SUBJECT: Mr. & Mrs. Gary Schmidt, 7071 Cottonwood Court
DATE: July 31, 2003
Mr. & Mrs. Schmidt desire to replace their current entrance area to their home by
constructing a larger landing-entry area. Mr. & Mrs. Schmidt desire to encroach into the
front yard setback requirement of 35' .
Mr. & Mrs. Schmidt were directed by staff to attend the Planning and Zoning
Commission meeting with their proposal. Mr. & Mrs. Schmidt have been advised that
encroaching into the front yard setback would require receiving a variance from the City.
I have attached those sections of Ordinance #4 that pertain to the desired construction and
the Schmidt's received a copy too.

Street Line - The legal line of demarcation between a street and abutting land.
Structural Alteration - Any change in the supporting members of a building or structure, such as
bearing walls, columns, beams, or girders; provided, however, the application of any exterior siding to an
existing building for the purpose of beautifying and modernizing shall not be considered a structural
alteration.
Subdivision - The separation of an area, parcel or tract of land under single ownership into two or more
parcels, tracts, lots, or long-term leasehold interests where the creation of the leasehold interest,
necessitates the creation of streets, roads, or alleys, for residential, commercial, industrial, or other uses
or any combination thereof, except those separations:
A. Where all the resulting parcels, tracts, lots, or interests will be twenty (20) acres or
larger in size and five hundred (SOD) feet in width for residential uses and five (5)
acres or larger in size for commercial and industrial uses; and
B. Creating cemetery lots; and
C. Resulting from court orders, or the adjustment of a lot line by the relocation of a
common boundary. The purpose or activity for which the land or building thereon is
designed, arranged, or intended, or for which it is occupied or maintained and shall
include any manner of performance of such activity with respect to the performance
standards of this ordinance.
Supply Yard - A commercial establishment storing or offering for sale building supplies, steel supplies,
coal, heavy equipment, feed and grain, and similar goods. Supply yards do not include the wrecking,
salvaging, dismantling or storage of automobiles and similar vehicles.
Townhouse - Single-family, attached units in structures housing three or more continuous dwelling
units, sharing a common wall, each having separate and individual front and rear entrances; the
structures being as of a row house type as distinguished from multiple dwelling apartment buildings.
Travel Trailers - A mobile vehicle with wheels, designed for overnight living or camping purposes,
capable of being towed by a motor vehicle.
Use, Pennitted - A use that is permitted in the district under which it is listed.
Usable Open Space - A ground area on a lot, which is graded, developed, landscaped or equipped or
intended and maintained for recreation or leisure, available to and useable by persons occupying a
dwelling unit and their guests.

Section 110-020: Excess Height on a Permit. Upon the securing of a Special Use Pennit any building
may be erected to a height exceeding that specified for the respective district providing:

A. The front, rear and side yards shall be increased one (1) foot for each one (1) foot
by which the building exceeds the height limit established for such district; and
B. The structure is any of the following: television and radio towers, church spires,
belfries, monuments, tanks, water and fire towers, grain elevators, stage towers and
scenery lofts, cooling towers, ornamental towers and spires, chimneys, elevator
bulkheads, smokestacks, conveyors, flagpoles, silos, and air conditioning and
heating units; and
C. No tower, gable, spire, or similar structure shall be used for sleeping or eating
quarters, or for any commercial purpose except one (1) incidental to the permitted
uses of the main building.

Section 115-030: Erection of More than One Principal Structure on Lot. In any district, more than
one structure housing a conforming principal use may be erected on a single lot if yard and other
requirements of this ordinance are met for each structure as though it were on an individual lot.
Required on-site parking space shall be provided on the same lot as the principal building or use, except
that combined or joint parking facilities may be provided for two (2) or more buildings or uses in
commercial districts and in industrial districts, provided that the total number of spaces is not less than
the sum of the requirements for each building or use. The proposed joint parking space shall be within
four hundred (400) feet of the entrance of the use it will serve. A properly drawn legal instrument,
approved by the City, executed by the parties concerned, for joint use of the off-street parking facilities
shall be filed with the County Recorder's office.
Division 120: Performance Standards
Every use permitted by this ordinance shall be so established and maintained as to comply with the
provisions of this section. The Council may require the owner or operator of a use permitted by this
ordinance to provide such tests or investigations by an independent testing organization satisfactory to
the Council as are necessary to show compliance with these standards. The cost of such investigation
and tests shall be shared equally by the owner or operator and the City unless the results disclose non-
compliance with these standards; in that event, the entire cost shall be borne by the owner or operator.
This provision does not preclude the City from making any investigations and tests it finds appropriate to
determine compliance with lhese standards.

Mr. Kilian originally requested to construct an accessory structure exceeding the
allowable 704 square feet. Mr. Kilian has now decided to construct two (2) accessory
structures, one (1) being 22' x2'1' and one (1) being 18' x 22'. Mr. Kilian has completed
the proper documentation for buming permits and Rice Creek approval is not necessary,
copy attached.
I have attached those sections of Ordinance #4 that pertain to the construction of these
buildings.
The Commission may also desire to combine this language with language contained in
Division 70: Site Plan Review Required, copies attached. It is believed that site plans
should require a public hearing before the Planning and Zoning Commission and
recommendations for same then being forwarded to Council for consideration. This
suggestion may be address if the Commission desire to re-write or make amendments to
the current ordinance.

Purpose
It is intended that the P-1 District provide opportunities for government facilities, schools, churches,
hospitals, libraries and other similar public and institutional uses.

require Site Plan approval by the Planning and Zoning Commission. Factors to be considered for such a
use conversion include, but are not limited to, compatibility with adjacent land uses, structural
appearance, structural adaptability, investment relationship, term or length of conversion (interim or
permanent) and consistency with any land use plans prepared by the City for the Mixed Use District.
The architectural design and exteriOr bUilding materiafs used in COl'1neCtIon with any new or expanded
use or structure shall be consistent with any architectural design or aesthetic control requirements
established by the City for the Mixed Use District.
In new residential subdivisions In M-1, R-2A, R-2, R-3 and R-4R$Sidential Zoning DiStritts, structures
may be arranged to include one (1) zero lot line provided that no windows or doors open on this side of
the structure. The appropriate setbacks apply.
Division 90: Commercial ~erior Buildina Materials
Except; as otherwise regulated herein, the exterior wall surfaces of all new or expanded commercial
buildings shall consist of face brick, finished block or other textured masonry product approved by the
Planning and Zoning Commission. Exceptions to all masonry exteriors may be considered and approved
by the Planning and Zoning Commission provided the following findings are met:
A. The combination of exterior materials is used as an architectural compliment to the
structure.
B. The combination of exterior materials used is not inconsistent with the quality and
appearance used on similar buildings in the same zoning district or neighborhood.
C. Site conditions limit public exposure to certain exterior surfaces where masonry
products are not proposed.
D. An exterior wall may be temporary and a future expansion area of a structure and
be subject to removal or redesign as an interior wall.
Buildings are required to have contrasting architectural features and must be designed to be
aesthetically pleasing.
Division 95: Industrial Exterior Buildina Materials
Industrial buildings are required to be constructed of brick, decorative block or approved textured
masonry product. Pole bam type buildings are not allowed. Buildings are required to have contrasting
architectural features and must be designed to be aesthetically pleasing.

exceed the size requirements for accessory structures, but they can not exceed fifty (50) percent of the
rear yard.

Commercial uses (as defined by Ordinance #4) in the M-1 District will follow the Commercial guidelines
for percentage of green space. For all other properties in the M-1 District, the maximum accessory
structure allowed is 704 square feet and 440 square feet in the R-4 District, neither to exceed the size of
the principal structure if an attached garage does not exist. If an attached garage exists, the maximum
accessory structure allowed is two (2) percent of the lot size or a maximum of 200 square feet.

Division 75: Final Gradina and LandscaDina
Lots in all districts shall be subject to the following:
Subd.1
No Occupancy Permit shall be issued until the lot upon which the structure is
constructed is brought to finished grade as specified, except during
inclement weather an escrow shall be deposited with the City as approved in
the fee schedule; and
Subd.2
Within six (6) months from the issuance of the Occupancy Permit the lot
shall be landscaped in a manner, which prevents erosion due to wind or
water. Extensions may be granted at the Building Official's discretion.
Division 80: Zonina Districts/Use Reaulations
Section 080-010: Zoning Map. A map entitled "Centerville Zoning Map" is hereby adopted by
reference and declared to be part of this Ordinance as the Official Zoning Map.
Such map shall be on permanent file and available for public inspection in the City Hall. It shall be the
responsibility of the City Clerk to maintain and keep the map up to date and to record each amendment
thereto within thirty (30) days after official publication of the ordinance adopting the amendment.
Section 080-020: Interpretation of the Zoning Map. Where due to the scale, lack of detail or
illegibility of the Zoning Map attached hereto, there is an uncertainty, contradiction or conflict as to the
intended location of any zoning district boundary as shown thereon, the Zoning Administrator shall make
an interpretation of the map upon the request of any person. Any person aggrieved by any such
interpretation may appeal such interpretation to the Board of Appeals and Adjustments. The Board of
Appeals and Adjustments, in interpreting the Zoning Map or deciding any appeal, shall apply to the
following standards:

NOTICE IS HEREBY GIVEN, that the City Council of the City of Centerville will
consider Ground Development's request to advance the development staging/MUSA
from 2006 - 2010 to 2001 - 2005 and final plat associated with the proposed Pheasant
Marsh Phase III Subdivision (Outlot B, Pheasant Marsh 2nd Addition - 14.91 + Acres).
The meeting will be held on Wednesday, August 13, 2003 commencing at 6:30 p.m. or
shortly thereafter. The meeting will be held in Council Chambers at City Hall, 1880
Main Street.

Attached, please find two (2) internal complaint forms, letters to resident in non-
compliance, information received from the City of Lino Lakes and a response letter from
Mr. & Mrs. Lawrence Perron, 1798 Main Street.
Attached, please find eight (8) internal complaint forms, seven (7) letters to residents in
non-compliance, one (1) issuance of a correction notice and two (2) response letters. One
(1) from Mr. Dave Brown, 1755 Meadow Lane and one (1) from Ms. Rhona Hubbell,
1735 Meadow Lane with a return response from staff.
Also attached, you will find those sections of Ordinance #4 that pertain to these issues.
Recently, another resident received a letter in regards to outside storage of an enclosed
trailer that had been parked 1f2 on his driveway and 1f2 in the front yard and also exceeded
the 35' limit. (See Attached)
The Commission may desire to discuss the possibility of amending portions of the
Ordinance. Staff would be open to restructuring the Ordinance for more adequate
interpretation and would like an opportunity to explore other communities' ordinances to
assist in the process. Staff would take into consideration the individuality of Centerville.
As you may also be aware staff has recently encountered several residents that either
desire to construction accessory structures larger than currently allowable or to impede in .

Dear Mr. Perron:
On June 3, 2003 you were issued a Correction Notice in regards to a temporary, tent-like
structure for outside storage. These temporary tent-like structures are a violation of
Ordinance #4 and a placement violation of the Building Code. Enclosed for your
reference are those portions of Ordinance #4 that pertain to the current violations. The
Correction Notice requested that you abate this violation within ten (10) days from the
date of issuance. To date, the structure remains in place.
The City again is requesting that you abate this violation within thirty (30) days of receipt
of this certified mailing (July 22, 2003).
You do have the ability to appeal this decision within the (30) thirty day period, please
feel free to contact the City Clerk, Ms. Teresa Bender or City Administrator, Ms. Kim
Moore-Sykes to discuss this issue if you desire to appear before City Council to appeal

Dear Kim,
I received a letter from the City of Centerville concerning what someone thought was an
accessory building behind my garage. This is a licensed ice house which is used on
occasion at larger gatherings when fishing far away lakes. The only ordinance relating to
this that I can find is Page 38 and 39 of Ordinance #4, which I have inserted.
Section 130-140: Outside Storage. All products, materials and equipment,
except as specifically provided in this Ordinance, shall be stored within permitted
structures, except for the following:
Residential Districts and Dwellings in the M-1 Districts:
A. Agricultural products, equipment and appurtenances owned by the owner of
the property and used on the property on which they are kept; and
8. All licensed and operational motor vehicles shall be parked on the permitted
driveway area. Any non-licensed, non-operational vehicles must be stored in an
enclosed structure; and
C. A maximum of two (2) of the following units may be stored outside of a
structure for more than forty-eight (48) hours on any residential parcel provided
they are stored on the permitted driveway area outside of the road right-of-way
or are in a side or rear yard. A licensed motor home or fifth wheel trailer is
allowed in a side or rear yard.

8. Small construction equipment
None of the above mentioned items may have an overall length from front to
back in excess of thirty-five feet (35').

ornaments and monuments; and
E. Temporary storage of materials and equipment during construction and
landscaping.
F. Lakeshore properties can store the following items of personal property within
50' of the shoreline during the months from September to May: docks, boat lifts,
swim rafts, slides, and other swimming equipment.

Mr. Smyser advised that a number of residents are constructing temporary fabric
structures, primarily for storage of vehicles. This is a relatively new product that
typically consists of aluminum poles with plastic fabric stretched over the poles. He
presented the staff report and explained that staff is bringing the issue to the Planning &
Zoning Board for discussion to if see staff should pursue adding language to the Zoning
Ordinance to address this type of structure.
Chair Schaps stated the very nature of these structures is temporary.
Mr. Tralle suggested the structures not be allowed in the front yard or visible from the
front street.
Mr. Rafferty stated neighbors do not have an interest in looking at something like this and
it causes rifts in neighborhoods. The people that put these up do not protect the rights of
the individuals that live next to them. This relates to aesthetics and the City should step
forward.
Mr. Lyden commented residents can be fiercely independent, whether it concerns the
wrecked vehicle or the garbage ordinance. This will be a 'slippery slope' and he
questions where they will end if they start here. He noted some people may not want to
allow something like trampolines. He agrees with a requirement for the structures to
meet setbacks and the City has brought this on by allowing houses to be built on such
small lots.
Ms. Lane suggested the structures be restricted from visibility from the street, with a
placement restriction in the back yard so side neighbors do not have to view them.
Mr. Corson suggested as a minimum the structures should be well maintained.
Mr. Hyden indicated he agrees in allowing the structures for temporary use. If they are
used for storage the property owner should obtain an accessory structure permit.
Chair SChaPS stated this should be recognized as a temporary structure, which can be
allowed with a permit for a time period of several months. It would not be wise to put
these structures up in the winter due to possible damage by snow.
Mr. Smyser explained this issue has not been discussed by the City CounciL There has
not been any enforcement action on these structures. When residents have inquired what
is allowed with the structures staffhas informed them they must meet setbacks and
accessory square footage requirements on the lot. There is nothing in the ordinance,
however, that states that. Many of the structures have been put up without notifYing the
City. He advised if something is done from a regulatory standpoint the zoning ordinance

few years ago they questioned if they would be a safety hazard due to the possibility of
them being crushed by snow. Most of the structures, however, are to cover things such as
boats. Staff did not believe there would be safety issues from that standpoint.
Chair Schaps suggested there be an exception to the permit requirement for a situation
such as a party, as the structure would only be needed for a day or two. He directed staff
to bring the suggestions of the Commission to the Council for discussion.
Mr. Tralle commented not all of these structures are cheap. There are some structures
that can house four rv's at a cost of $6,000.
Chair Schaps inquired if a structure of that size would fall under the accessory structure
ordinance. Mr. Smyser responded it is very common in situations like this for the
manufacturer to say a permit is not required. That, however, is up to the individual
municipality.
Mr. Tralle asked how a large structure like this would fit into a rural zone. Mr. Smyser
responded currently the amount of allowed accessory building space is dependent on the
size of the lot, and the temporary structures could be included in this.
Mr. Tra1le questioned if passing an ordinance in relation to these structures would create
another ordinance that is not going to be enforced.
Mr. Lyden asked how many inquiries or complaints staff receives regarding these
structures in a one year period. Mr. Smyser responded in the last 12 months staffhas
been contacted regarding this approximately 12 times, with two or three of these being
complaints. They are not peppered with complaints, but by the time we are, there would
already be a problem. He indicated staff will discuss the suggestions of the Commission
and bring back the possibilities to be considered. They may not even want to deal with it,
but he thinks it is important to have the discussion.

Thanks for responding so quickly! I do plan to pursue an ordinance change. As advised by Mayor Sweeny I intend
to take this matter to the Planning and Zoning committee. After talking to Ray Devine, a P & Z committee member
he said I should ask you to have me placed on the next P & Z agenda. Before I present my issue to this
committee I would like you to provide me with a list of names of other residents that have also been severed
notice of this violation. Based on my observation of pools similar to mine throughout Centerville this list should be
lengthy. I would also like to know the name of the person who reported my violation of this ordinance to the city. I
believe I'm entitled to this information since it is a matter of public record.
I'm assuming this violation was reported by another Centerville citizen. I would hope that a city employee would
have more important matters to tend to than to harass the citizens of Centreville regarding violations of this
matter. If it was an employee then I hope they intend to address ALL violations that are present throughout the
city of Centerville. I have contacted all of my close neighbors who have swimming pools similar to mine and none
of them have been served notification as of yesterday.

Thank you for your comments regarding the City's ordinance on swimming pools. While it may seem that
your pool was singled out, Staff sent several certified letters to property owners throughout Centerville
regarding ordinance issues with their pools. If you would like to voice your concerns to the City Council,
you would be welcomed to do so. Council meetings are held regularly on the second and fourth
Wednesday evenings at 6:30 p.m. and they are open to the public. The easiest way to get to speak to
the Council is to let me know when you can appear before the Council and I can put you on the agenda
under Appearances. Otherwise, you can just show up. If you do just show up, please let me know so

My name is David Brown and I reside at 1755 Meadow Lane.
I am writing this emai! to you in regards to a certified letter I received from Teresa Bender
regarding the swimming pool I have in my back yard located on 1755 Meadow Lane. Teresa's
letter is a notice requiring me to take down the pool, drain it to an acceptable level or build a fence
around the pool. My son and I have enjoyed using the pool this year and last on hot summer days,
but I cannot afford to build a fence around it that would probably cost thousands of dollars. I only
paid $125.00 for this pool! I'd like to know when this ordinance was written and suggest that
perhaps the ordinance be re-written because the type of pool I have is of newer technology that
may not have existed when this ordinance went into effect. I'm also concerned because pools very
similar to mine are common throughout Centerville as well as other neighboring communities. In
fact if I were to look out the front and back of my house I can see 4 other pools that would not meet
the requirements of the ordinance. In fact there is a pool in the back yard of a house located on
Center Street that has been up for the last 4 years, which is where I got the idea from to buy the
pool in the first place. Why do I not see fences around this, or any of the other pools visible to me
throughout Centerville? The letter I received from Teresa states that '1he cfty has noticed that you
have a pool located on my property". Why am I being singled out and not others in my community?
I would also like to voice my opinion regarding pool safety, which Teresa also did in her letter
addressed to me. The pool I have in my backyard has a latter used for climbing in and out of the
pool with and also has a cover that was included in the pool kit. Without the latter it is difficult, If not
impossible for a child to get in and out of when the pool is not in use. I store the latter in my garage
when the pool is not being used. I see several pools in our community that are below the water
depth level as required by this ordinance that put smaller children at a much higher risk because it
would be much easier for a child to fall into, which is another reason to re-address this ordinance. I
agree with Teresa's concerns regarding the danger swimming pools may pose to children in my
neighborhood, which is why i aiways remove the latter from pool when it is not in use. I also know
that I cannot control that my neighbors children may enter my yard, but nor can the yards that have
pools period.
Please let me know how I can voice my concerns to the Centerville city council and ask that
changes be made to this ordinance, or I suggest you contact all of the other citizens in Centerville
that also violate this ordinance.

The City has noticed that you have a pool located on your property at 1735 Meadow
Lane. The City would like to inform you that there is an Ordinance in effect that requires
that the pool is enclosed by a permanent wall or fence not less than six (6) feet in height
with a self-closing door and self-closing latch. It appears that you may be in violation of
the City's Ordinance #4. I have enclosed a copy of Section 100-040 pertaining to
Swimming Pool Fencing for your reference.
The City would like to remind you that swimming pools pose a danger to children, both
your own and neighborhood children. The City has chosen to take a proactive approach
to detening potential pole related accidents by containing the above stated language in
the City's Ordinance. The City hopes that residents that chose to install pools on their
. property give consideration to safety, location, accessibility and dangers that owners of
swimming pools are exposed to. The City does understand that su=er-time activities
are fun, but they should be safe for alL
The City requests that you either limit the amount of water contained in your pool to the
required level (depth not exceeding twenty-four (24) inches) or properly enclose it.
Please contact myself or City Administrator, Ms. Kim Moore-Sykes at (651) 429-3232
with any questions or comments you may have. We expect this situation to be remedied

All residential, commercial, industrial, public, institutional or other uses, which include plumbing facilities,
shall be connected to the public sewer and water system when available. See Ordinance #'s 30 & 45.
Division 60: Relocated Buildinas or Structures
No existing building or structure may be relocated anywhere in the City without a permit. A permit for
the relocation of any building or structure may not be issued without site plan approval by the Planning
and Zoning Commission with approval in accordance with Ordinance #8. The Planning and Zoning
Commission shall not approve a site plan without certifying the following:
A. The building or structure is compatible in appearance, age and character with
existing buildings and structures in the area; and
B. The building or structure meets all code requirements for new buildings or
structures; and
C. The building or structure is compatible with any other buildings or structures
existing on the same property; and
D. The building or structure meets all other requirements of this Ordinance and any
other City ordinances; and
Q!vision 65: Accessory Structures and Uses
No more than two (2) accessory structures are permitted on any Single-family, detached dwelling parcel
located in any district except R-1. Combined aggregate square footage for accessory structures may not
exceed two hundred (200) square feet or two percent (2%) of the lot area whichever is greater, except in
the M-1 and R-4 District. No accessory structure may be constructed on a parcel without a principal
structure. Accessory structures must have a minimum of a five (5) foot side setback and a ten (10) foot
rear setback, except in the M-1 District where the building code governs the setbacks. No structure may
be placed in an easement.
In case an accessory structure is attached to the main building, it shall be made structurally a part of the
main building and shall comply in all respects with the requirements of this Ordinance applicable to the
main building. An accessory building, unless attached to and made a part of the main building, shall not
be closer than six (6) feet to the main building, except as otherwise provided in this section. The side
walls of an accessory building may not exceed ten (10) feet in height. The total area of an attached

Division 100: Fences
A. All fences shall be located entirely upon the property of the fence owner unless the
owner of the adjoining property agrees, in writing that said fence may be erected on
the property line of the respective properties. Such an agreement shall be
submitted at the time of building permit application. If the adjoining property owner
does not agree to the erection of such fence, the fence shall be set back a minimum
of two (2) feet from all lot lines. No fence other than a decorative fence may be
constructed along the side lot lines of a residential lot between the street and the
front extension of the dwelling house. As used herein, the term "decorative fence"
means a wood vertical post and wood horizontal rail fence with no more than three
(3) rails or a wood picket type fence with at least two (2) inches of open space
between each picket.
B. No residential fence may exceed six (6) feet in height and no decorative fence in
the front yard may exceed thirty-six (36) inches in height. Fencing in
commercial/industrial zoning shall not exceed eight (8) feet in height.
C. All fences shall be constructed and maintained in a substantial, workmanlike
manner and of material reasonably suited for the purpose for which the fence is
proposed to be used. Every fence shall be constructed so that the side containing
the framing supports and cross pieces face the interior of the fence owner's lot.
Any fence which does not comply with the provisions of this Section or which
endangers the public safety, health or welfare shall be considered a public
nuisance.
Section 100-010: Snow-Stop Fencing. Snow-stop fencing may be used from November 1 to April 1.
No permit shall be required for temporary fencing.
Section 100-020: Electric and Barbed Wire Fence. Electric fences, hog wire fencing, barbed wire
fencing, and similar fencing will not be allowed except in the R-1 District.
Section 100-030: Visual Obstructions. No fence may be erected which creates visual obstructions at
any intersection, alley, driveway or street for safe vehicular, bicycle or pedestrian movement.

Section 130-080: Fire Hazards. Any activity involving the use or storage of flammable or explosive
materials shall be protected by adequate fire-fighting and fire prevention equipment and by such safety
devices as are normally used in the handling of such materials. Such hazards shall be kept removed
from adjacent activities to a distance which is compatible with the potential danger involved.
Section 130-090: Air Pollution. Every activity shall conform to state regulations relating to air quality
standards and air pollution control.
Section 130-100: Radioactivity or Electrical Disturbance. No activity shall emit dangerous
radioactivity at any point or any electrical disturbance adversely affecting the operation of any equipment
at any point other than that of the creator of such disturbance.
Section 130-110: Explosives. Any activity or operation requiring the use, storage or manufacturing of
explosives shall be located no closer than five hundred (500) feet from any residence, provided further
that the location of said activity or operation is such that damage from explosion, including flying debris,
vibration or smoke, is limited to the site on which the activity or operation is permitted.
Section 130-120: Burning. No person shall start or allow any open buming on any property in the City
without first having obtained an Open Bum Permit. Any person setting a fire or buming anything in the
City shall do so following City Fire Department, Department of Natural Resources and Minnesota
Pollution Control Agency Rules. Recreational fires three (3) feet x three (3) feet are allowed.
Recreational fires must be actively attended by a responsible adult. When the fire is abandoned it must
be completely extinguished.
Section 130-130: Bulk Storage. The storage of all bulk liquids, fuels, chemicals, and gases shall be in
compliance with and regulated by Minnesota Pollution Control Agency Rules, Minnesota State Fire
Marshal rules and the Minnesota State Building Code.

Storage of products, materials and equipment, excluding rubbish or junk, which is necessary to an
approved business operation in a Commercial or Industrial District, and which is completely screened
from adjoining properties and rights-of-way. The Site Plan Review process is required to determine the
appropriateness for storage permitted in this Section, surfacing required for the slorage area and the
screening required. The Site Plan Review process requires a hearing before the Planning and Zoning
Committee and the City Council. Outside display of vehicles, equipment and merchandise for direct sale
to consumers when such outside display is customary and necessary to the trade and is a permitted use
within the zoning district. The Site Plan Review process is required to determine the appropriateness of
the storage or display proposed, surfacing required for the display area and any additional landscaping
or screening which may be required.

Urban Runoff Program (NURP) standards for the design of new storm water ponds and the Minnesota

Mr. Kellier indicated that Sedona Homes is constructing townhomes in Hugo. He then
said that they attempted to respect all City requirements and setbacks but noted they
intend to seek a variance from the required 15 parking stalls to 7 stalls.
Chair Hanson indicated that vinyl siding is not allowed for commercial developments in
the City and then reviewed for Mr. Kellier the types of outside building materials
allowed. He also questioned whether the two story townhomes would meet ADA
requirements.
Mr. Kellier indicated they would review the City requirements for outside materials and
indicated he has been working on the ADA requirements and will be sure that those are
met.
Chair Hanson asked what types of businesses would be typical for these types of
buildings.
Mr. Kellier indicated that mortgage companies, attorneys and real estate companies are
the typical users.
Mr. Kellier indicated that it may make for nicer flow on the site if they were allowed two
entrances.
Commissioner Wilharber asked who had detennined that only one entrance would be
allowed.
Mr. Kellier indicated his surveyor told them that only one entrance would be allowed
after reviewing the ordinances.
Commissioner Wilharber indicated that he would like to look into the entrance
requirement further as it would seem that two entrances would be safer. He then said the
concept seems good but he would like two entrances.
Mr. Palzer indicated it is a County requirement and recommended that Mr.. Kellier
contact the County to discuss it. He also indicated that a wider entrance with a median
dividing it could be used.
Commissioner Wilharber indicated he had no issue with recommending approval to the
City Council provided the entrances and the outside building materials are addressed.
Commissioner Wilharber asked if it was advantageous to build them separately. Mr.
Kellier indicated that it allows for windows on three sides and that makes a more
desirable office space.
Commissioner Wilharber asked what the distance would be between buildings. Mr.
Palzer indicated it appeared to be about 20 feet. He then commented that individually
owned units would be preferable to rented units.

Mr. Kellier asked if there was a concept plan for the development of 20th Avenue. The
Commission explained the proposals for 20th Avenue and read from the Ordinance the list
of allowed uses for commercial and industrial zoning.
Mr. Kellier asked if there was a plan to widen 20lb Avenue. Mr. Palzer indicated that
there were discussions at the County level concerning widening 20th Avenue and
recommended that Mr. Kellier contact the County to discuss it.
Mr. Kellier asked if he could present his plan to Council. The Commission
recommended that he contact Ms. Moore-Sykes to discuss the matter.
Mr. Pajzer asked what type of signage was proposed. Mr. Kellier indicated there would
be onOiign listing the property address and the businesses located there and each business
would have a sign on their building. He then said that he would be requiring that the
signs be uniform.
The Commission recommended that Mr. Kellier obtain a copy of the sign ordinance for
reVlew.
IV. OLD BUSINESS

V. NEW BUSINESS
1. Mr. Dave Kilian - 1695 Sorel Street Site Plan Review
Mr. Kilian presented his plan for constructing a detached garage on his property. He then
indicated that he had applied for a variance three years ago that was never acted upon and
he could have built the garage as it was approved by non-action of the City. Since then
he has been told that the ordinance was amended and any previous approvals, even if by
non-action are null and void.
Mr. Kilian addressed all the issues listed in the Staff report and indicated he could meet
all of them with the exception of the square footage requirement which he says should
have been removed from the Ordinance because that is why he was asked to wait until the
Ordinance was amended when he applied for the variance last time. He then read
language from the Ordinance that he feels supports his right for a structure larger than
704 square feet.
Mr. Palzer indicated that the Ordinance specifically indicates that the maximum size
allowed in an M-1 district is 704 square feet.

Mr. Kilian asked why he was not told of that requirement when he spoke to Mr. Palzer
concerning the proposal. Mr. Palzer indicated that he had specifically indicated to Mr.
Kilian that the maximum size allowed is 704 square feet without a variance.
Mr. Kilian indicated he had discussed his proposal with Ms. Moore-Sykes and Ms.
Bender and was told that he should be fme but then found out through receiving the
packet the issues she had outlined in the Staff report.
Mr. Palzer suggested that Mr. Kilian discuss the square footage requirement with Ms.
Moore-Sykes and indicated that he would need to apply for a variance unless he wished
to build a 704 square foot structure.
Mr. Kilian indicated that 704 square feet did not suit his purposes and said that is why he
had applied for the variance three years ago and was told to wait until the Ordinance was
amended and he thought that the 704 was going to be removed from the Ordinance to
allow for larger structures in the M-l district. He further commented that he could have
built his garage because it was approved by inaction.
Mr. Palzer indicated that once the Ordinance was rewritten whatever was approved by
inaction was nullified.
Commissioner Wilharber asked if Mr. Kilian was willing to pay the $175.00 and apply
for the variance if that is required. Mr. Kilian indicated he would pay the fee if he knew
for sure that his variance would be approved.
Commissioner Wilharber indicated he does not have an issue with approving the request
whether or not it requires a variance. He then said that a City's planning is never perfect
and that is why variances are available. He further commented that he feels the City
should encourage residents to make improvements to their property rather than
discouraging them by denying variances for good projects that would improve the
property and increase taxes for the City.
Commissioner Klennert Hunt indicated she understood the reasoning behind caution
when granting variances but said this property is different in that is in the M-l district

Chair Hanson indicated he would like Staff to look into the legal issues concerning the
previously applied for variance and whether the City has a responsibility to Mr. Kilian to
approve this request due to how things were previously handled. He further clarified that
he would like to know whose responsibility it was to bring the variance off the table, the
City's or Mr. Kilian's responsibility.
Chair Hanson indicated he would like to know what is the right course of action.
Whether Mr. Kilian has to apply for a new variance or if the previous variance request
should be pulled off the table and acted upon.

Mr. Kilian indicated that Ms. Bender told him that he would have had 12 months to act
upon the variance that was approved by inaction but, since that was not done, the
approval is void.
Kilian then asked whether he would have to wait for the next Planning Commission
meeting for a public hearing on the variance and then for Council approval which means
it would be two or three months before he would obtain approval.
Mr. Palzer indicated that Mr. Kilian could discuss that matter with Ms. Moore-Sykes. He
then said that it may be possible to hold the public hearing at the Council level to
expedite the process.
Commissioner Wilharber commented that he hopes this City has not gotten so big that it
has lost sight of common sense. Mr. Kilian paid the fee for the variance once and the
City did not act upon it. He then said that it is sad when the City has to depend upon
attorneys for everything when years ago a handshake was all that was required.
Motion bv Commissioner Wilharber. seconded bv Commissioner Lakso to
recommend to Council approval of the site plan for 1695 Sorel Street with a five foot
separation from the propertY line. no zero lot lines. no occupancv of tbe structure
and approval from Rice Creek Watersbed District. Aves - 4. Navs - O. Abstain -
HKilian). Motion carried.
Mr. Palzer indicated that he did not think this would make it past Ms. Moore-Sykes to the
Council agenda because a variance application is required.
Mr. Kilian indicated he would contact Ms. Moore-Sykes to discuss why he was not given
the information presented in the packet when he brought in the application and discussed
the plan with her.

Commissioner Wilharber indicated the County had become involved in the City's
vacation of Goiffan{ Road and said the church intended to widen it and provide angled
parking on both sides. He then indicated that the church is still discussing its plans for
whether to add onto the existing church or rebuild it. He also asked for any ideas people
had for celebrating the church's I 50th anniversary.
