CALL TO ORDER Mayor Sweeney called the Council Worksession to order at 6:30 p.m. Present at the meeting were Councilmembers Broussard Vickers, Capra, Lee and Paar; City Administrator Kim Moore-Sykes, Finance Director Ellen Paulseth, City Engineer Tom Peterson, Northland Securities representatives George Eilertson and Nick Skarich, Sedona Homes representatives Paul Kellior, Scott Montgomery and Pat Pelstring. II. DISCUSSION ITEMS a. Street Reconstruction Plan. Tom Peterson, City Engineer, presented a draft of the City Street Reconstruction Plan with timing modifications proposed for years 2004, 2006 and 2008. George Eilertson, Northland Securities, reported on the financing requirements regarding the use of bond proceeds. Mr. Eilertson indicated that generally the City can expect between 15% and 20% pre-pay from residents on their special assessments. He also indicated that these pre-paid amounts can be placed in a revolving account that can be used to help pay for the next project in 2006. The Council asked about the City's current interest rate for special assessments. Mr. Eilertson responded that he thought the City's interest rates are low enough to be competitive with the market. Council asked about including the 2008 street project in the bonding for 2004 and 2006. Mr. Eilertson indicated that that could be done, but that 5% of the total amount needed to be spent down within 3 years. He indicated that that is why those projects for 2008 were not included in this evening's proposal. Mr. Eilertson also recommended that the length ofthe City's bond for these street projects be expanded to 15 years in order to limit the City's financial exposure. Staff concurred. Council asked that this item be placed on the November 12th Council meeting agenda for further discussion. b. Tax Increment Financing Discussion. Nick Skarich, Northland Securities, presented information regarding setting up and administering Tax Increment Financing District for redevelopment. He indicated that economics dictated the size of the district; that doing individual parcels is not cost effective and not an efficient use of redevelopment dollars. When asked how fast the properties along 20th Avenue would develop, he couldn't answer as he said that redevelopment is market driven. He indicated that it would depend on the cost to the developer to acquire the property, the cost to demolish any existing substandard structures and the cost to remediate any existing soil conditions, i.e. wetlands, debris. He added that it is comparatively cheaper to develop unimproved land and that TIF is intended to offset the cost of mitigating existing conditions of the property to prepare it for redevelopment, thereby making redevelopment as attractive to a developer as unimproved land would be. Mr. Skarich also reported that if the City designates an area as a TIF District and no redevelopment activities commence within four (4) years, the properties within the district are automatically removed from the district. Council further discussed the issues associated with establishing and administering a TlF District. The City Attorney was asked what was needed to rezone the area and the City Administrator was asked to contact the Met Council about the City's high density residential benchmark. III. CALL TO ORDER Mayor Sweeney called the Council Worksession to order at 6:30 p.m. Present at the meeting were Councilmembers Broussard Vickers, Capra, and Lee; City Administrator Kim Moore-Sykes, Finance Director Ellen Paulseth, and Public Works Director Paul Palzer. Absent: Councilmember JeffPaar. II. DISCUSSION ITEMS a. Capital Improvement Plan & Authorizing Capital Proiect Expenditures for 2004. Council and Staff review the draft of the Capital Improvement Plan as prepared by the Finance Director. Council also reviewed proposed Capital Project Expenditures for 2004 and directed Staff to place this item on the January 14,2004 Council meeting agenda for further action. b. 2004 Street Reconstruction Plan. Staff reported that a public input meeting has been scheduled for January 29, 2004 at 6:30 p.m. at the Centerville Elementary School c. Worksessions. Council directed Staff to schedule worksessions at 5:30 p.m. on the fourth Wednesdays of the month, before the regularly scheduled council meeting. Worksessions will be held in the Council Chambers. d. CSAH 14. Staff gave an update on the reconstruction project of CSAH 14. The City Administrator reported that Anoka County and SRF have scheduled a public input meeting for February 19th at the Wargo Nature Center at 5:00 p.m. Ms. Moore~Sykes indicated that notices are being drafted and mailed by the County, with City Staff providing labels to all property owners and tenants. e. Snowmobiles. Councilmember Capra had asked Staff to verify if snowmobiles are allowed on the frozen creeks in town. Staff responded that in calling DNR, they were advised that as long as the snowmobiles are able to gain legal access to the creek, it is legal for them to ride on the ice of the creek. They cannot trespass or destroy the banks along the creek. f. Frozen Fete des Lacs Car Race. The Public Works Director advised that Council that he was asked if the City would clear snow from the area on Centerville Lake where the Car Race is scheduled. Council agreed as long as the City is named as an additional insured. ID. A W ARDSIPRESENTATIONS/APPEARANCES 1. Mr. Paul Keleher. Sedona Homes Concept Plans 20th Avenue Mr. Keleher of Sedona Homes presented his revised concept plans for development along 20fu Avenue to Council. He then pointed out on the map the areas that they would ask for a rezone to residential and those that would remain commercial. Mr. Keleher indicated the number of units has been revised from 135 units to approximately 80. Council Member Paar indicated he met with Mr. Keleher and Mr. Hanson from the Planning Commission and he feels that this is a workable compromise and he would support the rezoning but not a TlF district. Council Member Lee asked whether the City needed to be concerned with spot zoning. City Attorney Hoeft said he does not think there would be an issue with the proposal. Council Member Capra asked what the proposal for Lloyd Drilling's property was. Mr. Drilling said it may be a nursing home or assisted care living or something similar but he does not know at this time. She then said that she asked Mr. Drilling and Mr. Keleher whether the commercial townhomes could be moved down to be the gateway into the townhomes. Council Member Broussard Vickers asked whether the existing buildings would be taken down and advised Mr. Keleher to ensure that no variances would be needed for the commercial lot size. Council Member Capra indicated she would not support the TIF but would be fme with the rezoning. Council Member Capra commented that she is concerned with residential being in between two commercial areas. Council Member Capra indicated a lot ofthis depends upon the flood plain and the City does not have the surface water management plan. Mr. Keleher indicated he is working with Rice Creek on the flood plain designation. Council Member Capra commented that this may not work without the flood plain designation change. Mr. Keleher indicated Mr. Rehbein has excess flood plain credits that they may be able to purchase for the project. Council Member Capra asked whether the development was contingent upon getting the TIF approved. Mr. Keleher indicated they would be coming with a request for TIF. Mayor Sweeney indicated he liked the idea of redeveloping the area and thinks this is a good compromise 2. Mr. Bill Gleason Concept Plans TownhomeslProposal for Annexation Mr. Gleason presented Council with his proposed townhome development and indicated that he would like Centerville to consider annexing his property from Lino Lakes because Lino Lakes has a moratorium on building permits and he wants to build out the entire property all at once not in stages. Council Member Lee indicated that Ms. Moore-Sykes spoke to Staff at Lino Lakes and it does not sound like they would be interested in being annexed. City Attorney Hoeft indicated that it would be very costly to attempt to force Lino Lakes to allow the annexation. Page 3 of9 City of Centerville January 14, 2004 Council Meeting Minutes Council advised Mr. Gleason to go to Lino Lakes and discuss it with them but said the City would not be interested ifLino is not willing to go along with the proposal. VI. PUBLIC HEARINGS None. vn. NEW BUSINESS 1. Dredging of Hardwood Estates Pond Mr. Peterson indicated that the City is going to begin its maintenance on ponds this year beginning with the Hardwood Estates Pond. He then explained the plan for excavating the pond and reseeding the edge. Mayor Sweeney explained that the culvert under Brian Way flows backwards because it is higher on one end then the other. Mr. Peterson said that the pipe fills up because the pond is so full of sediment. He then said that the culvert should be lowered but that should be done at the same time as the one under nDd He also indicated that there is positive flow toward the pond but the water has trouble going north. Council Member Capra asked if the Eagle Pass pond was being cleaned. Ms. Moore-Sykes indicated that Rice Creek was to do so and bill the developer. 2. 2004 Residential Street Imorovement Feasibility Study Council Member Capra expressed surprise that residents are assessed at 75% for the curb and gutter. She also asked how the assessments for comer lots are determined. Mr. Peterson indicated the policy is per lineal front foot on the short side plus 20% of the long side for comer lots. He then said that the assessment will be reduced slightly because he had used one and a half times. Council Member Broussard Vickers asked that Staff have the loan information available at the public information meeting as well as information as to the dollar amount per thousand borrowed for residents to consider. Council asked that there be an overhead with the information for review at the public information meeting as well as numerous copies of the feasibility study. Mayor Sweeney questioned the LaMotte Park assessment as some of the preparation has been done. Page 4 of9 City of Centerville January 14,2004 Council Meeting Minutes Mr. Peterson explained that a little work had been done but this estimate includes curb and gutter and adding aggregate base. Mr. Moore-Sykes indicated that the public information meeting is scheduled for January 29, 2004. Council discussed the schedule for the project as it is now one month behind the projected timeline. Council Member Capra asked if it is possible for residents to add drain tiling to the stonn sewer. Mr. Peterson explained that there is drain tiling for the road bed but sump pumps cannot connect to that. Council Member Broussard Vickers asked whether running more stonn sewer would help with drainage and asked that Staff review the proposal for stonn sewer to determine whether extending in any areas would increase drainage. Council Member Capra asked Staff to look into Metropolitan Council recommendations for cities. Council Member Capra indicated she is concerned that the City not create a holding pond behind the curb if the curb is higher than the yards. Motion bv Council Member Lee. seconded bv Council Member Broussard Vickers to accept the feasibility study and set a public heann!! for February 11. 2004. All in favor. Motion carried unanimously. 3. Kelly's Korner Compliance Check Failure Motion bv Council Member Capra. seconded bv Council Member Broussard Vickers to table this matter to January 28. 2004. All in favor. Motion carried unanimously. 4. TimeSaver Off site Secretarial Rate Increase and Contract Renewal for 2004 Motion bv Council Member Broussard Vickers. seconded bv Council Member Capra to approve the TimeSaver Off site Secretarial contract renewal for 2004. All in favor. Motion carried unanimouslY. S. Bonestroo. Rosene. Anderlik & Associates - Rate Increase for 2004 Mayor Sweeney commented that Council Members had suggested looking at engineering fmns and he suggested now would be the time to do so. Council Member Capra said she would like to research other engineers for any big City projects because she feels that the City is not requiring them to be competitive. Polices and Procedures for Assessments Council Member Capra explained that one resident called her because she felt as if she had not been treated with respect with regard to receiving information on the final assessment on Peltier Preserve. She also indicated that there is some confusion as to whether there is a policy to allow partial payment on assessments. Ms. Moore-Sykes indicated that Ms. Paulseth has explained that the City would just need to create a new amortization schedule if a partial payment is received. City Attorney Hoeft suggested the City create a policy for partial payments to eliminate excess Staff time for taking frequent small payments. Council Members indicated they would like the Staff to have conflict resolution and/or customer service training to assist them in dealing with residents. Ms. Moore-Sykes indicated she was off site at a meeting when the resident came in. Council Member Capra indicated she would like to have Ms. Paulseth available when Ms. Moore-Sykes is not. I Ms. Moore-Sykes indicated that Staff has the unfortunate task of providing information to residents that they usually do not want to hear so it is not always possible to have them leave City Hall happy. She then said that she would look into customer service training as a way of providing information and suggestions on how to handle difficult situations. Council Member Lee suggested keeping a call log and informing Council of anything that escalates over a minor issue. Council Member Paar commented that no matter what is done it is not going to be good enough and he agrees that residents should be treated fairly but he also believes that if someone is treating Staff badly they should not expect Staff to accept that type of abuse. 6. Tobacco License for New CentervilIe Market Abdusalam Hassen came to Council for a new tobacco license for the old Tom Thumb location newly renamed CenterviIle Market. Page 6 of9 City of Centerville January 14,2004 Council Meeting Minutes City Attorney Hoeft indicated the City Clerk informed him that a BCA check was not able to be conducted but the Anoka County background check was completed. Council asked Staff to determine what the requirements for background checks are for tobacco licenses. Capital Improvement Plan & Authorizing Capital Expenditures for 2004 Resolution #04-003 Motion by Council Member Canra. second by Council Member Broussard Vickers to apnrove the Capital Imnrovement Plan and authorize canital oroiect exoenditures as amended at the work session on Monday. Possible Ordinance #4 Amendment. 24-Hour Businesses Council Member Capra indicated she would like the City to consider regulating 24 hour businesses through Ordinance #4. Council agreed to ask Planning and Zoning to consider it as part of the ongomg Ordinance #4 amendments. X. ANNOUNCEMENTSIUPDATES 1. CSAH 14 Ms. Moore-Sykes indicated that the County will be holding a public information meeting on February 19, 2004 from 5:00 p.m. to 9:00 p.m. to discuss the different routes and feasibility. The meeting is tentatively scheduled to be held at Wargo Nature Center as the school is not available that evening. Council Member Capra suggested holding future meetings further in advance to be able to hold them at the elementary. 2. Lawful Gambling Regulations Council Member Capra asked whether Staff spoke to anyone at the Gambling Control Board concerning accepting donations from the Lions and giving a donation to the Lions. Page 7 of9 City of Centerville Jaml8lY 14, 2004 Council Meeting Mioutes Ms. Paulseth indicated she had highlighted the applicable areas in the documents provided and commented that the City can do whatever is legally authorized with the funds. Council Member Capra indicated she would feel better if the Lions would provide a list of what they would spend the money on. Mayor Sweeney indicated there is a budget for the festival. He then said that the budget is $25,000 and the City has donated $15,000 with specific restrictions as to what it is to be spent on. The other money comes from donations and ticket sales. He further commented that the money that was made last year on the festival was due to food and beer sales during the softball tournament. This year, rather than hitting up the businesses again, the suggestion is to use gambling funds. Council Member Capra said she is concerned with making a donation because once the City receives a donation it becomes City money and there are restrictions on what can be done with public funds. City Attorney Hoeft indicated that donating to the Lions is a lawful distribution and, while Council may worry about what it is spent on, it does not restrict the ability to give funds to the Lions. He further commented that the only criteria is that the City donates to the Lions and the Lions are not bound to spend that money according to a public purpose criteria. Council Member Capra indicated she would be more comfortable with it if the Lions brought her a list of what they would spend the money on so she could make sure it was for a lawful purpose. Ms. Paulseth commented the festival is a public purpose. Council Member Capra indicated that beer would not be for a public purpose. Mayor Sweeney explained that the beer is provided by the distributor and the Lions pay for what they use and they pay for the beer out of the money from the sales. 3. Frozen Fete Des Lacs Paul Burke updated Council on the frozen Fete Des Lacs. Council Member Broussard Vickers asked whether the experimental aircraft operators have liability insurance with the City named as a coinsured. Mr. Burke indicated that the insurance will be in place as will the racing insurance. Council Member Paar indicated that the EDC has finalized the business directories for 2004 and rolled the new resident packet into it. Page 8 of9 City of Centerville Januaty 14,2004 Council Meeting Minutes Council Member Paar told Council that the festival is looking for volunteers to assist with the events. He then asked whether the Lions would be handling concessions. Mayor Sweeney indicated that no one has volunteered for the event but the Lions will discuss it and they plan to have a trailer for the ice racing. Council Member Paar asked whether a blanket permit for the festival to cover all the events could be issued and whether the City could waive the cost. Council Member Paar asked for funds for the events not to exceed $1,500 on behalf of the EDC to cover the printing costs and cost of prizes. Council Member Lee indicated that skate night was very well attended and enjoyed by all. Mayor Sweeney indicated the next skate night is January 23,2004. Mayor Sweeney indicated that Centerville has gone from number 3 in terms of taxes down to 22. He then read from an article in the S1. Paul Pioneer Press that provided information on local taxes. Mayor Sweeney reported that the first police steering committee governing board meeting was held and there will be another one on January 24, 2004 from 8:00 a.m. to 3:00 p.m. Council Member Capra indicated there is a nice article in the Ouad Press about St. Genevieve's I 50th Anniversary celebration. Ms. Moore-Sykes asked whether any Council Members wanted to sit on the oral board for police interviews. Council Members Lee and Capra and Mayor Sweeney indicated they would be available. Changes in technology such as digital broadcast television and fiat screens shorten the US,e[Ullives of electronic devices and promise to increase the amount ofelectronicSlhat wili be discarded in the future. If not in the garbage can, where should old TVs and 'computer monitors go? . These wastes do l!Q1 belong in the garbage with other mixed wastes. In the 2003 session, the State Legislature prOhibited the disposal of cathode ray tubes found in iVs and computer monitors in mixed wastes, effective July 1, 2005. Discarded iVs and computer monitors can and should be recycled. Nearly all of the component parts, including the lead and glass, can be recycled or recovered. . In 2002, news of shipment of old iVs and computers to countries such as China became widely known, Old electronic equipment from the U.S. was being broken down in unsafe conditions and seriously contaminated local Waters. We need to work hard to be sure that this method of disposal of our wastes does not happen. Metropolitan counties are joining efforts to get manufacturers to participate in solving this problem. . It's called "product stewardship" - asking manufacturers to share responsibility for products they sell when those products reach the end of their useful lives. . Product stewardship efforts relating to electronics are in place in Europe, Japan and Canada, but progress in the United States has been slow, and the probiem remains unsolved. . Some manufacturers have initiated voiuntary programs, but so far, not enough has been done. FROM: RE: ............................................................................ ~ Ordinance #75 was adopted on February 12, 2003 as an interim ordinance to provide the City and Staff an opportunity to review Ordinance #4 provisions in response to the request by an applicant to be allowed to open a custom slaughter house and butcher shop. This review would also include considering additional provisions to Ordinance #4 that regulate this use and to review studies and additional information from other cities. Currently, the only zoning district that allows feed lots and related agricultural uses such as slaughter houses, butchery, animal products processing, etc., is currently R-I. Ordinance #4 also stipulates that such agricultural uses can only occur on parcels of 10 acres or more. Because of the amount and pace of residential development, there are very few parcels that currently conform to those regulations established for R-I. Due to development, Centerville is becoming less agricultural and more urban in nature. Four parcels, 7357 - 20th Avenue, 7384 Old Mill Road, 7386 Old Mill Road, and 6756 Centerville Road are designated as R-I, are 10 acres or more in size and agricultural uses are permitted. Other R-I designated parcels are located on 21" Avenue but these parcels are less than 10 acres and are considered non-conforming. Other parcels in Centerville that are 10 acres or more exist in the Industrial zoning district and if a slaughter house/butcher shop requested to located in this area, the owner would need to apply for rezoning. This could be considered as 'spot zoning' and the City has a precedent for denying rezoning requests if spot zoning is the result. Most of these aforementioned R-I parcels have wetlands or other waterways, making them environmentally sensitive to any farming or other agricultural uses. Staff recommends that language be added to Ordinance #4 to protect wetlands that may exist in any R-I zoning district. Additional examples of this language could include: 1. Definitions: . a. Farm: A farm is real property considered to be in agricultural use provided that annually it is devoted to the production for sale ofIivestock, dairy animals, dairy products, poultry and poultry products, horticulture and nursery stock, fruit of all kinds, vegetables, forage, grains, bees and apiary products. b. Farming: The cultivation of the soil and all activities incidental thereto; agriculture and the raising of livestock and/or poultry. c. Feedlot: A lot or building or combination of lots and buildings intended for the confined feeding, breeding, raising, or holding of animals exceeding ten (10) animal units (as defined by MPCA Chapter 7020) and specifically designed as a confinement area in which manure may accumulate, or where the concentration of animals is such that a vegetative cover cannot be maintained within the enclosure. Open lots used for the feeding and rearing of poultry (poultry ranges) shall be considered to be animal feedlots. Pastures shall not be considered animal feedlots. 2. Farm drainage systems, flood control and watershed structures and erosion control devices shall meet all County, State, City, and DNR regulations for the permitted uses of the R-l zoning district. In addition, sump type storage systems for manure, slaughter or butchering wastes of livestock and/or poultry or other systems of animal waste or manure storage that are of like or similar nature are required. These uses and systems shall comply with all applicable regulations of the Minnesota Pollution Control Agency.(MPCA) to prevent feedlot runoff. { 3. The feedlot area, confinement building, or manure storage area shall have side and rear yard setbacks of 500 feet from any existing non-farm building or dwelling. b. The feedlot area, confinement building, or manure area shall have side and rear yard setbacks of250 feet. This suggested language comes from lsanti County. I contacted the cities of Hugo and Lake Elmo regarding their experience with slaughter houses or butcher shops. The City Administrator indicated that from their experience, following their ordinance regarding these types of uses helped them to regulate the use. The City Administrator from Lake Elmo reported that his city has never had to deal a slaughter house or butcher shop request. The property that was involved in the original request for a slaughter house is currently being considered for purchase by another buyer. If this sale goes through, the developer is proposing to rezone the parcel to commercial and R-2A and the proposed uses will more closely match the current uses in that area. As such, the Council could decide at this time to allow the moratorium to expire. "Butcher" a person who kills, dresses or cuts and packages meat for the purpose of sale. "Butcher/Slaughter House" a place/facility where animals are butchered/slaughtered for food. "Custom" social conventions carried on by tradition. "Deity" a state of being a god; a god or goddess. "Meat Processing" the act of cutting, packaging and displaying of any animal or carcass of an animal(s). "Official Controls" means ordinance and regulations which control the physical development of the City, including air space and subsurface areas necessary for mined underground space development pursuant to Minnesota Statute 469.135 to 469.141, or any detail thereof and implement the general objectives of the Comprehensive Plan. Official controls include ordinances establishing zoning, subdivision controls, site plan regulations, sanitary codes, building codes and official maps. "Rite" a ceremonial, solemn act, as in religious use. "Ritual" a set form or system of rites, religious or otherwise. "Sacrifice" an offering, as of a life or object to a deity or giving up on one thing for the sake of another. "Slaughter" the killing of animals for food. , t,,' . PURPOSE It is the purpose of this interim ordinance to place temporary restrictions on all Slaughterhouse/Butcher Shop Operation(s) within the City ofCenterville. BACKGROUND There is concern that the current Ordinance #4 provisions exclude such permitted usage within any Zoning District in the CityofCenterville. The City Council has initiated the study of possible provisions that need to be contained in. Ordinance #4 if such an operation was to take place within the City. The City is in the process of reviewing studies and information from additional communities and upon completion of this review, will make the necessary revisions to Ordinance #4 for such operation and location of the same if deemed appropriate by Council. . AUTHORITY Pursuant to Minnesota Statutes, Section 462.365, Subd. 4, The City is authorized to establish Interim Ordinances to regulate, restrict or prohibit any use or development in all or part of the City while the City or its planning consultant is conducting studies, or has authorized a study to be conducted or has scheduled a hearing to consider adoption or amendment of the comprehensive plan or official zoning controls. The City declares that this Interim Ordinance is established pursuant to the aforementioned statute. PROHIBITION Pursuant to the authority of Minnesota Statutes, 462.355, Subd 4; there is hereby established a moratorium on slaughterhouselbutcher shop operation(s) that also include custom butchering for ritualistic. rituals or sacrifice within in any zoning district in the City of Centerville. . During the effective period of this Interim Ordinance, applications for amendments to Ordinance #4 or Special Use Permits for the above-mentioned use shall not be accepted, considered or approved by the City. This Interim Ordinance prohibits the further consideration and approval of any amendment or Special Use Permit request for the above-mentioned use. MISDEMEANOR Any person, persons, firm or corporation violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished pursuant to Minnesota Statute 609.02, Subd. 3, or as subsequently amended, plus costs of prosecution. ENFORCEMENT In the event of a violation of this Interim Ordinance, the City may institute appropriate actions or proceedings, including requesting injunctive relief to prevent, restrain, correct or abate such violations. SEP ARABlLITY Every section, provision or part of this Interim Ordinance is declared separable from every section, provision or part of this Interim Ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not invalidate any other section, provision or part of this Interim Ordinance. DURATION This Interim Ordinance shall take effect upon its adoption by the City Council and shall remain in effect until the date of the adoption by the City Council of the amendments to official controls contemplated hereunder or twelve (12) months, which ever occurs first. To reduce a recordkeeping burden, the IRS also announced that taxpayers who use no more than four vehicles at the same time for business purposes may use the standard mileage rate, starting in 2004. Currently, those using more than one vehicle at a time cannot use the standard rate at all, leaving them to track the actual expenses for each vehicle. "With this change, more than 800,000 businesses will become eligible to use the standard mileage rate," said IRS Commissioner Mark W. Everson, "This reflects our ongoing interest in reducing the burden for businesses to comply with the tax laws," Although many taxpayers may still ciaim actual vehicle expenses for vanous reasons, the IRS estimates that small businesses will save 8-10 million hours a year in recordkeeping with this expansion of the standard rate option. The city has no fair way to detennine who rents or who owns their housing. Because of this, the fee is an arbitrary tax. The city has a long history of rental housing being provided by private parties with no major problems or need for city involvement. It was only because the county could not manage its property/tenants that this ordinance was passed.
