We received the plan set on June 30, 1998. We would Tike to take this opportunity to offer the following preliminary comments on the plans and plat. We will have additional comments at the July a, 1998 planning and zoning meeting. ZONING ISSUES At the previous planning and zoning meeting In June, we discussed this plat and the potential for a zoning change on the property. Currently, only the eastern 300 feet is zoned for commercial use. The developer is seeking a mixed use designation. We recommend that this plat, whatever the final configuration. be considered as a PUD. The and location adjacent to commercial and industrial areas as well as residential areas lends itself to a mixed use development, transitioning from residential on the western side to commercial on the eastern side of the parcel. BRIAN DRIVE — STREET ISSUES One item that needs to be discussed at the July 6 planning and zoning meeting is the proposed streets within this development. There has been discussion in the past of the road providing access to 200 Avenue connecting with Brian Drive to farm a through street. The current plan shows the road off of 20 Avenue ending In a cul -de -sac. Brian Drive would be extended to the south and connect with Eagle Trail, part of the Eagle Pass development. At the June 2 planning and zoning meeting, several residents in the area attended the meeting to discuss development of this parcel and along 20 Avenue. Residents of Clearwater Meadows and possibly even the Center Oaks 2 development will most likely oppose a road connection with 20 Avenue. MN 55108 • 612/8 fax 612/644.9448 toll free 888f388-4389 ILL -02 -1998 08 38 P.03/09 Mr. Jim March July ' , 1998 Page 2 UTILITIES As we discussed at the previous planning and zoning meeting, we are working with the developer of this parcel to finalize the alignment of the forcemain for the 20 Avenue utility project. The forcemain alignment is proposed through the Center Villa property. The plan submitted for review shows the forcemain extending along the cul-de -sac, down !ut lines to Brian Drive, and connecting into a sewer manhole extended south from Brian Drive. If the planning and zoning committee can provide direction to the developer with respect to the alignments of streets and lot layouts an the plat, we may be able to secure a revised forcemain alignment that will fit the future configuration of the streets. The forcemain could be constructed through the middle of the development, where there Is considerable open area. This would allow the dense row of trees along the north side of the parcel, along the current proposed forcemain alignment, to remain in place and continue to serve as a landscape buffer between the property and the homes along Brian Drive and at the end of Brian Court. We will provide more information on this issue at the planning and zoning committee meeting next week. SUMMARY Obviously, the zoning change the developer Is seeking on this parcel is probably the most important issue for discussion. The developer will be In attendance at the July 6 meeting to discuss the proposed land use change and the possible uses for the commercial properties. Ordinance #44 -A, Section 2. Now Reads: All buildings erected on land within the commercial and industrial zoning districts shall be of wood frame, steel, reinforced concrete, masonry or an equivalent or better material. No building shall have pole barn type construction nor an exterior wall surface of sheet metal. Exterior wall surfaces of all buildings shall be face brick, glass, stone, decorative block, architectural concrete cast in place, pre -cast concrete panel or architectural metal panel. Wood may be used as a trim material. Amend to Read: Light Industrial /Industrial Districts All buildings erected on land within the light industrial and industrial zoning districts shall be constructed with the main wall component being masonry, concrete or structural iron. No building shall have pole barn type construction nor an exterior wall surface of sheet metal in excess of 25% of the surface area. Exterior wall surfaces shall be of non - combustible materials, the trim materials are excluded from this requirement. Contrasting architectural features must be included to highlight the exterior wall faces. This may include contrasting building materials and /or colors. The intent is to develop aesthetically pleasing buildings. The building design will be reviewed and approved by the Planning Commission. Commercial Districts Buildings in the commercial zoning districts shall be constructed with the main wall component being wood frame, masonry, concrete or structural iron. We received the plan set an July 1, 1998. We would like to take this opportunity to offer the following preliminary comments on the plan and plat. We will have additional comments at the July 6, 1998 planning and zoning meeting. • At the June planning and zoning meeting, the Travis' were present to request a building permit for one single family home on the proposed development They are requesting a building permit to construct a new home on lot 8, block 1. BRIAN DRIVE CUL -DE -SAC EXTENSION The street serving the development will be an extension of Brian Drive. Brian Drive would be extended approximately 600 feet to a temporary cul -de -sac. City Ordinance #8, paragraph 28.03 limits cul-de -sacs to a length of 800 feet. However, the 600 feet proposed for construction will be added on to what is currently a dead end street. The total ' ength of the cul-de -sac from 73' Street to the temporary cul -de -sac will be approximately 900 feet. While the cul -de -sac is proposed to be temporary, some discussion should occur at the July 6' meeting regarding future road connection points north of Revoir Street and this proposed plat. Revoir Street is another long temporary cul-de -sac. Drainage calculations need to be provided tor the street runoff contribution to the Center Hills deve :cpment, as well as calculations showing the sizing of the proposed pond on lots 2, 3, and 4, Block 2. A large Mn/DNR protected wetland is located through the center of the plat. if this wetland is landlocked, volume calculations should be Compieted to show the 100 -year high water level of the wetlard. Permits will be required from the Rice Creek Watershed District and possibly the Mn /CiNR for the wetland impacts shown on the grading plan. No mitigation site is shown on the plan. PRELIMINARY PLAT • Perimeter drainage and utility easements should be shown for each lot. • Drainage and utility easements should be shown around all wetland areas. • A 20 -foot drainage and utility easement should be shown along the proposed storm sewer between lots 3 and 4, block 2. • Ownership designation of Outlot A Will be required In the developers agreement. • A dditional right -of -way would be required for the temporary cul- de-sac as shown on the plat. The cul-de -sac boundaries extend beyond the proposed right -of -way, GRADING PLAN • Pond and wetland normal and high water levels should be shown on the grading parr. • Proposed contours should be shown on the grading plan. The grading plan only shows existing contours. • As indicated above, stom sewer and drainage calculations should be provided for the development. SUMMARY At this time, the developer of the project is requesting a change in the zoning of the property. The proposed zoning designation is R5. The developer would also like to secure a building permit as soon as possible for construction of a home on lot 6, block 1. Shin N.. e 04 t 4. �w.r ... w:TU.••n • 1 MEMO DATE : May 1, 1998 TO Planning Commission FROM : Jim March RE Amendment to Ordinance #5 - Discharge of Firearms The police department has had some difficulties in trying to enforce Ordinance #5 the way that it is currently written. This item has been referred to the Planning Commission by the City Council. The main issue is that the current Ordinance does not eliminate the discharge of firearms (shotguns) that emit multiple projectiles within the corporate limits. Duck hunters, trap- shooters, etc. are not banned from discharging their firearms as long as they are shooting multiple projectiles. This item needs to be amended in the current Ordinance. Enclosed in your packet is a copy of the Weapons Ordinance that was adopted this year by the City of Circle Pines. The Circle Pines Ordinance also defines other weapons of less than mass destruction. I would recommend adopting the same Ordinance to have consistency within the Cities for the enforcement by the police department. ORDINANCE NUMBER 5 AN ORDINANCE TO PROTECT AND PRESERVE THE PUBLIC'S SAFETY BY REGULATING THE DISCHARGE OF FIRE ARMS WITHIN THE VILLAGE OF CENTERVILLE AND PROVIDING A PENALTY FOR VIOLATION THEREOF. THE VILLAGE COUNCIL OF CENTERVILLE, MINNESOTA DO ORDAIN AS FOLLOWS: SECTION 1: It shall be unlawful to shoot, fire off, discharge or explode any gun, pistol, revolver, or other firearm or device which ejects a projectile, upon or onto: Any road, street, avenue, sidewalk or other public place in this village. SECTION 2: It shall be unlawful to shoot, fire off, discharge or explode any single ball ammunition in the Village except upon ranges permitted by the Village Council. SECTION 3: It shall be unlawful to own or operate a rifle or shooting range in this Village unless a permit therefore be issued by the Village Council. The fee for such permit shall be $15.00 and said fee shall be paid to the Clerk prior to issuance thereof. SECTION 4: Nothing herein contained shall prohibit the use of firearms: a) by duly authorized policemen or law enforcement officers, b) by persons engaged in the lawful defense of person, persons, or property. SECTION 5: Any person, firm or corpor'ation violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding three hundred dollars ($300.00) or by imprisonment not to exceed ninety (90) days. Subd. 32.03 -04 "Political Signs" Attached please find a few of the surrounding communities political sign ordinance. The following is submitted for your consideration. CURRENT ORDINANCE: Political signs are allowed in any district on private property with the consent of the owner of the property to a maximum size of sixteen (16) square feet per side. Such signs must be removed by property owner within seven (7) days following the date of the election to which they apply. AMEND TO READ: Political signs shall not exceed eight (8) square feet in area in residential districts and 32 square feet in all other districts. Such signs shall not be erected prior to the first day of filing. Such signs shall be removed within seven (7) days after the election to which they are applicable. Each such sign shall contain the name and address of the person responsible for the placement of the sign. Such persons shall be responsible for the removal. Signs are prohibited in the public right -of -way. R , • Circle Pines (1330.03 k.) Political Campaign Signs. Signs designating candidates seeking public political office and other data pertinent thereto shall be permitted on private property only, provided that the property owner's permission has been obtained, as follows: a maximum area of nine (9) square feet for each premise in a residential zone and maximum area of thirty -two (32) square feet In a commercial or industrial zone. These signs shall be located on private property and shall not be less than fifteen (15) feet from the nearest edge of the pavement and fifty (50) feet from the nearest curb line intersection of any street or road. These signs may be displayed thirty (30) days prior to five (5) days after the election for which they are intended. If a general election follows within sixty (60) days of a primary election, those candidates who were successful in the primary election may continue to display their signs until five (5) days after the general election. Signs placed in violation of this Section are subject to immediate removal. Columbia Heights Following are criteria pertaining to the use of political signs in residential areas: Allowed provided they do not exceed eight (8) square feet per surface, and limited to two (2) surfaces, provided they are displayed not more than thirty (30) days prior to an election or referendum and not more than seven (7) days following said election or referendum for which the sign is being erected. The code is a supplement to the Uniform Building Code. This item needs to be discussed. The City has been receiving several complaints from residents in regards to the conditions of buildings on their neighbors property. I will have Paul Palzer at the meeting to discuss how adopting this code could aid the City in enforcing a certain standard of housing maintenance.
