We are in receipt of a preliminary plat and llite plan-utility plan for the proposed Parkview
Addition in Centenrille. We r&Celvecl thill plat on January 28. 1998. Aa requested. we have
completed a review of the plat and offer the following comments.
PREUMINARYPLAT
· Lot 21, BloCk. 2, Is a butt lot (aide line coincides with the back line or one or more other lots).
Ordinance B, part 25.08, requires butt lola to be platted atleasl five feet wider than the
average InlBrior lola In the block. It doee not appear that this lot would meet this
requirement
· This eame butt lot has a rear lot line length 0131.87 feet. Ordinance e, i:llIrt 25.02, requires
thet rear lot lines be at least 50 feet In length.
. The proposed cul-de-sacs shown on the plat appear to ba a "taar-drop" design. In the past,
the City has approved cul-de-sac designs that are more circular In nature. Ordlnence 8. part
26.03, requires that cul-d&-sBClare constructed 'of nearly circular shape". Mr. Paul PelZer,
Centerville Public WoI'I<S, indlci!lted that he may be in favor of the tear-drop shape because
this type of cul-de-sac Is easier to plow.
· All lots need to show the required drainage and utility easements along front, rear, and side
lot lines.
· The comer lot on Park Terrace. Lot B, Block 2. should be shown with a curved radius to
match the right-of-way through the southeast comer of the lot The lot Slu needs to be
maintained It the minimum area size or 12,750 square reet for comer lola.
· We rellOmmend additional drainage and ulJlity easements to be shown along Lota 1, 10, and
11, Bltlck 2, to provide a 1o-foot eaHment after Anoka County Icqulres additional right-of-
way for reconstruction of Centerville Road.
· Ordinance B has special requirements for double front_iil.lete. Depending on an
Interpr,iltatlon of SectIOn 25.04, Lots 10 and 11, Block 2, may be required to be 20 feet
deeper than the R2A zonIng requirement of 125 feet. The City may also want to consider a
landscaping or bermlng requirement along Centervllle Road. .

SITE PLAN - UTILITY PLAN
· The plat shows a proposed road connection to Oupre Road. This arellls part of the Eagle
Pass plat, through an outlot area. A meeting should be scheduled with the developer of the
Eagle Pass plat to dlsculS coordination of this proposed road connection.
· We recommend a watermain loop project be completed with this development that would
inClude looping the wMermain north along Centerville Road to the hydrant at the northwest
comer ot the Senior Housing property. A loop connection from the Park TelTllce cul-de-sac
to CentervOIe Road would also be desirable due to the length 01 the cul-de-sac and the
number 01 lots along Park Terrace. In addition, tne City may consider extending a trunk
walen"_in to Center street for a Mure extension east along Center Street.
· Other issUQ that should be dlsoulSeCl InclUde potential sidewlIlk and trail routes, the
requiPid street section, and issues concerning drain tile.
If the City ohooses to ..seas some of the cost for the walermaln looping to reeldents outside of
the plat bounclary, we would need to pub6c1y bid that portion 01 the project and begin the 429
assessment proceu.
We will be, in attendance at the February 3" Planning an<l Zoning Commission meeting to
discuss this plat and anawer any quations you may have. We will also be in lIltendance at the
February 11 ", City Council meeting to discuss issues related to looping the watermaln.

Zoning Commission of the City of Centerville at the City Hall on Tuesday, February 3,

Dear, Planing and Zoning Committee,
As a resident at 1749 Heritage Street I am writing this letter to request that the
remainder of Clearwater Road be vacated. If the re-zoning of the property along
Clearwater and Main Street is approved, it would leave a one block section of Clearwater
Road. This section of road running from Sorrel Street to Heritage is the area [wish to be
vacated. This one block section boarders a wetland and has numerous mature trees that I
would like to remain unaltered. Living at the end of Heritage St. I would like it to
continue to be a dead end road. I support the re-zoning classification, bringing more
business opportunities into Centerville is important to our local economy. The
construction of the bank will not only enhance the landscape, but will also benefit
Centerville. Having the remaining one block section of Clearwater Road vacated will
also enhance the local neighborhood. Thank you for your consideration of this matter.

An Ordinance Amending City Code Section '" The Sale of Cigarettes
The City Council of the City ofCenterville does ordain as follows:

Section 1. The City Code of the City ofCenterville is hereby amended by deleting SectioC'._/
in its entirety and replacing it with the following:

SectioO The Sale of Tobacco
345.01 PUQ)ose. The city recognizes that many persons under the age of 18 years
purchase or otherwise obtain, possess, and use tobacco, tobacco products, and tobacco related
devices, and such sales, possession, and use are violations of both State and Federal laws; and
because studies, which the city hereby accepts and adopts, have shown that most smokers begin
smoking before they have reached the age of 18 years and that those persons who reach the age
of 18 years without having started smoking are significantly less likely to begin smoking; and
because smoking has been shown to be the cause of several serious health problems which
subsequently place a financial burden on all levels of government; This ordinance shall be
intended to regulate the sale, possession, and use of tobacco, tobacco products, and tobacco
related devices for the purpose of enforcing and furthering existing laws, to protect minors
against the serious effects associated with illegal use of tobacco, tobacco products, and tobacco
devices, and to further the official public policy of the State of Minnesota in regard to preventing
young people from starting to smoke as stated in Minn. Stat. ~ 144.3 91.
345.02
Definitions. As used in this section, the following terms are defined as follows:
Subd. 1 Tobacco or Tobacco Products. "Tobacco" or "Tobacco products" shall
mean any substance or item containing tobacco leaf, including but not limited to, cigarettes;
cigars; pipe tobacco; snuff; fine cut or other chewing tobacco; cheroots; stogies; perique;
granulated plug cut, crimp cut, ready-rubbed, and other smoking tobacco; snuff flowers;
cavendish; shorts; plug and twist tobaccos; dipping tobaccos; refuse scraps, clippings, cuttings,
and sweepings oftobacco; and other kinds and forms of tobacco leaf prepared in such manner as
to be suitable for chewing, sniffing, or smoking.
Subd.2 Tobacco Related Devices. "Tobacco related devices" shall mean any
tobacco product as well as a pipe, rolling papers, or other device intentionally designed
or intended to be used in a manner which enables the chewing, sniffing, or smoking of
tobacco or tobacco products.

Subd. 3 Self-Service Merchandising. "Self-Service Merchandising" shall mean
open displays of tobacco, tobacco products, or tobacco related devices in any manner
where any person shall have access to the tobacco, tobacco products, or tobacco related
devices, without the assistance or intervention of the licensee or the licensee's employee.
The assistance or intervention shall entail the actual physical exchange of the tobacco,
tobacco product, or tobacco related device between the customer and the licensee or
employee. Self-service merchandising shall not include vending machines.
Subd. 4 Vending Machines. "Vending Machine" shall mean any mechanical,
electric or electronic, or other type of device which dispenses tobacco, tobacco products,
or..tobacco related devices upon the insertion of money, tokens, or other form of payment
directly into the machine by the person seeking to purchase the tobacco, tobacco product,
or tobacco related device.
Subd. 5 Individually Packaged. "Individually packaged" shall mean the practice
of selIing any tobacco or tobacco product wrapped individually for sale. Individually
wrapped tobacco and tobacco products shall include, but not be limited to, single cigarette
- packs, single bags or cans ofloose tobacco in any form, and single cans or other packing
of snuff or chewing tobacco. Cartons or other packaging containing more than a single
pack or other container as described in this subdivision shall not be considered individually
packaged.
Subd. 6 Loosies. "Loosies" shall mean the common term used to refer to a single
or individually packaged cigarette.
Subd. 7 M!nm:. "Minor" shall mean any natural person who has not yet reached
the age of eighteen (18) years.
Subd. 8 Retail Establishment. "Retail establishment" shall mean any place of
business where tobacco, tobacco products, or tobacco related devices are available for
sale to the general public. Retail establishment shall include, but not be limited to,
grocery stores, convenience stores and restaurants.
Subd. 9 Moveable Place of Business. "Moveable Place of Business" shall refer to
any form of business operated out ofa truck, van, automobile, or other type of vehicle or
transportable shelter and not a fixed address, store front or other permanent type of
structure authorized for sales transactions.
Subd. I 0 ~. A "sale" shall mean any transfer of goods for money, trade, barter,
or other consideration.
Subd. 11 Compliance Checks. "Compliance checks" shall mean the system the city
uses to investigate and ensure that those authorized to sell tobacco, tobacco products, and
tobacco related devices are following and complying with the requirements ofthis
ordinance. Compliance checks shall involve the use of minors as authorized by this
ordinance. Compliance checks shall also mean the use of minors who attempt to
purchase tobacco, tobacco products, or tobacco related devices for educational, research
and training purposes as authorized by State and Federal laws. Other units of
government for the purpose of enforcing appropriate Federal, State, or local laws may
also conduct compliance checks and regulations relating to tobacco, tobacco products
and tobacco related devices.
Subd. 12 Community Service. "Community Service" shall mean a service that
provides assistance to the community. Community service shall have a reparative element
which enables offenders to actually, and symbolically, pay back a debt to the community.
345.03 License Required. No person shall sell or offer to sell any tobacco, tobacco
products, or tobacco related device without first having obtained a license to do so from the city.
Subd. 1 Application for License. An application for a license to sell tobacco,
tobacco products, or tobacco related devices shall be made on a form provided by the
city. The application shall contain the full name of the applicant, the applicant's residential
and business addresses and telephone numbers, the name of the business for which the
license is sought, and any additional information the city deems necessary. Upon receipt
of a completed application, the city clerk shall forward the application to the
council for action at its next regularly scheduled council meeting. If the clerk
shall determine that an application is incomplete, he or she shall return the application
to the applicant with notice of the information necessary to make the application complete.
Subd. 2 Action. The council may either approve or deny the license, or it may
delay action for a reasonable amount of time to complete any investigation of the
application or the applicant it deems necessary. If the council shall approve the license,
the clerk shall issue the license to the applicant. If the council denies the license, notice
of the denial shall be given to the applicant along with notice of the applicant's right to
appeal the council's decision.
Subd. 3 Imn. All licenses issued under this ordinance will expire December 31,
of the year the license was purchased.
Subd. 4 Suspension or Revocation. Any license under this ordinance may be
revoked or suspended as deemed necessary by the Council.
Subd. 5 Transfers. All licenses issued under this ordinance shall be valid only
on the premises for which the license was issued and only for the person (s) to whom the
license was issued. No transfer of any license to another location or person or entity shall
be valid without the prior approval of the council. The licensee shall not be entitled to
a refund of the license fee upon revocation or voluntarily ceasing the licensed activity.
Subd.6 Dis'play. All licenses shall be posted and displayed in plain view of the
general public on the licensed premise.
Subd. 7 Renewals. The renewal of a license issued under this section shall be
handled in the same manner as the original application. The request for a renewal
shall be made at least thirty days but no more than sixty days before the expiration of
the current license. The issuance of a license issued under this ordinance shall be
considered a privilege and not an absolute right of the applicant and shall not entitle
the holder to an automatic renewal of the license.
345.04 lm. No license shall be issued under this ordinance until the appropriate
license fee is paid in full. The fee for a license under this ordinance shall be determined by
resolution of the City Council.
345.05 Basis for Denial of License. The following shall be grounds for denying the
issuance or renewal of a license under this ordinance; however, except as may otherwise be
provided by law, the existence of any particular ground for denial does not mean that the city
must deny the license. If a license is mistakenly issued or renewed to a person, it shall be
revoked upon the discovery that the person was ineligible for the license under this Section:
A. The applicant is under the age of 18 years.
B. The applicant has been convicted within the past five years of any violation of a
Federal, State or local law, ordinance provision, or other regulation relating to
tobacco or tobacco products or tobacco related devices.
C. The applicant has had a license to sell tobacco, tobacco products, or tobacco
related devices revoked within the preceding twelve months of the date of
application.
D. The applicant fails to provide any information required on the application, or
provides false or misleading information.
E. The applicant is prohibited by Federal, State, or other local law, ordinance, or
other regulation, from holding such a license.

345.06 Prohibited Sales. It shall be a violation of this ordinance for any person to
sell or offer to sell any tobacco, tobacco product, or tobacco related device:
A to any person under the age of eighteen (18) years.
B. By means of any type of vending machine, except as may otherwise be
provided in this ordinance.
C. By means of self-service methods whereby the customer does not need to make
a verbal or written request to an employee of the licensed premise in order to
receive the tobacco, tobacco products, or tobacco related devices and whereby
there is not a physical exchange of tobacco, tobacco products, or tobacco related
device between the licensee or the licensee's employee, and the customer.
D. By means ofJoosies as defined in Section 345.01 Subd. 06 of this ordinance.
E. Containing opium, morphine, jimson weed, bella donna, strychnos, cocaine,
marijuana, or other deleterious, hallucinogenic, toxic, or controlled substances
except nicotine and other substances found naturally in tobacco or added as part
of an otherwise lawful manufacturing process.
F. By any other means, to any other person, or in any other manner ofform
prohibited by Federal, State, or other local law, ordinance provision, or other
regulation.
345.07 Vending Machines. It shall be unlawful for any person licensed under this
ordinance to allow the sale of tobacco, tobacco products, or tobacco related devices by the
means of a vending machine unless minors are at all times prohibited from entering the
licensed establishment.
345.08 Self-Service Sales. It shall be unlawful for a licensee under this ordinance to
allow the sale of tobacco, tobacco products, or tobacco related devices by any means whereby
the customer may have access to such items without having to request the item from the licensee
or the licensee's employee and whereby there is not a physical exchange ofthe tobacco, tobacco
products, or the tobacco related devices between the licensee or his or her clerk and the customer.
All tobacco, tobacco products, and tobacco related devices shall either be stored behind a
counter or other area, not freely accessible to customers, or in a case or other storage unit not
left open and accessible to the general public. Any retailer selling tobacco, tobacco products,
or tobacco related devices at the time this ordinance is adopted shall comply with this Section
within 90 days. Self-service sales restriction shall not apply to retail stores which derive at
least 90% of their revenue from tobacco and tobacco related products and which cannot be
entered at any time by person younger than 18 years of age.
345.09 Responsibility. All licensees under this ordinance shall be responsible for the
actions of their employees in regard to the sale of tobacco, tobacco products, or tobacco related
devices on the licensed premises and the sale of such an item by an employee shall be considered
a sale by the license holder. Nothing in this section shall be construed as prohibiting the City
from also subjection the clerk to whatever penalties are appropriate under this Ordinance, State
or Federal law, or other applicable law or regulation.
345.10 COmpliance Checks and Inspections. All licensed premises shall be open to
inspection by the city police or other authorized city official during reguJar business hours.
From time to time, but at least once per year, the city shall conduct compliance checks by
engaging, with the written consent of their parents or guardians, minors over the age of fifteen
(IS) years but less than eighteen (18) years, to enter the licensed premise to attempt to purchase
tobacco, tgbacco products, or tobacco related devices. Minors used for the purpose of
compliance checks shall be supervised by city designated law enforcement officers or other
designated city personnel. Minors used for compliance checks shall not be guilty of unlawful
possession of tobacco, tobacco products, or tobacco related devices when such items are
obtained as a part of the compliance check. No minor used in compliance checks shall attempt
to use a false identification misrepresenting the minor's age, and all minors lawfully engaged
in a compliance check shall answer all questions about the minor's age asked by the licensee or his
or he!; employee and shall produce any identification, if any exists, for which he or she is asked.
Nothing in this Section shall prohibit compliance checks authorized by State or Federal laws
for educational, research, or training purposes, or required for the enforcement of a particular
State or Federal law.
345.11 Other illegal Acts. Unless otherwise provided, the following acts shall be a
violation of this ordinance.
Subd. 1 lllef,lal Sales. It shall be a violation of this ordinance for any person to
sell or otherwise provide any tobacco, tobacco product, or tobacco related device to
any minor
Subd. 2 lllegal Possession. It shall be a violation ofthis ordinance for any minor
to have in his or her possession any tobacco, tobacco product, or tobacco related device.
This subdivision shall not apply to minors lawfully involved in a compliance check.
Subd. 3 megal U!Ie. It shall be a violation of this ordinance of any minor to smoke,
chew, sniff, or otherwise use any tobacco product, or tobacco related device
Subd. 4 lllegal Procurement It shall be a violation of this ordinance for any minor
to purchase or attempt to purchase or otherwise obtain any tobacco, tobacco product, or
tobacco related device, and it shall be a violation of this ordinance for any person to
purchase or otherwise obtain such items on behalf of a minor. It shall further be a
violation for any person to coerce or attempt to coerce a minor to illegally purchase or

otherwise obtain or use any tobacco, tobacco product, or tobacco related device. This
subdivision shall not apply to minors lawfully involved in a compliance check.
Subd. 5 Use of False Identification. It shall be a violation of this ordinance for any
minor to attempt to disguise his or her true age by the use of a false form of identification,
whether the identification is that of another person or one on which the age of the person
has been modified or tampered with to represent an age older than the actual age of the
person.
Violations.
Stlbd. 1 Notice. Upon discovery of a suspected violation, the alleged violator shall
be issued, either personally or by mail, a citation that sets forth the alleged violation and
which shall inform the alleged violator of his or her right to be heard on the accusation.
Subd. 2 Hearings. If a person accused of violating this ordinance so requests, a
hearing shall be scheduled, the time and place of which shall be published and provided
to the accused violator, their parent or legal guardian.
Subd. 3 Hearings Officer. The City of Centerville City Council shall serve as the
hearing officer.
Subd. 4 Decision. If the hearing officer determines that a violation of this
ordinance did occur, the decision, along with the hearing officer's reasons for finding
a violation and the penalty to be imposed under Section 345.13 of this ordinance, shall
be recorded in writing, a copy of which shall be provided to the accused violator, their
parent or legal guardian. Likewise, if the hearing officer finds that no violation occurred
or finds grounds for not imposing any penalty, such findings shall be recorded and a copy
provided to the acquitted accused violator, their parent or legal guardian.
Subd. 5 Appeals. Appeals of any decision made by the hearing officer shall be
filed in the district court for the city in which the alleged violation occurred.
Subd. 6 Misdemeanor Prosecution. Nothing in this Section shall prohibit the City
from seeking prosecution as a misdemeanor for any alleged violation of this ordinance.
If the City elects to seek misdemeanor prosecution, no administrative penalty shall be
imposed.
Subd. 7 Continued Violation. Each violation, and every day in which a violation
occurs or continues, shall constitute a separate offense.

345.13
Penalties.
Subd. 1 Licensees and Emplovees. Any licensee, and any employee of a licensee,
found to have violated this ordinance shall be charged an administrative fine which shall be
determined by resolution of the City Council for a first violation of this ordinance; for a
second offense at the same licensed premises within a twenty-four month period; and/or
a third or subsequent offense at the same location within a twenty-four month period. A
fine shall be determined by resolution of the City Council. In addition, after the third
offense, the license shall be suspended for not less than seven days.
Subd. 2 Other Individuals. Other individuals, other than minors regulated by
subdivision 3 of this subsection, found to be in violation of this ordinance shall be
charged an administrative fee set by resolution of the City Council.
Subd. 3 Minors. Minors found in unlawful possession of, or who unlawfully
purchase or attempt to purchase, tobacco, tobacco products, or tobacco related
devices shall be charged an administrative fee set by City Council resolution and will
be subjected to 20 hours of community service.
Subd. 4 Misdemeanor. Nothing in this Section shall prohibit the City from seeking
prosecution as a misdemeanor for any violation of this ordinance.
345.14 Exceptions and Defenses. Nothing in this ordinance shall prevent the providing
of tobacco, tobacco products, or tobacco related devices to a minor as part of a lawfully
recognized religious, spiritual, or cultural ceremony. It shall be an affirmative defense to the
violation of this ordinance for a person to have reasonably relied on proof of age as described
by State law.
345.15 Severability and Savings Clause. If any section or portion of this ordinance
shall be found unconstitutional or otherwise invalid or unenforceable by a court of competent
jurisdiction, that finding shall not serve as a invalidation or effect the validity and enforceability
of any other section or provision of this ordinance.
Section 2. Effective Date. This ordinance shall take effect the day following
publication in the city's official newspaper.

Pursuant to due call and notice thereof, the Park and Recreation Committee of the City of
Centerville held their regularly scheduled meeting on January 7, 1998 at City Hall.

Rick Carlson gave a presentation of the Tourville property. It was noted that in previous Park
and Recreation meetings that this development was discussed and that Park and Recreation had
decided to accept cash and not land for this project.
OLD BUSINESS
Review of Fund Raising Update - tabled at this time.
Overview of Chain ofT ...lees Little League - Park and Recreation approved the Little Leagues
request for use of the fields for the summer of 1998.
LaMotte Park U~date (soil botinfls and wetland credit) - Park and Recreation reviewed the letter
from Anoka County and the report from Jim March about soil borings in the parking lot. Park
and Recreation request that a new design(s) be completed based on the following:
Possible movement of the skating rink.
Keeping four ball fields.
Reducing the number ofballfields.
Reducing the number of soccer fields.
Eliminate the soccer field to be placed in other location.
Acorn Creek Snowmobile Prevention Update - No further action was necessary.
Parkview (Tourville Property) Development - Park and Recreation requested that all
trails be installed prior to any home being built. Motion by Michael Navin, seconded by
Richard Thompson, to accept Park and Recreation's Map "A", and the developer is to
escrow the amount equal to the construction cost of the segment rnarked"X", crossing
where indicated. Motion carried.

must contact Steve Brown concerning any changes in the ice schedule.

JANUARY 6, 1998
Pursuant to due call and notice thereof, the Planning and Zoning
Commission of the City of Centerville held their regular meeting
and a public hearing on January 6, 1998, at City Hall. Meeting

MEETING CALLED TO ORDER
PUBrrIC HBARING(S)
A public hearing was scheduled to consider vacation of a
construction easement on the property owned by Joyce Greene
located at 1873 Main Street. Mr. Joel Anderson representing Mr.
Olinger would like to see the property transferred unencumbered.
Joyce Greene discussed the history of the construction easement.
The easement is apparently designated to the City of Centerville.
Motion made by John Buckbee to recommend vacating the easement if
the City had no use for the easement and any other easements be
acquired as deemed necessary and to close the public hearing,
seconded by Linda Broussard-Vickers. Motion carried.
PARKVIEW DEVELOPMENT
Mr. Rick Carlson was present to discuss his concept plan for the
development of the former Tourville property. Mr. Carlson is
proposing one access on to Centerville Road. An additional 7' of
right-Of-way has been added to the east side of Centerville Road.
Mr. Carlson would propose plantings along Centerville Road
instead of any type of berm.
Mr. Carlson expects the homes to be valued in the $150,000 to
$155,000 range. Potential locations of trails were discussed.
The homes would be split-entry style.
Concerns were raised by John Buckbee in regards to density issues
and the R2A versus R2 zoning. Linda Broussard-Vickers mentioned
that she felt that this development is more attached to the Eagle
Pass development than it is attached to the Center Oaks
development and has no issue with the 80' lot widths.
Rick Carlson suggested turning the driveway on the Tourville
Property to face south onto his street and to eliminate the
current driveway onto Centerville Road. Discussion occurred on
garage sizes and the routing of storm sewer through the
development.
John Buckbee mentioned that he is comfortable with the R2A zoning
as long as it is consistent with the comprehensive plan. Motion
by John Buckbee to recommend the plat designed by Mattke and to
recommend R2A zoning, but as a restrictive covenant require the
standards for houses built in the R2 zoning, seconded by Linda
Broussard-Vickers. Motion carried.
FRUTH/FISCHER COMPREHENSIVE PLAN AMENDMENT
The Fruths and Fischers were present to discuss their intentions
of selling a portion of their property. The parties indicated
that they have made their intentions clear for a number of years.
Mot~on was made by John Buckbee to recommend pursuing the
proposed amendment and forward the recommendation to the City
Council, seconded by Linda Broussard-Vickers. Motion carried.
MINUTES
No quorum was present to approve the previous month's minutes.
MISCELLANEOUS
Jim March explained the potential chiropractic office the is
intending to practice out of the home that is for sale next to
City Hall. The practice would be consistent with the
requirements for a home based business. Jim March also explained
the changes to Ordinance 45A that are to become effective in
regards to allowing water meter readings to be automatically
phoned in to City Hall via the telephone line.
Motion by John Buckbee, seconded by Linda Broussard-Vickers to
table the shoreland ordinance. Motion carried.

As a resident at 1749 Heritage Street I am writing this Jetter to request that the
remainder of Clearwater Road be vacated. If the re-zoning of the property along
Clearwater and Main Street is approved, it would leave a one block section of Clearwater
Road. This section of road running from Sorrel Street to Heritage is the area I wish to be
vacated. This one block section boarders a wetland and has numerous mature trees that I
would like to remain unaltered. Living at the end of Heritage SI. I would like it to
continue to be a dead end road. I support the re-zoning classification, bringing more
business opportunities into Centerville is important to our local economy. The
construction of the bank will not only enhance the landscape, but will also benefit
Centerville. Having the remaining one block section of Clearwater Road vacated will

Re: Ordinance 44A
Dear Chairperson Welk and Committee Members:
I have provided a handout on Zoning Criteria which came from a recent building
seminar which was attended by Ken Cook. It helps to walk through the zoning process
and explains the goals to be achieved by various zoning procedures. I hope it is useful as
a reference guide for your use over the next year.
In a recent cooversion with fun March, the intent of a "Pole Barn" type buildings in
the commercial and industrial zoning has lead to some confusion between how the city
staffhas interpreted this restrictioo and how it literally reads within the ordinance. Staff
has lead potential business owners to believe that only concrete or block exterior walled
buildings were permitted within these zones and that no pole barn or pre-engineered metal
buildings were permitted by this ordinance.
As a staff member I would like the Planning and Zoning Committee to issue an
interpretation of their intentions with this restrictioo and possibly amend the ordinance to
more accurately state the intended restrictions for these zones. This would only include
the exterior walls of a building and clarify the following items.
I. Whether cootinuous or pier footings are permitted.
2. If any structural wood framing is allowed or if all studs are required to be of metal.
3. The issue of the main wall constructioo must be concrete or masonry versus steel or
wood construction.
I believe that with the rapid expansion of the city in the industrial and commercial
zones that this is an important issue as to what type of businesses the city will attract and
will impact the makeup of our industrial base and the revenues generated from these
structures.

Pursuant to due call and notice thereof, the Park and Recreation Committee of the City of
Centerville held their regularly scheduled meeting on January 7, 1998 at City Hall. .

APPEARANCES
Rick Carlson gave a presentation of the Tourville property. It was noted that in previous Park
and Recreation meetings that this development was discussed and that Park and Recreation had
decided to accept cash and not land for this project.
OLD BUSINESS
Review of Fund Raising Update - tabled at this time.
Overview of Chain of Lakes Little Le3.iUe - Park and Recreation approved the Little Leagues
request for use of the fields for the summer of 1998.
LaMotte Pjlrk Update (soil borinss and wetland credit) - Park and Recreation reviewed the letter
from Anoka County and the report from Jim March about soil borings in the parking lot. Park
and Recreation request that a new design(s) be completed based on the following:
Possible movement of the skating rink.
Keeping four ball fields.
Reducin~ the number of ball fields.
Reducing the number of soccer fields.
Eliminate the soccer field to be placed in other location.
Acorn Creek Snowmobile Prevention Update - No further action was necessary.

Parkview (Tourville Property) Development - Park and Recreation requested that all
trails be installed prior to any home being built. Motion by Michael Navin, seconded by
Richard Thompson, to accept Park and Recreation's Map "A", and the developer is to
escrow the amount equal to the construction cost of the segment marked "X", crossing
where indicated. Motion carried.
Centennial Youth Hockey Association. Outdoor Ice - Centennial Youth Hockey Association
must contact Steve Brown concerning any changes in the ice schedule.
NEW BU_SINESS
Park and Recreation Vacancy Consideration - Candidates are to be invited to the February
meeting.
Parkview (Tourville Property) Trailway Development Consideration - See Parkview Development
