Pursuant to due call and notice thereof, the Planning and
Zoning Commission held their regular meeting on April 2, 1985
in City Hall. Chairman Tourville called the meeting to
order at 7:10 P.M. Present: Welk, Buesseler, Lindgren.
Murray arrived at 7:16 P.M. Councilman Wilharber present
as liaison for April.
Motion by Buesseler, second by Welk to approve the minutes
of the March 5, 1985 meeting, motion carried.
NEW BUSINESS TAKEN FIRST:
Appearance of Pat Fruth. Discussion on his intention to
put up a building to raise veal on his property at 7384 Mill
Road. The building would be 40' x 140', fully enclosed,
concreted, and insulated at a cost of about $100,000.00.
Liquid manure would be put into a pit and eventually pumped
out. He was unsure how dead animals would be disposed of.
There would be 212 head raised every 16 weeks. A forty
foot trailer truck would do the hauling.
Mr. Fruth is trying to buy more land to meet the 300 foot
setback requirement. If he can't do that, he would like a
variance. It was brought to his attention that money spent
to apply for a variance is not refundable regardless of the
outcome. It was also suggested to him to get the permission
of surrounding property owners, check with the PCA and the
Rice Creek Watershed District before applying for a variance.
Appearance of Roy Mattson. Mr. Mattson wants to put an
addition on to a building which he owns a portion of at
7129 - 20th Avenue North. Mr. Mattson was referred to the
building inspector to check on the type of building he wants
to put up. The Planning & Zoning Commission saw no problems
at this point. The Clerk will have drainage easements of
this property available for the building inspector.
Discussion on property purchased by Becky & Lee Stevens
located at the intersection of Mill Road and Main Street
across from Trippel's Market. The legal description of the
property that the survey shows is different than the one
in our Council Meeting minutes of August 8, 1979, and
Planning and Zoning meeting minutes of August 7, 1979. The
Stevens need a variance from the City or a vacation of 8th
Street to make the lot buildable.
Motion by Buesseler, second by Murray to recommend to the
City Council the vacation of 8th Street for the following
reasons:
1. It does not appear to land lock any properties;
2. Development costs of the road would be high
versus it's benefits;
3. The road crossing would impose significant
environmental impacts. See pages 8, 9, & 24
of the Comprehensive Plan;
4. The vacation does not preclude any foreseeable
development consistant with our zoning district;
motion carried.

If the street is vacated, it is the opinion of the Planning
and Zoning Commission that the lot would no longer be con-
sidered a corner lot, and setback requirements could be met.
The $50.00 fee should then be applied to costs incurred to
vacate the street. If the street is not vacated and the
variance not acted upon, the $50.00 should be refunded to
the Stevens.
Motion by Buesseler, second by Welk to table the variance
request of Becky & Lee Stevens, with their consent, until the
vacation proceedings are acted upon, motion carried.
It was decided to table further discussion of animal ordinance
until the next meeting.
Further discussion on rezoning the property at 6805 - 20th
Avenue South was tabled until the next meeting.
Motion by Lindgren, second by Murray to adjourn meeting,
motto. carried. Meeting adjourned at 10:20 P.M.
