SUBJECT: Concerns regarding Pine Trees, Drainage, Fence Posts and Holes from Removal of Trees - Outlot DATE: July 28, 2004 Mr. Van Houdt contacted me today regarding a recent memo that was forwarded to him. The memo is the same as what is in Council's packet. Mr. Van Houdt also left a message for Ms. Moore-Sykes; however, Ms. Moore-Sykes is ill and unable to attend this evenings meeting. Mr. Van Houdt is concerned that if these items are not taken care of, the Twin Homes will be responsible for them and they feel that they never agreed to incur the expenses associated with same and do not have the financial capability to do so. Swift Construction/Sharper Homes recently fIled a Quit Claim Deed/Warranty Deed with Anoka County transferring ownership to the association. Mr. Palzer, Mr. Peterson and Mr. Quigley inspected the property prior to this filing (6/14/04). To Mr. Van Houdt's knowledge, the association did not participate in the decision making process regarding the 20' to 25' foot pine tree buffer and deviating from the original grading plan. Mr. Van Houdt stated that he has done a little research on the internet regarding the life span of the pine trees located in the area of question. Mr. Peterson had reported that they are Blue Spruce and do not have a long life expectance. Mr. Van Houdt disagrees and states that typically Blue Spruce will survive in good soil for approximately 90 - 200 years. Mr. Van Houdt states that since Swift Construction/Sharper Homes was last out on the site to remove some fence posts and dead trees, two (2) additional trees have turned brown and are suspected of being near death or are dead. Mr. Van Houdt requests that Council (withhold escrows - if allowable) or demand that these items be remedied. I received a recent memo from Tom Peterson and Bonestroo Rosene Anderfik that describes what is going to be done to correct this ongoing issue. I was disappointed to read that the drainage issue would not be resolved. As I review the past correspondence I have regarding this problem I'm disappointed that Tom Peterson is changing his opinion as to what really needs to be done to correct this problem. I have a past memo that was sent to then City Administrator Jim March from Tom Peterson. In that memo Tom did recognize a drainage problem that he felt need to be corrected. Why wasn't it??? The city is responsible for inspecting all lot grading. Why is his changing his mind? It cannot be to save the pine trees in this area, because they are now dying due to excessive water damage. If saving the trees is a priority then maybe the trees should be temporarily removed, the grading re-done, and the trees put back, which is what was done during the Eagle Pass construction. I watched them do this. I fact they forgot to put some of the trees back and left them to die. As far as the drainage issues I have. I experience standing water every spring due to this problem. This year alone there was standing water from March through mid May. I had to deal with the stench associated with rotting weeds that are now more than 6 feet tall. Misquotes are so dense that it makes it difficult for me to enjoy the back yard that I pay a great deal of money for and continue to pay taxes on, which I might add are still among the highest in the state. Please tell me that something more can be done! Thank you! The Notice of January 7, 2004 states improvements will be made to Peterson Trail from Fox Run to 73rd Street. The mill & overlay did NOT extend to 73rd Street. We are concerned that we will be assessed for work that was not performed. Temporary Membrane structures shall not be located within 20 feet from property lines, buildings, other temporary structures, parked vehicles, or internal combustion engines. For the purpose of determining required distances, support ropes and guy wires shall be considered as part of the membrane structure, tent or canopy. MSFC Chapter 24 Section 2403.2 l · Flame Resistant treatment. Before a permit is granted, the owner or agent shall file with the code official a certificate executed by an approved testing laboratory, certifying that the tent, air-supported, air-inflated or tensioned membrane structure and their appurtenances, sidewalls, drops and tops of temporary membrane structures, canopies, tarpaulins, floor coverings, bunting, combustible decorative materials and effects, including sawdust when used on floors or passageways, shall be composed of flame resistant materials or shall be treated with a flame retardant in an approved manner and meet the requirements for flame resistance in accordance with NFPA 701. MSFC Chapter 24 Section 2406.1 . Temporary membrane structures, tents or canopies shall have a permanently affixed label bearing the identification of size and fabric or material. MSFC Chapter 24 Section 2406.2 · An affidavit or affirmation shall be submitted to the code official and a copy retained on the premises on which the tent or air-supported structure is located. The affidavit shall attest to the following information relative to the flame resistance of the fabric: 1. Names and addresses of the owners of the tent or air- supported structure. 2. Date the fabric was last treated with the flame-resistant solution. 3. Trade name or kind of chemical used in treatment. 4. Name of person or firm treating the material. 5. Name of testing agency and test standard by which the fabric was tested. MSFC Chapter 24 Section 2406.3 · Hay, straw, shavings or similar combustible materials shall not be located within any tent or air-supported structure containing an assembly occupancy. Sawdust and shavings utilized for a public performance or exhibit shall not be prohibited provided the sawdust and shavings are kept damp. Combustibles materials shall not be permitted under stands or seats at any time. Combustible materials and vegetation that could create a fire hazard shall maintained clear of the structure by 20 feet. MSFC Chapter 24 Section 2406.4 . Smoking shall not be permitted in tents or air supported structures. Approved "NO SMOKING" signs shall be conspicuously posted in accordance with Section 310. MSFC Chapter 24 Section 2406.5 . Open Flame or other devises emitting flame, fire or heat or any flammable or combustible liquids, gas, charcoal or other cooking device or any other unapproved devices shall not be permitted inside or located within 20 feet of the tent while open to the public. MSFC Chapter 24 Section 2406.6 . Fireworks shall not be used within 100 feet of structure. MSFC Chapter 24 Section 2406.7 . Spot or effect lighting shall only be by electricity, and all combustible construction located within 6 feet of such equipment shall be protected with approved noncombustible insulation not less than 9.25 inches thick. Persons utilizing a torch or other flame-producing device for removing paint from a struc- ture shall provide a minimum of one portable fire extingnisher complying with Section 906 and with a minimum 4-A rating, two portable fire extingnishers, each with a minimum 2-A rat. ing, or a water hose connected to the water supply on the pre- mises where such burning is done. The person doing the burning shall remain on the premises I hour after the torch or flame-prodUCing device is utilized. 308.4.1 Approval. A permit in accordance with Section 105.6 shall be secured from the code official prior to the uti- lization of a torch or flame-producing device to remove paint from a structure. 308.5 Open-flame devices. Torches and other devices, ma- chines or processes liahle to start or cause fire shall not be oper- ated or used in or upon hazardous fire areas, except by a permit in accordance with Sectiou 105.6 secured from the code offi. cial. Exception: Use within inhabited premises or designated campsites which are a minimum of 30 feet (9144 rom) from grass-. grain-, brush- or forest-covered areas. 308.5.1 Signals and markers. Exception: The proper use of fusees at the scenes of emergencies or as required by standard railroad operat- ing procedures. 28 GENERAL PRECAUTIONS AGAINST FIRE 308.5.2 Portable fueled open.flame devices. Portable open-flame devices fueled by flammable or combustible gases or liquids shall be enclosed or installed in such a man- ner as to prevent the flame from contacting combustible ma- terial. Exceptions: 1. LP-gas-fueled devices used for sweating pipe joints or removing paint in accordance with Chap- ter 38. 2. Cutting and welding operations in accordance with Chapter 26. 3. Torches or flame-prodUCing devkes in accordance with Section 308.4. 4. Candles and open-flame decorative devices in ac- cordance with Section 308.3. SECTION 309 POWERED INDUSTRIAL TRUCKS 309.1 General: Powered industrial tmcks shall be operated and maintained in accordance with this section. 309.2 Battery chargers. Battery chargers shall be of an ap- proved type. Combustible storage shall be kept a minimum of3 feet (915 rum) from battery chargers. Battery charging shall not be conducted in areas accessible to the public. 309.3 Ventilation. Ventilation shall be provided in an approved manner in battery-charging areas to prevent a dangerous accu- muJation of flammable gases. 309.4 Fire extinguishers. Battery-charging areas shall be pro- vided with a fire extinguisher complying with Section 906 hav- ing a minimurn4-A:20-B:C ratiog within 20 feet (6096 rum) of the battery charger. 309.5 Refueling. Powered industrial tmcks using liquid fuel or LP-gas shall be refueled outside of buildings or in areas specifi- cally approved for that purpose and in accordance with Chapter 34 or 38. 309.6 Repairs. Repairs to fuel systems, electrical systems and repairs utilizing open flame or welding shall be done in ap- proved locations outside of buildings or in areas specifically approved for that purpose. !.sr:cTioi\f3tO'i ~., """--<""'U"""~__'" . \;._~~PJq~(j;; 310.1 General. The smoking or carrying of a lighted pipe, ci- gar, cigarette or any other type of smoking paraphernalia orma- terial is prohibited in the areas indicated in this section. 310.2 Prohibited areas. Smoking shall be prohibited where conditions are such as to make smoking a hazard, including areas of piers, wharves. warehouses, stores, industrial plants, institutions, schools, assembly occupancies and in spaces where combustible materials are stored or handled, except in approved designated smoking areas. 310.3 "No Smoking" signs. The content, lettering, size, color and location of reqnired . "No Smoking" signs shall be approved. 310,4 Removal of signs prohibited. A posted "No Smoking" sign shall not be obscured, removed, defaced. mntilated or de- stroyed. 310.5 Compliance with ''No Smoking" signs. Smoking shall not be permitted nor shall a person smoke, throw or deposit any lighted or smoldering substance in any place where "No Smoking" signs are posted. 310.6 Ash trays. Where smoking is permitted, suitable noncombustible ash trays or match receivers shall be provided on each table and at other appropriate locations. 310.7 Burnlng objects. Ligbted matches, cigarettes, cigars or other burning object shall not be discarded in such a manner that could cause ignition of other combustible material. 310.8 Hazardous environmental conditions. When the code official determines thar hazardous environmental conditions necessitate controlled use of smoking materials, the ignition or use of such materials in mountainous, brush-covered or forest- covered areas or other designated areas is prohibited except in approved designated smoking areas. SECTION 311 VACANT PREMISES 311.1 General. Temporarily unoccupied buildings, structures, premises or portions thereof, including tenant spaces, shall be safeguarded and maintained in accordance with this section. 311.1.1 Abandoned premises. Buildings, structures and premises for which an owner cannot be identified or located by dispatch of a certificate of mailing to the last known or registered address, which persistently or repeatedly become unprotected or unsecured, 'which have been occupied by un- authorized persons or for illegal purposes. or which present a danger of structural collapse or fire spread to adjacent properties shall be considered abandoned, declared unsafe and abated by demolition or rehabilitation in accordance with the Interlu1tional Property Maintenance Code and the International Building Code. 311.1.2 Tenant spaces. Storage and lease plans required by this code shall be revised and updated to reflect temporary or partial vacancies. 311.2 Safegnarding vacant premises. Temporarily unoccu- pied buildings, structures, premises or portions thereof shall be secured and protected in accordance with this section. 311.2.1 Security. Exterior openings and interior openings accessible to other tenants or unauthorized persons shall be boarded, locked, blocked or otherwise protected to .prevent entry by unauthorized individuals. 311.2.2 Fire protection. Fire alarm, sprinkler and standpipe systems shall be maintained in an operable condition at all times. Exceptions: 1. When the premises have been cleared of all com- bustible materials and debris and, in the opiniou of the code official, the type of construction, fire sep- 2000 INTERNATIONAL FIRE COOE@ 310.4 - 312.2 aration distance and security of the premises do not create a fire hazard. 2. Where buildings will not be heated and fire protec- tion systems will be exposed to freezing tempera- tures, fire alarm and sprinkler systems are permitted to be placed out of service and standpipes are permitted to be maintained as dry systems (without an automatic water supply) pro- vided the building has no contents at storage, and windows, doors and other openings are secured to prohibit entry by unauthorized persons. 311.2.3 Fire separation. Fire-resistance-rated partitions. fire barriers, and fire walls separating vacant tenant spaces from the remainder of the building shall be maintained. Openings, joints, and penetrations in fire-resistance-rated assemblies shall be protected in accordance with Chapter 7. 311.3 Removal of waste. Persons owning, or in charge or con- trolof. a vacant building or portion thereof, shall remove there- from all accumulations of flammable or combustible waste or rubbish and shall securely lock or otherwise secure doors, win- dows and other openings to prevent entry by unauthorized per- sons. The premises shall be maintained clear of waste or hazardous materials. Exceptions: 1. Buildings or portions of buildings undergoing addi- tions, alterations, repairs, or change of occupancy in accordance with the Interlu1tional Building Code, where waste is controlled and removed as reqnired by Section 304. 2. Seasonally occupied buildings. 311.4 Removal of hazardous materials. Persons owning or having charge or contrul of a vacant building shall remove all combustible and hazardous materials, and submit a facility clo- sure plan in accordance with Section 407.7. Exception: This section shall not apply to materials in heat- ing, air-conditioning, and refrigeration systems installed in accordance with Chapter 6 or exempted therein. . SECTION 312 VEHICLE IMPACT PROTECTION 312.1 General. Vehicle impact protection required by this code shall be provided by posts that comply with Section 312.2 or by other approved physical barriers that comply with Sec- tion 312.3. 312.2 Posts. Guard posts shall comply with all of the following requirements: 1. Constructed of steel not less than 4 inches (102 rom) in . diameter and concrete filled. 2. Spaced not more than 4 feet (1219 mID) between posts on center. 3. Set not less than 3 feet (914 mID) deep in a concrete foot- ing of not less than a IS-inch (381 mID) diameter. 4. Set with the top of the posts notless than 3 feet (9 14 mm) above ground. 29 Chapter 5 FIRE SERVICE FEATURES SECTION 501 GENERAL 501.1 Scope. Fire service features for buildings, structures and premises shall comply with this chapter. 5Q1.2 Permits. A permit shall be required as set forth in Sec- tions 105.6 and 105.7. 501.3 Construction documents. Construction documents for proposed fire apparatus access,locatiou of fire lanes and con- struction documents aM hydraulic calculations for fire hydrant systems shall be submitted to the fire department for review and approval prior to construction. 501.4 Timing of installation, When fire apparatus access roads or a water supply fot fire protection is required to be in- stalled, such protection shall be installed and made serviceable prior to and during the time of construction except wben ap- proved alternative methods of protection areprovided. Tempo- rary street signs shall be. installed at each street intersection when construction of new roadways allows passage by vehicles in accordance with Section 505.2. SECTION 502 DEFINITIONS 502.1 Definitions. The following words and terms shall, for the purposes of this chapter and as used elsewhere in this code, have the meanings shoWn herein. FIRE APPARATUS ACCESS ROAD. A road that provides fire apparatus access from a fire station to a facility, building or portion thereof, This is a general term inclusive of all other terms such as fire lane, public street, private street, parking lot lane and access roadway. FIRE COMMAND CENTER. The principal attended or un- attended location where the status of the detection, alarm com- munications, and control systems is displayed, and from which the system(s) can be manually controlled. FIRE DEPARTMENT MASTER KEY. A limited issue key of special or controlled design to be carried by fire department officials in command which will open key boxes on specified properties. FIRE LANE. A road or other passageway developed to allow the passage of fire apparatus. A fire lane is not necessarily in- tended for vehicular traffic other than fire apparatus. KEY BOX. A secure, tamperproof device with a lock operable only by a fire department master key; and containing building entry keys and other keys that may be required for access in an emergency. 2000 INTERNATIONAL FIRE CODE@ I;SECTIOr:,SOj' ... lfIREJI.{'PARATUS ACCESS RoAI5S 503.1 Where required. Fire apparatus access roads shall be provided and maintained in accordance with Sections 503.1.1 through 503.1.3. 503.1.1 Buildings and facilities. Approved fire apparatus access roads shall be provided for every facility, building or portion of a building hereafter constructed or moved into or within the jurisdiction. The fire apparatus access road shall comply with the requirements of this section and shall ex- tend to within 150 feet (45 720 rum) of all portions of.the fa- cility or any portion of the exterior wall of the first slory of the building as measured by an approved route around the exterior of the building or facility. Exception: The code official.;s authorized to increase the dimension of 150 feet (45 720 rum) where: . 1. The building is equipped thronghout with an ap- proved automatic sprinkler system installed in ac- cordance with Section 903.3.1.1, 903.n.2 or 903.3.1.3. 2. Fire apparatus access roads cannot be installed due to location on property. topography, waterways, non-negotiable grades or other similar conditions. and an approved alternative means of fire protec- tion is provided. 3. There are not more than two GroupR-3 or Group U occupancies. 503.1.2 Additional access, The code official is authorized to require more than one fire apparatos access road based on . the potentialfor impainnent of a single road by vehicle con- gestion, condition of terrain, climatic conditions or other . factors that could limit access. 503.1.3 IDgh-pUed storage. Fire department vebicleaccess to buildings used for high-piled combustible storage shall . comply with the applicable provisions of Chapter 23. 503.2 Specifications. Fire apparatos access roads shall be in- . stalled and arranged in accordance with Sections 503.2.1 through 503.2.7. 503.2.1 Dimensions. Fire apparatus access roads shall have . an unobstructed width of not less thso 20 feet (6096 rum), ' except for approved security gates in.accordance with Sec- . tion 503.6. and an onobstructed vertical clearsoce of not less : than 13 feet 6 inches (4115 rum). 503.2.2 Authority. The code official shall have the author- ity to require an increase .in the minimum access widths where they are inadequate for fire or rescue operations. 503.2.3 Surface. Fire apparatus access roads shall be de- sigoed and maintained to support the imposed loads of fire apparatus sod shall be surfaced so as to provide all-weather driving capabilities. 39 503.2.4 .,. 506.2 .' 503.2.4 Thrning radius. The required turning radius of a fire apparatus access road shall be determined by the code official. 503.2.5 Dead ends. Dead-end fire apparatus access roads in . 'excess of 150 feet (45 720 mm) in length shall be provided with an approved area for turning around fire apparatus. 503.2.6 Bridges and elevated surfaces. Where a bridge or an elevated surface is pilrt of a fire apparatus access road,. the bridge shall he constructed and maintained in accordance with AASHTO Standard Specification for Highway Bridges. Bridges and elevated sutfaces shall be designed for a live load sufficient to carry the imposed loads of fire appa- ratus. Vehicle load limits shall be posted at both entrances to bridges when required by the code official. Where elevated sutfaces designed for emergency vehicle use are adjacent to sutfaces which are not designed for such use, approved bar- riers,. approved sill1's or both shall be installed and main- tained when required by the code official. ,503.2.7 Grade. The grade of the fire apparatus access road shall be within the limits established by the code official based on the fire department's apparatus. 503.3 Marking. Where required by the code official, approved signs or other approved notices shall be provided for fire appa- ratus access roadS to identify such roadS or prohibit the obstruc- tion thereof. Signs or notices shall be maintained in a clean and legible conditional all times and be replaced or repaired when necessary to provide adequate visibility. 503.4 Obstruction oflire apparatus access roads. Fire appa- ratus access roads shall not be obstructed in any manner, in- cluding the parking of vebicles. The nrinimum widths and cleanmces established in Section 503.2.1 shall be maintained at all times. ' 503.5 Req1Jired gates or barricades. The code official is au- thorized to require the installation and maintenance of gates or other approved barricades across fire apparatus access roads, trails or other accessways, not including public streets, alleys or bighways. 5113.5.1 Secured gates and barricades. When required, gates and barricades shall be secured in an approved man- ner. Roads. trails and other access ways that have been closed and obstructed in the manner prescribed by Section 503.5 shall not be trespassed on or used unless authorized by the owner and the code official. Exception: Theresmction on use shall not apply tu pub- lic officers acting within the scope of duty. 503.6 Security gates. Where security gates are installed, they shall be maintained and an approved means of emergency oper- ation sball be provided and maintained. SECTION 504 ACCESS TO BUILDING OPENINGS AND ROOFS 504.1 Required access. Exterior doors and openings required by this code or the International Building Code sball be main- tained readily accessible for emergency access by the fire de- partment. An approved access walkway leading from fire 40 FIRE SERVICE FEATURES apparatus access roads to exterior openings shall be provided when required by the code official. 504,2 Maintenance of exterior doorll and openings. Exterior doors and their function shall not be eliminated without prior approval. Exterior doors that have been rendered nonfunctional and that retain a functional deor exterior appearance shall have a sign affixed'to the exterior side of the door with the words THIS DOOR BLOCKED. The sign shall consist ofletters hav- ing a principal stroke of not less than 0.75 inch (19.1 rom) wide and at least 6 inches (152 rom) bigh on a contrasting back- ground. Required fire department access doors shall not be ob- structed or eliminated. Exit and exit access doors shall comply with Chapter 10. Access doors for bigh-piled combustible stor- age shall comply with Section 2306.6.1. 5114.3 Stairway access to roof. New buildings four or more stories in height, except those with a roof slope greater than four Units vertical in 12 uuits horizontal (33.3-percent slope), shall be provided with a stairway to the roof. Such stairway shall be marked at street and floor levels with a sign indicating that the stairway continues to the roof. Where roofs are used for roof gardens or for other purposes, stairways shall be provided as required for such occupancy classification. e SECTION 505 PREMISES IDENTIFICATION 505.1 Address numbers. New and existing buildings shall have approved address numbers, building numbers, or ap- proved building identification placed in a position to be plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals or alphabet letters. Numbers shall be anrinimumof4 inches (102mm) bigh with a minimum stroke width of 0.5 inch (12.7 mm). . 505.2 Street or road signs. Streets and roads shall be identified with approved signs. TemporaIy signs shall be installed at each street intersection when construction of new roadways allows passage by vebicles. Signs shall be of an approved size. weather resistant and be maintained untilreplaced by permanent signs. SECTION 506 KEY BOXES 506.1 When required. Where access to or within a structure or an area is restricted because of secured openings or where im- mediate access is necessary for life-saving or fire-fighting pur- poses, the code official is authorized to require a key box to be installed in an accessible location. The key box shall be of an approved type and shall contain keys to gain access as required by the code official. 506.1.1 Locks. An approved lock shall be installed on gates or similar barriers when required by the code official. 506.2 Key box' maintenance. The operator of the building shall irilmediately notify the code official and provide the new key when a lock is changed or rekeyed. The key to such lock shall be secured in the key box. 2000 INTERNATIONAL FIRE CODE@ e Chapter 24 TENTS AND OTHER MEMBRANE STRUCTURES SECTION 2401 GENERAL 2401.1 Scope. Temporary tents, canopies. air-supported, air- inflated or tensioned membrane structures shall comply with this chapter. The provisions of Sections 2401.2 through 2401.7.1, and Sections 2403, 2404,2405,2409 and 2410 are applicable only to temporary membrane structures. All other provisions are applicabl.e to temporary and permanent mem- brane structures. 2401.2 Approval requlred. Tents and membrane structures having an arellinexcess of2oo square feet (19 m') and canopies in excess of 400 square feet (37 m') shall not be erected, oper- ated or maintained for any purpose without first obtaining a permit and approval from the code official. Exceptions: 1. Tents used exclusively for recreational camping pur-' poses. . , 2. Fabric canopies and awnings open on all sides which comply with all of the following: 2.1. Individnal canopies having a maximum size of 700 square feet (65 m'). 2.2. The aggregate area of multiple canopies placed side by side without a fire break clear- ance of 12 feet (3658 rom) not exceeding 700 square feet (65 m') tQtal. . 2.3. A minimum clearance of 12 feet (3658 rom) to all structures and other tents. . 2401.3 Place of assembly. For the purposes of this chapter, a place of assembly shall include a circus, carnival, tent show, theater, skating rink, dance hall or other place of assembly in or under which persons gather for any purpose. 2401.4 Permits. Permits shall be required as set forth in Sec- tion 105.7. 2401.5 Use period. Temporary tents, air-supported, air-in- flated or tensioned membrane structures and canopies shall be used for a period of not more than 180 days within a 12-month period on a single premise. 2401.6 Construction docnrnents. A detailed site and floor plan for tents, canopies, air-supported, aircinflated or tensioned membrane structures with an occupant load of 50 or more shall be provided with each application for approval. The tent, air- supported, air-inflated, tensioned membrane structure or can- .opy floor plan shall indicate details of the means of egress facil- ities, seating capacity, arrangement of the seating and location and type of heating and electrical equipment. 2401.7.Inspections. The entire tent, air-supported, air-inflated or tensioned membrane structure system shall be inspected at 2000 INTERNATIONAL FIRE CODEiIIl l regular intervals, but not less than two times per permit use period, by the permittee, owner or agent to determine that the installation is maintained in accordance with NFP A 102. Exception: Permit use periods of less than 30 days. 2401.7.1 Inspection report. When required by the code of- ficial, an inspection report shall be provided and shall con- sist of maintenance, anchors and fabric inspections. SECTION 2402 DEFINITIONS 2402,1 Defiultlons. The following words and terms shall, for the purposes of this chapter and as used elsewhere in this code, . have the meanings shown herein. . AIR-SUPPORTED STRUCTURE; A strUcture wherein the shape of the structure.!.s attained by air pressure, and occupants of the structure are within the elevated pressure area. CANOPY. A structure, enclosure or shelter constructed of fab- ric or pliable materials supported by any manner, except by air or the contents it protects, and is open without sidewalls or drops on 75 percent or more of the perimeter. TENT. A structure, enclosure or shelter constructed of fabric or pliable material supported by any manner except by air or the contents that it protects. SECTION 2403 ACCESS, LOCATION AND PARKING 2403.1 Access. Fire apparatus access roads shall be provided in . accordance with Section 503. 2403.2 Location. Temporary membrane structures, tents, can- opies, air-supported, or air-inflated structures shall not be lo- cated within 20 feet (6096 rom) of lot lines, buildings, other temporary membrane structures, other tents and canopies, parked vehicles or internal combustion engines. For the pur- pose of determining required distances, support ropes and guy wires shall be considered as part of the temporary membrane structure, tent or canopy. Exceptions: 1. Separation distance between temporary membrane structures, tents and canopies, not used for cooking, is not required when the aggregate floor area does not exceed 15,000 square feet (1394 m'). 205 2403.3 - 2406.4 2. Temporary membrane structures, tents or canopies need not be separated from buildings when all of the following conditions are met: 2.1. The aggregate floor area of the temporary membrane structure, tent or canopy shall not exceed 10,000 square feet (929 m'). 2.2. The aggregate floor area of the building and temporary membrane structure, tent or can- opy shall not exceed the allowable floor area including increases as indicated in the Inter- . national Building Code. 2.3. Required means of egress provisions are pro- vi~d for both the building and the temporary membrane structure, tent or canopy, including travel distance. .2.4. Fire apparatus access roads areprovil:ledinac- . cordance with Section 503. \ .' . 2403.3 Location of structuredn excess of 15,000 square feet in area. Tents, air-supported. air-inflated or tensioned mem- brane structures having an area of 15,000 square feet (1394 m2) orinore shall be located not less than 50 feet (IS 240 rom) from any other tent or structure as measured from the side wall of the tent unless joined together by a canidor. 2403:.4 Connecting corridors. Tents, air-supported, air-in- flated or tensioned membrane structures are allowed to be joined together by means of corridors. Exit doors shall be pro- vided at each end of snch corridor. On each side of such corri- dor and approximately opposite each other, there shall be provided openings not less than 12 feet (3658 inm) wide. 2403.5 Fire hreak. An unobstructed fire break passageway or fire road not less than 12 feet (3658 rom) wide and free from guy ropes or other obstructions shall be maintained on all sides of all tents, air supported, air-inflated or tensioned membrane structures unless otherwise approved by the code official. SECTION 2404 STRUCTURAL STABILITY 2404.1 Anchorage required. Tents, air-supported, air-inflated or tensioned membrane structures and their appurtenances shall be adequately roped, braced and anchored to withstand the elements of weather and prevent against collapsing. Docu- mentation of structural stability shall be furnished to the code official on request. SECTION 2405 AIR-SUPPORTED AND AIR-INFLATED STRUCTURES 2405.1 Door operation. During high winds exceeding 50 miles per hour (80 kph) or in snow conditions, the use of doors in air-supported structures shall be controlled to avoid exces- sive air loss. Doors shall not lie left open. 2405.2 Fabric envelope design and construction. Air-sup- ported and air-inflated structures shall have the design and con- struclion of the fabric envelope and the method of anchoring in accordance with Arcbitectural Fabric Structures Institute ASI 77. 2405.3 Blowers, An air-supported structure used as a place of assembly shall.be furnished with not less than two blowers, 206 TENTS AND OTHER MEMBRANE STRUCTURES p each of which has adequate capacity to maintain full inflation pressure with normal leakage. The design of the blower shall be so as to provide integral limiting pressure at the design pressure specified by the manufacturer. 2405.4 Auxiliary power. Places of public assembly for more than 200 persons shall be furnished with either a fully auto- matic auxiliary engine-generator set capable of powering one blower continuously for 4 hours, or a supplementary blower powered by an internal combustion engine which shall be auto- matic in operation. . SECTION 2406 FIRE SAFETY REQUIREMENTS 2406.1 Flame.resistant treatment. Before a permit is granted, the owner or agent shall me with the code official a certificate executed by an approved testing laboratory, certifying that the tents, air-supported, air-inflated or tensioned membrane struc- turis and their appurtenances, sidewalls, drops and tops oftem- porary membrane stru~tures, canopies, tarpaulins, floor coverings, bunting, combustible decorative materials and ef- fects, including sawdust when used on floors or passageways, shall be composed of flame-resistant material or shall be treated with a flame retardant in an approved manner and meet the requirements for flame resistance as determined in accor- dance with NFPA 701, and that sJlch flame resistance is effec- tive for the period specified by the permit. 2406.1. Label. Temporary membrane structures, tents or cano- pies shall haVe a permanently affixed label bearing the identifi- cation of size and fabric or material type. 2406.3 Certification. An affidavit or affirmation shall be sub- mitted to the code official and a copy retained on the premises on which the tent or air-supported structure is located. The affi- davit Shall attest to the following information relative to the flame resistance of the fabric. 1. Names and address of the owners of the tent or air-sup- ported structure. 2. Date the fabric was last treated with flame-resistant soln- tion. 3. Trade name or kind of chemical used in treatment. 4. Name of person or firm treating the material. . 5. Name of testing agency and test standard by which the. fabric was tested. 2406A Combustible materiaIs. Hay, straw, shavings or simi- lar combustible materials shall not be located within any tent or air-supported structure containing an assembly occupancy, ex- cept the materials necessary for the daily feeding and care of animals. Sawdust and shavings utilized for a public perfor- mance or exhibit shall not be prohibited provided the sawdust and shavings are kept damp. Combustible materials shall not be permiited under stands or seats at any time. The areas within and adjacent to the tent or air-supported structure, shall be maintained cIearof all combustible materials or vegetation that could create a fire hazard within 20 feet (6096 rom) from the structure. Combustible trash shall be removed at least once a day from the structure during the period the structure is occu- pied by the public. 2000 INTERNATIONAL FIRE CODE@ TENTS AND OTHER MEMBRANE STRUCTURES 2406.5 Smoking. Smoking shall not be permitted in tents or air upported strUctures. Approved "No Smoking" signs shall be conspicuously posted in accordance with Section 310. . 2406.6 Open or exposed flame. Open flame or other devices emitting flame. fire or heat or any flammable or combustible liquids. gas. charcoal or other cooking device or any other un- approved devices shall not be permitted inside or located within 20 feet(6096 rom) of the tent, air-supported. air-inflated or tensioned membrane structures while open to the public un- less approved by the code official. 2406.7 fireworks. Fireworks shall not be used within 100 feet (30 480 rom) of tents. air-supported. air-inflated or tensioned membrane.structures. 2406.8 .Spot lighting. Spot or effect lighting shall only be by electricity. and all combustible construction located within 6 feet (1829 =) of such equipment shall be protected with ap- proved noncombustible insulation not less than 9.25 inches (235 rom) thick. 2406.9 Safety film. Motion pictures shall not be displayed in tents. air-supporied. air-inflated or tensioned membrane struc- tures unless the motion picture film is safety film. 2406.10 Clearance. There shall be a minimum clearance of at. .. least 3 feet (914 mm) between the fabric envelope and all con- tents located inside the air-supported structure. SECTION 2407 FIRE EXTINGUISHER AND OTHER FIRE PROTECTION EQUIPMENT 2407.1 Portable lire extinguisheI'1l. Fire extinguishers shall be provided as required by Section 906. . 2407.2 FIre protection equipment. Fire hose lines: water sup- plies and other auxiliary fire equipment shall be maintained at the site in such numbers and sizes as required by the code offi- cial. SECTION 2408 OCCUPANT LOAD 2408.1 Occupant load factors. The occupant load allowed in an assembly structure. or portion thereof, shall be determined in accordance with Chapter 10. SECTION 2409 SEATING 2409.1 Seating arrangements, Seating in tents, air-supported, air-inflated or tensioned membrane structures, temporary membrane structures or canopies shall be in accordance with Chapter 10. SECTION 2410 MEANS OF EGRESS 2410.1 Distribution, Exits shall be spaced at approximately equal intervals around the perimeter of the tent, air-supported, air-inflated or tensioned membrane structure, temporary mem- 2000 INTERNATIONAL FIRE COOEIil 2406.5 - 2410.5 brane structure. or canopy. and shall be located such that all points are 100 feet (30 480 rom) or less from an exit. 2410.2 Number. Tents. canopies, air-snpported. air-inflated or tensioned membrane structures, temporary membrane struc- tures or usable portion thereof shall have at least one exit and not less than the number of exits required by Table 2410.2. The widths of means of egress required by Table 2410.2 shall be di- . vided approximately equally among the separate means of egress. Exit openings from tents shall remain open unless covered by a flame-resistant curtain. The curtain shall comply with the follOwing reljclrements: 1. Curtains shall be free sliding on a metal support. The support shall be a minlmum of' 80 inches (2032 rom) above the floor level at the exit. The curtains shall be so arranged that. when open, no part of the curtain'obstructs the exit. 2. Curtains shall be of a color, or colors, that contrasts with the color of the tent. 2410.4 Doors. Exit doors shall swing in the direction of exit travel. To avoid hazardous air and pressure loss. such doors shall be automatic-closing against operating pressUres. Open- ing force at the door edge shall not exceed 15 pounds (7 kg). 2410.5 Aisle. The width of aisles without fixed seating shall be in accordance with the following: 1. In areas serving employees only. the minlmum aisle width shall be 24 inches (610 rom) but not less than the width required by the number of employees served. 2. In public areas, smooth-sUIfaced, 'unobstructed aisles having a minimum width of not less than 44 inches (1118 rom) shall be provided from seating areas, and aisles shall be progressively increased in width to provide,atall points. not less than 1 foot (305 =) of aisle width for each 50 persons served by such aisle ai that point. 207 TENTS #jD OTHER MEMBRANE STRUCTURES supported, air-inflated or tensioned membrane structures, tem- porary membrane structures or canopies. SECTION 2414 LIQUID- AND GAS-FUELED VEHICLES 2414.1 Display ofmotor-vehides:Uquid-and gas.fueled vehi- cles and equipment used for display within tents, air-supported, air-inflated or tensioned membrane structures, temporary membrane structures or canopies shall be in accordance with this section. 2414.2 Batteries. Batteries'sball be disconnected in an appro- priate manner. 2414.3 Fuel systems. Fueling vehicles or equipment shall not be fueled or defueled within the building. 2414.3.1 Quantity limit. Fuel in the fuel tank shall not ex- ceed one-quarter of the tank capacity or 5 gallons (19 L), whichever is less. ' 2414.3.2 Inspection. Fuel systems shall be inspected for leaks. 2414.3.3 Closure. Fuel tank opeuing~ sball be locked and sealed to prevent the escape of vapors. 2414.4 Location. The location of vehicles or equipment shall not obstruct means of egress. 2414.4.1 Places of assenlbly. When a compressed natural gas (CNO) or liquefied petroleum gas (LP) powered vehicle is parked inside a place of assembly, all the following condi. tions ,hall be met: 1. The quarter-turn shutoff valve or other shutoff valve on the outlet of the CNG or LP.gas container shall be clo,ed and the engine shall be operated until it stops. Valves shall remain closed while the vehicle is in- doors. 2. The hot lead of the battery _shall be disconnected. 3. Dual-fuel vehicles equipped to operaie on gasoline andCNG or LP-gas shall comply with this section and Sections 2414.2 through 2414.5.3 for gasoline-pow- ered vehicles. - 2414.5 Competitions and demons~ations. Liquid- and gas- fueled vehicles and eqUipment used for competition or demon- " stration within a tent, air-supported, air-inflated or tensioned membrane structure, temporary membrane structure or canopy shall comply with Sections 2414.5.1 through 2414.5.3. 2414.5.1 Fuel storage. Fuel for vehicles or equipment ,hall be stored in approved containers in an approved location outside of the structure. - . - 2414.5.2 Fueling. Refueling ,hall be performed outside of the structure in accordance with Section 2413.3. 2414.5.3 Spills. Fuel spills shall be cleaned up immediately. SECTION 2415 GENERATORS 2415.1 Separation. SECTION 2416 STANDBY PERSONNEL 2416.1 Crowd managers. When, in the opinion of the code of- ficial, it is essential for public safety in a place of assembly or any other place where people congregate, because of the num- ber of persons. or the nature of the perfonnance, exhibition, display, contest or activity, the owner, agent or lessee shall em- ploy one or more qualified persons, as required and approved, to remain on duty during the times such places are open to the public, or when such activity is being conducted. Before each performance or the ,tart of such activity, standby personnel shall keep diligent walth for fires during the time such place is open to the public or such aClivity is being conducted and take prompt, measures for extinguishment of fires that occur and assist in,the evacuation of the public from the structure. i - , There shall be trained crowd managers or crowdmanager su- pervisors at a ratio of one crowd managerfsupervisor for every 250 occupants, as approved. . SECTION 2417 HOUSEKEEPING 2417.1 Vegetation removal. Combustible'vegetation shall be removed from the area occupied by a tent, air-supported. air-in- flated or tensioned membrane strocture, temporary membrane stroctore or canopy and from areas within 3D feet (9144 rom) of such structures. - 2417.2 Waste material. The floor surface inside tents, air-sup- ported, air-inflated or tensioned membrane structures, tempo- rary membrane structures or canopies and the grounds outside and within a 3D-foot (9144 rom) perimeter shall be kept clearof combustible waste. Such waste shall be stored in approved con- tainers until removed from the premises. 209 . 2410.5.1 - 2413.3 . . 2410.S.1 Arrangement and maintenance. The arrange- ment of aisles shall be subject to approval by the code offi- cial and shall be maintained clear at all times during occupancy. 2410.6 Exit sigus. Exits shall be clearly marked. Exit signs shall be installec1 at required exit dootways and where other- wise necessary to indicate clearly the direction of egress when the exit serves an occupant load of 50 or more. 2410.6.1 Exit sign illumination. Exit signs shall be of an approved self-luminous type or shall be internally or exter- nally illuminated by fixtures supplied in the following man- . ner: 1. Two separate circuits, one of which shall be separate from all other circuits, for occupant loads of 300 or less; or .' . 2. 'Iylo separate sources of power, one of which shall be an approved emergency system, sball be provided I when the occupant load exceeds 300. Emergency sys- tems shall be supplied from storage batteries or the on-site generator set. and the system shall be installed in accordance with the ICC Electrical Code. 2410.7 Means of egress illumination. Means of egress shall . be illuminated with light having an intensity of not less than 1 foot-candle (11 lux) at floor level while the stmcture is occu- pied. FIXtures required for means of egress illumination shall be supplied from a separate circuit or source of power. ~10.l! Maintenance of means ofegress. The required width ~f exits, aisles aild passageways shall be maintained at all times to a puhlic way. Guy wires, gny ropes and other support mem- ben shall not cross a means of egress at a height ofless than 8 feet (2438 rom). The surface of means of egress shall be main- tained in an approved manner. SECTION 2411 HEATING AND COOKING EQUIPMENT 2411.1 Installation. Heating. or cooking equipment, tanks, piping, hoses, fittings, valves, tubing and other related compo- nents shall be installed as specified in the International Me- cluinical Code and the International Fuel Gas Code, and shall be approved hy the code official. . 2411.2 Venting. Gas, liquid and solid fuel-burning equipment designed to be vented shall be vented to the outside JIir as speci- fied in the International Fuel Gas Code and .the International Mechanical Code. Such vents shall be equipped with approved spark arresters when required. Where vents or flues are used, all portions of the tent, JIir-suppOrted, JIir-inflated or tensioned membrane stmctures, temporary membrane stmctures or cano- pies shall be not less than 12 inches (305 mm) from the flue or vent. 2411.3 Location. Cooking and heating equipment shall not be located within 10 feet (3048 rom) of exits or combustible mate- rials. . ~11.4 Operations, Operations such as warming of foods, cooking demol1strations and similar operations that use solid flammables, butane Or other similar devices which do not pose an ignition hazard, shall be approved. 208 TENTS AND OTHER MEMBRANE STRUCTURES 2411.S Cooking tents. Tents where cooking is performed shall be separated from other tentS, air-supported, air-inflated or tensioned membrane stmctures. temporary membrane stmc- tures or canopies by a minimum of 20 feet (6096 rom). 2411.6 Outdoor cooking. Outdoor cooking that produces sparks or grease-Iadeu vapors shall not be performed within 20 feet (6096 mm) from a tent, air-supported, air-inflated or tensioned membrane structure, temporary membrane structure or canopy. 2411.7 Electrical heating and cooking equipment. Electrical cooking and heating equipment shall comply with the ICC Electrical Code. SECTION 2412 lP.GAS 2412.1 General. LP-gas equipment such .as tanks, piping, hoses, fittings, valves, tubing and other .related components shall be approved and'in accordance with the International Fuel Gas Code and Chilpter 38. 2412.2 Location of containers. LP-gascontainers shall be lo- cated outside. Safety rel~asevalves shall be pointed away from the tent; JIir-supported, air-inflated or tensioned membrane structure,orcanop~ . 2412.2.1 Containers SOO gallons or less. Portable LP-gas containers of 500 gallons (1893 L) or less capacity shall have a minimum separation between the container and stmcture not less than 10 feet (3048 rom). 2412.2.2 Containers more than 500 gallons. Portable LP- gas containers of more than 500 gallons (1893 L) capacity and shall have a minimum separation between the container and stmctures not less than 25 feet (7620 mm). 2412.3 Protection and security. Portable LP-gas containers, piping, valves and fittings which are located outside and are be- . ing used to fuel equipment inside a tent, air-supported, JIir;in- flated or tensioned membraile structure, temporary membrane stmcture or canopy sball be adequately protected to prevent tampering, damage by vehicles or other hazards and shalll>e lo- cated in an approved location. Portable LP-gas containers shall be securely fastened in place to prevent unauthorized move- ment. SECTION 2413 FLAMMABLE AND COMBUSTIBLE LIQUIDS 2413.1 Use. Flammable-liquid-fueled equipment shall not be used in tents, air-supported, air-inflated or tensioned mem- brane structures, temporary membrane stmctures Or canopies. 2413.2 F1ammable and combustible liquid storage. Flam- mable and combustible liquids shall be stored outside in an ap- proved manner not less than 50 feet (15 240 mm) from tents, JIir-supported, air-inflated or tensioned membrane structures, temporary membrane structures or canopies. Storage shall be in accordance with Chapter 34. . 2413.3 Refueling.
