Memo to Planning & Zoning Commission
Re: Application of Jason's Bobby and Steve's Auto World
Bobby & Steve's Auto World has made application for a conditional use permit (CUP) to
operate an automotive repair business in the B-1 district. The business has already begun
operating without proper permits. This particular location abuts a residential zone, so
additional concerns are worth noting.
The applicant requests to operate a "automotive repair and storage" business. The
applicant has not provided a good description of how they intend to operate the business,
further the building they intend to operate in is part of a large site that also includes the
operation of construction-excavating business. Existing storage of tires, construction
materials and equipment on the site may harbor rodents and insect pests and is quite
unsightly when viewed from the residential areas to the north and west.
The City Code, section 154.060, D & E require landscape buffering and screening in
conjunction with a commercial use that adjoins a residential district. While the existing
construction business may predate these requirements, the city is within its power to
consider these measures as part of a conditional use permit for a new or changed use.
Thus, this application may provide an opportunity to correct some issues and conflicts
that exist in the current situation.
In considering the conditional use permit the Commission and Council may want to
consider any number of the following as well as others:
1) Clean up of the site to remove all tires, debris, equipment parts.
2) Remove the fence from the north property line and instead construct a screen and
buffer along the north property line in accordance with City Code Section
154.060 D.
3) Limits on the days and hours of operation.
4) Limits on the number of vehicles that can be stored on the site at anyone time.
5) Limits on the number of days that any vehicle may be stored on the site.
6) Prohibiting storage of tires and vehicle parts outside of the building.
7) Prohibiting storage of vehicles outside that are missing body parts.
8) Prohibiting storage of gas or other fuels on site and prohibiting any exterior
storage of containers of lubricants or other chemicals.

9) Issuing the permit to the landowner and the business operator so that both are
responsible for the continuing conformance with the permit.
10) Limits on the noise emitted at the property line to not exceed 70 decibels. And
requiring that the business conform to the noise regulations contained in City
Code Section 91.09 and other nuisance regulations contained in Chapter 91.
11) Vehicle drives, parking and storage areas shall be improved with a dust-free
asphalt or concrete surface.
I would suggest that P&Z hold its hearing and consider any written or oral comments
presented. Then, express your intentions by a motion directing staff to make fmdings, for
consideration at your next meeting, that are consistent with an approval or consistent with
denial, depending upon how you perceive this. Staff will then prepare an appropriate
finding and decision for consideration at your next meeting. This will cause a little delay~.
in the final decision, but will allow the City to make a good and informed decision. V

My name is Richard Williams and I live at 1736 Brian Way, my backyard backs up to the property of the
proposed building site and I have some concerns. First this is a very quiet neighborhood, are there going
to be normal business hours? (Ex. 7:00am-5:00pm.) I am concerned about dust control and also would
ask that no lighting be in the direction of homes. Please consider at least an 8-10' fence be constructed to
match my existing fence and that a line of 8-10' pine trees also be planted as a sound buffer. See Diagram

Memo to Planning & Zoning Commission
Re: Request for Variance to allow construction of a garage addition
I am aware of a proposal of Brian and Diane Clancy, 1882 Center Street, to construct a
garage addition. The as-built survey created at completion of the existing home and
garage suggests that the buildings are situated approximately 15 feet from the property
line on the side of the proposed garage. The City Code requires a setback of lOin this
particular zoning district. Thus there is clearly not enough room to add an additional stall
to the attached garage. It seems unlikely that the property could meet the required
findings that are necessary to justify a variance.
The best alternative would be for the property owner to request a permit for a detached
garage to provide the additional space. For guidance, accessory buildings are regulated
by City Code Section 154.022.

Per your request, I have attached information regarding the set-back requirements for the
R-2 Zoning District (which 1882 Center Street is zoned) and Variance requirements.
As discussed during our telephone conversation, it appears that the existing garage is
situated approximately 14.9 feet from the lot line and would not accommodate the structure
desired by the homeowner. As also discussed, it does not appear that they would be able
to obtain a variance due to the hardship requirement.
As suggested, you may appear before the Planning and Zoning commission to request
modifying the existing ordinance allowing less than the currently required 10 foot side
setback or discuss the option of constructing an accessory structure on the opposite side
of the home with the homeowner.
The Planning and Zoning Commission meets the first Tuesday of the month in Council
Chambers of City Hall located at 1880 Main Street at 6:30 p.m. or shortly thereafter.
The Planning and Zoning Commission Chairperson's name is Brian Hanson and he can be
contacted at 651-407-8398 if you desire to speak with him prior to the meeting. The
Planning and Zoning Commission is advisory to Council and only make recommendations to
Council.

Chair Hanson called the meeting to order at 6:30 p.m.

1. Proposed Ordinance #. Second Series Amending City Code. Chapter 154.170
Parking Requir~ments
City Administrator Larson stated that the proposed ordinance would amend the code for
parking requirements for various uses permitted within the City. He explained that the
required green space could be converted to parking spaces if required.
Commissioner Love questioned if a specific timeframe was set for the CUP.
City Administrator Larson replied that it is unlikely a CUP would be pulled unless
specified requirements were not met. He explained that the property owner would be
notified and given a chance to correct any problems.

Vice Chair Klennert-Hunt referred to Item D and inquired as to whether this statement
agreed with the parking requirement.
City Administrator Larson replied that the more restrictive ordinance would be enforced.
He commented that Item D is intended for shared parking or to purchase land for
additional parking.
Vice Chair Klennert-Hunt questioned whether the City Council should be making the
decisions relative to Item G instead of the Planning and Zoning Commission.
City Administrator Larson replied that the process starts with the Planning and Zoning
Commission making and forwarding a recommendation to the City Council. He stated
that the City Council would make the final decision.
Commissioner Love questioned if the elements pointed out in Item I would present
opportunities to look at the CUP.
City Administrator Larson replied that it could if the conditions were not abided by.
Commissioner Pangell inquired whether existing businesses would fall under this
ordinance.
City Administrator Larson replied that it is difficult to impose new regulations onto
existing businesses.
Councilmember Broussard questioned Commissioner Pangell if he meant that if the
owner were not keeping the property up, would there be a reason to review the CUP.
Commissioner Pangell replied that was correct.

IV. OLD BUSINESS
1. Final Plat - 7381 Old Mill Road (Hanzal Addition/Clearwater Creek Estates)
Mr. Jeff Banzai, 7381 Old Mill Road, presented the final plat and pointed out the name
was the only change. He explained that the name Clearwater Creek Estates imparted a
more conducive reflection of the City. He commented that this would be one of the last
developments on the creek.

Mr. Hanzal indicated that the City had some concern with the name as it might cause
confusion with other similarly named developments. He presented examples of other
similarly named developments to support the request for s name change.
Commissioner Pangell inquired as to the significance of the name.
city Administrator Larson replied that the confusion could be with mixing up names.
Councilmember Broussard pointed out the location of Clearwater Creek and other
developments to emphasize the similarity in the names of several developments.
Discussion ensued.

V. NEW BUSINESS
1. Reschedule July 3. 2007 Meeting
Consensus reached by the Planning Commission was not to change the meeting date.
2. Conditional Use Permit Request -7137 - 20th Avenue (Jason. Bobby & Steve's)
Auto Repair and Storage.
City Administrator Larson reported that the previous CUP was voided due to that
business no longer is in operation. He explained that Jason, Bobby & Steve's Auto
Repair and Storage would like to lease the building. He stated that a public hearing is
required for this action.
City Administrator Larson displayed an aerial photo of the location.
Vice Chair Klennert-Hunt commented that she visited the area and described the
condition of the property as messy.
City Administrator Larson stated that this might be an opportunity to deal with the
condition of the properties.
Commissioner Fehrenbacher questioned whether any feedback was received from the
homes in the area.
City Administrator Larson replied that he had not received any feedback.

Discussion ensued.
City Administrator Larson recommended scheduling a public hearing. He stated that he
would draft a list of conditions to be met.

vm. COMPREHENSIVE PLAN AMENDMENT REVIEW
Present from the Planning and Zoning Commission were Brian Hanson, Jennifer Klennert-Hunt,
Ben Fehrenbacher, Mark Pangell, D. Love, and Tom Wood. Present from Council were Mayor
Mary Capra, Council members Michelle Lakso, Linda Broussard-Vickers, Tom Lee and Jeff
Paar.
Planners Tina Goodroad and Brandon Slotterback of DSUlBonestroo, Rosene, Anderlik and
Associates were present to review the Comprehensive Plan-background report.
Tina Goodroad discussed the background report that has been prepared as part of the
comprehensive planning process. The background report updated statistics, estimates, identified
natural resources, parks, and other issues related to the city.

Brandon Slotterback reviewed a map of existing land uses and received feedback on potential
errors in the map.
After discussion, the following issues were identified for further study and analysis:
NATURAL RESOURCES:
. Peltier Lake - aquatic value
. Trail connection to SCfhool from the east
. Pedestrian access - over/under (14)
.. Creek rerouting (14)
· Affect on land use
. Plan to connect all existing sidewalks
. Pedestrian connects to downtown - interconnects the community
. Remnant parcels from reconnecting of 14 to the city
· Those of economic value - 1st right of refusal - park opportunity
TRANSPORTATION:
. Signals at 21st Avenue
. Intersection near gas station
. Discussion with Anoka County Park and Ride lots
· Consolidate with existing church lot
. Identify other transit opportunities - downtown, others
. Identify appropriate future roadways
· Concern over how some are identified
· South collector
. North preserved wetlands
. Joint opportunities with Lino Lakes
LAND USE:
. Population up over to 5,000 - growth to meet this
