Present were Mayor Capra, Council members Jeff Paar, Tom Lee, Linda Broussard-
Vickers, and Michelle Lakso. Also present were Mark Statz of Bonestroo & Assoc., City
Attorney Kurt Glaser and Council member elect, Ben Fehrenbacher.

Minutes of Work Session
2009 Street Project:
Dallas Larson reviewed the schedule of special assessments that was calculated
subsequent to receiving bids in late October. The schedule excluded watermain, which
the council would have the City pay for and then collect the costs as the properties that
are served begin to hook up. It was noted that the assessments total just over $900,000.
The fInancing plan that was prepared by the fInance director assumed adjustments that
might lower that amount as much as 15%.
The Council questioned the engineer on whether there would be any benefIt to rebid the
project, given that crude oil prices and retail gas prices have dropped signifIcantly. Mark
Statz of Bonestroo indicated that a savings of around $40,000 (less costs of $5000-
$10,000 to re-bid) might be possible, if prices hold at their current levels. He indicated
that the refIneries are not committing to a future price for paving asphalt, so the
contractor assumes the risk that the price will remain at lower levels.
Property owner, Wayne LeBlanc was present to discuss the rain gardens needed on this
project. He has been in contact with Rice Creek Watershed District and believes that
grass rain gardens will be allowed. Mr. LeBlanc suggested that the areas along the
wetlands have a "no mow" type of grass to help protect the wetlands. Engineer Statz
indicated that he is hoping that RCWD will approve turf grass for the rain gardens. That
will permit the owners to mow the grass and the areas will appear like the yards except
for a short time after a rain event. Mr. LeBlanc suggested that the property owners have
the option to upgrade their raingardens to flowering plants if they wish to do the
additional work at their expense. The extra work may be eligible for grants from RCWD.
The Council discussed maintenance of the raingardens. The city will clean out sediments
periodically, but the adjoining property owners will be expected to mow and maintain
them as they do the rest of the boulevard area. It is still expected that almost all of the
rain gardens will fIt in the right of way or city utility easements. The engineer suggested
that workshops be held with property owners affected by rain gardens to explain the
program.
The Council took input from property owners that were present. Art Mohler commented
that he understood that a rain garden would be necessary and has been working with the
engineer on the details. Bill Sveten indicated that he was happy that the council plans to
have the city pay for the watermain and then collect the cost when hookup is requested.
Mr. Sveten indicated that he thought that the cost of the street paving would be around
$2500, but that was not the correct number. The assessment estimate indicates about
$6000. Mr. Sveten and Mr. Mohler both indicated that they thought property owner
resistance on their street would be much less with the change in the policy on the
watermain.
The resolution scheduling a public hearing on the special assessment will be on the
agenda for the meeting on December 2, 2008. Council member Broussard-Vickers asked
what the last date would be to take action before the expiration of the bids. The hearing
would be needed by the middle of January in order to take action before the bids expire
on January 27,2009. Engineer, Mark Statz was directed to check with the contractor to
see if he would extend his bid for a month, with a minimum extension of two weeks. Mr.
Statz indicated that he would do so, but cautioned that the pond cleaning work that was
scheduled for this winter may need to be pushed back to next winter, if the award of bid
isn't done on schedule.

I. CALL TO ORDER
Mayor Capra called the December 2, 2008, Truth in Taxation meeting to order at 6:07
p.m.
II. PUBLIC HEARINGS
1. Truth and Taxation
Finance Director Meyer presented information on the 2009 General Fund Budget
and Tax Levy. He indicated the 2009 General Fund Budget and Tax Levy is
scheduled for adoption at the December 10, 2008 City Council meeting. The tax
rate for 2009 will be slightly lower for the city portion of the tax. He noted that
79% of the city budget is paid for by property taxes and that 44% of expenditures
are for public safety expenses.
The hearing was opened to public comment, the following persons offered
comments on the budget:
Robert Clasauson, 1688 Lakeland Circle, questioned the rise in his taxes when
the market value of his property is going down.
Mr Clauson was told that the city portion of his tax would be stable or lower if it
were not for increases in property value. The administrator will provide him with
the phone number for the city assessor.
Jesse Lang, 7048 Cottonwood Court, also questioned the valuation of his
property and the time frame to challenge the valuation assigned to his property.

Truth and Taxation Hearing

Mayor Capra explained that the property values were established as of January 2,
2008, for taxes payable in 2009. The law requires that 25 percent of the
properties in each jurisdiction be valued each year and that the City and County
have tax valuation hearings in late spring and early summer.
After everyone who wished to do so had been given an opportunity to speak, the
hearing was closed.

Vickers~ to close the Truth in Taxation Public Dearine: at 6:26 p.m. All in
favor. Motion carried unanimously.

Engineer Statz provided an update on final payment to Burshville Construction.
Council Member Paar questioned whether all items on the punch list had been
completed to City standards, and if the large pile of top soil had been removed.
Engineer Statz stated all punch list items had been completed and the top soil had
been removed.
Motion by Council Member Lee. seconded by Council Member Paar to
approve the Cmal payment to Burschville Construction. Inc. in the amount of
$30.829.55 for closeout - Backae:e Road/21st Avenue Utility & Street
Improvements.
Engineer Statz requested the motion include wording referring to payment of
Change Order #5.
Council Member Lee accepted this friendly amendment. Council Member Paar
also accepted this friendly amendment.

Council Member Paar asked if these charges would be reimbursed from the City's
LMC Insurance Trust.
Finance Director John Meyer stated these expenses would be reimbursed through
the insurance following the City's deductable. He also stated this would be a total
payment of $24,498.00 divided up as follows: A.J. Ross Masonry $9,978.00 and
A.J. Ross Masonry & Bear Roofing & Exterior, Inc. $14,520.00.

3. Liquor License Renewal 2009 - Kelly's - On-Sale & Sunday
Council Member Lee stated he was aware Kelly's has passed all compliance
checks. The Council agreed to issue a Temporary On-Sale Liquor License to
Kelly's if they are unable to pay for the full year. This exception was previously
discussed and approved by Council due to hardship per the October 8, 2008
meeting minutes.
Motion by Council Member Paar. seconded by Council Member Lee to
approve a Temporary On-Sale Liauor License and Sunday Liauor License
for Kellv's. All in favor. Motion carried unanimously.
4. Tobacco License Renewal for 2009 - Kelly's and CenterMart.
Motion by Council Member Lee. seconded by Council Member Paar to
approve Tobacco License Renewals for Kelly's and CenterMart. All in
favor. Motion carried unanimously.
IX. ANNOUNCEMENTSIUPDATES

a. Livable Communities Demonstration Account Funding
Recommendations - Redevelopment of Block 8
Mr. Meyer provided an update on the status of the City's application for grant
dollars from the Metropolitan Council in the amount of $763,100. Mr. Meyer
stated the possibility of funding appears favorable for the City and that he has

notified the City's Met Council representative of our application. The
decision on these funds will be made by Met Council on December 10, 2008.
b. Downtown LightinglBusiness Promotion
Mayor Capra updated the council on the ribbon cutting ceremony and
business promotion scheduled for December 9, 2008 at 6:00PM in the
downtown. Newspaper Ads have been placed in several local papers
promoting this event and invitation are scheduled to go out by Wednesday of
this week.
c. Citizen Corps Council
Mayor Capra provided an update on her attendance at the Minnesota State
Citizen Corps Council conference held at the University of Minnesota. She
also stated she has provided a presentation to the City of Lexington last week
Thursday and will be presenting it to the City of Circle Pines tomorrow
evening. She has received by~laws for a Citizen Corps Council, she and Mr.
Larson will be working on them for presentation to the Council in January of
2009.
d. CSAH 14 Update
Engineer Statz provided an update and stated the road work is for the most
part completed for this construction season. He requested that if any residents
have outstanding issues with the project, they should contact City Hall as soon
as possible. The start of the 2009 construction season will begin following the
removal of the spring weight restrictions.
The work on the City 2009 Street Project if approved, would begin around the
same time as the completion of the CSAH 14 road work, but some pond
dredging may occur over the winter months.

SUBJECT: 2009 Skate Nights
The committee discussed scheduling at least two (2) Parks & Recreation Skate Nights at Laurie
LaMotte Memorial Park and would like to have one with the horse driven hayride as in the past
years. The dates selected were Saturday, January 10 and Saturday, February 14,2009. Ms. Stephan
will contact Bunker Hills Stable to inquire as to costs and availability. In the past years the horse
drawn hay ride was approximately $550. The committee would also supply a bonfire, hot chocolate
and popcorn and are considering various winter games or events that could include children's
prizes.
Motion was made by Vice-Chairperson Amundsen, seconded by Committee Member Lee to
recommend City Council approve funding of two (2) Skate Night events in 2009 at Laurie

Staff recommends that we contract with the Citizen to do the business directory.
We recommend that we do the lowest cost option and if ad sales are adequate so that
the city cost would be zero, that the highest possible upgrade be included.
The advertising goal is to reduce the city cost to near zero. If ad sales exceeded the
cost of printing the directory, excess funds would be used for business promotion.
If the Citizen distribution is used, the number of copies would be increased by about 600 to include
nearest Lino lakes addresses.
The last time this project was done, the city cost share was just over $1000.

WHEREAS, Res. #08-015 adopted by the City Council on June 11, 2008,
ordered the 2009 Street Improvement project, more fully described on the
attached Exhibit B (Improvement Description), and
WHEREAS, the Council authorized plans and specification and solicited
bids for parts 1-18 as described on the attached Exhibit B, and
WHEREAS, it is the desire of the City Council to modify the project by
reducing its scope.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA:
1. The Res. #08-015 ordering the improvement is amended to remove
watermain and service line construction from items 1 and 2 of the
project description of the attached Exhibit B.
2. The Res. #08-015 ordering the improvement is amended to delete
streets identified as items 3 and 19 through 23 as shown on the attached
Exhibit B.
3. The project scope as modified is described on the attached Exhibit C.

A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING
PREPARATION OF PROPOSED ASSESSMENT AND CALLING FOR A
PUBLIC HEARING ON 2009 IMPROVEMENT
WHEREAS~ bids have been received~ and costs have been determined for the 2009 Street
Improvement Project~ more specifically described on the attached "Exhibit C," and
WHEREAS, the contract price for the improvement is $2~844,497, and the expenses to be
incurred in the making of such improvement amount to $796~359 so that the total cost of
the improvement will be $3,640,359.
NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA:
1. The portion of the cost of such improvement to be paid by the city is hereby declared
to be $2,724,939 and the portion to be assessed against benefiting property is declared
to be $915,420.
2. The City Administrator, with the assistance of the consulting engineer shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece or parcel of land within the district affected, without regard
to cash valuation, as provided by law and in accordance with the adopted assessment
policy of the City, and he shall file a copy of such proposed assessment in his office
for public inspection.
3. A hearing shall be held on the 7th day of January~ 2009, at St. Genevieve Parish
Community Center, at 6:30 p.m. to pass upon the proposed assessment and at such
time and place all persons owning property affected by such improvement will be
given an opportunity to be heard with reference to such assessment.
4. The City Administrator is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper at least two
weeks prior to the hearing and he shall state in the notice the total cost of the
improvement. He shall also cause mailed notice to be given to the owner of each
parcel described in the assessment roll not less than two weeks prior to the hearing.

1. Plumbing Permits
A. The charge shall be five dollars ($5.00) for each plumbing fixture, device or connection to the sewer or
plumbing system, with a minimum charge of twenty-nine dollars and fifty cents ($29.50)
B. For any alteration, repair or extension to an existing plumbing system, where the work is of such a
nature that the permit fee charge cannot be determined from the above schedule, the permit fee shall be
thirty dollars ($30.00) first five-hundred dollars ($500.00) or fraction thereof, plus fifteen dollars

GRADING FEES
General. Fees shall be assessed in accordance with the provisions of this section or shall be as set forth in the fee
schedule adopted by the jurisdiction.
Plan Review Fees. When a plan or other data are required to be submitted, a plan review fee shall be paid at the

~ 92.21 SHORELINE PROTECTION
The shoreline where any public park or public grounds meets Centerville Lake is a protected area.
The shoreline must be protected from vehicular and foot traffic in order to establish and maintain
vegetation. Shoreline vegetation will stabilize and protect the shoreline from erosion. This protected
area extends fifteen feet from the ordinary high-water mark of the Lake.
No person may be present within a protected shoreline area which is so posted. It is a trespass for
anyone to be present within a protected shoreline area when the area is posted against entry.
Section 6. Section 92.17(A)(2)(a) of the Centerville City Code is hereby amended as follows
(a) An obstruction permit is required to hinder free and open passage over the specified
portion of rights-of-way by placing equipment and/or garbage containers described therein on the
rights-of-way, to the extent and for the duration specified therein.
Section 7. Chapter 94 of the Centerville City Code is hereby amended by inserting the following:
~ 94.02 ULTIMATE FIGHTING PROHIBITED
(A) Definition and pwpose. Ultimate fighting is any activity, regardless of how named or
described, or any form of entertainment, where the primary practice involves individuals engaged in
physical contact by striking an opponent with hands, head, feet or body. This shall include, but not be
limited to, any contest where kicking, punching, martial arts, or submission holds are permitted. The
City Council finds that the practice of ultimate fighting is dangerous and puts individuals and the
public health, safety and welfare at great risk.
(B) Prohibited conduct. It shall be unlawful in any public or private building or place to
organize, permit, be present at, or to participate in the practice of ultimate fighting. Officially
sanctioned matches regulated by the Minnesota Boxing Commission, martial arts, wrestling and team
sports in which physical contact is incidental to the primary pwpose of the game such as hockey,
basketball, volleyball, soccer, baseball and softball, are not included among activities prohibited by this
section.
Section 8: Effective Date: This ordinance shall be effective immediately upon its passage and
publication according to law.

(A) This section establishes a City Planning and Zoning Commission, and a Parks and Recreation
Committee. The purpose of these Committees is advisory and they may make recommendations to the
City Council for consideration regarding matters relating to this Committee.
(B) For the purpose of this chapter, the terms Commission and Committee are used
interchangeably. Policy refers to Commissioners and Committee Members alike.

Section 3: Chapter 32 of the Centerville City Code is hereby amended by inserting the entire chapter to

CHAPTER 32: GENERAL AUTHORIZATION
~ 32.01 BACKGROUND INVESTIGATIONS
(A) The purpose of this section is to authorize the City of Centerville acting through a Police
Department to access through the Bureau of Criminal Apprehension, Minnesota Computerized
Criminal history public data and driver's license history background checks on employees, applicants
for employment, volunteers and applicants for any license issued by the City, including but not limited
to licenses for intoxicating liquor, wine, beer, refuse haulers, tobacco, peddler, solicitor and massage.
The City may conduct comprehensive background investigations, including but not limited to
accessing data through other automated and non-automated sources and contacting references. The
City may periodically conduct a driver's license inquiry upon employees, volunteers or licensees where
possession of a valid driver's license is an essential qualification of the position or license. Before the
investigation is undertaken, the person must authorize the Police Department in writing to undertake
the investigation and to release the information to the City Administrator, and other City staff as
appropriate. If a questioned identity situation occurs, fingerprint or other biometric verification shall be
obtained.
(B) Should the City reject an applicant's request for employment due, partially or solely, to the
applicant's prior conviction of a crime, subject to the exception set forth in Minnesota Statutes Section
364.09, the City Administrator shall notify the applicant in writing of the following:
1) The grounds and reasons for the denial;
2) The applicable complaint and grievance procedure set forth in Minnesota Statutes
Section 364.06;
3) The earliest date the applicant may reapply for employment; and
4) All competent evidence of rehabilitation will be considered upon reapplication.

(A) It is the purpose of this chapter to regulate adult-oriented businesses to promote the health,
safety, morals and general welfare of the citizens of the city and to establish reasonable and uniform
regulations to:
(3) To locate adult-oriented businesses away from residential areas, schools, churches, parks

shall be construed as authorizing or permitting conduct which is prohibited or regulated by other
statutes or ordinances, including but not limited to statutes or ordinances prohibiting the exhibition,
sale or distribution of obscene material generally, or the exhibition, sale or distribution of specified
materials to minors. To the extent that a law or regulation adopted by a different unit of government is
consistent with this chapter, that supersedes or is in whole or in part more restrictive than this chapter,
it shall apply to adult-oriented businesses in the City. If a law or regulation adopted by a different unit
of government supersedes any portion of this chapter and which only regulates a portion or facet of the
operation of an adult-oriented businesses regulated by this chapter then this chapter or this code of
ordinances applies to the remainder of the operation that is not regulated by the superseding
jurisdiction.

Section 3. Section 110.07 (B), (B)(3),(B)(6), (B)(7), and (B)(8), of the Centerville City Code is hereby
amended to read as follows:
(B) Applications. An application for a license must be made on a form provided by the city.
Providing false, misleading or inaccurate information as part of this application is a violation of the city
code. The application shall contain or be accompanied by the following:
(3) Application for a license shall contain the address and legal description of the property to
be used; the names, addresses, phone numbers, dates of birth of the owner(s), lessee if any, the
operator( s) or manager( s), and all employees; the name, address and phone number of two persons who
shall be residents of the state and who may be called upon to attest to the applicant's, manager's or
operator's character; the names and addresses of all creditors of the applicant, owner, lessee or manager
insofar as regarding credit which has been extended for the purposes of constructing, equipping,
maintaining, operating, furnishing or acquiring the premises, personal effects, equipment or anything
incident to the establishment, maintenance and operation of the business.
(6) The license fee as set forth in the annual fee schedule.
(7) The applicant shall disclose the nature of, and identifying information regarding all prior
criminal convictions or pending criminal charges for each person or business named in the application.
This disclosure shall also include the disposition of each conviction. Also each person or business
named in or as part of this application shall execute a written authorization allowing the City to
complete a criminal background investigation. These shall be on form supplied by the City. Any
criminal conviction can be considered as part of the application process; however, disclosure of certain
criminal convictions will result in denial of the application. Those convictions include:
(8) Each person or business named in or as part of this application shall execute a written
authorization allowing the city and/or the Chief of Police to verify all information disclosed as part of
the application..
Section 4. Section 110.10 (A)(3), (G)(2) and (G)(3) of the Centerville City Code is hereby
amended to read as follows:
(A) (3) Every application shall disclose the nature of, and identifying information regarding all
criminal convictions or pending criminal charges for each person or business named in the application.
(G) Execution of Application
(2) Falsification is a cause for revocation or denial of the license, and is a criminal offense
punishable as a misdemeanor.
(3) Each person or business named in or as part of this application shall execute a written
authorization allowing the city and/or the Chief of Police to verify all infonnation disclosed as
part of the application
Section 5: Section 111.12 (B)(l) of the Centerville City Code is hereby amended to read as follows:
(B)(1) The city will endeavor to mail all application fonns by September 30 with a letter stating 1

Section 6: Section 111.12 (D) of the Centerville City Code is hereby amended by inserting the
following:
(D) CONTESTS OF PUGILISM ON THE PREMISES OF LICENSED ESTABLISHMENTS IS
PROHffiITED.
(l) The City Council finds that it is in the best interests of public health, safety and general
welfare of the people of the city that Boxing, Ultimate Fighting or more generally, contests
involving pugilism or battery are prohibited as provided in this section on the premises of any
establishment licensed under this chapter. This is to protect and assist the owner, operators and
employees of the establishment, as well as patrons and the public in general, from harm
stemming from the physical immediacy and combination of alcohol and violence. The Council
especially intends to prevent any endorsement of assaultive behavior or activities likely to lead
to the possibility of various criminal conduct, including assault, battery, threatening behavior,
disorderly conduct, or public nuisance. The Council also finds that the prohibition of contests
involving pugilism or battery on the premises of any establishment licensed under this chapter,
as set forth in this section, reflects the prevailing community standards of the city.
(2) The City Council finds that it is in the best interests of enforcing its Liquor Regulations and
policing establishments which can serve intoxicating beverages that the previous Subdivision
shall also apply to non-alcoholic events on the licensed premises.
(3) A violation of this section is a misdemeanor punishable as provided by law, and is
justification for revocation or suspension of any liquor, wine, or 3.2 percent malt liquor license
or the imposition of a civil penalty under the provisions of this chapter.

Section 7: Section 112.03(A)(1)(h) and (A)(5) of the Centerville City Code is hereby amended to read
as follows:
(A)(1 )(h) Whether applicant has ever been convicted of, or charged with a felony, gross
misdemeanor or misdemeanor, including traffic violations, and if so, the date and place of conviction,
the nature of the offense, and identifying information such as a ticket number or case number;
(A) (5) Written Authorizations. Each person or business named in or as part of this application shall
execute a written authorization allowing the city and/or the Chief of Police to verify all information
disclosed as part of the application.
Section 8: Section 113.03 (C), (C)(1), and (C)(2) of the Centerville City Code is hereby amended to
read as follows:
(C) Application. Application for a city license to conduct business as a peddler or transient merchant
or to be registered for contribution solicitation shall be made at least 14 days before the applicant
proposes to conduct the licensed or registered activity. Application shall be made on forms supplied by
the city. The application shall include the names and addresses of all persons that will be conducting
the licensed or registered activity, prior locations where similar activities have been conducted, the
dates that the activities are proposed to be conducted and the other information and the city may require
as a condition oflicensing or registration. All applicants must disclose whether applicant has ever been
convicted of, or charged with a felony, gross misdemeanor or misdemeanor, including traffic
violations, and if so, the date and place of conviction, the nature of the offense, and identifying
information such as a ticket number or case number.
(1) Written Authorizations. Each person or business named in or as part of this application shall
execute a written authorization allowing the city and/or the Chief of Police to verify all
information disclosed as part of the application.
(2) False statements. It is unlawful to knowingly make a false statement in the license
application and is punishable as a misdemeanor criminal offense. In addition to all other

A violation ofthis chapter shall be a misdemeanor. For continuing violations, each day the violation
exists shall be considered a separate offense.
Section II: Section 120.01(A) and (B) of the Centerville City Code is hereby amended to read as
follows:
(A) Except for plumbers and other contractors exempted by State law from be licensed by the City, no
excavator or water/sewer service line installer will be allowed to commence any water and/or sewer
service installation without first having obtained a license from the city. Forms supplied by the
Administrator shall be completed and accompanied by a license fee in the amount established by
Council resolution. Homeowners desiring to do their own work shall not be required to be licensed,
but the work shall be done under supervision of a plumber licensed by the State of Minnesota.
(B) The application shall include information as is requested by the city for determining identity and a
qualification to perform as a water/sewer service line installer. Upon a determination by the
Administrator that the application is complete and proper in all respects and the license fee is paid, the
Administrator shall issue the license. The term of the license shall run from the date of issue until
December 31 of the year of issue, unless sooner terminated by the City Council. Renewal shall be
accomplished by the same manner as original issue. The license may be revoked by action of the City
Council for violation of any ordinance, regulation, or law relating to the licensed work.

Section 12: Section 120.99 of the Centerville City Code is hereby amended to read as follows:
Any persons violating any provision of this chapter shall be guilty ofa misdemeanor. Notwithstanding
other penalties, any person who begins work governed by this chapter without first obtaining a license
from the city shall pay double the normal license fee.

Section 1. Section 130.03 heading and Section 130.03(A) of the Centerville City Code is hereby
amended to read as follows:

(A) It shall be unlawful to shoot, fire off, discharge or explode any gun, pistol, revolver or other
firearm or device which ejects a projectile upon or onto any road, street, avenue, sidewalk or other
public place, or inside any dwelling or structure in the city except upon ranges permitted by the City
Council.
Section 2. Section 130.99 of the Centerville City Code is hereby amended by deletion of the entire
section.

Attached is the insurance proposal that we are going to use.
We would like to use the old public works building to store our equipment for 6 to 12 months
or longer (we understand that
If the building is sold we will be moving our equipment out.) In lieu of rent we will furnish the
labor and miscellaneous small parts
to restore the old fire truck. Any major items needed would have to be purchased by the city. If
all goes well we should be able to
complete this task in 6 to 9 months. We would not require any additional heat for the space we
are using we are accustomed to
working outside and if we need additional heat for a short period of time we would be willing to
reimburse the city for what we use.
We are willing to pay $200.00 per month for the use of the building, Repair the east service
door, clean and maintain shop
area. Because we would be working on the fire truck after our normal work day we will be in and
out at different times of the day
and night also providing limited security for the property.
