Pursuant to due call and notice thereof: the Planning and Zoning Commission of the City of Centerville held its regularly scheduled meeting at City Hall, 1880 Main Street. PRESENT: Chairwoman Kathy Welk Commission Members: Linda Broussard Vickers John Buckbee AI LaMotte Brian Hanson ABSENT: None STAFF/CONSULTANTS: Tun March Ry-Chel Gaustad Paul Palzer ************************************************************************ OPENING Roll Call PUBLIC HEARING (S) Special Use Permit - CTOetz Landscaping lvIr. Joe Goetz gave a summary of the proposed property timeline to build a 6000 sq. ft building at 2030 Main Street. Mr. Goetz plans to construct a 12 x 60 sq. ft. mobile building in March of 1999, which will be a temporary office until a permanent structure is complete. Mr. Goetz ultimately wants to construct a 50 x 120 ft. (6000 sq. ft.) building with the exterior completed by the first freeze in 1999. He will then continue to complete the interior of the building over the winter, with a grand opening in April of2000. Mr. Goetz would also like to construct a 60 x 30 sq. ft. green house. All structures will be in line with the neighboring structures. Mr. Goetz requested a Special Use Permit (SUP) for the following: ". , . Outside displays Size of mobile structure Approval of 6000 sq. ft. building The Commission confirmed that the mobile structure would be removed upon completion of the permanent 6000 sq. ft. building. Chair Welk: noted receipt of Paul McDowell's (president of Northern Forest Products) favorable letter supporting the Special Use Permit approval. Motion by Mr Buckbee to close the Public Hearing Seconded by Mr LaMotte All in favor Public Hearing closed at 7'17 p m SpeciallJse Permit - Gerald Rehbein Ms. Susan Fusse~ P.E. gave a brief overview of the methodology for the traffic flow. Also, specifically, the drainage plan directs the water to flow to the northeast pond located on the property. Ms. Fussel commented the Staff questioned how the property to the east would develop and how the drainage would effect the surrounding property. Thus, plans indicating such will be issued to the City. Chair Welk: confirmed adequate truck turn around. Ms. Tina Riehle of 7044 Cottonwood Court noted she was concerned about additional drainage directed toward her property (drainage swale) and the possibility of s\vamping her backyard. Ms. F ossel confirmed that there will be no increased drainage directed to her property and no additional grading will effect their property. Mr. Mark Riehle stated that the residents were told a berm would be constructed to buffer the commercial from the residential, and trees would be planted along the top of the berm. Mr. Rehbein noted additional grading will be needed to be done and seedlings can be planted on the berm. Ms. Riehle expressed concern that in the future the office building will not have an aesthetic appeal and would prefer some mature trees on the berm. Ms. Susan Luke of 7050 Cottonwood Court was also in favor of a tree buffer on the berm. Officer Scott Parks was concerned about putting chains up to redirect the traffic on the west side of the building because it may cause safety problems. He suggested a cattle fence be used in place of a logging chain. 2 Mr. Tom Wtlharber of 6848 Centerville Road thought Officer Parks brought up a good point. Furthermore, if the City allows the construction of the building with chains, and a fatality or injury occurs the City may be held responsible. Mr. Rehbein noted the school preferred chains and the district had removed gates at other structures. Motion by Mr Buckbee to close the public hearing Seconded by Ms Broussard Vickers Public hearing adjourned at 7'45 p m Special Use Permit - Lloyd Dn11il1g Mr. Lloyd Drilling briefed the Commission on a proposed commercial building at the southeast intersection of Peterson Trail and Main Street. Mr. Drilling planned to have a 5000 sq. ft. day care center, and a 7200 sq. ft. retail office building. The building would house just about anything, i.e.: Hardware Store, Restaurant, Cost Cutters, Video Update etc.. Mr. Drillings commented the site plan will address the drainage located to the east property line. Ms. Kimberly Turner of 715 1 Peterson Trail stated the water level is too high. The water stands and it increases with the rain. Ms. Broussard Vickers questioned the east side exit and its distance from County Road 14. Mr. Drilling explained he would adjust some distance of the entrance on the :final plans. Ms. Turner requested a private fence. Ms. Welk questioned the setbacks from the center line. Mr. Dri11ings stated they are as such: North -57 Front -75 Side -20 Side -20 Kathy Welk noted receipt ofan unfavorable letter from 7154 Peterson Trail. Motion by Linda Broussard Vickers to close the public hearing Seconded by John Buckbee All in favor Public hearing closed at 8'30 p m APPEARANCES ACTION Ms. Linda Broussard Vickers removed herself from the table and sat in the audience. Special Use Permit - Goetz Landscaping Mr. Paul Patzer (Building Official) stated that it must be ADA accessible if it is used for retail. It must have a paved parking lot to comply with the Americans with Disabilities Act. There will also have to be restrooms. Mr. Buckbee suggested a time frame be established. 3 Ms. Kathy Welk suggested the Commission make plans as to how many green houses and additional buildings will be approved and when the structures will be removed. Ms. Linda Broussard Vickers of6756 Centerville Road questioned if the zoning complied with the request. Mr. March stated that the zoning issues were raised and usage was approved in the district. Mr. Buckbee requested more information on the ADA, to have more of a definitive site plan and add a specific date that the mobile building will be removed. Mr. LaMotte requested more information on restroom facilities. Mr. Buckbee questioned sewer and water hook-up and/or satellite facilities. Mr. Patzer commented utilities are already on the property. Brian Hanson suggested bringing this issue back next month for closure to prevent problems in the future - i.e.: stipulations, timelines, etc. Mr Buckbee motioned to recommend that the direct concerns be ex;plained by Mr Goetz at the next meeting Also, stipulate that the trailer be removed within a specific timeline., detennine ADA approved issues with facilitie~ limit to one green house., start construction by a specific date and provide additional information for drainage p]an~ Seconded by Brian Hanson Buckbee., Hanson, Welk and LaMotte - aye Broussard Vickers - abstained. Di~ha1::Be of Firearms Officer Scott Parks of Circle PineslLexington Police Department spoke of his personal experience with 9 mm handguns. He stated hunters are hunting ducks in the bay near Waterworks Beach Club. He also reviewed the ordinance of Circle Pines/Lexington Police. In the City of Minneapolis - all firearms must be kept in the trunk, in box identified gun with the ammunition kept in another area. He suggested eliminating single projectile - thus equipping the enforcing officers to remove abused firearms. He stated sling shots and B.B. guns are problematic. Tom W1lharber mentioned that Chief Heckman suggested a Uniform Firearm ordinance. Ry-Chel Gaustad mentioned the City received one complaint of a shot "dead" duck along Peltier Lake Drive.
