ADJOURNMENT Memorandum To: Honorable Mayor and Council From: Diane Ward, City Clerk Date: 11/15/99 Subject: Hearing on Delinquent Sewer and Water Bills At the November 10 meeting, Council called for a hearing on the proposed special assessment of delinquent sewer and water bills. Affected residents were notified of the delinquency and had until November 12, 1999 to pay the delinquent bills. Council should conduct the public hearing and if Council wishes to have these delinquent charges certified to the County they should pass a motion adopting Resolution No. 99 -20, adopting the special assessments. Michael Navin is scheduled to appear to discuss the Park and Recreation Committee's goals for the next three years. Mr. Navin will also be presenting Park and Recreation's justification for an increase in the park department budget for the year 2000. MEMO Date: November 18, 1999 To: Honorable Mayor and Council From: Jill Lien Re: Park and Recreation Year 2000 Budget Attached is a itemized list of goals the Park and Recreation Committee has established for the next three years for the parks in the City. Please note the motion made, and also the fact that the Park and Recreation Committee would like to establish an Enterprise Fund for the future. Thank You!! Budget 2000 There was a lot of discussion regarding the Park and Recreation budget for the year 2000. Based on historical use, $20,000 out of the $50,000 proposed budget would be projected for labor, maintenance and other known park expenses. The Park and Recreation Committee came up with the following budget which forcasts over the next three (3) years. CALL TO ORDER Mayor Wilharber called the November 10, 1999 City Council meeting to order at 6:00 p.m. II. PUBLIC HEARING (S) NONE III. APPEARANCES /AWARDS Lino Lakes Area Chamber of Commerce Mr. March stated that Mr. Tim Rehbine would try to be in attendance toward the later part of the meeting. IV. CONSIDERATION OF MINUTES October 26 and October 27, 1999 Council Meeting Minutes Motion by Council member Nelson, seconded by Council member Travis to approve the October 26, 1999 Council workshop minutes. Motion carried unanimously. Motion by Council member Travis, seconded by Council member Broussard Vickers to approve the October 27, 1999 Council meeting minutes. Motion carried. Motion carried unanimously. Centennial Fire District Motion by Council member Travis, seconded by Council member Nelson to approve the Centennial Fire District ratification of expenditures. Motion carried unanimously. Water Interconnect — Pay Request No. 1 Motion by Council member Sweeney, seconded by Council member Broussard Vickers to approve the Water Interconnect — Pay Request No. 1. Motion carried unanimously. VI, SET AGENDA NEW BUSINESS: 5. Resolution 99 -19 Delinquent Sewer and Water Bills To Be Certified to County 6. Meeting Changes due to Thanksgiving and Christmas Holidays Motion by Council member Sweeney, seconded by Council member Travis, to approve the agenda with additions. Motion carried unanimously. VII. PETITIONS AND COMPLAINTS - NONE VIII. UNFINISHED BUSINESS Eagle Trucking Appraisal Mr. March stated that the City received a signed option, prepared by the City Attorney, on the Eagle Trucking site. He has contacted the appraiser the City has used in the past to schedule an appraisal and she will complete the appraisal as soon as possible. He also advised Council that Mr. Huber has removed the last underground tank on the property and the soil tests of the property should be available in the near future. The option was in consideration of $1.00 which just leaves the price to negotiation. The option was for a 90 -day term, or February 15, 2000. Page 2 of 6 IL - Rental Property Ordinance Mr. March reviewed the rental ordinance with Council. He recommended that the language in Section 38.12, Subd. 2 be changed to read "....including any provision of the Uniform Housing Code" instead of the presently stated language. Council member Broussard Vickers expressed concern regarding the exception of "domestic assaults in Section 38.152, Subd. 2.10. City Attorney Hoeft explained the reason that domestic assaults were excepted, but the section could be changed to include domestic assaults. It was the consensus of Council to make the change to include domestic assaults. Motion by Council member Broussard Vickers, seconded by Council member Travis to direct staff to make the changes and prepare a Title and Summary for Council review at the November 22, 1999 meeting. Motion carried unanimously. Council Chambers Rental Policy — For -profit Organizations Mr. March reviewed the draft rental policy with Council. Motion by Council member Broussard Vickers, seconded by Council member Nelson to adopt the Council Chambers Rental Policy. Motion carried unanimously. Tri-City Police Joint Powers Agreement Mr. March stated that he spoke with the City Administrators of Circle Pines and Lexington to find out where they are in the process of reviewing this document. Mr. March stated that the attorneys for both cities are currently reviewing the document. He also stated the city attorneys and city administrators for all three cities would be meeting to try and hammer out language in the agreement so that hopefully the agreement can be approved the first meeting in December. City Attorney Hoeft stated that he only has suggestions that are policy related. Mayor Wilharber stated that the issue of non - payment would be addressed at the next meeting of the police commission. He also stated that he received a question in relation to a "Joint Civil Service Police Commission." City Attorney reviewed the John Civil Service Police Commission issue. He stated that he would not recommend that a Civil Service Police Commission be formed St. Paul Water Utility Surplus Property — Peltier Lake Flowage Mr. March stated that the Parks and Recreation Committee reviewed the surplus property issue and that they recommend that the City does not acquire this property for park purposes. Page 3 of 6 Motion by Council member Nelson, seconded by Council member Travis directing staff to prepare a letter to St. Paul Water Utility informing them that the City of Centerville does not wish to acquire the parcel known as the Peltier Lake Flowage. Motion carried unanimously. Public Works Site — Request for Proposals Mr. March reviewed the draft Request for Proposals. Council consensus was to not have a minimum purchase price and to make people in the area aware of what the City is proposing. Councilmember Broussard Vickers stated that along with the proposal a letter should be sent letting proposed developers know that the City is making residents aware of this proposal in case they wish to approach surrounding residents. Mr. March stated that he would also state in the letter to the residents that the City Engineer is currently preparing a feasibility study for running utilities to the site and that one of the components is the street scape enhancement in the downtown area. Mayor Wilharber addressed the issue of rebuilding Heritage. Mr. March stated that it might be best to have this project as a separate project. Mr. March stated that Mr. Peterson would have the feasibility study for the water main extension completed for Council review at the first meeting in December. Motion by Council member Broussard Vickers, seconded by Council member Nelson directing staff to proceed with the Request for Proposal process and before sending proposals to prepare a letter to residents in the area (350 feet) to inform them of what the City is proposing. Motion carried unanimously. IX. NEW BUSINESS Abatement of Special Assessments (Parkview Addition) Motion by Council member Travis, seconded by Council member Nelson adopting Resolution No. 99 -18, RESOLUTION FOR ABATEMENT OF SPECIAAL ASSESSMENTS (PARKVIEW ADDITION). Motion carried unanimously. Metropolitan Council Easement near Cedar Street Park Mr. March reviewed the temporary easement acquisition and the proposed offer by the Metropolitan Council. He stated that if Council did not act on this offer that it would be placed on the condemnation list. Page4of6 Motion by Travis, seconded by Nelson to accept the Metropolitan Council's offer for the easement near Cedar Street Park. Motion carried unanimously. Lloyd Drilling — Appletree Square Trail Issue Mr. Drilling stated that the Rice Creek Watershed District does not want him to construct the trail. He stated that they would rather see plantings in that area. Council stated they are concerned about safety in the area and want the trail installed. Employee Paid Holidays W0 • 1 - 5 V Mr. March explained the difference between the union contract and the personnel policy with relation to holidays. He recommended that Columbus Day be deleted from the current personnel policy and add the day after Thanksgiving as stated in the union contract and not add a floating holiday for 1999. The year 2000 olidays would be the same as the union contract. Motion by Council member ney, seconded by Council member to accept the written recommendation and adopt the same holiday schedule as in the union contract. Motion carried unanimously. This summary needs to be accepted for publication. Also included in your packet is a complete copy of the proposed ordinance. Language has also been modified to allow property owners the option of certifying that their units meet the requirements of the Uniform Housing Code without the City having to inspect each unit prior to issuance of a registration certificate. Upon application for a registration certificate, each landlord will be provided a copy of the Uniform Housing Code along with language spelling out reportable conditions that they need to include in their leases with tenants. The rental registration certificate fee should be adopted at this meeting. Included in your packet is a copy of the 1997 rental fees charged by other communities with a rental housing ordinance. CITY OF CENTERVILLE ORDINANCE NO. 38 HOUSING CODE: REGISTRATION OF RENTAL UNITS 38.01 Registration Certificate Required. No owner shall allow another person to occupy or let to another for occupancy any dwelling, or any apartment or rooming unit in any dwelling without first obtaining a registration certificate as provided in this chapter. Any registration certificate obtained pursuant to this section shall be issued in the name of the owner. In the case of a multiple unit dwelling, a registration certificate issued pursuant to this section includes and applies to both the entire dwelling as well as each individual rental unit within the dwelling. Any suspension or revocation of the registration certificate may involve the entire dwelling or an individual unit or units within the dwelling. 38.02 Application for Registration Certificate. An application for a registration certificate shall be filed by the owner at City Hall. An application for any dwelling to be converted to a use which would require a registration certificate shall be made at least 30 days prior to such conversion. 38.03 Housing Code Violations. Any violation of the Uniform Housing Code brought to the owner's attention which is not brought into compliance within the time frame provided in the violation notice shall constitute grounds for suspension or revocation of a license. 38.04 Applications Each application for registration certificate shall contain the following information: (1) Name, residence address, telephone number, and date of birth of the owner of the dwelling. If the owner is a partnership, the name of the partnership, and the name, residence address, telephone number, and date of birth of the managing partner. If the owner is a corporation, the name and address of the corporation, and the name, address, telephone number, and date of birth of the Chief Operating Officer. If the dwelling is being sold on a contract for deed, the name and address of the vendee. (2) Name, residence address, telephone number, and date of birth of any agent appointed by the owner to accept service of process and to receive or give receipt for notices. 1 (3) Name, residence address, telephone number, and date of birth of any agent actively involved in maintenance or management of said dwelling. (4) Legal address of the dwelling. (5) Complete details of the number and kind of units offered for rent, classified as to the type of unit on the application, and the facilities incorporated in such rental units. (6) Any person making application for a rental registration certificate must provide proof of identification by the use of a driver's license, state issued identification card, military identification card, or such other identification as is acceptable to City staff to provide proof of identification. The identification provided must set forth the full name and date of birth of the person making the application. 38.05 Compliance with the Zoning. No rental registration certificate will be issued to properties that are not in compliance with the appropriate zoning requirements. 38.06 Investigation. Staff may investigate any application for a registration certificate to verify that the dwellings, apartments, or rooming units offered for rent comply with the provisions of the Uniform Housing Code. 38.07 Issuance and Posting of Registration Certificate. Whenever the investigation of an application indicates that the dwellings, apartments, or rooming units offered for rent comply with all provisions of the Uniform Housing Code or the owner certifies that the unit(s) meets the provisions of the Uniform Housing Code, staff shall issue a registration certificate. Every registrant of a dwelling, apartment or rooming unit offered for rent shall post the registration certificate in a conspicuous place within said dwelling, apartment or rooming unit. 38.08 Notice of Violation. Whenever an investigation of an application for registration certificate indicates that the dwelling, apartment or rooming unit offered for rent does not comply with the provisions of this code, building inspections staff shall serve a notice to the applicant. Additionally, owners of rental property must give notice of outstanding violations to potential purchasers of such property. 38.09 Rejection of Application. Whenever the investigation of an application for registration certificate indicates that the dwelling, apartment or rooming unit does not comply with the provisions of this ordinance, and from the nature of the violations, the dwelling, apartment or rooming unit can not be brought into compliance with this ordinance, then the Page 2 of 8 application for registration certificate should be returned to the applicant. 38.10 Appeals. Any applicant whose application for registration certificate, after investigation has been rejected, may request and shall be granted a hearing in the matter before the City Council. 38.11 Failure to Register. Subdivision 1. Every person required to register a dwelling, apartment, or rooming unit offered for rent under the provisions of this chapter and who fails to do so shall be guilty of a violation of this code. Each day that a property is rented out without a valid rental registration certificate on file for that property is a separate violation. A violation of this section shall be a misdemeanor. Subdivision 2. Any person who rents out to another any type of unit to be used for human habitation without first making out an application for a housing registration certificate shall be assessed a penalty fee. 38.12 Certificate Renewal and Non - transferability. Subd. 1. All registration certificates shall expire one year after date of issuance and must be renewed annually. All information required by Section 38.04 of this chapter must be submitted at the time of renewal. Whenever the applicant certifies that no change has been made in a registered dwelling, apartment, or rooming unit, a renewal registration certificate may be issued provided the units are in compliance with the Uniform Housing Code. Subd. 2. A registration may be suspended or revoked if it is found that at any time after issuance, the rental property as a whole, or any of the units therein, are not in compliance with this code, including any provision of the Uniform Housing Code. Subd. 3. Every person who transfers title to property registered under this chapter shall provide City Staff with the name, residence address, telephone number, and date of the transfer of title to the new owner within 30 days of the date of such transfer. Within 60 days of the date of such transfer, the new owner shall apply for a new registration certificate. In the case of an option contract where the holder of the option is collecting rents and/or is paying on the mortgage to the property while the option remains unexercised, the holder of the option shall be deemed to be the owner of the property for purposes of this section and shall be required to apply for a rental registration certificate in his/her name. The date of option contract is created shall be deemed to be the date the holder of the option becomes the "owner" for purposes of this section. Subd. 4. Registration certificates may not be transferred or assigned. Page 3 of 8 38.13 Fees. Fees per unit and penalty fees will be set with the annual fee resolution. 38.14 Legislative Intent. It is declared to be the purpose and intent of sections 38.15 through 38.18 to protect and preserve this city's neighborhoods and the public health, safety, welfare and morals of those who live there. The Centerville Council determines that: (1) there are persons residing in rental property in Centerville engaging in disorderly conduct which results in a hostile environment for other Centerville citizens living close to the rental property; (2) there is currently no city ordinance which provides a formal procedure by which the City can notify a rental property owner or manager of the disorderly conduct occurring on the property; (3) there is currently no procedure by which the City can require a rental property owner or manager to respond to and resolve the occurrences of disorderly conduct occurring on his or her rental property and to take administrative action against his or her rental registration certificate should he or she fail to do so. Accordingly, it is the intent of Section 38.15 through 38.18 to address the serious and, at time, life threatening problems posed by the occurrence of disorderly conduct to the health and safety of all Centerville residents in all portions of this city. At the same time, the City Council recognizes, acknowledges, and complies with all due process and property rights enjoyed by those who own or manage rental property as well as those who reside in such property. This ordinance represents the City's good faith effort to balance those competing and legitimate interests. 38.15 Definitions. For the purpose of this subdivision, the following terms shall have the meanings ascribed to them. Appropriate action shall mean that action which a reasonable license holder would take based upon the facts and circumstances of each case so as to prevent a reoccurrence of the disorderly use. License shall mean a registration certificate as required by this chapter of the Centerville City Code. Licensee or License Holder shall mean one who holds the license as required by this chapter of the Centerville City Code. Licensed Premises or Premises shall mean the property owned, operated, or managed by a Licensee Holder and shall refer to an individual unit within a multi -unit complex when applicable. Page 4 of 8 Disorderly or Disorderly Use shall mean that conduct occurring on Licensed Premises which violates Section 38.16(2). 38.16 Conduct on Licensed Premises. Subd. 1. Any license holder shall be responsible to take appropriate action against persons occupying specific units in the licensed premises who conduct themselves in such a manner as to cause the premises to be disorderly in violation of the statutes or ordinances listed in Subdivision 2. Those persons occupying the premises shall include tenants as defined by Minn. Stat. § 566.18, and those persons on the licensed premises whose presence that tenant has invited or to which the tenant has acquiesced. Violations of this section apply to individual units within buildings or complexes containing multiple units. Subd. 2. The following ordinances and statutes are applicable to this section: (1) Minnesota Statutes prohibiting prostitution; (2) Minnesota Statutes prohibiting indecent conduct; (3) Minnesota Statutes prohibiting participation in a disorderly house; (4) Minnesota Statutes Section 617.23 through 617.299 prohibiting obscenity; (5) Minnesota Statutes Sections 609.75 through 609.76 which prohibit gambling; (6) Minnesota Statutes Section 152.01 through 152.025 and Section 152.027, Subd. 1 and 2, which prohibit the unlawful sale or possession of controlled substances; (7) Minnesota Statutes Chapter 340A which prohibits the unlawful sale, use or possession of alcoholic beverages; (8) Minnesota Statutes Section 97B.021, 97B.045, 609.66 through 609.67 and 624.712 through 624.716, which prohibit the unlawful possession, transportation, sale or use of a weapon; (9) Minnesota Statutes Section 609.72 which prohibits disorderly conduct; or, (10) Minnesota Statutes Sections 609.221, 609.222, 609.2231, 609.223, and 609.2242 which prohibit assaults. Page 5 of 8 Subd. 3. The police shall be charged with the responsibility of enforcing Subdivision 2. Subd. 4. Upon determination by the police that the licensed premises were involved in a disorderly use, City staff shall notify the license holder by regular mail of such violation and direct the license holder to take appropriate action to prevent further violations. Notice shall be effective if mailed to the license holder at the person's last known address. Subd. 5. If another instance of disorderly use on licensed premises occurs within twelve (12) months of an incident for which notice in Subdivision 4 of this section was given, the license holder shall be notified of the instance of disorderly use and shall also be required to submit a written report of appropriate actions taken by the landlord to prevent further disorderly use of the premises. This written report shall be submitted to the housing inspector within five (5) days of the notice of disorderly use of the premises and shall, in addition to the report of appropriate actions to be taken, detail all actions taken by the license holder in response to all notices of disorderly use of the premises within the preceding twelve (12) months. Failure to submit the written report as required herein shall be a basis for the imposition of a fine and the revocation or suspension of the license for the specific units or units located on the license premises as otherwise provided for in this chapter. Subd. 6. If another instance of disorderly use of the premises occurs within twelve (12) months after receipt of notice pursuant to Subdivisions 4 and 5, the license may be revoked or suspended for specific unit or units located on the licensed premises. If the notice of violation has been issued with respect to a common area of a building or complex of buildings then the license as to all units in such building or complex may be suspended or revoked. Subd. 7. No suspension or revocation shall be imposed where one or more of the three required disorderly use notices were mailed or delivered to the landlord after the landlord has filed an unlawful detainer action with the district court for the particular unit or units identified in the disorderly use notice. Calls to police made by licensees shall not be considered incidents of disorderly use in initiation of an unlawful detainer action shall not be a bar to sanctions, however, unless the action is diligently pursued by the license holder. A copy and notice of the unlawful detainer action shall be delivered to the City Administrator. A determination that the licensed premises have been involved in a disorderly use as described in Subdivision 2 shall be made upon a preponderance of the evidence. It shall not be necessary that the criminal charges be brought to support a determination of disorderly use, nor shall the fact of dismissal or acquittal of such a criminal charge operate as a bar to adverse license action under this section. Subd. 8. All written leases for licensed premises executed after adoption of this ordinance, Page 6 of 8 shall contain a clause providing that conduct which would be in violation of Subdivision 2 shall constitute both a material breach of the lease and grounds for termination of such lease. Subd. 9. This ordinance is not intended to supersede criminal sanctions that may be applied to the individual who violates the statutes and ordinances listed in Subdivision 2. 38.17 License Suspension and Revocation. Subd. 1. Upon a determination that a license may be suspended or revoked, or that a fine may be imposed, a public hearing shall be held before the City Council. All parties shall be afforded an opportunity to appear at such hearing after receiving reasonable notice. The notice shall state the time, place, and issues involved. At this hearing, license holders may present evidence of mitigating circumstances. At the conclusion of the hearing, the City Council shall make a decision. Subd. 2. The City Council reserves the right to impose any of the following sanctions for violations of Subdivision 38.16(2): (1) suspend the license for up to 60 days; or (2) revoke the license; or (3) impose a civil fine not to exceed an amount equal to one months' rent for each violation found as a result of the hearings; or (4) impose other reasonable conditions intended to limit future incidents of disorderly use. No owner shall allow another person to occupy or let to another for occupancy any dwelling, or any apartment or rooming unit in any dwelling without first obtaining a registration certificate as provided in this chapter. Any registration certificate obtained pursuant to this section shall be issued in the name of the owner. In the case of a multiple unit dwelling, a registration certificate issued pursuant to this section includes and applies to both the entire dwelling as well as each individual rental unit within the dwelling. Any suspension or revocation of the registration certificate may involve the entire dwelling or an individual unit or units within the dwelling. 38.02 Application for Registration Certificate. An application for a registration certificate shall be filed by the owner at City Hall. An application for any dwelling to be converted to a use which would require a registration certificate shall be made at least 30 days prior to such conversion. 38.03 Housing Code Violations. Any violation of the Uniform Housing Code brought to the owner's attention which is not brought into compliance within the time frame provided in the violation notice shall constitute grounds for suspension or revocation of a license. 38.04 Applications. Each application for registration certificate shall contain the following information: (1) Name, residence address, telephone number, and date of birth of the owner of the dwelling. If the owner is a partnership, the name of the partnership, and the name, residence address, telephone number, and date of birth of the managing partner. If the owner is a corporation, the name and address of the corporation, and the name, address, telephone number, and date of birth of the Chief Operating Officer. If the dwelling is being sold on a contract for deed, the name and address of the vendee. (2) Name, residence address, telephone number, and date of birth of any agent appointed by the owner to accept service of process and to receive or give receipt for notices. The identification provided must set forth the full name and date of birth of the person making the application. 38.05 Compliance with the Zoning. No rental registration certificate will be issued to properties that are not in compliance with the appropriate zoning requirements. 38.06 Investigation. Staff may investigate any application for a registration certificate to verify that the dwellings, apartments, or rooming units offered for rent comply with the provisions of the Uniform Housing Code. 38.07 Issuance and Posting of Registration Certificate. Whenever the investigation of an application indicates that the dwellings, apartments, or rooming units offered for rent comply with all provisions of the Uniform Housing Code or the owner certifies that the unit(s) meets the provisions of the Uniform Housing Code, staff shall issue a registration certificate. Every registrant of a dwelling, apartment or rooming unit offered for rent shall post the registration certificate in a conspicuous place within said dwelling, apartment or rooming unit. 38.08 Notice of Violation. Whenever an investigation of an application for registration certificate indicates that the dwelling, apartment or rooming unit offered for rent does not comply with the provisions of this code, building inspections staff shall serve a notice to the applicant. Additionally, owners of rental property must give notice of outstanding violations to potential purchasers of such property. 38.09 Rejection of Application. Whenever the investigation of an application for registration certificate indicates that the dwelling, apartment or rooming unit does not comply with the provisions of this ordinance, and from the nature of the violations, the dwelling, apartment or rooming unit can not be brought into compliance with this ordinance, then the application for registration certificate should be returned to the applicant. Any applicant whose application for registration certificate, after investigation has been rejected, may request and shall be granted a hearing in the matter before the City Council. 38.11 Failure to Register. Subdivision 1. Every person required to register a dwelling, apartment, or rooming unit offered for rent under the provisions of this chapter and who fails to do so shall be guilty of a violation of this code. Each day that a property is rented out without a valid rental registration certificate on file for that property is a separate violation. A violation of this section shall be a misdemeanor. Subdivision 2. Any person who rents out to another any type of unit to be used for human habitation without first making out an application for a housing registration certificate shall be assessed a $50 penalty fee. 38.12 Certificate Renewal and Non - transferabilitv. Subd. 1. All registration certificates shall expire one year after date of issuance and must be renewed annually. All information required by Section 38.04 of this chapter must be submitted at the time of renewal. Whenever the applicant certifies that no change has been made in a registered dwelling, apartment, or rooming unit, a renewal registration certificate may be issued provided the units are in compliance with the Uniform Housing Code. Subd. 2. A registration may be suspended or revoked if it is found that at any time after issuance, the rental property as a whole, or any of the units therein, are not in compliance with this code, including any provision of the Uniform Housing Code. Subd. 3. Every person who transfers title to property registered under this chapter shall provide City Staff with the name, residence address, telephone number, and date of the transfer of title to the new owner within 30 days of the date of such transfer. Within 60 days of the date of such transfer, the new owner shall apply for a new registration certificate. In the case of an option contract where the holder of the option is collecting rents and/or is paying on the mortgage to the property while the option remains unexercised, the holder of the option shall be deemed to be the owner of the property for purposes of this section and shall be required to apply for a rental registration certificate in his/her name. The date of option contract is created shall be deemed to be the date the holder of the option becomes the "owner" for purposes of this section. Subd. 4. Registration certificates may not be transferred or assigned. 38.13 Fees. Fees per unit will be set with the annual fee resolution. Page 3 of 8 38.14 Legislative Intent. It is declared to be the purpose and intent of sections 38.151 through 38.153 to protect and preserve this city's neighborhoods and the public health, safety, welfare and morals of those who live there. The Centerville Council determines that: (1) there are persons residing in rental property in Centerville engaging in disorderly conduct which results in a hostile environment for other Centerville citizens living close to the rental property; (2) there is currently no city ordinance which provides a formal procedure by which the City can notify a rental property owner or manager of the disorderly conduct occurring on the property; (3) there is currently no procedure by which the City can require a rental property owner or manager to respond to and resolve the occurrences of disorderly conduct occurring on his or her rental property and to take administrative action against his or her rental registration certificate should he or she fail to do so. Accordingly, it is the intent of Section 38.151 through 38.153 to address the serious and, at time, life threatening problems posed by the occurrence of disorderly conduct to the health and safety of all Centerville residents in all portions of this city. At the same time, the City Council recognizes, acknowledges, and complies with all due process and property rights enjoyed by those who own or manage rental property as well as those who reside in such property. This ordinance represents the City's good faith effort to balance those competing and legitimate interests. 38.15 Definitions. For the purpose of this subdivision, the following terms shall have the meanings ascribed to them. Appropriate action shall mean that action which a reasonable license holder would take based upon the facts and circumstances of each case so as to prevent a reoccurrence of the disorderly use. License shall mean a registration certificate as required by this chapter of the Centerville City Code. Licensee or License Holder shall mean one who holds the license as required by this chapter of the Centerville City Code. Licensed Premises or Premises shall mean the property owned, operated, or managed by a Licensee Holder and shall refer to an individual unit within a multi -unit complex when applicable. Disorderly or Disorderly Use shall mean that conduct occurring on Licensed Premises Page 4 of 8 which violates Section 38.152(2). 38.16 Conduct on Licensed Premises. Subd. 1. Any license holder shall be responsible to take appropriate action against persons occupying specific units in the licensed premises who conduct themselves in such a manner as to cause the premises to be disorderly in violation of the statutes or ordinances listed in Subdivision 2. Those persons occupying the premises shall include tenants as defined by Minn. Stat. § 566.18, and those persons on the licensed premises whose presence that tenant has invited or to which the tenant has acquiesced. Violations of this section apply to individual units within buildings or complexes containing multiple units. Subd. 2. The following ordinances and statutes are applicable to this section: (1) Minnesota Statutes prohibiting prostitution; (2) Minnesota Statutes prohibiting indecent conduct; (3) Minnesota Statutes prohibiting participation in a disorderly house; (4) Minnesota Statutes Section 617.23 through 617.299 prohibiting obscenity; (5) Minnesota Statutes Sections 609.75 through 609.76 which prohibit gambling; (6) Minnesota Statutes Section 152.01 through 152.025 and Section 152.027, Subd. 1 and 2, which prohibit the unlawful sale or possession of controlled substances; (7) Minnesota Statutes Chapter 340A which prohibits the unlawful sale, use or possession of alcoholic beverages; (8) Minnesota Statutes Section 97B.021, 97B.045, 609.66 through 609.67 and 624.712 through 624.716, which prohibit the unlawful possession, transportation, sale or use of a weapon; (9) Minnesota Statutes Section 609.72 which prohibits disorderly conduct; or, (10) Minnesota Statutes Sections 609.221, 609.222, 609.223, 609.2231, and 609.223 which prohibit assaults, except that domestic assaults, as the same are defined by state law, are not included herein. Page 5 o g f 8 Subd. 3. The police shall be charged with the responsibility of enforcing Subdivision 2. Subd. 4. Upon determination by the police that the licensed premises were involved in a disorderly use, City staff shall notify the license holder by regular mail of such violation and direct the license holder to take appropriate action to prevent further violations. Notice shall be effective if mailed to the license holder at the person's last known address. Subd. 5. If another instance of disorderly use on licensed premises occurs within twelve (12) months of an incident for which notice in Subdivision 4 of this section was given, the license holder shall be notified of the instance of disorderly use and shall also be required to submit a written report of appropriate actions taken by the landlord to prevent further disorderly use of the premises. This written report shall be submitted to the housing inspector within five (5) days of the notice of disorderly use of the premises and shall, in addition to the report of appropriate actions to be taken, detail all actions taken by the license holder in response to all notices of disorderly use of the premises within the preceding twelve (12) months. Failure to submit the written report as required herein shall be a basis for the imposition of a fine and the revocation or suspension of the license for the specific units or units located on the license premises as otherwise provided for in this chapter. Subd. 6. If another instance of disorderly use of the premises occurs within twelve (12) months after receipt of notice pursuant to Subdivisions 4 and 5, the license may be revoked or suspended for specific unit or units located on the licensed premises. If the notice of violation has been issued with respect to a common area of a building or complex of buildings then the license as to all units in such building or complex may be suspended or revoked. Subd. 7. No suspension or revocation shall be imposed where one or more of the three required disorderly use notices were mailed or delivered to the landlord after the landlord has filed an unlawful detainer action with the district court for the particular unit or units identified in the disorderly use notice. Calls to police made by licensees shall not be considered incidents of disorderly use in initiation of an unlawful detainer action shall not be a bar to sanctions, however, unless the action is diligently pursued by the license holder. There has not been any feedback from the public in regards to this item. In order to maintain healthy balances in the sewer and water funds, it is important to increase rates so that quarterly service fees meet the annual operation and maintenance costs of the respective utilities. I am recommending that the Council adopt the proposed increases so that they may appear during the first quarterly billing in the year 2000. The next quarterly billings will be mailed during the first week in January. The recommended increases are taken from the Water and Sewer Rate Phase II study. The recommended sanitary sewer rate increase is from $39 /quarter to $42/quarter. The recommended water rate increase is from $15 to $16 /flat rate and from $1.50 /thousand gallons used to $1.60 /thousand gallons used. I have been in contact with Mr. Fred Stenborg (Bonestroo) he is working to finish his recommendations on the proposed connection charges for new construction for the respective utilities. There has not been any feedback from the public in regards to this item. In order to maintain healthy balances in the sewer and water funds, it is important to increase rates so that quarterly service fees meet the annual operation and maintenance costs of the respective utilities. I am recommending that the Council adopt the proposed increases so that they may appear during the first quarterly billing in the year 2000. The next quarterly billings will be mailed during the first week in January. The recommended increases are taken from the Water and Sewer Rate Phase II study. The recommended sanitary sewer rate increase is from $39 /quarter to $42/quarter. The recommended water rate increase is from $15 to $16 /flat rate and from $1.50 /thousand gallons used to $1.60 /thousand gallons used. I have been in contact with Mr. Fred Stenborg (Bonestroo) he is working to finish his recommendations on the proposed connection charges for new construction for the respective utilities. The connection charges will be used to establish appropriate capital replacement funds. There is no increase recommended for the quarterly storm water charge at this time. I would like to include the fees as part of the information I am preparing. The Municipal License & Permit Fee Survey prepared by the Association of Metropolitan Municipalities provides fee information relating to animal licenses, kennel licenses, and impounding release fees. Listed below are license fees for populations of 2500 — 10000 with two -year license requirement. Cat & Dog License Female $10 — 15 Cat & Dog License Male $10 - 15 Cat & Dog License Neutered $7.50 - $15 Cat & Dog License Spayed $7.50 - $15 Cattery $100 per year Kennel $10 - $300 per year The City of Circle Pines charges a $15.00 fee for dog and cat licenses and charges $7.50 if the animal is spayed or neutered. My interpretation of the ordinance requires for the payment of a release fee in addition to payment of maintenance costs provided by the Otter Lake Animal Control Facility. A procedure will need to be developed on the release fee process. My thought would be that the animal owner would have to pay the release fee at City Hall, a receipt issued which would be proof of payment of the fee to Otter Lake Animal Control facility. The animal owner would pay the maintenance cost of the animal directly to Otter Lake Animal Control. November 17, 1999 The common fee for impoundment/release fee (2500 -10000 population) is: First Offense $25.00 Second Offense $50.00 Third Offense $75.00 Council may wish to set just a flat release fee and not address the second or third offense fee. I request that Council set fees for animal and kennel licenses and release fees so that information can be presented to the public prior to the ordinance becoming effective. 2 City of Centerville Animal Ordinance #24 (6) An animal control officer and/or police officer may enter upon the private property of another for the purpose of removing such quarantined animal to an animal shelter when it has been determined that such quarantined animal has not been maintained by the owner in a manner consistent with the provisions of this Section. 24. 04 Non - Domestic Animals. It shall be illegal for any person to own, possess, harbor. or offer for sale, any non - domestic animal within the City limits. An exception shall be made to this prohibition for animals specifically trained for and actually providing assistance to the physically challenged and for those animals brought into the City for educational purposes, as part of an operating zoo, veterinarian clinic, scientific research laboratory, or a licensed show or exhibition. 24.05 Farm Animals. Farm animals shall only be kept in an agricultural district of the City. or on a residential lot of at least ten (10) acres in size provided that no animal shelter shall be within three hundred (300) feet of an adjoining piece of property. An exception shall be made to this Subsection for those animals brought into the City as part of education, an operating zoo, veterinarian clinic, scientific research laboratory, or a licensed show or exhibition. 24.06 Impounding. Subd. 1 Running at Large. Any animal running at large is hereby declared a public nuisance. Any police officer may impound any animal found unlicenced or any animal found running at large and shall give notice of the impounding to the owner of such animal. if known. Subd. 2 Reclaiming. All animals conveyed to the pound shall be kept. with humane treatment and sufficient food and water for their comfort, at Least five regular business days to a maximum of seven days, unless reclaimed sooner by its owner or keeper as provided by this Ordinance. If the animal is a dangerous animal as defined under § 24.01, Subd. 5, it may be impounded for a period of time including the time required to complete an appeal process. The owner of an animal is required to pay the entire costs of confinement of any animal. Immediately on confinement of any animal, reasonable effort shall be made by the impounding official to notify the owner of the animal, of the animal's confinement, and procedures to be followed for reclamation of such animal. Any animal may be redeemed from the pound by the owner upon performance of the following: (1) Payment of a release fee and receipt of a release permit from the police; and (2) Payment of maintenance costs, as provided by the pound, per day or any part of day while animal is in said pound; and (3) If an animal is unlicenced, payment of a regular license fee and valid certificate Page 7of 16 City of Centerville Animal Ordinance #24 of vaccination for rabies and distemper shots is required; and (4) Said fee shall be set by City Council and reviewed periodically and kept on record with the City. Subd. 3 Permissible Return of Unrestrained Dog. Not withstanding the provisions of Section 24.06, Subd.1, if a licensed animal is found unrestrained and its owner can be identified and located, such animal need not be impounded but may, instead be taken to the owner. In such case, however, proceedings may be taken against the owner for violation of this Ordinance. Subd. 4 Unclaimed Animals. At the expiration of the times established, if the animal has not been reclaimed in accordance with the provisions of this Ordinance, the officer appointed to enforce this ordinance may let any person claim the animal by complying with all provisions in this Ordinance, or the officer may sell the animal, with all funds paid to the City of Centerville, or cause the animal to be destroyed in a proper and humane manner and shall properly dispose of the remains thereof. Any money collected under this Ordinance shall be payable to the City of Centerville. 24.07 Kennels. Subd 1. A commercial kennel license is required in addition to individual licenses. The City Council shall issue a commercial kennel license upon the following conditions: (1) Payment of an commercial annual kennel license fee which shall expire on December 31 of each year and must be renewed annually. (2) Kennels and the premises used therefore shall be kept in a clean. quiet, orderly and sanitary condition, so at not to constitute a nuisance. In determining whether a nuisance exists, consideration shall be given to the kennels location, location of other residents, and the general character of the neighborhood. (3) All such dogs in excess of two shall be at all times confined in a building or enclosure by a leash or otherwise under control. (4) A commercial kennel must be in compliance with the City Zonine Code. 24.08 Nuisances. Subd. 1 Habitual Barking. It shall be unlawful for any person to keep or harbor an animal which habitually barks or cries. Habitual barking shall be defined as barking for repeated intervals of at least three minutes with Less than one minute of interruption. The current drop box is non - secure, unattractive and ineffectively labeled. Many residents use the current drop box, but a large number of residents are unaware of the existing drop box and hand deliver their payments into City Hall. I would recommend purchasing a new drop box for the following reasons: improved security, visual appeal and improved customer service. Diane has proven to be a great asset to the City with her superb software knowledge and computer proficiency. Diane currently maintains and updates eight websites in her spare time. Diane has prepared a comprehensive analysis for Council review. I concur with Diane's findings that the City should authorize switching to MTN for internet access and web hosting. Diane has a good working relationship with the staff at this facility and this switch will save approximately $650 /year. Diane has also provided an analysis on the benefits of adding Microsoft Office to the software that is used by the City. Diane has permission from the City of Stillwater to transfer many of the databases she constructed to the City of Centerville. This will save countless hours of staff time in creating these databases. The addition of Microsoft Office, a scanner and Omni Page OCR will also allow the City to archive old documents on CD -Rom. Diane also has the expertise to train existing staff in the use of this new software. I would recommend that Council authorize the purchase of the items as outlined in the attached memo to enhance customer service. I am convinced that the benefits will outweigh the costs in this matter. The purpose of Mr. Carlson's presentation was to receive input from the Planning Commission on the concept, zoning determinations, and comprehensive plan amendment. After discussion, the Planning Commission advised Mr. Carlson to investigate the Planned Unit Development options and to make a presentation to the City Council and Park and Recreation Commission. The Commission made a few changes in Section 5.02 and Section 5.04. Motion by Mr. McLean, seconded by Mr. DeVine to make the changes, forward the ordinance to the City Attorney for his review and comments and bring back to the Commission at their December 7, 1999 meeting. Motion carried unanimously. Ordinance # 4 Review Mr. March informed the Commission of a booklet on "Preparing a Conventional Zoning Ordinance." He explained that this model provides the Commission direction in setting up the zoning ordinance to be easy to read and easy to administer. Motion by Mr. McLean, seconded by Mr. DeVine to table the Ordinance #4 Review, directed staff to provide the Commission with a copy of the "Preparing a Conventional Zoning Ordinance" for their review and for staff to prepare a "draft" Ordinance #4 incorporating the style described in the publication by the January 4, 2000 meeting, and to hold two workshops per month in addition to the regularly scheduled meeting beginning in January, 2000. Ms. Dorn seconded the motion. All in favor. Motion carried. APPOINTMENT OF NEW MEMBERS The committee welcomed two new members to EDC, Betsy Scheller and Michelle Moser. Ms. Scheller and Ms. Moser expressed they were pleased to be on EDC. OLD BUSINESS DESIGN TEAM - "IDEAS IN ACTION' A. City Theme: Ms. Dorn indicated she has spoken with a representative from the Minnesota Page 1 of 3 • Historical Society. Ms. Dorn shared a printout of all the Historical properties in Centerville. St. Genevieve's church and part of the commercial district are listed as Centerville's historical properties. Ms. Dorn stated she has spoken with Susan Roth of the National Register, who informed Ms. Dorn that the historical inventory was taken in 1978, and that a record of the exact commercial property considered historic was not available. Ms. Roth's recommendation was to determine whether preserving the historical properties in Centerville is worth the effort, and if so develop a preservation commission of some kind. Ms. Capra indicated she has the Historical Register "guidelines" for properties that qualify to be on the registry. Ms. Capra and Ms. Dorn will present the EDC with information regarding the State of Minnesota Historical Building site criteria at the November meeting. Ms. Capra added she would like to have this item remain as an agenda item for further discussion as needed if changes arise. CITY MERCHANDISE The committee is pleased with the merchandise sales at this point, but feels the coffee mugs may need to be marketed differently due to the large quantity on hand. EDC may look at running a "coupon" or a "special" on city merchandise in the future. The committee discussed selling the coffee mugs and sweatshirts at the City Wide Bon -Fire. Ms. Scheller volunteered to coordinate this activity with Ms. Fairbrother. SPECIAL REVENUE FUND Ms. Fairbrother stated that Deputy Clerk Teresa Bender is working on an updated balance of the EDC Special Revenue Fund. GOOD NEIGHBOR PACKETS Ms. Dom updated the committee on the status of the Good Neighbor Packets. The committee was in support of having Ms. Dorn continue working on the packets, focusing on the packets to be out in January of 2000. ORDINANCE UPDATE Ms. Fairbrother stated the Planning and Zoning Commission hope to submit a draft of the revised Firearm Ordinance to Council in November. Planning and Zoning will resume discussion on City Ordinance #4 - Regulating the Use of Land/Building Codes at the November Planning and Zoning meeting. Page 2 of 3 LINO LAKES AREA CHAMBER OF COMMERCE Motion by Ms. Capra, seconded by Ms. Dorn to recommend to City Council that the City of Centerville become a member of the Lino Lakes Area Chamber of Commerce for a one year term, contin ent upon the City Administrator being able to serve as the representative of the City. For clarification, the Economic Development committee feels that the City would be the member of this Chamber, not the Economic Development Committee. If the City Administrator is unable to serve as the representative, the Mayor or another member of Council could be designated. NEWSLETTER ADVERTISING The committee discussed the recent changes in the City Newsletters, and agreed to abide with Council's decision for disbursement of funds. Ms. Moser indicated she would be willing to serve as the EDC contact representative for the City Newsletter. Ms. Moser will touch base with Patricia Scott, the City's Media Relations Specialist on a monthly basis to inform her of EDC's activities and updates. Please provide a contact person, if possible, or inform the City of Centerville about any information or other sources of information you may have regarding trails in your area. In particular, the City of Centerville is interested in planning a trail system that connects to the Anoka County Regional Parks Chain of Lakes in two ways and connects to the trail that goes through Hugo. Note that there are plans to develop an extensive trail system in the Anoka County Park Chain of Lakes and that these trails will connect to a number of communities and their trails. Hugo Trail Connection Possibilities The City of Centerville would like to investigate possibilities in connecting its community with the Chain of Lakes Park and the trail in Hugo. A trail connecting Hugo to the Chain of Lakes Park looks like a win for Hugo, a win for Centerville, and a win for the Chain of Lakes Park. The Hugo trail looks to be an interesting destination as this trail may extend some distance (Duluth to St. Paul perhaps), and the Chain of Lakes Park looks to be an interesting destination as there are resources such as the Wargo Nature Center, swimming beach, and other activities. Anoka County Chain of Lakes Park Possibilities The City of Centerville has already determined how it will connect to the Chain of Lakes trail system on the southeast side of Centerville Lake through its own LaMotte Park. This connection hooks to other trails in the park that circle half of Centerville Lake. An idea for the future would provide for circling the rest of Centerville Lake, allowing a trail all around the lake. Other Possibilities There may be plans or ideas on other trails in the surrounding area unknown to the City of Centerville. This is the information the City is also trying to collect to try to plan for the best possible future of all the people and communities involved.
