CITY COUNCIL MEETING
November 12, 2008
Pursuant to due call and notice thereof, the City of Centerville held its regularly scheduled meeting
on November 12, 2008, at 6:30 p.m.

Prior to the start of the November 12 City Council Meeting, the Council met to interview
two candidates for the Planning & Zoning Commission vacancy (current)/vacancy
(January 2009). The candidates interviewed were:
1. Mr. James Wekseth, 1832 Fox Run (Interviewed at 6:00 p.m.)
2. Mr. Jesse Lange, 7363 Peltier Circle (Interviewed at 6:15 p.m.)

Mayor Capra called the November 12, 2008, City Council Meeting to order at 6:35 p.m.
II. APPROVAL OF AGENDA
Mayor Capra made the following additions to the Agenda:

Motion by Council Member Broussard-Vickers, seconded by Council Member Lee, to
approve the November 12, 2008, Agenda as amended. All in favor. Motion carried
unanimously.
III. PUBLIC HEARING
1. Delinquent Sewer/Water/Garbage Services Certification/Assessments Payable in
2009
Mayor Capra opened the Public Hearing at 6:36 p.m.
City Administrator Larson stated that letters were sent to all residents approximately 14
days prior to the Public Hearing date.
Mayor Capra asked if anyone would like to make a comment regarding this Public
Hearing.
No one came forward to speak.
Motion by Council Member Broussard-Vickers, seconded by Council Member Lee to
close the Public Hearing. All in favor. Motion carried unanimously.
Mayor Capra closed the Public Hearing 6:37 p.m.
IV. APPROVAL OF MINUTES
1. October 22, 2008, City Council Meeting Minutes
Mayor Capra made the following change to the October 22, 2008, City Council Meeting
Minutes:
On Page 2 of 6, Changes to Minutes, Second Paragraph, change "Eagle Trail" to "Eagle
Pass."
Councilmember Lee made the following change to the October 22, 2008, City Council
Meeting Minutes: Page 6 of 6, under Adjournment, in the Motion for Adjournment, the
titles of those making and seconding the motion should be changed from "Commissioner
Paar" and "Commissioner Broussard-Vickers" to "Council Member Paar" and "Council
Member Broussard-Vickers."
Motion by Council Member Lee, seconded by Council Member Paar, to approve the
October 22, 2008, City Council Meeting Minutes, as amended. All in favor. Motion
carried unanimously.

Motion by Council Member Broussard-Vickers, seconded by Council Member Lee, to
approve the November 5, 2008, Special City Council Meeting Minutes, as presented.
All in favor. Motion carried unanimously.

Motion by Council Member Broussard-Vickers, seconded by Council Member Paar,
to approve the Consent Agenda as presented. All in favor. Motion carried
unanimously.
VL AWARDS/PRESENTATIONS/APPEARANCES
Mr. Terry Sweeney -Centerville Lions Use of 7087 - 20th Avenue Stora'~e for
Haunted House Items
Mr. Terry Sweeney thanked the City Council for the use of the Warming House for the
Lions' use for the Haunted House. He requested that the Centerville Lions be allowed to
use the old Public Works Building for storage of the Haunted House items until they are
able to find a suitable place to store them.
Mayor Capra replied that the City is looking at renting out part of the building. She
inquired as to how much space the Lions Club would need. She also suggested that, as an
alternative, they may be able to use the storage container that the City owns.
Mr. Sweeney replied that there would not be a lot to store. They are looking to purchase
an old semi-trailer for storage of some items.
City Administrator Larson suggested that Mr. Sweeney speak with the Public Works
Director. .

Mr. Sweeney reported that the Centerville Lions collected a lot of food for the food
shelf. He stated that they had a Boy Scout troop leader and a couple scouts helping, along
with some people from Eagle Brook Church.
Motion by Council Member Lee, seconded by Council Member Lakso, to allow
Public Works Director Palzer and the City Staff accommodate the temporary storage
needs of the Centerville Lions. All in favor. Motion carried unanimously.
VII. OLD BUSINESS
Un-declare Linda Broussard-Vickers Day -Res. #OS-021
Councilmember Broussard-Vickers requested that this resolution be rescinded.
Motion by Council Member Lee, seconded by Council Member Lakso, to rescind
Resolution #05-021 regarding Linda Broussard-Vickers Day. All in favor. Motion
carried unanimously.
VIII. NEW BUSINESS
Parks & Recreation Committee's Request to Make Final Payment to Veit &
Company for Hidden Spring Park Renovation
Councilmember Lee reported that the Parks & Recreation Committee did awalk-through
of the Hidden Spring Park renovation and found that everything appeared to be completed.
City Engineer Statz reported that the amount of the final payment was $17,633.67.
Motion by Council Member Lee, seconded by Council Member Broussard-Vickers, to
approve the fifth and final payment of $17,633.67 and close out the contract with
Veit & Company for the Hidden Spring Park Renovation. All in favor. Motion
carried unanimously.
2. Res. #08-XXX -Calling for a Public Hearin. on Special Assessments for the 2009
Street Improvement Project
City Administrator Larson displayed a slide, which showed the impact of the 2009 Street
and Utility Project on non-specially assessed properties. He reported that the City's
portion of the Project's cost is $2.8 million or $268,000 annually. The annual cost of the
levy fora $250,000 house would be approximately $152 per year, and the cost for a
business, with a $250,000 market value, would be approximately $305 per year.
Mayor Capra reported that at the Special City Council Meeting on November 5, the
Council looked at the potential of pulling the water portion out of the assessment and the
costs recouped through connection charges as they are used. She inquired whether there
was any information regarding this request.

City Attorney Glaser stated that if the Council wished to do so, all the water improvement
could be removed from assessments on the project. He suggested that they should change
how this is done in the future for everyone by possibly including a trunk fee.
City Administrator Larson suggested that they may want to review this in more detail at a
workshop.
Mayor Capra suggested having a Workshop on Monday, December 1, which was
previously the tentative date for a Public Hearing on assessments for the project. Action to
set a public hearing could be on the agenda for the December 2 Truth in Taxation meeting.
Discussion ensued.
City Engineer Statz reported that January 27, 2008 is the deadline to award the contract.
Councilmember Broussard-Vickers and Mayor Capra questioned whether the 2009 Street
Project could be added to the Agenda for the December 2 Taxation Meeting. City
Administrator Larson stated that it could.
Discussion ensued. The Council concured to tentatively schedule the Public Hearing on
January 7, 2009, with January 6 as a possible back-up date.
Councilmember Broussard-Vickers stated that she would desire to see the proposed
assessment amounts prior to consideration.
Mayor Capra stated that this would be changing their policy for going forward. She added
that she is concerned about possibly setting a precedence and being fair to people in the
2004 Project.
Motion by Council Member Lee, seconded by Council Member Broussard-Vickers, to
table consideration of the call for a Public Hearing on Special Assessments for the
2009 Street Improvement Proiect until after the City Council has met to discuss it
further. All in favor. Motion carried unanimously.
City Engineer Statz reminded the Council that the City has 90 days (the last day being
January 27, 2009) to award the contract, and the Council will have to allow time to have
the Public Hearing before that date also.
3. Res. #08-030 -Submission of Safe Routes to School Grant Abblication
City Administrator Larson stated that this will be the City's third attempt to get a tunnel
crossing under CSAH 14 approved, to provide children with a safe route to school. He
added that this will be the City's last chance to submit this request as the county road
reconstruction will be completed early next summer.

Councilmember Lee stated that this would require more work on CSAH 14, and it would
slow the current progress. He expressed concern for the businesses along CSAH 14.
City Engineer Statz stated that the Finance Director had a conversation with the County
Engineer who appeared to be in favor of the project.
Mayor Capra inquired whether this could be in conjunction with completing the remainder
of CSAH 14.
City Engineer Statz replied that it would be a separate bid process.
Councilmember Lee stated that if the tunnel was approved, it would be desirable to have
the City start with that before they finish the work on CSAH 14.
City Engineer Statz stated that there are a lot of timing issues that would need to be worked
out.
Discussion ensued.
Councilmember Paar stated that the City applied for this, knowing CSAH 14 was being
reconstructed.
Mayor Capra suggested that they can apply for and the grant, if it is approved, they could
then decide whether to accept it.
Motion by Council Member Paar, seconded by Council Member Lee, to approve Res.
#08-030 -Submission of Safe Routes to School Grant Application. All in favor.
Motion carried unanimously.
4. Res. #08-031 -Preliminary Action on the City's 2030 Comprehensive Plan
City Administrator Larson stated that there is a memo in the Council's packet, suggesting
the next steps regarding the City's 2030 Comprehensive Plan, and a Resolution has been
prepared. City Administrator Larson stated that, if the City gets their plan in before most
of the other communities, they should get it back quickly (March). He stated that they
could then hold a Public Hearing and take final action to approve the Plan..
Councilmember Broussard-Vickers stated that she needs to disqualify herself from voting
on this because it would have an affect on her property.
City Attorney Glaser stated that this resolution would have a positive impact on
Councilmember Broussard-Vicker's property, so her vote would not count in the tally. It
would have to be approved at least 3 out of 4.
Mayor Capra stated that the City Council would like to thank Bonestroo's staff for
working with them. She added that it was a job well done.

Motion by Council Member Lakso, seconded by Council Member Paar, to adopt Res.
#08-031 -Preliminary Action on the City's 2030 Comprehensive Plan. Motion passed
(4/0/1). Council Member Broussard-Vickers did not vote on the matter to the conflict
of interest..
Request for Council Consideration for Staff to Commence 2008-2009 Business
Directory
City Administrator Larson reported that in the past, the City has worked in conjunction
with Media Junction on providing the City's Business Directory to all property owners and
new residents. Staff is requesting direction on whether to commence the process for the
upcoming 2009-2010 edition.
Councilmember Paar stated that he felt with the re-construction of CSAH14, businesses
would appreciate the opportunity to advertise their businesses.
Motion by Council Member Lee, seconded by Council Member Paar, to approve City
Staff commencing with the 2008-2009 Business Directory. All in favor. Motion
carried unanimously.
6. Council Consideration of Regional Trail Maintenance Along CSAH 14
City Administrator Larson stated that with the completion of the trail in the downtown
area, Council may want to consider plowing the snow and keeping the trail clear as the
County does not do routine maintenance of regional trails. Administrator Larson
questioned the length of maintenance to the west.
Councilmember Lee stated that he sees a lot of people using and enjoying that area on a
regular basis.
Councilmember Broussard-Vickers suggested that it be maintained as far as the City limits.
She also suggested that the Council be informed if there was a staffing issue.
Motion by Council Member Lee, seconded by Council Member Broussard-Vickers, to
direct City Staff to remove snow from the Regional Trail along CSAH 14 to the
entrance to Rice Creek Regional Park. All in favor. Motion carried unanimously.
7. Appointment of Planning & Zoning Commission Members
Both Mr. James Wekseth and Mr. Jesse Lange were interviewed on November 12, prior to
the City Council Meeting.
Motion by Council Member Lee, seconded by Council Member Broussard-Vickers to
approve the appointment of Jim Wekseth and Jesse Lame to the Planning & Zoning

Commission, pursuant to meeting requirements of Ordinance and Policy set forth by
the City of Centerville. All in favor. Motion carried unanimously.
IX. ANNOUNCEMENTS/UPDATES
1. City Administrator, Mr. Dallas Larson
a. Special Recognition of Election Judges/Public Works Staff/St. Genevieve's
Staff & the Public
City Administrator Larson reported that the Election went very well, and the Judges
did a fine job.
Councilmember Lee stated that he heard one complaint that the lines were chaotic
at 7 a.m. He suggested that for future elections the lines be better organized.
Mayor Capra stated that City Clerk Teresa Bender did an outstanding job
organizing the Election. There was a great turnout of both registered and new
registrants. Mayor Capra stated that she would like to thank City Clerk Bender and
the Staff.
City Administrator Larson stated that they would also be sending thank you letters
to the Judges involved and to St. Genevieve's for sharing their facilities.
Councilmember Lee stated that he would like to thank the people of Centerville
also. He stated that Centerville's percentage of voter turnout was the highest in the
State and possibly the highest nationally as well.
b. Li..~g Ceremony for the Downtown Area
City Administrator Larson stated that the City would like to have a lighting
ceremony for the downtown area following the completion of the light futures on
the south side of Main Street.
City Engineer Statz stated that electrical contractors have been busy working on
what they need to get done before the ground freezes, but should be back on this
project soon.
City Administrator Larson stated that the electrical contractors believe they will be
complete with the project around Thanksgiving. He added that the Staff will try to
pin that down to a specific date. However, they do not want to have a date they
cannot meet.
Mayor Capra stated that dignitaries from the County should be considered for
participation in this event

2. Police Governing Board -Written Statement - 11/10/08
Mayor Capra stated that the Police Governing Board met on November 10, 2008. The
Governing Board received a written statement regarding the Chief of Police, which raised
an issue regarding job performance. Mayor Capra read this written statement to the
Council, and said it would be available for the media. She stated that the Governing
Board, with the help of Consultants, will be implementing Job Performance Evaluations
for all members of the Department. She stated that the Police Governing Board accepted
the written statement as this part of the Job Review. The Midwest Community Policing
Institute will also be working with them, and they will be proceeding with the entire
Department. This will be implemented some time in January.
3. Council Goals/Objectives 2009
Councilmember Paar stated that the Council has "a lot on its plate," and they have a new
Council Member, who wants to jump right in. He suggested that this be covered in a
Workshop.
Mayor Capra stated that, in February, they could have a separate evening Workshop to
look at what was done in the past and what should be done going forward.
City Administrator Larson stated that he would send an example of what they had last year
and add a few suggestions for 2009.
Councilmember Paar suggested that the Council invite The Beard Group to attend a City
Council Meeting to give the Council an update on the downtown redevelopment He also
suggested having an all Committee Meeting.
4. Parks & Recreation Committee
Councilmember Lee reported that the Parks & Recreation Committee met on Wednesday,
November 5. He stated that the big issue is signage. He added that this is not getting
done, and it needs better follow-up through Public Works.
Councilmember Lee stated that aWalk/ Run activity was discussed. He stated that this
event would be an all-day event.
Councilmember Lee reported that there were more problems at Eagle Park involving
teenager issues. Some of the ideas Officer Dixon had suggested to the Park and Rec.
Committee, at a previous meeting, were enacted. Councilmember Lee added that the
Committee will work on more lighting and will need assistance from the Public Works
Department. The Committee is also in the process of working on additional solutions.
5. Planning & Zoning Commission -Changes to City Code Chapters 150-154

Councilmember Broussard-Vickers stated that the Planning & Zoning Commission held
the Public Hearing then passed up to the Council a number of amendments to City Code
Chapters 150-154. He added that the Council is waiting on the City Attorney to draft the
Ordinances to adopt the changes.
X. ADJOURNMENT
Motion by Council Member Paar, seconded by Council Member Lakso, to adiourn
the November 12, 2008, City Council Meeting. All in favor. Motion carried
unanimously.
