SET AGENDA Mayor Sweeney indicated that Chauncey Barett Gardens concept plans would be heard after the Consent Agenda. Council Member Capra requested that input from the HERON group with regard to Eagle Brook Church be added under appearances. Council Member Lee requested that a discussion concerning the location of the trail in Hunter's Crossing, Second Addition, Phase I be added under Old Business. Public Works Director/Building Official (Monthly Update) Mr. Palzer indicated the hockey rink is open and said he would be putting together specifications on the new vehicles for 2004. He also informed Council that he has been working with EDC, Parks and Recreation and the Lions on the Frozen Fete des Lac. Mr. Palzer indicated that Mr. McPherson is in the training phase of that and will be expanding his duties. Ms. Moore-Sykes indicated that Staff is working on an advertisement for the Public Works employee position. Council Member Lee asked whether the Sheriff has checked the ice thickness for the festival. Mr. Palzer indicated that would be done one week before the event. 2. Heron GrouplEagIe Brook Church Doug Jost, 7304 Brian Drive, indicated he and the neighbors have been working on this matter since the proposed development carne forward. He then handed out a letter to Council that he read outlining his concerns with the proposed church. Council Member Capra indicated that she received information with regard to the Eagle Brook Church and then said that the City is involved in the Tri-City Coalition in an attempt to keep informed about issues that affect the City. Council Member Broussard Vickers commented that Lino Lakes has not asked for input from CenterviIle on the project. She then cautioned those concerned that, if the church does not go through, something else would because that property is too valuable to sit as agricultural land. She then said she is not sure what the highest and best use of the land is but it could be something with more of an impact than the church would have. She further commented that this City cannot tell Lino Lakes how to develop its land. /"I.!J^I.A'/J!../Vvr.€/v.,r..t'-<'-,-, Council Member Capra indicated she spoke with Ms.~arlson from the Lino Lakes Council and told her that she is concerned that the construction time frame respect the nesting season for the herons_ She then said that the City is involved in the Tri-City Coalition and noted that the DNR and Rice Creek Watershed District are studying the corridor. Mr. Jost indicated that they would like Council to draft a letter letting Lino Lakes know that the City ofCenterville is concerned about the potential impact on the heron's nesting season as well as the potential traffic impact to the City. Council Member Capra commented that the ramps may be updated within the next year or so prior to the bridge work. Council Member Broussard Vickers commented that, in order to raise the project to the level of needing to do something, traffic has to be consistently backed up. Page 3 of! 0 City of Centerville January 28, 2004 Council Meeting Minutes Council Member Capra indicated she does not have an issue with sending a letter to the Lino Lakes Council requesting that they be cognizant of the heron nesting if the project is approved. Council Member Broussard Vickers indicated she did not have an issue with sending a letter about the nesting birds and general construction traffic. Stacy Wittner, 7542 Peltier Lake Drive, Lino Lakes, indicated she is concerned that there is no communication about such a large development so close to the borders. She then provided information on the church indicating it is more than 84,000 square feet with 4,000 to 6,500 attendees. She then said that this is far more than a church they have six services, two on Saturday and four Sunday with more than 40 other programs during the week making it a seven day per week operation. Ms. Wittner indicated that there are 700 cars per service making 2,800 trips on Saturday and 5,600 trips on Sundays. She then said that it is possible to take 77tb to Peltier Lake Drive to Old Mill Road to Peterson Trail or back out onto 20tb Avenue as a short cut through the neighborhoods. Ms. Wittner indicated she went to the church's current location to observe traffic and the traffic they have now is a mess. There is 200 feet between the four-lane highway and the church and a stoplight and traffic officer that helps manage the high volume and there is still significant backup. Ms. Wittner indicated that the church does not provide tax dollars for upgrading the roads and this church would provide a serious and significant impact to the existing roads. She then said it would be possible to build only 9 homes on that property if the church were denied and she would prefer that. Ms. Wittner indicated the next City Council mee1ing in Lino Lakes is February 9, 2004 and noted that she asked the Planning and Zoning Commission if they would support postponing construction during the heron nesting period and only one member thought it was a good idea and the others said no. Council Member Broussard Vickers indicated that the City is aware of the project but has not been asked for its input on the project because Lino can develop its land anyway they see fit. Ms. Moore-Sykes indicated that they have received postcards in the mail with meeting dates and Council and the Mayor have been invited. Clearwater Trail Grant Mr. Wayne LeBlanc indicated that the Parks Committee has been working on a grant for funds for a trail across the easement east of LaMotte Park following the creek across the freeway connecting with Hugo. Mr. LeBlanc indicated that the deadline to submit the grant is approaching and they are asking that Council provide a letter stating that the matching funds would be available. Council Member Lee asked how much the matching would cost the City. Mr. LeBlanc indicated that it would be a $100,000 match from Centerville. Council Member Capra asked if the Parks Committee has been working with Lino Lakes and Hugo to keep them aware of the plan for the trail. Mr. LeBlanc indicated that they have been working with Lino Lakes, Hugo and Anoka County and all are aware of the proposal. Council Member Lee indicated that usually the first application for a grant is denied but there is more than a slight possibility that the City could receive this grant. Council discussed the grant and the trail and agreed that funds were set aside to have available for grant matching within the parks budget. Suzanne Seeley, 1784 Peltier Lake Drive, indicated that two resolutions are required one is that Council supports the application of the grant and the second is that the City supports the project they are applying for. She then said that those resolutions would need to be attached to the grant when it is submitted. Staff agreed to draft the resolutions for consideration at the next meeting. VI. PUBLIC HEARINGS None. vn. NEW BUSINESS 1. Plans and Specs Water Tower - Resolution #04-005 Mayor Sweeney indicated he thinks that the City should have the logo on the tower like other cities. Council Member Lee agreed. All in favor. Motiou carried unanimouslv. 2. Radio-Signal Telemetry Svstem Mr. Peterson indicated he had provided a memorandum to Council concerning the radio- signal telemetry system and explained that the system would take care of the tower, two wells, and the lift stations. Mr. Palzer indicated that it would put security alarms on the doors and run the wells. Council Member Capra asked whether the City's two wells needed to be secured better. Mr. Palzer indicated that they did and said they would be doing something soon. He also indicated that this system would tie in the door alarms and the well heads. Motion bv Council Member Lee. seconded bv Council Member Caora to Dreoare plans and bid specifications for the telemetry system for the water tower oroiect. All in favor. Motion carried unanimouslv. 3. Resolution #04-004 2004 Residential Street Improvements Feasibility Study Motion bv Council Member Broussard Vickers. seconded bv Council Member Paar to aoorove Resolution #04-004 as presented. AD in favor. Motion carried unanimously. 4. Slaughter House Ordinance #75 Ms. Moore-Sykes reviewed her Staff report with Council indicating that the R-l zoning designation allows agricultural type uses such as a slaughter house with the condition that the property be at least 10 acres in size. She then explained that there were only a few parcels in the City that would be the appropriate size and then provided some suggested language for clarifying agricultural uses within Ordinance #4. Ms. Moore-Sykes indicated that the moratorium ordinance expires at the end of February and, if Council would like to amend the language, the ordinance should be extended. City Attorney Hoeft clarified that if the use is allowed in the R-l district within certain parameters and not mentioned in another zone then it is not allowed unless by variance or special conditional use. He then said that it would be possible to purchase more than one parcel to obtain the necessary size piece of land but, from an economic standpoint, that may not be feasible due to the land costs in the area. Council Member Broussard Vickers indicated she feels that the City needs to do wording that defines what the R-l uses are and specifically include slaughter houses. Page 6 of 10 City of Centerville JanuaI)' 28, 2004 Council Meeting Minutes City Attorney Hoeft indicated it could be a point of clarification to make in the ordinance to bring specific reference to slaughter houses but, Staff interprets them to fall under agricultural uses. Motion bv Council Member Lee. seconded bv Council Member Caora to extend interim Ordinance #75. All in favor. Motion carried unanimouslv. City Attorney Hoeft indicated that it was appropriate to extend by motion because the original Ordinance allows for up to 18 months. 5. Resolution #04-007 - 2004 Fee Schedule Council requested that the garbage hauler certification costs be raised to $50.00. Council Member Broussard Vickers indicated she feels the park fee should be increased along with all other fees requiring Staff time. Mayor Sweeney indicated that it was discussed at the strategic planning meeting that it is not cost effective to have police officers or CSO's performing animal control functions. He then said that the City needs to look into having an animal control company for that purpose. Ms. Moore-Sykes agreed to look into it. Council Member Capra indicated that some residents have asked that the pet license fees be for a longer period and be slightly increased. Motion bv Council Member Broussard Vickers. seconded bv Council Member Lee to table to the next meetin2 for better information on animal control and to allow Staff time to review the fees to be increased. AU in favor. Motion carried unanimously. 6. Kelly's Komer Compliance Check Failure (2nd Violation) Res. #04-002 Council Member Capra indicated that the City could add an additional compliance check over the two per year and she would like to do so. City Attorney Hoeft indicated that the City can do as many compliance checks as it wishes to but it is a cost and timing issue with the police. Mayor Sweeney indicated he did not think: it would be prudent to add additional compliance checks since the department is short of officers. Council Member Capra indicated she would like one additional compliance check within the next six months. Council Member Broussard Vickers indicated she is not in favor of doing an additional check due to the fact that the department is short staffed. Centerville Lions Request for Special Event Permit - Fishing Contest Mr. Kieselhorst indicated they have permission from Water Works for access but could obtain it in writing ifnecessary. Council Member Broussard Vickers indicated that the City would need to be listed as an additional insured. Mr. Kieselhorst indicated that the City would be named as an additional insured. Motion bv Council Member Caora. secouded bv Council Member Lee to aoprove the soccial event apolication for the 2004 ice fisbinl! contest on February 7. 2004 from 11:00 a.m. to 2:00 p.m. All in favor. Motion carried unanimously. 8. Centerville Lions - Fete des Lacs 2004 Council Member Capra indicated she would be opposed to doing the noise permit until l:OO a.m. and would prefer midnight. Council Member Lee indicated he has no issue going to midnight. Council Member Capra indicated that last year Council requested that alcohol stop being served at 11 :30 p.m. and that is her request for this year. Concept Plans - Chauncey Barrett Gardens Phase IT Ms. Karen Skepper, representative from Anoka County, presented the plans for Chauncey Barett Gardens Phase IT. Council Member Capra asked if the plans were available for current residents at Chauncey Barett. She then asked that plans be made available to them. Ms. Skepper indicated the building would be marketed to the general public including those at the existing building and she agreed to provide drawings at the rental office at the existing building. Council Member Capra asked if they anticipated any issues with underground garages and the water table. Ms. Skepper indicated that initial soil borings were done and it should not be an issue. Ms. Moore-Sykes indicated that a variance will be needed because the ordinance only allows for 16 units. IX. OLD BUSINESS 1. Hunter's Crossing Trail Location Council Member Lee indicated he had spoken to Staff and they are concerned with the trail location as it is very low and the area holds water most of the time. He then asked City Engineer Peterson to review it. Mr. Palzer suggested moving it down four or five lots because the water will flow over that trail because there is a large swale there for drainage. Mr. Peterson indicated the issue could be alleviated with a culvert and agreed to look into it. X. ANNOUNCEMENTSIUPDATES 1. CSAH 14 Ms. Moore-Sykes indicated that a newsletter with information on the upcoming public informational meeting would be mailed to residents prior to the February 19, 2004 meeting at Wargo Nature Center from 5;00 p.m. to 7;30 p.m. She also indicated that Staff would be putting the information on the cable channel as well as the sign out front. He then said that there has been an overall feeling of lack of direction and support from the cities and the new goveming board hopes to eliminate that. He further commented that the immediate issue to be handled is to find space to lease that works better for the police department while a potential new building is being considered. Ms. Moore-Sykes indicated that the March, 2004 Planning and Zoning Commission meeting has been rescheduled to February 17, 2004 due to the fact that it is caucus night and the City carmot hold a meeting. My street is one that is included in the 2004 Street Reconstruction Proposal. I was unable to attend the meeting on Wednesday, January 29, 2004, so I apologize if my comments and questions were answered during that session. My husband, Keith, was able to attend for most of the meeting though. 1. I would like to see sidewalks down Center St. included in the proposal. I feel this would enhance the look of the street and improve safety for the children living on this street and the circle drives that connect to it. More residents would have access to Eagle Park, as well as the trail going to the beach on Centerville Lake. The current proposal for the sidewalk is to run along Dupre St., on our property, and hook up with Eagle Park. This would mostly benefit the residents in the new Pheasant Marsh subdivision and the subdivision North of the park (the places where sidewalks currently exist, or will exist in the future). I feel that the Center St. residents would end up looking like the "mediocre" neighborhood in comparison to the new homes and the aesthetic and safety benefits they have with sidewalks. I also feel that the cost of the sidewalks should be split up among everyone undergoing the street improvements. It will benefit many more people than just the ones whose property it is on. 2. Since we live on a corner lot, on Center St. and Dupre St., I would like to know how the financial cost is determined. Are we assessed two "units" ecause of the corner lot? We also already have curb and gutter on approximately two- lirds of our property. The original owners of our property were assessed for this before. Is this something you are taking into consideration? I don't believe that we should be .assessed fully for curb and gutter again if we already have it in place on some of our property. Thank you for the time you have already put into this project. I believe that there will be substantial benefits to our property value by making the improvements, and it should also help solve some of the water drainage problems our property has encountered. The drainage ditch behind our house was dredged and extended to the new housing development that is also behind our house. Connecting water from the main at the street to the house is the responsibility of the property owner and as such, the property owner is able to select a plumbing contractor to do the job. While we have no definitive answer as to what future hook-up costs will be, it is generally agreed that costs will increase by at least 3% to 5% annually. These figures can also be used to estimate labor costs each year. Any material cost increases are dependant upon demands and any increases in production costs. It would probably be best to contact a plumbing contractor to find out what Cost of Living (COLA) figures they generally use for this type of a job. 2. Can we get a schedule of the work? I would like to know when Tourville Circle and Center Street will be under construction. You can view the feasibility study documents on the City's web page, which can be found at www.centervillemn.com. That document has a basic schedule of the proposed project, which shows construction to start in May and being completed in September. Of course ,this document assumes that the City Council will approve the project and these preliminary dates are all subject to weather considerations and material availability. Please note that the public hearingfor the 2004 proposed street reconstruction project is scheduledfor February 11, 2004. A more detailed work schedule will be available if the project is approved and a contractor is selected as a result of the bidding process. 3. This easement is part of the Pheasant Marsh development and not generally available for use by others unless permission is obtained from Ground Development, the property owner. 5. City Staff will contact Waste Management of the construction schedule once the project receives approval so that pick-ups can be coordinated with that schedule. 6. How will the school bus stops work? Again, we will contact the bus company should the construction begin before school is outfor the summer or if the construction is not completed before school begins in the fall. This was done last fall when Mound Trail was being reconstructed 7. What is the due date for the assessments? Once the project is completed and City Stqff has what the real costs of the street project are, those costs will be submitted to the City Council at a scheduled Ih ....'" Once those final costs are approved, a final special assessment notice will be sent to those affected property owners advising them of the amount of the special assessment and when it is to be assessed. Generally, a property owner has 30 days before the assessments are certified to Anoka County. The exact language of the resolution reads: "The Owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, exceot that no interest shall be charged if the entire assessment is paid within 30 davs from the adootion of this resolution; and [the property owner) may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. " The public hearing to approve those final costs is tentatively scheduled for October. As you can see below I work at the Carlson School of Management in the Departments of Accounting and Finance. It is a privilege to work with some of the great minds of the financial world. One thing that I have learned is everything is an investment and you have to determine what you are getting in return for spending your money. Buy a new truck, you lose money the moment you put in the key, hopefully your returns will come from usage of the vehicle. When I crunch the numbers i1looks to me that in the past 5 years my investment in housing has gained nearly 70%, my taxes have gone up 25-40% according to one member of the audience. The new improvements are about a 5% expense on my investment, but they have a potential to raise my return far more than that. So right now I am looking at about approximately 40% increase in retum on my investment in the last 5 years. Not only that, but the city of Centerville is going to offset some of the costs of this improvement and not raise my taxes? DAMN! You guys are good, very good. If anything I would ask that if at all possible the city should do more. Can we please get sidewalks on Center Street? It would give a much more finished look to the area, add value at a relatively small cost and make the neighborhood safer to move about. If those same people that are complaining about the costs would have put their money in a mutual fund or in stocks, chances are they wouldn't have come close to that kind of return. Beyond the money issue, it makes our neighborhood better, and should give the residents a better feeling for updating their own properties. If any of the residents of my street want to know what they are getting from city govemment, they only have to look at the price of the homes on their street. Currently there is a house for sale that is going for $239,000. Six months ago that same house was for sale at $190,000. That is incredible to me. Maybe the guy doing his budget at the kitchen table who is trying to scare residents with thoughts of a mass exodus. Should buy himself a desk, get a computer and read what's going on around him. He would probably sell his house and take his princely profits with him. Thank you again to all of you and your hard work. You are doing a splendid job, regardless of what a few said last night. I will not only vote for all of you, if you need help (web page, desktop publishing, etc...) feel free to ask me. I'm not certain at this time what the City wants to do with the proposed water assessment for the main along Lamotte and Heritage. Since it appears the church is planning to develop the property in the foreseeable future, we will need to adjust that number. In the Feasibility Report, I figured 8 equivalent residential units for the church property. Based on the preliminary plan you showed me at the Information Meeting, we would likely not charge for 8 units. The other charges (street, storm, curbing) would still be assessed for the proposed improvements along both streets. Again, since I am assessing on an equivalent lot basis, there is a total of 8 equivalent residential lots that would "fit" along both streets. One oflhose lots would be a corner lot at Heritage and Lamotte. Like other areas in the city, a comer lot counts as 1.5 uni.ts for the street portion ofthe assessment. In this case, I did not even use the 1.5 factor and kept your number at 8 units. Therefore, the storm unit assessment of $946 X 8 = $7,568. Street = $2,719 X 8 = $21,752. Curb = actual fronlfootage X $13.12 per foot = $11,808. Call me if you have any questions. In addition, could you please send a copy of the proposed development for the property? I write this letter with a strong opposition to any changes to the street or water as proposed by the Council. Notice that I didn't use the word improvements as you did in your notice; this is because I cannot see what the council is proposing as an improvement, or a small improvement at best. Certainly not so great of an improvement as to warrant the ridiculous amount of the proposed assessment. I can only speak for my piece of property and the street I've lived on for the last five years; my road, to my understanding, was built in the mid eighties and is less than twenty years old. There are no serious drainage problems and no serious damage to the road such as potholes or major cracks. As far as the water goes, well, I have no problem with my well water. I actually like it that way. There are many other reasons that I'm opposed to the Council's proposal. One is that our country is still in a time of fiscal recovery. I'm sure that I'm not the only person to be affected financially by the events of the past few years. And any assessment, even if it is paid out over several years, will greatly affect my budget. Not to mention that with interest the real money I spend on the assessment will be double or triple the assessed value. As with any purchase that an individual makes, that individual must take into consideration the value of the purchase opposed to the cost of the purchase. I'm sure I don't have to preach economics 101 to the Council. My point is that it might be nice to have new roads and gutters, but the cost far outweighs any benefit that I'm going to see. I'm sure the Councils' argument is that it will increase the value of my property. To that I say that this is true because the appraisers and surveyors say it is true, and even with that I can't see it improving the value of my property as much as the proposed assessment. It is not real money to me and I would not benefit unless I sold my property. I can go on and on, but I'm sure the Council has several other anger letters to read and upset residents to listen to. If there was a vote of all the residents affected and it was concluded that the majority of the affected residents think that this is a good idea, then so be it. But from what I've heard, there is a lot of resistance to this proposal. The only people I see benefiting from this is the contractors, construction companies, and the banks or whoever will be collecting my interest. Thank you for taking your time to read my letter. Water Revenue Bonds, Series 1996 - (see attached) 1) Call Notice - In order to payoff the 1996 Bonds, the City must adopt a Call Notice, The Notice states your intent to payoff the remaining principal and any accrued interest. Adoption of the Call Notice is necessary so the Paying Agent can notifY the holders (investors) of the Bonds that the City intends to pre-pay. The notice to the bondholders can take up to 45 days. The Notice states that the City will payoff the remaining principal ($190,000) and any accrued interest due on April 1,2004. Since the interest rate on the remaining principal varies from 5.10% to 5.40%, it would probably be prudent to pay the bonds of[. Since many of the assessments have been prepaid and the City has the money, the additional fees associated with refunding the bonds would make refinancing a less desirable option. The amount of principal due is $190,000. Since 30 days notice is required to call the bonds, there will also be approximately $1,200 in interest due. The balance of the Elementary Water Main Debt Service Fund is $140,895.33. The City will be collecting a total of $35,694 in special assessments over the next three years. There will be a shortfall of over $14,000 in the fund even with an early payoff. However, waiting until the maturity date of the bonds may result in more than double that amount. H Council wishes to pay of[ the bonds, it will be necessary to make a temporary transfer of $50,000 from the General Fund or one the Enterprise Funds. As assessments are received, the transfer will be repaid. Page 1 J GOVERNMl:NTAL IMMUNITIES Recreational-use immunity Habeck brought a wrongful-death action after a child's death that occurred as a result of fulling from a tractor-trailer used to transport county fur visitors within the county fairgrounds. The county and the tractor-trailer driver brought a motion for summary judgment, arguing they were protected from liability under the recreational-use inununity statute, Minn. Stat. ~ 466.03, subd. 6e. The district court dertied summary judgment, ruling that the term "property" in the recreational-use immunity statute meant real estate itself, including fixtures and appurtenances, and excluded the tractOT- trailer. The MN Court of Appeals reversed, holding that county-sponsored transportation of county fair visitors within county fairgrounds is a recre- ational service for the purposes of the recreational-use immunity statute. The Court of Appeals further ruled that the child-trespasser standard, tather than the less rigorous general trespass standard, is the appropriate standard for the district court to apply in deterrrtirting liability on remand. Habeck v. Mille Lacs County Agric. Soc'y, 669 N.W.2d 907 (Minn. Ct. App. 2003). CRIMINAL LAW Investigatory stop A Chaska police officer, responding to a Carver County dispatcher's description of an erratic driver in Chanhassen, stopped a car Y oraway was driving. The stop occurted outside of Chaska. Y oraway challenged the district court's subsequent order sustaining the revoca- tion of his driver's license under the implied-consent law, arguing that the arresting officer had no authority to stop him when the alleged illegal driving occurred outside the officer's territorial jurisdiction. The MN Court of Appeals held that a police officer has authority to stop a vehicle when the illegal activity JANUARY 2004 commences and the stop occurs com- pletely out of the officer's jurisdiction, if the officer is acting within the course and scope of employment. The Court of Appeals further held that an on-duty police officer is acting within the course and scope of employment and may lawfully stop a vehicle outside the officer's jurisdiction when assisting an officer of another jurisdiction. Yoraway v. Commissioner of Pub. Sqfety, 669 N.W.2d 622 (Minn. Ct. App. 2003). LOCAL IMPROVEMENTS Special assessments The Roberts own property that was specially assessed $17,300 for installation of infrastructure, including sewer, water, curbs, gutters, and bituminous streets. The Roberts appealed the assessment pursuant to Minn. Stat. ~ 429.081. At trial, the Roberts called no expert wit- nesses of their own but cross-examined the city's expert. The city called an expert appraiser who testified that the improvemenfs added a value of at least $25,000. The trial court ruled the Rob- erts had fuled to meet their burden of proof in challenging the assessment and dismissed the appeal. The MN Court of Appeals affirmed, holding that the Roberts had fuled to rebut the common- law presumption of validity because they had offered no evidence to counter the city's expert witness who testified that the special benefit is greater than the assessment. Roberts v. City of Lake Crys- tal, A03-172 (Minn. Ct. App. Nov. 4, 2003) (unpublished opinion). LICENSING Dangerous dogs After Pittman's dog allegedly chased and bit a rtine-year-old boy, the city declared the dog potentially dangerous and placed restrictions on it. Pittman appealed the decision and the city held a hearing before a hearing officer. Based on evi- dence and testimony presented at the MINNESOTA CITIES hearing, the officer deterrrtined that after Pittman's daughter let the dog out of its kennel, the dog escaped, ran around the house, and chased the rtine-year-old boy; when the boy tripped and fell, the dog bit the boy. The officer upheld the decision and found the dog potentially dangerous. Pittman challenged the decision by writ of certiorari. The MN Court of Appeals affirmed, holding that evidence in the record reasonably sup- ported the determination that the dog was potentially dangerous. Pittman v. City of St. Paul, C4-03-196 (Minn. Ct. App. Sept. 23, 2003) (unpublished opirtion). TELECOMMUNICATIONS Internet voice communication v onage markets and sells a service that allows customers to place and receive voice communications over the Internet. The MN Dept_ of Commerce filed a complaint with the MN Public Utilities Commission (pUC), alleging Vouage had fuiled to comply with requirements for providing telephone service in Minne- sota. The PUC concluded that V onage was required to comply with Minnesota statues and rules regarding the offering of telephone service. V onage filed a complaint in federal district court seeking a preliminary injunction. The court granted the injunction, holding that Tide ][ of the federal Commurtications Act of 1996 pre-empted state regulation of information service providers like Vonage. The court ruled that Vonage's voice communication service does not constitute a telecommunications senrice, but is an information service that uses telecommunications to provide enhauced functionality.
