CITY OF CENTERVILLE SPECIAL CITY COUNCIL MEETING October 24, 2005 9:00 a.m. Pursuant to due call and notice thereof, the City of Centerville held a special meeting scheduled on October 24, 2005, at the Anoka County Court House, 2100 Third Ave., Anoka, Minnesota 55303. PRESENT: Mayor Mary Capra Council Member Tom Lee Council Member Jeff Paar ABSENT: Council Member Michelle Lakso Council Member Richard Terway STAFF: Litigation Attorney Joan Quade Litigation Attorney Susan Sheely I. CALL TO ORDER Mayor Capra called the October 24, 2005, Special Council meeting to order at 9:08 a.m. II. SET AGENDA Agenda approved Motion by Council Member Lee seconded by Council Member Paar to approve the agenda as presented. All in favor. Motion carried unanimously. III.PUBLIC HEARING(S) None. IV. APPEARANCES/AWARDS None. V. CONSIDERATION OF MINUTES None VI. PETITIONS AND COMPLAINTS VII.OLD BUSINESS City of Centerville Special Council Meeting Minutes October 24, 2005 VIII. EXECUTIVE SESSION (CLOSED) Royal Oaks Realty Litigation 9: 10 a.m. – Mayor Capra recessed the council to executive session for discussion of settlement with Royal Oaks Realty. 9:30 a.m . – Mayor Capra reconvened the regular session of the meeting. During the executive session the council discussed a settlement offer to be presented to Royal Oaks Realty by the attorney representing the City of Centerville, Ms. Quade in the amount of $80,000.00 payable today. Motion by Council Member Lee seconded by Council Member Paar to offer a settlement amount of $80,000.00 to Royal Oaks Realty payable today. All in favor. Motion carried unanimously. 9:45 a.m. – Mayor Capra recessed the special meeting and council moved into the courtroom. 10:10 a.m. – Mayor Capra reconvened the special meeting and recessed to executive session for settlement negotiation with Mr. Marcel Eibensteiner of Royal Oaks Realty per the request of Judge Maas. 10:41 a.m. – Mayor Capra reconvened the special meeting. During the executive session the council discussed with Mr. Marcel Eibensteiner a settlement of $65,000.00 to be paid by cashier check to the City of Centerville no later than Wednesday, October 26, 2005 before the close of the business day. The City of Centerville would dismiss the case following the receipt of the check. Motion by Council Member Paar seconded by Council Member Lee to offer a settlement amount of $65,000.00 to Royal Oaks Realty payable in the form of a cashier check to the City of Centerville by close of business day Wednesday, October 26, 2005. Once the City has the payment has been received the City of Centerville will move that the case against Royal Oaks Realty will be dismissed. All in favor. Motion carried unanimously. IX. NEW BUSINESS X. ADJOURNMENT Motion by Council Member Lee seconded by Council Member Paar to adjourn the October 24, 2005 City Council Special Meeting at 10:43 a.m. All in favor.
