Member Paar, to forward to Anoka County, Claudia Comstock's request to put a crosswalk and suns by the trail crossing on Centerville Road. All in favor. Motion carried unanimously. IX. ANNOUNCEMENTS/UPDATES 1. City Administrator. Mr. Dallas Larson City Administrator Larson reported that the County Road discussion will take place in the Work Session, following the August 13 City Council Meeting. 2. Fete des Lacs Mayor Capra stated that the Council would like to thank the Lions Club and others who made the festival possible. Councilmember Lee stated that there were 4 bands, and about 125-150 people there. He stated that the event went over pretty well. He added that there were some amazing tricks done on the skate park by Centerville kids. Mayor Capra pointed out that she understood that Councilmember Paar contributed a lot of his time also. Councilmember Paar replied that he served beer and helped to setup on Thursday. On Saturday, he was a floating guy, helped with tents, helped when some Lions needed a break, etc. He added that everything went extremely well Mayor Capra stated she understands that it takes thousands of hours to get everything organized. Page 7 of 9 City of Centerville City Council Meeting August 13, 2008 Mayor Capra stated that they had the City Hall open. She wanted to thank the Centennial Fire District No. 3 for their help. Councilmember Paar stated that he never realized what went into this event. He said it is a great festival. Hats off to the Lions for putting all the effort into it. Councilmember Lee stated that they are getting ready to plan next year's festival. He invited the Council to attend the Planning Meeting. He added that they need help, and he would like to encourage people to help. 3. Planning & Zoning Commission Councilmember Broussard-Vickers announced that Chair Hanson will be retiring in September 2008. She stated that Chair Hanson has been on the Planning & Zoning Commission for a long time, and is leaving due to work commitments. She stated that Chair Hanson would be missed. There will now be an opening in the Planning & Zoning Commission. Mayor Capra recommended that the City Council and the Planning & Zoning Commission have a Joint Session to go over some of the Ordinances. Councilmember Lee recommended that the City not pay for the Park projects until there is a walkthrough. He stated that the painting of equipment was not done, and there are several other things that have to be addressed. Mayor Capra stated that the whirl is 18" above grade, and looks like it should be lowered a foot. City Administrator Larson stated that, if something was missed, the contractor will come back to fix it. With regard to Hidden Springs Park, City Engineer Statz stated that the original contract has aone-year warranty when plans are initially installed. He stated that, when they come back, there would not be a one-year warranty. However, this was discussed and worked out, so there will be a warranty. Mayor Capra inquired whether City Administrator Larson got photos of what was done to restore the shoreline. City Administrator Larson replied that he did, and he showed the photos of the work being done. City Engineer Statz stated that most of the plants are pretty well established and are pretty aggressive plants. 4. Fire Steering Committee Meeting Page 8 of 9 City of Centerville City Council Meeting August 13, 2008 Councilmember Paar reported that the Fire Steering Committee did not meet. Councilmember Paar reminded the Council that, on Thursday, August 21, there would be a party for Chief Milo Bennett's retirement at the Lino Lakes Fire Station. He added that there will be a short program at 5 pm. City Council Work Session Meeting Mayor Capra announced that, after a brief break, the City Council would reconvene for the City Council Work Session Meeting. X. She pointed out that the signs that are orange, with black lettering, indicate that there is an "automatic" double fine in that area. VII. OLD BUSINESS L Ms. Cathy Fruth (7384 Old Mill Road) -Driveway Issue - (Old Mill Road Improvements) - (Tabled from Previous Meeting Mayor Capra inquired whether there were any updates on Ms. Fruth's driveway issue. City Administrator Larson replied that the last they heard was that she needed time to decide whether any of the Counsel's suggested solutions were acceptable. He added that no one has heard back from her. City Engineer Statz stated that Ms. Fruth's neighbor, Mr. Fischer`s, driveway was recompacted and touched up a little. He recommended sending Ms. Fruth a letter stating that, unless the City Council hears otherwise, they will assume this issue is settled. The City would then go ahead and do touchups work. Motion was made by Council Member Lee, seconded by Council Member Broussard- Vickers, to send a letter to Ms. Fruth, stating that, unless the City Council hears otherwise, they will assume this issue is settled. All in favor. Motion passed unanimously. 2. Approve Joint Settlement Agreement -Sheehy Condemnation City Administrator Larson stated that he had received an update from City Attorney Glaser that the settlement amount was still at $ 201,500, but that some of the language in the Agreement had been changed. Motion made by Council Member Lee, seconded by Council Member Paar, to reaffirm the approval of the Joint Settlement Agreement with Sheehy Condemnation. Council Member Broussard-Vickers abstained. Motion carried (4/1). VIII. NEW BUSINESS 1. Request for Reduction of Security (Letter of Credit) for Clearwater Creek Estates Development - to $146,890, and Request for Refund of the $10,000 Escrow Deposit Mayor Capra requested that this issued be deferred to City Engineer Statz and City Administrator Larson. City Administrator Larson stated that he is all right with it, as long as there are no outstanding charges or bills. Motion by Council Member Broussard-Vickers, seconded by Council Member Paar, to approve Res. #08-022 -Proclaiming Constitution Week (September 17-23, 2008). All in favor. Motion carried unanimously. 3. Res. #08-023 - Proclaiming October, 2008, to be Domestic Violence Awareness Month Mayor Capra reported that this request was sent by Alexandra House, Inc., and this is something that is done every year. Motion by Council Member Paar, seconded by Council Member Broussard-Vickers, to approve Res. #08-023 -Proclaiming October, 2008, to be Domestic Violence Awareness Month. All in favor. Motion carried unanimously. 4. Parks & Recreation Committee Requesting Funds Not to Exceed $1,500 for Advertising the 2009 Festival of the Lakes 8K Run Councilmember Lee stated that he has a notation from City Finance Director Meyer that the money is in the fund, and there is money left in the budget. He stated that the Parks & Recreation Committee members believe the cost would be more than recouped with the runners' entry fees. Councilmember Lee stated that it is very important to work quickly on this. Motion by Council Member Lee, seconded by Council Member Lakso, to approve funds for the Parks & Recreation Committee, not to exceed $1,500, for advertising the 2009 Festival of the Lakes 8K Run. All in favor. Motion carried unanimously. 5. Claudia Comstock -Request for a Crosswalk and Si.~ns by the Trail Crossing on Centerville Road Mayor Capra reported that Claudia Comstock, age 7, came into the City Hall today, August 13, 2008. She brought in a picture of the trail crossing on Centerville Road, by former Mayor Wilharber's house. Ms. Comstock drew a picture by the trail, and stated that there should be a crosswalk and signs to make the crossing safer. She stated that her grandmother's car got hit by a bike at that location, and provided a picture of the damage Page 6 of 9 City of Centerville City Council Meeting August 13, 2008 done to her grandmother's car. Ms. Comstock made a $33 donation from her allowance money. Her brother made a $17 donation. Mayor Capra stated that the Council would deposit the donations from Ms. Comstock and her brother into the City's account, and then send a letter regarding Ms. Comstock's issue, along with a check in the amount of the donations, to the County. Mayor Capra stated that she had thanked Ms. Comstock for making an effort to change an unsafe situation. Councilmember Lee stated that he was impressed that Ms. Comstock would do that. Mayor Capra stated that they would send a letter to Commissioner Sivarajah, the Council's Representative for their area, with a request that they respond to Ms. Comstock. Councilmember Broussard-Vickers suggested that the Council also send a letter to Ms. Comstock, thanking her and telling her what action was taken by the City Council. Motion by Council Member Broussard-Vickers, seconded by Council Member Paar, to forward to Anoka County, Claudia Comstock's request to put a crosswalk and suns by the trail crossing on Centerville Road. All in favor. Motion carried unanimously. IX. ANNOUNCEMENTS/UPDATES 1. City Administrator. Mr. Dallas Larson City Administrator Larson reported that the County Road discussion will take place in the Work Session, following the August 13 City Council Meeting. 2. Fete des Lacs Mayor Capra stated that the Council would like to thank the Lions Club and others who made the festival possible. Councilmember Lee stated that there were 4 bands, and about 125-150 people there. He stated that the event went over pretty well. He added that there were some amazing tricks done on the skate park by Centerville kids. Mayor Capra pointed out that she understood that Councilmember Paar contributed a lot of his time also. Councilmember Paar replied that he served beer and helped to setup on Thursday. On Saturday, he was a floating guy, helped with tents, helped when some Lions needed a break, etc. He added that everything went extremely well Mayor Capra stated she understands that it takes thousands of hours to get everything organized. Page 7 of 9 City of Centerville City Council Meeting August 13, 2008 Mayor Capra stated that they had the City Hall open. She wanted to thank the Centennial Fire District No. 3 for their help. Councilmember Paar stated that he never realized what went into this event. He said it is a great festival. Hats off to the Lions for putting all the effort into it. Councilmember Lee stated that they are getting ready to plan next year's festival. He invited the Council to attend the Planning Meeting. He added that they need help, and he would like to encourage people to help. 3. Planning & Zoning Commission Councilmember Broussard-Vickers announced that Chair Hanson will be retiring in September 2008. She stated that Chair Hanson has been on the Planning & Zoning Commission for a long time, and is leaving due to work commitments. She stated that Chair Hanson would be missed. There will now be an opening in the Planning & Zoning Commission. Mayor Capra recommended that the City Council and the Planning & Zoning Commission have a Joint Session to go over some of the Ordinances. Councilmember Lee recommended that the City not pay for the Park projects until there is a walkthrough. He stated that the painting of equipment was not done, and there are several other things that have to be addressed. Mayor Capra stated that the whirl is 18" above grade, and looks like it should be lowered a foot. City Administrator Larson stated that, if something was missed, the contractor will come back to fix it. With regard to Hidden Springs Park, City Engineer Statz stated that the original contract has aone-year warranty when plans are initially installed. He stated that, when they come back, there would not be a one-year warranty. However, this was discussed and worked out, so there will be a warranty. Mayor Capra inquired whether City Administrator Larson got photos of what was done to restore the shoreline. City Administrator Larson replied that he did, and he showed the photos of the work being done. City Engineer Statz stated that most of the plants are pretty well established and are pretty aggressive plants. 4. Fire Steering Committee Meeting Page 8 of 9 City of Centerville City Council Meeting August 13, 2008 Councilmember Paar reported that the Fire Steering Committee did not meet. Councilmember Paar reminded the Council that, on Thursday, August 21, there would be a party for Chief Milo Bennett's retirement at the Lino Lakes Fire Station. He added that there will be a short program at 5 pm. City Council Work Session Meeting Mayor Capra announced that, after a brief break, the City Council would reconvene for the City Council Work Session Meeting. X.
