All in favor. Motion carried unanimously. V. A W ARDS/PRESENTATlONS/APPEARANCES 1. Mr. Tom Wilharber. Trustee - Chun;h of St_ J:Jenevieve. (Request for Coll1prehensive Plan Amendll1ent Fee Waiver) Mr. Torn Wilharber of 6849 Centerville Road appeared before Council and asked for consideration of a fee waiver since the Church feels that there has been a mistake in the Comprehensive Plan designation for the church property Mayor Capra indicated that she has been working on researching this matter with Staff and would like additional time to do so 2. Mr. John Thill - Fete des Lacs Parade Mr. Thill appeared before Council on behalf of the parade committee and asked for the City's contribution to this year's festival. Council discussed the matter and a!,'feed that the money has been budgeted for the festival and informed Mr. Thill that invoices should be submitted to the City for payment Page 2 of6 Citv of Ccntervillc Council Meeting Minutes Fehmary 23, 2005 3. Mr Greg Kieselhorst - Fete des Lacs~Centerville Lions - Fireworks, Satellites & Tent Mr. Kieselhorst appeared before Council and outlined the proposed changes for this year's festival and the budget for 2005. Council discussed the matter with Mr Kieselhorst and Staff indicated that the City budgeted $18,000 for the festival this year. Mr Kieselhorst indicated that he would like to apply to the Spring Lake Park Lions for a donation again this year and asked that Council consider accepting that donation and forwarding it to the Lions for the festival. Motion bv Council Member Lee. seconded bv Council Member Lakso. to approve $18,000 for the Festival with the understandinl! that the money be spent on items that benefit the entire community such as the parade. fireworks. stal!e. tent. and the portable toilets with $7.750 I!oinl! toward the parade and the remainder to be spent at the discretion of the Lions for the Festival. All in favor. Motion carried unanimouslv. Mr Kieselhorst asked for permission for the Lions to use the park for the Easter egg hunt on March 26, 2005. Council agreed and Staff asked that Mr Kieselhorst stop into City Hall to fill out a special event form. 4. Mr Paul Montain Mr. Montain was not present at the meeting VI. PUBLIC HEARINGS Nonc. VII. NEW BUSINESS Successful Completion of Annual Review - Building Inspector Joel McPherson Motion bv Council Member Lee. seconded bv Council Member Lakso to approve the successful completion of annual review and step increase for Mr. Joel McPherson. All in favor. Motion carried unanimouslv. 2. Staff Participation in CPR Training March 3Q or 31. 200~ Ms. Bendcr indicated that alt hut one Staff member are interested in participating in the CPR training and that Staff member has agrecd to man thc phones and window at City Halt on the day of training Council agreed to one person at City Hall during thc training 4. Ordinance #79 - Construction Site Runoff Control Ordinance for Review Ms. Bender indicated that this Ordinance is on for public hearing on March 9, 2005 Vlll. OLD BUSINESS Lynn & AssQciates - StafflLcadership Training/City Administrator Search a. City Administrator Search - $4,91765 b StafflLeadership Training - $5,50000 Council discussed the StafflLcadership training with Staff and agreed to hold off on any further training until sometimc in April. 2. Page 4 of6 Citv ofCentervil1e Council Meeting Minutes Fcbnmry 23, 2005 4, AnQl<:a Countv CSA,H 14 Proiect -,Memorandum,ofUnderstamIing a, Northern Forest Products Council discussed the Memorandum of Understanding and agreed that there are too many issues with the Plan for Council to agree to sign it. Mayor Capra asked ML Peterson to contact White Bear Township to obtain plan information for 96 at Centerville Road, Council discussed the issue with truck traffic entering Northern Forest Products and Mayor Capra indicated that Northern Forest Products is working on a DVD and is interviewing thosc affected by the plan for CSAH 14 including residential and commercial and has asked if anyone from the City would like to participate in the documentary. Council outlined the changes they would like to see to the Plan and Council Member Lee agreed to work on an amendment to the Plan for review. Mayor Capra asked Staff to put rezone to Ml on the Planning Commission's next Agenda for consideration Mayor Capra noted that the flashing lights at the school are not working and asked that Staff look into fixing them as soon as possible IX. ANNOUNCEMENTS/UPDATES 1. 1601 LaMotte Drive - St Paul Water Utilities Mayor Capra provided Council with an update of her negotiations with ML Tschida concerning the purchase price for 1601 LaMotte Drive She then eXplained that one of the requirements for the DNR matching grant that the City is applying for to assist with the purchase of this park property is that the City obtain a parkland appraisal for the property. She then asked for Council authorization to do so in an amount not to exceed $3,000 Motion by Council Member Lee. seconded by Council Member Lakso to authorize Staff to obtain a parkland appraisal in an amount not to exceed $3.000 with the funds bein!! expended from Park Dedication Funds. All in favor. Motion carried unanimously. Mayor Capra indicated that Mr. Tschida has asked for the maximum amount that the City is willing to pay for the property and has offered to finance the property over three years at 6% interest if the City is interested. Final Candidate Interviews Work Session o March 3, 2005 at 610 p.m. Council asked that Staff post the meeting 3. Personnel Policy Work Session Council set a work session for March 9, 2005 at 5:30 pm. to discuss the personnel policy. 4. 6923 Tourville Circle Ms. Bender indicated that public works Staff went to the property and cleaned it up by placing as many items as possible in the shed in the rear yard and by removing some items for storage at public works. 5. 1759 Peltier Lake Drive Ms Bender reported that the property has been cleaned up and said she would ask public works to keep an eye on the property. 6. North Metro Telecom Council Member Lakso asked Council to read the information provided by North Metro Telecom as there are invaluable services provided that people are unaware of Council Member Paar thanked everyone for their help with making the Frozen Fete des Lacs as successful as it was. He then said that he had hoped for a larger turnout but the event was fun for those that attended. He also thanked the Lions for their assistance with the event. X. The YMCA is currently working on summer programs and wondered if offering Park Play Days again would be a option? We are considering the following: A seven (7) week program, July tbrough most of August. Runoff from the existing building and parking lot drains north to an existing vegetated swale before. discharging to stormsewer on Heritage Street. The proposed stormwater management plan includes a NURP pond and an infiltration swale for the currently proposed church building and parking lot as well as all future phases of development. Since more than 50% of the site is proposed for redevelopment, stonnwater management is required for all impervious areas (existing and new). District rate control and water quality treatment requirements have been satisfied for the subwatersheds with new and future imperviousness. However, survey data and storage information is required for the existing vegetated swales serving runoff from the existing parking lot and church. Also, the outlet invert elevation for the existing swales is required and must be modified to provide sufficient storage and skimming capability up to the I-year event for both the existing impervious areas and the proposed entrance drive subwatershed. The submitted geotechnical soil borings indicate clays throughout the site and a low water table. Therefore, the proposed infiltration. swale should be revised to be a biofi.ltration basin. 3. The District Permit Coordinator has field verified that there are no jurisdictional wetlands onsite. Feel free to forward my contact information to the City Attorney if needed. For enforcement and penalties, I included a financial security. However, I did not provide the amount. There are plenty of examples from other communities which could be either written into the ordinance or referenced. In the example ordinance produced by the MPCA, a $3000/acre security is suggested. I would suggest something smaller ($1000/acre) with a maximum amount of $10,000 or more for large subdivisions over 10 acres. In the attached Draft Ordinance (79.08.0), I referenced the .current City fee and security structure". All activities on the site shall be conducted in a logical sequence to minim;7" the area of bare soil exposed at anyone time. 3. Runoff from the entire disturbed area on the site shall be controlled by meeting either subsections a and b. or a. and c. a. All exposed soil areas with a continuous positive slope within 200 lineal feet of a surface water, must have temporary erosion protection or permanent cover for the exposed soil areas year round, according to the following table of slopes and time frames: Tvne of slone Steeper than 3: I 10:1 to 3:1 Flatter than 10:1 Time 7days 14 days 21 days b. For sites with more than ten (10) acres disturbed at one time, or if a channel originates in the disturbed area, one or more temporary or permanent sedimentation basin shall be constructed. Each sedimentation basin shall have a surface area of at least one percent of the area drnining to the basin and at least three feet of depth and constructed in accordance with accepted design specifications. Sediment shall be removed to mainlain 79.10 a depth of three feet. The basin dischmge rate shall also be sufficiently low as to not cause erosion, scour, or flooding along the discharge channel or the receiving water. c. For sites with less than ten (10) acres distwbed at one time, sih fences or equivalent control measures shall be placed along all side slopes and down slope sides of the site. If a channel or area of concentrnted runoff passes through the site, silt fences shall be placed along the channel edges to reduce sediment reaching the channel. The use of silt fences or equivalent control measures must include a maintenance and inspection schedule. 4. Any soil or dirt storage piles containing more than ten (10) cubic yards of material should not be located with a downsUde drninage length of less than twenty-five (25) feet from the toe of the pile to a roadway or drninage channel. If retrulining for more than seven days, they shall be stabilized by mulching vegetative cover, 1arps or other means. Erosion from piles which will be in existence for less than seven days shall be controlled by placing strnw bales or silt fence barriers around the pile. In-street utility repair or construction soil or dirt storage piles located closer than twenty-five (25) feet of a roadway or drninage channel must be covered with tarps or suitable alternative control, if exposed for more than seven (7) days, the stormdrnin iulets must be protected with an appropriate filtering barrier. Assuming that the painter starts painting as soon as weather permits, then the painting should be done prior to occupancy. If this is nolthe case, and the buildings will be occupied before June of 2005, then we may need to rethink the containment situations, but based on our last conversations with Paul Keleher, they will not be occupied during the tank painting. We also were informed by the developer that it will not be occupied until after the painting. If you look on the plan sheets, the one we were originally concerned with was the building proposed directly south of the tower. This one won't be buill before we are done. Maguire will be extra careful not to allow any drift, and KLM will be monitoring it. They will be monitoring the winds and paint accordingly. He finally was able to get a hold of his foreman. The Foreman screwed up and took the key with him. Jeremy hopes he will be back at the shop in time to ovemight mail the key to you this afternoon. If not, he will overnight it to you tomorrow. His foreman is in a little bit of trouble for leaving the door unlocked. Thanks for checking on that and notifying us about it. Please keep track of the key he sends you just in case some subcontractors need to get in the tank and also in case they forget to make a copy!?!? In regards to the containment deduct. The contractor is bound in the contract by the insurance requirements specified. If any drift does occur, he is liable for any damage he does to property near the tank whether it be by painting, sand blasting, or any other construction. Please refer to the letter Mark sent you on December 28 regarding the decision to proceed with this deduct. It basically was originally in the contract to protect the building that was supposed to be built directly south of tower. Within a 100 feet or so. This building won't be constructed now until after painting. If any drift were to happen and anyone comes to the City with a complaint, have them contact Maguire or Maguire's insurance company that can be found in your copy of the signed contract documents. let me know if you have any questions regarding this. Xcel Energy will probably be locating the power poles two feet behind the sidewalk on the north side of Main street. SRF Consulting Group is interested in obtaining the City's streetscape design which would include lighting, trees, plantings, sidewalk design, etc. SRF is now recommending considering utifizing a surcharge method and rubber tire base for the roadway through the park which means Main Street north of Centerville may be closed for up to a year staring the winter of 2006-2007. The possibility of a stop fight at Centerville Road and Main was briefly discussed. Paul 3/3/2005 Memo", TO: Honorable Mayor and Council Members FROM: Teresa Bender, City Clerk SUBJECT: Rezoning Along Main Street/CSAH 14 Widening DATE: March 4, 2005 Mayor Capra recommended that the Planning and Zoning Commission consider potentially rezoning along Main Street from 20th Avenue to the sharp curve by St. Genevieve's to M-l (Mixed Use) or B-1 (Commercial). Planning and Zoning met on February 28,2005 and discussed the five (5) houses to the north of Main Street near 20th Avenue primarily. Consensus was that this area would be more conducive for B-1 (Commercial) zoning due to the close proximity of additional property zoned B-1 (Commercial). It was felt that additional time and discussion needed to occur prior to making any recommendations. It was felt that consideration should be given to the types of businesses that would utilize the property and potential redevelopment in the future. Effective 9/5/00 City of Centerville Qrd. #4 manufactured housing in subdivided developments, in safe, attractive residential neighborhoods with all urban services and desired amenities as other residential areas. No person shall erect, establish, extend or enlarge a manufactured housing development within the limits of the City of Centerville without first obtaining Site Plan approval from the City Council upon receipt of the recommendation of the Planning and Zoning Commission. Approval shall be granted only upon compliance with all the following: 1.) Compliance with all other terms of this Ordinance #4, Centerville Zoning Ordinance; 2.) Compliance with all the terms of Ordinance #8, Centerville Subdivision Ordinance; 3.) The proposed development must be located in the City's urban service area as shown in the Comprehensive Development Plan, and must be served by public utilities as approved by the City of Centerville. Section 080-080: Single-Family, Residential - Estate (R-5). Purpose It is intended that the R-5 District provide for low-density traditional single family residential where public utilities are available and required for service. The design and circulation of new residential areas are also intended to be complimentary with and enhance the community's small town atmosphere. Permitted Uses A. Single-Family, detached dwellings. B. Accessory uses. C. Public parks and recreation uses. D. Day care facility. E. Residential facility. F. Home occupations Section 080-090: Commercial District (B-1). Purpose It is intended that the B-1 District provide opportunities for retail and service business uses which require larger development sites, highway visibility or highway access. General Minimum Requirements The following minimum requirements, as set forth, shall apply to all buildings that may be erected, converted or structurally altered in Commercial Districts. Setback See Table A - Schedule of District Regulations Lot and Yard Requirements. Building Height in Commercial Districts As provided in Division #110 of this ordinance. Page 23 of 59 L Effective 9/5/00 City of Centerville Ord. #4 Off Street Parking A. Space for a single vehicle shall be nine (9) feet by eighteen (18) feet or larger. B. Off street parking area shall be surfaced with asphalt or concrete, and with permanent concrete curbs to define driveways and parking limits. Plans and specifications tor parking areas shall be reviewed by the Rice Creek Watershed, and approved by the City. Approval trom the City will occur only after completion of the site plan review process. The site plan review process requires a hearing before the Planning and Zoning Committee and the City Council. C. There shall not be off street parking within five (5) feet from any street right of way nor five (5) feet from any other lot line. D. Also see Division #160. Buffer Zone Between Commercial and Residential Districts Where a Commercial District abuts a Residential District, any new development shall include a buffer zone. There shall be a protective strip of not less than ten (10) feet in width. This protective strip shall contain no structures, shall not be used for parking, off street loading, or storage, and shall be landscaped. The landscape treatment shall include a compact screen wall or fence, but shall not extend within fifteen (15) feet of the street right-ot-way. The planting or fence design must be approved by the site plan review process. The site plan review process requires a hearing before the Planning and Zoning Committee and the City Council. Per Division #70. Screening Requirements I It the City Council requires any type of screening as a condition tor a variance or special use permit; the applicant shall comply with the following conditions: A. File a copy of the screening plans with the Zoning Administrator. B. The screening, planting or construction, or both shall be complete within one year from the date of the building permit, subject to extension by the City Council. C. The screening shall be maintained after completion. Landscaping A minimum of ten (10) percent of any lot shall be green space. Three (3) percent of the surface area of the land within a parking area shall be landscaped with grass and shrubbery or other approved ground cover. Landscaped areas will continue to be maintained by the property owner on a continuous basis. Green areas within abutting street right-at-ways will also be maintained by the property owner. See Division #155 tor other requirements. Special Use Plan Review Site plans for all uses requiring a special use permit must be submitted for review prior to the issuance of the building permit. A. Building plans, including building elevations, indicating mass, building materials, and color of all exterior surfaces, including all materials proposed to meet the screening requirements of this ordinance. C. Landscape plans, including the number, species, and size of all plantings. D. Grading, drainage, parking areas, items to be stored, and utility plans. E. See Division #195. Accessory Structures Garages, accessory structures, screen walls, buildings, and exposed areas of retaining walls shall be of similar type, quality, and appearance as the principal structure. Accessory structures shall comply with all of Division #65. Exterior of Building All buildings shall be finished on all sides with permanent finished materials of consistent quality, per Division #90, and Ordinance #44-A. Permitted Encroachments The following shall not be considered as encroachments on setbacks subject to other conditions within this ordinance: Off street parking spaces, flues, belt course, leaders, sills, pilaster, lintels, cornices, eaves, gutters, awnings, open terraces, service station pump islands, open canopies, steps, chimneys, flag poles, ornamental features, open fire escapes, sidewalks, and fences, except as hereinafter amended. Exterior Merchandise See Division #130-140. Nuisance See Division #130-040. Driveways A. No driveway shall be located within one hundred (100) feet of any right-of-way line of a street intersection. Said distances shall be measured along the property line from the corner right-of-way and County line. B. Access drive onto county roads shall require a review by the City Engineer. This review shall be measured along the property line from the corner right-of- way and County line. Special Use Permits As provided in Division #195 of this ordinance. Criteria for issuance of Special Use Permit. Impact on traffic. B. Impact on parks, streets, and other public facilities. C. Compatibility of the site plan, internal traffic circulation, landscaping and structures with contiguous properties. D. Impact of the use on the market value of contiguous properties. E. Impact on general public health, safety, and welfare. F. Compatibility with the City's Comprehensive Plan. Signs As provided in Ordinance #39. Refuse A. All premises shall be provided with, at owner's expense, an adequate number of approved containers to hold the garbage accumulated by such premises. Such containers shall be made of metal or other suitable material, shall be water tight, insect and rodent proof, and shall be of a material not easily corrodible and equipped with suitable handles and tight fitting covers and shall be kept covered when there is garbage stored therein. B. Garbage and rubbish containers shall be placed at the rear of the premises or in such a manner as to be out of view from the street. In no event shall container or their enclosures be placed or maintained in such a way to unreasonably interfere with the use or enjoyment of adjoining property. C. All garbage containers shall be screened with a suitable enclosure. D. Every garbage or rubbish container shall be maintained in as sanitary condition as is possible and shall be thoroughly cleansed as needed. If, upon inspection by the Administrative Authority a container is found to be in poor repair, corroded or otherwise defective the Administrative Authority shall notify, in writing, the provider or user of the container of the deficiency and shall require the repair or replacement of the container within fifteen (15) days. All container enclosures shall also be kept in good repair. Permitted Uses A. Retail sales and service, but excluding adult orientated businesses. B. Purpose It is intended that the P-1 District provide opportunities for government facilities, schools, churches, hospitals, libraries and other similar public and institutional uses. Permitted Uses A. Government buildings, structures, facilities, utilities, rights-of-way, easements, parks, open spaces and vacant land. B. Schools, churches, cultural and educational facilities and uses, libraries, hospitals and health facilities. Section 080-120: Mixed Use District (M-1). Purpose It is intended that the M-1 District provide for the unique layout and character of a traditional central Business district with retail, professional office, residential, and other mixed uses. Permitted Uses A. Retail sales conducted within structures, but excluding automobile and motorized equipment sales, truck stops, gasoline and fuel sales, drive through restaurants. B. Repair and service conducted within structures, but excluding automobile and motorized equipment repair. C. Professional and business offices. D. Multiple residences and accessory uses. E. Accessory apartments. F. Theaters and recreational businesses conducted within structures. G. Public buildings. Special requirements It is the intent of these provisions to allow for flexibility of land uses and exceptions to traditional dimensional standards, when other conditions and special requirements are met. These provisions are not meant to allow unrestricted leapfrogging of land uses or disregard for compatibility of land uses. Greater flexibility in zoning regulations often leads to more subjectivity in land use interpretations. In making zoning decisions about land use compatibility and dimensional criteria for uses and structures, the City shall have broad discretion to protect the public health, safety and welfare; and to protect the residential integrity of the Mixed Use District and surrounding residential neighborhoods. Page 32 of 59 Effective 9/5/00 City of Centervi]le Ord. #4 Setbacks and lot coverage for new or expanded structures shall be determined through the Site Plan Review process by the Planning and Zoning Commission. Factors to be considered in the determination shall include; but not be limited to, existing setbacks, structural appearance, site drainage, public access, pedestrian safety, automobile safety, intersection visibility, height, parking, landscaping and other site design factors. Residential dwellings shall not be prohibited or discouraged in the M-1 District. The use or conversion of a residential structure for commercial use, other than a home occupation, shall require Site Plan approval by the Planning and Zoning Commission. Factors to be considered for such a use conversion include, but are not limited to, compatibility with adjacent land uses, structural appearance, structural adaptability, investment relationship, term or length of conversion (interim or permanent) and consistency with any land use plans prepared by the City for the Mixed Use District. The architectural design and exterior building materials used in connection with any new or expanded use or structure shall be consistent with any architectural design or aesthetic control requirements established by the City for the Mixed Use District. Division 85: Zero Lot Lines In new residential subdivisions in M-1, R-2A, R-2, R-3 and R-4 Residential Zoning Districts, structures may be arranged to include one (1) zero lot line provided that no windows or doors open on this side of the structure. The appropriate setbacks apply. Division 90: Commercial Exterior Buildina Materials Except; as otherwise regulated herein, the exterior wall surfaces of all new or expanded commercial buildings shall consist of face brick, finished block or other textured masonry product approved by the Planning and Zoning Commission. Exceptions to all masonry exteriors may be considered and approved by the Planning and Zoning Commission provided the following findings are met: A. The combination of exterior materials is used as an architectural compliment to the structure. B. The combination of exterior materials used is not inconsistent with the quality and appearance used on similar buildings in the same zoning district or neighborhood. C. Site conditions limit public exposure to certain exterior surfaces where masonry products are not proposed. D. An exterior wall may be temporary and a future expansion area of a structure and be subject to removal or redesign as an interior wall. Buildings are required to have contrasting architectural features and must be designed to be aesthetically pleasing. Division 95: Industrial Exterior BuildinQ Materials Industrial buildings are required to be constructed of brick, decorative block or approved textured masonry product. While the causes may be worthy, cities need to be cautious when making any financial commitments involving public funds. Generally, in order to spend money on something, a local government must have authority to do so. . Authority for an expenditure may be specifically stated in a statute or charter, or it may be implied as necessary to do what an express power authorizes. Gifts/Donations to Private Individuals/Organizations Following this general principle, donations to people, non-profits, charities, or other groups are not permitted unless they are based upon specific statutory or charter authority. For example, the Minnesota Attorney General's Office has issued opinions finding that cities have no authority to donate city funds to 4-H Clubs, the Red Cross, or the Boy Scouts. The assumption is that a gift of public funds to an individual or private entity necessarily serves a private rather than a public purpose. Before a city makes a contribution, it is important for the city to determine that it has specific authorization to make the expenditure. Here are some examples of specific, statutorily authorized appropriations: . Artistic Organizations. A county, city or town may appropriate money to support artistic organizations. . Historical. A city may annually appropriate a specified amount to a county historical society affiliated with, and approved by, the Minnesota Historical Society. The Attorney General recognizes that a city can sponsor a centennial celebration. Cities have express authority to commemorate important and outstanding events in city history. . SeniorlY outh Centers. A county, city or town may appropriate money to support the facilities, programs, and services of a public or private, not-for-profit senior citizen center or youth center. . City Promotion. A city may appropriate up to $50,000 annually to an incorporated development society or organization of this state, for promoting, advertising, improving, or developing the economic and agricultural resources of the city.! . Public Recreation Programs. Cities, towns, counties and school districts may spend funds to operate programs of public recreation, recreational facilities, and playgrounds. These programs may be conducted independently or with any nonprofit organization. Cities should consult with their city attorney or review the League of Minnesota Cities research memo "Public Purpose Expenditures" for a more comprehensive list of authorized city expenditures. If the city wants to make other donations, the city may wish to seek specific statutory authority for them. Additionally, cities may enter into contracts with an organization to accomplish tasks that the city is authorized to perform by statute or charter. For example, the city could not give money to the Boy Scouts for a recycling program, but the city could enter a contract with the Boy Scouts to do part of its recycling program. The amount of money paid to the Boy Scouts must be related to the value of the services they provide to the city. Memberships and Dues There is no general authorization for cities to join "private" organizations; but there may be specific statutory or charter authority to join specific organizations. For example, cities and urban towns in Minnesota may pay dues to become members of the League of Minnesota Cities. Similarly, cities, counties, and towns may appropriate money for membership in county, regional, state, and national associations of a civic, educational, or governmental nature. These associations must have as their purpose the betterment and improvement of municipal governmental operations. This authorization also allows public entities to participate in the meetings and activities of these associations. The Attorney General's Office has determined that local units of government may not pay dues to a local chamber of cornmerce. However, because cities may appropriate up to $50,000 to an incorporated development society or organization for promotional activities, a city could contract with a local chamber of commerce for one of the purposes authorized by statute, such as promoting the city.2 The chamber's use of the public funds would be limited to the statutorily authorized activities. We urge cities to review documents submitted by the chamber of commerce to verify that the money is spent for contracted statutory purposes. I In addition, EDAs have authority to conduct activities advaocing the city aod its economic development, aod to carry out other public relations activities to promote the city and its economic development. 2 EDAs have broader authority to join an official, industrial, connnercial or trade association, or other organization concerned with one ofthe EDA's authorized purposes. These questions are motivated by a desire to celebrate a holiday or significant event in an employee's life or to generally boost morale in the workplace. While these motives are good, important limitations exist on the use of public funds for employee social and recognition events. The key question is whether a local government has legal authority for this type of spending. Generally, in order to spend money on something, a local government must have authority to do so. Authority for an expenditure may be specifically stated in a statute or charter, or it may be implied as necessary to do what an express power authorizes. The Minnesota Attorney General's Office has considered the issue several times and has consistently said that local governments do not have implied authority to sponsor employee social events simply because they have the express power to compensate employees. Instead, the Attorney General's pOSItIon is that non-monetary benefits must be specifically authorized by law or charter. Based on this rationale, the Attorney General's Office wrote to The Champlin city attorney in 1998, indicating that no statutory authority existed for a city to hold an annual employee appreciation dinner or to award employee recognition gifts to employees. The Attorney General's Office stated: "while an agreed upon monetary bonus might be provided as part of a salary plan to employees who meet performance or longevity standards, we are at a loss to locate authority for expenditures of funds for in-kind awards or social occasions of the type described." Soecific Statutory Authority Granted to Counties Counties (and the state government) have specific authority for a wellness and employee recognition program under Minn. Stat. S 15.46. This statute states "[a] county may establish and operate a program of preventive health and employee recognition services for county employees and may provide necessary staff, equipment, and facilities and may expend funds as necessary to achieve the objectives of the program," However, this authority does not extend to other local units of government. Properly established county programs should be in writing and approved by the county board. They should include clear wellness and recognition objectives. The county board must determine what amounts can be expended as "necessary to achieve the objectives of the program." The State Auditor's Office, in reviewing county expenditures for wellness and employee recognition programs, will be guided by what is permitted and what is prohibited for state employees. Counties cannot simply provide employee banquets or parties for all employees. County funds can be spent only as necessary to achieve the objectives of an established wellness and employee recognition program. For example, based on established criteria, a program might include an annual employee recognition event that provides a meal reimbursement limited to the specific employees being recognized. We believe such a program could also include the provision of non-cash/non-negotiable items of nominal value for the specific recognized employees. Although we would consider a program recognizing all employees to be inappropriate, light refreshments (i.e. coffee and cake) could be served to all county employees at a service award reception. Of course, all elements of the wellness and employee . recognition program should be approved in writing by the county board before expenditures are made. Cities. Towns and School Districts Lack Similar Specific Statutory Authority Cities, towns and school districts are not mentioned in Minn. Stat. g 15.46. For this reason, these local governments do not currently have the same authority that counties have to establish wellness and employee recognition programs. Cities, towns and school districts may wish to seek similar legislative authorization. Unless the statutes are changed to grant this type of authority to cities, towns, and school districts; public expenditures by these entities for employee wellness and recognition programs are unauthorized and improper. More than 100 years ago, visionaries like Horace Clevdand and Charles Loring helped esrablish an oursranding nerwork of drives, parks and boulevards around rhe lakes and rivers of Minneapolis and St. Paul. In response to state legislation. the Metropolitan Council in 1974 designared abour 31,000 acres of existing parks owned by counties, cities and special park districts as "regional recreation open space." Those parks had about five million visits in 1975. Berween 1974 and 2004, rhe Council- wirh borh regional and seare funds - inveseed $367 million ro help local park agencies develop rhese parks as well as acquire and develop uew parks and trails for the growing metropolitan population.
