Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled
meeting on March 24,2004, at City Hall, 1880 Main Street.

I. CALL TO ORDER
Mayor Sweeney called the March 24, 2004, City Council meeting to order at 6:35 p.m.
II. SET AGENDA
Mayor Sweeney indicated that Chauncey Barettand Mr. Walmar would be moved up in
the agenda.
Motion bv Council Member Paar. seconded bv Council Member Broussard Vickers
to approve the al!:enda as amended. All in favor. Motion carried unanimouslv.

1. March 10. 2004 City Council Meeting Minutes
Mayor Sweeney requested the following changes: On Page 2 of 12 format the motion.
On Page 3 of 12 change be come to become. On Page 9 change fire department to Lino
Lakes Police Department.
Motion bv Council Member Paar. seconded bv Council Member Lee to approve the
March 10. 2004 City Council Meetinl!: Minutes as amended. All in favor. Motion
carried unanimouslv.

VII. NEW BUSINESS
1. Mr. Michael Walmar ReQuest for Tobacco License and Off Sale LiQuor License-
Centerville LiQUOrs (oreviouslv Sal1.er LiQuor)
Mr. Walmar appeared before Council and asked for approval of his liquor license.
Ms. Moore-Sykes indicated that the required background investigations have been
completed and the required information submitted by Mr. Walmar.
Council Member Broussard Vickers asked whether there would be any employees
because Mr. Walmar has indicated he would not carry workers compensation insurance.
Mr. Walmer indicated that he would be the sole employee at this point.
Council Member Lee asked whether Mr. Walmar was aware of the Best Practices
Ordinance.
Mr. Walmar indicated he was and has filled out the information and is ready to turn it in.
Council Member Broussard Vickers indicated that she did not want to approve this
license and leave the existing license for Sager's Liquor outstanding.

City Attorney Hoeft indicated that the license for Sager's Liquor would no longer be
valid because it is tied to a location and that location is now Centerville Liquor.
Council Member Broussard Vickers asked that the owner of Sager Liquor be notified that
his license is no longer valid in the City.
Motion bv Council Member Broussard, Vickers. seconded bv Council Member Paar
to approve the reauest of Michael Walmar for a tobacco license and off sale liauor
license. All in favor. Motion carried unanimouslY.
2. Minnesota Deoartment of Transoortation - Inter Re!!ional Corridor Mana"ement
Plan for Interstate 35
Ms. Moore-Sykes indicated that MNDOT is looking for a representative to attend the
corridor management meetings.
Council discussed the matter and determined that daytime meetings should be attended
by Ms. Moore-Sykes and evening meetings by Council Member Broussard Vickers.
3. Payment Drop Box Purchase
Ms. Paulseth reviewed the proposal to purchase a payment drop box with Council.
Council Member Broussard Vickers commented that she felt this was too much money to
spend so that residents could make a payment without getting out of their vehicle.
Motion bv Council Member Capra. seconded bv Council Member Lee to approve
an amount not to exceed $2.000 for the purchase of a pavment drop box for City
Hall. Aves - 4. Navs -l(Broussai-d Vickers). Motion carried.
4. Economic Development Committee ruDC) Request of Council to Consider
Citizen of the Year and Lifetime Achievement Awarding Responsibilitv
Council discussed the matter and agreed to move forward with the business nomination
for this year and Council Member Capra will provide information on a new process for
having the lifetime achievement award every three years.
vm. OLD BUSINESS
1. Chauncev Baret! Gardens. Phase II
Ms. Karen Skepper from Anoka County appeared before Council and explained the
bonding process and asked for Council support for the funding of Phase II. She then
explained how the Resolution was worded and why it was worded that way.

Council Member Capra asked whether the wording of the Resolution would require the
City to have more of this type of housing.
Ms. Skepper indicated it would not.
Motion bv Council Member Canra. seconded bv Council Member Broussard
Vickers to annrove Resolution 04-019 as nresented. All in favor. Motion carried
unanimously.
2. Resolution #04-018 Purchase Cedar Street Park from Anoka County
Motion bv Council Member Broussard Vickers. seconded bv Council Member Lee
to annrove Resolution #04-018 as nresented. All in favor. Motiou carried
unanimousIv.
3. Eagle Pass Pond
Ms. Moore-Sykes indicated that Mr. Palzer has discussed the matter with Rice Creek and
Rice Creek recommends that the pond does not need dredging at this time. Funds are
available and being held by Rice Creek for when the City decides to dredge the pond.
Ms. Moore-Sykes indicated the management company has been notified of Rice Creek's
decision.
Council asked Staff to send a letter to Rice Creek confirming the telephone conversation
and making note that they are holding funds and the City will be looking to use those
funds when it is time to dredge the pond.
IX. ANNOUNCEMENTSIUPDATES
1. Sex Offender Notification Policv
Council Member Capra indicated that residents had asked her to bring this before Council
for consideration of creating a policy for notifYing residents when sex offenders move to
the City.
Council discussed the matter and agreed to add this matter to the next work session
agenda.
City Attorney Hoeft indicated that the City is able to inform residents but he
recommended only using information obtained from the state's sex offender websiteas
that information has been determined to be public.
Ms. Moore-Sykes indicated that it would not be possible to have one card key and
identification badge so Staff is working on getting the access cards up and running and
will work on identification badges separately.

Council Member Paar indicated that the EDC meeting was rescheduled and he was
unable to attend. He then said his wife attended the speaker meeting and said the speaker
was very good but the meeting was not very well attended.
Council Member Capra indicated that she was unable to attend the ground breaking
ceremony for the new cable building. She then reported that the Commission approved a
Resolution against the proposed Victory Sports Channel.
Ms. Moore-Sykes indicated that the City has received close to 50 applications for the
public works position. She then asked whether Council was interested in hiring for one
or two positions at this time.
Mayor Sweeney asked whether it would be possible to use high school graduates as
summer interns before they go to college for help with public works related jobs.
Ms. Moore-Sykes indicated that it is difficult to do your own job and manage interns.
Council discussed the matter and there was consent to hire two at this time.
Council recessed to executive session at 7:30 p.m.
X. EXECUTIVE SESSION (CITY ADMINISTRATOR-PRIORITIES)
Council convened the closed executive session at 7:32 p.m. to discuss priorities of the
City Administrator's work goals. No action was taken.
Council closed the executive session at 8:13 p.m.
XI ADJOURNMENT
Council reconvened the regular Council meeting at 8: 14 p.m.

to adiourn the March 24. 2004 City Council Meetilll!: at 8:15 D.m. All in favor.

At the City Council's March 24th Council meeting, the Council approved Staff's
recommendation that the City should recruit applicants for two Public Works positions.
One position is essentially replacing the position vacated by the promotion of an
employee to the open Building Inspector's position and the other open position was
created and budgeted for 2004. The City Administrator asked the Council to consider
hiring for both positions at the same time, given the high costs of recruitment.
The City received more than fifty applications, which were pared down to thirteen
through an initial screening process. These thirteen were then asked to participate in an
interview scheduled for Thursday afternoon, April 8. and Friday, April 9. From these
interviews, the panel members, Ellen Paulseth, Finance Director; Tedd Peterson, Public
Works; Paul Palzer, Pubic Works Director and Kim Moore-Sykes, City Administrator,
selected the following two individuals to be recommended to the City Council for hiring
approval.

As Council is aware, the sidewalk in the CenterVilIa subdivision is in need of
repair/completion. The City was instructed to complete this project at its expense and L
& N Sodding has been retained to commence working on the sidewalk the week of April
19 - 23, 2004. L & N Sodding will need a 7-ton overweight permit for this period of
time. The route of travel will be Brian Drive south to Eagle Trail.
Also, restoration work was not included in the pond dredging project and L & N Sodding
will be completing that also. They will require two truck loads at 9-tons. The route of
travel will be Brian Drive to Brian Way.
Staff requests Council's considerate granting of these overweight permits allowing
completion of both of the projects within the CenterVilla subdivision.
Please note the attached proposal (not to exceed $2,000) for the restoration work for the
pond and L & N Sodding's Certificate of Liability Insurance and needs Council approval.

PREDATORY OFFENDER AND COMMUNITY NOTIF1CATION POLICY
Minnesota Statutes, Section 244.1 0,244.052, 244.053 and Chapter 13
I. POLICY
It is the policy of the City of Centerville/Centennial Lakes Police Department to protect
the public by disclosing information on predatory offenders residing in the City of
Centerville. The extent of the information disclosed/disseminated and to who is at the
discretion of the Chief of Police of the Centennial Lakes Police Department. However, it
must relate to the level of danger posed by the offender, to the offender's pattern of
offending behavior and to the need of the community members to enhimce their
individual and collective safety.
II. DEFINITION
Three possible risk levels can be assigned to an offender. They are:
. Levell -low risk of re-offending
. Level 2 - moderate risk of re-offending
. Level 3 - high risk of re-offending
Note: Some offenders are not assigned a risk level due to their offense being adjudicated
prior to predatory offender legislation enactment or due to the offender;s conviction not
leading to supervision by the Department of Corrections. These offenders are still subject
to the predatory offender registration statutes, though they are not subject to community
notification.
ill. PROCEDURE
A. Community Notification - For questions regarding community
notification or risk level assigned to an offender, please contact the
Predatory Offender Unit of the Department of Correction (DOC) at 651-
642-0279 or at www.corr.state.mn.us. The DOC will answer questions
about the process and responsibilities, and assist agencies and the
Centennial Lakes Police Department in conducting public notification
meetings when an offender subject to notification moves into the
community.
B. Notification Process
Levell - The purpose is to disclose information to raise awareuess.
. Mandatory - Victims who have requested disclosure.
. Discretionary - Wi1nesses or victims, other law enforcement
agencies.
Level 2 - The objective is to disclose information to safegnard
facilities and protect the individnals within those facilities.
. Mandatory - All persons and entities included in Level 1
disclosure.
. Discretionary - Groups and agencies that the offender is likely to
encounter including staff members of both public and private
schools, day care facilities and organizations that would provide
services to the individuals likely to be victimized by the offender.
o Consider using the following to assist with
discretionary disclosure: the offender's prior
history; offense characteristics; employment;
recreational, social and. religious interests; and
characteristics ofIikely victim.
Level 3 - The goal is to disclose information not only to
safeguard facilities and protect the individuals they serve, but
also to protect the community as a whole.
. Mandatory - All persons and entities included in Level 1
and Level 2 disclosure. A good faith effort must be made
to notify within 14 days of receiving documents from the
Department of Corrections.
Note: If the offender is placed or resides in a residential facility, do NOT disclose
any information until the law enforcement agency is notified that the offender has
been relocated.
. Discretionary - Other members of the community who the
offender is likely to encounter, unless public safety would be
compromised by the disclosure or a more limited disclosure is
necessary to protect the identity of the victim.
o How an agency decides to inform the public is their
discretion. The current standard for a Level 3 offender is to
invite the community to a public meeting and disclose the
necessary information.

244.053 Notice of release of certain offenders.
Subdivision 1. Notice of impending release. At least
60 days before the release of any inmate convicted of an offense
requiring registration under section 243.166, the commissioner
of corrections shall send written notice of the impending
release to the sheriff of the county and the police chief of the
city in which the inmate will reside or in which placement will
be made in a work release program. The sheriff of the county
where the offender waS convicted also shall be notified of the
inmate's impending release.
Subd. 2. Additional notice. The same notice shall be
sent to the following persons concerning a specific inmate
convicted of an offense requiring registration under section
243.166:
(1) the victim of the crime for which the inmate was
convicted or a deceased victim's next of kin if the victim or
deceased victim's next of kin requests the notice in writing;
(2) any witnesses who testified against the inmate in any
court proceedings involving the offense, if the witness requests
the notice in writing; and
(3) any person specified in writing by the prosecuting
attorney..
The notice sent to victims under clause (1) must inform the
person that the person has the right to request and receive
information about the offender authorized for disclosure under
the community notification provisions of section 244.052.
If the victim or witness is under the age of 16, the notice
required by this section shall be sent to the parents or legal
guardian of the child. The commissioner shall send the notices
required by this provision to the last address provided to the
commissioner by the requesting party. The requesting party
shall furnish the co~ssioner with a current address.
Information regarding witnesses requesting the notice,
information regarding any other person specified in writing by
the prosecuting attorney to receive the notice, and the notice
are private data on individuals, as defined in section 13.02,
subdivision 12, and are not available to the inmate.
The notice to victims provided under this subdivision does
not limit the victim's right to request notice of release under
section 6llA.06.

244.052 Predatory offenders; notice.
Subdivision 1.
Definitions. As used in this section:
(1) ttconfinement" means confinement in a state correctional
facility or a state treatment facility;
(2) "inunediate household" means any and all individuals who
live in the same household as the offender;
(3) "law enforcement agency" means the law enforcement
agency having primary jurisdiction over the location where the
offender expects to reside upon release;
(4) "residential facility" means a facility that is
licensed as a residential program, as defined in section
245A.02, subdivision 14, by the commissioner of human services
under chapter 245A, or the commissioner of corrections under
section 241.021, whose staff are trained in the supervision of
sex offenders; and
(5) "predatory offender" and .'offender" mean a person who
is required to register as a predatory offender under section
243.166. However, the terms do not include persons required to
register based solely on a delinquency adjudication.
Subd. 2. Risk assessment scale. By January 1, 1997,
the commdssioner of corrections shall develop a risk assessment
scale which assigns weights to the various risk factors listed
in subdivision 3, paragraph (g), and specifies the risk level to
which offenders with various risk assessment scores shall be
assigned. In developing this scale, the conunissioner shall
consult with county attorneys, treatment professionals, law
enforcement officials, and probation officers.
Subd. 3. Bnd-of-confinement review COIIIIIl1.ttee. (a)
The commissioner of corrections shall establish and administer
end-of-confinement review commdttees at each state correctional
facility and at each state treatment facility where predatory
offenders are confined. The conunittees shall assess on a
case-by-case basis the public risk posed by predatory offenders
who are about to be released from confinement.
(b) Each committee shall be a standing committee and shall
consist of the following members appointed by the commissioner:
(1) the chief executive officer or head of the correctional
or treatment facility where the offender is currently confined,
or that person's designee;
(2) a law enforcement officer;
(3) a treatment professional who is trained in the
assessment of sex offenders;

(4) a caseworker experienced in supervising sex offenders;
and
(5) a victim's services professional.
Members of the committee, other than the facility's chief
executive officer or head, shall be appointed by the
commdssioner to two-year terms. The chief executive officer or
head of the facility or designee shall act as chair of the
committee and shall use the facility's staff, as needed, to
administer the cOmmlttee, obtain necessary information from
outside sources, and prepare risk assessment reports on
offenders.
(c) The committee shall have access to the following data
on a predatory offender only for the purposes of its assessment
and to defend the co~ttee's risk assessment deter.mination upon
administrative review under this section:
(1) private medical data under section 13.384 or 144.335,
or welfare data under section 13.46 that relate to medical
treatment of the offender;
(2) private and confidential court services data'under
section 13..84;
(3) private and confidential corrections data under section
13.85; and
(4) private criminal history data under section 13.87.
Data collected and maintained by the committee under this
paragraph may not be disclosed outside the committee, except as
provided under section 13.05, subdivision 3 or 4. The predatory
offender has access to data on the offender collected and
maintained by the cOmmQttee, unless the data are confidential
data received under this paragraph.
(d) (i) Except as otherwise provided in item (ii), at least
90 days before a predatory offender is to be released from
confinement, the co~ssioner of corrections shall convene the
appropriate end-of-confinement review committee for the purpose
of assessing the risk presented by the offender and determining
the risk level to which the offender shall be assigned under
paragraph (e). The offender and the law enforcement agency that
was responsible for the charge resulting in confinement shall be
notified of the time and place of the committee's meeting. The
offender has a right to be present and be heard at the meeting.
The law enforcement agency may provide material in writing that
is relevant to the offender's risk level to the chair of the
commdttee~ The commdttee shall use the risk factors described
in paragraph (g) and the risk assessment scale developed under
subdivision 2 to determine the offender's risk assessment score
and risk level. Offenders scheduled for release from
confinement shall be assessed by the committee established at
the facility from which the offender is to be released.
(i11 If an offender is received for confinement in a
facility with less than 90 days remaining in the offender's term

of confinement, the offender's risk shall be assessed at the
first regularly scheduled end of confinement review committee
that convenes after the appropriate documentation for the risk
assessment is assembled by the committee. The commissioner
shall make reasonable efforts to ensure that offender's risk is
assessed and a risk level is assigned or reassigned at least 30
days before the offender's release date.
(e) The committee shall assign to risk level I a predatory
offender whose risk assessment score indicates a low risk of
reoffense. The committee shall assign to risk level II an
offender whose risk assessment score indicates a moderate risk
of reoffense. The committee shall assign to risk level III an
offender whose risk assessment score indicates a high risk of
reoffense.
(f) Before the predatory offender is released from
confinement, the co~ttee shall prepare a risk assessment
report which specifies the risk level to which the offender has
been assigned and the reasons underlying the committee's risk
assessment decision. The committee shall give the report to the
offender and to the law enforcement agency at least 60 days
before an offender is released from confinement. If the risk
assessment is perfor.med under the circumstances described in
paragraph (d), item (ii), the report shall be given to the
offender and the law enforcement agency as soon as it is
available. The committee also shall inform the offender of the
availability of review under subdivision 6.
(g) As used in this subdiVision, "risk factors" includes,
but is not limited to, the following factors:
(1) the seriousness of the offense should the offender
reoffend. This factor includes consideration of the following:
(i) the degree of likely force or harm;
(ii) the degree of likely physical contact; and
(iii) the age of the likely victim;
(2) the offender's prior offense history. This factor
includes consideration of the following:
(i) the relationship of prior victims to the offender;
(ii) the number of prior offenses or victims;
(iii) the duration of the offender's prior offense history;
(iv) the length of time since the offender's last prior
offense while the offender was at risk to commit offenses; and
(v) the offender's prior history of other antisocial acts;
(3) the offender's characteristics. This factor includes
consideration of the following:
(1) the offender's response to prior treatment efforts; and

(ii) the offender's history of substance abuse;
(4) the availability of community supports to the offender.
This factor includes consideration of the following:
(i) the availability and likelihood that the offender will
be involved in therapeutic treatment;
(ii) the availability of residential supports to the
offender, such as a stable and supervised living arrangement in
an appropriate location;
(iii) the offender's familial and social relationships,
including the nature and length of these relationships and the
level of support that the offender may receive from these
persons; and
(iv) the offender's lack of education or employment
stability;
(5) whether the offender has indicated or credible evidence
in the record indicates that the offender will reoffend if
released into the community; and
(6) whether the offender demonstrates a physical condition
that minimizes the risk of reoffense, including but not limited
to, advanced age or a debilitating illness or physical condition.
(hI Upon the request of the law enforcement agency or the
offender's corrections agent, the commissioner may reconvene the
end-at-confinement review committee for the purpose of
reassessing the risk level to which an offender has been
assigned under paragraph (e). In a request for a reassessment,
the law enforcement agency which was responsible for the charge
resulting in confinement or agent shall list the facts and
circumstances arising after the initial assignment or facts and
circumstances known to law enforcement or the agent but not
considered by the committee under paragraph (e) which support
the request for a reassessment. The request for reassessment by
the law enforcement agency must occur within 30 days of receipt
of the report indicating the offender's risk level assignment.
The offender's corrections agent, in consultation-with the chief
law enforcement officer in the area where the offender resides
or intends to reside, may request a review of a risk level at
any time if substantial evidence exists that the offender's risk
level should be reviewed by an end-of-confinement review
commdttee. This evidence includes, but is not limited to,
evidence of treatment failures or completions, evidence of
exceptional crime-free community adjustment or lack of
appropriate adjustment, evidence of substantial community need
to know more about the offender or mitigating circumstances that
would narrow the proposed scope of notification, or other
practical situations articulated and based in evidence of the
offender's behavior while under supervision. upon review of the
request, the end-of-confinement review committee may reassign an
offender to a different risk level. If the offender is
reassigned to a higher risk level, the offender has the right to
seek review of the committee's determination under subdivision 6.
(i) An offender may request the end-of-confinement review

committee to reassess the offender's assigned risk level after
three years have elapsed since the committee's initial risk
assessment and may renew the request once every two years
following subsequent denials. In a request for reassessment,
the offender shall list the facts and circumstances which
demonstrate that the offender no longer poses the same degree of
risk to the community. In order for a request for a risk level
reduction to be granted, the offender must demonstrate full
compliance with supervised release conditions, completion of
required post-release treatment programming, and full compliance
with all registration requirements as detailed in section
243.166. The offender must also not have been convicted of any
felony, gross misdemeanor, or misdemeanor offenses subsequent to
the assignment of the original risk level. The committee shall
follow the process outlined in paragraphs (a) to (c) in the
reassessment. An offender who is incarcerated may not request a
reassessment under this paragraph.
(j) Offenders returned to prison as release violators shall
not have a right to a subsequent risk reassessment by the
end-of-confinement review commdttee unless substantial evidence
indicates that the offender's risk to the public has increased.
(k) The commissioner shall establish an end-of-confinement
review committee to assign a risk level to offenders who are
released from a federal correctional facility in Minnesota or
another state and who intend to reside in Minnesota, and to
offenders accepted from another state under a reciprocal
agreement for parole supervision under the interstate compact
authorized by section 243.16. The committee shall make
reasonable efforts to conform to the same timelines as applied
to ~nnesota cases. Offenders accepted from another state under
a reciprocal agreement for probation supervision are not
assigned a risk level, but are considered downward dispositional
departures. The probation or court services officer and law
enforcement officer shall manage such cases in accordance with
section 244.10, subdivision 2a. The policies and procedures of
the committee for federal offenders and interstate compact cases
must be in accordance with all requirements as set forth in this
section, unless restrictions caused by the nature of federal or
interstate transfers prevents such conformance.
(1) If the committee assigns a predatory offender to risk
level III, the committee shall determine whether residency
restrictions shall be included in the conditions of the
offender's release based on the offender's pattern of offending
behavior.
Subd. 4. La" enforc8D8nt agency; cU.sclosure oe
information to public. (a) The law enforcement agency in the
area where the predatory o!fender resides, expects to reside, is
employed, or is regularly found, shall disclose to the public
any information regarding the offender contained in the report
forwarded to the agency under subdivision 3, paragraph (f), that
is relevant and necessary to protect the public and to
counteract the offender's dangerousness, consistent with the
guidelines in paragraph (b). The extent of the information
disclosed and the community to whom disclosure is made must
relate to the level of danger posed by the offender, to the
offender's pattern of offending behavior, and to the need of

community members for information to enhance their individual
and collective safety.
(b) The law enforcement agency shall employ the following
guidelines in determining the scope of disclosure made under
this subdivision:
(1) if the offender is assigned to risk level I, the agency
may maintain information regarding the offender within the
agency and may disclose it to other law enforcement agencies.
Additionally, the agency may disclose the information to any
victi~ of or witnesses to the offense committed by the
offender. The agency shall disclose the information to victims
of the offense committed by the offender who have requested
disclosure and to adult members of the offender's immediate
household;
(2) if the offender is assigned to risk level II, the
agency also may disclose the information to agencies and groups
that the offender is likely to encounter for the purpose of
securing those institutions and protecting individuals in their
care while they are on or near the premises of the institution.
These agencies and groups include the staff members of public
and private educational institutions, day care establishments,
and establishments and organizations that primarily serve
individuals likely to be victimized by the offender. The agency
also may disclose the information to individuals the agency
believes are likely to be victimized by the offender. The
agency's belief shall be based on the offender's pattern of
offending or victim preference as documented in the information
provided by the department of corrections or human services;
(3) if the offender is assigned to risk level III, the
agency shall disclose the information to the persons and
entities described in clauses (1) and (2) and to other members
of the community whom the offender is likely to encounter,
unless the law enforcement agency determines that public safety
would be compromised by the disclosure or that a more limited
disclosure is necessary to protect the identity of the victim.
Notwithstanding the assignment of a predatory offender to
risk level II or III, a law enforcement agency may not make the
disclosures permitted or required by clause (2) or (3), if: the
offender is placed or resides in a residential facility.
However, if an offender is placed or resides in a residential
facility, the offender and the head of the facility shall
designate the offender's likely residence upon release from the
facility and the head of the facility shall notify the
co~ssioner of corrections or the commissioner of human
services of the offender's likely residence at least 14 days
before the offender's scheduled release date. The commissioner
shall give this information to the law enforcement agency having
jurisdiction over the offender's likely residence. The head of
the residential facility also shall notify the commissioner of
corrections or human services within 48 hours after finalizing
the offender's approved relocation plan to a permanent
residence. Within five days after receiving this notification,
the appropriate commissioner shall give to the appropriate law
enforcement agency all relevant information the commissioner has
concerning the offender, including information on the risk

factors in the offender's history and the risk level to which
the offender was assigned. After receiving this information,
the law enforcement agency shall make the disclosures permitted
or required by clause (2) or (3), as appropriate.
(c) As used in paragraph (b), clauses (2) and (3), "likely
to encounterll means that:
(1) the organizations or community members are in a
location or in close proximity to a location where the offender
lives or is employed, or which the offender visits or is likely
to visit on a regular basis, other than the location of the
offender's outpatient treatment program; and
(2) the types of interaction which ordinarily occur at that
location and other circumstances indicate that contact with the
offender is reasonably certain.
(d) A law enforcement agency or official who discloses
information under this subdivision shall make a good faith
effort to make the notification within 14 days of receipt of a
confirmed address from the Department of Corrections indicating
that the offender will be, or has been, released from
confinement, or accepted for supervision, or has moved to a new
address and will reside at the address indicated. If a change
cccurs in the release plan, this notification provision does not
require an extension of the release date.
(e) A law enforcement agency or official who discloses
information under this subdivision shall not disclose the
identity or any identifying characteristics of the victims of or
witnesses to the offender's offenses.
(f) A law enforcement agency shall continue to disclose
information on an offender as required by this subdivision for
as long as the offender is required to register under section
243.166.
(g) A law enforcement agency that is disclosing information
on an offender assigned to risk level III to the public under
this subdivision shall inform the co~ssioner of corrections
what information is being disclosed and forward this information
to the commissioner within two days of the agency's
determination. The commissioner shall post this information on
the Internet as required in subdivision 4b.
(h) A city council may adopt a policy that addresses when
information disclosed under this subdivision must be presented
in languages in addition to English. The policy may address
when information must be presented orally, in writing, or both
in additional languages by the law enforcement agency disclosing
the information. The policy may provide for different
approaches based on the prevalence of non-English languages in
different neighborhoods.
Subd. 4a. Level III ot"t"enclers; location of residence.
(a) When an offender assigned to risk level III is released
from confinement or a residential facility to reside in the
community or changes residence while on supervised or
conditional release, the agency responsible for the offender's

supervision shall take into consideration the proximity of the
offender's residence to that of other level III offenders and
proximity to schools and, to the greatest extent feasible, shall
mitigate the concentration of level III offenders and
concentration of level III offenders near schools.
(b) If the owner or property manager of a hotel, motel,
lodging establishment, or apartment building has an agreement
with an agency that arranges or provides shelter for victims of
domestic abuse, the owner or property manager may not knowingly
rent rooms to both level III offenders and victims of domestic
abuse at the same time. If the owner or property manager has an
agreement with an agency to provide housing to domestic abuse
victims and discovers or is informed that a tenant is a level
III offender after signing a lease or otherwise renting to the
offender, the owner or property manager may evict the offender.
Subd. 4b. Level :I:I:I offenders; mandatory posting of
info~tioD on Internet. The commdssioner of corrections
shall create and maintain an Internet Web site and post on the
site the information about offenders assigned to risk level III
forwarded by law enforcement agencies under subdivision 4,
paragraph (g). This information must be updated in a timely
manner to account for changes in the offender's address and
maintained for the period of time that the offender remains
subject to community notification as a level III offender.
Subd. 5. Relevant information provided to law
enforcement. At least 60 days before a predatory offender is
released from confinement, the Department of Corrections or the
Department of Human Services, in the case of a person who was
committed under section 253B.185 or Minnesota Statutes 1992,
section 526.10, shall give to the law enforcement agency that
investigated the offender's crime of conviction or, where
relevant, the law enforcement agency having primary jurisdiction
where the offender was committed, all relevant information that
the departments have concerning the offender, including
information on risk factors in the offender's history. Within
five days after receiving the offender's approved release plan
from the hearings and release unit, the appropriate department
shall give to the law enforcement agency having primary
jurisdiction where the offender plans to reside all relevant
infoomation the department has concerning the offender,
including intormation on risk factors in the offender's history
and the riSk level to which the offender was assigned. If the
offender's risk level was assigned under the circumstances
described in subdivision 3, paragraph (d), item (ii), the
appropriate department shall give the law enforcement agency all
relevant information that the department has concerning the
offender, including information on the risk factors in the
offender's history and the offender's risk level within five
days of the risk level assignment or reassignment.
Subd. 6. Administrative review. (a) An offender
assigned or reassigned to risk level II or III under subdivision
3, paragraph (e) or (h), has the right to seek administrative
review of an end-ot-confinement review committee's risk
assessment determination. The offender must exercise this right
within 14 days of receiving notice of the committee's decision
by notifying the chair of the commattee. Upon receiving the

request for administrative review, the chair shall notify: (1)
the offender; (2) the victim or victims of the offender's
offense who have requested disclosure or their designee; (3) the
law enforcement agency that investigated the offender's crime of
conviction or, where relevant, the law enforcement agency having
primary jurisdiction where the offender was committed; (4) the
law enforcement agency having jurisdiction where the offender
expects to reside, providing that the release plan has been
approved by the hearings and release unit of the department of
corrections; and (5) any other individuals the chair may
select. The notice shall state the time and place of the
hearing. A request for a review hearing shall not interfere
with or delay the notification process under subdivision 4 or 5,
unless the administrative law judge orders otherwise for good
cause shown.
(b) An offender who requests a review hearing must be given
a reasonable opportunity to prepare for the hearing. The review
hearing shall be conducted on the record before an
administrative law judge. The review hearing shall be conducted
at the correctional facility in which the offender is currently
confined. If the offender no longer is incarcerated, the
administrative law judge shall determine the place where the
review hearing will be conducted. The offender has the burden
of proof to show, by a preponderance of the evidence, that the
end-of-confinernent review co~tteels risk assessment
determination was erroneous. The attorney general or a designee
shall defend the end-of-confinement review committee's
determination. The offender has the right to be present and be
represented by counsel at the hearing, to present evidence in
support of the offender's position, to call supporting witnesses
and to cross-examine witnesses testifying in support of the
committee's determination. Counsel for indigent offenders shall
be provided by the Legal Advocacy Project of the state public
defender's office.
(c) After the hearing is concluded, the administrative law
judge shall decide whether the end-of-confinement review
committee's risk assessment determination was erroneous and,
based on this decision, shall either uphold or modify the review
committee's determination. The judge's decision shall be in
writing and shall include the judgels reasons for the decision.
The judge's decision shall be final and a copy of it shall be
given to the offender, the victim, the law enforcement agency,
and the chair of the end-of-confinement review committee.
(d) The review hearing is subject to the contested case
provisions of chapter 14.
(e) The administrative law judge may seal any portion of
the record of the administrative review hearing to the extent
necessary to protect the identity of a victim of or witness to
the offender's offense.
Subd. 7. ImIIIunity from ~iabi~ity. (a) A state or
local agency or official, or a private organization or
individual authorized to act on behalf of a state or local
agency or official, is not criminally liable for disclosing or
failing to disclose information as permitted by this section.

(b) A state or local agency or official, or a private
organization or individual authorized to act on behalf of a
state or local agency or official, is not civilly liable for
failing to disclose information under this section.
(c) A state or local agency or official, or a private
organization or individual authorized to act on behalf of a
state or local agency or official, is not civilly liable for
disclosing information as permitted by this section. However,
this paragraph applies only to disclosure of information that is
consistent with the offender's conviction history. It does not
apply to disclosure of information relating to conduct for which
the offender was not convicted.
Subd. 8. Limitation on scope. Nothing in this
section imposes a duty upon a person licensed under chapter 82,
or an employee of the person, to disclose information regarding
an offender who is required to register under section 243.166,
or about whom notification is made under this section.

244.10 Sentencing hearing; deviation from guidelines.
Subdivision 1. s-ntencing hearing. Whenever a person
is convicted of a felony, the court, upon motion of either the
defendant or the state, shall hold a sentencing hearing. The
hearing shall be scheduled so that the parties have adequate
time to prepare and present arguments regarding the issue of
sentencing. The parties may submit written arguments to the
court prior to the date of the hearing and may make oral
arguments before the court at the sentencing hearing. Prior to
the hearing, the court shall transmit to the defendant or the
defendant's attorney and the prosecuting attorney copies of the
presentence investigation report.
At the conclusion of the sentencing hearing or within 20
days thereafter, the court shall issue written findings of fact
and conclusions of law regarding the issues submitted by the
parties, and shall enter an appropriate order.
Subd. 2. Deviation from guidelines. Whether or not a
sentencing hearing is requested pursuant to subdivision 1, the
district court shall make written findings of fact as to the
reasons for departure from the sentencing guidelines in each
case in which the court imposes or stays a sentence that
deviates from the sentencing guidelines applicable to the case.
Subd. 2a. Notice of infoJ:1llation regarding predatory
offenders. (a) Subject to paragraph (b), in any case in which
a person is convicted of an offense and the presumptive sentence
under the sentencing guidelines is commitment to the custody of
the commissioner of corrections, if the court grants a
dispositional departure and stays imposition or execution of
sentence, the probation or court services officer who is
assigned to supervise the offender shall provide in writing to
the following the fact that the offender is on probation and the
terms and conditions of probation:
(1) a victim of and any witnesses to the offense committed
by the offender, if the victim or the witness has requested
notice; and
(2) the chief law enforcement officer in the area where the
offender resides or intends to reside.
The law enforcement officer, in consultation with the
offender's probation officer, may provide all or part of this
information to any of the following agencies or groups the
offender is likely to encounter: public and private educational
institutions, day care establishments, and establishments or
organizations that primarily serve individuals likely to be
victimized by the offender.
The probation officer is not required under this
subdivision to provide any notice while the offender is placed

or resides in a residential facility that is licensed under
section 245A.02, subdivision 14, or 241.021, if the facility
staff is trained in the supervision of sex offenders.
(b) Paragraph (a) applies only to offenders required to
register under section 243.166, as a result of the conviction.
(c) The notice authorized by paragraph (a) shall be limited
to data classified as public under section 13.84, subdivision 6,
unless the offender provides informed consent to authorize the
release of nonpublic data or unless a court order authorizes the
release of nonpublic data.
(d) Nothing in this subdivision shall be interpreted to
impose a duty on any person to use any information regarding an
offender about whom notification is made under this subdivision.
Subd. 3. Computation of criminal history score. If
the defendant contests the existence of or factual basis for a
prior conviction in the calculation of the defendant's crindnal
history score, proof of it is established by competent and
reliable evidence, including a certified court record of the
conviction.

The City Council of the City of Centervi11e does ordain:
SECTION 1. CONTAINMENT OF DEBRlS.
Subsection 1.
On parcels which construction is being taken place, the property owner shall be responsible to

construction material, the City shall be authorized to clean the premises and the property owner

Wednesday, May 5, 2004 at 11 :00 a.m. in the council chambers of the city
hall, bids will be received by the City Clerk and Engineer, will be
tabulated, and will be considered by the Council on May 12, 2004 at their

RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING
ADVERTISEMENT FOR BIDS FOR THE 2004 STREET IMPROVEMENT
PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTERVILLE, MINNESOTA:
WHEREAS, the City Engineer has prepared plans and specifications for the 2004 Street
Improvement Project involving the following streets as directed by Council and has
presented such plans and specifications to the council for approval:
. Shad Avenue from Main Street to Fox Run
. Brian Drive from Main Street to 150' north of Brian Court
. Heritage Street from Centerville Road to LaMotte Drive
. LaMotte Drive from Heritage Street to the west City Limits
. Center Street from Centerville Road to Dupre Road
. Tourville Circle from Center Street to cuI de sac
. Oak Circle from Center Street to cui de sac
. Pheasant Lane from Center Street to Short Street
. Dupre Road from 200' south of Center Street to 200' north of Center Street
Mill and overlay involving the following streets:
. Peterson Trail from Fox Run to 73m Street
. 73M Street from 20th Avenue to Brian Drive
The installation of municipal services in conjunction with this project such as water main,
storm sewer, sidewalks, curb and gutter are also included in the submitted report (see
attached).
Also included in this project are projects within the Laurie LaMotte Memorial Park being
an asphalt parking lot and pad for the wheels park and a treatment ditch near Heritage
Street These two (2) projects will be funded through a grant and park dedication fees_
The committee agreed charges per acre would be the fairest standard to follow opposed to per unit,
since there could be one large unit on 20 acres or 10 small buildings on the same piece of property.
It would be uniform. if charged by acre.
The committee discussed keeping the fee for industrial & commercial the same as residential, but
compared to the Cities of Lino Lakes and Hugo, the City of Centerville already charges more for
residential than the neighboring communities. It was decided to recommend to council that the fees
for Industrial & Commercial Park Dedication Fees be set at the same rate as Lino lakes, which
would be $2175/acre. Chairperson Peterson also suggested passing this on to the Economic
Development Committee for their input.
Motion was made by Committee Member Ziegler, seconded by Committee Member Anderson
to recommend to City Council incorporating an Industrial & Commercial Park Dedication
Fee into the fee schedule with the amount being set in line with the City of Lino Lakes at the
amount of$2175/acre. All in favor. Motion carried unanimously.

BOND INSURANCE AT
PURCHASER'S OPTION:
The Issuer will designate the bonds as qualified tax
exempt obligations for purposes of Section 265(b)(3) of the
Internal Revenue Code of 1986, as amended.
If the Bonds qualify for issuance of any policy of municipal
bond insurance or commitment therefore at the option of
the Underwriter, the purchase of any such insurance policy
or the issuance of any such commitment shall be at the sole
option and expense of the purchaser of the Bonds. Any
increase costs of issuance of the Bonds resulting from such
purchase of insurance shall be paid by the Purchaser,
except that, if the City has requested and received a rating
on the Bonds from a rating agency, the City will pay that
rating fee. Any other rating agency fees shall be the
responsibility of the Purchaser. Failure of the municipal
bond insurer to issue the policy after the Bonds have been
awarded to the purchaser shall not constitute cause for
failure or refusal by the purchaser to accept delivery on the
Bonds.
The Issuer reserves the right to reject any and all proposals, to waive informalities and to adjourn

The Bonds will be awarded on the basis of the lowest
interest rate to be determined on a true interest cost (TIC)
basis. The Issuer's computation of the interest rate of each
proposal, in accordance with customary practice, will be
controlling. In the event of a tie, the sale of the Bonds will
be awarded by lot. The Issuer will reserve the right to: (i)
wsive non-substantive informalities of any proposal or of
matters relating to the receipt of proposals and award of the
Bonds, (ii) reject all proposals without cause, and (iii)
reject any proposal which the Issuer determines to have
failed to comply with the tenns herein.
All rates must be in integral multiples of I/2Oth or I/8th of
1%. No limitation is placed upon the number of rates
which may be used. All bonds of the same maturity must
bear a single uniform rate from date of issue to maturity.
The successful purchaser will be required to provide,
in a timely manner, certain information relating to the
initial offering price of the bonds necessary to compute the
yield on the bonds pursuant to the provisions of the Internal
Revenue Code of 1986, as amended.
The Official Statement, when further supplemented by an
addendum or addenda specifYing the maturity dates,
principal amounts and interest rates of the Bonds, together
with any other information required by law, shall constitute
a "Final Official Statement" of the City with respect to the
Bonds, as that term is defined in Rule 15c2-12. By
awarding the Bonds to any underwriter or underwriting
syndicate submitting a proposal therefore, the City agrees
that, no more than seven business days after the date of
such award, it shall provide without cost to the senior
managing underwriter of the syndicate to which the Bonds
are awarded copies of the Official Statement and the
addendum or addenda.
The Issuer will covenant in the resolution awarding the sale
of the bonds and in sale of the bonds and in a Continuing
Disclosure Undertaking to provide, or cause to be provided,
annual financial information, including audited financial
statements of the Issuer, and notices of certain material
events, as required by SEC Rule 15c2- 12.
DELIVERY:
Forty days after award subject to approving legal opinion
of Kennedy & Graven, Chartered, of Minneapolis,
Minnesota. Legal opinion will be paid by the Issuer and
delivery will be anywhere in the continental United States
without cost to the Purchaser at DTC.
TYPE OF PROPOSAL:
Sealed proposals of not less than $2,506,825 and accrued
interest on the principal sum of $2,545,000 from date of
original issue of the bonds to date of delivery must be filed
with the undersigned prior to the time of sale. Proposals
must be unconditional except as to legality. A certified or
cashier's check (the "Deposit") in the amount of $50,900,
payable to the order of the Administrator of the Issuer, or a
Financial Surety Bond complying with the provisions
below, must accompany each proposal, to be forfeited as
liquidated damages if proposal maker fails to comply with

bond must be submitted to Northland, prior to the opening
of the proposals. The Financial Surety Bond must identify
each proposal maker whose Deposit is guaranteed by such
Financial Surety Bond. If the bonds are awarded to a
proposal maker using a Financial Surety Bond, then that
purchaser is required to submit its Deposit to Northland in
the form of a certified or cashier's check or wire transfer as
instructed by Northland not later than 3:30 P.M., Central
Time, on the next business day following the award. If
such Deposit is not received by that time, the Financial
Surety Bond may be drawn by the Issuer to satisfy the
Deposit requirement. The Issuer will deposit the check of
the purchaser, the amount of which will be deducted at
settlement and no interest will accrue to the purchaser. In
the event the purchaser fails to comply with the accepted

BOOK ENTRY SYSTEM:
The bonds will be issued by means of a book entry system
with no physical distribution of bond certificates made to
the public. The bonds will be issued in fully registered
form and one bond certificate, representing the aggregate
principal amount of the bonds maturing in each year, will
be registered in the name of Cede & Co. as nominee of
Depository Trust Company ("DTC"), New York, New
York, which will act as securities depository of the bonds.
Individual purchases of the bonds may be made in the
principal amount of $5,000 or any multiple thereof of a
single maturity through book entries made on the books
and records of DTC and its participants. Principal and
interest are payable by the Issuer through U.S. Bank

The Planning and Zoning Commission met on April 6, 2004 and discussed this item. A
motion was made to recommend to Council the approval of the requested Lot Split and
Site Plan Review subject to the Fire Chiefs approval of the easement/private roadway for
the rear lots being wide enough (20' required) and a turnaround with a 40' radius
allowing public safety vehicle size. The sewer services should be brought from the rear
of the parcels to the front parcel.

Mr. Clay AlCOCk respectfully requests that the public hearing on the vacation of Mill Road
Extension / Eighth Street be removed from tonight's City Council meeting agenda and tabled
until the April 28, 2004 City Council meeting. As you and I discussed this afternOon, Mr.
Alcock and Mr. Larry Perron, the owner of the property immediately to the west of Mill Road /
Eighth Street, have reached an agreement as to the division of Mill Road I Eighth Street after the
vacation by the City of the same. However, Mr. Alcock and Mr. Perron are in the process of
negotiating an easement for Mr. Perron for driveway purposes over the portion of said property
which will be owned by Mr. Alcock We request that the public hearing on the vacation be
postponed to give the parties time to finalize their agreement prior to the final approval of the
vacation.

The Bald Eagle Water~ Show 1WU1d like 10 place a water~ jump in front of the Water-
Works Beach Club. Similar 10 past years, this requires a perm~ from the Anoka County Sherffls water
patrol, a permission letter from the Cente<ville City Council and a permission Ieller from the owner of
Water Works Beach Club. This IelIer is to request the opportun~ to appear bem the Council and
discuss our intentions and address any questions or concerns you may have about our club, or our
previous activities on Centerville lake.
Our club would use the jll'Tlp primarily on Tuesday and Thursday nights between 5:00pm and
9:00pm. Daytime and weekend use is very lim~, exoept for a few Sunday afternoon showS dunng
July and August
. Every member of our club knows \hat using our lakes is a privilege, with ever increasing
pressure on metro area lakes, we as a club try to minimize our impacl on the lake and Iakeshore. We
contain our activities to the area In front of the WateIWOIks; give right of way to fishemlan and other
famijies who are also enjoying Centerville lake.
It is important to us to cultivate a positive relationship with the commun~ of Cenlelville. We
are vEll}' excited to be involved if the 'Fete de lacs' celebration again this summer. We are planning
our entry for the parade, and wi" again perform a free Water-ski show in the afternoon.

It has been a delight to serve on the Economic Development Committee for the past
several years. I have enjoyed working with many fun and energetic people. However, I
am resigning as member of this committee effective April 9th, 2004. This decision does
not in anyway have to do with the agenda or the persons ofEDC, but rather my need to
diversify my time. I would be pleased if you would call me to assist in anyway with
special events or time limited projects.

Dear City of Centerville,
I am writing to let you know of the nail problem on Partridge Place. I have
been living in Centerville since 1974 at 6904 Centerville Rd. Recently a new
development began and our driveway going out to Centerville Road was taken
away from us. Now our only way out is the USe of the new street, Partridge
Place. We had no choice in this decision.
We have lived at 6904 Centerville Road since 1974 and never have had a flat
tire with a nail in it until July 2002. From July 2002 until December 2003
we have had 5 nails in our tires. We have found many nails in the middle of
the street on Partridge Place. If we had another exit out from our home, we
would take it as the nails continue to be out in the street. As of April 3rd ,
2004, I found 27 nails in the street in one day. Today I found another nail
in the middle of the street about 20 feet from our driveway. Yesterday,
John found 2 nails while riding his bike on the street.
We have shared this information with the Developer, Dale Runkel, and
nothing has been done and it continues to be a problem. He is blaming the
contractors and has done nothing to correct this problem or reimburse us
for the loss. When I asked for the street to be swept last summer, it was
only done once or twice in all this time. We are still out $341.44 for our
tires and continue daily to drive on a road filled with nails.
I have enclosed a list from Tires Plus of the expenses that we have paid. A
new truck tire valued at $150 dollars was unrepairable and was added to
that bill.
We would like to see reimbursement for our losses and trouble.

WHEREAS, upon the request of both owners (1798 & 1806 Main Street) at
different times and the consideration of the Planning and Zoning Commission and City
Council; and
WHEREAS, Minnesota Statute Section 412.851, entitled "Vacation of Streets,"
authorizes the City Council of a statutory city by resolution to vacate any street on its
own motion; and

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of

Monument SignslFlower Beds in City Parks

The monument signs/flower beds in each of the five (5) city parks has needed attention the last few
years and with limited staff time available, the planting and weeding of these flower beds was done
by volunteers in the 2003 summer season, Perennials were donated to be planted in each bed and
residents/committee members did the planting and weeding. The volunteers are still willing to
continue with this project, but the beds really need additional work this year. The committee would
like to request funds not to exceed $50 per park/flower bed to purchase supplies such as plants,
fertilizer, top soil & mulch, The committee feels these funds should not be taken from the Parks &
Recreation Committee's budget, but rather from the Park Maintenance Fund,
Motion was made by Chairperson Peterson, seconded by Committee Member Lindsay, to
request funds not to exceed $50 per park/flower bed to purchase supplies such as plants,
fertilizer, top soil & mulch with funds from the Park Maintenance Fund. All in favor.

The Economic Development Committee made the foUowing recommendations &
requests for City Councll consideration at their April 13, 2004 committee meeting.
BII-iness Person of the Year
The Economic Development Committee discussed the nominations for Business Person
of the Year. Committee Member Smith had been nominated as owner of Centerville Pet
Foods, but opted to turn down the nomination. The committee then voted on the other
nomination and would like to recommend to City Council the 2003 Business Person of
the Year Award be presented to Brenda McLean, Hansel & Gretel.
Motion was made by Committee Member Smith, seconded by Committee Member
Ebel to recommend to City Council awarding the 2003 Business Person of the Year
Award to Ms. Brenda McLean of Hansel & GreteL The committee reqnests council
direct staff to purchase a plaque not to exceed 550, to be presented at the Business
Appreciation Barbeque, May 11, 2004. AU in favor. Motion carried unanimously.

Committee Member Betsy ScheUer has resigned from the Economic Development
Committee. The committee would like to acknowledge Ms. Scheller's contributions to

New businesses will be recognized for expanding or starting a business in Centerville in
the previous year with a framed certificate and a dollar symbolizing the first dollar

request from council expending funds not to exceed $100 for supplies associated
with New Business Recognition Certificates. All in favor. Motion carried

Reschedulin2 of the Mav Ecouomic Development Committee Meetin~
The Economic Development Committee will be holding the Annual Business
Appreciation Barbeque on Tuesday, May 11, 2004 which is the regularly scheduled
meeting date for the Economic Development Committee. The committee chooses to
reschedule the May 2004 meeting to Thursday, May 13, 2004 opposed to canceling it for
the month. Ms. Stephan will ensure this is posted.

Smith to reschedule the May 2004 Economic Development Committee from May 11,
2004 at 6:30 p.m. to Thursday, May 13, 2004 at 6:30 p.m. AU in favor. Motion

Commercial & Industrial Park Dedication Fees
The Parks & Recreation Committee requested the Economic Development Committee
review the recommendation to council regarding Commercial & Industrial Park
Dedication Fees to determine if EDC had any questions or further recommendations to
council. The committee discussed the options and were satisfied with the
recommendations made by the Parks & Recreation Committee and had no changes or
further recommendations. The committee did want it noted that the option to receive
Park Dedication Fees or a portion of the property in lieu of the fees should remain
consistent for commercial & residential properties as it is with residential.

The Parks and Recreation Committee made the following recommendation for Council
consideration at their April 7, 2004 committee meeting.
Commercial & Industrial Park Dedication Fees
At the March 3,2004 Parks & Recreation Meeting, Vice-Chairperson LeBlanc questioned if there
were currently any park dedication fees required for commercial or industrial properties.
Chairperson Peterson responded with the City of Lino Lakes is currently charging park dedication
fees for commercial property, but Centerville requires only residential properties to pay park
dedication fees. Council Member Lee requested this be added as a discussion on the next council
agenda ~:1?S March 10, 2004. City Council directed staff to research what other cities were
charging;"1ranytmng, for Commercial & Industrial Park Dedication Fees.
The information the City Clerk put together from the Cities ofLino Lakes & Hugo was presented to
City Council at the March 24, 2004 City Council Meeting. City Council requested this information
be passed on to the Parks & Recreation Committee for a recommendation.
Both the cities ofLino Lakes & Hugo have Commercial & Industrial Park Dedication Fees as
follows:
Lino Lakes
$2,175/acre - Both Commercial & Industrial
$1,665/unit - Residential
$1,800/acre - Commercial, Industrial & Residential
Hugo
The Parks & Recreation Committee discussed the various options at length. Committee Member
Peil stated she was in favor of charging fees per acre, but wanted an amount lower than the cities
current $3000/unit charge for Residential Park Dedication Fees. Committee Member Peil felt the
various fees charged for permits was already a deterrent to businesses choosing to look at building
in Centerville and wanted to keep the Park Dedication Fees lower so as to not discourage
businesses or appear that Centerville was not business friendly. Chairperson Peterson agreed and
added that Centerville's requirements for building in industrial and commercial areas were already
more stringent than neighboring communities, and although that allowed for higher quality
buildings, it also kept some businesses from choosing Centerville.
Minnesota Statutes 2003, 475.521
(1) the condition of the city's existing infrastructure,
including the projected need for repair or replacement;
(2) the likely demand for the improvement;
(3) the estimated cost of the improvement;
(4) the available public resources;
(5) the level of overlapping debt in the city;
(6) the relative benefits and costs of alternative uses of
the funds;
(7) operating costs of the proposed improvements; and
(8) alternatives for providing services most efficiently
through shared facilities with other cities or local government
units.
(b) The capital improvement plan and annual amendments to
it must be approved by the city council after public hearing.
Subd. 4. Limitations on amount. A city may not issue
bonds under this section if the maximum amount of principal and
interest to become due in any year on all the outstanding bonds
issued under this section, including the bonds to be issued,
will equal or exceed 0.05367 percent of taxable market value of
property in the county. Calculation of the limit must be made
using the taxable market value for the taxes payable year in
which the obligations are issued and sold. This section does
not limit the authority to issue bonds under any other special
or general law.
Subd. 5. Application of this chapter. Bonds to
finance capital improvements qualifying under this section must
be issued under the issuance authority in this chapter and the
provisions of this chapter apply, except as otherwise
specifically provided in this section.

475.521 Capital improvement bondS.~
Subdivision 1. Definitions. For purposes of this
section, the following terms have the meanings giv~n.
(a) "Bonds" mean an, obligation defined under section 475.51.
(b) "Capital improvement'l means acquisition or betterment
of public lands, buildings or other improvements for the purpose
of a city hall, public safety facility, and pUblic works ~
facility. An improvement must have an expected useful life of
five years or more to qualify. Capital improvement does not
include light rail transit or any activity related to it, or a
park, library, road, bridge, administrative building other than
a city hall, or land for any of those facilities.
{c} "City" means a home rule charter or statutory city.
Subd. 2. E~ection requirement. (a) Bonds issued by a
city to finance capital improvements under an approved capital
improvements plan are not subject to the election requirements
of section 475.58. The bonds are subject to the net debt limits
under section 475.53. The bonds must be approved by an
affirmative vote of three-fifths of the members of a five-member
city council. In the case of a city council having more than
five members, the bonds must be approved by a vote of at least
two-thirds of the city council.
(b) Before the issuance of bonds qualifying under this
section, the city must publish a notice of its intention to
issue the bonds and the date and time of the hearing to obtain
public comment on the matter. The notice must be published in
the official newspaper of the city or in a newspaper of general
circulation in the city. Additionally, the notice may be posted
on the official Web site, if any, of the city. The notice must
be publiShed at least 14 but not more than 28 days before the
date of the hearing.
(c} A city may issue the bonds only after obtaining the
approval of a majority of the voters voting on the question of
issuing the obligations, if a petition requesting a vote on the
issuance is signed by voters equal to five percent of the votes
cast in the city in the last general election and is filed with
the city clerk within 30 days after the public hearing. The
commissioner of revenue shall prepare a suggested form of the
question to be presented at the election.
Subd. 3. Capital improvement p1.an. (a) A city may
adopt a capital improvement plan. The plan must cover at least
a five-year period beginning with the date of its adoption. The
plan must set forth the estimated schedule, timing, and details
of specific capital improvements by year, together with the
estimated cost, the need for the improvement, and sources of
revenue to pay for the improvement. In preparing the capital
improvement plan, the city council must consider for each
project and for the overall plan:

Attached you will fmd fmancing estimates prepared by Northland Securities for the
purchase of a new police station. With that information, I have also prepared estimates of
annua1lease amounts.
The improvements to the building were estimated at $250,000 for the purpose of arriving
at a preliminary fmancing estimate. There are no firm numbers available at this time.
The average annual debt service payment for the estimated cost of the building would be
$106,908. It is unclear at this point as to the period of time in which the cost of the
building would be recouped. Much will depend on the structure of the joint powers
agreement.
Mr. George Eilertson from Northland Securities will be available at the meeting to
answer any financing related questions you may have.

Re: Request to Include Ojibway Drive for Annual Spring
Street Sweeping
~s we discussed today, the Home Owners Association would
appreciate the inclusion of Ojibway Drive when toe City does
the street sweeping. Ojibway Drive is a short street with a
small cul-de-sac. Eighteen units of housing are located on
this street and the street is not only utilized by these
Centerville residents but also by the USPO, assorted
delivery trucks and other visitors.
These same Centerville residents also support the upkeep of
the public sidewalk (snow removal, watering and grass
cutting) on Dupre Road and Meadow Lane through their payment
of monthly assessments. I live on Dupre Road and the use of
these public sidewalks is phenomenal and surely appreciated
by all Centerville citizens.
