Present were Mayor Mary Capra, Council members Linda Broussard Vickers, Michelle Lakso, and Tom Lee. Absent was Council member Jeff Paar. Also present were City Attorney Kurt Glaser, Engineer Mark Statz and Administrator Dallas Larson. The purpose of the meeting was to consider the 2009 Street Improvement project assessments. Mayor Capra asked whether there were any property owners that had provided additional information to be considered relating to their special assessments. City Attorney Glaser has had extensive conversations with property owners over the last several days and none of the owners have had an appraisal done, nor provided any new information that would cast doubt on the amount of the special assessment adopted by the City. A motion was made by Council member Lee that the Council go into closed session to meet with the attorney to consider possible litigation relating to special assessment appeals. The motion was seconded by Council member Fehrenbacher, all present voted in favor. The motion passed (4-0). The meeting was closed at 6:23 City Attorney Glaser reviewed the discussions that he has had with property owners regarding special assessments. The meeting was recessed at 6:55 p.m. in order to begin the regular council meeting. The meeting was reconvened at 8:00 p.m. The council discussed possible outcomes of the special assessment appeals and their potential impacts on the street project. The meeting was reopened at 8:46. Mayor Capra reported that the only business considered during the closed session was the discussion with the City Attorney regarding possible litigation that may result from the adoption of special assessments for the 2009 Street Improvement Project A motion was made by Council member Broussard Vickers that the meeting be adjourned. Motion seconded by Council member Fehrenbacher, all present voted in favor. Motion passed (4-0). The meeting was adjourned at 8:46 p.m. Kurt Glaser, Acting Secretary 1 CITY OF CENTERVILLE CITY COUNCIL MEETINGIPUBLlC HEARING January 21, 2009 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held a public hearing on January 21,2009, at 6:30 p.m., at St. Genevieve Parish Community Center, 6995 Centerville Road. The purpose of the hearing was to hear objections to and to consider adopting an assessment roll for the 2009 Street Improvement Project. CALL TO ORDER Mayor Capra called the public hearing to order at 6:30 p.m. II. PUBLIC HEARING Presentation of 2009 Street Proiect Mayor Capra explained the purpose of the meeting tonight is to hear testimony on the special assessment for the 2009 Street Improvement Project. She stated if residents have documentation they would like to submit, that documentation including written objections, they will be accepted into the official record until the close of the meeting. City Administrator Larson indicated notices were mailed to all property owners on January 5, 2009, and the notice was published in the official paper on January 6, 2009, as required by Minnesota statutes Chapter 429. He added individual notices included the proposed assessment. City Attorney Glaser reviewed the assessment process and explained what is required to object to special assessments and further to appeal to district court if unsatisfied with the decision of the Council. He also noted that a handout with the process described was on the table at the entrance to the room. 2 Centerville City CounciJ/Public Hearing Meeting Minutes January 21, 2009 City Engineer Statz reviewed the project and the various changes that were made to respond to comments from the public. City Engineer Statz that the project has four improvement types, identified as Types B, C, D, or E. All are reconstruction of streets in varying degrees, although work will be done that includes spot sanitary sewer repairs, water main bolt replacement, storm sewer repair and watershed requirements, including a number of rain gardens. The bid on the work also included water services from the right-of-way directionally drilled into to homes, but that work would be completely at the option of homeowners that wish to take advantage of the bid. City Engineer Statz presented an overview of the project schedule and stated if the project moves forward, construction would begin in spring of 2009. City Administrator Larson stated that the mailed notices indicated the assessment amount for each property and also reviewed how the assessments were calculated. He explained that the notices indicate that assessments would be paid over 10 years at 5.5% except that larger assessments would be spread over 15 years. Mayor Capra stated each resident will be given two to three minutes to speak and stated if a resident has a written objection, that document should be submitted at this time and that the end of the hearing would be the final opportunity to submit objections. Gary Oslund. 1594 Peltier Lake Drive Mr. Oslund stated that he didn't believe that his property is benefited to the extent of the proposed assessment. Asked Council to consider the odd shape of his lot as it considers his special assessment. Tom Dario. 1573 Peltier Lake Drive Mr. Doesn't believe that his property is benefited by the improvement. Liz We2l1er. 1525 Peltier Lake Drive Ms. Wegner questioned if the construction of their part of the project was included in the bid as it was actually built with County Road 14. Pat Fish. 1537 Peltier Lake Drive Ms. Fish presented a written objection. Also questioned if there will be a requirement to connect to watermain. Mayor Capra. The City policy to require connection to water has been deferred to at least 2020. The project has water service line installation as an option for property owners that wish to connect. Irene Seashore. 1689 Peltier Lake Drive. Has submitted a written objection. No additional comments. Page 2 of5 3 Centerville City Council/Public Hearing Meeting Minutes January 21, 2009 Derick Gavin. 1540 Peltier Lake Drive Mr. Gavin pointed out that he has an odd shaped lot which should be considered by the council in making their decision on his assessment. Dean Luxenbuflz. 1697 Peltier Lake Drive Mr. Luxenburg believes his proposed assessment is 100 high. He was assigned 135 feet, but doesn't have that much road frontage. Would be willing to pay for 98 feet, which is about average for the lots nearby. Also objects to the proposal to remove the turn-around at the end of the street. Gary Dowd. 1529 Peltier Lake Drive Mr. Dowd filed a written objection. Daniel Skoo!;l. 1613 Peltier Lake Drive Mr. Skoog stated that his proposed assessment is too high and that the senior citizen deferment is not helpful since it requires interest to accrue during the deferment period. Bill Svetin. 1687 Peltier Lake Drive Mr. Svetin feels the assessment is too high, that it should be around $4,000. Wayne LeBlanc. 1677 Peltier Lake Drive Filed written objection, no additional comments. Geor~e Burr. 1693 Peltier Lake Drive Asked about connection fees versus assessments and how that would work. Mayor Capra explained that the connection fee will be collected when the homeowner decides to connect to watermain. The WAC fee is for the trunk mains, water tower and wells. Pam Kennedv. 1983 73rd Street Ms. Kennedy stated that she believed that the road failed prematurely and that the council should take that into consideration in making the assessment. Scott Kleman. 1968 73 rd Street Mr. Kleman stated that he talked to the Anoka County Assessor who told him that the improvement will not increase the value on their records. Sherry Cerra. 1975 73rd Street Ms. Cerra asked the council to consider the perceived premature failure of 73rd Street as they make a decision on the special assessments. Russell Koski. 7280 Twin Lakes Avenue Mr. Koski stated that he feels 73rd Street failed prematurely and that roads in Centerville generally are not lasting. Asked of traffic during construction will be kept off Mill Road, so it doesn't fail prematurely. Laura Powers. 7173 Brian Drive Ms. Powers stated that she doesn't believe that her property will increase in value due to the street improvement. Joe Georgi. 1926 nod Street Mr. Georgi stated that he doesn't believe that his property will increase in value due the improvement. He doesn't think that interest should accrue until the project is complete. City Administrator Larson stated that the proposed resolution that has been presented to Council would allow the special assessments to be paid until October 1,2009, without interest. Julie Reiman. 7174 Brian Drive Ms. Reiman stated that she doesn't believe her property will increase in value by the amount of the proposed assessment. Terry Elkin. 1701 Peltier Lake Drve Mr. Elkin stated that his street would be sufficient with an overlay and doesn't need reconstruction. Mayor Capra announced that the meeting would be recessed in order to allow anyone who wished to do so to prepare and file a written objection. Meeting recessed at *:)05 p.m. Meeting Reconvened at 8:20 p.m. After evervone who wished to do so had been dven an opportunity to speak with regard to the proposed assessment. a motion was made by Council member Paar that the hearin!!: be closed. City Attorney Glaser made some closing comments to the public and to the council. He indicated that he will be calling those who objected to review the process for appeals and do discuss their issues. He indicated that anyone who wished to present additional information that hasn't been received or considered would be scheduled for a time with the City Council on Wednesday, January 28, 2009, to afford that opportunity. He indicated that information in the form of appraisals would be especially useful for the City to consider. Search Tips QuicMmrt foLPro~~ administratQ.!'$, ;> L~j~mmentslsct'lQQ1~ Local Board of Appeal and Equalization Training Legislation enacted in the 2003 session requires that, at each meeting of a Local Board of Appeal and Equalization (beginning with the 2006 local boards), there be at least one voting member who has, within the last four years, attended an appeals and equalization course developed or approved by the Commissioner of Revenue. The appeals and equalization course details the responsibilities, procedures and requirements of Local Boards of Appeal and Equalization. The legislation also requires the Commissioner of Revenue to develop a handbook to be reviewed during the course. The contents of the handbook include: the role of the local board in the assessment process; the legal and policy reasons for fair and impartial appeal and equalization hearings; local board meeting procedures that foster fair and impartial assessment reviews and other best practices recommendations; quorum requirements for local boards; and explanations of alternate methods of appeal. More than one board member encouraged to attend While the law only requires that one voting board member attend the appeals and equalization course within the last four years, the Department of Revenue recommends that additional board members attend the training. It is important to note that the member who attended the training session must be present at the Local Board of Appeal and Equalization meeting. If that member fails to attend the meeting due to illness or other circumstances, the board is deemed to have transferred its Local Board of Appeal and Equalization duties to the county, Having more than one board member attend the course can eliminate situations in which unforeseen circumstances result in a failure to comply with the training requirement. Must be voting member to satisfy requirements Please note that a voting member of the board must attend the appeals and equalization course to meet the training requirements. Generally, the town board of a town or the council or other governing body of a city is the Local Board of Appeal and Equalization. While city and township clerks are encouraged to attend the training, the clerk's attendance will not satisfy the training requirements if the clerk is not a voting member of the board. For townships, this means that only the township supervisors are voting members: township clerks are not voting members of the board. For cities, some clerks are voting members of the board (in standard pian cities, the clerk is a voting member). REVENUE MEMO Date: February 3, 2009 To: All County Assessors From: MICHAELSTALBERGER Information and Education Section Subject: Local Board of Appeal and Equalization CATCH-UP Training Sessions The Department of Revenue has scheduled four catch-up local board training sessions before the 2009 Local Board of Appeal and Equalization (LBAE). These sessions will accommodate jurisdictions who were in compliance with the training requirements when the LBAE meetings were scheduled (i.e. they had a trained member on December I, 2008), but lost their trained member due to city/township eJections, resignations or other circumstances. The training is open to any local board members, but these "catch-up" sessions will only benefit those boards that were already in compliance with the training requirement and would otherwise lose their right to hold their LBAE because they would not have a trained member present at the 2009 LBAE meeting. It will not enable those boards that were not already in compliance to regain their boards for 2009-1lpen book meetings win need to be scheduled in these jurisdictions. Please notuy your board members of the training sessions. They must register to ensure space is available in the session they wish to attend. To register, please have them contact the person listed below at the location they will be attending. You will note these are the first trainings provided under new policies put into place regarding board member certification and requiring pre-registration. More information for assessors will follow shortly. Please review this additional information as soon as it is released so you are familiar with the new policy and guidelines and can answer any questions your LBAEs may have. Before making a recommendation to City Council the Parks & Recreation Committee wanted to know exactly what 'the same service provided by Public Works Staffin regards to grooming the fields prior to games' involves. Ms. Stephan requested information from Public Works. Per Mr. Tedd Petenon, Public Works: As a staff we were directed to groom the ball fields Monday through Thursday. Grooming the ball fields took about an hour a day. Just a note, Centennial Little League purchased a new groomer for the City in the spring of2008. Motion was made by Vu:e-Chairpel'Son Amundsen, seconded by Committee Member Branch to recommend City Council approve the request from Centennial Lakes Little League to use the three baseball and softballfrelds andfaciJities located at Laurie LaMotte Memorilll Park for the summer months of 2009 beginning April 1 through August 15, 2008, Monday through Friday from 4:00 p.m. until dark with the same service provided by Public Works Staff in regards to grooming the fields Monday through Thul'Sday.
