AN ORDINANCE REGULATING THE PLACEMENT AND INSTALLATION OF MAILBOXES
AND PAPER BOXES WITHIN THE CITY OF CENTERVILLE.

SECTION 1. INTENT.
The intent of this ordinance is to reduce the number of mailbox and paper box locations on City
streets. The reasons for this are: to make snow removal a more efficient process, and to enhance
the looks of the City streets.
SECTION 2. GROUPING MAILBOXES AND PAPER BOXES.
All mailboxes shall be clustered in groups of not less than four, or more than six. Paper boxes
are in addition to the mailboxes and shall be installed on the same stand. Groups of less than
four will be allowed if any mailbox is more than 250 feet from the property it serves.
SECTION 3. LOCATION.
The Public Works Director shall produce a Mailbox Location Plan for the City and designate
group mailbox locations. Residents replacing existing mailboxes will check with City Hall for
the new group box locations.
SECTION 4. HANDICAPPED PERSONS.
Any handicapped or elderly person who would have difficulty using a group box location shall
be exempt from this ordinance upon notification of handicap or physical condition to City Hall.
SECTION 5. REMOVAL OF PAPER BOXES FROM THE RIGHT -OF- WAY.
As of August 1, 1990 all paper boxes not in group locations will be removed from the City street
right-of-way.
SECTION 6. CUL-DE-SACS.
Group mailbox and paper box stands shall not be located in any cul-de-sac. Box locations will
be allowed on streets entering and leaving the cul-de-sac.

The Public Works Department shall install mailbox platforms in all new developments after the
streets are complete.
SECTION 8. FEE FOR NEW DEVELOPMENTS.
A per dwelling unit fee will be recommended as determined necessary by the Public Works
Director, to the City Council who shall set the per dwelling unit fee in the current fee structure.
The per unit dwelling fee shall be charged for the installation of mailboxes and stands in new
developments. Such charge shall be added to the building permit, at the time of issue. The
Public Works Department budget shall be directly reimbursed to cover costs involved.
SECTION 9. ALL OTHER RESIDENCES AND BUSINESSES.
Approved mailbox platforms shall be available from the Public Works Department at a cost to
cover material and labor. Plans for building your own platform shall also be made available
from the Public Works Department.
SECTION 10. MAINTENANCE.
Maintenance of the mailbox platforms shall be the responsibility ofthe residents served.
SECTION 11. PENALTY.
Any person in violation of any provision of this ordinance shall be punished by a fine not more
than $700 or imprisonment in the County jail for not more than 90 days or both, plus the cost of
prosecution in the case.
SECTION 12. EFFECTIVE DATE.
This ordinance becomes effective upon its passage and publication

Commercial uses (as defined by Ordinance #4) in the M-l District will follow the Commercial guidelines
for percentage of green space. For all other properties in the M-1 District, the maximum accessory
structure allowed is 704 square feet and 440 square feet in the R-4 District, neither to exceed the size of
the principal structure if an attached garage does not exist. If an attached garage exists, the maximum
accessory structure allowed is two (2) percent of the lot size or a maximum of 200 square feet.
Division 70: Site Plan Review ReQuired
For all land use applications or permit applications, a site plan review is required by the Zoning
Administrator or their designee. Said review shall take place thirty (30) days prior to the desired Planning
and Zoning meeting. For example, if a property owner desires to construct a home (or any other
structure) and desires to have it presented t6 the Planning and Zoning Commission in May, the
application and site plan need to be presented to the Zoning Administrator or his/her designee the first
week in April.
Section 070-010: Submittal Requirements.
A. Boundary survey of parcel including identification of all monuments; and
B. Scaled location of all buildings, structures, driveways, sidewalk, trails, parking stalls
and curbing; and
C. Scaled identification of all setback dimensions from property lines; and
D. Scaled locations of all existing and proposed utilities and easements; and
E. Scaled depictions of floor plans for each story; and
F. Scaled depictions of each building elevation and descriptions of exterior building
materials and color schemes; and
G. Scaled site grading plans, including erosion and sedimentation control mechanisms
and procedures; and
I. Scaled delineations of any shoreland, floodplain or wetland areas on the site; and
J. Identification of any floodplain or wetland encroachments and detailed mitigation
plans; and
K. Detailed landscape plans, illustrating size, types and locations of all materials, a
description of site seeding or sodding, a description of the timetable for site
landscaping and the identification of any irrigation systems; and
L. Detailed descriptions of any site fencing, including type, location and height.
All plans shall be dated and bear the preparer(s) name(s), including professional registrations or
certifications when appropriate or required.

Section 070-020: Review Requirements. For actions that will require City review, applicants shall
submit sixteen (16) sets of site plans with a required application form and appropriate fees to the City
Clerk for distribution. Site plans will be evaluated for consistency with documentation requirements.
Upon acceptance of the application, site plans will be distributed to the appropriate City entity for review
and recommendation.
Action to approve, modify or deny site plan applications will be based upon consistency ofthe application
with the City's Comprehensive Plan, Zoning Ordinance, other policies and official controls and the
compatibility of the proposed action with existing area land uses, existing area investments and
neighborhood character, capacity of public streets and utilities and future planned land uses.
Section 070-030: Exceptions. The City may waive certain submittal requirements for residential
variance applications, when it is determined that submittal requirements are not applicable or are not
necessary to complete a review of the proposed action. The City may also waive certain submittal
requirements for other actions, when site plan information for the subject property has previously been
submitted to the City and may be more appropriately supplemented with new information.
Division 75: Final Grading and Landscaping
,
Lots in all districts shall be subject to the following:
Subd. 1
No Occupancy Permit shall be issued until the lot upon which the structure is
constructed is brought to finished grade as specified, except during
inclement weather an escrow shall be deposited with the City as approved in
the fee schedule; and
Subd. 2
Within six (6) months from the issuance of the Occupancy Permit the lot shall
be landscaped in a manner, which prevents erosion due to wind or water.
Extensions may be granted at the Building Official's discretion.
Division 80: Zoning Districts/Use Regulations
Section 080-010: Zoning Map. A map entitled "Centerville Zoning Map" is hereby adopted by
reference and declared to be part of this Ordinance as the Official Zoning Map.
Such map shall be on permanent file and available for public inspection in the City Hall. It shall be the
responsibility of the City Clerk to maintain and keep the map up to date and to record each amendment
thereto within thirty (30) days after official publication of the ordinance adopting the amendment.
Section 080-020: Interpretation of the Zoning Map. Where due to the scale, lack of detail or illegibility
of the Zoning Map attached hereto, there is an uncertainty, contradiction or conflict as to the intended
location of any zoning district boundary as shown thereon, the Zoning Administrator shall make an
interpretation of the map upon the request of any person. Any person aggrieved by any such
interpretation may appeal such interpretation to the Board of Appeals and Adjustments. The Board of
Appeals and Adjustments, in interpreting the Zoning Map or deciding any appeal, shall apply to the
following standards:

The Commission indicated they did not receive the right-of-way ordinance.
Ms. Moore-Sykes indicated the Ordinance provided was a model ordinance provided by
the League of Minnesota Cities and approved by several local cities, including Ham
Lake, Blaine, and Spring Lake Park.

Commissioner De Vine indicated that the Commission has seen the model ordinance and
had asked Staff to amend the model ordinance to reflect the language specific to
Centerville.
Commissioner DeVine pointed out there was discussion on Page 5 of 10 of the minutes
from the July 2,2002 meeting on the right-of-way ordinance.
Ms. Moore-Sykes indicated Staff would have an ordinance ready for review at the
October meeting.
Chair Hanson asked if the penalty in Ordinance #13 was retroactive.
Ms. Moore-Sykes indicated that license holders would need to do a number of things
when they renew their license in order to be allowed to participate in the best practices
program.
Commissioner DeVine asked what the benefits of being on the best practices would be.
Ms. Moore-Sykes indicated the biggest advantage would be a reduction in underage
drinking along with better communication between license holders, the police
department, and the City.
Council Liaison Travis indicated the penalties for violations are not as harsh if they are
on the best practices schedule.
Ms. Moore-Sykes indicated a third violation would mean that the license holder would
revert to the regular penalty grid until they can prove that they are eligible for the best
practices program.
Commissioner Wilharber suggested the title should reflect that this new ordinance repeals
the old Ordinance #13.
Ms. Moore-Sykes indicated the title allows for a better paper trail for future tracking of
the changes made to the ordinance.

1. Rescheduling November Meeting (General Election)

VI. DISCUSSION ITEMS
1. Encroachment/Zoning Permits/Fences (Ordinance #4)
Ms. Moore-Sykes indicated that City Staff has been inundated with questions concerning
fencing and has found themselves being pulled into several neighborhood disputes. She
then indicated she had met with the Staff and Staff would like the Commission to
consider amending Ordinance #4 as the draft document shows.
Commissioner DeVine asked if any other city reqUlres a two-foot setback when
permission cannot be obtained from the neighbor.
Ms. Moore-Sykes indicated that the change is causing more problems because neighbors
do not want to sign or those putting up fences do not want to ask for permission. She
then said she feels that all fences should come before Staff and/or the Planning
Commission to ensure that residents are determining where the property lines are.
Commissioner Wilharber indicated he felt the fencing should be an administrative issue
and not something the Planning Commission should deal with.
Commissioner DeVine indicated he liked the way the Ordinance was amended by Staff
but said that wording the ordinance in such a manner would require a homeowner to
obtain a survey if an agreement could not be reached with the neighbor.
Commissioner Wilharber indicated there is also an issue with the maintenance of the
other side ofthe fence.
Mr. Richard Thompson of 1657 Peltier Lake Drive addressed the Commission and
explained what goose fencing was and asked whether the ordinance would cover that
type offencing.
Ms. Moore-Sykes indicated she did not feel that Ordinance #4 would govern goose fence
becausc a fence is a barrier and a goose fence is only a barrier to the geese.
Commissioner McLean suggested using the word permanent.
Mr. Thompson asked if the goose fence could go back up if he takes out the other
fencing.
Ms. Moore-Sykes indicated that one section of Mr. Thompson's fence would be
grandfathered in.
Mr. Thompson asked if he put the rails in at 45 degrees if that would be considered a
fence or if that would be ornamental.
Commissioner Kilian said he felt that would still be considered a fence.

Chair Hanson suggested that a line of any sort should be visible so no one trips over it.
Corrunissioner DeVine indicated he would be in favor of indicating that goose fencing is
not regulated by Ordinance #4.
Commissioner Wilharber suggested that it may be tough for residents to swallow having
to pay for a land survey to put up a fence. He then said he would like some time to
review and consider these suggested changes before making a decision.
Ms. Moore-Sykes indicated that Mr. Palzer had said he wants the fences on the property
lines and, if homeowners cannot agree on the property line, a survey will be needed.
Mr. Thompson indicated he knows where the posts are but his neighbor has said he
disagrees with their location.
Ms. Moore-Sykes indicated she had told Mr. Thompson's neighbor that a survey should
be done to eliminate the controversy as to the location of the property line.
Commissioner DeVine indicated that he would not want City Staff out .making
determinations on property lines as that could open the City up to liability. He then said
he would like to give the ordinance changes some more thought because a survey will be
required in a lot of cases the way it is written.
Commissioner McLean indicated it is in the property owner's best interest to locate the
property pins because that infOlmation will be needed at some time.
Ms. Moore-Sykes indicated that most cities charge $25.00 to $30.00 for a fence permit.
Commissioner Kilian said he felt that $25.00 or $30.00 is too high as taxes are too high in
Centerville already.
Commissioner Helmbrecht indicated the Ordinance needed to address snow fence and
goose fencing.
Commissioner Wilbarber asked if the City would be liable if someone uses a material for
their goose fencing that is not clearly visible and someone trips because the Ordinance
says that goose fencing is allowed.
Chair Hanson said he feels that would be the homeowner's responsibility.
Chair Hanson suggested indicating in the Ordinance that a highly visible material needs
to be used.
Motion by Commissioner DeVine. seconded by Commissioner Kilian to table
Ordinance #4 revisions to the next meetin2.

Ms. Moore-Sykes suggested adding language that the goose fencing should be
completely contained on the homeowner's own property.
VOTE: All in favor. Motion carried unanimously.
Ms. Moore-Sykes indicated Staff would like to discuss accessory structures and uses and
indicated she would put that on a future agenda for discussion.
Commissioner McLean asked to have a discussion concerning total lot coverage added to
a future agenda.
Commissioner DeVine asked that a. discussion regaTding fron~ porches be added to a
future agenda.
Mr. Thompson asked about parking on City streets over the curb.
Ms. Moore-Sykes indicated she had addressed that today. She then said that Ordinance
# 16 states that it is not allowed.
VII. CONSIDERATION OF MINUTES

Motion by Commissioner Wilharber, seconded by Commissioner DeVine to approve
the August 6, 2002 Meeting Minutes as presented. All in favor. Motion carried

BUSINESSES IN THE CITY OF CENTERVlLLE; PROVIDING FOR THE
ISSUANCE OF LICENSES AND COLLECTION OF FEES THEREFORE;
PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
The City Council of the City ofCenterville does ordain as follows:
ADULT ESTABLISHMENTS
Section 1 Purpose and Intent.
Subdivision 1. Endings.. It is the purpose of this Ordinance to regulate Adult
Oriented Businesses to promote the health, safety, morals, and general welfare of the
citizens of the City and to establish reasonable and uniform regulations to:
(a) Prevent additional criminal activity within the City;
(b) Prevent deterioration of neighborhoods and its consequent adverse effect
on real estate values of properties within the neighborhood;
( c) To locate Adult Oriented Businesses away from residential areas, schools,
churches, and parks and playgrounds;
(d) Prevent concentration of Adult Oriented Businesses within certain areas of
the City.
Subdivision 2. The provisions of this Ordinance have neither the purpose nor
effect of imposing a limitation or restriction on the content of any communicative
materials, including Adult oriented materials. Similarly, it is not the intent nor effect of
this Ordinance to restrict or deny access by adults to Adult oriented materials protected by
the First Amendment, or to deny access by distributors and exhibitors of Adult oriented
entertainment to their intended market.
Section 2. Definitions.
Subdivision 1. For purposes of this section the terms defined in this section have
the meanings given them.

Subdivision 2. Adult Use. Any of the activities and businesses described below
constitute "Adult Oriented Businesses" which are subject to the regulation of this
Ordinance.
Subdivision 3 Adult Book and/or Media Store. An establishment which excludes
minors and which has a substantial portion of its stock in trade or stock on display books,
magazines, films, videotape, or other media which are characterized by their emphasis on
matter depicting, describing, or relating to Specified Sexual Activities or Specified
Anatomical Areas.
Subdivision 4. Adult Caharet. An establishment which provides dancing or other
live entertainment, if such establishment excludes minors by virtue of age from all or part
of the establishment and if such dancing or other live entertainment in distinguished or
characterized by an emphasis on the performance, depiction or description of Specified
Sexual Activities or Specified Anatomical Areas.
Subdivision 5. Adult Establishment. Any business which offers its patrons
services, entertainment, or the sale of merchandise characterized by an emphasis on matter
depicting, exposing, describing, discussing, or relating to specified sexual activities or
specified anatomical areas. Specifically included in the term, but without limitation, are
adult book and media stores, adult cabarets, adult hotels or motels, adult mini-motion
picture theaters, adult modeling studios, adult motion picture arcades, adult motion
picture theaters, adult novelty businesses, and other adult establishments.
Subdivision 6. Adult Hotel or Motel. Adult Hotel or Motel means a hotel or
motel form which minors are specifically excluded from patronage and wherein material is
presented which is distinguished or characterized by an emphasis on matter depicting,
describing, or relating to specified sexual activities or specified anatomical areas.
Subdivision 7. Adult Mini-Motion Picture Theater.
(a) A theater in an enclosed building, from which minors are excluded from all
or part of the establishment, with a capacity for less than 50 persons used
for presenting motion pictures, including but not limited to film and
videotape, having as a dominant theme material distinguished or
characterized by an emphasis on matter depicting, describing, or relating to
Specified Sexual Activities or Specified Anatomical Areas.
(b) Any business which present motion pictures, from which minors are
excluded from all or part ofthe establishment, including films and
videotapes, having as a dominant theme material distinguished or
characterized by an emphasis on matter depicting, describing, or relating to
Specified SeA'UaI Activities or Specified Anatomical Areas, for viewing on
the premises, including but not limited to private booths, viewing by means

of coin operated or other mechanical devices, and the viewing of excerpt of
motion pictures offered for sale or rent,
Subdivision 8. Adult Modeling Studio. An establishment, which excludes minors
from all or part of the establishment, whose major business is the provision, to customers,
or figure models who are so provided with the intent of providing sexual stimulation to
sexual gratification to such customers and who engage in specified sexual activities or
display specified anatomical areas while being observed, painted, painted upon, sketched,
drawn, sculptured, photographed, or otherwise depicted by such customers.
Subdivision 9. Adult Motion Picture Arcade. Any place which excludes minors
from all or part of the establishment wherein coin or token operated or electronically,
electrically, or mechanically controlled or operated still or motor picture machines,
projectors, or other image producing devices are maintained to show images to five or
fewer persons per machine at anyone time, and where the images so displayed are
distinguished or characterized by an emphasis on depicting or describing Specified Sexual
Activities or Specified Anatomical Areas.
Subdivision 10, Adult Motion Picture Theater. A theater in an enclosed building,
from which minors are excluded from all or part of the establishment, with a capacity of
50 or more persons used regularly and routinely for presenting live entertainment or
motion pictures, including but not limited to film and videotapes, having as a dominant
theme material distinguished or characterized by an emphasis on matter depicting,
describing, or relating to Specified Sexual Activities or Specified Anatomical Areas for
observation by patrons herein.
Subdivision 11. Adult Novelty Business. A business, from which minors are
excluded from all or part ofthe establishment, which sells, offers to sell, or displays
devices which simulate human genitals or devices which are designed for sexual
stimulation.
Subdivision 12. Specified Anatomical Ar~ are any of the following conditions:
(a) Less than completely and opaquely covered;
(1) human genitals, pubic region, or pubic hair;
(2) buttock; and
(3) female breast below a point immediately above the top of the
areola; and
(b) Human male genitals in a discernible turgid state, even if opaquely covered,
Subdivision 13. Specified Sexual Activities are any of the following conditions:
(a) An act of sexual intercourse, normal or perverted, actual or simulated,

including genital-genital, anal-genital, or oral-genital intercourse, whether
between human beings or between a human being and an animal.
(b) Sadomasochistic abuse, meaning flagellation or torture by or upon a person
who is nude or clad in undergarments or in a revealing costume or the
condition of being fettered, bound, or otherwise physically restricted on the
part of one so clothed.
(c) Masturbation or lewd exhibitions of the genitals including any explicit,
close-up representation of a human genital organ clothed or unclothed.
(d) Physical contact or simulated physical contact with the clothed or
unclothed pubic areas or buttocks of a human male or female, or the
breasts of a female, whether alone or between members of the same or
opposite sex or between humans and animals in an act of apparent sexual
stimulation or gratification.
Section 3. Application ofthis Ordinance.
Except as in this Ordinance specifically provided, no structure shall be erected,
converted, enlarged, reconstructed, or altered, and no structure or land shall be used, for
any purpose nor in any manner which is not in conformity with this Ordinance.
No Adult Oriented Business shall engage in any activity or conduct or permit any
other person to engage in any activity or conduct in or about the establishment which is
prohibited by any ordinance ofthe City ofCenterville, the laws of the State of Minnesota,
or the United States of America. Nothing in tms Ordinance shall be construed as
authorizing or permitting conduct which is prohibited or regulated by other statutes or
ordinances, including but not limited to statutes or ordinances prohibiting the exhibition,
sale, or distribution of obscene material generally, or the exhibition, sale, or distribution of
specified materials to minors.
Section 4. Location.
During the term of this Ordinance, no Adult Oriented Businesses shall be located
less than 500 feet from any residential zoning district boundary or site used for residential
purposes, and less that 500 feet from any church site, from any school site, from any day
care facility, or from any park wmch is adjacent to property zoned residential. In addition,
no Adult Oriented Business may be located within 500 feet of another Adult Oriented
Business. For purposes oftrus Ordinance, this distance shall be a horizontal measurement
from the nearest existing residential district boundary or site used for residential purposes,
church site, school site, day care site, park site, or another Adult Oriented Business site to
the nearest boundary of the proposed Adult Oriented Business site.
Section 5. BOlll"s of Opcl"ation.

No Adult Oriented Business site shall be open to the public from the hours of
11:00 p.m. to 9:00 a.m.
Section 6. Operation.
Subdivision 1. Off-site Viewing. An establishment operating as an Adult Oriented
Business shall prevent off-site viewing of its merchandise, which ifviewed by a minor,
would be in violation of Minnesota Statutes Chapter 617 or other applicable Federal or
State Statutes or local ordinances.
Subdivision 2. Entrances. All entrances to the business, with the exception of
emergency fire exits which are not useable by patrons to enter the business, shall be visible
from a public right-of-way.
Subdivision 3. T ,ayout. The layout of the display areas shall be designed so that
the management of the establishment and any law enforcement personnel inside the store
can observe all patrons while they have access to any merchandise offered for sale or
viewing including but not limited to books, magazines, photographs, video tapes, or any
other material.
Subdivision 4. Illumination. Illumination ofthe premises exterior shall be
adequate to observe the location and activities of all person on the exterior premises.
Subdivision 5. Signs.. Signs for Adult Oriented Businesses shall comply with the
City's Ordinance for signs addressed in ordinance 4, and in addition signs for Adult
Oriented Businesses shall not contain representational depiction of an adult nature or
graphic descriptions of the adult theme of the operation.
Section 7. Licenses.
Subdivision 1. Licenses_Required. All establishments, including any business
operating at the time this Ordinance become effective, operating or intending to operate
Adult Oriented Business, shall apply for and obtain a license from the City of Centerville,
A person is in violation of the City Code if he or she operate an Adult Oriented Business
without a valid license, issued by the City.
Subdivision 2. Applications. An application for a license must be made on a form
provided by the City.
(a) The application must be accompanied by a sketch or diagram showing the
configuration ofthe premises, including a statement of total floor space
occupied by the business. The sketch or diagram need not be
professionally prepared but must be drawn to a designated scale or drawn

with marked dimensions of the interior of the premises to an accuracy of
plus or minus six inches.
(b) The applicant must be qualified according to the provisions of this section
and the premises must be inspected and found to be in compliance with the
appropriate state, county, and local law and codes by the health official, fire
marshal, and building official.
(c) Application for license shall contain the address and legal description of the
property to be used; the names, addresses, phone numbers, dates of birth,
of the owner, lessee, if any, the operator or manager, and all employees;
the name, address, and phone number of two persons, who shall be
residents of the State of Minnesota, and who may be called upon to attest
to the applicant's, manager's, or operator's character; whether the applicant,
manager, or operator has ever been convicted of a crime or offense other
than a traffic offense and, if so, complete and accurate information the
disposition thereof; the names and addresses of all creditors of the
applicant, owner, lessee, or manager insofar as the regarding credit which
has been extended for the purposes of constructing, equipping, maintaining,
operating, or furnishing or acquiring the premises, personal effects,
equipment, or anything incident to the establishment, maintenance and
operation of the business.
(d) If the application is made on behalf of a corporation, joint business venture,
partnership, or any legally constituted business association, it shall submit
along with its application, accurate and complete business records showing
the names, addresses, and dates of birth of all individuals having an interest
in the business, including partners, officers, owners, and creditors
furnishing credit for the establishment, acquisition, maintenance, and
furnishings of said business and, in the case of a corporation, the names,
addresses, and dates of birth of all officers, general managers, members of
the board of directors as well as any creditors who have extended credit for
the acquisition, maintenance, operation, or furnishing of the establishment
including the purchase or acquisition of any items of personal property for
use in said operation.
( e) All applicants shall furnish to the City, along with their applications,
complete and accurate documentation establishing the interest of the
applicant and any other person having an interest in the premises upon
which the building is proposed to be located or the fiunishings thereof,
personal property thereof, or the operation or maintenance thereof.
Documentation shall be in the form of a lease, deed, contract for deed,
mortgage deed, mortgage credit arrangement, loan agreements, security
agreements, and any other documents establishing the interest of the

applicant or any other person in the operation, acquisition or maintenance
of the enterprise,
(f) The license fee required by this ordinance has not been paid,
(g) An applicant has been convicted of a crime involving any of the following
offenses:
(1) Any sex crimes as defined by Minn, Stat. 609.29 through 609,352
inclusive or as defined by any ordinance or statute in conformity
therewith;
(2) Any obscenity crime as defined by Minn, Stat, 617.23 through
617,299 inclusive, or as defined by any ordinance or statute in
conformity therewith; for which:
. less than two years have elapsed since the date of conviction or the
date of release from confinement imposed for the conviction,
whichever is the later date, if the conviction is of a misdemeanor
offense,
. less than five years have elapsed since the date of the last conviction
or the date of release from confinement for the conviction,
whichever is the later date, if the conviction is a felony offense; or
. less than five years have elapsed since the date ofthe last conviction
or the date of release from confinement for the last conviction,
whichever is the later date, if the conviction is of two or more
misdemeanor offenses or combination of misdemeanor offenses
occurring within any 24 month period,
(3) The fact that a conviction is being appealed shall have no effect on
disqualification of the applicant or applicant's spouse,
Subdivisionj. Requalification., An ap'ylicant who has been convicted of an
offense listed in Section 7, Subdivision' (gtfmay qualify for an Adult Oriented Business
license only when the time period required by Section 7, Subdivision 1 (gihas elapsed,

Subdivision { Posting The license, if granted, shall state on its face the name of
the person or persons to whom it is granted, the expiration date, and the address of the
Adult Oriented Business. The license shall be posted in a conspicuous place at or near the
entrance to the Adult Oriented Business so that it may be easily read at any time,

Subdivision-'~. Council Action. The City Council shall act to approve or
disapprove the license application within 120 days from the date the application was

submitted, provided that the application contains all of the information required by this
ordinance. If the application is deficient, the Council shall act on the application within
120 days from the date that the deficiency has been corrected.
Subdivision!. Appeals. An Within 90 days after the decision by the Council, the
applicant may appeal to the District Court by serving a notice upon the Mayor or Clerk of
the Municipality.
Section II. ~.
Fees shall be set by City Resolution on the fee structure.
Section 9. Inspection.
Subdivision 1. Access. An applicant or licensee shall permit health officials,
representatives of the police department, fire department, and building inspection division,
to inspect the premises of an Adult Oriented Business for the purpose of ensuring
compliance with the law, at any time it is occupied or open for business.
Subdivision 2. Refusal to Permit Inspections. A person who operates an Adult
Oriented Business or his agent or employee commits an offense if she or he refuses to
permit a lawful inspection of the premises by health officials, representatives of the police
department, fire department, and building inspection division at any time it is occupied or
open for business. Refusal to permit inspections may result in the suspension of the
license as provided in Section 11.
Subdivision 3. Exceptions. The provisions of this section do not apply to areas of
an adult motel which are currently being rented by a customer for use as a permanent or
temporary habitation.
Section 10. Expiration and Renewal.
Subdivision 1. Expiration. Each license shall expire at the end of the calendar year
and may be renewed only by making application as provided in Section 7, Subdivision 1.
Application for renewal must be made at least 60 days before the expiration date, and
when made less that 60 days before the expiration date, the expiration of the license will
not be affected.
Subdivision 2. Denial of Renewal. When the City denies renewal of a license, the
applicant shall not be issued a license for one year from the date of denial. If, subsequent
to denial, the City finds that the basis for denial of the renewal license has been corrected
or abated, the applicant may be granted a license if at least 90 days have elapsed since the
date denial became final.
Section H. Suspension.

Subdivision 1. Causes of Suspension. The City may suspend a license for a period
not to exceed 30 days if it determines that a licensee or an employee of a licensee has:
(a) Violated or is not in compliance with any provision of this chapter.
(b) Engaged in the use of alcoholic beverages while on the Adult Oriented
Business premises other than at an Adult Hotel or Motel.
(c) Refused to allow an inspection of the Adult Oriented Business Premises as
authorized by this chapter.
(d) Knowingly permitted gambling by any person on the Adult Oriented
Business premises.
(e) Demonstrated inability to operate or manage an Adult Oriented Business in
a peaceful and law-abiding manner, thus necessitating action by law
enforcement officers.
Subdivision 2. Notice. A suspension by the City shall be proceeded by written
notice to the licensee and a public hearing. The notice shall give at least 10 days' notice of
the time and place of the hearing and shall state the nature of the charges against the
licensee. The notice may be served upon the licensee personally, or by leaving the same at
the licensed business premises with the person in charge thereof
Section 12. Revocation.
Subdivision 1. Suspended Licenses. The City may revoke a license if a cause of
suspension in Section II occurs and the license has been suspended within the preceding
12 months.
Subdivision 2. ~es. of Revocation. The City shall revoke a license ifit
determines that:
( a) A licensee gave false or misleading information in the material submitted to
the City during the application process;
(b) A licensee or an employee has knowingly allowed possession, use, or sale
of controlled substances on the premises;
(c) A licensee or an employee has knowingly allowed prostitution on the
premises;
(d) A licensee or an employee knowingly operated the Adult Oriented Business
during a period of time when the licensee's license was suspended;

(e)
A licensee has been convicted of an offense listed in Section 7 Subdivision
Z 3(g)!"'for which the time period required in Section 7, Subdivi;ion i(g):'has
not elapsed; . Z
(t)
On two or more occasions within a l2-month period, a person or persons
committed an offense occurring if! or on the licensed premises of a crime
listed in Section 7, Subdivision i(g), for which a conviction has been
obtained, and the person or pert-on were employees of the Adult Oriented
Business at the time the offenses were committed.
(g)
A licensee or an employee has knowingly allowed any act of sexual
intercourse, sodomy, oral copulation or masturbation to occur in or on the
licensed premises.
Subdivision 3. Appeals The fact that a conviction is being appealed shall have no
effect on the revocation of the license.
Subdivision 4. Exceptions. Section 12, Subdivision 2(g), does not apply to adult
motels as a ground for revoking the license unless the licensee or employee knowingly
allowed the act of sexual intercourse, sodomy, oral copulation, masturbation, or sexual
contact to occur in a public place or within public view.
Subdivision 5. C'tl"anting a License After Revocation. When the City revokes a
license, the revocation shall continue for one year and the licensee shall not be issued an
Adult Oriented Business license for one year from the date revocation became effective.
If, subsequent to revocation, the City finds that the basis for the revocation has been
corrected or abated, the applicant may be granted a license if at least 90 days have elapsed
since the date the revocation became effective. If the license was revoked under Section
12, Subdivision 2(e), an applicant may not be granted another license until the appropriate
number of years required under Section 7, Subdivision $ (g);nas elapsed.

Section 14. Severability.

Every section, provision, or part of this Ordinance or any permit issued to this
ordinance is declared severable from every other section, provision, or part thereof to the
extent that if any section, provision, or part of this Ordinance or any permit issued
pursuant to this ordinance shall be held invalid by a court of competent jurisdiction it shall
not invalidate any other section, provision, or part thereof

North 208.7 feet of the East Section of the South Half ofthe Southwest Quarter of the
Southwest Quarter of Section 23, Township 31 Range 22. My property adjoins Hunters
Crossing to the North; it also adjoins the City ofCenterville trail, which runs East and
West on the North side of my property.
I wish to add a one hundred (100) feet by two hundred and eight point seven (208.7) feet
as described on the attached survey as Parcel C (Surveyed by Tedd W. Mattke, RLS of
Mattke Surveying and Engineering, Inc of7671 Central Ave., NE, Fridley, MN 55432
(Telephone # (6]2) 783-0300) done on 6 May 02. The legal description is "The North
208.70 feet of the West ]00.0 feet of the East 308.70 Feet of the South Half of the
Southwest Quarter of the Southwest Quarter of Section 23, Township 3], Range 22,
Anoka County, Minnesota."
I also wish to add the Outlot A of Hunters Crossing to my property which is described as
a piece of ground] 0 feet by 160.01 feet of the South Line ofthe North 'li ofthe
Southwest y. of the Southwest y. of Section 23 Township 3] Range 22 (With the
assigned PIN# ofR23 3] 22 330040). I pay taxes on this piece of ground to the tune of
approximately $3.00 a year and wish to clean up my abstract and description of my
properties.
After approval by the P&Z and the City of€enterville, my lot size would be
approximately 218.7 fronting Centerville Road, by 308.7 feet deep to the west of

CLOSING AGREEMENT

THIS CLOSING AGREEMENT dated this 15 day of August, 2001, by and between
Patricia A. Wilharber, Trustee of the W. W. Wilharber Trust Agreement dated March 6, 1996
(hereinafter "Seller") and Richard S. Carlson & Associates, LLP, a Minnesota limited liability
partnership (hereinafter "Purchaser").
WHEREAS, Seller has just sold and Purchaser has just purchased real property legally
described on Exhibit A attached hereto (hereinafter the "Property").
WHEREAS, pursuant to the Purchase Agreement, it was agreed that Purchaser would
plat the property and re-convey back to the Seller, a small parcel in the northeast comer of the
property that is 208.71 feet by 100 feet inunediately west of the I-acre parcel in the northeast
comer ofthe Property.
WHEREAS, this document is intended to set down in writing the intentions of the parties
to complete tills platting and re-conveyance of the small parcel in tile future.
NOW, THEREFORE, the parties hereto in consideration of the sale-purchase of the
Property described on Exhibit A, and other good and valuable consideration, hereby agree to the
following:
1. Purchaser will plat the Property legally described on Exhibit A attached hereto in
the next one to five years.
2. Immediately after obtaining the final plat approval and recording of the plat on
the property, the Purchaser will re-convey to Seller a small platted parcel that is 208.71 feet by

Dear Commission members:
Subject: Rezoning Request
We purchased our property in 1984 when Centerville's population was approximately
600 residents. Today the population exceeds 3,000. In 1989 we began our journey
into horse ownership. Now in 2002 we have invested time and money into making
our hobby a business. Due to the limitations of our current property, we have
decided to purchase a larger parcel that will accommodate our business needs.
Therefore, we are requesting that our property be rezoned as outlined in the
Centerville Comprehensive Plan. Areas proposed by the city for future residential
growth (beyond the year 2000) include low-medium density east of Peltier Lake. We
are requesting that our property be rezoned from R-1 Rural Residential, P-1
PublidSemi Public and C-1 Conservation to R-2 Single Family Residential. Due to
the uniqueness of our property, we would like to present the following:
. The majority of our property is zoned R-1 Rural, with a minimum area of 10
acres.
. The property zoned P-1 PublidSemi Public is land that we purchased from
the St. Paul Water Utility. This zoning district is for land owned or leased by
federal, state, county or city government and it would be appropriate to re-
zone this parcel since the zoning is no longer relevant. All restrictions and
convents recorded on this parcel would be recorded with any new subdivision
of this land.
. The C-1 Conservation portion is a City designation only and is not a defined
zoning district within Table A - SCHEDULE OF DISTRICT REGULATIONS.
The intended location of any zoning district boundary is ambiguous due to the
scale and lack of detail of the Official Zoning Map.

We have an offer from a developer to develop our 15. +/- acres into a residential
development. Their plans may include a mixture of attached and detached housing
units. The Comprehensive Plan defines low/medium density areas to include single
family detached and single family attached residential dwellings. Detached dwellings
will develop at densities between two and two and one-half units per acre, while
attached units may approach four units per acre.
We respectfully ask for your recommendation of approval to the City Council based
on the following:
1. The request is consistent with the designated utility staging as defined
in the Comprehensive Plan.
2. The request is consistent with the growth management plan for future
residential development as defined in the Comprehensive Plan.
3. The request is will not grant any special privileges.

BACKGROUND
City Staff received a request from John and Sanna Buckbee to rezone their property at 7381
Peltier Circle from R-l to R-2. The Buckbees are proposing to sell their property and the
purchaser is interested in developing the property as an R-2. This zoning designation allows for
the construction of single family, detached dwellings and single family, attached dwellings, with
two units. The intent is to develop this property into a mixed residential project, incorporating
single family housing with twin home-style housing, similar to the Eagle Pass project.
To meet the setback requirements and to allow for the development of this property, the
Buckbees have also applied for a PUD and Special Use Permit once the rezoning is approved.
The Public Hearing for the PUD will be scheduled for the Planning and Zoning meeting in
December and the December 19th Council meeting.
The developer understands that it will be their responsibility to extend water and sewer to this
property. In researching the rezoning request, the Staff found that the Buckbee property is
eligible for inclusion in the City's MUSA according to the City's Comprehensive Plan. Looping
water through this area will provide increase fire protection to this proposed development and the
surrounding properties. It will also provide another means of accessing water and having it
available to all the homes in this area and to Centerville Elementary School as well.
Road easements currently exist to the property. One road already exists as Peltier Circle and the
other easement is unnamed, but platted and recorded with Anoka County. The developer will
also be responsible for constructing this road to City specifications and it is expected that it will
meet up with Peltier Lake Drive.
The City received a letter from S1. Paul Water Utilities advising that the northern portion of the
Buckbee property adjacent to Clearwater Creek has recorded restrictions. This portion was
purchased by the Buckbees from S1. Paul Water Utility and at the time of sale, the Buckbees
agreed to leave this land structure free. This land is intended to be continued as a wetland.
In checking with the City Attorney about this restrictive covenant, Mr. Hoeft agreed that the land
has to remain structure-free but the restriction will not prevent the Buckbee property from being
rezoned.

Preliminary Plat.
Some other issues that need to be addressed as part of the preliminary plat are listed below. The
preliminary plat should be considered for approval only after the rezoning request has been
recommended for approval.
Shed on the property line. A neighboring property has an accessory structure on
the property line. It will have to be removed to the owner's property and must
adhere to the setback requirements in its replacement.
Sidewalk/Trail. Staff is recommending that a sidewalk or trail be provided by the
developer that will connect to the existing sidewalk in Lakeland Hills.
Storm Sewer and Amendments. Because the area is low, Staff is recommending
that the developer also install a drain tile system to supplement the two holding
ponds that have been proposed.
Rice Creek Watershed District (RCWD) Approvals. Staffin its review of the site ~ J-'
plan and sketch noticed that some of the lots may be within the 100 foot setback ~ "';'\P e)-P1J
as required by the RCWD. This should be verified and variance requests "I i)ff
submitted if warranted. '7'::>
Storm Water Retention and Elevations, Elevations should be verified with the
City Engineer for flood plain designation. Also, the City Engineer should review
the proposed elevations ofthe southern portion of the property to determine the
amount of water that will flow from adjacent properties to the south retention
pond. Staff questioned whether this pond would be sufficient to hold water that
may drain from the adjacent properties to the new development.
Reconfigure lots 12 and 13. The developer should consider siting the proposed
residential structure on lot 13 so as to allow for the straightening of the SW lot
line for lot 12.
RECOMMENDATION
Staff is recommending approval of the applicant's request to rezone the property at 7381 Peltier
Circle from R-I to R-2. Based on Staff review of the proposed site plan, contingent upon review
by the City Engineer and the inclusion of revisions and conditions for approval as suggested by
the aforementioned list of issues, Staff is also recommending approval of the proposed
preliminary plat.

CENTERVILLE SELF STORAGE DEVELOPMENT
Preliminary Concept Review
Who, What, Where, When, Why and WHAT's IT GOING TO LOOK LIKE:
WHO: Thomas Keller, resident of White Bear Lake, MN, utility and general contractor by
profession and Henry Votel, resident Forest Lake, MN, real estate broker and developer
by profession together will be developer, owners and operators of this Self Storage
development. Keller's construction background is in utilities and commercial building
construction. Votel's real estate experience is in the brokering, operation and development
of lodging facilities, self storage facilities and residential land developments.
WHAT: A newly constructed 500-600 unit self storage facility in the City of Centerville,
MN. The facility will offer individual storage units to residents in the area and businesses that
need secured units. Most of the facility units will be cold storage type units; however a
small percentage will likely be climate controlled units. The facility will meet all City
construction code requirements for concrete exterior walls, paved surfaces, lighting, etc. No
building setback variances will be requested. The developers have some questions and
issues relative to the City code requirements that all the buildings be sprinkled units and will
raise some discussion about this requirement during the approval process. Other local
governing units have considerations/applications under way relative to the wetland issues,
property platting, etc. All permits for development are expected to be received before
any construction will start. It is expected that the development will be constructed in two
building phases.
WHERE: See attached maps and drawings. Located on a 4 acre parcel of land in
property owned and under development by R & R Leasing on Fairview Street in the
Southeast quadrant of the City. The land is zoned 1-1 and can be developed to this use
under special use permit requirements from the City.
City services are in Fairview Street and the street pavement issue is under City control.
The development will not require any additional city services. No subsidies will be
requested from the City for this development.
WHEN: The developers have been pursuing development issues since a purchase was
agreed with R & R Leasing in August and are in their middle planning stages at this point in
time. Earlier the developers met with City staff, private contractors and private engineering
consultants.
The developers have requested a Preliminary Concept Review by the City Planning
Commission and Council for commentary and suggestions about any City concerns before
advanced designs and drawings are prepared. The developers will be moving forward as
quickly as practical and would like to start construction in Spring 2003 with the facility opening
for business in early Summer 2003.
WHY: Self Storage facilities are proven businesses opportunities and investments since
their refined inception about 20 years ago. They offer mostly community residents a

location to securely store all types of possessions that suffer if exposed to weather,
elements or unsecured locations. They offer a place to store excess personal possessions
that are too much for their residential spaces or just plain temporary storage. Self storage
facilities also offer and provide businesses storage for items that must be retained,
inventoried or kept in a secure location until used. They will otten be used by businesses
that are small local proprietorships whose vehicles require large buildings than most homes
offer.
Most self storage facilities serve a customer base that is within a 5 mile radius of their
location. The typical customer is a area resident and the average length of storage runs 6
months to several years. Customers of such facilities expect a secure, properly operated
and easily accessed facility. Self storage facilities are otten an enhancement to area
residents who desire a clean and orderly community.
Self storage facilities are not an excessive user of city utilities, administration, police or fire
services and cause no burden on the local government, schools and residential tax payers.
Some local employment is generated because such facilities are open usually six days a
week; otten staffed and maintained by area residents who want a job in the community and
the facility is also a user of services from local businesses.
WHAT's IT GOING TO LOOK LIKE: The developers envision a very nice self
storage facility that will not detract from other buildings in this industrial park area of the city as
it develops The facility will be a city business and operated by the developers who desire
a neat, clean and tidy facility for their investment.
Attached is a concept site plan and some building samples. Our plan submitted herein is
not a final design and the building configuration many change. We have attached some
pictures of similar buildings to help the Planning Commission and City Council understand
our vision for the final product. The layout of the buildings and the internal unit configuration
will, be refined as we proceed and change is expected.
Several mandates are stipulated by City code and we will work to plan attractive buildings
with decorative concrete block work, colored metal standing seam roofing, possibly some
brick work at the entry areas, wrought iron fencing at the front of the facility, asphalt paved
drives and lanes, attractively landscaped perimeter areas, non obtrusive lighting, attractive
signage, etc. will all be planned for special use permit requirements.
