L CALL TO ORDER
Mayor Sweeney called the August 25, 2004, City Council meeting to order at 6:30 p.m.
II. SET AGENDA
Mayor Sweeney added the Dutch Elm Disease tree under New business as well as an
overweight permit request for Mr. Emert and the Trio wedding reception. He then noted
that number one under Appearances would be removed.
City Attorney Hoeft requested that an executive session to discuss the City's litigation
with Royal Oaks Realty be added.
Motion bv Council Member Canra. seconded bv Council Member Paar to aoorove
the al!enda as amended. AU in favor. Motion carried unanimouslv.

V. A W ARDSIPRESENTATIONS/APPEARANCES
1. Judy Montain Trio Inn Wedding Receotion
Ms. Montain addressed Council and indicated she had come to City Hall and watched the
tape of the meeting where the permit was approved and the word liquor was used and
liquor is not the same as 3.2 beer. She then asked Council to reconsider allowing the
liquor.
Council Member Capra indicated that, for her, it was a stretch to allow the permit at all
because of noise concerns. She then said that she does not feel it is necessary to have
hard liquor in the parking lot and keeping it inside may curb the noise slightly.
Council Member Paar indicated he would have no issue with issuing a permit for the hard
liquor.
Council Member Lee indicated he is concerned about creating a precedent where the City
would be asked by others for the same type of permit.

Mr. St. Sauver indicated that they would have had the reception in their backyard but the
street is torn up so that is why they moved it to the Trio.
Council Member Paar said he does not think this is a precedent setting situation because
Council makes decisions all the time that have the potential to set precedent. He then
said that Council has the right to consider each application separately.
Council Member Lee asked whether liquor would be sold in the parking lot.

Mr. St. Sauver indicated that beer would be available outside but liquor would need to be
purchased inside the bar.
Motion bv Council Member Lee. seconded bv Council Member Paar to reconsider.

Council Member Capra indicated that she felt that the City does not usually issue permits
for hard liquor and, it was her thought, that people would go into the bar to have a drink
and could then go out and watch the band.
Motion bv Council Member Paar. seconded bv Mavor Sweeney to aoorove an
Au!!ust 28. 2004 temoorarv liquor license which covers the oarkin!! lot of the Trio
Inn for a weddin!! receotion with a fenced in area. Aves - 3. Navs - HCaora).
Motion carried.
Ms. Montain and Mr. St. Sauver thanked Council for its consideration.
VL PUBLIC HEARINGS
None.
VB. NEW BUSINESS
1. Mr. Emert. ofHea1thv Home Builders Overweight Permit
Mr. Emert addressed Council and asked for consideration of an overweight permit for
two loads of concrete at 9 tons as he has homes under construction on Peltier Circle.
Mr. Peterson indicated that he did not have an issue with allowing two trips.
Motion bv Council Member Caora. seconded bv Council Member Lee to aoorove
the requested overwei!!ht oermit for two 9-ton loads within the next 30 days oer the
recommendation ofthe City Enl!ineer. All in favor. Motion carried unanimously.
2. Owes! Lease/Agreement (1875 Fox Run)
Motion bv Council Member Caora. seconded bv Council Member Paar to aoorove
the Consent to Assil!Dment of A!!reement of Owest forwardin!! antenoa
resoonsibility to Verizon Wireless. All in favor. Motion carried unanimously.
3. Resolution #04-041 - ICMA (Legislative Body - 457 Deferred Compo Plan)
Mayor Sweeney indicated the City went to great lengths to pare down the number of
plans available and he is not interested in making a change at this time.

Council Member Capra indicated she would like to leave the plan as it is at this time but
would have no issue looking at the costs and benefits of another company in the future.
4. Color Scheme for the Water Tower
Council discussed the various color options for the water tower and agreed on beige for
the main tank, old glory blue for the wording, fountainbleu for the lakes, and hunter green
and spearmint for the other portions of the logo.
5. Dutch Elm Diseased Tree
Ms. Moore-Sykes indicated that a resident had come to the City asking that his tree be
looked at and the City Clerk contacted the forester who made the determination that the
tree does have Dutch Elm Disease.
Council asked Staff to have the diagnosis confirmed and provide notice to the resident
that the tree would need to be removed.
VIII. OLD BUSINESS
1. American Publishing Companv Code Codification
Ms. Moore-Sykes informed Council she received a call from Amy at American
Publishing Company indicating that the City had contracted with them for a code
codification that was never finished. She then asked whether council is interested in
finishing the project and noted there is an outstanding balance.
Council discussed the matter and agreed that, since the process was started and the City
contracted for the work, it should be completed. Council also asked that Staff determine
what the outstanding balance for the work is.
2. Gassen COlI1Panies Request to Move Mailboxes
Council discussed the matter and asked that Staff inform Gassen Companies that the City
will not authorize the mailboxes to be moved unless they provide to the City written
authorization and approval from the affected property owners.
3. Police Budget
Council Member Capra indicated that she would like the police advisory board to be told
that, other than political reasons, there are no levy limits so the other two cities have the
ability to levy for police protection.
Council discussed the estimated costs for the City to have its own department and agreed
to wait for the quote information from Anoka County and Lino for contract services for
comparison. Council then discussed the proposed police budget for 2005.

Mayor Sweeney indicated that there are some who would prefer to build a $3,000,000
new facility just because it is on the other side of the lake rather than look into the
existing building in Centerville for half the cost.
Council Member Lee indicated that Chief Heckman has said publicly that the location of
the building in no way affects the service the cities receive.
Motion bv Council Member Caora. seconded bv Council Member Paar to aoorove
tbe Centennial Lakes Police Deoartment buded as oresented. All in favor. Motion
carried unanimously.
4. Purchase Agreement 1601 LaMotte Drive
City Attorney Hoeft indicated that he has been unable to contact the seller to discuss the
City's concerns with the purchase price and deed restrictions so a letter was written and
faxed to them for consideration.
5. Storm Drainage on Center Street
Council Member Capra indicated that Staff has asked how they are supposed to track
delayed assessments because, when the homes are sold, Staff is contacted and asked
whether there are any assessments.
Council discussed the matter with the City Attorney who indicated that, in this case, the
answer would be no and he then explained that the City has the right to assess residents
for any work done at this time in two years when the other proposed work is done.
Ms. Stephan indicated she did not think the City could do work now and then ask for
payment in two years.
City Attorney Hoeft indicated that the City is allowed to do so.
IX. ANNOUNCEMENTSIUPDATES
1. 2004 Street Proiect
Mr. Peterson provided a brief progress update on the 2004 street project.
2. Eal!le Pass
Mr. Peterson indicated that Jesse from Swift has promised to dig a trench behind the
cottages on Ojibway to drain the water out of the pine trees and then put the sod back.

3. 1540 Peltier Lake Drive
City Attorney Hoeft indicated that he drove by the property on the way to the meeting
and it has been mowed.
4. Chauncey Barett Gardens. Phase II
Ms. Moore-Sykes indicated that an informational handout on the construction schedule
was provided in Council packets.
Ms. Moore-Sykes provided information on the quotes for team building facilitators
indicating the information was received that afternoon. She then asked Council to review
and consider the proposals.
Council Member Capra asked that this be added to the next meeting agenda for
discussion.
Council recessed to executive session to discuss the City's litigation with Royal Oaks
Realty at 8:15 p.m.

Attached is a request from Jodi McGregor, Outdoor Ice Coordinator for the Centennial Youth
Hockey Association, requesting the use of Laurie LaMotte Memorial Park for the 2004-2005
season.
The committee discussed the use of the facilities for dry land practice and agreed to the usage
with the following conditions:
1. A schedule of usage, as well as a contact list of coaches responsible during the time it is
being used will be provided by the association.
2. There will be no use of the facilities after 9 p.m. daily.
3. The nets will be padlocked when not in use. The key to the lights and padlock will be
supplied in a lock box by Public Works.
4. The Centennial Youth Hockey Association will sign a waiver releasing the City of
Centerville from any liability and will take responsibility for any damage occurring
while the association is using the facilities.
The following recommendation was made by the Parks & Recreation Committee at the
September 1,2004 Parks & Recreation Committee Meeting.
Motion was made by Chairperson Peterson, seconded by Committee Member Peil to
recommend to City Couneil approving the Centennial Youth Hockey Association's use of
dry land time with the use of the park lights at Laurie LaMotte Memorial Park with the
above conditions. All in Favor: Motion passed unanimously.
The committee discussed the association's request for additional ice time and opted to keep t1ie
days and hours the same as in the past seasons allowing Centerville residents access to the ice
with the exception of 8:00 - 9:00 p.m. Monday through Thursday.
Motion was made by Chairperson Peterson, seconded by Committee Member Peil to
recommend to City Council approving the Centennial Youth Hockey Association's use of
the hockey rink for the 2004-2005 season with a dedicated half sheet of ice from 7:00-
8:00 pm. and a dedicated fun sheet of ice from 8:00 - 9:00 p.m. Monday through
Thursday. An in Favor: Motion passed uuanimously.

The CYHA would like to formally request to use LaMotte Park outdoor hockey rink for
the upcoming 2004-2005 hockey season. As the Outdoor Ice Coordinator, I will take
care of the initial scheduling of the rinks for outdoor practices and scrimmages. I will pass
that information on to you, as well as the final coaches list, once the scheduling is
complete. The scheduling should be completed by mid December. Also, the
coaches/parents will once again be asked to help shovel the ice surface before and/or after
using it.
If at all possible, we would like to extend the time available for CYHA, allowing whole
sheets of ice for both hours. At a minimum, we would like to reserve the same hours at
LaMotte Park for the 2004-2005 season, as we did in 2003-2004. Any additional ice time
CYHA can schedule would be much appreciated. The days and times from the 2003-2004
season are as follows:

land practice schedule will be faxed to you the end of September, fur your approval.

Kim,
Thank you so much for the response that you received my letter requesting outdoor ice. I wanted to clarify
for your September 1st meeting, CYHA would like to use the rink for outdoor ice as they have in the past
(requested dates and hours can be found on letter sent to Tedd Peterson), and are also requesting to use
the rink for dryland training starting in Oct, after tryouts and teams are placed, and continuing until
outdoor ice is available or weather permits. This is a first time request being made to your City. We
currently use two other parks in the surrounding communities for this purpose. It aids in our training and
preparation for the on ice season.
We usually use the rink in the evenings, from 5:00 pm until 9:00 pm, during the week. If this is approved,
we would need to know what is appropriate for your fighting situation. The other parks we use have either
automatic light systems or we manually turn them on and off when we are at the rink. We also use a
"lock box' system for obtaining access to the warming house with the key always being returned to the
lock box. This system has worked well with the other communities and I would be happy to forward names
and phone numbers if you would like to speak with others regarding the process and procedure.
If you have any questions before the September 1st meeting, I would love to talk to you.

THE PROPERTY OWNERS HAVE AGREED THAT CURRENTLY THERE IS

NOTICE IS HEREBY GIVEN, that the Planning and Zoning Commission and the City
Council of the City of Centerville will consider the requested lot split submitted by the
current owner KCR Investments (Mr. Richard Carlson) of 17' x 73.28' of PIN #R26-3l-
22-22-0011 and to combine same with PIN #R26-31-22-22-0003 currently owned by Mr.
Robert Koran, 6759 Centerville Road. This requested lot splitllot combination would
alleviate an existing encroachment issue. The meetings are scheduled for Tuesday,
September 7, 2004 and Wednesday, September 8, 2004 respectively at 6:30 p.m. or
shortly thereafter. The purpose of the meeting is to ascertain public input regarding the
above request and the possibility of granting the lot splitllot combinations as requested.
Both public hearings will be held in Council Chambers located at 1880 Main Street,
Centerville, Minnesota 55038.
The City Hall is ADA accessible. Requests for hearing assisted devices or a sign
language interpreter must be received before 4:00 p.m. September 3, 2004. All persons
interested are invited to attend and to be heard.

I would like to request a Variance on lot I block 2, burque addition no. 1. The variance is
necessary for two separate reasons, in order for me to build a home on the vacant lot.
1. Minimum Area needed on a conforming lot is 15,000 Square feet.
2. Minimum width of a conforming lot is 100 feet from where the home sits. (@ -k~'Q/'1)
Provided with this letter is a site plan that explains that I cannot meet those requirement,s
due to the dimensions of the platted lot. The square footage of the lot is only 12,009 feet,
and the width of the lot at where the home sits is roughly 85 feet wide.

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only, A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood, Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance, If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the
property owner's circumstances are self-created,
Minnesota Statutes (MS 462.357, Subd, 6) and City Ordinances (Ord, #4, Division 180) require that
the following conditions must be satisfied for approval of this request, Please respond to these
conditions using additional sheets of paper if necessary,
L Because of the particular physical surroundings, shape or topographical
conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced,
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel ofJand,
4, The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood,

2. Submit a complete survey and site plans (including measurements, dimensions),
showing lot lines and building footprint, driveways, sidewalks, curb cuts, ingress,
egress, etc. on the property and its relation to adjacent properties.
3. Explanation of materials that will be used and plans for screening, landscaping,
fencing and dumpster enclosures.
4. Drawings of completed buildings, if appropriate to the project, and materials used.

5. Storm water retention and drainage plans. The Rice Creek Watershed District
and/or other water management organizations may need to be notified of the
project.
6. A letter explaining the reason for the variance request. The letter must also
demonstrate the variance will not impact the surrounding properties nor impact

NOTICE IS HEREBY GIVEN that the Council of the City of Centerville, Minnesota will
conduct a public hearing on the following proposed amendments to Ordinance #23
(Increasing the Salaries of the Council Persons and Mayor) and Ordinance #52 (Regulating
the Site Maintenance On Parcels of Property on which New Residential, Commercial, or
Industrial Construction is in Process) as follows:
Ordinance #23
Currently Reads: Therefore the salary for the Mayor is hereby established at 250.00 per
month plus an additional $25.00 for any additional Council meeting(s)
and workshop(s) attended; and
Proposed Language: Therefore the salary for the Mayor is hereby established at $350.00 per
month plus an additional $25 for any additional Council meeting(s)
and workshop(s) attended; and
Currently Reads: And the salary for the Council Members is hereby established at
200.00 per month plus an additional $25.00 for any additional Council
meeting(s) and workshop(s) attended; and
Proposed Language: And the salary for the Council Members is hereby established at
$275.00 per month plus an additional $25 for any additional Council
meeting(s) and workshop(s) attended; and
Ordinance #52 - Section 3. Site Maintenance Fee.
Subsection 1.
Currently Reads:
A $215 Site Maintenance Fee shall be placed in escrow to the City at
the time that a building permit is issued.

Proposed Language: A Site Maintenance Fee shall be placed in escrow to the City at the
time that a building permit is issued. The escrow charges shall be
established according to the annual Fee Schedule approved by City
Council.
Subsection 2
Currently Reads: Contingent upon no City action being required to monitor and or clean
the site, $200 of the Site Maintenance Fee will be refunded to the
property owner at such time that construction on the parcel has ceased,
and the construction site is free of rubbish, debris and excess
construction materials.
Proposed Language: Contingent upon no City action being required to monitor and or clean
the site, the escrow amount as established per the annual Fee Schedule
shall be refunded to the individual/company that originally supplied
the escrow fee along with the building permit less an administration
fee also established per the annual Fee Schedule as per Section 4,
subsection 4 of this Ordinance, such time that construction on the
parcel has ceased, and the construction site is free of rubbish, debris
and excess construction materials.
Section 4. Payment/Assessment of Costs.
Subsection L
Currently Reads: The cost for any action taken by the City to monitor or clean the site
will be deducted from the Maintenance Fee. Should the costs for City
action exceed $200.00 the property owner will be billed for the excess.
Proposed Language: The cost for any action taken by the City to monitor or clean the site

action exceed the escrow fee established by the Fee Schedule, the

AND MAYOR FOR THE CITY OF CENTERvn.LE, ANOKA COUNTY,
MINNESOTA
The City Council of the City of Centerville ordains:
The City of Centerv:ille, a statu10ry city has adopted an ordinance to fix their own salaries
as members of the governing body and the salary of the elected officer of the City, in
such amount, as they deem reasonable;
The City Council consists of the Mayor and four Council members. The City Connci1
holds regular meetings as prescribed by its rules; and special meetings that may be called
by the MByor or by any two (2) members of a five-member Council by writing filed with
the CleIk who shall then mail a notice to all the members of the time and place of
meetings at least one day before the meeting;
It is the obligation of each elected official to attend regular and special meetings and; the
Council may compel the attendance of members. There will be no penalty for members
missing less than three (3) meetings per year; thereafter a missed meeting will result in
the loss of that meetings pay.

AN ORDINANCE REGULATING TIIE SiTE MAINTENANCE ON PARCELS OF PROPERTY ON
WIDCH NEW RESIDENTIAL, COMMERCIAL, OR INDUSTRIAL CONSTRUCTION IS IN
PROCESS.
The City Council of the City of Centerville does ordain:
SECTION I. CONTAINMENT OF DEBRIS.
Subsection I.
On parcels which construction is being taken place, the property owner shall be responsible to
contain all rubbish, debris and excess construction material within the construction site
SECTION 2. REMOVAL OF DEBRIS.
Subsection 1.
The property owner is responsible to remove all rubbish, debris and excess construction material
from the construction site hi-weekly.
Subsection 2.
In the event the property owner fuils to contain or remove rubbish, debris and/or excess
constructiou material, the City shall be authorized to clean the premises and the property owner
shall be responsible for the cost thereof.
SECTION 3. SiTE MAINTENANCE FEE.

SECTION 4. PAYMENT/ASSESSMENTOF COSTS.
Subsection l.
The cost for any action taken by the City to monitor or clean the site will be deducted from the

Subsection 2.
A Certificate of Occupancy will not be issued for newly constructed bnildings until such bill is
paid in full.
Subsection 3.
On or before September I of each year, the City Clerk shaUlist the total unpaid cbarges for
monitoring and removal of rubbish, debris and/or excess construction materials against each
separate lot or parcel to which they are attributable under this ordinance. The council may then
spread the asses'lIDent charges against the property benefited as a special assessment under
Minnesota Statutes, Section 429.10 1 and other pertinent statutes for certification to the County
Auditor and collection along with the corrent taxes the following year.

SECTION 5. PENALTY.
Any person who violates, disobeys, omits, neglects or refuses to comply with the provisions of
this ordinance sball be gniIty of a petly misdemeanor and upon conviction shall be punished as
defined by State Statute.

Dear Mr. Martin:
Recently, the City received a complaint in regards to debris (ladders, hoses, lawnmowers,
etc.) located near your garage in your yard. The Chief Building Official and Zoning
Administrator both deem this to be a nuisance and a violation of Ordinance #6. I have
enclosed Ordinance #6 and Ordinance #6A for your reference.
Ordinance #6A, Section 6, #1 of the ordinance reads: Whenever the Zoning
Administrator or Chief Building Official finds with reasonable certainty that a public
nuisance exists on any public or private property in the City of Centerville, he shall notify
the affected property owner by personal service or by certified mail that the nuisance
must be abated within a reasonable time, not less than twenty (20) days from the date of
service of the notice. Service by certified mail shall be deemed complete upon mailing.
The order shall state with specificity the nature of the violations and the requirements for
compliance. The order shall also state that the property owner may, within twenty (20)
days of the date of the order request a hearing before the Hearing Examiner and shall set
out the procedure by which that hearing may be requested The order shall also state
that failure to abate the nuisance or request a hearing within the applicable time periods
will result in summary abatement procedures, and that the cost of abatement will be
assessed against the subject property. Upon expiration of the time required by the notice,
the zoning Administrator or Chief Building Official may abate the nuisance unless a
request for a hearing has been timely filed
Ordinance #6A, Section 6, #2 of the ordinance reads: Any property owner who feels
aggrieved by an order of the Zoning Administrator or Chief Building Official issued
pUrsuant to this ordinance may request a hearing before the Hearing Examiner. Such
request shall be filed in writing with the office of the City Clerk within twenty (20) days
after service of the notice by. the Zoning Administrator or Chief Building OfficiaL The
City Clerk shall notify the Hearing Examiner who shall notify the property owner of the
date, time and place of the hearing. The hearing shall be conducted no more than ten
(10) days after the Hearing Examiner receives notice of the request, unless a later date is

Here is a cUp from the City's Zoning Map and find the attached Compo Plan Map.
It is difficult to tell from the Comp, Plan Map but it supersedes the Zoning Map.
The Compo Plan does not show any area north of Main Street but the Zoning Map does.
The Compo Plan does not show any past Goiffon Road toward the lake and the Zoning Map does,
The Compo Plan does not show Clearwater Road (which is really not a road) at all - hard to detemine where the
cut off Is on that side.
The Compo Plan shows on the other side of Heritage Street (South of Heritage) but the Zoning Map does not.

I have researched some of the old records that were stored at the Public Works site in
regards to the City's Compo plans. I was able to find a 1980 compo plan and it appears.
that it was adopted by Council on June 2, 1982. An update was approved in 1989 and the
current compo plan was completed in 1997.
Further research needs to be done to ensure that appropriate public hearings were held to
make modifications between the first Comprehensive Plan and the Update. It appears
that there were numerous joint meetings between several members of Planning and
Zoning, Council, Parks and Rec. and the Economic Development Task Force prior to the
update in 1989 with a public hearing held at the Plarming and Zoning level.
There are questions regarding the M-1 district and its inception, in 1980 it was B-1 and a
much smaller area; 6805 - 20fu Avenue South, a compo plan amendment in 1986 to
rezone from commercial to industrial with the updated compo plan in 1989 notes stating
that it was Council's desire to revert the zoning back to B-1; and Uptown Center
currently not reflecting a compo plan amendment in 1987 from R-2 to B-1 even though
there was a residence on the property until several years ago (2000).
In 1995 legislature was modified requiring a City's compo plan to supersede their zoning
map and ordinances in whole or part that contradicted their compo plan would be need to
be modified accordingly. This may have something to do with timing of amendments,
review and approval of Met. Council and requirements needed for same.
I will be in contact with Met. Council to gather additional information that they may have
regarding amendments and what is currently on file with them in an attempt to correct
any inaccuracies with the current compo plan and the current zoning map.

Honorable Mayor and Council,
I received a call from a resident requesting clarification on where their property feel
regarding zoning classification. Within researching this issue I was made aware of the
differences between our Zoning Map and our Comp Plan.
I have requested this item be added to our next agenda and Teresa is looking into this
with Tom Peterson. Apparently our Zoning map and our Comp Plan do not match in several
areas. If zoning changes had been approved without Comp Plan amendments the Comp Plan is
the legal document. Teresa will check if amendments had been voted on and made without
the simple changing of the actual paper copy of the document.
One of the main areas of the City affected is the downtown properties as more is listed on
the Zoning Map as MI than is listed on the Comp Plan.

AGREEMENT FOR RESIDENTIAL RECYCLING PROGRAM
TIDS AGREEMENT made and entered into on 16th day of December, 2003,
notwithstanding the date of the signatures of the parties, between the COUNTY OF ANOKA,
State of Minnesota, hereinafter referred to as the "COUNTY", and the CITY OF
CENTERVllLE, hereinafter referred to as the "MUNICIPALITY".
WITNESSETH:
WHEREAS, Anoka County has received $708,603 in funding from the Solid Waste
Management Coordinating Board and the State of Minnesota pursuant to Minn. Stat. ~ 11SA.5S7
(hereinafter "SCORE funds"); and
WHEREAS, the County wishes to assist the Municipality in meeting recycling goals
established by the Anoka County Board of Commissioners by providing said SCORE funds to
cities and townships in the County for solid waste recycling programs.
NOW, THEREFORE, in consideration of the m\ltual covenants and promises contained
in this Agreement, the parties mutually agree to the following terms and conditions:
1. PURPOSE. The purpose of this Agreement is to provide for cooperation between the
County and the Municipality to implement solid waste recycling programs in the
Municipality.
2. TERM. The term of this Agreement is from January I, 2004 through December 31,
2004, unless earlier terminated as provided herein.
3. DEFINITIONS.
a, "Problem material" shall have the meaning set forth in Minn. Stat. ~ lISA.03,
subdivision 24a.
b. "Multi-unit households" means households within apartment complexes,
condominiums, townhomes, mobile homes and senior housing complexes.
c. "Opportunity to recycle" means providing recycling and curbside pickup or
collection centers for recyclable materials as required by Minn. Stat. ~ 1ISA.5S2.
d. "Recycling" means the process of collecting and preparing recyclable materials
and reusing the materials in their original form or using them in manufacturing
processes that do not cause the destruction of recyclable materials in a manner
that precludes further use.
e. "Recyclable materials" means materials that are separated from mixed municipal
solid waste for the purpose of recycling, including paper, glass, plastics, metals,
fluorescent lamps, major appliances and vehicle batteries.
f. Refuse derived fuel or other material that is destroyed by incineration is not a
recyclable material.

g. "Yard waste" shall have the meaning set forth III Minn. Stat. ~ 1l5A.03,
subdivision 38.
4. PROGRAM. The Municipality shall develop and implement a residential solid waste
recycling program adequate to meet the Municipality's annual recycling goal of 300 tons
of recyclable materials as established by the County. The Municipality shall ensure that
the recyclable materials collected are delivered to processors or end markets for
recycling.
a. The Municipal recycling program shall include the following components:
i. Each household (including multi-unit households) in the Municipality
shall have the opportunity to recycle at least four broad types of materials,
such as paper, glass, plastic, metal and textiles.
11. The recycling program shall be operated in compliance with all applicable
federal, state, and local laws, ordinances, rules and regulations.
111. The Municipality shall implement a public information program that
contains at least the following components:
(1)' One promotion is to be mailed to each household focused
exclusively on the Municipality's recycling program;
(2) One promotion advertising recycling opportunities available for
residents is to be included in the Municipality's newsletter or local
newspaper; and
(3) Two community presentations are to be given on recycling.
The public information components listed above must promote the
focused recyclable material of the year as specified by the County. The
County will provide the Municipality with background material on the
focused recyclable material of the year.
IV. The Municipality, on an ongoing basis, shall identify new residents and
provide detailed information on the recycling opportunities available to
these new residents.
b. If the Municipality's recycling program did not achieve the Municipality's
recycling goals as established by the County for the prior calendar year, the
Municipality shall prepare and submit to the County by March 31, 2003, a plan
acceptable to County that is designed to achieve the recycling goals set forth in
this Agreement.
5. REPORTING. The Municipality shall submit the following reports semiannually to the
County no later than July 20, 2004 and January 20, 2005:
a. An accounting of the amount of waste which has been recycled as a result of the
Municipality's activities and the efforts of other community programs, redemption
centers and drop-off centers. For recycling programs, the Municipality shall
certify the number of tons of each recyclable material which has been collected
and the number of tons of each recyclable material which has been marketed. For
recycling programs run by other persons or entities, the Municipality shall also
provide documentation on forms provided by the County showing the tons of
materials that were recycled by the Municipality's residents through these other

programs. The Municipality shall keep detailed records documenting the
disposition of all recyclable materials collected pursuant to this agreement. The
Municipality shall also report the number of cubic yards or tons of yard waste
collected for composting or landspreading, together with a description of the
methodology used for calculations. Any other material removed from the waste
stream by the Municipality, i.e. tires and used oil, shall also be reported
separately.
b. Information regarding any revenue received from sources other than the County
for the Municipality's recycling programs.
c. Copies of all promotional materials that have been prepared by the Municipality
during the term of this Agreement to promote its recycling programs.
The Municipality agrees to fumish the County with additional reports in form and at
frequencies requested by the County for financial evaluation, program management
purposes, and reporting to the State of Minnesota.
.. .6. BILLING AND PAYMENT PROCEDURE. The Municipality shall submit itemized
invoices semiannually to the County for abatement activities no later than July 20, 2004
and January 20, 2005. Costs not billed by January 20, 2005 will not be eligible for
funding. The invoices shall be paid in accordance with standard County procedures,
subject to the approval of the Anoka County Board of Commissioners.
7. ELIGmlLITY FOR FUNDS. The Municipality is entitled to receive reimbursement
for eligible expenses, less revenues or other reimbursement received, for eligible
activities up to the project maximum as computed below, which shall not exceed
$28,467.06. The project maximum for eligible expenses shall be computed as follows:
a. A base amount of $10,000.00 for recycling activities only;
b. $4.51 per household for recycling activities only; and
c. unexpended funds carried over from the Municipality's 2003 allocation.
8. RECORDS. The Municipality shall maintain financial and other records and accounts in
accordance with requirements of the County and the State of Minnesota. The
Municipality shall maintain strict accountability of all funds and maintain records of all
receipts and disbursements. Such records and accounts shall be maintained in a form
which will permit the tracing of funds and program income to final expenditure. The
Municipality shall maintain records sufficient to reflect that all funds received under this
Agreement were expended in accordance with Minn. Stat. ~ 1I5A.557, subd. 2, for
residential solid waste recycling purposes. The Municipality shall also maintain records
of the quantities of materials recycled. All records and accounts shall be retained as
provided by law, but in no event for a period of less than five years from the last receipt
of payment from the County pursuant to this Agreement.

9. AUDIT. Pursuant to Minn. Stat. S 16C.OS, the Municipality shall allow the County or
other persons or agencies authorized by. the. County, and the State of Minnesota,
including the Legislative Auditor or the State Auditor, access to the records of the
Municipality at reasonable hours, including all books, records, documents, and
accounting procedures and practices of the Municipality relevant to the subject matter of
the Agreement, for purposes of audit. In addition, the County shall have access to the
project site(s), if any, at reasonable hours.
10. GENERAL PROVISIONS.
a. In performing the provisions of this Agreement, both parties agree to comply with
all applicable federal, state or local laws, ordinances, rules, regulations or
standards established by any agency or special governmental unit which are now
or hereafter promulgated insofar as they relate to performance of the provisions of
this Agreement. In addition, the Municipality shall comply with all applicable
requirements of the State of Minnesota for the use of SCORE funds provided to
the Municipality by the County under this Agreement.
b. No person shall illegally, on the grounds of race, creed, color, religion, sex,
marital status, public assistance status, sexual preference, handicap, age or
national origin, be excluded from full employment rights in, participation in, be
denied the benefits of, or be otherwise subjected to unlawful discrimination under
any program, service or activity hereunder. The Municipality agrees to take
affirmative action so that applicants and employees are treated equally with
respect to the following: employment, upgrading, demotion, transfer, recruitment,
layoff, termination, selection for training, rates of pay, and other forms of
compensation.
c. The Municipality shall be responsible for the performance of all subcontracts and
shall ensure that the subcontractors perform fully the terms of the subcontract.
The Agreement between the Municipality and a subcontractor shall obligate the
subcontractor to comply fully with the terms of this Agreement.
d. The Municipality agrees that the Municipality's employees and subcontractor's
employees who provide services under this agreement and who fall within any job
classification established and published by the Minnesota Department of Labor &
Industry shall be paid, at a minimum, the prevailing wages rates as certified by
said Department.
e. It is understood and agreed that the entire Agreement is contained herein and that
this Agreement supersedes all oral and written agreements and negotiations
between the parties relating to the subject matter hereof.
f. Any amendments, alterations, variations, modifications, or waivers of this
Agreement shall be valid only when they have been reduced to writing, duly
signed by the parties.

g. Contracts Jet and purchases made under this Agreement shall be made by the
Municipality in conformance with all laws, rules, and regulations applicable to the
Municipality.
h. The provisions of this Agreement are severable. If any paragraph, section,
subdivision, sentence, clause or phrase of this Agreement is for any reason held to
be contrary to law, such decision shall not affect the remaining portion of this
Agreement.
1. Nothing in this Agreement shall be construed as creating the relationship of co-
partners, joint venturers, or an association between the County and Municipality,
nor shall the Municipality, its employees, agents or representatives be considered
employees, agents, or representatives of the County for any purpose.
11. PUBLICATION. The Municipality shall acknowledge the fmancial assistance of the
County on all promotional materials, reports and publications relating to the activities
funded under this Agreement, by including the following acknowledgement: "Funded by
the Anoka County Board of Commissioners and State SCORE funds (Select Committee
on Recycling and the Environment).
12. INDEMNIFICATION. The County agrees to indenmify, defend, and hold the
Municipality harmless from all claims, demands, and causes of action of any kind or
character, including the cost of defense thereof, resulting from the acts or omissions of its
public officials, officers, agents, employees, and contractors relating to activities
performed by the County under this Agreement.
The Municipality agrees to indemnify, defend, and hold the County harmless from all
claims, demands, and causes of action of any kind or character, including the cost of
defense thereof, resulting from the acts or omissions of its public officials, officers,
agents, employees, and contractors relating to activities performed by the Municipality
under this Agreement.
The provisions of this subdivision shall survive the termination or expiration of the term
of this Agreement.
13. TERMINATION. This Agreement may be terminated by mutual written agreement of
the parties or by either party, with or without cause, by giving not less than seven (7)
days written notice, delivered by mail or in person to the other party, specifying the date
of termination. If this Agreement is terminated, assets acquired in whole or in part with
funds provided under this Agreement shall be the property of the Municipality so long as
said assets are used by the Municipality for the purpose of a landfill abatement program
approved by the County.

Hello Everyone,
Based on a discussion I had with Lyndon yesterday we have decided to cancel the PMT
meeting we had scheduled for tomorrow. I will let everyone know when it is re-scheduled.
We have gotten some direction from the Centerville Park and Ree on trails within the city.
This needs to be brought before the city council - Kim please let us know what happens
with this.
We also still need to meet with the Centerville Council in a workshop format to go through
the options prior to showing something at the next public information meeting which we
would like to hold in October.
We received some information from Mike Kelly on estimated market values from the tax roles
to help evaluate taking the north side or south side through the downtown area. We will
have this info tabulated when we next meet.

RE: Driveway Patch
Here is a brief history first before I address my question. In
July of 2003 I had my driveway re-constructed with new
base material and blacktop with flairs on the street end. In
July of 2004, as part of the Street and Water project, a
portion of my driveway was removed. In August of 2004
my driveway was patched, but without flairs. It is my
understanding and the Best Business Practice to replace
back to the original state.
My question is why was my driveway patched
without Flairs?

Trails for County 14 Reconstruction

The following information is from Parks & Recreation Vice-Chairperson LeBlanc, who met with Mr.
Nick Eoloff from Anoka County Parks on September 1, 2004. The purpose of the meeting was to
discuss the county's trail plans with the reconstruction of County Road 14 and how that fits in with the
Parks & Recreation Committee's Trail Plan.
'i Per Mr. Eoloff, the intersection ofCenterville Road and County 14 is proposed to be controlled with a
,
stop light. From the intersection of County Road 14 and Centerville Road going east, there will be a
sidewalk on the north of County Road 14 to 20th Avenue. On the south of County Road 14 going east,
there will be a trail to the freeway.
West of the CenterviIle Road and County 14 intersection, Mr. Eoloff suggests a 10 feet wide trail on
the Centerville Lake side of the road going to Wargo Nature Center. The fishing pier on Peltier Lake is
proposed to be moved north to the dam and boat launch area near the Rice Creek Outlet. This is also
near the Peltier Lake Bridge Outlet.
At the boat launch/fishing pier the trail will be on the south (west) side of County 14 and the boat
launch/fishing pier will be on the north (east) side of County Road 14. The county plans include a
possible underpass for the trail at the boat launch area so trail users will not have to cross County Road
14. Mr. Eoloff suggests residents north of the Centerville Elementary School in the Lakeland Hills
development use the trail through the school to get to the controlled intersection at CenterviIle Road
and County 14. Mr. Eoloff will look at striping or something similar for residents on Peltier Lake
Drive to get to the trail from Peltier Lake Drive.
A decision needs to be made on the area west of Centerville Road. Mr. Eoloff suggests a 10 foot wide
trail on the south (and west) and no sidewalk on the north (and east) side of County Road 14. The
engineers could put a sidewalk there, but then the trail would have to be g feet wide and there just isn't
enough room for both the sidewalk and the trail. Vice-Chairperson LeBlanc suggested to the Parks. &
Recreation Committee that there is more value in having a good trail along the south (and west) side of
County Road 14 without a sidewalk on the north (and east), than to have a mediocre trail with a
sidewalk of minimal value. Vice-Chairperson LeBlanc also felt the committee should recommend a 10
foot wide trail east of 20th Avenue. Mr. Eoloff would like a recommendation from the Parks and
Recreation Committee on this option.
Motion was made by Vice-Chairperson LeBlanc, seconded by Committee Member Seeley to
recommend to City Council that the City of Centerville r~uest a 10 foot wide trail be installed
on County Road 14 from Centerville Road on the south (and west) side to at least Wal1lo Natnr~
Center. A sidewalk on the north (and east) side of County 14 is not recommended as it would
cause the trail to be narrower and reduce the usefnlness of the trail. It is highly desirable to have
a 10 foot wide trail east of 20th Ave to the freeway that would eventually Nmnt't>t with the 10 foot
:Wide re2ional trail which goes through the Chain of Lakes Regional Park. All in favor. Motion
carried unanimously. -

In our phone conversation on August 24, 2004, you agreed to excavate a swale to drain the low area
behind the townhomes on Ojibway Drive. This fax will serve as the Agreement between Sharper Homes

The work that is necessary to solve the drainage problem includes:

-Sharper to protect or replace sprinkler heads and water lines disturbed by the work.
-Stakes will be provided by Bonestroo surveyors- every 25', 7' offset from centerline, cuts to finished

Dear Property Owner:
There are two transportation activities that are taking place in your general area, which may be of significance to you.
Both are described below, as well as on the enclosed map.
First, the County has just completed the first phase of the County Road 14 (Main Street) study in Lino Lakes and
Centerville. The goal of the study was to determine a preferred aligument of County Road 14 between I-35W and 1-
35E. It was determined that the existing aligument will be maintained; however, there will be some lanes added as the
road passes throngh downtown Centerville. Construction is anticipated for 2006 or 2007.
Second, while working in cooperation with the local communities and Mn/DOT on this project, one issne became
clear: Because County Road 14 currently is the only existing connection between I-35W and I-35E, planned growth
. in the area would put more pressure on the County Road 14 corridor than it could handle, unless roads were added
between 1-35W and 1-35E. As a result, during the public meetings about County Road 14, we also asked residents alld
businesses to consider how alternate routes could be developed to meet this need.
The alternative chosen is now proposed north of the existing County Road 14 aligument, and north of the Rice Creek
Chain of Lakes Park. A copy of this alternative is shown on the map enclosed with this letter. It is verv important to
understand that this is a future need (20 - 30) vears frorn now--NOT somethinl! that is needed today. It is also
important to understand that the schematics of this alternate as shown on the attached map are conceptual in nature as
far as the exact location of the future roadway and interchanges are concerned.
At this time there is no funding available to construct such a northerly bY-pass. However, due to the very high costs
of land and road construction, it is important for your commUjlity, neighboring communities, the County and
Mn/DOT to begin planning for this needed road in order to provide the for future safety, capacity and mobility on our
roadways. Just as important is making certain that the public, you and your neighbors, are aware of the need for this
road in the future.
TIlls future northerly bypass road will be discussed many more times in the coming years as sUlTounding
communities start seeing development occur in the area. Meanwhile, if you have any questions or concerns,
