Pursuant to due call and notice thereof, the City Council of the City of Centerville held a workshop on March 23, 1999 at City Hall, 1880 Main Street. PRESENT: Mayor Tom Wilharber Council Members: Theresa Brenner Mari Nelson Richard Travis Terry Sweeney (arrived at 7:00 p.m.) ABSENT: None STAFF: Jim March, City Administrator Paul Palzer, Public Works Director/Building Official CALL TO ORDER Mayor Wilharber called the March 23, 1999 Workshop meeting to order at 6:00 p.m. 1. PUBLIC WORKS BUILDING Mayor Wilharber opened the discussion by questioning future purchases of additional equipment for the city. Mr. Palzer, Public Works Director responded by stating that sometime in the future the city will need a new loader or bobcat. Furthermore, as we add additional staff members, we will need to expand our mowing and park vehicles to maintain our parks at a higher level then we have in the past. Mr. Palzer continued, stating that he would like to see the city purchase a used snowplow truck for the heavier snow falls. Councilmember Nelson addressed the issue of the number of employees and questioned Mr. Palzer what he thought might be needed. Mr. Palzer indicated that it is hard to tell at this point, that it will depend on the service needs of the city. Currently, we have two full time public works employees besides Mr. Palzer. The City also has one full time building inspector. Future staffing needs cannot be determined at this point. Mayor Wilharber explained that the building analysis was currently completed on March 19, 1999. The analysis lists the four different options available and reviews the city's development. Mr, March explained that the analysis included input from Mr. Palzer, Tim Danielson, and Robert Westerlund from the Public Works Department. Although the analysis is complete, a couple of other options have surfaced. One would be to possibly do something on the site behind City Hall. The other would be to possibly develop the property just north of LaMotte Park which is currently owned by St. Genevieve's Parish. There has been an effort started recently to see if the Archdiocese would be interested in parting with the property. This option may be quite lengthy, and if investigated further, the possibility of losing the two existing building options would exist . Mayor Wilharber suggested that the Council review the options that are available and discuss the advantages and disadvantages of each. Mr. March stated the cost option is listed on the back page of the analysis, but it was difficult to determine without getting an architect involved. One idea was to save one of the buildings for a heritage museum and possibly demolish the other building. There would be a cost involved in regards to ongoing operation and maintenance. Another issue would be deciding who would be responsible for the utilities. Option #4 Cedar Street Park Advantages: City owns the land We could build exactly what we want Few residential neighbors to worry about Disadvantages: Cost for building and utilities Isolated location More valuable to sell as industrial Mayor Wilharber asked the Council if there was any of the four options that they would like to throw out right now or if they would like to continue to look at all four options. Councilmember Travis stated that he had some concerns about the size and the future use of the building. Councilmember Travis also questioned whether the Cedar Street location could be used as a dual purpose. The City has talked about a possible salt storage with the County, as well as obtaining a second water tower. In order to incorporate these items, Councilmember Travis stated that he was thinking about an office- warehouse type building, basically a slab on grade where you don't have to worry about ADA and there would be bathrooms, and offices for the police. Councilmember Travis continued, stating the he was looking more for a building that would be like a pole -barn with a house at the end of it. Mr. March commented that previously he was involved in a similar project and at that time, building construction was $65 a square foot. Mr. Palzer added that now we are looking at about $100 per square foot for 6000 square feet, and that we need to keep in mind that this facility will be around for the next 80 to 100 years. Mr. March indicated that the City of Circle Pines just built a fire department about that size and that it cost $995,000 and that was without showers. Due to the cost and complexity of this option, it was dropped as a possible location for the new Public Works building. Councilmember Nelson suggested that we would be better off as a City to sell this property then to build on it because we could actually make some money. The Council continued by discussing option #1 and decided that it should be thrown out due to the disadvantages listed and it being an eyesore to the downtown area. After a lengthy discussion between options #2 and #3, the Council decided that the Lake Area Utilities location would be the most favorable option. The reasons for the decision include the following: less cost, growth possibilities, not primarily residential, obtain possession this fall, additional income from rentals currently leasing, more square footage, and additional land available for a possible second water tower. Mr. March indicated that 3 the next steps would include contacting the attorney and pursuing a purchase agreement with Willie Lessard. 2. COMPUTER SYSTEM Councilmember Sweeney gave a brief overview based on a conversation that he had with City Clerk Ry -Chel Gaustad. Councilmember Sweeney stated that there have been some bids that have come in and if the City is looking at purchasing a full network system, we would be looking at over $20,000. A full network system includes a main central computer with satellite computers hooked up to it. Since the City Hall office is small, this idea was dropped. Another bid looked at and suggested that all the computers be upgraded. This bid was submitted by Amacomp Inc., but Councilmember Sweeney felt that because of the limitations involved with upgrading the systems, the City would be better off purchasing new PC's. Mr. Sweeney continued, stating that for about $7,000 - $10,000 the City could get new PC's which would guarantee Y2K compatibility. The City would be looking at purchasing four new systems that would be networked together, pier to pier. The systems should include Windows 98 and the purchase of a network card for the system currently used by Mr. March. This sort of system would enable public works to tap into the network. The purchase would also include a laptop that could be run in the Council Chambers for any meetings or sessions. The laptop could also be used for meetings that are held in different locations. The software issue was also addressed and Councilmember Sweeney clarified that whatever software program the City purchases, some training will need to be scheduled. Councilmember Sweeney stated that he would be willing to set up templates and newsletters etc. for the City. Councilmember Sweeney recommended that the City purchase the Word Perfect Suite and the Corel Drawing Suite. Councilmember Sweeney also suggested that if we ran cable into the City Hall for intemet access that we would not need to have additional phone lines, although each computer would need to have a modem. Mr. March stated that since the cost of the purchase would be less then $25,000 it would not have to go out for bids. Councilmember Nelson stated that her experience with Amacomp is that they have gotten her hardware at a lesser cost then CompUSA, Circuit City or Best Buy. Mr. March questioned if we need to create some specifications to get somebody else to bid on something similar to what Amacomp bid on. Councilmember Sweeney questioned the budget available. Mr. March stated that money was available for at least the pier to pier. In conclusion, it was determined that Udo Wegmann of Amacomp would be asked to give the City a quote on the cabling and the hook -up. 3. NEWSLETTER Councilmember Nelson stated that she received an e -mail from Shelly LaBarre of 7261 Mill Road. Ms. LaBarre's e-mail indicated that while viewing the City Council meeting on cable last week, the sound quality was so poor, it was unviewable. She also mentioned that in the year that she has lived in Centerville, she has never received a newsletter. Ms. LaBarre suggested a monthly newsletter and also suggested placing copies of the monthly newsletter at local businesses. 4 This issue was discussed in great detail. It was decided that a large, quarterly newsletter would continue to be mailed out, supplemented by a smaller monthly newsletter that would be available for residents to "pick up" at the Centerville City Hall as well as at local businesses. Possible Newsletter "pick -up" locations are: Tom Thumb, Corner Express, and Amoco. The "pick up" process would save on postage as well as time spent on folding as required by the postal system. Councilmember Nelson suggested that Ms. Gaustad contact the local businesses to see if they would be willing to help in the distribution of the newsletters. After the new software is in place, the newsletters should be easier to write. A program can be developed in which the newsletter format is set up. At this point, somebody would just need to fill in the blanks. Councilmember Brenner questioned where we get the information for the monthly newsletter. Mr. March stated that it takes a lot of time for just one person to write the newsletter. Mr. March suggested that we invite several people to write articles on current event issues. Councilmember Nelson commented that the newsletters should focus on recent meetings, regular scheduled meetings, and extra meetings /workshops. Councilmember Sweeney added that maybe they could just pull together the highlights. This would allow residents to know what is going on and to be informed on things that are coming up. Councilmember Brenner stated that in prior years the newsletter included a "Council Corner ", which highlighted the events from current City Council meetings. In addition to the newsletter, it was also mentioned that communication with the residents per the cable channel is not yet functioning. Mr. March stated that the City is waiting for a response from a letter sent to the cable company in regards to training issues. Training was included in the price of the system and up to this point has not been offered. As soon as training becomes available, Staff will be trained in on how to use the software. The cable channel should also include current events information and meeting highlights. Mr. March also mentioned that some websites of larger cities also include minutes from all committee meetings on -line. This could be a possibility in the future. 4. TRI - CITY POLICE DEPARTMENT FUNDING FORMULA Mayor Wilharber began the discussion stating that for about the last sixteen months we have been working with the City of Circle Pines and the City of Lexington in reference to funding a tri-city police department. Mr. March passed out copies of a funding formula, which weighs the different factors involved. Mr. March explained he favored the ideas of using a formula currently used by the IACP (International Association of Chief of Police). This is a nationally accepted formula. One thing that is going to happen is that Circle Pines is going to allow Lexington to phase in to the formula over a five year basis. By the year 2002 each City will be paying their fair share based on population, number of calls, and other formula factors. Councilmember Nelson questioned how the formula rate 5 compared to what we are currently paying. Mr. March responded that there is less than a $10,000 difference. Mayor Wilharber mentioned the determination of assets is one of the factors. He stated that the value of the assests is a concern and that the next tri-city meeting will be here on March 30, 1999 at 7:00. Mr. March stated that the council will have to have come to a consensus for Tuesday's meeting. This item will be discussed at the regular scheduled City Council meeting on March 24, 1999. 5. OPEN MEETING LAW Tabled until next workshop to be scheduled on April 7, 1999 at 6:00. Although there are no current issues, Councilmember Nelson would like to address the Open Meeting Law for future reference. 6. CONFLICT OF INTEREST Tabled until next workshop to be scheduled on April 7, 1999 at 6:00. Although there are no current issues, Councilmember Nelson would like to address Conflict of Interest for future reference. 7. UNIFORM HOUSING CODE (UHC) The UHC was adopted a few months ago, there are some residents properties that could be used for testing out the UHC. Mr. March stated that staff needs to know the level of enforcement that the Council wants staff to pursue. After a long and detailed discussion the Council agreed to check with other cities that currently use the UHC to establish a "Board of Appeals ". The Council also agreed that a policy should be established for staff to follow, complaints should be investigated and ordinances should be enforced. The UHC will be an agenda item for the regular scheduled meeting on March 24, 1999. Mr. Bill LaLonde of 1687 Westview Street was present and voiced an ongoing complaint about a neighbor that resides on the corner of Centerville Road and Westview Street. This property will be investigated after the UHC Board of Appeals is determined and staff procedures are developed. ADDITIONAL INFORMATION: Ordinance #4 Mr. March stated that Dean Johnson would like to meet with the City Council on April 14, 1999 at 5:00 p.m. This workshop would take place before the regular scheduled City Council meeting at 6:00 p.m. The Planning and Zoning Committee will be invited to attend this workshop, since Mr. Johnson is not able to attend the April Planning and 6 r - Zoning meeting. The purpose for this workshop will be to give input to the re- writing of Ordinance #4. Mr. March added that once this is completed, it will solve a lot of our problems. Grant fgantilpdates Mr. March gave an overview of the two Outdoor Recreation Grants that will be submitted to the DNR next week. A resolution for each grant will be on the consent agenda for the City Council meeting on March 24, 1999. The Acorn Creek estimated project cost is $91,640. We are asking for a grant in the amount of $45,820. We are also proposing a local match to come from park dedication funds. For the Acorn Creek park project, we will have about $10,800 of sweat equity from the residents that have volunteered to install the playground equipment. Councihnember Theresa Brenner recommended that a summary of the grant be included in the newsletter. Councilmember Brenner and Councilmember Sweeney agreed that the cover page of the grant, (photo of the City sign with children from the city surrounding the sign) should be on the cover of our newsletter. Councilmember Sweeney stated that if the picture was printed on an ink jet printer, it would produce a clearer picture. The Council supported the Acorn Creek Park grant application as well as the Laurie LaMotte Park grant application. PETITIONS AND COMPLAINTS - None VIII. UNFINISHED BUSINESS Meeting Minute Delivery Time Ms. Gaustad updated the Council on their past meeting discussion regarding the distribution of minutes which resulted in a tie vote. The discussion tapered to either having the minutes delivered within four business days of a meeting or have them delivered in the next packet. Councilmember Nelson felt the minutes should be delivered within four days in hopes to have faster and better communication. Councilmember Travis felt the Planning meeting minutes should be available prior to discussing items forwarded by the Commission. Mayor Wilharber felt providing service or addressing other needs maybe more important than receiving the minutes within four business days after a meeting. Mayor Wilharber noted that the City has two staff members and a Council liaison present at the Planning Commission and whom can report or update on the Council on issues. Councilmember Sweeney felt that the City should establish a policy and institute the delivery of minutes over a specific amount time. Motion by Councilmember Nelson, seconded by Councilmember Brenner to have Committee, Commission and Council meeting minutes four business days following a meeting. Further discussion: Councilmember Sweeney suggested a friendly amendment to implement this change after a computer and policy has been established. Motion by Councilmember Nelson, seconded by Councilmember Brenner to request the Committee, Commission and Council minutes are delivered within four business days, after the purchase of a computer and proper training. Nelson, Brenner, Sweeney Travis, aye; Wilharber opposed. Motion carried. Council Chamber Podium Ms. Gaustad distributed a copy of several photographs of podiums and their cost. Ms. Gaustad reminded the Council of podium options: such as a microphone, etc. Mayor Wilharber suggested the split podium that can be used for several purposes. Water /Sewer Rate Analysis - Fred Stenborg Mr. Stenborg gave a brief overview of the need to implement a water and sewer rate policy. Moreover, he presented his phase 1 analysis of the City sewer, water and storm sewer funds and their respective current rates. Mr. Stenborg specifically identified the replacement funds. Mr. Stenborg commented that they have prepared specific recommendations for a phase two study to address some concerns and limitations with the current utility rates for Sanitary Sewer, Water and Storm Sewers. Councilmember Nelson noted she is particularly interested in a phase two analysis. Current Utility Rates The current utility system gathers revenue with a combination of service charges from existing and new customers connection fees. The current system is summarized as follows: City Sanitary Sewer Rates: Quarterly Services Charge - $39 /residential units (senior discount $33/ unit) Connection Fee - $1750/ residential equivalent unit. City Water Rates: Quarterly Services Charges - $15 /unit minimum - $ 1.50/ thousand gallons of metered water. Connection Fee - $1,300 / residential unit $3,300/ buildable commercial acre. City Storm Water Rates: Annual Service Charges - $8 /residential unit and $24 / commercial unit New Development - $0.01546 /square foot of platted area New Construction - $200 / residential unit and $0.05/ square foot for commercial building (Please see attached) Motion by Councilmember Nelson, seconded by Councilmember Travis to approve phase two. Motion carried. 1999 Sealcoat Project - Attached Map Mr. Stenborg referred to the 1999 sealcoat project map and the specifications. NEW BUSINESS • Little League Agreement Mr. March explained the request for an agreement between the Chain of Lakes Little League and the City of Centerville. The Chain of Lakes Little League contributed a large amount of money to develop Laurie LaMotte Memorial Park and they would like to enter into an agreement with the City for scheduled uses of the park. The Little League needs to know the City's response to a proposal requesting priority and city maintenance. After review, Mr. Hoeft suggested that the agreement be changed to read the "Facility Maintenance Amendment" instead of "Facility Maintenance Agreement." This is in hopes to note the change that the City will maintain the park within its means, not to drag the field daily nor to clip the grass on certain days. Motion by Councilmember Brenner, seconded by Councilmember Nelson to approve the Facility Maintenance Agreement with the Chain of Lakes Little League. Motion carried. Mailbox Stands for Parkview Addition Mr. March gave a brief overview of the Parkview Developer, Richard Carlson's request to install mailbox stands and to amend the development agreement to reflect the change. In addition, Mr. Carlson would like the City to reimburse him the $25 fee that the City collects with each building permit to help defray the cost of construction of the stands. Moreover, the developer is willing to pay the additional cost to construct sawn cedar mailbox stands. Motion by Councilmember Travis, seconded Councilmember Sweeney to have the developer of Parkview be reimbursed $25.00 per structure, after the development complete. City Hall / Park Maintenance Mr. March gave a presentation on the current City program regarding the fertilizers and maintaince of the grounds for City Hall and parks. After discussing environmentally safe fertilizers the Council suggested Staff contact Mr. Randy Hagerty and the City Forester to discuss the advantages and disadvantages of different types of fertilizers and the most suitable for use. The Council took no action. Centennial School Facility Task Force Mayor Wilharber commented that the Centennial School Board authorized the initiation of a Facility Task Force to look at short and long -term student housing needs. The committee will be officially appointed by the School Board at its April 12, 1999 meeting. Mayor Wilharber commented that the School requested a name be forwarded to Mr. John McClellan, Superintendent of Schools by Friday, April 2, 1999 if possible. Councilmember Travis volunteered to represent the City in this matter. Board of Review Ms. Gaustad noticed that a Council workshop and the Board of Review are scheduled for April 7th and 8th, and she suggested the two meetings be conducted together on Thursday, April 8, at 6:00 p.m. The Council concurred the meetings should be conducted together. COMMITTEE REPORTS Tri City Task Force Mr. March noted the next meeting scheduled on March 30, 1999 at 7:00 p.m. Mayor Wilharber requested the Council's approval of the International Association of the Chief of Police formula. Motion by Councilmember Brenner, seconded by Counciimember Travis that the Council approve the International Association of Chief of Police formula for the CPLPD. Motion carried. XII. ADMINISTRATORS REPORT Mr. March requested Mr. Hoeft to explain the Uniform Housing Code (UHC) and how the board of appeals could be set up. Mr. Hoeft explained that the Council my find it beneficial to keep the board of appeals within the City organization, such as Planning and Zoning or the Council. However; the City may want to consider waiting, in order to fully understand the whole process and options that are available. The City of Minnetonka has set up a board of appeals within its government. Whereas, other Cities utilize the Planning Commission or the Council to be the Board of Appeals. Furthermore, enforcement may be a concern and it may be too difficult for the Building Official to handle it alone. Mr. Hoeft warned the Council of potential discrimination threats if the process is not followed closely. The adoption of the UHC allows for the City to clean up troubled areas. The easiest way is to make the Council the appeal board. Motion by Councilmember Nelson, seconded by Councilmember Brenner to authorize staff to enforce the UHC on a complaint basis. The Building Official will monitor and regulate the code and make the Council the board of appeals. Motion carried. XIII. I am requesting in behalf of the entire neighborhood that either the speed limit be reduced to 10 -15 mph or a " Slow Children at Play " sign be posted in the areas of Twin Lakes, 72 1/2 & Unity Avenue & 72nd St. So many cars are driving too fast and there are many children in these areas. On Unity Avenue alone there are approximately 20 kids between the ages of 2 -5. I am always outside watching my children and continually stressing that they need to watch for cars. On Saturday March 27, my 4 year old son was inches away from getting hit by a car in which a teenage girl was driving. It appeared that she was NOT paying attention to the kids playing in this area. We need this request taken care of before a tragedy occurs. We want our children to be able to ride their bikes without worry of someone speeding around the corner, not stopping at the stop sign, and injuring or killing one of our children. Visible enforcement of the current speed law, along with the cooperation of all area residents, will go along way toward reaching harmony in the neighborhood. Reducing the speed limit in one residential area would most likely necessitate the reduction of all residential speed zones. At that time, the Council elected to allocate the cost to benefited properties according to square footage. One of Mr. Rehbein's 38 acre parcels was no exception, and thus assessed accordingly ($152,498.77). Mr. Coatney (owner of Terminal Transport) was in the process of purchasing the property and signed a purchase agreement when the assessment was placed on the property. In their signed agreement, Mr. Rehbein and Mr. Coatney agreed that Terminal Transport, Inc. would be responsible to pay their assessment respective to the footage purchased. The two men agreed that Mr. Coatney's assessment responsibility is $30,548.12, and this amount would be assessed to his property until the term date of year 2008. Mr. Rehbein also entered into a similar agreement with Royal Oaks Realty ($100,000) containing corresponding stiplutations regarding assessments. However, this practice is not usually exercised by Cities. Under the stated circumstances, Mr. Rehbein requests that the City authorize Staff to reallocate the assessment as noted. Mr. James Hoeft will be in attendance to further discuss this issue. Introduction of City Council Liaison. Chairperson Tim Rehbine introduced Councilmember Dick Travis as the official City Council Liaison for the Economic Development Committee. OLD BUSINESS Design Team - "Ideas in Action" Mary Capra informed the committee that Ms. Penny Simonson and Ms. Lucy Thompson would be present on March 25, 1999 at 6:30 for a follow up- meeting to discuss the progress of the Design Team ideas. Ms. Capra stated that she would draft an agenda for the meeting. In addition, there will be a six month Design Team follow -up scheduled some time in June. This follow -up will be open to all residents, volunteers, and staff. A. Snowmobile Trail Update: Mr. Wayne LeBlanc has been actively involved in the Design Teams vision of Centerville's trails, lakes and parks. It was decided that the Economic Development Committee would monitor the progress of the trails through input from Mr. LeBlanc. B. Heritage Museum: The residents that are interested in this task group have been waiting for the city's decision on the status of a new public works building. Once this decision is made the group will be able to begin discussing the Design Team's vision of a Heritage Center. The Studebaker and the Antique Water Pump could be part of the museum. Committee member Capra mentioned that she has had several conversations with Mr. Bob Thein of White Bear Lake, who is extremely committed in the genealogy of Centerville. Mr. Thein has assisted Ms. Capra often with research and historical information, and is dedicated to seeing Centerville's history preserved. Chairperson Rehbine suggested that Ms.Capra ask Mr. Thein if he would like to work as a volunteer member for the Heritage Museum. Business Appreciation Dinner After a brief discussion, a tentative date of May 11, 1999, was set for the Business Appreciation Dinner. At that time, the Committee will create an invitation for this years dinner and develop a list of businesses that will be included. A current list of Centerville businesses, as well as home based businesses will be provided at the April 20, 1999 meeting. A suggestion was made to invite future Centerville businesses. This would ensure that both established and new businesses are recognized equally. Ms. Capra stated that Lloyd Drilling should be invited to give a short presentation on his strip mall. Mr. Johnson explained the purpose of revising the ordinance is to include amendments and to allow the ordinance to be more readable and `user friendly." Moreover, the contents of the ordinance encompasses; general provisions, zoning districts/use regulations/performance standards, administration and enforcement. Major point: Conditional Use Permits omitted and replaced with "Interim Use" which allows a use within a time frame; however, the Commission must identify "Interim Uses." Ms. Broussard Vickers questioned the possibility to place a moratorium on zoning changes, and building changes, until the ordinance is complete. Mr. Johnson explained that a moratorium does not require a public hearing if the City requests a delay in zoning and building construction until 1 the zoning ordinance is in place. Moreover, conflicting verbiage in the past ordinance on variance - when the Council makes a decision on a variance the only repeal made will be at the court level. However, the ordinance can reflect that Council will hear repeals. Ms. Broussard Vickers questioned if City should place the philosophy "Small Town Atmosphere" in the body of the ordinance. Mr. Johnson commented the ordinance will outline that theme through factual items. Mr. March questioned the approach the city should consider if a rezone or building change request is submitted. Mr. Johnson suggested the Commission work on the updated draft Ordinance #4. Motion by Mr. Buckbee, seconded by Ms. Broussard Vickers to adjourn the workshop meeting at 7:05 p.m. PUBLIC HEARING (S) A. Variance Request - Hanson (7149 Brian Drive) Mr. Eric Hanson requested the Commission to grant a variance for a three foot easement encroachment in order to build an addition. The Hanson's answered the Commission question that the situation is not unique and it doesn't have special conditions or circumstances that surround the reasoning behind the request. Ms. Broussard Vickers specifically questioned if without the request the Hanson family would be deprived of rights commonly enjoyed by other property owners. Ms. Joni Hanson said "No, that they are not being deprived of rights commonly enjoyed by other property owners." Ms. Broussard Vickers noted that Ordinance #4, Section 65. 03 -1 (Special conditions and circumstances exist which are peculiar to the lanc4 structure or building involved and do not result from the actions of the petitioner.) Ms. Joni Hanson explained that there are no special or peculiar circumstances that surrounds the request. Mr. Buckbee questioned if the Hanson house could expand the addition to the west (rear yard) Mr. Hanson explained that there is a 12 X 24 screened porch that limits the addition possibilities. Motion by Broussard- Vickers, seconded by Mr. LaMotte to close at 7:20 p.m. B. Variance Request - Vesel (7055 - 21st Street) Motion by Broussard Vickers, seconded by Mr. Buckbee to close the Pubic Hearing. Motion carried unanimously. C. Variance Request - Wolf Ms. Welk opened the meeting by explaining that Mr. Wolf addressed the Commission during the 2 last meeting and had requested to construct an accessory building in his side (rear) yard. Mr. Wolf expressed the desire to construct an accessory building as soon as possible. Mr. Craig Kurds (1902 Center Street) expressed concern that the building will be closer to his structure than Mr. Wolfs house. Mr. Michael Carter (6173 Sumac Court) stated that he has no problem with Mr. Wolf constructing an accessory building (See attached letter). Hearing no further comments the Commission took the following action: Motion by LaMotte, Mr. Broussard Vickers seconded by Mr. Buckbee to close the public hearing. Motion carried unanimously. D. Rezone Request - Rehbein (Property East of Willow Glen) Ms. Gaustad gave a brief overview of the proposed request to rezone the property east of Willow Glen town home development. Mr. Rehbein explained the property zoned commercial is surrounded by commercial properties and requested the rezone be granted. Mr. Buckbee questioned the road and traffic circulation. Mr. Dale Rukel (Bright Keys) is looking to expand and the property assist the process. Willow Glen's (Sales and Marketing Manager) noted that 55 of 62 existing property owners have signed a petition requesting the City change the zoning status from commercial to residential. Ms. Debra Kopp (2055 Willow Circle) voiced concern about high density and the possibilities of the town homes developing like Willow Glen. Ms. Norma Essix (7333 Old Mill Road) commented that the city needs the Commercial tax base. Mr. Hanson questioned the traffic stress on Main Street. Mr. Rehbein commented Anoka County has restricted access onto Main Street. Motion by Ms. Broussard Vickers seconded by Mr. Hanson to close the public hearing. Motion carried unanimously. APPEARANCE (S) ACTION ITEMS A. Action on Variance Request - Hanson Chair Welk noted receipt of a letter indicating consent to the variance request which is signed by two property owners. 3 Ms. Broussard Vickers mentioned the Planning and Zoning commission's requirement to grant a variance and the situation is not unique. Therefore, she did not recommend granting the variance. Motion by Broussard Vickers, seconded by Mr. Buckbee to deny the variance request based on the ordinance requirements outlined in Section 65.03 -1. Motion carried unanimously. B. Action on Variance Request - Vesel Ms. Gaustad distributed pictures of the proposed structure. Motion by Ms. Broussard Vickers, seconded by Mr. Buckbee to recommend to the Council to deny the variance request based on the fact that it does not conform to the requirements of the ordinance and violates Ordinance #4, building material as well as the building is within the right - of -way. Motion carried unanimously. C. Action on Variance Request - Wolf Ms. Broussard Vickers explained that there are too many issues to discuss; side yard, rear yard, size of building, etc. In short, Ms. Broussard suggested waiting until the ordinance is in place. Motion by Broussard Vickers, seconded by Mr. Buckbee to table this request until the May meeting - due to new ordinance consideration. Motion carried unanimously. D. Rezone Request - Rehbein (Property East of Willow Glen) Ms. Gaustad distributed a letter that the City received that is in favor of the rezone request. Chair Welk noted receipt of the letter. Ms. Broussard Vickers inquired about the comparisons in tax base between commercial or residential. Mr. Rehbein stated that the residential zoning will benefit the tax base more than commercial. The Commercial tax will not go into effect until after the buildings are constructed and taxed. Ms. Broussard Vickers questioned if the Met Council will have concerns with a rezone change. Mr. March felt that Met Council may have more concerns with providing utilities than the rezone. Ms, Jenny Gilmore (2031 Willow Glen) would rather see residential zoning than commercial. Councilmember Ms. Mari Nelson said that she would rather have the property zoned commercial instead of residential. Chair Welk questioned the traffic circulation and potential traffic congestion concerns. A gentleman from (2005 Willow Glen) will increase his property value and strongly urged the Commission to consider authorizing residential zoning. 4 Mr. Brett Baily (2037 Willow Circle) said he would rather see the rezone approved than leave it commercial. Motion by Mr. Buckbee, seconded by LaMotte to table the rezone contingent upon Mr. Rehbein signing a 45 day waiver and that Staff report the tax difference between commercial and residential. Motion carried unanimously. DISCUSSION ITEMS A. Subdivision Sketch Plan - Mr. Gerald Rehbein The Commission discussed the 15 parcel subdivision sketch for R5 homes. The Commission acknowledged that the cul -de -sac should be placed at the end of the road, 5 variances for lot size and lot width. Mr. Rehbein commented that a sound drainage plan would require the row of trees to be removed. Ms. Broussard Vickers recalled the City granted variances for the Lessard development and may be permissible with the peculiar wetland issues. Mr. Wayne LaBlanc (1677 Peltier Lake) would prefer Mr. Rehbein attempt to meet with the R5 requirements. The Commission discussed in great length PUD (Planned Unit Development) and its requirements. The Commission requested staff seek legal guidance as to whether or not a variance takes precedence over a PUD. Motion by Ms. Broussard Vickers, seconded Mr. Buckbee to direct staff to contact the attorney and receive input in regards to whether a variance or a PUD, and to work with the developer on the best way to address the wetland issues. Motion carried unanimously. 13. Consider audio /video taping meeting Ms. Gaustad reported the Council requested the Commission consider audio or video taping meetings for reference purposes. Motion by Broussard Vickers, seconded by Mr. Buckbee to approve that the Commission meetings be audio taped. Motion carried unanimously. C.
