NOTICE OF PUBLIC HEARING TO CONSIDER PASSING RESOLUTION #04-042
DECLARING AN AMERICAN ELM TREE THAT IS WCATED ON PIN #R23-31-
22-24-0102,7052 DUPRE ROAD A PUBLIC NUISANCE AND SETTING
ABATEMENT PROCEDURES FOR SAME
NOTICE IS HEREBY GIVEN that the Council of the City of Centerville, Minnesota will
conduct a public hearing to consider Resolution #04-042 Declaring an American Elm Tree
located on PIN #R23-31-22-24-0102, 7052 Dupre Road a public nuisance and setting
abatement procedures for same. The American Elm tree in question has been inspected by
the City Forester and Mr. Marty Asleson, City of Lino Lakes and both individuals have
determined that it is infected with Dutch Elm disease fungus Ceratocysitis mmi (Buisman)
Moreau or harbors elm bark beetles Scolytus Multistriatus (Eichh), or Hylugopinus Rufipes
(Marsh).
The said meeting will take place on Wednesday, September 22" 2004 at the Centerville City
Hall, 1880 Main Street, Centerville, Minnesota in the Council Chambers commencing at 6:30
p.m. or shortly thereafter.
The City Hall is ADA accessible. Requests for hearing assisted devices or a sign language
interpreter must be received before 4:00 p.m., September 17, 2004. All persons interested
are invited to attend and to be heard, verbally or in writing.

Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled
meeting on September 8, 2004, at City Hall, 1880 Main Street.

Mayor Sweeney called the September 8, 2004, City Council meeting to order at 6:30 p,rn.

Council Member Capra requested that Center Street road issues be added under updates
along with Eagle Pass and Police Commission.
Ms, Moore-Sykes noted that Council needed to set the levy at this meeting and asked that
it be added to the Agenda.
Motion bv Conncil Member Capra. seconded bv Conncil Member Paar to aporove
the al!enda as amended. All in favor. Motion carried unanimously.

1. Mr. Kevin Ryan - Candidate for County Commissioner
Mr. Ryan addressed Council and answered questions and asked that anyone with any
questions feel free to contact him.
2. Mr. Lloyd Drilling. Apple Tree Square Trail
Mr. Drilling appeared before Council and indicated that he has no intention of doing
anything with that trail especially since the County is coming through with widening the
road and it has not been determined which side they are taking.
Council Member Capra indicated that Mr. Drilling had been asked to escrow funds for
the trail at a Council Meeting and agreed to do so.
Mr. Drilling indicated that there is no developer's agreement that would require him to do
anything with the trail.
Council Member Capra indicated there is no developer's agreement but said that Mr.
Drilling had agreed to escrow funds for the repair of the trail at a Council Meeting.
Mr. Drilling asked that the City provide those minutes so that he could review them as he
does not remember what he agreed to do.
Council asked Staff to provide the minutes to Mr. Drilling.

Mr. Carlson addressed Council and explained his lot split/combination request for the
Boyle property.
Council Liaison Broussard Vickers indicated that the parcels would need to be rezoned as
a part of this process.
Mr. Carlson explained his request on the Koran property to Council indicating that the
jog in the property line is due to a permanent easement to the County for the road.
Mr. Carlson explained his MUSA request to Council indicating that he would like the
parcels to be added to his existing Phase II and allowed into MUSA for 2001 to 2005. He
then explained that he has no intention of building out the properties right away but needs
the MUSA approval in order to begin the design and other requirements at this time.
Council Member Capra asked that the rezoning of Mr. Evans property be added to the
Comprehensive Plan amendment when that is done.
City Attorney Hoeft indicated that Staff would need to determine whether the
Comprehensive Plan lists these properties as R2. If it does an amendment may not be
necessary and the City will do a petition for rezoning and amend the zoning map.

the lot solit reouest for PIN R26-31-22-22-0004 6709 and lot solit combination for
R26-31-22-22-0011 as reQuested. All in favor. Motion carried unanimouslv.

Nonconforming Lot

Council Member Capra asked for Rice Creek and DNR positions on this proposal.

Mr. Frank indicated that there are no restrictions provided he remains 75 feet from the
lake.
Mayor Sweeney asked if this house would be in line with other homes on the street.
Council Member Broussard Vickers explained the process and discussion that occurred at
the Planning Commission meeting noting that Mr. Palzer has indicated that there is a way
to change the square footage of the footprint to meet the front yard setback and meet the
minimum finished square footage of 1600. She then pointed out that there was one
Commissioner who was concerned with allowing this front yard setback variance when
they heard a potential request earlier during the same meeting and that one may not be
approved.
Mayor Sweeney asked if the home could be moved any closer to the lake.
Council Member Broussard Vickers indicated that the home shows a patio door
potentially leading to a deck and there is no room to add the deck without encroaching
into the 75 foot setback from the lake.
Mr. Frank read from the ordinance that indicates that a home can be located closer if the
surrounding homes are closer.
Council Member Broussard Vickers indicated that Rice Creek Watershed District
governs the distance from the lake and they are more restrictive than the City requiring
75 feet.
Council Member Capra indicated that she would feel more comfortable with the request
ifit were the original property owner requesting it.
Mr. Frank commented that making the previous owner the only one that could build on
the property would be a hardship for him.
City Attorney Hoeft indicated that because this is a previously platted lot he does not see
any issue with the lot size variance and lot width. He then said that the water issues will
be handeled per the ordinance and that means that you cannot allow water from your site
to flow onto neighboring properties. He further commented that he questions whether it
would be appropriate to grant the front yard setback because it is possible for the
applicant to meet the minimum square footage requirements without the variance.
Council Member Broussard Vickers indicated that the home could be 24.5 feet wide and
the two-story would be 1,720 square feet.
Mr. Frank told Council that he does not think that what he is asking for is out ofline and
he would like the City to consider approval of his front yard variance as he has spent
$3,000 on plans for this home.
City Attorney Hoeft indicated there is no basis for the variance if the property owner can
meet the minimum requirements and meet the 35 foot setback.

Mayor Sweeney noted that the City is considering changing the side yard setbacks and, if
the home were stretched so it was longer than it was wide the property owner could get

would involve amending the plans.
City Attorney Hoeft indicated that the City could grant a side yard setback variance at
whatever it is the City is going to set as the standard to allow the home to be stretched
and have more square footage.
Mr. Frank indicated that he would like the City to consider tabling this request so that he
could go to Rice Creek and ask whether they would allow him to move the home closer
to the lake.

split for the Carpenter property because it creates a nonconforming lot and there is no
proposal to combine it with an existing piece of property.
Mr. Shudy indicated that there should be a proposal in the near future.
City Attorney Hoeft indicated that he understands that this is a situation that the City
would like to have cleared up but this is not the way to do it.

Mayor Sweeney opened the public hearing at 7:44 p.m.
Mr. Ray Olson addressed Council and explained his request for a special use permit
noting that he started the operation with 24 trailers, is down to 16, and intends to be down
to 12 by January 1, 2005.
City Attorney Hoeft indicated that the property can be treated as industrial as that is and
has been the use and the Comprehensive Plan issues can be handled separately. He then
asked whether Planning and Zoning discussed and made a recommendation as to the
performance standards to be required under the special use permit.
Council Member Broussard Vickers commented that Mr. Rehbein was to have hooked up
to sanitary sewer and has not done that. She then asked whether that could be a
requirement under the special use permit.
City Attorney Hoeft indicated that would be handled as a separate matter.
Council discussed the matter and agreed that the use is and has been there and should be
allowed to continue under a special use permit.

Mr. Koran asked Council whether his property would be rezoned and how that would
happen. Council informed him that the City would initiate a petition for rezoning all the
properties in that area to bring them into conformity with the Ordinance.

Mr. Koran asked how, where and when it would be possible to bring sewer to his
property.
Council indicated that it is not known at this time as it is dependent upon development in
the area. It was recommended that Mr. Koran discuss the matter with Mr. Carlson to
determine whether it is possible to bring sewer to the Koran property from the second
Phase of Hunter's Crossing.

Council Member Capra indicated that she feels that the City needs to clarify the zoning in
the mixed use district downtown because the value is different if it is mixed use versus
residential and the County can come closer with the road to mixed use than it can with
residential property.
Staff was asked to research zoning with the County and place this matter on the next
meeting agenda.
3. Agreement for Residential Recyclin~ Program (Anoka County/Citv of
Centerville)
This item was tabled for further information.
4. Parks and Recreation Recommendation for Trail West ofCenterville Road to
Anoka County Re~onal Park - Alignment with Reconstruction of CSAH 14
Ms. Stephan explained her memo and the recommendation from the Parks Committee.

Council discussed the matter and agreed to schedule the team building for an upcoming
Saturday session. Council agreed that this will be mandatory for Staff and that they will
be paid.
2. Recommendation for Hirine Public Works Maintenance Emoloyee
Ms. Moore-Sykes indicated that this matter is on the agenda because she was asked to
bring this up in six months for discussion as to whether a second employee is necessary.
Mayor Sweeney asked for information from public works as to how things are going.
Ms. Moore-Sykes indicated that she is told daily by Mr. Palzer that things are fine.
Council agreed not to hire an additional employee at this time.
3. Finance Director Candidates
Ms. Moore-Sykes indicated that she and Council Members Lee and Capra spent a day
interviewing finance director candidates and have made a recommendation for the two
top candidates.
Council discussed the matter and agreed to make the offer to the top recommended
candidate based on the recommendation of the interviewing panel.

4. Levv Certification
Mayor Sweeney provided Council with an update on the proceedings of the Police
Commission and advised Council that the City needs to consider, prior to approving the
preliminary levy, the potential of funding a new facility or remodeling an existing
building for the new police headquarters.
Mayor Sweeney informed Council that there has been a lot of officer turn over and
turmoil within the department because the three cities have not done anything about the
issues with the building and he feels it is time to take care of the problem or the
department risks losing its experienced officers. He then informed Council that Chief
Heckman has tendered his resignation effective the end of the year but he will be done on
October 15, 2004.
Mayor Sweeney informed Council that Centerville getting quotes from Lino Lakes and
the County for police services was a source of turmoil for the department. He then said
that Council had no intention of causing disruption and only wanted to see what, if
anything, the City of Centerville could do on its own if the three cities continue to
disagree.

allow room in the budget for the potential costs associated with the police building. She
then said that the number can be reduced prior to the end of the year.

JX. ANNOVNCEMENTS/UPDATES
1. Dutch Elm Disease. 7052 Dupre Road Update
Council Member Capra indicated she received a call from a concerned resident with an
elm tree. She then said she looked into the matter and the disease is spread by beetles
that can travel up to two miles.
Ms. Moore-Sykes indicated there are not funds available for Dutch Elm Disease due to
the expenses with oak wilt. She then said that the only effective way is to remove the
tree and dispose of it properly.
2. Center Street Issues
Council Member Capra indicated the driveways were not replaced as they were.
Mr. Peterson explained that driveways are typically replaced straight to the street without
flares.
Council discussed the matter and agreed they should be replaced as they were.
Council Member Capra indicated that the resident at 1753 has issues with the driveway as
it dips where it is connected.
Council Member Capra indicated she had a complaint about invisible fencing that was
dug up and the resident wanted to know if that would be replaced. She then explained
that it was in the City's right-of-way and will not be replaced.
Council Member Capra indicated that there is a drainage issue between 1753 and the next
house to the west.
Mr. Peterson agreed to look into the issues raised by Council Member Capra.
Mayor Sweeney asked Staff to provide an update on dredging and culverts at the next
meeting.

Council Member Capra indicated there would be a meeting at the Portage Way cul-de-sac
on Thursday, September 9, 2004 at 11 :00 a.m. and asked Ms. Moore-Sykes to see if Mr.

Mr. Peterson indicated they are working on it today and tomorrow.
Council Member Broussard Vickers indicated that the Planning Commission has two
vacant seats and will soon have a third because Ms. Lakso has filed for Council.
Council Member Capra indicated that the new cable building has been completed and
they are moving in.
Mayor Sweeney noted that only two people filed for Mayor and only two people filed for
Council seats in a town of3,000 plus people.

Mayor Sweeney request for the record his disagreement with recalling the original
motion due to the uncertainty of what funds would he needed for a new police
building. He felt with the ability to decrease the levy prior to the first of the year
this recall was not necessary.
Council member Capra stated per the former finance director the first payment for
a new police building was factored into the original levy amount and felt by
increasing the levy from the original proposed amount would add undue stress by
showing up as a 30"10 increase to some of the residents in their City Tax
Statements. She also stated the consensus of the council was to keep the tax rate
at last years rate including a police building payment, which the former finance
director accomplished on the original levy of$I,700,000.
Council member Capra stated should we need additional funds we did budget
$110,000 for a new public works building that could he redirected to a police
building if necessary.
Mayor Sweeney felt the council should not consider using those public works
funds for the police build as they have already been earmarked for the public
works department. Mayor Sweeney also stated previous councils have taken
monies away from the public works department over the years and he feels that is
not acceptable.
Council member Lee stated he agreed with Mayor Sweeney regarding not using
the public works building funds towards a potential police building. He also
stated he did not believe the building was going to happen at all. He also agreed
adding an additional $300,000 to the levy would cause stress to the residents.
Mayor Sweeney stated many things have occurred since the August Police
Commission meeting that he sees as encouraging towards approval of a police
building for the department.
Council member Paar stated when he ran one of the biggest issues was the high
taxes residents' pay in the City of Centerville. He felt we should not add
$300,000 onto the levy if the payment for the building was included in the
original $1,700,000. He felt we should approve the levy the former finance
director recommended. He also agreed with Mayor Sweeney on not using the
Public Works funds for tIllS purpose. He also stated if we need additional monies
he would rather hold public hearing for a special levy for the cities police costs.

ORDINANCE REGULATING THE SUBDIVISION AND PLATTING OF
LAND WITIDN THE CITY OF CENTERVILLE, MINNESOTA AND
FOR THE ADMINISTRATION AND ENFORCEMENT OF SUCH
REGULATIONS.
THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA ORDAINS:

TITLE. This ordinance may be cited as the "Centerville Subdivision
Ordinance" and will be referred to herein as "this ordinance".
JURISDICTION. The geographic jurisdiction of this ordinance includes the
entire area within the corporate limits of Centerville, Minnesota.
DEFINED WORDS. Words used in a special sense in this ordinance are
defined in Article 6.
PURPOSE. This ordinance is adopted:
To assist the orderly, efficient and integrated development of the City;
To provide uniform procedures and standards for all subdivisions;
To enSure consistency between future subdivision development and the
Centerville Comprehensive Plan;
To provide for the protection and conservation of flood plains, shore lands,
soils, water, vegetation, energy, air quality, geologic and ecologic features and
features and agricultural lands.
COMPLIANCE. Platting is required for all subdivisions creating five (5) or
more lots or parcels which are two and one-half (2 v,) acres or less in size.
Hereafter, no lot in subdivision may be sold, no permit to erect, alter or repair
any building upon land in a subdivision may be issued, and no building my be
erected in a subdivision, unless and until a subdivision plan has been approved
and, where required, recorded, and until the improvements required by the
Council in connection therewith have either been constructed or guaranteed,
as herein provided.

are either more or less restrictive that comparable conditions
by any other regulation, the regulations which impose the higher
or requirements shall prevail.
SEVERABILITY. If any provision of this ordinance or the application of any
provision to particular circumstances is held invalid, the remainder of the
ordinance or the application of such provision to other circumstances shall not
be affected.
REPEAL. Ordinance including all prior subdivision ordinances and
amendments or parts thereof in force at the time this ordinance shall take
effect and inconsistent herewith are hereby repealed, including Centerville
Ordinance #15. Nothing contained in this ordinance repeals or amends any
ordinance requiring a permit or license to engage in any business or
occupation.
ARTICLE 2. DESIGN STANDARDS

GENERAL. Subdivision design shall comply with the following general
design standards.
NATURAL FEATURES. Existing natural features which would add value to
the subdivision and the City such as trees, . steep slopes watercourses, historic
spots and similar irreplaceable assets, shall be preserved, insofar as possible,
through harmonious design of the subdivision.
LAND DEDICATION. In all new subdivisions, ten (10) percent of the gross
area subdivided shall be dedicated for public recreation space, with such ten
(10) percent being in addition to property dedicated for streets, alleys,
easements, or other public ways. No areas may be dedicated for public use
until such areas have been approved as being suitable and needed for the
public health, safety, convenience, and/or general welfare. When the
subdivision is too small for practical dedication of public land or if no land in
the subdivision is suitable for such use, the subdivider shall be required to pay
a fee as per schedule in effect per lot created or ten (10) percent of the
subdivision land value, whichever is greater, prior to subdivision; the value
(market) of the land shall be determined by negotiation between City and
developer. Lots created in any manner that are larger than five (5) acres or
three hundred (300) feet in width shall not be subject to dedication ofland for
public use. A fee according to the current schedule will be charged on every
building permit issued pertaining to new housing units for parks and
playgrounds.
PLANNED UNIT DEVELOPMENT. These design standards of this
ordinance may be modified by the Council in the case of a plan utilizmg an

necessary for two separate reasons, in order for me to build a home on the vacant lot.
1. Minimum Area needed on a conforming lot is 15,000 Square feet.

Provided with this letter is a site plan that explains that I cannot meet those requirements
due to the dimensions of the platted lot. The square footage of the lot is only 12,009 feet,

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only. A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the
property owner's circumstances are self-created.
Minnesota Statutes (MS 462.357, Subd. 6) and City Ordinances (Ord. #4, Division 180) require that
the following conditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary.
I. Because of the particular physical surroundings, shape or topographical
conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced.
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel ofland.
4. The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood.
5. Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subject property is located.

demonstrate the variance will not impact the surrounding properties nor impact

This memo is intended to update Staff and Council on the status of pond dredging and storm sewer
improvements in the City. This work was authorized by Council on May 26, 2004, using monies from the
Storm Sewer Fund.
72nd Street Storm Sewer Improvements: A Quote Package is being prepared to send out to several
contractors. In general, a new 24" diameter pipe will be extended from Hardwood Pond to the north side of
nnd Street. The pipe will be about 1.5' lower than the current culverts/ditch, and Improve the drainage in
the area. The estimated construction cost is $25,000. We will award the work to the low bidder on October
13,2004. It should take 3 - 5 days to complete. The 42" pipe down the property line north of Brian Way
will remain as Is.
Pond Dredging: Last winter, Hardwood Estates pond was dredged by Arnt Construction for $39,000.
The work was done in mid-February when the ground was frozen. This winter we plan to dredge several

CONTRACT FOR ANIMAL CONTROL SERVICES
THIS AGREEMENT, entered into this 22ud day of Sl:\ltember, 2004 by and between the City of
Centerville, 1880 Main Street, Centerville, Minnesota 55038, hereinafter referred to as the
"Municipality", and Otter Lake Animal Care Center, 6848 Otter Lake Road, Hugo, Minnesota
55308, hereinafter referred to as "Otter Lake", regarding the provision of animal control services
in the City ofCenterville.
The parties hereto agree as follows:
1. TERM
The term of this contract shall be from October 1,2004 through October 1, 2005.
II. BASIC SERVICES
Otter Lake agrees to provide the following services:
1. Shelter for animals on a 24-hour basis.
2. Pick up animals at sites and transport to the shelter building during normal
business hours, seven days per week upon the request of the appropriate
Municipal official.
3. Animal examinations and veterinary care as required whenever staff is available.
4. Boarding for up to seven (7) days.
5. Euthanasia and disposal of animals if required.
6. Assist in handling animal abuse/neglect cases in cooperation with Municipal
officials when necessary.
7. Vaccinate all boarders with Bordatella upon arrival at $5.00 per cat or dog.
ID. COMPENSATION
1. The Municipality shall pay Otter Lake the following fees:

BOARDING FEE: $12.00 per day, per animal, for each day after

TRANSPORTATION FEE: $27.50 per pick up.
VETERINARY SERVICE: $40.00 per hour (maximum of $200.00
on any injury charged to the city).
FLEA DIP: $15.00 per animal.

2. The Municipality will not be charged those costs rewvered from pet owners.
3. Charges for services shall be paid monthly or within thirty (30) days after
submission of the monthly claims by Otter Lake to the Municipality. A copy of
the impound sheet(s) shall accompany the monthly claims
IV. COMPliANCE WITH LAWS
In providing all services pursuant to this contract, Otter Lake shall abide by all statutes,
ordinance rules and regulations pertaining to or regulating the provision of such services,
including those now in effect and hereinafter adopted. Otter Lake shall comply with all
requirements of Minnesota State Statute 346.37 and shall indenmify and defend the City
against any claimed violation of that statute, or any other statute, ordinance, rule or
regulation pertaining to the services provided by Otter Lake.
V. AUDIT DISCLOSURE AND RETENTION OF RECORDS
Otter Lake agrees to make available to duly authorized representative(s) of the
Municipality and either the legislative auditor or the State Auditor for the purpose of
audit examination pursuant to Minnesota State Statute 16B.06, any books, documents,
papers and rewrds of Otter Lake that are pertinent to Otter Lake's provision of services
hereunder. Otter Lake further agrees to maintain all such required rewrds for three (3)
years after receipt of final payment and the closing of all other related matters.
VI INSURANCE
Otter Lake shall purchase, maintain in full force and effect during the term of this
contract the following insurance coverage:
1. WORKER'S COMPENSATION: Coverage at statutory limits as provided by
the State of Minnesota.
2. COMPREHENSIVE GENERAL UABILITY: Coverage shall have
minimum limits of $1,000,000 per occurrence, combined single limit for
bodily injury liability and property damage liability.
3. BUSINESS AUTO UABlLITY: Coverage shall have minimum limits of
$500,000 per occurrence, combined single limit of bodily injury liability and
property damage liability. This shall include owned vehicles hired and non-
owned vehicles and employee non-ownership.
VIl. EARLY TERMINATION
This contract may be terminated by either party, with or without cause, upon thirty (30)
days written notice, delivered by certified mail or in person, to the other party. .
VIll. MODIFICATIONS
Any material alteration, modifications or variations of any terms of the contract shall be
valid and enforceable only when they have been reduced to writing as an amendment and
signed by the parties.
IX. ENTIRE AGREEMENT
It is understood and agreed by the parties that the entire agreement of the parties is
contained herein and that the contract superseded all oral agreements and negotiations
between the parties relating to the subject matter hereof as well as any previous
agreements presently in effect between Otter Lake and Municipality. The parties hereto
revoke any prior oral or written agreements between themselves and agree that this
contract is the only and complete agreement regarding the subject hereof.

A RESOLUTION DECLARING COST TO BE ASSESSED, AND ORDERING PREPARATION OF
PROPOSED ASSESSMENTS FOR THE HUNTERS CROSSING 2ND ADDITION, PHASE I
SUBDIVISION
WHEREAS, a contract has been let (costs have been determined) for the improvement of the Hunters Crossing
2nd Addition, Phase I Subdivision and the contract (bid) price for such improvement is $598,750, and the
expenses incurred or to be incurred in the making of such improvement amount to $143,808 so that the total
cost of the improvement will be $742,108.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
:ENTERVILLE, MINNESOTA:
I. The portion of the cost of such improvement to be paid by the City is hereby declared to be
$8,555 and the portion of the cost to be assessed against benefited property owners is declared to
be $725,471.
2. The assessments shall be payable in equal annual installments extending over a period of
years, the first of the installments to be payable on or before the first Monday in January, 2005
and shall bear interest at the rate of percent per annum from the date of the adoption of
the assessment resolution.
3. The City Clerk, with the assistance of the City Engineer, shall forthwith calculate the proper
amount to be specially assessed for such improvement against every assessable lot, piece or
parcel ofland within the district affected, without regard to cash valuation, as provided: by law,
and he/she will file a copy of such proposed assessment in his office for public inspection.
4. The Clerk shall upon the completion of such proposed assessment, notify the Council thereof

A RESOLUTION FOR BEARING ON PROPOSED ASSESSMENTS FOR THE HUNTERS
CROSSING 2ND ADDITION, PHASE I SUBDIVISION
WHEREAS, by a resolution passed by the Council on September 22, 2004, the City Clerk/City Engineer were
directed to prepare a proposed assessment of the cost of improvements associated with the Hunters Crossing 2nd
Addition, Phase I and benefited properties known as 6882 Centerville Road, Outlot B Pheasant Marsh owned by
Ground Development and 6849 Centerville Road; and
WHEREAS, the Clerk has notified the Council that such proposed assessment has been completed and filed in
hislher office for public inspection; and
OW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENTERVILLE, MINNESOTA:
1. A hearing shall beheld on the'l:t- day of Jdc, 2004 in the City Hall Council Chambers at
6:30 p.m. to pass upon such proposed assessments and at such time and place all persons owning
property affected by such improvement will be given an opportunity to be heard with reference
to such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to
be published once in the official newspaper at least two weeks prior to the hearing, and he/she
shall state in the notice the total cost of the improvements. He/she shall also cause mailed notice
to be given to the owner of each parcel described in the assessment roll not less than two weeks
prior to the hearings.
3. The owner of any property so assessed may, at any time prior to certification of the assessmentto
the County Auditor, pay the whole of the assessment on such property, with interest accrued to
the date of payment, to the City Clerk, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of the assessment. He/she may at any time
thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is made. Such payment must
be made before November 15 or interest will be charged through December 31 of the succeeding
year.

responsibilities that RCWD and the City have with regard to storm water. She gave us a

seminar helps us to meet one of our Best Management Practices (BMP).
If you are interested in attending, please let me know which dates works best for you.

Dear Council Members,
1 am a resident on Center and Dupre Streets. During this past Summer we have had to endure the
installation of new sewer; water; curb and gutter; and road surfacing. Part of the process involved
removing part of our 4 year old concrete driveway. On September 7, 2004 the removed piece of cement
was replaced by a cement contractor hired by the city of Centerville.
The replacement cement is comprised of inferior quality materials and poor workmanship. Some of the
issues include:
+ Gouging our existing slab and not repairing the missing piece.
When cutting out our original concrete driveway the Centerville contractor gouged out a sizable
piece of concrete. When the new concrete was poured the Centerville contractor failed to repair
the original driveway.
+ Excessive overrun of cement.
When pouring the concrete the contractor did not install the forms all the way to ground level.
This allowed concrete to pour out underneath the fonn.
+ Leaving closed seams and seams that are too narrow.
Our original concrete slab has seanlS installed for drainage and to offset cracking. The Centerville
contractor tried installing seams but they are too narrow making it easy for dirt to become trapped,
also at least one seam is not finished.
+ Using unspecified aggregate to compose the cement.
I spoke with the contractor we hired to do our driveway originally. He used granite rock to
manufacture our concrete. This makes for a more stable, and longer lasting product. I questioned
tile makeup of tl1e replacement cement and was told that it was "standard aggregate according to
city standards." When I spoke with Ryan Goodman he tl10ught our original driveway was rated at
3900psi, the new section was 4200 psi. TIus was incorrect, tlle original slab is rated at 4500 psi.
Tile original slab also has a 5 year guarantee; tl1e new one only has a
1 year guarantee (only because the project will still be open tl1en).
+ Leaving littered gap between the two slabs of concrete.
After installing the cement tlle Centerville contractor left pieces of old cement in tile gap between
the 2 slabs. Our yard is also littered with excess cement. TIlis is something that was not done by
our contractor when he poured tl1e original driveway.
+ New slab is not adequately engineered for water damage.
One of our biggest concems is that because this new concrete isn't sealed appropriately to our
original driveway, and tllat it is located at tl1e steepest pitch of the drive where water will get under
the new piece of concrete and wash out the soil undemeath. The Centerville contractor confimled
that this is very likely to happen. In a sllort time tlle slab will begin to rock as we drive over it.
The new slab will tl1en crack, break, and we will have to pay to replace it in a much earlier
timeframe tl1an wllat is acceptable.
+ Not installing an expansion piece between the existing and new concrete slab.
When I consulted witil our contractor he, and I agreed, tl,at there should be an expansion piece on
both ends of the replacement slab. TIlis would help alleviate any damage to tlle origiual slab if tile
new slab breaks loose or tllere is any other movement oftl1e slabs. I mentioned tius to tile
Centerville contractor and Ryan Goodman. TIleir explanation for not installing an expansion piece
is tilat tius would allow more water to seep under the new concrete tl1an tl1e existing gap between
the two slabs. TillS would speed np tile process of washing out the dirt under tile new slab.
Unfortunately tlllS argument is proven incorrect by tl,at fact tllat in tile middle of our original
driveway (approximately 20 feet from the new concrete) has an expansion piece tllat was installed
by our contractor. There has been no water issues, the slabs have not fallen, cracked or been
damaged in the slightest by having the expansion piece there.
At the end of my meeting with the Centervil1e contractor and Ryan Goodman I was told that the Centerville
contractor would bring another city official ont to verify that they followed city standards. The Centerville
contractor felt that he had followed these standards therefore no further action will be taken. Personally, I
find it hard to believe that the city would condone such sloppy and unprofessional work.
Initially I asked Mr. Goodman for the new concrete to be removed and replaced with adequate
workmanship and materials. However considering the contractors initial attemp~ and their customer
service skills, I am now asking:
1. 111at the replacement cement be removed at either the city or the contractors expense
2. The cost of the replacement cement be removed from our assessment of the CenterlDupre Street
project
3. I will contract someone at my expense to replace the torn out cement.
We were given the impression at the meetings with the City Council earlier this year that this project was to
eulIance tlle value of our home. I fail to see how the work done on our driveway will do snch. In fact the
new piece gives our property a cobbled together look. In any case, I refuse to be forced to pay for such
inferior work. We strongly believe that this new piece of cement will have to be replaced in a few short
years. Thus we will be paying twice for mistakes made by the cement contractor.
Your immediate attention to tins matter would be greatly appreciated. We look forward to your written

Subject: Downtown Revitalization
This letter is submitted with interest and support for the "downtown area" of Centerville. We, as
a committee, strongly hope our City Council will propose a project in the near future for the
revitalization of the downtown area. We feel the timing of this project is very important due to
the upgrading of County Road 14 in 2006.
Many discussions have taken place regarding the downtown area. Community and professional
input were accomplished when the Minnesota Design T earn provided direction for the future, not
only for the downtown area, but for the entire city, six years ago. The topic has been on our
agenda for over 10 years. At one point a petition for city water from an adequate amount of
property owners in the downtown area was presented. We do understand property owners do not
like assessments, but unfortunately the infrastructure wears out and needs repair with better and
newer capabilities. No city water, an old sewer and limited storm drains are presently what we
have. The area is zoned mixed use and a 'zero lot line' type setback is allowed. With this type
of use and two county roads intersecting the downtown area, the future growth will transform to
more commercial than residential or a creative combination of both.
We suggest the revitalization project would include; city water, city sewer, storm drainage,
curbs, sidewalks, lighting, asphalt, and streetscapes. There have been ideas discussed and
estimates done. There are most likely various grants and/or funding available to help all
involved to hopefully produce a cost effective project for the beautification and infrastructure
improvements of the downtown area. Let us all work with a positive approach to accomplish the
project as a community.
Our committee is available to help with processes involved to not only initiate, but also to
support the city through the entire revitalization project.

At Council's previous meeting, Council requested additional information regarding this
item, it is as follows:
Anoka County receives SCORE (Select Committee on Recycling and the Enviromnent)
funds that are disbursed/offset expenditures/incentives to City's that agree to provide
educational events, programs, etc. for recycling opportunities within there communities.
This agreement is between Anoka County and the City regarding the offering of
programs, receiving funds and a legal agreement.
Once again, the County is requesting that the City participate in this program.

AGREEMENT FOR RESIDENTIAL RECYCLING PROGRAM
THIS AGREEMENT made and entered into on 16th day of December, 2003,
notwithstanding the date of the signatures of the parties, between the COUNTY OF ANOKA,
State of Minnesota, hereinafter referred to as .the "COUNTY", and the CITY OF
CENTER YULE, hereinafter referred to as the "MUNlCIP ALITY".
WITNESSETH:
WHEREAS, Anoka County has received $708,603 in funding from the Solid Waste
Management Coordinating Board and the State of Minnesota pursuant to Minn. Stat. S l15A.557
(hereinafter "SCORE funds"); and
WHEREAS, the County wishes to assist the Municipality in meeting recycling goals
established by the Anoka County Board of Commissioners by providing said SCORE funds to
cities and townships in the County for solid waste recycling programs.
NOW, THEREFORE, in consideration of the m\ltual covenants and promises contained
in this Agreement, the parties mutually agree to the following terms and conditions:
1.
. PURPOSE. The purpose of this Agreement is to provide for cooperation between the
County and the Municipality to implement solid waste recycling programs in the
Municipality.

2. TERM. The term of this Agreement is from January 1, 2004 through December 31,
2004, unless earlier terminated as provided herein.
3. DEFINITIONS.
a, "Problem material" shall have the meaning set forth in Minn. Stat. S 115A.03,
subdivision 24a.
b. "Multi-unit households" means households within apartment complexes,
condominiums, townhomes, mobile homes and senior housing complexes.
c. "Opportunity to recycle" means providing recycling and curbside pickup or
collection centers for recyclable materials as required by Minn. Stat. S 115A.552.
d. "Recycling" means the process of collecting and preparing recyclable materials
and reusing the materials in their original form or using them in manufacturing
processes that do not cause the destruction of recyclable materials in a manner
that precludes further use.
e. "Recyclable materials" means materials that are separated from mixed municipal
solid waste for the purpose of recycling, including paper, glass, plastics, metals,
fluorescent lamps, major appliances and vehicle batteries.
f. Refuse derived fuel or other material that is destroyed by incineration is not a
recyclable material.

"Yard waste" shall have the meaning set forth ill Minn. Stat. S 115A.03,
subdivision 38.

4.
PROGRAM. The Municipality shall develop and implement a residential solid waste
recycling program adequate to meet the Municipality's annual recycling goal of 300 tons
of recyclable materials as established by the County. The Municipality shall ensure that
the recyclable materials collected are delivered to processors or end markets for
recycling.
a. The Municipal recycling program shall include the following components:
i. Each household (including multi-unit households) in the Municipality
shall have the opportunity to recycle at least four broad types of materials,
such as paper, glass, plastic, metal and textiles.
11. The recycling program shall be operated in compliance with all applicable
federal, state, and local laws, ordinances, rules and regulations.
iii. The Municipality shall implement a public information program that
contains at least the following components:
(1)" One promotion is to be mailed to each household focused
exclusively on the Municipality's recycling program;
(2) One promotion advertising recycling opportunities available for
residents is to be included in the Municipality's newsletter or local
newspaper; and
(3) Two community presentations are to be given on recycling.
The public information components listed above must promote the
focused recyclable material Of the year as specified by the County. The
County will provide the Municipality with background material on the
focused recyclable material of the year.
iv. The Municipality, on an ongoing basis, shall identify new residents and
provide detailed information on the recycling opportunities available to
these new residents.
b. If the Municipality's recycling program did not achieve the Municipality's
recycling goals as established by the County for the prior calendar year, the
Municipality shall prepare and submit to the County by March 31, 2003, a plan
acceptable to County that is designed to achieve the recycling goals set forth in
this Agreement.

5. REPORTING. The Municipality shall submit the following reports semiannually to the
County no later than July 20,2004 and January 20, 2005:
a. An accounting of the amount of waste which has been recycled as a result of the
Municipality's activities and the efforts of other community programs, redemption
centers and drop-off centers. For recycling programs, the Municipality shall
certify the number of tons of each recyclable material which has been collected
and the number of tons of each recyclable material which has been marketed. For
recycling programs run by other persons or entities, the Municipality shall also
provide documentation on forms provided by the County showing the tons of
materials that were recycled by the Municipality's residents through these other

programs. The Municipality shall keep detailed records documenting the
disposition of all recyclable materials collected pursuant to this agreement. The
Municipality shall also report the number of cubic yards or tons of yard waste
collected for composting or landspreading, together with a description of the
methodology used for calculations. Any other material removed from the waste
stream by the Municipality, i.e. tires and used oil, shall also be reported
separately.
b. Information regarding any revenue received from sources other than the County
for the Municipality's recycling programs.
c. Copies of all promotional materials that have been prepared by the Municipality
during the term of this Agreement to promote its recycling programs.
. The Municipality agrees to furnish the County with additional reports in form and at
frequencies requested by the County for financial evaluation, program management
purposes, and reporting to the State of Minnesota.
.6.
BILLING AND PAYMENT PROCEDURE. The Municipality shall submit itemized
invoices semiannually to the County for abatement activities no later than July 20, 2004
and January 20, 2005. Costs not billed by January 20, 2005 will not be eligible for
funding. The invoices shall be paid in accordance with standard County procedures,
subject to the approval of the Arioka County Board of Commissioners.

7. ELlGmILITY FOR FUNDS. The Municipality is entitled to receive reimbursement
for eligible expenses, less revenues or other reimbursement received, for eligible
activities up to the project maximum as computed below, which shall not exceed
$28,467.06. The project maximum for eligible expenses shall be computed as follows:
a. A base amount of $10,000.00 for recycling activities only;
b. $4.51 per household for recycling activities only; and
c. unexpended funds carried over from the Municipality's 2003 allocation.
8. RECORDS. The Municipality shall maintain financial and other records and accounts in
accordance with requirements of the County and the State of Minnesota. The
Municipality shall maintain strict accountability of all funds and maintain records of all
receipts and disbursements. Such records and accounts shall be maintained in a form
which will permit the tracing of funds and program income to final expenditure. The
Municipality shall maintain records sufficient to reflect that all funds received under this
Agreement were expended in accordance with Minn. Stat. S 115A.557, subd. 2, for
residential solid waste recycling purposes. The Municipality shall also maintain records
of the quantities of materials recycled. All records and accounts shall be retained as
provided by law, but in no event for a period of less than five years from the last receipt
of payment from the County pursuant to this Agreement.

9. AUDIT. Pursuant to Minn. Stat. g 16C.OS, the Municipality shall allow the County or
other persons or agencies authorized by. the County, and the State of Minnesota,
including the Legislative Auditor or the State Auditor, access to the records of the
Municipality at reasonable hours, including all books, records, documents, and
accounting procedures and practices of the Municipality relevant to the subject matter of.
. the Agreement, for purposes of audit. In addition, the County shall have access to the
project site(s), if any, at reasonable hours.
10. GENERAL PROVISIONS.
a. In performing the provisions of this Agreement, both parties agree to comply with
all applicable federal, state or local laws, ordinances, rules, regulations or
standards established by any agency or special governmental unit which are now
or hereafter promulgated insofar as they relate to performance of the provisions of
this Agreement. In addition, the Municipality shall.comply with all applicable
requirements of the State of Minnesota for the use of SCORE funds provided to
the Municipality by the County under this Agreement.
. b. No person shall illegally, on the grounds of race, creed, color, religion, sex,
marital status, public assistance status, sexual preference, handicap, age or
national origin, be excluded from full employment rights in, participation in, be
denied the benefits of, or be otherwise subjected to unlawful discrimination under
any program, service or activity hereunder. The Municipality agrees to take
affirmative action so that applicants and employees are treated equally with
respect to the following: employment, upgrading, demotion, transfer, recruitment,
layoff, termination, selection for training, rates of pay, and other forms of
compensation.
c. TIle Municipality shall be responsible for the performance of all subcontracts and
shall ensure that the subcontractors perform fuIiy the terms of the subcontract.
The Agreement between the Municipality and a subcontractor shall obligate the
subcontractor to comply fully with the terms of this Agreement.
d. The Municipality agrees that the Municipality's employees and subcontractor's
employees who provide services under this agreement and who fall within any job
classification established and published by the Minnesota Department of Labor &
Industry shall be paid, at a minimum, the prevailing wages rates as certified by
said Department. .
e. It is understood and agreed that the entire Agreement is contained herein and that
this Agreement supersedes all oral and written agreements and negotiations
between the parties relating to the subject matter hereof.
f. Any amendments, alterations, variations, modifications, or waivers of this
Agreement shall be valid only when they have been reduced to writing, duly
signed by the parties.

g. Contracts let and purchases made under this Agreement shall be made by the
Municipality in conformance with all laws, rules, and regulations applicable to the
Municipality.
h. The provisions of this Agreement are severable. If any paragraph, section,
subdivision, sentence, clause or phrase of this Agreement is for any reason held to
be contrary to law, such decision shall not affect the remaining portion of this
Agreement.
1. Nothing in this Agreement shall be construed as creating the relationship of co-
partners, joint venturers, or an association between the County and Municipality,
nor shall the Municipality, its employees, agents or representatives be considered
employees, agents, or representatives of the County for any purpose.
11. PUBLICATION. The Municipality shall acknowledge the financial assistance of the
County on all promotional materials, reports and publications relating to the activities
funded under this Agreement, by including the following acknowledgement: "Funded by
the Anoka County Board of ComInissioners and State SCORE funds (Select Committee
on Recycling and the Environment).
12. INDEMNIFICATION. The County agrees to indemnify, defend, and hold the
Municipality harmless from all claims, demands, and causes of action of any kind or
character, including the cost of defense thereof, resulting from the acts ot omissions of its
public officials, officers, agents, employees, and contractors relating to activities
performed by the County under this Agreement.
The Municipality agrees to indemnify, defend, and hold the County harmless from all

The provisions of this subdivision shall survive the termination or expiration of the term
of thiS Agreement.
13. TERMINATION. This Agreement may be terminated by mutual written agreement of
the parties or by either party, with or without cause, by giving not less than seVen (7)
days written notice, delivered by mail or in person to the other party, specifying the date
of termination. If this Agreement is terminated, assets acquired in whole or in part with
funds provided under this Agreement shall be the property of the Municipality so long as
said assets are used by the Municipality for the purpose of a landfill abatement program

AGREEMENT FOR RESIDENTIAL RECYCLING PROGRAM
THIS AGREEMENT made and. entered into on 16th day of December, 2003,
notwithstanding the date of the signatures of the parties, between the COUNTY OF ANOKA,
State of Minnesota, hereinafter referred to as .the "COUNTY", and the CITY OF
CENTERVILLE, hereinafter referred to as the "MUNICIPALITY".
WITNESSETH:
WHEREAS, Anoka County has received $708,603 in funding from the Solid Waste
Management Coordinating Board and the State of Minnesota pursuant to Minn. Stat. 9 115A.557
(hereinafter "SCORE funds"); and
WHEREAS, the County wishes to assist the Municipality in meeting recycling goals
established by the Anoka County Board of Commissioners by providing said SCORE funds to
cities and townships in the County for solid waste recycling programs.
NOW, THEREFORE, in consideration of the ml,)tual covenants and promises contained
in this Agreement, the parties mutually agree to the following terms and conditions:
1. . PURPOSE. The purpose of this Agreement is to provide for cooperation between the
County and the Municipality to implement solid waste recycling programs in the
Municipality.
2. TERM. The term of this Agreement is from January 1, 2004 through December 31,
2004, unless earlier terminated as provided herein.
3. DEFINITIONS.

"Problem material" shall have the meaning set forth in Minn. Stat. 9 115A.03,
subdivision 24a.
"Multi-unit households" means households within apartment complexes,
condominiums, townhomes, mobile homes and senior housing complexes.
"Opportunity to recycle" means providing recycling and curbside pickup or
collection centers for recyclable materials as required by Minn. Stat. 9 115A.552.
"Recycling" means the process of collecting and preparing recyclable materials
and reusing the materials in their original form or using them in manufacturing
processes that do not cause the destruction of recyclable materials in a manner
that precludes further use.
"Recyclable materials" means materials that are separated from mixed municipal
solid waste for the purpose of recycling, including paper, glass, plastics, metals,
fluorescent lamps, major appliances and vehicle batteries.
Refuse derived fuel or other material that is destroyed by incineration is not a
recyclable material.

g. "Yard waste'" shall have the meaning set forth In Minn. Stat. S IISA.03,
subdivision 38.
4.
PROGRAM. The Municipality shall develop and implement a residential solid waste
recycling program adeguate to meet the Municipality's annual recycling goal of 300 tons
of recyclable materials as established by the County. The Municipality shall ensure that
the recyclable materials collected are delivered to processors or end markets for
recycling.
a. The Municipal recycling program shall include the following components:
i. Each household (including multi-unit households) in the Municipality
shall have the opportunity to recycle at least fonr broad types of materials,
such as paper, glass, plastic, metal and textiles.
ll. The recycling program shall be operated in compliance with all applicable
federal, state, and local laws, ordinances, rules and regulations.
iii. The Municipality shall implement a public information program that
contains at least the following components:
(1)' One promotion is to be mailed to each household focused
exclusively on the Municipality's recycling program;
(2) One promotion advertising recycling opportunities available for
residents is to be included in the Municipality's newsletter or local
newspaper; and
(3) Two community presentations are to be given on recycling.
The public information components listed above must promote the
focused recyclable material of the year as specified by the County. The
County will provide the Municipality with background material on the
focused recyclable material of the year.
iv. The Municipality, on an ongoing basis, shall identify new residents and
provide detailed information on the recycling opportunities available to
these new residents.
b. If the Municipality's recycling program did not achieve the Municipality's
recycling goals as' established by the County for the prior calendar year, the
Municipality shall prepare and submit to the County by March 31, 2003, a plan
acceptable to County that is designed to achieve the recycling goals set forth in
this Agreement.
5.. REPORTING. The Municipality shall submit the following reports semiannually to the
County no later fuan July 20, 2004 and January 20, 2005:
a.
An accounting of the amount of waste which has been recycled as a result of the
Municipality's activities and the efforts of other community programs, redemption
centers and drop-off centers. For recycling programs, the Municipality shall
certify the number of tons of each recyclable material which has been collected
and the number of tons of each recyclable material which has been marketed. For
recycling programs run by other persons or entities, the Municipality shall also
provide documentation on forms provided by the County showing the tons of
materials that were recycled by the Municipality's residents through these other

programs. The Municipality shall keep detailed records documenting the
disposition of all recyclable materials collected pursuant to this agreement. The
Municipality shall also report the number of cubic yards or tons of yard waste
collected for composting or landspreading, together with a description of the
methodology used for calculations. Any other material removed from the waste
stream by the Municipality, i.e. tires and used oil, shall also be reported
separately.
b. Information regarding any revenue received from sources other than the County
for the Municipality's recycling programs.
c. Copies of all promotional materials that have been prepared by the Municipality
during the term of this Agreement to promote its recycling programs.
. The Municipality agrees to furnish the County with additional reports in form and at
frequencies requested by the County for financial evaluation, program management
purposes, and reporting to the State of Minnesota.
BILLING AND PAYMENT PROCEDURE. The Municipality shall submit itemized
invoices semiannually to the County for abatement activities no later than July 20, 2004
and January 20, 2005. Costs not billed by January 20, 2005 will not be eligible for
funding. The invoices shall be paid in accordance with standard County procedures,
subject to the approval of the Anoka County Board of Commissioners.
7. ELIGIBILITY FOR FUNDS. The Municipality is entitled to receive reimbursement
for eligible expenses, less revenues or other reimbursement received, for eligible
. activities up to the project maximum as computed below, wbich shall not exceed
$28,467.06. The project maximum for eligible expenses shall be computed as follows:
a. A base amount of $10,000.00 for recycling activities only;
b. $4.51 per household for recycling activities only; and
c. unexpended funds carried over from the Municipality's 2003 allocation.
8. RECORDS. The Municipality shall maintain financial and other records and accounts in
accordance with requirements of the County and the State of Minnesota. The
Municipality shall maintain strict accountability of all funds and maintain records of all
receipts and disbursements. Such records and accounts shall be maintained in a form
wbich will permit the tracing of funds and program income to final expenditure. The
Municipality shall maintain records sufficient to reflect that all funds received under this
Agreement were expended in accordance with Minn. Stat. ~ 115A.557, subd. 2, for
residential solid waste recycling purposes. The Municipality shall also maintain records
of the quantities of materials recycled. All records and accounts shall be retained as
provided by law, but in no event for a period of less than five years from the last receipt
of payment from the County pursuant to tbis Agreement.

9. AUDIT. Pursuant to Minn. Stat. S 16C.05, the Municipality shall allow the County or
other persons or agencies authorized by. the . County, and the State. of Minnesota,
including the Legislative Auditor or the State Auditor, access to the records of the
Municipality at reasonable hours, including all books, records, documents, and
accounting procedures and practices of the Municipality relevant to the subject matter of.
. the Agreement, for purposes of audit. In addition, the County shall have access to the
project site(s), if any, at reasonable hours.
10. GENERAL PROVISIONS.
a. In performing the provisions of this Agreement, both parties agree to comply with
all applicable federal, state or local laws, ordinances, rules, regulations or
standards established by any agency or special governmental unit which are now
or hereafter promulgated insofar as they relate to performance of the provisions of
this Agreement. In addition, the Municipality shall comply with all applicable
requirements of the State of Minnesota for the use of SCORE funds provided to
the Municipality by the County under this Agreement.
. b. No person shall illegally, on the grounds of race, creed, color, religion, sex,
marital status, public assistance status, sexual preference, handicap, age or
national origin, be excluded from full employment rights in, participation in, be
denied the benefits of, or be otherwise subjected to unlawful discrimination under
any program, service or activity hereunder. The Municipality agrees to take
affmnative action so that applicants and employees are treated equally with
respect to the following: employment, upgrading, demotion, transfer, recruitment,
layoff, termination, selection for training, rates of pay, and other forms of
compensation.
c. The Municipality shall be responsible for the performance of all subcontracts and
shall ensure that the subcontractors perform fully the terms of the subcontract.
The Agreement between the Municipality and a subcontractor shall obligate the
subcontractor to comply fully with the terms of this Agreement.
d. The Municipality agrees that the Municipality's employees and subcontractor's
employees who provide services under this agreement and who fall within any job
classification established and published by the Minnesota Department of Labor &
Industry shall be paid, at a minimum, the prevailing wages rates as certified by
said Department. .
e. It is understood and agreed that the entire Agreement is contained herein and that
this Agreement supersedes all oral and written agreements and negotiations
between the parties relating to the subject matter hereof.
f.
Any amendments, alterations, variations, modifications, or waivers of this
Agreement shall be valid only when they have been reduced to writing, dilly .
signed by the parties.

g. Contracts let and purchases made under this Agreement shall be made by the
Municipality in conformance with all laws, rules, and regulations applicable to the
Municipality.
h. The provisions of this Agreement are severable. If any paragraph, section,
subdivision, sentence, clause or phrase of this Agreement is for any reason held to
be contrary to law, such decision shall not affect the remaining portion of this
Agreement.
1. Nothing in this Agreement shall be construed as creating the relationship of co-
partners, joint venturers, or an association between the County and Municipality,
nor shall the Municipality, its employees, agents or representatives be considered
employees, agents, or representatives of the COlmty for any purpose.
11. PUBLICATION. The Municipality shall acknowledge the financial assistance of the
County on all promotional materials, reports and publications relating to the activities
funded under this Agreement, by including the following acknowledgement: "Funded by
the Anoka County Board of Commissioners and State SCORE funds (Select Committee
on Recycling and the Environment),

INDEMNIFICATION. The County agrees to indemnify, defend, and hold the
Municipality harmless from all claims, demands, and causes of action of any kind or
character, including the cost of defense thereof, resulting from the acts or omissions of its
public officials, officers, agents, employees, and contractors relating to activities
performed by the County under this Agreement.

13. TERMINATION. This Agreement may be terminated by mutual written agreement of
the parties or by either party, with or without cause, by giving not less than seven (7)
days written notice, delivered by mail or in person to the other party, specifying the date
of termination. If this Agreement is terminated, assets acquired in whole or in part with
funds provided under this Agreement shall be the property of the Municipality so long as
said assets are used by the Municipality for the purpose of a landfill abatement program
approved by the County.

discussion. I have attached some information that was taken from the Ad Hoc
Communications Task Force Report, November 14, 2001.
I thought that I would add some additional information since this report was put together.
The City has purchased and utilizes a scanner, Adobe PDF software and a new copy
machine that has scanning capabilities that are utilized.
Staff has been requesting that such items as zoning, address and trailway maps be
provided on disk. It has been a suggestion from staff that consultants provide their
written reports on disk, in PDF, so same can be retained off site. Some consultants are
reluctant to do so, but staff continues to request it.

IV. SURVEY UPDATE

Chair Brenner stated that all of the surveys had been distributed and the
Committee was waiting for feedback Chair Brenner stated that they were
distributed along with the newsletter. Discussion ensure regarding the prize give-
away and items. Chair Brenner stated that the polo/golf shirts were valued at $20
each and if they issued five (5) it would total $100. Consensus was that the shirts
to given away would be the polo/golf shirts. Chair Brenner stated that the coping
of the surveys totaled $117. Committee Member Abrahamson stated that he had
a co-worker that stated for $100 he would provide the Committee with a program
that would tabulate responses from residents, Committee Member Abrahamson
questioned whether Council approval was needed for this expenditure. Chair
Brenner concurred. Discussion ensued regarding forwarding the request to
Council to consider setting a not exceed amount at their next meeting.
Committee Member Abrahmson requested copies of sample, completed surveys
to provide his co-worker with same to ascertain an actual cost Chair Brenner
stated that she would notifY Staff that the Committee had an item they wanted on
the agenda, however, the item would be forwarded on Monday or Tuesday to
Committee members and Mr. Jim March along with a request that he forward
same to all Council members prior to their next meeting.
DOCUMENT IMAGING
The Chair stated that recently COImcil Member Capra, two (2) members of Staff
and herself had a brief demonstration of a product llllllled Laser Fiche, a
document imaging software. Committee Member Fairbrother stated that recently
he had participated in a Laser Fiche demonstration and informed Committee
members of same. Discussion ensured regarding capabilities of same, web page
capabilities, records retention, survey results and citizen desire, Consensus was
that the true value of the product would also be received by Staff for records
retention, etc. and would need to,involve Staff and Mr. March if the Committee
were to make a recommendation to Council for consideration. Discussion also
ensued regarding cost effectiveness. Chair Brenner stated that the City of Circle
Pines has purchased the software and is utilizing same. Committee Member
Abrahamson suggested that the Committee or Staff meet with same to discuss
their usage, web capabilities, etc. Consensus was that the anticipated expenditure
of this system would be $40 - $50,000. Chair Brenner questioned whether the
Committee desired to wait for additional proposals or research other options.
Committee Member Abrahamson stated that it would be wise to contact the City
of Circle Pines to ascertain usage and cost benefit Consensus was that Staff and
Mr. March ascertain the benefits for the administrative and Public Works
perspective. Committee Member Fairbrother stated that staff would need to scan
every document into the system. Committee Member Witzel stated that the City
could hire a temporary position to complete same. Committee Member
Fairbrother volunteered to discuss Laser Fiche with the City of Circle Pines.

VI. . TOWN LIFE MAGAZINE
Chair Brenner questioned whether CoinInittee members had a chance to review
same and stated that she had spoken with Ms, Katherine Kerry, the publisher of
Town Life Magazine, to thank her for expressing interest Chair Brenner stated
that she liked the magazine, however, was unsure if it met all of the City's needs.
Committee Member Fairbrother felt that it WllS rirther expensive, Committee
Member Abrahamson stated that the magazine was delivered to a larger
geographic area and EDC may be interested in same, Chair Brenner stated that
the magazine is mailed to 10,000 homes with an additiona11,000 magazines
being sold at retail centers and subscription for annual delivery, Mr, Klang
questioned the impact of those same numbers if the City also participated, Chair
Brenner stated that an additiona11,300, Chair Brenner stated that the annual cost
for a two (2) page report would be $14,400, $2,400 per issue at six (6) issues for
one (1) page would be $7,000, Consensus was that it was not comparative to the
newsletter due to the limited amount of space and selectiveness, Consensus was
that the magazine would be better utilized as a public relations tool rather than a
newsletter, Discussion ensued regarding the use of The Quad Community Press,
Consensus was that the The Quad could be utilized for the more immediate items,
the quarterly utility billing could contain information, and the use of the Town
Life Magazine for more feature related articles, Chair Brenner requested wbat
should be done regarding the tabled newsletter in the interim, She believed that
Council was looking for a recommendation in the area of a newsletter,
Discussion ensued regarding upcoming events throughout the summer, the hiring
ofMs, Scott by the Hugonian, her position on the Fete des Lacs Committee, The
Chair stated that she wanted the Committee to consider the short-term needs of
the Communications Ad Hoc Committee without a newsletter, Consensus was
that The Quad and the Hugonian were the two (2) largest viewership areas
available. Committee Member Fairbrother stated that Mr. March agreed to e-mail
the Week fu Review to residents V{ho requested same. Consensus WllS that in the
interim, e-mails to residents and announcements to The Quad would be utilized to
communicate with the residents until the survey resnhs are received.

Discussion ensued regarding the willingness and availability of Staff to draft
something to be printed in The Quad. Chair Brenner stated that the City would be
hiring an intern this summer, which may allow Staff to summarize Council
meetings that can be forwarded to the two (2) local papers. Consensus was that
Council would need to determine what information would need to be released to
the papers and Staff would need 10 draft and forward same. Chair Brenner
suggested adding It Communications item on Council's agenda allowing Council
to determine their communication desires for that two (2) week period and Staff
would draft and forward same to the paper. Chair Brenner stated that she would
attend the next Council meeting to recommend same.

IV. SURVEY UPDATE
Chair Brenner stated that the deadline for survey submission was June 1, 2001.
Committee Member Abrahamson stated that his co-worker had completed the
program and it was available on disk. Committee Member Abrahamson
volunteered to enter the surveys into the database. Chair Brenner stated that she
had spoke with Committee Member Witzel earlier that day and she had stated that
she would be able to complete same. Committee Member Abrahamson reviewed
the program with the Committee. Chair Brenner stated that the drawing for the
five (5) polo/golfshirts should be completed and Council's June 13,2001
meeting. Chair Brenner stated that she would arrange same. Committee Member
Bode suggested setting up two (2) different databases for
committee/commissions, staff and citizens. Chair Brenner stated that Committee
Member Bode would retrieve all survey boxes from local business and contact her
and schedule pick up for same. Chair Brenner would then forward to Committee
Member Witzel for entry. Committee Member Abrahamson will familiarize
Committee Member Witzel with the program. It was anticipated that it would
exceed four (4) hours for entry, but results would be available for their next
meeting.

DOCUMENT IMAGING
Committee Member Fairbrother stated that he had spoken with a Staff member of
the City of Circle Pines. She explained that the City Administrator, Mr. Jim
Keinath, had research several document imaging vendors. Committee Member
Fairbrother stated that the City of Circle Pines purchase Laser Fiche in 1997 and it
cost $7,151. The equipment purchased was a server, scanner, etc. Committee
Member Fairbrother stated that they purchase same from a vendor named
Software Tailors, Inc. Committee Member Fairbrother stated that the City of
Circle Pines is utilizing the software for ongoing items only, if time allows, they
would use same for older records. The Staff member reported that they have been
experiencing problems with the software/computer and slowing speeds.
Committee Member Fairbrother questioned the Staff member as to would they
purchase the same system or a different system and the Staff member stated that
they wonld retain Laser Fiche. Committee Member Fairbrother stated that the
Staff member stated that the scanning of documents was highly time consuming.
Committee Member Fairbrother reported that retrieval of documents was
excellent. Committee Member Fairbrother stated that he would contact Software
Tailors, Inc. Consensus was that the City cannot spend money on technology and
not use it. It was felt that no one has responsibility for the web site, cable
channel, etc. so these items are not being used.

Bode to recommend uudatine: the web site with cnrrent information and
Laser Fiche be reviewed bv Administrative Staff. All in favor. Motion

Background
In 1997, the City of Centerville was looking to create a web site for informational
purposes, and Media Junction was a new business in Centerville. The City asked Media
Junction to develop a web site. Media Junction created the web site
(www.centervillemn.com) at no cost and charges the city $50 per month for host fees.
Any updates to the web site are sent to Media Junction, and the City is charged a
discounted rate of $40 per hour. The updates could be done electronically, either e-
mailing or sending a disc, or Media Junction could type the information onto the web
site.
Currently, the web site has five sections with nested sections as follows:

The purpose of the Communication Task Force is to evaluate current systems and
recommend methods that enhance participation from the citizens ofCenterville.

The Internet is changing the way we work, interact, look for information, and order goods
and services. City halls are learning their citizens expect the same online access to their
city government. Citizens want to be able to log on to their city's web site and register
their kids for a summer program, notify the public works department about a pothole in
their neighborhood, or find out what happened at Wednesday night's City Council
meeting. City officials and staff, in turn, are looking for efficient and effective ways to
communicate with their citizens, businesses, and community organizations.

The Communication Task Force was concerned about the information currently on the
web site as well as the ability to communicate using the web site.
When the Communication Task Force first met and pulled up the city web site, the
information was outdated. The names of the council members had not been changed, the
newsletter was old, and the City Council minutes were not up-to-date. The basic
information is good, but the sections that have informational changes are very hard to
manage.
Users could link to several local businesses from the Centerville web site, but the
"Contact Us" section only had a list of phone numbers and e-mail address for City Hall.
The Communication Task Force approached Media Junction with the possibility of
adding a bulletin board for users to communicate. Media Junction would be able to
upgrade the web site at a cost of$l,OOO.
In order for the City web site to be effective, people have to be given access to the most
current information possible. They also need a way to communicate concerns. If either of
these two elements is missing, the number of users going to the Centerville web site will
surely decrease.

The Communication Task Force studied several possibilities, which are listed along with
prices.
1. Media Junction - City Administrator will need to develop a better plan to keep
updates current. Add a bulletin board for communication purposes. Cost: $1,000
for bulletin board, $40 per hour to update, and $50 per month host fees.
2. Laser Fiche - Document imaging that combines storage of records and a web ~..t2
link for users to obtain information. This system is very user friendly with the + '
added feature of storing documents. Cost: $14,694 plus $9,000 per year for the
web link.
3. Twin Cities Media - Create a web site that is more user friendly, with the ability
to update information controlled by the City. Cost: Approximately $8,000 and
$50 per month for host fees.
4. Web for Cities (GovOffice.com) - Web site created by the League of Minnesota
Cities (LMC) for cities to create and maintain their own web sites. Cost: $500
start-up fee and $35 per month for host fees.

Recommendation
The Communication Task Force recommends GovOffice.Com as the best value for the
Centerville Web site.

The League of Minnesota Cities (LMC) created Web for Cities with the help of fourteen
Minnesota cities, ranging in size from 700 to 52,000. These cities, in cooperation with
LMC staff and A venet' s team of developers, evaluated the existing technology, suggested
improvements, and tested the changes. The result of their efforts is the new
GovOffice.com web site development tool.
GovOffice.com is easy to use, affordable, accessible, secure, and fully supported through
GovOffice Customer Service.
Attached is a sample of GovOffice. Com for Springfield. The City can create as many
sections and nested sections as they desire. Information can be images, audio, video,
documents sidebar and related links. There are several pages showing the administrative
functions. Little Canada was one of the fourteen cities that helped create
GovOfffice.com, and their home page is also attached. Notice the search function,
allowing users to find information quickly. The Communications Task Force spoke with
representatives from two of the fourteen involved cities in GovOffice.com development.

Cost
With GovOffice.com, cities are charged according to population (see attached pricing
structure chart). Attached is a quote from GovOffice.com as well as a breakdown of
expenses for the first year totaling $1,180. This total includes $60 for a customized
header, enabling Centerville to stand out. After the first year, the expense would only be
$35 per month for 12 months, or $420 per year. By comparison, Media Junction's price is
$50 per month, or $700 per year, plus $40 per hour to update any information, including
City Council minutes every 2 weeks.
The Centerville staff will be responsible for creating and updating the web site. Start up
time for the new web site will take approximately 20 hours, while updating the web site
will take approximately two hours every two weeks. The possibilities for involving the
community in the Centerville web site are endless. Periodically placing citizen photos on
the web page, single question surveys, community calendar, posting results of local
teams, and pictures from local events are just a few ways to have the citizens participate
in the web site. The web site will need to be part of the weekly routine by Centerville city
staff in order to make it successful.
GovOffice.com has the experience and technological support to make Web for Cities the
best value to our community.

2 comments for you today. Can you provide me with addresses for Mary Capra & the other
person (Kleinhorst???) running for Mayor? Our Board wants to send them an invitation to
address the Board of Directors of their association.
Regarding the 2 single family home mailboxes that are near an Eagle Pass resident (by 1854
Pioneer Lane) the Board is going to drop this matter. We drove around the area & there's
really no other place to locate these mailboxes without being in the yard of another Eagle
Pass resident! Subsequently, this matter can be withdrawn.

Metropolitan Council Hosts Public MeetinQs on Reaional Transportation Plan
Public hearing set for Sept. 27 at 5 p.m.
ST. PAULo-Aug. 31, 2004--With more people, and more people making more trips and
traveling longer distances, the Twin Cities is expected to generate another 4 million daily
trips by 2030, for a 37 percent Increase in travel on metro-area roads. Currently,
motorists travel about 56 million miles a day in the region. In an average week, the
number of vehicle miles traveled in the Twin Cities is three times greater than the
distance to the sun--93 million miles away.

To help plan and prepare for growth in travel, the Metropolitan Council is updating the
regional Transportation Policy Plan (TPP), an update that federal law requires every three
years. The Council has adopted a draft plan and will take comments and questions at a
series of upcoming information sessions, with a pUblic hearing Sept. 27 and final adoption In December.
"The region Is at a crossroads with respect to transportation," said Council Chair Peter Beil. "While there Is no 'sliver bl
eliminate congestion, the TPP includes policies and strategies to help slow the growth in congestion and improve mobil
In 1990,30 percent of the region's freeway lanes were congested during peak periods; by 2000, the figure had grown
percent. In the Council's 2003 survey of metro area residents, traffic congestion ranked as the No. 1 concern, outpacir
education and housing.
"Growth is a good thing, with many benefits and positive implications for the region," said Bell. "But it also comes with
challenges, as anyone who sits in rush hour traffic can attest. Our goal is to help manage and mitigate congestion in tt
cost-effective way possible."
Policies in the TPP include:
. Planning and investing In multi-modal transportation choices based on the fuil range of costs and benefits.
. Encouraging mixed-use development in centers along transportation corridors that better links housing, jobs an
amenities, and reduces the need for single-destination trips.
. Making more efficient use of the regional transportation system by encouraging flexible work hours, telecommu
ridesharlng and transit ridership.
. Focusing highway investments flrst on maintaining and managing the existing system, and second on slowing c
. Building transit ridership by expanding the current bus system and developing a network of dedicated rail and/,
"transitways. "
. Encouraging local communities to Implement a system of fully interconnected arterial and local streets, pathwa\
bikeways.
Council members and staff will be on hand at public information sessions to hear from the public and respond to questl
addition, officials from the Minnesota Department of Transportation will be available to discuss the update of their Trar
System Plan. The Council and Mn/DOT work collaboratively on transportation planning in the metro area.
