Some of the more significant changes are outlined as follows: 1. 150.10 has been amended to adopt most recent version ofthe International Fire Code. 2. 150.10 (D) is amended allow storage of flammable liquids only in 1-1 and B-1 zoning districts and must be at least 50 feet from a property line. 3. 150.30 C, 2 Sump Pump regulations are modified to provide rigid connections to outside of building and providing for discharge into rear yards except by special approval for another location. 4. 152.01 Included definitions for "Dynamic Sign," "Pylon Sign", and "Ground Sign" which are regulated later in the draft. 5. Removed definitions of "Advertising Sign" and "Business Sign." Definitions were not used in the text of the chapter. 6. In Section 152.15, General Regulations, language was inserted to regulate billboards and regulations inserted to permit Dynamic Signs up to 20 square feet. Also included were requirements on light intensity of lighted and dynamic signs. 7. Modifications were made to sections relating to political signs in conformity with state law. 8. Section] 52.16 was modified to allow sandwich boards without a permit, subject to conditions. 9. Section 153.44 F. Clarifies that utilities must be placed underground in new subdivisions. 10. Section 153.45 Provides for Manufactured Home Developments as Planned Unit Developments (PUD) 11. Districts are being moved to follow definitions. Currently lot and building requirements are divided by "Districts." Districts are now 154.100 -{}ther sections were renumbered accordingly. 12. 154.100 C 10 previously 154.035 C, 10 includes M-2 Mixed Use Neighborhood Districts which was part of an earlier amending ordinance. 13. Section 154.113 changes related to manufactured homes. Provides that manufactured home parks or districts can only be considered as Planned Unit Development. Includes requirement for continuous perimeter footing and foundation. Old section providing for manufactured home park districts was deleted. 14. Section 154.151 is inserted to include missing language that was part of Ordinance 3, Second Series. 15. 154.201 previously 154.015 was modified to adopt the Table one. Also clarifies minimum residential building sizes. This was previously buried in Table One. 16. Table one has been modified to reduce front yard setback from 35 to 30 feet in R- 2A zoning district. 17. 154.204 previously 154.018 confirms minimum dwelling size at 24 feet for M-2 district. 18. 154.204 previously 154.018 F requires continuous perimeter footing and foundation for dwellings. 19. 154.213 previously Section 154.023 relates to site plan review and requires submittal of electronic copies of plans. 20. 154.220 previously 154.110 Incorporates a number of new requirements for fences. Diagrams will be included for illustrative purposes. Includes language requiring fences for permanent swimming pools. 21. 154.231 A,4,a, previously 154.130 requires parking area setback for non residential uses shall be 20 feet when abutting a residential use or zone. 22. 154.240 previously 154.140 Shoreland rules were left with 75 foot setbacks from lakes except that docks must now be 10 feet from side property line. 23.154.270 previously 154.170 will be modified to substitute Ordinance 19, Second Series that modified parking requirements. 24. 154.271 previously 154.171 Tree Planting. Policy will now be that trees should be planted at least 15 feet from the curb and out of the right of way. Code will refer to "front-yard trees" rather than "boulevard trees." This will clarify responsibility for tree maintenance and will reduce conflicts with public utilities where trees have been planted close to the curb. 25. 154.410 Variance language is modified in light of recent court rulings and to reflect state law requirement. 26. 154.330 Interim Use permits. This section was added allow permits to be issued for temporary or time specific periods. Complete text of these Chapters may be obtained from City Hall. The City Hall is ADA accessible. Requests for hearing assisted devices or a sign language interpreter must be received before 4:00 p.m., October 30, 2008. Love Commissioner Ben Fehrenbacher Commissioner Roland Parucci Commissioners Mark Pangell Commissioner Thomas Wood Commissioner Darrin Mosher ABSENT: None COUNCIL: Council Member Broussard was absent STAFF: City Administrator Dallas Larson I. CALL TO ORDER Chair Love called the meeting to order at 6:30 p.m. 1. Roll Call II. APPEARANCESIPRESENT A TION(S) Brendon Slotterback-regarding Comprehensive Plan. Brendon Slotterback of Bonestroo & Associates was present to discuss the city's Comprehensive Plan update. He indicated that the review period for neighboring jurisdictions expires on October 9,2008. He reviewed the comments received thus far from Anoka County, Lino Lakes and Met Council. Comments received have been minor and responses given to each jurisdiction. Hugo sent a letter indicating "no comment." Slotterback reviewed the process to finalize the plan. The Commission could either hold a hearing and then recommend the plan for adoption or recommend preliminary approval of the plan with the understanding that a public hearing would be held after Met Council completes its formal review, and prior to final adoption by the City. Since there had already been public open house/input opportunities, the consensus was to recommend the plan for preliminary adoption with the public hearing to follow Met Council formal review. All in favor. Motion carried unanimously. Randy Haggerty regarding front porches. Randy Haggerty of 1835 Prairie Drive was present to suggest that City rules might be changed to encourage front porches to be constructed. He felt that neighborhoods would be perceived to be more friendly, if homes had porches on the front of the homes. He suggested that grants be explored to come up with some sample designs and further that the rules be relaxed to encourage construction of front porches. This would also add value to the homes. Staff will look into the grant possibilities and report back. III. PUBLIC HEARING(S): None IV. OLD BUSINESS A. CODE REVIEW. The Commission reviewed a memo containing a summary of the changes that are proposed as a result of its review process over the past several months. The Commission directed that language in the sump pump regulations be changed to say that a "rigid connection shall be made to the outside of the structure." The Commission examined the sign regulations and determined that a definition and regulation should be added for a "Pylon Sign" and a "Ground or Monument" sign. A pylon Sign should be located ten feet from the property line and must be at least six feet to the bottom of the sign. A ground sign should be at least fifteen feet from any property line and may not interfere with traffic visibility. These changes will be incorporated into the revision. The Commission further directed a change in the draft to include a regulation that illuminated signs may not direct excessive light onto adjoining residential properties. Motion by Commissioner Pan!!:ell, seconded bv Commissioner Wood, to schedule a public hearin!! at its November meetin!! to consider the Code revisions to Chapters 150-155. All in favor. Motion carried unanimously. B. BUILDING SETBACKS. The Commission discussed the building setbacks following a number of recent requests for variances. The Commission identified the R-2A zone as a likely candidate for changed setback. The majority of the homes were constructed on smaller lots with small two-car garages and minor change might allow flexibility for expansion of garages and homes. Consensus was that a five foot reduction in the setback would be warranted. Motion by Commissioner Fehrenbacher, seconded by Commissioner Pan!!elL to schedule a public hearin!!: at its November meetin!! to consider a proposed ordinance that would chan!!e the front-yard setback in the R-2A district to 30 feet. CREATIVE KIDS DA YCARE-REQUEST FOR SIGN PERMIT. The Commission received a request for a sign permit for a pylon sign to be located on the north side of the property along Center Street. The Commission felt the sign would be better on the north side of the parking lot adjoining the County road, but the Code would only allow the Commission to impose restrictions that deal with safety and traffic visibility. Staff will pass on the Commission's recommendation to the applicant that the sign would be better placed if moved to the east end of the parking lot and oriented to CSAH 54. Motion by Commissioner Fehrenbacher. seconded bv Commissioner Pane:ell. to recommend approval of the SiD permit conditioned upon the requirement that the siD be placed a minimum of ten feet from the propertv line to the center post and that the bottom of the SiD must be a minimum of six feet above the driveway elevation to ensure visibility and traffic safety.
