NOTICE OF PUBLIC HEARING
SPECIAL USE PERMIT
NOTICE IS HEREBY GIVEN that a public hearing will be held before the Planning and
Zoning Commission of the City of Centerville at City Hall, 1880 Main Street. The said
meeting will take place on Tuesday, January 5, 1998 at 7:00 p.m. or shortly thereafter. The
purpose of the hearing will be to hear all parties present regarding the consideration of
granting a special use permit to Rehbein Properties, LLC for a Kindergarten Center along
20th Avenue, south of 7087 20th Avenue; legal description 23-31-22-14-0055 (Clearwater
Meadows Outlot C). Written comments will be accepted uutil 4:00 p.rn ou January 5,
1998. City Hall is ADA accessible. However, if you need special accommodations please
make requests by phone or fax at (651) 429-8629. All interested person are iuvited to
attend and to be heard. You may call City Hall at 429-3232 if you have any questions or if
you need additional information.

Mary Capra and Wayne LeBlanc - EDC Minnesota Design Team Update
Mary Capra and Wayne LeBlanc presented sketches ofthe Minnesota Design Team
(MDT) visit to the committee. Discussion surrounded the implementing of the MDT
designs to make them a reality. Mary Capra suggested that a letter be drafted by the
Economic Development Commission (EDC) about the MDT visit and given to developers
as a way of incorporating some of the ideas, Mary Capra also suggested that the EDC
contact Anoka County about the County Road 14 plan and invite them to the EDC Open

House scheduled for November 17. Mary Capra mentioned that the MDT visit was very
positive and that the MDT accomplished more in Centerville with 10 members than they
had in other places with 18 because the City was well prepared.
Wayne LeBlanc suggested that someone from the Planning & Zoning Committee be a
liaison/contact person for the MDT Committee. Linda Broussard-Vickers agreed to be
the liaison/contact person and to attend the EDC Open House.
Joe Goetz - Goetz I,andscaping
Joe Goetz was in attendance and thought he was supposed to be on the agenda for a
special use permit to sell Christmas trees in Centerville. Kathy Welk suggested that Mr.
Goetz contact City staff regarding permits or fees and whether or not he would need to
appear before the Planning & Zoning Committee for this request.

Varience Request (Robert Nepper)
Mr. Nepper gave an overview of a varience request for the east property line of 7289 Mill
Road, located south west of the intersection of Peltier Lake Drive and Mill Road.
Furthermore, the varience is to implement a 25' front yard set back, rather than the
required 35'. The Commission discussed the surrounding property setbacks which ranged
from 37' to 59' and clarified the varience request complied with the four criteria layed out
in the ordinance. The Commission noted the special hardship circumstance the comer lot
featured; creek side, front yard and front side yard. In addition, the south properties
structures are set back from the curb line and the proposed parcel will be set back from
the ROW. Mr. Nepper did not foresee vehicles in the driveway to obstruct the vision of
traveling vehicles because the Peltier Lake Drive and Mill Road intersection is controlled
by a stop sign and a dead-end street.

The Commission considered the Saxton request and elected to leave the ordinance in its
current condition.
Consider Amendment to Ordinance #5 - Discharge of Firearms
The Commission discussed the difference between Centerville and Circle Pines discharge
of firearms. In particular, the wording of the Centerville ordinance "... a device which
ejects "a" projectile upon or onto...." and changing to multi-projectile.
The Commission requested staff supply the following:
1. A police officer to be present at the next meeting.
2. A list of City and Police complaints.
3. Lino Lakes Discharge of Firearms Ordinance.
4. State laws on the distance between shooters and residential homes.
Consider Cat Ordinance and Complaint Letter
The Commission requested staff provide a copy of the existing Animal Ordinance for the
January meeting.

Amendment to Ordinance #5 - Discharge of Firearms

The police department has had some diffiqulties in trying to
enforce Ordinance #5 the way that it is currently written. This
item has been referred to the Planning Commission by the City
Council. The main issue is that the current Ordinance does not
eliminate the discharge of firearms (shotguns) that emit multiple
projectiles within the corporate limits. Duck hunters, trap-
shooters, etc. are not banned from discharging their firearms as
long as they are shooting multiple projectiles. This item needs
to be amended in the current Ordinance.
Enclosed in your packet is a copy of the Weapons Ordinance that
was adopted this year by the City of Circle Pines. The Circle
Pines Ordinance also defines other weapons of less than mass
destruction. I would recommend adopting the same Ordinance to
have consistency within the Cities for the enforcement by the
police department.

97B.002 Civil trespass.
Subdivision 1. Authority to issue. Conservation
officers, sheriffs, and deputies may issue citations to a person
who trespasses in violation of section 97B.001 or removes a sign
posted to prevent trespass without permission of the owner of
the property.
Subd. 2. Penalty amount. The citation must impose
the following penalty amounts:
(1) $50 for the first violation;
(2) $200 for the second violation in a three-year period;
(3) for a third or subsequent violation in a three-year
period, the penalty shall be $500 and loss of every license or
registration being used; and
(4) $50 for removal of a sign posted pursuant to this
section.
Subd. 3. Appeals. Citations may be appealed under
the procedures in section 116.072, subdivision 6, if the person
requests a hearing by notifying the commissioner in writing
within 15 days after receipt of the citation. If a hearing is
not requested within the IS-day period, the citation becomes a
final order not subject to further review.

Subdivision 1. Agricultural land definition. For
purposes of this section, "agricultural land" means land:
(1) that is plowed or tilled;
(2) that has standing crops or crop residues: or
(3) within a maintained fence for enclosing domestic
livestock.
Subd. 1a. Outdoor recreation definition. "Outdoor
recreation" means any voluntary activity, including hunting,
fishing, trapping, boating, hiking, camping, and engaging in
winter sports, which is conducted primarily for the purposes of
pleasure, rest, or relaxation and is dependent upon or derives
its principal benefit from natural surroundings.

(I} state "no trespassing" or similar terms;
(2) display letters at least two inches high;

(ii) include the legible name and telephone number of the

REGULAR MEETING MINUTES
NOVEMBER 17,1998
Pursuant to due call and notice thereof, the Centerville Economic Development
Committee held their regular scheduled meeting on Tuesday November .17, 1998. At
approximately 7:00 p.m. the meeting began with a "Design Team - Open House". The
open house forum was held for residents, presenters, volunteers, and city staff to view the
ideas and drawings created for Centerville by the Minnesota Design Team. The
Economic Development Committee resumed their regularly scheduled meeting following
the open house. Chairperson Tim Rehbine called the meeting to order at 9: 10 p.m.
Present: Theresa Brenner, Mary Capra, John Magill, and Aimee Fairbrother.
OPEN HOUSE MINUTES
At approximately 7:00 p.m. the Minnesota Design Team - Follow up Forum was open to
all residents, presenters, volunteers, and city staff The drawings/ideas created by the
Design Team were on display in the council chambers. Chairs and tables were set up for
people to share their thoughts and ideas. Theresa Brenner provided coffee and cookies,
and John Magill provided soda. There were twenty-eight people that had signed in for
the open house (see attached), although the total estimated attendance was around fifty.
At 7:20 p.m. Council member Brenner welcomed all present, and introduced Mary Capra
- Design Team Co-Chair, Wayne Lablanc - Centerville resident, and Margaret Langfeld
- Anoka County Commissioner. Brenner turned the presentation over to Wayne Leblanc.
Wayne Leblanc extended a sincere thank you to all present, and explained that the goal
for the open house was not to go over each drawing/idea individually, but to go forward
with some of the Design Team ideas. Each person present gave an introduction,
indicating his or her name and areas of interest.
Wayne Leblanc suggested an action plan to keep ideas moving, and to keep the lines of
communication open. His plan incorporated the following ideas:
I. Have the entire volunteer group meet every two months at City Hall. These meetings
would welcome all current volunteers, as well as new volunteers, and serve as a
communication source for all groups. The bi-monthly meetings would be to present
feedback from the various task groups, and keep the community involved. These
meetings would begin in January 1998, and would be held at 7:00 p.m. on the second
Tuesday of the month. The council chambers have been reserved for this group of
volunteers on the following days: January 12, February 9, March 9, April 13, May 11,
July] 3, September 14, and November 9.
2. In-between the two-month meetings, the individual task groups should meet at a time
convenient for them. The meeting would be based on the progress of their task, and
would be held in order to gather or exchange ideas, resources, or project
developments.
3. As a City we should accept the Design Team results as a guide, although some things
will have to change a little from their plan.
4. Have one person as the designated leader for each task group.
5. The list of volunteers is always open for change. If there is another area of interest
you would like to help in, or if you have any special talents that would assist in a
project, please notify Wayne Leblanc and he will add it to the list.
6. There will be a communication mail slot at City Hall for any information that may
need to go out to the volunteers. Wayne Lablanc has also requested putting the
Comprehensive Plan on the Centerville website. Jim March is looking into the cost,
seeing that the Comprehensive Plan is extremely lengthy.
Wayne Leblanc then asked if anybody had any general questions, before the group
divided into specific task groups. Shelly LaBarre stated that she was concerned that she
may have missed something. She questioned whether everybody in the city was all right
with these changes. She stated that her husband was at the open house earlier, and he left
feeling like all the Design Team ideas were going to be put into place now, no matter
what the residents wanted. Wayne Leblanc then stated that there are going to be some
problems. Some residents will like some ideas, and not others. The key is to get groups
together, and get involved. The more people the better. Mary Capra added that the
Design Team visit was a year and a half-long process, and that a lot oftime was put into
the visit. Mary Capra also stated that no idea here is etched in stone, and that is why we
have the meetings, for residents to give their input. She stated that some things will
change, and some things will not. Some of the smaller changes are moving forward: the
fence at the school has been removed and a new, lighted school sign has been granted to
Centerville Elementary. Mary Capra stated that she was very glad that Shelly LaBarre
was at the open house, and hopes that she continues to give her imput. Shelly LaBarre
then stated that she, as well as others thought that the Design Team was just here to give
some ideas for a downtown revitalization, not a citywide revitalization. Therea Brenner
explained that a downtown revitalization is where it started but expanded from there.
Shelly LaBarre then stated that the city should decide as a whole on the ideas, not just
come to the open house, and do it. Rod Henslin concluded that the Design Team ideas
are like a very flexible master plan. The ideas define a goal, not the exact way to get
there. Tonight we are here to formulate a working team, to work towards the master
plan. We need to start someplace.

4. Wayne Leblanc will work on a presentation for Anoka County in reference to
Highway 14 and trials.
5. February 9th and April 13th, there will be a meeting at City Hall to discuss Park/Trails
and Lakes.
6. City to give and overview of the Comprehensive Plan at the January 12th, 1999
meeting.
Randy Hagerty suggested that each person tell five neighbors when the next meeting is,
to keep communication open. Mary Capra stated that we could also publish the meetings
in the community section of the Quad Community Press.
Based on areas of interest, all groups gathered until approximately 9:05 p.m. Those
present left after their task group, and concluded their discussion.

OLD BUSINESS
1. Vote on "Citizen of the Year Award":
Although Mary Capra was the recommended for the "Citizen of the Year Award," the
Economic Development Committee discussed the voting procedure. Much discussion
was held on the issue, because EDC members are very active with the community during
the year, and therefore get nominated. It was decided unanimously to take the issue to
the City Council.
2. Vote on "Business Person of the Year Award"
Father Richard Wolter was recommended to City Council for "Business Person of the
Year Award".

Dear Members:
I am writing to comment on the granting of a special use permit to Goetz
Landscaping to operate a landscape and irrigation business at 2030 Main Street.
Our business, Northern Forest Products, owns the land directly to the east of the
above location and has been very pleased with having Goetz Landscaping as our
neighbors. Everyone we have met from the owners to all of their employees
have been friendly, professional, and have demonstrated a desire to bring a
positive impact to the Centerville community.
Recently, Goetz Landscaping completed the project of a turnaround driveway at
our site. Not only did they help us accomplish our objectives of creating a safer
and more efficient use of our property, but also designed a professional looking
landscape which enhanced the aesthetic appeal of our community.
I strongly support the approval of the granting of the above referred to permit. I
also strongly encourage other considerations for Goetz Landscaping as they
arise to help them realize their potential as a strong asset to the Centerville
community.
