The meeting was called to order at 6:30 p.m.

1. Snowmobile Ordinance
Commissioner Wilharber thanked Staff for the new procedure of redlining changes and
said it helps a great deal with reviewing the ordinances.
Commissioner Lakso pointed out that the numbering was incorrect on the first page. She
then asked whether page 2 should state unless the snowmobile is reported stolen. Ms.
Moore-Sykes indicated she would consult the City Attorney.
Commissioner Lakso asked whether the wording under Section 5 needed to be repeated.

Commissioner K1ennert Hunt indicated she felt the information should stay under traffic
yielding not under defmitions. Ms. Moore-Sykes suggested indenting the section under
Section 5 and leaving it in as it is important language that warrants repeating.
Council Liaison Broussard Vickers asked whether the language making the owner of the
snowmobile responsible for violating the ordinance not just the operator.
The Commission requested that under section three restrictions a number 12 be added to
hold the owner accountable for any violations with their machine.
Motion bv Commissioner DeVine, seconded by Commissioner Wilharber to
recommend to Council approval of Ordinauce 17A with the amendments. All in
fayor. Motion carried unanimously.
2. GarbageIRubbish Ordinance
Commissioner K1ennert Hunt indicated that independent contractor should be replaced
with a person authorized by the City to perform collections on the first page.
Council Liaison Broussard Vickers asked whether the City needed to designate a disposal
location in Anoka County or if the language could be more generic to allow for changes
in requirements that would not require amending the ordinance.
Commissioner K1ennert Hunt suggested using the language at the Anoka County
designated facility as the state delegates the authority to the County. She then asked that
after must maintain receipts Anoka County be removed.
Commissioner K1ennert Hunt questioned whether the City really wanted to prohibit
residents from putting their garbage out the night before pickup.
Discussion ensued and the Commission agreed to add language to allow residents to put
their garbage cans out no sooner than 12 hours prior to pickup.
The Commission discussed the insurance requirements and determined that
100,000/300,000 was adequate and asked that Staff verify that the current carrier meets
the insurance requirements.
Commissioner Klennert Hunt asked than an "f' be added to the "0" on page 3 to make
the word "of."
Commissioner K1ennert Hunt asked for an explanation of the termination of licenses
when ordinance takes effect.

The Commission discussed the matter and determined no changes were necessary as the
requirement would simply require the City to renew the license when the Ordinance takes
effect.
Commissioner Lakso asked that the "his" on Page 4 be changed to "their".
Commissioner Klennert Hunt asked whether the City licenses commercial haulers.
Council Liaison Broussard Vickers suggested putting commercial haulers on the agenda
for discussion to determine licensing requirements and discuss whether to limit
commercial haulers to one contract within the City.
The Commission discussed hours of operation and decided to add 7:00 a.m. to 8:00 p.m.
for collection.
Council Liaison Broussard Vickers suggested putting in language to allow the City to
grant permission to haul at other times in emergency situations.
Motion by Commissioner Lakso. seconded by Commissioner DeVine to recommend
to Council anuroval of Ordinance 1 with tbe amendments. All in favor. Motion
carried unanimously.
V. NEW BUSINESS
1. Arcade Concrete Site Plan - 2016 Gatewav Circle
Ms. Moore-Sykes indicated the Staff report questions were addressed by the
supplemental site plans submitted.
Ron Larke of Arcade Concrete addressed the Commission and explained that the building
would be an office in front with warehouse in the back. He then explained that
Innovative Tool would be operating out ofthe building.
Commissioner DeVine asked if the architect has the City's commercial code
requirements. Mr. Larke indicated that the architect had the requirements and the plans
should comply with all rules and regulations.
Commissioner McLean asked whether the setbacks are met. Ms. Moore-Sykes indicated
that all the setbacks are met and she and Mr. Palzer discussed the plans.
Ms. Moore-Sykes indicated that Chair Hanson was not able to be at the meeting but had
asked her to ask questions for him. She then asked Mr. Larke the nature of the business.
Mr. Larke explained that the building is a distribution warehouse not a manufacturing
facility.

Ms. Moore-Sykes explained that Mr. Hanson's concerns were if the facility would be a
concrete manufacturing facility and, since that is not the case, the questions are not
relevant.
Motion bv Commissioner Wilharber. seconded bv Commissioner DeVine to
recommend to Council approval of the site plan for J and L Construction at 2016
Gatewav Circle pendin!!: Rice Creek Watershed District approval. All in favor.
Motion carried unanimouslv.
2. Proposed Amendments Lawn and Garden Watering Ordinance
Ms. Moore-Sykes indicated the public works staff would like to amend the ordinance to
restrict watering to after 6:00 p.m. on odd and even days based on addresses.
Conunissioner De Vine reviewed the ordinance with the Conunission.
Conunissioner McLean asked if a new water restriction notice was needed.
Council Liaison Broussard Vickers indicated the notice was not necessary for the
ordinance and said she would like to use the word may provide a warning so the City is
not required to do so.
Conunissioner Lakso asked whether new lawns should be added as an exemption.
The Conunission asked that language concerning new lawns be added to 4.3.
Motion bv Commissioner KIennert Hunt. seconded bv Commissioner Lakso to
recommend approval to Council with the amendments. All in favor. Motion
carried unanimouslv.
3. Proposed Amendments to Sump Pump Ordinance
Ms. Moore-Sykes indicated that the amendments would allow Staff the ability to put in
the remote reading information.
Council Liaison Broussard Vickers indicated she did not feel it was necessary to provide
four notices before fining people.
The Commission agreed that two notices would be adequate with a fine on the third
notice.
Motion bv Commissioner Wilharber. seconded bv Commissioner DeVine to send the
ordinance back to Staff to provide notice information and present it to the
Commission for review. All in favor. Motion carried unanimouslv.

Council Liaison Broussard Vickers asked Staff to check with the City Attorney to
determine where the best place for this would be.
VII. DISCUSSION ITEMS
Ms. Moore-Sykes provided information from Mr. Hanson on NPDES for review.
Ms. Moore-Sykes indicated that she had received a call from Mr. Vang but had not been
able to return his call. She then said that Mr. Palzer spoke to him and he is interested in a
bowling alley as well as a nightclub.
Ms. Moore-Sykes indicated the Developer's Agreement for Pheasant Marsh Phase II has
been signed and the documents are at the County for recording.
Ms. Moore-Sykes indicated that some of the residents to be bypassed by water with
Peltier Preserve have submitted letters to the City asking for water.
Ms. Moore-Sykes indicated that Mr. Buechler brought in a map for a twinhome on 1810
Main Street.
The Commission discussed zero lot line setbacks and asked Staff to check with the City
Attorney for the appropriate way to allow for two separate owners of the townhome
building.
VII. CONSIDERATION OF MINUTES
1. March 4. 2003. Planning and Zoning Meeting Minutes
Commissioner Klennert Hunt requested that she and Commissioner Lakso be listed as
present at the meeting.
Motion by Commissioner Wilharber. seconded by Commissioner Klennert Hunt to
approve the Minutes of March 4. 2003. as amended. All in favor. Motion carried
unanimouslv.
Commissioner McLean abstained from voting.
VIII. ADJOURNMENT
Motion bv Commissioner DeVine. seconded by Commissioner Wilharber to adiourn
the April I. 2003 Plannilll! Commission Meetiul! at 7:40 p.m. All in favor. Motion
carried unanimously.

Lloyd Drilling Re-Zone
DATE: May 6, 2003
Due to the fact that the City's Comprehensive Plan shows that Mr. Carlson's property
that he desires to develop is currently represented as Agricultural and not slated for
MUSA development until 2006 & 2011, a Comprehensive Plan Amendment is needed.
Mr. Carlson is aware and has begun the process; however, two (2) Public Hearings are
needed for the amendment. No re-zoning action may be taken at this evenings Planning
and Zoning meeting or Wednesday's Council Meeting. Lot combination plays not part
and a recommendation may come forward to Council. Preliminary Plat may be
recommended for approval to come forward to Council contingent upon a
Comprehensive Plan Amendment and Re-Zone at Mr. Carlson's expense. Mr. Carlson
must sign a 60 day waiver otherwise Council has no alternative but to deny Mr. Carlson's
request due to the fact that the Comprehensive Plan prevails over the City Zoning Map
and same would not be allowable zoning. If desired, Mr. Carlson can submit a grading
plan for Engineer, Public Works Director and Council review and commence grading
upon proper permitting if he is willing to assume all costs associated with work
commenced and zoning or the Compo Plan Amendment is denied by either Met. Council
or City Council.
Due to the fact that the City's Comprehensive Plan shows that Mr. Lloyd Drilling's
property that he also desires to develop/re-zone is currently represented as Commercial, a
Comprehensive Plan Amendment is also needed. No re-zoning action may be taken at
this evenings Plarming and Zoning meeting or Wednesday's Council Meeting. Mr.
Drilling must sign a 60 day waiver otherwise Council has no alternative but to deny Mr.
Drilling's request due to the fact that the Comprehensive Plan prevails over the City
Zoning Map and same would not be allowable zoning.
Both public hearings may be held this evening at Planning and Zoning and again at
Council. However, if both waivers are signed Council may CONTINUE the re-zone
public hearings for June 11, 2003. I will place notices in the Quad for Compo Plan
Amendments for Public Hearings at May 28 & June 11, 2003 Council Meetings. At the
June 11, 2003 Public Hearing for the Compo Plan Amendments, the Re-Zone public
hearings will be reopened and acted upon. (I spoke with Lloyd, he is fine with the
process and will sign the waiver this evening, he will find you).

Mr. Lloyd Drilling is requesting that his property at 6939 - 20th A venue South be rezoned
from B-1 Commercial to R-2 SF Residential for the purpose of constructing 15 plus
townhomes, which is allowed under this zoning designation. Mr. Drilling has submitted
the appropriate application and paid the required fee for rezoning. The City Clerk has
published a notice to rezone and sent letters to those property owners affected by this
proposed rezoning request as required by the Minnesota statutes.
Mr. Drilling will be in attendance to discuss the request and to answer any questions.
Although Staff feels that this rezoning would provide adequate buffering to the industrial
area on the east side of 20th Avenue for the residential area to the west of the subject
property, a similar request came before you in August, 2002 and consensus was to retain
the current B-1 zoning status. Also, I have had a call from the Metropolitan Council
reminding the City that as part of our agreement to support the state's Livable
Community Act, the City has agreed to construct 162 high density, affordable housing.
To date, the City has constructed 130 ofthese units and the Met. Council is interested in
the City's future compliance.

Rezoning, Lot Combination and Preliminary Plat Requests for Hunter's
Crossing, Second Addition, Phase 1.

Mr. Richard Carlson has requested that Hunter's Crossing, Second Addition be rezoned
from R-I Rural to R-2 SF Residential Planned Unit Development for the purpose of
developing single family residential homes. Hunter's Crossing, Second Addition is
proposed to be comprised of the two sections ofland lying directly south of the currently
existing Hunter's Crossing, First Addition residential development.
While Mr. Carlson has stated before at the Planning and Zoning Commission and the
City Council that he is interested in doing this development in a phased manner, he needs
to combine the two parcels in order to accommodate the construction ofthe first phase of
the proposed second addition. Combining the parcels now, also gives him clear title and
alleviates any potential issues with setbacks that may arise during the construction of the
first phase of this addition that may encroach into the adjoining parcel.
Lastly, ifthe Planning and Zoning Commission votes to recommend the rezoning and the
lot combination, Mr. Carlson is also at this time seeking preliminary plat for his proposed
development.
Mr. Carlson has submitted the appropriate applications and paid the required fees for the
rezoning, lot combination and preliminary plat. The City Clerk has published a notice
for these public hearings and sent letters to those property owners affected by these
proposed requests as required by the Minnesota statutes.
Mr. Carlson will be in attendance to discuss the request and to answer any questions.

Dear Ms. Olsen:
This letter summarizes issues I have discussed with Tori Dupre regarding a sewer
staging amendment in the City of Centerville. Also attached are copies of the
Plan Amendment Information Summary, and Centerville "Growth Management
Plan" and "Utility StaginglMUSA Additions" graphics illustrating the proposed
amendment. I also spoke with Don Bluhm, MCES, and he informed me that
downstream capacity in the metro system will currently accommodate sewer
flows planned for 2020.
The City has received a 43-acre single family residential development proposal
which includes 77 single family lots. Approximately 18 acres of the site is
located within the 2006-2010 sewer staging area and approximately 25 acres of
the site is located within the 2011-2020 sewer staging area. This development
will generate approximately 0.0208 mgd sewer flows. The City's approved sewer
staging plan includes the following projected wastewater flow data:
2000 0.299 mgd
2005 0.371 mgd
2010 0.436 mgd
2020 0.564 mgd
According to Don Bluhm, the 2002 wastewater flow data from Centerville was
approximately 0.273 mgd. Annual projected wastewater flows in the sewer
staging plan are anticipated to add approximately 0.014 mgd per year. This
estimate plus the proposed development would add a combined 0.0352 mgd to the
current cumulative flow of 0.273 mgd or an estimated 2003 total flow of 0.308
mgd. As you can see from the table above, this anticipated flow is consistent with
2000 flow data and is well below 2005 and 2010 forecasts.
There is no land use change associated with the proposed development. The site
is currently guided Low/Medium Density Residential, which is consistent with the
proposed development. There are no regional park, transportation, or airport
issues associated with the proposed plan amendment.

Centerville

Attached is Ordinance #31 that the City Clerk recently found in going through the City
ordinances. While this ordinance was adopted in 1978, she was not aware that the City
required contractors, firms, corporations, and subcontractors doing work in Centerville to
obtain City licensure and bonding. Apparently, this is something that has not been done
for years and she was never made aware of this requirement. She also did not find
evidence that Ordinance #31 was ever repealed.
If the City is not interested in requiring licensure and bonding of the contractors, et at
who work and provide services to the residents, then this ordinance should be repealed.
Please review and we can discuss the future of Ordinance #31.
ORDINANCE #31
AN ORDINANCE PROVIDING FOR THE LICENSING AND BONDING OF INDIVIDUALS,
FIRMS, CORPORATION, CONTRACTORS AND SUBCONTRACTORS DOING OR PER-
FORMING WORK WITHIN THE CITY OF CENTERVILLE AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF.
The City Council of the City of Centerville, Anoka. County, Minne-
l!lota, ordaine::
SECTION 1. That it 13 deemed in the interest of the public and
the residents of the City of Centerville that any person, firm
or corpora.tion who engages in the business of building, conl!;truc:-
tion or related work, within the City of Centerville, as defined a1>
:::ection 4 of this ordinance, ehall firet secure a licens;& the-xefor
all provided herein. This ordinance shall not apply to persons,
firms or corpo:ns:tiioneo who' produce a product within the City of
Centerville for uee outside of the City of C~nterville.

SECTION 3. The licenBe fee ehall be $25. annually. Each license
shall expire on the 1st day of January after the Bame iBsued and
shall not be prorated. The fee herein eBtablished may be Changed,.
from time to time, by the City Council, by resolution, a copy of
which shall be on file and open for inspection at regular busine~.

SECTION 4. Licenses Bhall b~ obtained by every parson engaged in
the following businesses or work in accordance with the applicable
ordinances of the City of Centerville:
a. General contractors, including thol!le involved in erection,
alterati'on or repair of Btructures'.
b. Masonry, cement work, cement block'work, block laying or
brick work..
c. Heating and ventilating.
d. ROOfing.
e. Plaetering, BtuccO work and sheet rock taping.
f. ExcavationB, including excavations for footings, basements
lIIld grading of lote_
g. Wrecking of structuves.
h. All fences.
i. ABphalt work.

Wothing herein sha~~ be construed as preventing any such qualified
licensee from performing the work by an employee under his super-
vision and control, nor a property owner from performing his own
work providing all provisions of the Uniform Building Code are
adhered to.
A license granted to a general contractor shall include the right
to perform all of the work included in his general contract. Such
license shall include any or ~l persons performing the work which
is c~assified and listed in Section 4 above, provided that each
person performing such work is in the regular employ of such gen-
eral contractor and qualified as required under state law and the
provisions of this Ordinance to perform such work. The general
contractor shall be responsible for the quality and completeness
of all of the work so performed.
SECTION 5. This Ordinance shall not be construed to effect the
responsibl1ityor liability for any party owning, operating or
installing the above described work for damages to persons or
property caused by any defect therein nor shall the City of
Centerville be held as assuming any such liability by reason of
the licensing of persons, firms or corporations engaged in such
work.
SECTION 6. The City Council may issue a variance hereto, waiving
the requirements of this Ordinance or any portions thereof in the
event of a declared emergency and for such periOd of time as deemed
by the Council to be necessary.
SECTION 7. Any license may be revoked for just cause after a
public hearing proceeded by ten (10) days written notice to the
licensee.
SECTION 8. Any person, firm or oorporation who shall violate any
proviaion of this Ordinance shall be guilty of a misdemeanor as
defined by State Law.
SECTION 9. This ordinance will take effect August 1, 1978.
Adopted by the City Council of the City of Centerville on June 14,
1978.
