PRESENT: Mayor Mary Capra Council Member Linda Broussard Vickers Council Member Ben Fehrenbacher Council Member Jeff Paar Council Member D. Love ABSENT: None. STAFF: City Administrator Dallas Larson City Attorney Kurt Glaser City Engineer Mark Statz Finance Director Mike Jeziorski CALL TO ORDER Mayor Capra called the December 9, 2009, City Council meeting to order at 6:30 p.m. II. PUBLIC HEARING(S) 1. Budget & Tax Levies for 2010 Finance Director Jeziorski presented a brief presentation on the Budget and Tax Levies for 2010. He reviewed the General Fund Expenditures, which includes the General Government, Public Safety, Public Works, Culture and Recreation, Capital Outlay and Economic Development. He stated that the total Tax Levy increase is $2,265,661.00, equaling an 11% increase. Mayor Capra opened the Public Hearing at 6:33 p.m. Erick Marshall, 7216 Lovell Drive, appeared before the Council expressing his concern regarding the tax increase. He stated his taxes have increased from $4,200 in the year 2007 to $5,600 this year. He questioned the increase in taxes while his business revenue is decreasing. He noted his objection to such a large increase over the short span of two years. He stated with the economic crisis, tax increases in this amount are what would encourage him to move out of Centerville. 1 City of Centerville Council Meeting Minutes December 9, 2009 Mayor Capra explained the operating budget to Mr. Marshall stating that it has been reduced. She also clarified that Mr. Marshall's total amount of tax increase is not all City tax, but also School and County taxes. She also reviewed the States' 2009 market home value levy stating that without the suspension of the program $68,000 of the levy that the City collected was credited back to residents' property taxes. City Administrator Larson also clarified that the tax increase is because of a redistribution that is occurring, properties that are going down in value compared to other properties such as Mr. Marshall's, which have increased in value. Councilmember Linda stated that citizens are welcomed to offer ideas and input, as taxpayers, where they feel the City should implement cuts. Janice Hackman, 7034 Dupre Road, appeared before the Council and asked who plans all of the after school programs, extracurricular and evening adult activities, noting these are areas that could be cut. Mayor Capra replied that those programs are funded through Community Education, not the City. Mayor Capra encouraged residents to attend the budget communications meetings that the City Council holds in July and August to offer their input. There being no further speakers Mayor Capra closed the public hearing at 7:10 p.m. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to approve closing the public hearing at 7:10 p.m. All in favor. Motion carried unanimously. III. APPROVAL OF AGENDA Mayor Capra made the following additions to the Agenda: Consent Agenda, Item 1, added Page 6a, (Check#25017 — 25025). New Business, Item 5, added Replacement pages. New Business, Item 6, added Replacement pages. New Business, Item 8, added Page 100a, Res. #09 -0XX — Authorizing Closing Certain Funds. New Business, Item 9, added Page 100b, Consider Recycling Refund/Incentive for 2009. New Business, Item 10, added Page 100c, Liquor, Tobacco, Massage Therapist & Establishment License Renewal/New License. Motion carried unanimously. IV. APPROVAL OF COUNCIL MINUTES 1. November 23, 2009 Council Meeting Minutes Motion by Council Member Love, seconded by Council Member Broussard Vickers to approve the November 23, 2009 Council Meeting Minutes as presented. All in favor. Motion carried unanimously. V. CONSENT AGENDA 1. City of Centerville November 24, 2009 through December 9, 2009 Claims (Check #24990 — 25016) & (Check #25017 — 25025) (Check #7510 7554) 3, P &R Recommendation to Continue Support of the YMCA's Park Play Days Program for 2010 — Not to exceed $1,500. 4. P & R Request for Funding for Skate Night/Horse Drawn Hayride — Not to exceed $750. 5. P & R Recommendation for Centennial Little League's Use of Ball Fields at Laurie LaMotte Memorial Park in 2010. Councilmember Love requested Consent Agenda Item 2 be removed for discussion and clarification. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve the Consent Agenda as amended. All in favor. Motion carried unanimously. 2. Centennial Lakes Police Department Claims through November 25, 2009 (Check #7540 —7554) Councilmember Love expressed his concern regarding types of expenditures that should not be paid for by the City. Council and Staff agreed and it was discussed and clarified that the noted expenditure questioned was not a common place occurrence. Motion by Council Member Love, seconded by Council Member Paar to approve the Consent Agenda Item 2: Centennial Lakes Police Department Claims through November 25, 2009(Check #7540 —7554) as presented. Ordinance #33, Second Series - Fee Schedule 2010 City Administrator Larson reviewed background information on the 2010 City Fees. Motion by Council Member Fehrenbacher, seconded by Council Member Love to approve Ordinance #33, Second Series - Fee Schedule 2010. All in favor. Motion carried unanimously. VIII. NEW BUSINESS 1. Planning & Zoning Commission Recommendation for Preliminary and Final Plat — Clearwater Business Park City Administrator Larson reviewed background information on the Preliminary and Final Plat for Clearwater Business Park. He stated the Planning Commission held the Public Hearing and that there had been no comments from the public. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve Planning & Zoning Commission Recommendation for Preliminary and Final Plat — Clearwater Business Park. All in favor. Motion carried unanimously. 2. Res. #09 -036 — Adopting Budget and Tax Levies for 2010 The City Council each shared their opinions on the Levy with the understanding that no one wants to increase taxes. It was stated that the current proposal was decided upon by a compromise after reviewing levy limit laws and concerns regarding maximum levy limits being protected in the future. Discussions about the City roads being completed during this state of economy were of most concern, realizing the need that they need to be done, but perhaps not at this time. The Council discussed the minimum amount of dollars that the Public Works Director had stated could be used for the road repair. The amount of work to the roads that could be done with half of the maximum levy amount, in the amount of $35,000, making the overall levy increase 9% instead of 11% was also discussed. After discussion Council consensus concluded that the total amount of levies would be $2, 231,661, overall increase of 9% and includes $67,000 for street seal coating. Motion by Council Member Love, seconded by Council Member Fehrenbacher to authorize Res. 09 -036 — Adopting Budget and Tax Levies for 2010 in the amount of $2,231,661. Motion carried (3/2). (Councilmembers Broussard Vickers and Paar opposed.) 3. Res. #09 -037 — Approving Amended 2009 Budget Page 4 of 7 4 City of Centerville Council Meeting Minutes December 9, 2009 Finance Director Jeziorski reviewed information on the General Fund Budget for the Amended 2009 Budget. Motion by Council Member Broussard Vickers, seconded by Council Member Love to approve Res. #09 -037 — Approving Amended 2009 Budget. All in favor. Motion carried unanimously. 4. Res. #09 -038 — Establishing a Minimum General Fund Balance City Administrator Larson reviewed background information stating the City policy is to try and keep between 40 to 55 percent of planned expenditures and transfers to meet working capital and small emergency needs. He explained that this is to formalize documentation for bonding agencies; however the City can amend at a later date if needed. Motion by Council Member Fehrenbacher, seconded by Council Member Love to approve Res. #09 -038 — Establishing a Minimum General Fund Balance. All in favor. Motion carried unanimously. 5. Approval of Res. #09 -039 — Shared Salt Supplies (State of MN Dept. of Transportation) City Administrator Larson reviewed background information stating this would be the first year that the City would use only salt on roads rather than the normal sand/salt mix. He explained there would be less sweeping and less debris in the ponds next spring. He also stated the salt would be stored in the Minnesota Department of Transportation facilities, being the City does not have adequate facilities for storage. Motion by Council Member Love, seconded by Council Member Broussard Vickers to approve Res. #09 -039 — Shared Salt Supplies (State of MN Dept. of Transportation). All in favor. Motion carried unanimously. 6. Approval of Updated Personnel Policy City Administrator Larson reviewed all of the changes made to the Personnel Policy. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to approve the updated Personnel Policy. All in favor. Motion carried unanimously. 7. Acceptance of the 2010 Local 49'ers Contract Provisions City Administrator Larson reviewed background information regarding contract provisions that were accepted by Union Local 49 representing Public Works Employees. No monetary increases are included in the contract. All in favor. Motion carried unanimously. 8. Res. #09 -040— Authorizing Closing Certain Funds Finance Director Jeziorski reviewed background information on several funds that were established to account for revenue and expenses related to their respective improvement projects and are currently paid and are no longer needed. Motion by Council Member Broussard Vickers, seconded by Council Member Fehrenbacher to authorize Res. #09- 040 — Authorizing Closing Certain Funds. All in favor. Motion carried unanimously. 9. Consider Recycling Refund/Incentive for 2009 City Administrator Larson reviewed background information stating the City is anticipating that there would be approximately $5,500 more or less, remaining in SCORE Funds for the year. Staff recommended the City provide residents with a refund/incentive to increase their recycling efforts similar to last year. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve refunding recycling dollars that are left over from 2009 from the SCORE Funds to Centerville residents. All in favor. Motion carried unanimously. 10. Liquor, Tobacco, Massage Therapist & Establishment License Renewal/New License City Administrator Larson reviewed information on pending licenses and requested due to time constraints, that Council approve the licenses subject to meeting the license requirements per City Code. He explained Staff would require all Licensee's to complete the remaining requirements. The City Council consensus was to approve the licenses as long as all the requirements are met. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve Liquor, Tobacco, Massage Therapist & Establishment License Renewal/New License, contingent upon all remaining requirements being met. All in favor. Motion carried unanimously. IX. ANNOUNCEMENTS/UPDATES 1. City Administrator, Dallas Larson a. Successful Tobacco Compliance Checks Page 6 of 7 6 City of Centerville Council Meeting Minutes December 9, 2009 City Administrator Larson reported a tobacco compliance check had been completed and that all businesses in the City that are licensed to sell tobacco passed the check. b. One Unsuccessful Liquor Compliance Check City Administrator Larson reported an alcohol sales compliance check had been completed and one business in the City that is licensed to sell alcohol failed the check. A hearing on the license violation is scheduled for the next meeting of Council. Commission Updates Councilmember Broussard Vickers reported on the Planning and Zoning Commission Meeting. X. ADJOURNMENT Motion by Broussard Vickers, seconded by Love to adjourn the December 9, 2009 City Council Meeting at 8:24 p.m. All in favor. Motion carried unanimously. Well #2 has the highest pumping capacity and the best water quality, so if you were inclined to do only one well, Well #2 would be the clear choice. The proposal did not provide a generator set, but only the connections to facilitate use of a generator to run the well in the event of a power outage. The city would have to rent a generator when the event happens. In the event of a very wide spread event, there could be significant demands for generators of the size needed for this purpose. Still, the cost to ready the well is relatively low, and if arrangements were made quickly, the city would likely find a generator. The Council directed that staff find out what capacity Lino Lakes in this specific area. We found that Lino Lakes has one portable generator large enough to power its wells. Each of its wells has connections for a generator, but only one well at a time could be powered. Second, the Council instructed that the joint powers agreement for the interconnect between the two cities be looked at to determine if the city has the authority to close the interconnect in the event of an emergency. We found several problems with the old existing agreement. It was written at a time when Centerville did not have adequate storage and it envisioned that Centerville would be likely to buy water from Lino Lakes. That no longer applies. The joint powers agreement has been updated to provide for the clear authority for either party to close the interconnect valve if it is unable to supply the water needs of the other. A copy of the proposed agreement is included in the packet. Lino Lakes has the agreement on their next agenda for approval. Dallas Larson, City Administrator 12 Hello Dallas — I received two quotes for emergency power for well #2. This would include adding a manual transfer switch and a power plug receptacle to the main control panel. The quotes also include 50 feet of power cord with a plug on one end for connection to the panel. The other end would have to be manually connected to a portable generator of at least 200KVA by a certified electrician. This emergency configuration would not be automatic and it would take half a day to get a generator and have it wired for operation. This does give the city the potential to run one well if the power goes out. The water interconnect with Lino Lakes opens either direction automatically. Well # 2 can pump about 1,140 gallons per minute and the interconnect can provide about 1,600 gpm. The council may want to purchase this equipment in case the power goes out for more than one day. Aid Electric's quote is $4,778.00 with two 100 amp power cords and Rivard Electric "s quote is $5,964.00 for the transfer switch and $2,454.00 for the power cord and plug. The cost is fairly low to provide another source to run the well. Both Lino Lakes and Centerville have the authority to enter into this agreement pursuant to Minnesota Statute 471.59. WHEREAS, Lino Lakes has constructed a water system capable of providing emergency and peak demand water supply service to Centerville, and Centerville has constructed a water system capable of providing emergency and peak demand water supply service to Lino Lakes, including the construction of an elevated water storage tank and trunk watermains. WHEREAS, an interconnection has been constructed between the two communities water systems providing the means for each city to provide such peak or emergency demand water supply service to the other. WHEREAS, water flow recording meters have been installed at the interconnection line for the purpose of measuring the flow from the Lino Lakes water system into the Centerville water system and the flow from the Centerville water system into the Lino Lakes water system. NOW, THEREFORE, the parties hereto agree as follows: SECTION 1. OWNERSHIP AND MAINTENANCE 1. Lino Lakes shall have ownership and be responsible for operation and maintenance of the water system located within the corporate boundaries of Lino Lakes. Centerville shall have ownership and be responsible for operation and maintenance of the water system located within the corporate boundaries of Centerville. 2. The interconnection line, metering manhole, and appurtenances shall be jointly maintained by the two cities and costs for such maintenance shared equally. 3. The cities of Centerville and Lino Lakes shall adopt an "odd/even" lawn watering policy. The cities shall enforce total lawn watering bans that may be necessary to manage use and available supply. 19 SECTION 2. CHARGES The single two -way meter installed on the interconnect shall be read at the end of each calendar quarter. The city receiving the greatest net flow shall reimburse the other city in the form of water which may be used within twelve months. In the event that that city does not have water capacity to provide the reimbursement in the form of water, they shall instead reimburse the providing city for the cost of such water at a rate of 80% of the providing city's residential water rate at the time of billing. Payments shall be made on or before the 20th day of the month following the end of the quarter. SECTION 3. WATER STANDARDS AND CONSTRUCTION 1. Each city's water supply shall provide clean, safe, potable water. Lino Lakes and Centerville agree that they shall exercise reasonable care to prevent toxic or harmful substances from contaminating the water supply of the other party. In the event that either party finds or has reason to believe that contamination exists in its system, or upon a finding that their water is not potable, that city shall notify the other immediately. Upon request, each city shall supply the other city with copies of yearly analytical test data from the Minnesota Department of Health. If either city allows volatile organics to be discharged into the water system, such items shall be eliminated by the responsible city. Failure to comply with this section shall be grounds for immediate termination of the water exchange system. 2. All watermain construction within Centerville or Lino Lakes shall meet the most recent City Engineers Association of Minnesota "Standard Utilities Specifications for Watermain and Service Line Installation and Sanitary Sewer and Storm Installation." Neither party shall substantially change the specifications for any parts of the water system which would be interconnected between the cities without the notification of the other. SECTION 4. INDEMNIFICATION Each party agrees to indemnify the other and save the other harmless from any and all claims or demands for damages arising out of or which may result from the water supply pursuant to this Agreement, and from the use, installation, maintenance, and repair of its facilities as set forth in this Agreement. SECTION 5. EVENT OF EMERGENCY Either party shall have the absolute right to close off the interconnect in the event of a water emergency where the City in its sole judgment will be unable to supply any water needs of the other. SECTION 5. TERMINATION In addition to the termination provisions in Section 3, either city shall have the 20 right to cancel this Agreement on account of any violation of the terms and conditions of this Agreement by the other city by first giving thirty (30) days written notice to the other party of such violation and a failure to correct the violation within said thirty (30) day period of time. Either city shall have the right to cancel and annul this Agreement, without cause, by first giving three (3) years written notice to the other party of such intent to cancel this Agreement, no further payments shall be due hereunder, except obligations arising prior to the effective date of termination. Upon such effective date of termination, the connection between the water system of Lino Lakes and the water system of Centerville shall immediately be disconnected by the party terminating the agreement. SECTION 6. (A) No person shall bring into the City an animal which has previously been declared by another jurisdiction to be dangerous. No person shall bring into the City an animal which has previously been declared by another jurisdiction to be potentially dangerous without first securing a permit from the City to register the animal, The City may seize and destroy, at the owner's expense, any animal brought into the City in violation of this provision. (B) Attack by an animal. It shall be unlawful for any person's animal to inflict or attempt to inflict bodily injury to any person or other animal whether or not the owner is present. This section shall not apply to an attack by a dog under the control of an on -duty law enforcement officer or to an attack upon an intruder who has unlawfully entered the owner's home. (C) Stopping an Attack. If any police officer or Animal Control Officer is witness to an attack by an animal upon a person or another animal, the officer may take whatever means the officer deems appropriate to bring the attack to an end and prevent further injury to the victim. (D) Destruction of dangerous animal. The Animal Control Officer shall have the authority to order the destruction of dangerous animals in accordance with the terms established by this Chapter. (E) Definitions. The following definitions shall apply unless the context clearly indicates or requires a different meaning. Dangerous Animal. An animal which has: (1) Without provocation by the victim, inflicted substantial bodily harm on a human being on public or private property; (2) Killed a domestic animal without provocation while off the owner's property; or (3) Been found to be potentially dangerous, and after the owner has notice that the dog is potentially dangerous, the animal aggressively bites, attacks or endangers the safety of humans or domestic animals. Potentially Dangerous Animal. An animal which has; (1) When unprovoked by the victim, inflicts a bite on a human or domestic animal on public or private property. (2) When unprovoked, chases or approaches a person, including a person on a bicycle, upon the streets, sidewalks or any public or private property, other than the animal owner's property, in an apparent attitude of attack; or Draft for review 12 -23 -2009 55 (3) Has the known propensity, tendency or disposition to attack while unprovoked, causing injury or otherwise threatening the safety of humans or domestic animals. Proper Enclosure. Securely confined indoors or in a securely locked pen or structure suitable to prevent the animal from escaping and to provide protection for the animal from the elements. A proper enclosure does not include a porch, patio or any part of a house, garage or other structure that would allow the animal to exit of its own volition or any house or structure in which windows are open or in which door or window screens are the only barriers which prevent the animal from exiting. The enclosure shall not allow the egress of the animal in any manner without human assistance. Unprovoked. The condition in which the animal is not purposely excited, stimulated, agitated or disturbed. (F) Designation as a Dangerous Animal or Potentially Dangerous Animal. The Animal Control Officer shall designate any animal as a dangerous animal or potentially dangerous animal upon receiving evidence that the animal has, when unprovoked by the victim, committed an act meeting the definition of a "dangerous animal" or "potentially dangerous" animal. When the Animal Control Officer determines that an animal has committed on of these acts, he /she shall cause the owner of the animal to be notified in writing of his intention to designate the animal as a dangerous animal or potentially dangerous animal and that his designation shall apply, unless the owner makes an appeal in accordance with this Chapter. The notice shall also include the conditions that the Animal Control officer intends to place on the owner for keeping the animal and whether or not the animal must be destroyed. (G) Appeal of Designation as Dangerous Animal or Potentially Dangerous Animal. An owner shall be given fourteen (14) days to appeal the order of the Animal Control Officer, by requesting a hearing before the City Council for a review of this determination. If no appeal is filed within the requisite time period, the order designating the animal as a dangerous animal, or potentially dangerous animal, shall stand. If an owner requests a hearing to appeal the order designating the animal as dangerous or potentially dangerous, the hearing shall be held before the City Council or its designated hearing officer, which shall set a date for hearing not more than three weeks after demand for the hearing. The records of the Animal Control Officer, Police Department, or City Administrator's office shall be admissible for consideration by the City Council or its designated hearing officer without further foundation. A copy of the records shall be made available to the owner at least one week before the hearing. The City Administrator's Office shall notify the victim of the hearing date and time. After considering all evidence, the City Council or its designated hearing officer shall make an order as it deems proper either sustaining the designation as a dangerous animal or potentially dangerous animal or rescinding the designation. If the order sustains the designation, the designation as dangerous or potentially dangerous shall remain in effect for the life of the animal, unless otherwise rescinded at a later date in accordance with the procedures set forth in this Chapter. Draft for review 12 -23 -2009 56 OD Exemption to Declaration as Dangerous Animal or Potentially Dangerous Animal. Animals may not be declared dangerous or potentially dangerous if the threat, injury, or damage was sustained by a victim: (1) who was committing, at the time, a willful trespass or other tort upon the premises occupied by the owner of the animal; (2) who was provoking, tormenting, abusing, or assaulting the animal or who can be shown to have repeatedly, in the past, provoked, tormented, abused, or assaulted the animal; or (3) who was committing or attempting to commit a crime. (I). Authority to Order Destruction. The Animal Control Officer, upon finding that an animal is dangerous hereunder, following expiration of the appeal process contained herein, is authorized to order, as part of the disposition of the case, that the animal be destroyed based on a written order containing one or more of the following findings of fact; (1) The animal is dangerous as demonstrated by vicious attack, an unprovoked attack, an attack without warning or multiple attacks; or (2) The owner of the animal has demonstrated an inability or unwillingness to control the animal in order to prevent injury to persons or other animals. (J) Procedure. The Animal Control Officer, after having determined that an animal is dangerous, may order the animal seized or make orders as set forth in this Chapter. (1) If no appeal is filed, the orders issued will stand or the Animal Control Officer may order the animal destroyed. (2) No person shall harbor an animal after it has been found to be dangerous and ordered into custody for destruction. (K) Dangerous Animal or Potentially Dangerous Animal — Registration Requirements. The owner of an animal declared dangerous (where destruction of the animal is not ordered) or potentially dangerous shall register the animal with the City and be issued a Certificate of Registration stating that the dog is dangerous or potentially dangerous. The owner shall pay the City the current registration fee as established by ordinance or resolution. In addition to registration, the following conditions shall apply (1) The owner of an animal designated as dangerous or potentially dangerous must have a microchip implanted in the animal for identification, and the name of the microchip manufacturer and identification number of the microchip must be provided to the Animal Control Officer. If the microchip is not implanted by the owner, it may be implanted by the Animal Control Officer. In either case, all costs related to purchase and implantation of the microchip must be borne by the animal's owner. Draft for review 12 -23 -2009 57 (2) That the owner provide and maintain a proper enclosure for the dangerous or potentially dangerous animal. (3) If the animal is a dog that has been declared dangerous and is outside the proper enclosure, the dog must be muzzled and restrained by a substantial chain or leash (not to exceed six feet in length) and under the physical restraint of a person 16 years of age or older. The muzzle must be of a design as to prevent the dog from biting any person or animal, but will not cause injury to the dog or interfere with its vision or respiration; (4) If the Animal Control Officer does not order the destruction of an animal that has been declared dangerous, the following conditions shall also apply: (a) Post the front and the rear of the premises with clearly visible warning signs, including a warning symbol to inform children, that there is a dangerous animal on the property (b) Provide and show proof annually of public liability insurance in the minimum amount of $300,000.00; (c) If the animal is a dog, it must have an easily identifiable, standardized tag identifying the dog as dangerous affixed to its collar at all times. (d) An animal control authority shall require a dangerous dog to be sterilized at the owner's expense. If the owner does not have the animal sterilized within 30 days, the animal control authority shall seize the dog and have it sterilized at the owner's expense (M) Notification Requirements. (1) An owner of a dangerous animal or potentially dangerous animal must notify the animal control authority in writing of the death of the dog or its transfer to a new location where the dog will reside within 30 days of the death or transfer, and must, if requested by the animal control authority, execute an affidavit under oath setting forth either the circumstances of the dog's death and disposition or the complete name, address, and telephone number of the person to whom the dog has been transferred or the address where the dog has been relocated. (2) A person who owns a dangerous animal or potentially dangerous animal, and who rents property from another where the animal will reside must disclose to the property owner prior to entering the lease agreement and at the time of any lease renewal that the person owns a dangerous animal or potentially dangerous animal that will reside at the property. (N) Dangerous Animal or Potentially Dangerous Animal, Designation Review. Beginning six (6) months after a dog is declared dangerous or potentially dangerous, an owner may request annually that the animal control authority review the designation. The owner must provide evidence that the dog's behavior has changed due to the dog's age, neutering, environment, completion of obedience training that includes modification of aggressive behavior, or other factors. If the animal control authority finds sufficient evidence that the dog's behavior has changed, the authority may rescind the dangerous dog designation. The request shall be considered in the same manner as an appeal from designation of the animal control officer. 56
