The said meeting will take place on Tuesday, January 4,2000 at 6;45 p.m or as soon as possible thereafter. The purpose of the hearing will be to hear all persons present regarding the possibility of rezoning of Parcel Identification No. 23.31.22.12.0002 described as follows: The South 419 feet ofthe West 208 feet ofthe East 24 rods of the Northwest Quarter of the Northeast Quarter of Section 23, Township 31, Range 22, Anoka County, Minnesota (except the East 30 feet) (except the West 30 feet) and (except the North 219 feet thereof) (except part taken for highway by Anoka County) Containing 1.0 acres, more or less. Also subject to other easements of record, if any. The request is to rezone the property from R2, Single Family Residential to B 1, Commercial. At the said time and place, the City will give all parties present an opportunity to express their views with respect to the proposed request to rezone the property. CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION DECEMBER 7,1999 Pursuant to due call and notice thereof, the Planning and Zoning Connnission of the City of Centerville held its regularly scheduled meeting at City Hall, 1880 Main Street. CALL TO ORDER Commission member LaMotte called the meeting to order at 6:40 p.m. II. APPEARANCES - None III. DISCUSSION ITEMS Fire Arm Ordinance Commission member Hanson stated that he did not like the word "owo" in Section 5.02, Regulations. Mr. March stated that he contacted the City Attorney and that this word should be removed from the section. He also stated that he discussed with the attorney the discharge section in relation to some ofthe dangerous weapons listed and the City Attorney suggested that those items be removed from the list of dangerous weapons. It was the consensus of the commission that Section 5.02, Regulations should read "No person shall at any time discharge or use in a manner that may cause bodily harm or property damage any firearm or dangerous weapons upon or onto any lands within the City of Centerville except as provided by this Ordinance." Mr. Tedd Peterson, 6933 Pheasant Lane, stated that he felt that the limitation of discharging a bow and arrow to 2.5 acres was too high. He stated that he practices in his back yard with the target towards the house and shoots from approximately 20 yards and with this section he would not be allowed to do that on his property. He also stated that he could see addressing juvenile issues in the ordinance, but not a sweeping ordinance for banning archery on lot sizes less than 2.5 acres. Commission member LaMotte explained that there were problems with minors shooting arrows into people's property without parental supervision. Even after neighbor's would talk to the parents it continued and the property owner's did not have any recourse to deal with this issue. So it was decided that a limit had to be put on the smaller properties. Commission member McLean stated that the commission obtained ordinances from Champlin, Forest Lake, Anoka, Coon Rapids, Circle Pines, and Lino Lakes in the preparation of this ordinance. Council member Broussard Vickers stated that ordinances are to provide regulations for what is best for the community as a whole. Mr. Mike Carter, 6913 Sumac Court, asked what brought up the need for this ordinance and if there are reported incidents reflecting problems with bow and arrows. He expressed that the government is getting too much control on what people can do on their property. Mr. March explained that the ordinance was brought to the attention of the Planning and Zoning Commission and City Council by the police department. The police department's main concern was not the bow and arrows, but weapons, such as BB guns being discharged in the community and no method of confiscating the weapons. Commission member McLean moved. seconded by Commission member Shepard to amend the Firearm Ordinance with the cban2es in Section 5.02 and forward the ordinance to the City Council. Aves: Commission member McLean. Sbepard. Devine. Hanson Navs: Commission member LaMotte. Killian The Commission recommends that the Council table approval of the ordinance in order to 2 receive more public input and information from the police department on the bow and arrow issue in the ordinance. V. PUBLIC HEARING(S) Rezoning Request - Parcel # 23.31.22.41.0007 -7:00 p.rn Mr. March stated that he received 15-20 calls relating to this issue and the calls were opposing the rezoning to allow apartments. Commission member LaMotte opened the hearing at 7:15 p.m. Mr. Lloyd Dri1ling presented information related to the proposed rezoning of a parcel located on 20th Avenue from commercial to residential single family, with a special use permit. The information dealt with the placement of two 24-unit apartment complexes on the property, which would need to be rezoned. Mr. Mike Carter, 6913 Sumac Court, asked what is going to happen when you want to sell the apartments in 3-5 years. Mr. Drilling stated that this would be a high rent apartment complex and that no subsidies would be used that would require the setting aside of apartments at a reduced rent. Mr. Bill Krech, partner of Mr. Dri1ling, explained that the use of Tax Increment Financing would require a certain amount of occupancy towards a certain rental. Ms. Briggette Thaewald, 6947 Ivy Court, expressed concern on the height of the three- story building. She stated that she has a concern because the elementary school is already full, and they rent from St. Genevieve's because they do not have room at the school. She asked if commercial property would provide a better tax base than the proposed apartments. She feels that owner occupied housing would be better than rental apartments. Ms. Mary Billingsley, 6923 Sumac Court, stated that she is concerned at what this proposal will do to the property values of surrounding homes. Commission member DeVine informed the audience of the possible uses that can be allowed on this commercially zoned property. Council member Broussard Vickers explained the process of approving or disapproving what type of businesses can come into the commercial area. Mr. Tom Hanson, 1965 Center Street, stated he is concerned about property value. He just bought his house in June. 3 Mr. Jim Hoftter, 6905 Dupre, expressed that he felt commercial could be good for the community in providing jobs, or town homes like what is north of Main Street. Mr. DriJling stated that he didn't feel that a business would locate in this area because there is no traffic on 20th Avenue. Mr. Mike Carter, 6913 Sumac Court, stated that he disagreed on the traffic issue because people use the County Road J ramp to come into Centerville rather than use the County Road 14 exit. He felt that a strip mall would succeed in this area. Mr. Blaine Hopp, 1949 Center Road, stated his concern is that ifapartment buildings are built on this property what is to stop someone from building apartments across the street. He also asked ifthere would be fences and trees for privacy. Mr. Drilling stated that that berms, trees, and fencing would be a part ofthis proposal. Mr. Mark Olson, 1934 Center Street, asked how close does the County allow you to build to the road (20th Avenue). Mr. Drilling stated the County requires an 80-foot setback for the building. Mr. Joseph Steele, 6926 Sumac Court, expressed his concerns on rental apartments, the lack of maintenance, trouble that comes with some of the apartment dwellings and he has had bad experiences with apartments. He also stated that he felt people in the apartments would complain about snowmobiles in the area. He also stated that having Terminal Trucking has not lowered the value ofhis home, but that apartments probably would. Mr. Krech stated that he felt property values would maintain versus a blacktopping company or construction company. Mr. DriJlings stated that some low-income apartments are like that, but that this proposal would be on the order of what is on Highway 96. Mr. Steele stated that may be the case, but there are very few homes around that complex. Mr. Drilling asked the audience if they would prefer owner-occupied rather than rental in this area. The audience responded that they would. Commission member Hanson reviewed the proposal that was submitted for north of Main Street to rezone from commercial to town home. He stated that the concern was the limited commercial property and if commercial were all turned to residential soon all commercial would be gone and commercial property is a limited resource to the City. 4 Ms. Brigitte Thaewald stated that she felt ifit were owner-occupied they would have more of an investment in the community and maintain the property. She also stated she would rather see residential than commercial, and asked the reasons for wanting commercial rather than residential. Commission member LaMotte stated that the City wants nice businesses to bring jobs to Centerville. Mr. Carter stated that commercial is needed. He expressed the lack of restaurants in Centerville. Council member Broussard Vickers informed the audience that there have been businesses interested in Centerville, but for one reason or another those plans fell through. Mr. March explained a previous proposal for the property north of County Road 14, east of Willow Glen that was before Council. He also stated that Council had no interest in rezoning the commercial property. He also explained that if a company wishes to place a business on commercial property and it meets the criteria of the commercial zoning, Council has to defend its reasons for denial of a particular business. Mr. Peterson asked if there was any other property available for this type of building. Mr. Drilling stated no, and that the closer you get to Main Street the price of the property increases. Council member Broussard Vickers provided information on the County Road 14 issue, County plans for this road, that the County wants to provide a way for people from Lino Lakes to get to 35E, what they will and will not allow. Council member Broussard Vickers stated that she understands some want to leave it commercial, but she asked the audience that if it goes residential if they want it to be owner-occupied as opposed to apartments. The audience responded affinnatively. Mr. March explained that ifthis issue goes before the City Council if residents would prefer to see it residential rather than commercial it has to be voiced at the City Council and the past practice of Council has been not to rezone commercial. Mr. Drilling stated that town homes would be a nice addition to Centerville. Mr. Hopp stated that if this would proceed would there be a playground for kids and would pets be allowed. Mr. Drilling stated that green space would have to be incorporated into the plan. 5 Mr. Peterson stated that he felt this could be rezoned easier if it was owner-occupied residential rather than rental. He also stated that commercial would be good for the community to provide jobs for teenagers in the area. Commission member DeVine moved. seconded bv Commissioner Killian to close the public hearinl!. Motion carried unanimouslv. Commission member DeVine moved. seconded bv Commissioner Sheppard to table the rezonine contineent on the Developer sieninl! an extension to the 60-dav Council approval requirement. NEW BUSINESS Public Works Request for Proposals Mr. March reviewed the request for proposals that is being sent to potential developers for the Public Work site and stated that the residents in the area were also notified of the City's intention for this property. Set Workshop Dates for Ordinance #4 Rewrite The Commission set the following dates in January for workshops on the Ordinance #4 rewrite for Tuesdays, January 18 and 25,2000. V.
