Mayor L'Allier called the meeting to order at 7:00 P.M. Present: Ayers, Robischon, Zimny, Wilharber. Motion by Robischon, second by Wilharber to accept the minutes of the December 11, 1985 meeting, motion carried unanimously. P~TITIONS AND COMPLAINTS: Councilman Zimny made mention of an article written by Bob Lattery of the Circulating Pines. He requested Mr. Lattery specify in his articles when a separate interview is being included in the report of the City Council meeting so the readers will not assume that person has attended the Council meeting. OLD BUSINl:!:SS I Appearance of Phil Little, DTRA, to answer any questions or concerns the Council had regarding the races to be held on Centerville Lake. Some concerns addressed were. emergencies - ambulance will be on site, parking problems - lots will be plowed on the lake, insurance coverage - both racers and spectators will be covered, sanitation - satellites will be on site, clean up - there will be a cleanup crew after races to comply with the DNR permit requirements. Appearance of Terry Mauer, Maier Stewart & Associates, Mr. Mauer thanked the Council for selecting MSA as City Engineers. He will work with the City Clerk on the transition. After transition, he will work on the L'Allier - Houle ditch cleanout. i- - Motia by Ayers, second by Robischon to approve the 1986 Centennial Fire District Budget of $134,423 a 10%~1ncrease over the 1985 budget, motion carried unanimously. Discussion of the Centennial Fire District - Equipment Appraisal. Motion by Ayers to approve equipment appraisal - died for lack of a second. Motion by Zimny to have Des Englund prepare a statement showing the original cost of the equipment effective 1-1-85 in order for the City to calculate 60% and 70% figures - motion withdrawn. Motion by Zimny, second by Robischon to table the approval of the equipment appraisal figure until January 8 meeting, Councilmen Wilharber, Zimny, Robischon & Mayor L'Allier - Aye, Councilman Ayers - Nay, motion carried. Clerk will call Circle Pines to verify the $134,750 figure and will obtain original appraisals from Des Englund & Jerry Sundberg. Councilman Zimny will be Centerville's City Council representative to the Centennial Fire District Planning Committee.~ The communi ty~s papers will publish the need for a Centennial Fire District - Audit Committee Member. Motion by Ayers, second by Zimny to approve Ordinance # 24-B relating to the keeping of Wild and Exotic Animals ~ I Page Two - City Council Meeting Minutes December 2), 1985 r-~"i I r ' I _ '_ ~ I in the City of Centerville, motion carried unanimously. Motion by Ayers, second by Zimny to approve Ordinance Summary #24-B relating to the keeping of Wild and ~xotic Animals in the City of Centerville for publication, motion carried unanimously. Clerk will get information on lease program for sirens and used siren costs and availability. Motion by Wilharber, second by Ayers to table the nuisance ordinance until the second meeting in January, motion carried unanimously. Clerk will get more information on using the Community Development Block Grant Funds for local business expansion: paybacks, qualifications, requirements to be met current and future, is there information to send to businesses, how to contact businesses. Clerk will contact Diane Harberts to get estimate cost of transportation program for seniors for 1986. Clerk will put employee vacations on next agenda. Clerk will contact Expert Construction on roof problems. NEW BUSINESS: Motion by Ayers, second by Robischon to approve the agreement between the City of Centerville and White Bear Animal Control from 1-1-86 to 12-)1-86, motion carried unanimously. Clerk will check wi~ police on overnight parking on Peltier Lake Drive and City Hall parking lot. Clerk will contact Father Zweber at St Genevieve's Church to request a note be put in the bulletin asking that there be no parking in the City Hall parking lot during church in the interest of public safety. Motion by Wilharber, second by Zimny to close City Hall Christmas Eve and New Yea~s Eve, motion carried unanimously. Clerk read resignation letter of Councilman Ayers. Motion by Wilharber, second by Robischon to accept resignation of Michael Ayers effective 1-)1-86, motion carried unanimOUSly. Entire' council thanked Councilman Ayers for his service to the City. Motion by Wilharber, second by Robischon to have the paper notify the public there is an opening on the Council, applications will be taken until Noon January 22nd for the appointment which will be made February 12, 1986, motion carried unanimously. In light of the fact Wager's will no longer cover the '" --! Motion by Ayers, second by Robischon to pay current claims excluding the Expert Construction bill, motion carried unanimously. A copy of the receipts and disbursements are attached to and made a part of these minutes. FINAL COMMENTS: Mayor L'Allier called attention to "Harvey's Workshop" and what an asset it is to the City. Harvey does a lot of work from his own garage and the City appreciates it. Clerk will include a copy of "Impact of Rate Setting" from the MWCC in the next packet. Mayor L'Allier called the meeting to order at 7:00 P.M. Present: Ayers, Zimny, Robischon, Wilharber. Motion by Ayers, second by Wilharber to accept the minutes of the November 25, 1985 Council meeting, motion carried unanimously. P~TITIONS AND COMPLAINTS: None OLD BUSINESS: Appearance of Ted Gonsior, Centerville's Cable Representative, and Michael Cusick, Cable Administrator for the North Central Suburban Cable Communication Commission, to update the Council on the progress of cable tv in the area and to request approval of amendment to the franchise agreement. Motion by Ayers, second by Wilharber to approve the ordinance summary amending Ordinance #41 regarding the franchise agreement between the City of Centerville and Group W Cable of the North Central Suburbs, Inc., motion carried unanimously. Motion by Ayers, second by Wilharber to approve Cable Communications Ordinance Amendment Agreement No.1, motion carried unanimously. Motion by Robischon, second by Ayers to approve Resolution #4 adopting Cable Communications Ordinance Amendment Agreement #1, motion carried unanimously. Copies of these agreements are on file in the City Clerks office. Final discussion was made on the three engineering firms to be considered for City ~ngineer. A roll call vote was taken of the councilmen as follows: Councilman Wilharber - Maier, Stewart and-Associates, Councilman Zimny - Maier, Stewart and Associates, Councilman Robischon - Maier, Stewart and Associates, Councilman Ayers - Toltz, King, Duvall and Anderson, Mayor L'Allier - Maier, Stewart and Associates. Maier,;;Stewart and Associates will be the Ci ty' of Centerville' s City Engineer effective January 1, 1986. Clerk will notify remaining firms. Clerk will also send a letter to Milner Carley & Associates thanking them for their years of service, and assisting the new firm in a smooth transition. ( ! Motion by Ayers, second by Zimny to table the Centennial Fire District Appraisal until the second meeting in December, motion carried unanimously. Clerk will request Des or Art be at the meeting. Centennial Fire District Planning Commission will be on the agenda for the second meeting in December. Clerk will find out additional information on Commission. Clerk will put 1540 Peltier Lake Drive - Yard Cleanup - ~ ( Page Two - City Council Meeting Minutes December 11, 1985 on pending action list until March 1986. Discussion on Community Development Block Grant. Clerk will further check into using grant money for handicapped access and sidewalks to the City Hall, Transit Advisory Committee money, and Housing Rehabilitation including money to publicize the program. Clerk will also verify time schedule with the County. Motion by Wilharber, second by Ayers to change the second meeting in December from the 25th to the 2Jrd, motion carried unanimously. There will be a Centennial Fire District Budget Meeting from 6:00 P.M. to 6:Jo P.M. at the Lino Lakes City Hall on Tuesday, December 17, 1985. NEW BUSIN~SS: Discussion on damage to mailboxes by snowplow. It was decided mailboxes bumped will be repaired by owners as it is on the City right of way. If a mailbox is flattened, the City will replace it. Clerk will also check with other communities to see what their procedure is. Clerk will request police check on the snowbird on Clear- water Drive. Motion by Wilharber, second by Zimny to send a letter to Department of Natural Resources, Anoka County Sheriff's Office, Lino Lakes Police Department; copying in DTRA, Rice Creek Watershed District, St. Paul Water Dept.; expressing the City of Centerville's concerns regarding the races on Centerville Lake, specifically including the lack of outdoor sanitation facilities, trash pickup, and oil or fuel spills, motion carried unanimously. Clerk will check with the new City Engineer on the Houle- L'Allier Ditch cleanout. Per contract must be done by 4-16-86. Motion by Ayers, second by Wilharber to deny payment to Truck Utilities, motion carried unanimously. Clerk will send a letter to Truck Utilities conveying our dissatis- faction with the present plow and reasons for denying payment including - Plow not long enough to extend past wheels, original shoes not strong enough, plow originally set too high to plow snow, welding done on truck broke before the truck made it back to town. Motia by Robischon, second by Wilharber to pay current claims excluding claim from Truck Utilities, motion carried unanimously. (hereinafter "Group W"l, a Minnesota Corporation, is constructing a cable communications system in the City pur- suant to City Ordinance No. 41 ; and , I WHEREAS, the North Central Suburban Cable Communicatio~s Commission has recommended certain amendments to the Ordi- I nance and the execution of "Amended Agreement No. 1" betwe~n the City and Group W~ WHEREAS, the Council finds that the adopting and I approval of the recommended amendments and Amendment Agree~ ment No. 1 are in the best interests of the City; : I NOW, THEREFORE, BE IT RESOLVED, by the City Council of: the City of Centerville: 1. Mayor L'Allier called the meeting to order at 7:00 P.M. Present: Ayers, Robischon, Zimny, Wilharber. Motion by Wilharber, second by Ayers to approve the minutes of the November 13, 198.5 meeting, motion carried unanimously. PETITIONS AND COMPLAIN~S: Jeff Speed will be moving a house onto the lot at 6923 Pleasant Lane. He will be responsible for any curbing that may be broken with this move, and he will have Harvey Cartier, Public Works Director, on site when he does the moving. Harvey Cartier will move the 3T per axle load limit sign to the other side o~ the street where it will be more visible. Appearance of Mr. Michael Moreland, 1.540 Peltier Lake Drive. Mr Moreland has filled two dumpsters with debris from his property and feels that should be sufficient cleanup. The council requested he also clean up two brush piles. Mr. Moreland conceded to do so. Clerk will request the Planning and Zoning Commission look at the need for a cat ordinance. qlerk will get an example from the City of Blaine. OLD BUSINESS: Motion by Wilharber, second by Zimny to have a final round of interviews with Maier-Stewart & Associates, Rieke-Carroll- Muller Associates Inc., and Toltz-King-Duvall-Anderson on December 9, 1985 at 7:00, 7:30 and 8:00 P.M. respectively, motion carried unanimously. The format will be 15 minutes presentation and 15 minutes question and answer period. Motion by Ayers, second by Robischon to table the acceptance of the Fire Department ~quipment & Vehicle appraisal until the December 11, 1985 Council meeting, allowing Circle Pines time to act on it, motion carried unanimously. Motion by Ayers, second by Robischon to send a letter to Circle Pines, Li.no Lakes and Commission Chairman LaTuff reflective of the 11-1.5-8.5 letter from Circle Pines and identifying the need for the three cities and commission to meet to resolve the Centennial Fire District budget for 1986, motion carried unanimously. Appearance of Margaret Langfeld, Anoka County Commissioner. Mrs. Langfeld updated the council on the future development of the Rice Creek Chain of Lakes Park. $750,000 has been allocated to development in 1986-1987. This development would consist of: building at main entrance, 2 restrooms at campground, showers at campground, power and water at 64 campsites, water well, central telephone, 60 picnic tables - ~rill~ -.waste receptacles, campground signs, grade & 011 eXlstlng class .5 roads in campground. The development of the park is presently 3 - 5 years behind schedule. Mrs. Langfeld will arrange to have Mr. LaTuff and Dean Campbell, Lino LakesChief of Police, at a council meeting to discuss security at the park. In other business, Mrs. Langfeld reported the culverts under Centerville Road were cleaned out as we requested. She will check to see what can be done to cut back the ditches along Centerville Road. Councilman Ayers requested Commissioner Langfelds support of Centerville's recycling program and their request for County grant money. Commissioner Langfeld concurred. Clerk will attend a Community Development Block Grant informational meeting on Tuesday, November 26. Any pertinent information will be brought back to the Council. Motion by Ayers, second by Wilharber to turn compost and separate branches at a cost not to exceed $75.00, motion carried unanimously. Mayor L'Allier called the meeting to order at 7:00 P.M. Present: Ayers, Robischon, Zimny, Wilharber. Motion by Ayers, second by Wilharber to accept the minutes of the October 2), 1985 meeting, motion carried unanimously. OLD BUSINESS: Discussion on drainage of pond south of Center Street and east of Centerville Road. Members of the audience expressed their opinion on the matter: Joe Berscheid, 1744 Center Street John Lundblad, 6904 Centerville Road Nancy Daschel, 1760 Center Street The City does not have an easement along the pond or ditch system to the pond. If the City were to be involved in cleaning out or lowering portions of the ditch system, easements would first need to be obtained. Any work the City would do would have to be assessed back to the benefitting property owners. The neighbors will get together to try to resolve the problem among themselves with the understanding no one person will go ahead and do anything without the agreement of the other neighbors. Appearance of Mary Ayde, Lake Sanitation. The Council has received many complaints on the late garbage pickup. Mrs. Ayde explained a combination of equipment breakdowns, new help and the addition of the fall leaves being hauled with the regular pickup have slowed them down. She assured the Council the late pickup would be resolved within a couple of weeks, and it wouldn't be necessary to change our pickup day to Saturday. There was a brief discussion with Mary Ayde on be~inning a pickup for recyclables in Centerville. Counci~man Ayers wiil pursue this matter with Norm Schiferl at Anoka County to see if we can get any funds to subsidize this effort. ~lerk will, set up interviews with Maier, Stewart & Associates at 7:00 P.M., Isrealson & Associates at 8:00 P.M., and Rieke Carroll Muller Associates Inc. at 9:00 P.M. on November 18, 1985. The format will be 15 - JO minutes presentation with time for questions following. Clerk will confirm use of the City Hall with the Boy Scouts. After this work has been completed, the council would like Ro-So to document their work to allow us to forward it to the Metropolitan Waste Control Commission. NEW BUSINESS: Appearance of Harvey Karth, President and Bob Chilson, Vice- President of the Lino Lakes Lion's Club. They requested permission to have pull tabs at the Twin Lakes Pavillion. The permit would be for the period of 1 year, 3 nights per week until 9:00 P.M., staffed by Lions Club members. Proceeds go to a sight and hearing charity at the University of Minnesota. This operation would be licensed by the state and monitored by the state. The Centerville Lion.s Club has no problem with the Lino Lakes Lion's Club doing this in Centerville. Motion by Ayers, second by Robischon to approve a permit for the Lino Lakes Lion's Club to have pull tabs at the Twin Lakes Pavillion for the period of 1 year from issuance of state license, on the condition it be operated by Lion's Club members only, motion carried unanimously. I ~~ / Page Three - City Council Meeting Minutes November 13, 1985 The City Council is totally supportive of the Planning and Zoning Commission in their evaluation of Ordinance #4. The Council would like to be kept abreast of their progress and be able to attend meetings when they are discussing some of the more controversial areas. Motion by Ayers, second by Robischon to pay Mr. Fagerstrom for his appraisal of the Fire Equipment for the Centennial Fire District, motion carried unanimously. Approval of the appraisal is tabled until the November 25, 1985 council meeting. Clerk will contact Anoka County Highway Department by letter to request they clean out the culverts under Centerville Road just south of Center Street and the culvert under Center Street just east of Centerville Road. Clerk will also request ditches be cut farther in from the road along Centerville Road at about Center Street. Councilman Ayers mentioned the roads will need more work when the rain stops. Harvey will take care of it. Mayor L'Allier received complaints on Lake Sanitation pickup trucks speeding. Clerk will contact Lake Sanitation on this matter. Harvey will check all streets for curbs broken by Group W construction crews. Councilman Wilharber met with residents at Royal Meadows. Most of their concerns were things the developer needed to deal with. It may be appropriate to have the Building Inspector meet with them ~lso, if they have further problems with itemsthey feel he should be addressing. The Council will wait to hear back from the residents. Clerk will advise the Rice Creek Watershed District of the dirt being hauled into the flood plain area on Rehbein's property at 6805 - 20th Avenue South. Clerk will check with the Building Inspector and the Engineer on the dirt East of Shad Avenue and North of Main Street. There is a question as to whether or not this dirt can be removed. PETITIONS AND COMPLAINTS: Councilman Wilharber will be meeting with the residents at Royal Meadows on October J, 1985, to discuss concerns the residents have with their development. Councilman Zimny received complaints on teenagers hanging around town. The residents concerned with this problem will be getting together to discuss it and then approach the Council with their ideas. - 'I Councilman Ayers has received complaints on residents dumping their yard waste in the ditches causing the culverts to clog and not drain properly. Clerk will contact Lake Sanitation for a Fall yard waste pickup. Clerk will check into the ownership of lots on the corner of Center Street and Centerville Road to have the weeds cut. Clerk will send letter to 1862 Main Street on the boxes piled up in their yard and request they dispose of them. Ed Adams, Ed's Trio Inn, 7084 Centerville Road, reported a dog cornered his 3t year old daughter. Clerk will check with the City of Lexington for information on their ordinance regarding the removal of a dog from its owners premises. Clerk will get prices on landscaping along the front of the Ci ty Hall. The scouts are unable to paint the skating rink this year. It was decided not to paint it at all since it may be moved to the City Park. NEW BUSINESS. Appearance of Bruce Wojak, Director of Anoka County Emergency Services. He informed the Council of different types of sirens and their costs available to the City. Clerk will check with the City of Fridley and the City of St. Louis Park on possibly. purchasing used sirens from them. Clerk will also check with Federal and Lane Electric to get size of siren needed and costs to hook them up. Ms. Harberts is looking for a representative recommended by the City Council to serve on a committee to research transportation alternatives for senior citizens. She will send a list of seniors .- residing in Centerville in order for the council to solicite an interested senior to serve on this committee. Clerk will find out if the City can request a pressure test on an underground tan~ presently in use. If so, the Clerk will request a pressure test be done on the underground tank at 1798 Main Street in Centerville. Clerk will send copy of the City Attorney's response to a lawsuit against the City Engineer to Mr. Wayne LeBlanc, 1677 Peltier Lake Drive. The first question concerns my professional opinion on the chances of the City recovering funds through a lawsuit against the City Engineer. The question of whether or not the City would be able to collect against the City Engineer depends on whether or not they failed to exercise the due care in designing and/or inspecting the road construction. For us to make a determination of whether or not such a lawsuit would be successful, it will be necessary for a complete review of all correspondence, plans and specifications, council actions and other relevant items that took place before and during the construction of these roadways. Furthermore the question of whether or not the action taken by the Engineer was negligent should be supported by another reputable engineering firm. Unless the City Council authorizes such a detailed investigation and retaining a consulting engineering firm whom could provide us with a professional opinion concerning the actions of the City Engineer, we do not feel we are capable of giving you an informed opinion ort such a question. If the Council wishes to discuss further the steps necessary and the possible costs to make such determination we would be happy to meet with them. The second question concerns the bonding limitations of the City. The bonding limitations established by statute restrict a City from having a net debt in excess of seven and one-third (7-1/3%) per cent of the assessed valuation of the City. Net debt does not include bonds issued which are wholly or partly payable from the proceeds of special assessments. I do not believe the City at the present time has any outstanding bonds which would be considered in the net debt calculations. If I I I _J / << -' ";-' . If no assessments were used to pay the bonds the seven and one-third (1-1/3%) per cent limit wuold be ~pplicable. There may be practical considerations, however, the City should examine in determining how much debt the municipality may fund. A general recommendation is that the gross debt of the municipality, which includes special assessment obligations, should not go beyond the point at which the amount of money needed to retire five (5%) per cent of the principal plus the total interest requirement for the year exceeds twenty-five (25%) per cent of the City's normal operating budget. Councilman Wilharber was the August liaison to Planning and Zoning. He mentioned the Planning and Zoning Commission would appreciate the council considering a new City Engineer with planning capabilities. He also stated a developer proposed a possible plat behind Trippels Market consisting of 103 homes ranging in price from $70,000 - $100,000, with lot sizes smaller than our ordinance presently allows. Council agreed with Planning and Zoning Chairman Dan Tourville that it would be a good idea to look at and review Ordinance No.4. Clerk will set up a Capital Improvement Fund. Clerk will research the possibilities of combining smaller savings accounts and investing them in a higher interest bearing fund. Clerk, Harvey Cartier and Dick Robischon will be on the Federal Surplus Property eligibility list. City will reimburse Deputy Clerk for use of her own typewriter at the City Hall. Wayne LeBlanc, 1677 Peltier Lake Drive requested an update on the road reconstruction situation. Councilman Ayers advised him the City is sending out a letter requesting proposals and bids from other engineers. The purpose of the meeting was to discuss the size of the Clearwater Creek culvert crossing under Peltier Lake Drive. Based on past correspondence between the City Engineers, the developers of Peltier Lake Hills and the Rice Creek Watershed District Engineers, it was decided that the 102" arch pipe culvert was put in according to Rice Creek Watershed District recommendations and would handle the present flow of water. The managers present will go back to discuss our findings with the rest of the Rice Creek Watershed District staff and confirm with us in writing. The City's maintenance department will log the culverts water levels in the future so the Rice Creek Watershed District has some data to base decisions on when issuing permits for future developments that may contribute to the water flow in Clearwater Creek. Mayor L'Allier called the meeting to order at 7.00 P.M. Present. Ayers, Robischon, Zimny, Wilharber. Motion by Ayers, second by Wilharber to approve the minutes of the July 10 meeting, motion carried unanimously. PETITIONS AND COMPLAINTS. Complaint received on kids loitering at the tennis court and school parking lo't at night. Clerk referred matter to Police Chief prior to meeting. Petition received from residents on Mill Road requesting the following. 1. Elevation of Mill Road remain same. 2. Mill Road be upgraded with current elevation maintained. 3. Check into replacing base & resurfacing road maintaining current elevation. 4. 100% tax levy to pay for costs. The following residents expressed their opinion on the reconstruction of the roads. Councilman Ayers will work with Clerk to prepare letter for engineering firms. Motion by Wilharber, second by Zimny .~to increase the sewer rates by $8.00 per quarter effective July 1, 1985 for the period of one year at which time the charge will be reevaluated, motion carried unanimously. ~ Motion by Ayers, second by Wilharber to amend motion of July 10, 1985 meeting amending motion of April 13, 1983 meeting to read. "And to chan~e the sewer service area from swi of swt of NW4 of Section 24, Township 31,' Range 22 Anoka County, Minnesota to the NEi.of swt of NW! of Section 24, Township 31, Range 22, Anoka County, Minnesota," upon verification by the developer of Raven Industrial Park that the legal description follows their original intent, motion carried unanimously. ~ / Page two - City Council Meeting Minutes July 24, 198.5 Councilman Zimny received a complaint from Steven King, 708.5 Progress Road, on verbal abuse from volleyball players behind Ed's Trio Inn. The Trio now has a building permit to put up a fence around the court, and has begun construction. NEW BUSINESS. Presentation by Diane Harberts, Transportation Specialist, Anoka County Transportation Coordination Program. Ms. Harberts will be surveying elderly people in the area to determine the need for a transportation program. She will be approaching the Council again in about a month to solicite their support for such a program. Mayor L'Allier and Councilman Zimny will contact Ray Houle and Gary Barott to see if an overhead can be added to the well being put in the City Park. Clerk will send letter to Sandra Heineman, 1983 North Robin Lane, to inform the residents that the City is considering the acceptance of the roads and sewers at Royal Meadows. If the residents have any comments referencing this matter, they can contact the City prior to the next meeting. Motion by Ayers, second by Zimny to have the City Clerk publicize for a new City Engineer for the purpose of replacing Milner W. Carley & Associates, motion carried unanimously. Clerk will contact Milner W. Carley & Associates to ask for continuous inspections and reports on the sewer stubs going into Peltier Lake Hills Addition #2. Clerk will check with the Building Inspector on pressure testing underground tank at 1724 Main Street. Clerk will check with Building Inspector on underground tank at the Perron property, 1798 Main Street. Motion by Wilharber, second by Ayers to pay claims, motion carried unanimously. FINAL COMMENTS. Complaint received on open drinking at a City Park softball game. City Clerk will refer the matter of posting park rules to the Park & Recreation Committee. Council heard from Ray Houle on the plans the Centerville Lion's Club have to put in a new 4" well, electric, and a combination warming house and concession stand over at the City Park. Appearance of John Stewart, Maier, Stewart & Associates. Mr. Stewart presented information to be discussed with residents at the Public Information Meeting on Monday, July 15, 1985 at Centerville Elementary School. He also presented a flyer to be distributed to all residents within the City. Motion by Wilharber, second by Ayers to have the Clerk send Milner W. Carley & Associates a copy of the preliminary road findings made up by Maier Stewart & Associates, and a copy of the flyer to be distributed to the residents of Centerville, and give them the option of attending the Public Information Meeting on July 15, 1985, motion carried unanimously. Motion by Ayers, second by Robischon to have the Clerk contact ~ / I Page two - City Council Meeting Minutes July 10, 1985 the Rice Creek Watershed District, City Attorney, and City Engineer, to propose a meeting on August 12, at 7100 P.M. for the purpose of discussing the Peltier Lake Drive culvert crossing, motion carried unanimously. The location of the meeting could be at the City Hall in Centerville or at their City Hall - at the Rice Creek Watershed's option. Softball Committee met with Debbie Dykema. She will give the City a set of written regulations for the record. Motion by Robischon, second by Wilharber to approve the contract with Lake Sanitation, motion carried unanimously. In a recent poll of the residents of Centerville, Lake Sanitation received a 45% positive response in favor of a recycling program. Mike Ayers will be working with Mary Ayde to set up such program and allow us to get grant monies that may be available. Motion by Ayers, second by Zimny to approve the continuance of the MCl special use permit, motion carried unanimously. This permit will be reviewed again in 6 months. Clerk will contact the Anoka County Health Department to see what steps have been taken to check into the barrels at 6805 - 20th Avenue South. Ed Adams has applied~jor a building permit for a fence around his volleyball courti and has turned his volleyball court to move it away from residents property. He will be allowed to continue playing p~iQr to p~ttang up the fence, providing there are no more pro.blems with the neighbors. They are concerned about the welfare of the child, and the possibility the dog may bite someone. Motion by Zimny, second by Robischon to have the clerk send a letter to Ed's Trio Inn notifying Mr. Adams of the problem, giving him )0 days to correct it with a fence, or advise the City Council how he plans to correct the situation. The City of Centerville is requesting a continuance of the court date to properly prepare for defense, but hasn't received confirmation yet. Ms. Devich is interested in purchasing property on Centerville Lake and Sorel Street. Because that part of Sorel Street is not yet developed, her concern was Sorel Street would be vacated and she would lose access to her property. The council clarified for her that this was a dedicated street. If it were to be vacated, there would have to be a public hearing notifying adjoining property owners. It is therefore incumbent upon the City Council to determine whether or not it is in the interest of the public to vacate this street. It is of no significance that a private individual may benefit by the vacation. Items which you should consider are access and need for the easement for future development, costs of maintenance or lack thereof, increased tax revenues by vacation, the affect and ability on adjacent properties to develop and the interests of the public to have proper development of such parcels and such other interests as may benefit the City as a whole. As I have. further advised you in the past the City must leave reasonable access to 'properties that abut or may utilize the easement. Removal of access to the property may result in damages to the property owners which could be sought from the City. FITZPATRICK nay 22, 1985 Centerville City Council 1694 Sorel Street Centerville, ~N 55038 Re: Rezoning of 6805 20th Avenue South from Commercial to Industrial Gentlemen: The following letter is written in response to your request for my written opinion concerning the rezoning of the above referenced property in November of 1980. ~pparently several questions have been raised concerning the propriety of this action on the part of the City Council. . procedurally under the zoning Ordinance for the City a petition to initiate rezoning may be commenced by the City Council, or the Planning Commission, or 50 per cent of the affected land- owners and 50 per cent of the persons within 350 feet. ~he information provided to me indic.ates that the only party who initiated the rezoning was the property owner. Under Minnesota Statute 462.357 the enabling legislation dealing with amendments to zoning ordihances for cities indicates that a city may in its zoning ordinance establish the number of affected persons needed to initiate a zoning change. While most communities merely allow the owner of the property who requests the zoning to petition, the Centerville City Ordinance is much more strict than that. Since the zoning application was not initiated by the requisite number of persons under our ordinance it would certainly appear to be subject to challenge by the affected and adjacent property owners. While it may be argued that the City Council in acting upon the application in effect initiated the application this argument is certainly not as strong as if the rezoning was actually initia~ed by a separate council resolu- tion. There has been some discussion regarding the possible inconsist- ency of the rezoning to the Centerville Comprehensive Plan. Minnesota courts have held that all inconsistencies between zoning and a comprehensive plan do not necessarily invalidate ~ , Centerville City Council May 22, 1985 Page 2 zoning decisions. However it would be my recommendation that if there is any inconsistency it should be rectified immediately. Since the procedure utilized in the rezoning is questionable I would rec.ommend that the Council immediately determine what type of proposed development it wishes to encourage in this area, amend the Comprehensive Plan, if necessary to accomplish these objectives, and initiate a rezoning to effect the policies and goals in the plan. i;J~~*~- William G. A letter was presented to the council dated May 18, 1977, from the Rice Creek Watershed District engineers to Milner W. Carley & Associates. The letter re- commended a 96" corrugated metal pipe be installed at the crossing of Clearwater Creek and Peltier Lake Drive. The actual pipe installed was 102". Referencing an analysis by Peter Buesseler, member of the Planning and Zoning Commission, there is some question that the procedure used in the initial rezoning of the property from Commercial to Industrial was in accordance with State statutes and local ordinances. Motion by Wilharber, second by Robischon to forward Peter Buesseler's analysis of the rezoning at 680.5 - 20th Avenue South along with copies of the minutes from Council and Planning and Zoning meetings to the City Attorney for a written legal opinion, motion carried. Harvey will contact Jim's Remodeling to clarify the width and depth of the ditch at 7228 Mill Road, and also to clarify whether or not sod was included in his $49.5.00 estimate. Article II PURPOSE OF THIS COMlVIIT'JEE The purpose of this committee will be advise or make recommenda- tions to the Centerville City Council on matters relating to Parks and Recreation activity within the City of Centerville. In addition, this committee will make recommendations to the Centerville City Council on proposed purchases of park equipment and other expenditures as the committee deems appropriate. Article III MEMBERSHIP A. Appointment of Members The members of this committee will be residents of the City of Centerville and will be appointed by the Centerville City Council in January of each year. B. Representation The committee shall consist of five (5) members. One (I) member of the Centerville City Council will serve as ex-officio member without voting privileges. C. Terms of Members All appointments will be for two (2) year terms. D. Vacancy When a vacancy occurs, a new member will be appointed by the Centerville City Council as recommended by the Park and Recreation Committee to serve the unexpired term. ~ I Article IV OFFICERS A. Officers The committee will elect its officers annually at the first (1st) regular meeting in a calendar year. A chairperson, a vice-chairperson, and a secretary will be elected. B. Term of Office The term of office for all officers will be one (1) year. Each officer will be eligible for not more than three ()) consecutive terms of office. C. Duties I. Chairperson a) to preside at meetings of the Park and Recreation Committee meetings; b) to give leadership to the committee; c) to sign reports and other papers as authorized by the Park and Recreation Committee; d) to appoint task forces as authorized by the bylaws. Vice-chairperson a) to lend support and assistance to the chairperson; b) to preside at Park and Recreation Committee meetings in the absence of the chairperson; c) to fill the office of chairperson, should that post become vacant, for the remainder of the unexpired term. Secretary a) will take minutes of all regular and specially scheduled meetings; b) prepare meeting minutes in duplicate; c) distribute one copy of minutes to the Committee and the second copy to the City Clerk for distribution to the Centerville City Council. ~- I Article V MEETINGS A. MEETINGS The committee will meet once each month on the second (2nd) Tuesday of the month. However, the schedule may be amended from time to time to suit the convenience of the members. B. Notification of special meetings mu~t be made at least five (5) days in advance of the meeting date. Special meetings may consider only those items so specified in advance. C. Is willing to come out free of charge and take a look at our road situation. May be able to work with the City on repairing the roads over 4 - 5 year period. Art will have contractor come and take a look next week. Harvey will make necessary repairs on Center Street and Peltier Lake Drive. OLD BUSINESS: Appearance of Police Chief Dean Campbell. Mention by Wilharber of officers speeding within the City limits. Chief Campbell will check into it. Mention by Robischon of excessive parking at home on Main Street and Shad Avenue. Chief Campbell will also check into that situation. Chief Campbell will be glad to meet with the council on a monthly basis either personally or have ~ representative in his place. Mention by Wilharber of the fine job the police force is doing. Discussion with Mike Dykema on softball tournaments at Twin Lakes. Mr. Dykema stated that there will be a league game on Tuesday and Thursday evenings, no beer or liquor will be sold on the fields during tournaments, fencing will be used to limit parking, and they will be out policing the fields. It was the councils understanding that a written memorandum of agreement would be drawn up by Mr. Dykema. Tom Wiharber will arrange a time with Harvey to blade the roads next week. Harvey will check into the cost of re-establishing the ditch at 7228 Mill Road. Harvey will check on the progress of the yard cleanup at 7112 Shad Avenue. Appearance of Leonard Ayde from Lake Sanitation along with his attorney to renew sanitation contract for five years. There will be no increase for 1985 unless the State of Minn. imposes a tax. Would like to renew with the same terms and conditions. Council requested Lake Sanitation use pickup on bad roads instead of the big truck. Clerk will send list of roads to Lake Sanitation. A questionaire on recycling will be sent in the next billing. Harvey will check into the composting site to see if dry enough for a truck. Wilharber questioned the possibility of having a recycling provision in the contract. The manufactured units themselves are inspected by the State Buiiding Code Division. The City inspects the foundations, setbacks etc. "Second" concrete blocks have been allowed to be used in the foundations below grade. Gunnar will check to be sure they were only used below grade, and will no longer allow their use in any part of the foundations built in the future. Clerk will send Mr. Dykema, Twin Lakes Pavillion, a letter reminding him of the meeting on April 24, 1985 and requesting he give us a copy of his proposal for softball tournaments in advance of the meeting to be included in the agenda packets. Update on North Central Suburban Cable Communication Commission by Ted Gonsior. Group W is presently trying to re-negotiate the Franchise agreement. When Group W & the NCSCCC come to terms, City approval will be needed. Centerville is 16th out of 18 initial service areas. Projected installation is November 1985. Spring clean up is set for April 27, 1985. A dumpster will be placed along side the rink just off the City Hall driveway and Heritage Street. A yard waste pickup is also set for May 4, 1985. Dis~ussion of finances. Centennial Fire District. The City will be paying the Centennial Fire District $1),002.88 in 1985. Some of the depreciation will be returned to the City in 1985. The amount to be returned and time frame in which it will be returned has not yet been determined. A percentage of the electricity, gas and telephone will be reimbursed to the City. The Finance Committee of the Centennial Fire District is presently reviewing what an appropriate percentage wilt be to present to the City for final approval. The City wil~ be able to use the tank truck to flush its sewers without Cha(ge. A fireman will need to be with the truck in case of a f-re call. Aud-tor's Financial Statement: The City of Centerville ended up ith a $)4,089 deficit in the General Fund and a $12,))0 def~cit in the Park Fund. In the financial report the audli tor brought to mind the issue of the Homestead Credi t. In !the past, the Homestead credit has been budgeted as a separate revenue producing item. In reality, the Homestead Cr~dit is a portion of the tax levy (approx. 30%). The 1986 bu~get will reflect proper handling of the Homestead Credit and an attempt to reduce the City's deficit. Motion by Wilharber, second by Zimny to approve the minutes of the February 1J, 1985 meeting, motion carried. PETITIONS AND COMPLAINTS_ Discussion on problems with the rink and warming house. More adult supervision Have police stop in unannounced Monitors can no longer skate Clean up warming house monthly Establish written rules and regulations for the monitors Pay a leader at a higher amount to oversee the monitors Stress monitoring is a job - not fun with pay Complaint on dogs on east end of town. Mayor will contact police to see if they can patrol more. Complaint received from retired fireman on distribution of Fire Relief Funds being distributed equally. He felt unfair to those who served more years on the Fire Department. Long distance calls being made on hall phone at night. Clerk will report to phone company. Harvey will get some class 5 for Mill Road and Peltier Lake Drive, and check with Dan Tourville on leveling the roads. OLD BUSINESS: It was decided not to participate in the Minnesota Housing Financing Agency's Rental Rehabilitation Program as it wasn't applicable to our needs. Motion by Wilharber, second by Robischon to move the gas switch from the warming house to the garage, and to replace broken light switch in the warming house, motion carried. The Committee has outlined their goals for the coming year, and talked to a few engineers about coming our and helping us with our road problems without a preliminary cost to the City. They have been looking into a newer procedure of using a mat as an underlayment for roads built on our type of soil, and will also be looking into methodsof controlling the dust this summer. They will be having more meetings beginning in the Spring when it begins to thaw. NEW BUSINESS. Motion by Robischon, second by Zimny to adopt Resolution No. 2 supporting an amendment of Minnesota Statute to allow for the payment of pension benefits after 20 years of service, motion carried. Discussion on the acquisition of easements from the property owners along Clearwater Creek. Presentation by Larry Winner, City Engineer, to update property owners present. He outlined the three alternatives available to solve the problem. 1. Add another culvert at a cost of $15,000. 2. Replace the present culvert with a bigger one at a cost of $50,000. 3.
