Present were Mayor L'Allier, Councilmen Ayers, Baumann and Wilharber. Results of November 6, 1984 General Election were canvassed: CITY ELECTION I Leon L'Allier received 352 votes for office of Mayor. He was declared the winner. Term to be two years expiring on December 31, 1986. Michael Ayers received 342 votes for the office of councilman. Richard Robischon received 72 votes for the office of councilman. Michael Ayers and Richard Robischon were declared the winners. Term of office is four years, expiring on December 31, 1988. SPECIAL ELECTION: On the Questionl "Shall the Ci ty of Centerville issue special licenses to on-sale liquor establishments to permit the serving of intoxicating liquor between the hours of 10100 AM and 12100 Midnight on Sunday in conjunction with the serving of food provided that the licensee establishment is in conformity with the Minnesota Clean Indoor Air Act? YES VOTES - 237 NO VOTES - 187 5 blank ballots The question passed. Mayor L'Allier called the meeting to order at 6'50 PM. Present: Ayers, Baumann, Zimny and Wilharber. It was decided to wait until December to designate the use of the Revenue Sharing funds for Entitlement Period 16, when the exact amount of money to be received will be known. Motion by Baumann, second by Ayers to adjourn meeting, motion carried. Meeting adjourned at 7:00 PM. Pursuant to due call and notice thereof, the City Council of Centerville held their regular meeting on Wednesday, October 24, 1984 in City Hall. Mayor L'Allier called the meeting to order at 7.00 PM. Present: Ayers, Baumann, Wilharber and Zimny. Motion by Ayers, second by Baumann to approve the minutes of the October 10, 1984 meeting, motion carried. PETITIONS AND COMPLAINTS. None OLD BUSINESS, Motion by Baumann, second by Ayers to send two people from the Planning & Zoning Committee to the Annual Planning Institute for Planning Commissioners and Elected Officials, motion carried. Clerk will notify Planning & Zoning Committee members. Motion by Wilharber, second by Zimny to send letter to residents on Mound Trail to see if they are interested in having two street lights put up, motion carried. Summer Recreation Committee member tabled until November 14 meeting. Update by Mayor, Councilmen and Des Englund on Fire Commission meeting of October 22, 1984. Motion by Ayers, second by Baumann to have Des Englund work with the Clerk on a letter for Leons signature to the City of Lino Lakes, copies to the City of Circle Pines & the Fire Commission members, outlining the understandings the City of Centerville has of the October 22, 1984 meeting and requesting a response of their intent by our next council meeting on November 14, 1984, motion carried. Mike Ayers will not be able to make the November 20, 1984 Citizens 509 Task Force of the Rice Creek Water Shed meetng. Council felt a single representative would be ok for that meeting. Peter Buesseler updated the Co~il on the Technical Advisory Committee of the Rice Creek Water Shed. To date they have received mostly technical information. They will be receiving their policies and objectives next. Hunting will be put on the November 14 agenda in order to allow more people to be involved. Clerk will request Hal Leibel and Maureen Aslesen attend the meeting to discuss the proposal they submitted. NEW BUSINESS: Motion by Baumann, second by Wilharber to reduce Royal Meadows letter of credit from $315,000.00 to $37,500.00 per the city engineer Larry Winner's recommendation, motion carried. Motion by Ayers, second by Baumann to adjust the load limits of Peltier Lake Drive and Mill Road to 5 tons per axle until spring when the 3 ton load limits go into effect, motion carried. Clerk will check into signs for 5ton load limits. Page two - City Council Meeting Minutes October 24, 1984 Motion by Baumann, second by Wilharber to approve the grading permit for Peltier Lake Hills Addition #2 subject to clerks receipt of a letter of credit of $6,000.00; subject to the Rice Creek Water Shed's permit approval; and subject to the agreement of the contractor to restore the roads to their present condition if any further damage is done by their trucks during construction, motion carried. Mention by Wilharber of error in Quad Press on the number of vacant coundl seats coming up in the City Election. Clerk will call the police on cars parking in the City lot overnight, and also check into an appropriate sign to be posted. Clerk will check with city attorney on a waiver for firemen wi th beards, and whether or not that would cover the ~i tjr' s liabili ty. Clerk will write letter to City of Lino Lakes Mayor Benson, confirming our need to see acting pOlice chief at the first council meeting of each month, per a previous conversation with the Mayor when he verbally agreed to honor such request. Motion by Wilharber, second by Zimny to approve the minutes of the September 26 meeting, motion carried. PETITIONS AND COMPLAINTS, A "Pending Action" file will be included on the agenda for followup on City actions. Clerk will write a letter to Mr. Ruud at the County Highway Dept. and copy Margaret Langfeld, County Commissioner, to get the pine trees trimmed on Brian and Main Streets. OLD BUSINESS: Motion by Zimny, second by Baumann to authorize the Fire Dept. to buy needed equipment, given the Fire Chief times the purchases so payment most closely matches the City's ability to pay, Wilharber opposed, motion carried. Mary Ayde, Lake Sanitation, will work with Mike Ayers in coordinating a pick up of yard waste for composting on Saturday, October 27. Motion by Ayers, second by Wilharber to vacate that portion of Westview Street North of Lot 6, Block 3, Centerville and North of Clearwater Road (as vacated), motion carried. Clerk will contact Hal Leible and Maureen Aslesen to form a citizen's comm~ttee on Hunting and make recommendations they feel necessary to the council regarding that matter. Clerk will send letter to residents on Mound Trail regarding the installation of two street lights. Motion by Ayers, second by Baumann to appoint Mavis Solheid as Deputy Clerk, motion carried. Harvey will contact Dan Tourville to get Mill Road ~~RPltier Lake Drive graded again. NEW BUSINESS, Dr. Richard Weber addressed the council on the summer recreation program. He needs a representative from Centerville for the Centennial Community Education Committee. Motion by Baumann, second by Wilharber to approve Resolution #6 appointing election judges for the General Election. Clerk will request the P & Z address old Ordinance #10 - keeping of non-domestic animals, and make a recommendation to council. It is preferred that recommendation be made as a separate ordinance. Clerk will check into class held by the Government Training Service for P & Z people. Motion by Baumann, second by Wilharber to pay current claims, motion carried. PETITIONS AND COMPLAINTS: Resident complaint received on trash left from the softball tournaments at Twin Lakes. Clerk will deliver a letter to Twin Lakes requesting this be corrected at their next tournament. , Barb Scribner presented the Council with a petition requesting road repairs and maintenance of Centerville streets - specifically Mill Road and Peltier Lake Drive. Reporter present apologized and will be more careful in the future. OLD BUSINESS: Jeff Nottum presented his request for a variance. Motion by Zimny, second by Ayers to grant an 8" building variance to Mr. Nottum, motion carried. Brad Gulsvig reported back to the council on the progress of solving the drainage problems on Mill Road. Residents will solve the problem on their own without further assistance from the City. NEW BUSINESS. Motion by Ayers, second by Wilharber to approve the wording of the general referendum as follows: "The City of Centerville has issued special licenses to on-sale liquor establishments for the service of alcoholic beverages on Sunday between the hours of 12:00 Noon and 12:00 Midnight. Shall the City of Centerville issue special licenses to on-sale liquor establishments to permit the serving of intoxicating liquor between the hours of 10:00 A.M. and 12:00 Midnight on Sunday in conjunction with the serving of food provided that the licensee establishment is in conformity with the Minnesota Clean Indoor Air Act?: motion carried. page two - City Concil Mee ting Minu te s September 26, 1984 Motion by Ayers, second by Wilharber to hold the next budget meeting on September 27, 1984 at 7:)0 P.M.in City Hall, and to hold the special meeting to certify the budget on Tuesday, October 2, 1984 at 7100 P.M. in City Hall, motion carried. Clerk will contact the city attorney to send a letter to Mr. Rehbein regarding further dumping of demolition materials, and his need to comply with State and County requirements. Des Englund wil provide a priority list of expendituresto the Council at their next meeting. Motion by Ayers, second by Baumann to pay current claims, motion carried. Police Chief Myhre and Officer Mike Jensen answered questions the council had on recent burglaries and general police protection in the area. A possible crime watch program will be announced in the paper. If anyone is interested Tom Wilharber will work with Officer Mike Jensen to set it up. . Harvey will check with Dan Tourville to get the weeds cut. OLD BUSINESS: Engineer discussed proposed swayl between 1355 and 1369 Mound Trail. Also discussed other options and their costs. Clerk will send letter to property owners involved to come to an informational meeting on drainage solutions and assessments for work done. Engineer will also check on who is actually contributing to drainage problem and affected by solution and assessments. Engineer discussed possible solutions to drainage problems on Mill Road. Engineer will measure elevations of back of property owners affected on Mill Road and present solution and costs at next meeting. Clerk will send letter to property owners involved to come to an informational meeting on drainage solutions and assessments for work done. Engineer will check on owners actually contributing to the drainage problem and affected by the solution and assessments. Mr. Thill, 1385 Mound Trail, questioned the possibility of installing street lights on Mound Trail. Clerk will check into cost.s. Harvey will have Dan Tourville grade Peltier Lake Drive and Mill Road so calcium chloride can be spread for the dust problem. Harvey will spread the calcium chloride. Motion by Ayers, second by Baumann to send letter to 1540 Peltier Lake Drive addressing their potential rodent problem, enclosing a copy of the Anoka County Health Dept. letter, and requesting they rectify the situation, motion carried. NEW BUSINESS. Jerry Sundberg briefed the council on activities of the Joint Powers Commission. Council requested monthly updates until the first of the year. Motion by Ayers, second by Zimny to approve Barry Matson as chairperson of the Joint Powers Commission, motion carried. Motion by Baumann, second by Zimny to allow the Joint Powers Commission to meet at the Centerville City Hall the third Thursday of each month at 6.30 PM, motion carried. Item #2 concerned drainage problem between 1343 and 1355 Mound Trail. Engineer recommended swale be graded on lot line between 1355 and 1369 Mound Trail. Engineer and clerk are going to review material on LeRoux Addition before any action is taken. Item #3 concerned water collection by and between 7246 and 7254 Mill Road. Engineer stated two solutions but is going to check with adjoining property owner about putting in swale going North across back of properties and give the council a cost estimate on same. Raymoume Houle appeared before council stating plans the Lions Club have for improvements in the city park. Informed council of Lions Steak Fry to be held on Sunday, July 17, between 12:30 and 5130 in Kelly's Park. Mayor received complaint on drainage problem at 7254 Mill Road. Clerk will have engineer check it out. Complaint received on rat problem at 1540 Peltier Lake Drive, Zimny confirmed problem. Clerk will contact Anoka County Health Dept. and Building Inspector if need be. Complaint received on mess at 1567 Peltier Lake Drive. PETITIONS AND COMPLAINTS: Clerk had received a complaint about drinkin~ in the city park during softball games; complaint had been rece1ved by Mayor on filling of ponding area on the Rehbein property and Gunner Pettersen had looked into problem and Ayers will also be checking into it; resident on Mill Road had contacted building inspector about grading on her property which had been done and is causing a water problem; Building inspector had some questions on our Ordinance #4 and whether or not he should be receiving copies of development contracts between city and developer so he is aware of construc- tion going on in the city; washout problem on Brian Drive has not been taken care of and clerk will check with Des Englund who was looking into solution for problem. OLD BUSINESS: On evening of June 12, 1984, Tom Wilharber and Mike Ayers had met with Margaret Langfeld, Paul Ruud and Dave Torkildson on the problems the city is having concerning the fishing by the Pavilion. The following items were discussedl (a) garbage proBlem - Anoka County will stop and pick up the cans once a week from the area between the lakes. They were informed that our pickup date was on Friday and they will attempt to pick up at another time during the week. (b) parking lot on west side of Peltier Lake across from Mound Trail: With the council's agreement, the county will develop a parking lot as described above for between 12-15 cars as soon as the weather clears. A trail will also be developed between the problem area, the proposed parking lot and the larger parking lot further up the Peltier Lake area. A satellite will be placed by the county at the smaller parking lot. Council should also consider asking for one at the larger parking lot. (c) Speed limit signs have been installed in three additional areas along Main Street on both sides of the roadway and a larger sign has been added just north of Lakeside Auto & Paint. (d) Additional fill will be brought into the area on the North side of Main Street on the Peltier Lake side of the road, a power pole across from Twin Lakes will be moved back away from the road more by NSP within the next few days. After the fill is put in a fence (guardrail type with cable) and one entrance will be implaced. Where the opening is, a pedestrian crosswalk will be painted and signs installed. (e) Concerning the drainage problem on the south side of Main Street just next to the ball diamonds, the county will check for a culvert and if not, will put a colvert under the road to drain that area. (f) Signs directing people to the entrance to the Anoka County Preserve are being made at the sign shop and will be installed shortly. page two - City Council meeting minutes - June 1), 1984 (g) Hal Leibel has been authorized as a Park Ranger and has a key for the entrance to the park. This should eliminate or assist in eliminating some of the problems concerned with the gate. (h) Protection, No real answers were returned to us on protection for the park. After camping starts (maybe fall of this year) a person with radio and phone will be in the park on Friday, Saturday and Sunday nights. A park ranger unit will be available to assist and these people can make citizen arrests. This matter should be addressed further. Rich Granger and Jim Husnick appeared before council with preliminary sketch of Peltier Lake Hills #2 which the P & Z had looked at on the 5th of June. Mr. Granger and Husnick asked the council if they felt this addition was feasible. No real concerns voiced by council and Mr. Granger was to check with clerk on holding public hearing on development at next P & Z meeting. Fire Chief has advised council that the Bean Fire Truck is out of service and the city has requested the services of the Ford fire truck from Circle Pines if the need arises. Motion by Ayers, second by Baumann to enter into lease agrement with the City of Circle Pines for use of their 1956 Ford fire pumper while the Bean fire truck is out of service, motion carried. Clerk will advise fire chief of first task force meeting between Circle Pines, Lino Lakes and Centerville on Wednesday, June 27th, at 61)0 PM in the Lino Lakes City Hall. Clerk will send a letter to Mrs. Langfeld recapping our discussion, thanking her for her attendance, and advising her of the need for restroom facilities for the fishermen, and the drainage problem at the Twin Lakes Pavilion. Council discussed request from Northwestern Bell to install buried cable on Heritage Street and Progress Road. Motion by Zimny, second by Ayers to approve the application for NW Bell to bury cable on right of way of Heritage Street and Progress Road with stipulation they push the cable under all hard surface driveways and streets, motion carried. The Park and Recreation Committee will be purchasing a new snow blower. Harvey will work with the rink attendants to be sure they are operating it correctly. A rink attendant must be 18 years or older to operate the snow blower. CI~k will request satellites be delivered December 21st. Three additional keys to the Hall will be made for the rink attendants. Rink attendants will be paid every two weeks. NEW BUSINESS: Presentation by Patricia Weber, representative from Rudy Boschwich's office. Resignation letters from Planming and Zoning Chairman Walter Prachar, and Planning and Zoning member Robert LaMotte were read by the clerk. Thank you letters will be sent to them -,' for their many years of service. Discussion on Sunrise Plastics, Inc. It was decided a special use permit is needed by the company to operate. Some suggestions to the Planning and Zoning Committee for specific requirements to be stated in the special use permit were; adequate screening, move grinder inside, and Mr. Brokke's letter. Motion by Ayers, second by Zimny to send a letter to Sunrise Plastics, Inc. stating it's our understanding they will be at the January Planning and Zoning meeting, and that continued operation is contingent upon their application and receipt of a special use permit, motion carried. Clerk will write a letter to Mr. Barrott, 7105 Main Street, requesting he remove the concrete structure he has built on city property with in two weeks. Harvey will buy new ceiling tiles. Clerk will write a letter to 1540 Peltier Lake Drive to clean up their yard by 6-1-85. Clerk will write a letter to Dale Larson verifying he is interested in being Civil Defense Director for Centerville. Clerk will notify Lake Sanitation to pass the landfill abatement tax on to the consumer. Clerk will send letter to Royal Meadows allowing street light installation in the spring of 1985 as long as it doesn't extend their development contract. Discussion held on amending the Centerville Relief Association by-laws. Art Mohler advised council on Relief Association meeting held on January 25 in reference to amending Article 6, Section 3 - AMOUNT OF PENSION. The relief association is suggesting the figure for retirement benefits be increased from $50. to $90 for each year of approved service. Motion by Baumann, second by Wilharber to amend Article 6, Section 3 to read as follows: "The amount paid as a retirement benefit shall be ninety dollars ($90) for each year of approved service. The total amount of the retirement pension shall be based on the rate in effect at the time of retirement from the Centerville Fire Department. NOW THEREFORE BE IT RESOLVED, thatl 1. The Centerville City Council hereby supports and wholeheartedly endorses the concept and creation of a Fire District between the Cities of Centerville, Circle Pines and Lino Lakes. 2. The Centerville City Council understands that the proposed joint powers agreement is only a draft and the areas of voting powers, initial contribution and financial formulas must still be refined in order to make the District acceptable to all communities involved. Sump pump was installed in 1973 at which time it drained into a ditch along side the Eoad and flowed through a culvert under Mr. Haberman's driveway. When the City put in Mill Road, the ditch and the culvert were removed, thus altering the flow of his discharge water onto the City street. Motion be Wilharber, second by Ayers to further check into the discharge problem at 7288 Mill Road in the spring, re- commending re-establishing the ditch alond the property and culvert under the driveway, motion carried. - OLD BUSINESS: Presentation by Larry Winner, City Engineer, on the 509 Task Force. Motion by Ayers, second by Wilharber to forward the recommendations made by the City Engineer to the Rice Creek Watershed District , incorporating any comments by Peter Buesseler, our representative to the Rice Creek Watershed District Technical Advisory Committee, as the City's position, motion carried. Discussion on the letter from the Rice Creek Watershed District referencing the culvert in Clearwater Creek at Peltier Lake Drive. Three alternatives were considered: 1. 1. Obtaining easements along Clearwater Creek from property owners adversely affected by the elevated flood levels. 2. Add a second, smaller culvert. ). Replace existing culvert with a larger one.
