HomeMy WebLinkAbout1998-08-04 P & Z CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION MEETING AUGUST 4, 1998 Pursuant to due call and notice thereot: the Planning and Zoning Commission of the City of Centerville held its regularly scheduled meeting on August 4,1998, at City Hall, 1880 Main Street. PRESENT: Chairwoman Kathy Welk Commission Members Linda Broussard Vickers Ai LaMotte John Buckbee STAFF I CONSULTANTS: run March, City Administrator Ry-Chel Gaustad, CMC City Clerk Dave Nyberg, HR Green Consulting *********************************************************************** RoD CaD Chair Welk called the meeting to order at 7: 10 p.m. PUBLIC BEARING(S) Preliminmy Plat Consideration for Travis Mr. William McCoughly, Engineer (Rehbein Companies) gave an overview of the proposed Travis preliminary plat, grading and utility plans. Mr. McCoughly specified the wetlands are protected and the grading plan mitigates the water north. Mr. Dave Nyberg explained that the high water level is based on vegetation and the grading plan may need to be fine tuned. Mr. run Jacobson (1941 73rd Street) noted the current elevation at his home is draining at 906 ft. when the correct drainage should be at 905 ft. Mr. Nyberg stated that in a level area, the city typically required drainage at the minimum elevation of908 ft. The overland outlet is above 906.7 ft. and is designed to flow north. Mr. Robert Steward (1995 73rd Street) noted that the water flows to the west, and drowns the east properties. Mr. Mike Harris (7296 Brian Drive) noted there is ponding in his backyard regularly and his sump pump runs in the winter and in the summer. Furthermore, he hit water at 36" when diggIng for deck post. Mr Buckbee moved to close the public hearing Ms Broussard Vickers seconded the motion Motion carried unanimously Variance - Reconstmction of a Shed at 1563 Peltier Lake Drive for Phippen Mr. & Mrs. Phippen were present to request a variance to reconstruct a shed near Peltier Lake. Mr. Phippen commented that they were not aware of a 75' shed setback from the lake nor that if two walls remain standing, a variance would not be required. Mr. Buckbee noted that during his visit to the property in question, surrounding property owners had also constructed structures near the lake. Currently, the Shoreland Ordinance requires a 75' setback from the lake and the proposed ordinance permits an inland boathouse within 10' of the lake. Ms. Broussard Vickers questioned if the property owner is able to place the structure near the house. Ms. Gaustad distributed a letter from the Saint Paul Water Department and a letter from a resident at (1559 Peltier Lake Drive), both noting an objection to the variance approval at this time. Ms. Welk acknowledged receipt of the letters. Mr. Buckbee entertained moving the cement slab closer to the house structure. Mr. Phippen stated he was unable to relocate the structure without placing it in the middle of the yard. Motion by Ms Broussard Vicker~ seconded by Mr LaMotte to close the public hearing Motion carried unanimously Rezone Property From Rl to PUD (:planned Unit Development) for Rehbein Mr. Gerald Rehbein (R & R Leasing) was present to request the Planning Commission's opinion on the request to rezone the property east of "The Woods of Clearwater Creek. " Ms. Gaustad explained the City ofLino Lakes Comprehensive Plan states the property east of 20th Avenue and north of the Willow Glen Development will be rezoned to Rural Business Reserve (RBR) high density. Mr. Rehbein commented that the proposed zoning is medium density with five or possibly six structures in a PUD (planned Unit Development). Mr. Rod Henslin (1967 73rd Street) presented a plat for PUD consideration. He felt it was erroneous to consider zoning without knowing the site plan and density. Mr. Henslin suggested the developers spend more time researching. Mr. Eric Larson (1957 73rd Street) stated there is a transitional stage. There are larger lots next to high density urban development and his home is 960 sq. ft. and it is too small. Mr. Rod Henslin urged the Planning Commission to read PUD 52.01. Chair Welk stressed the City has heard the same concerns which impact the Hre Department, Police Department and school district every time a new development is 3 considered. In addition, it is difficult to act on the proposal without a full plan to determine if this is applicable to the ordinance or comprehensive plan. Motion by Mr John Buckb~ second hy Mr LaMotte to table and to continue the public hearing at another date Mr LaMotte seconded the motion Motion carried unanimously APPEARANCES Paul McDowell - Northern Forest Product Driveway E:qJansion Mr. Paul McDowell of Northern Forest Products briefly explained he purchased Lot 5, Block 1, of the Industrial District and one year later he purchased Lot 6, Block 1. Mr. McDowell stated he is concerned with the safety of the truck turn around area and would like to create a "un shaped driveway. Mr. McDowell commented that he has submitted plans to RCWD and Anoka County Highway Department for consideration. Mr. Buckbee questioned if a "U" shaped driveway would eliminate or hinder future growth on the lots. Mr. McDowell stated they plan to construct buildings around the "U" shape. The benefit of having an entrance only and an exit only would assist in the flow of traffic. Mr. Buckbee questioned if there are any county concerns. Ms. Gaustad commented that Mr. Roger Butler (Anoka County Highway Department) has received the plans and will forward the county's concerns. In addition, Mr. McDowell will have to obtain an Anoka County permit prior to working within the county's right of way. Motion by Ms Broussard Vickers to recommend the site plan contingent upon Mr. McDowell obtaining a proper permits from governmental J\gencies Mr Buckbee seconded the motion Motion carried unanimously Concept Sketch Plan for Hal Leibel Mr. Leibel was present to give a thumbnail sketch of a proposed subdivision on Mound Trail. He was concerned with the wetland and ponding on the property, but noted the drainage plan will address each item. Mr. Letbel questioned the lot size, if sewer is required and how it is zoned. Ms. Gaustad explained the property is zoned R2 and requires a minimal lot size of 11,000 sq. ft. Furthermore, sewer is required and independent wells will need to be drilled and approved. The Commission felt the sketch plan was keeping within the comprehensive plan. ACTION ITEMS Action on Preliminaty Plat for The Woods of Clearwater Meadows ('rravis) Ms. Broussard Vickers stated the lot size is good, but her biggest concern is the drainage Mr. Buckbee requested assistance on the drainage issues concerning the neighboring properties. Ms. Welk called the councils attentiootothedrainage issues. Mr. LaMotte 4 .. " questioned who checks and verifies the drainage concerns. Mr. Nyberg stated the City can put anything in the Developers Agreement including specification regarding the drainage. Mr. Dan Saxton (1949 73rd Street) stated that the drainage is not a concern and in June, July and August there is no standing water on his property. Mr. fun Jacobson stressed the people do not want to shut down the development but the neighbors do not want increased drainage. Ms Broussard Vickers moved to rec-.ommend approval of the Preliminary Plat based on the following contingencies' 1 City Engineer approval. 2 City Inspect-OfS approval, 3. Special Use Permit Vehicle Speed on 20th A~eDue Mr. Tom Howgin (1994 73rd Street) requested the Commission consider lowering the speed limit on 20th Avenue. Mr. Howgin was redirected to discuss the issue with Staff. Mr Buckbee moved to adjourn the August 4. 1998 Planning and Zoning Commission meeting Me LaMotte seconded the motion.
