TUESDAY FEBRUARY 5, 1985

Peter Buesseler was duly recognized as a member of the Planning and Zoning
Commission.
A motion was made by Peter Buesseler second by Kathy Welk to elect Dan Tourville
Chairman of Planning & Zoning Commission, motion carried.
Chairman Dan Tourville called the meeting to order at 7:25 P. M.
Deputy Clerk read a letter by Mr. Brokke. Copy of which is attached to and
made part of these minutes.
Members of audience expressed their oppinions on this matter.
Mr. Gordon Rehbein said Sunr ise Plastics has intentions of moving back to
the Centerville location when the building has been added on to possibly
in two years."
Mr. Ken Carpentier asked if grievences would be taken care of if Sunrise
Plastics mocwa back in, such as noise pollution, middle of the night traffic
noise and clean up of the area around the building?
Mrs. Larry Brokke',s question, "Why to they want to change it from commercial
to industrial:"
Chairman Tourville read her ordinances on Commercial and Industrial uses.
He told her the land was now zoned Industrial as granted by the City Council
and could now be used for any business listed under Industrial in the Ordinance.
Mrs Brokke stated her main concern was the devaluation of her porperty. She
also was concerned about the grinding of parts which landed in her yard and
the shift changing which causes noise in the middle of thr night. She had
complained to Sunrise Plastics and nothing was done about it.
Gordon Rehbein was asked by Chairman Tourville if he wants zoning to stay
industrial he said "yes ".
Mr. Ken Carpentier said it was rezoned for Sunrise Plastics and they are not
conducting business there now. His request is to rezone it back to Commercial
until such time that Sunrise Plastics comes back.
Mr. Gordon Rehbein said that Sunrise Plastics would have stayed if he could
have had the building ready before the first of the year and that Sunrise
Plastics does plan to come back when the building is ready.
Mrs. Borkke invited members of P & Z Committee to her home to see the
Surronding property in question. Committee accepted invitation.
No decision was made by P & Z Committee on this matter.

Deptuy Clerk will check with Lino City Hall to Determine from maps what
Mr. BrokkOs land is zoned as.
Deputy Clerk will give current copies of Ordinances k & 8 & Comprenshive Plan
to each new member of the P & Z Committee.
Deputy Clerk will start a list of expenses for formulating a budget to be
presented to the City Council by Sept 1, 1985.
Deputy Clerk will get Flood Plain Map for use at P & Z meetings.
Deputy Clerk will describe land for rezoning with land description, address or
location when public notice is given for rezoning.
Chairman Tourville asked Deputy Clerk to bring request before City Council to
have one member attend r & Z meetings this being rotated between Council Members.
Deputy Clerk will provide copies of minutes of City Council meetings to P & Z
members.
Deputy Clerk will check with Bob Lindgren about his intentions of being a member
of P & Z Commission.
Deputy Clerk will make copies of Animal Ordinances from other towns for Peter
Buesseler.
Peter Buesseler presented materials on Water Recourse Management Plan and asked
Deputy Clerk to distribute copies to P & Z members and to Mike Ayers.
Animal Ordinance was tabeled for further study until next meeting.
Future Agenda -- review zoning areas for accuracy.
Chairman Tourville set next P & Z meeting for Feb. 19, 1985.
Motion by Buesseler, second by Murray to adjourn, motion carried,
Meeting adjourned at 10:00 P. M.

discuss the possibility of rezoning the "East 740 feet of
the south 265 feet of the SE 4 of the SE 4 of Section 23,
Twonship 31, Range 22" from Industrial to Commercial.

Dear Councilmen:
I have attended two city meetings in the month of November. During
those meetings I have clearly expressed my concerns and objections
to the rezoning request by Sunrise Plastics and W & G Rehbein proper-
ty from commercial to industrial. The W & G Rehbein property has been
zoned commercial for at least the last 12 years. The Comprehensive
Zoning Plan by Anoka County in conjunction with its city's, has been in
place for approximately 5 years. The Comprehensive Zoning Plan spe-
cifically describes the W & G Rehbein property as being commercially
zoned. I have lived adjacent to this property under this commercial
zoning for 9 years. I originally built the existing building. I
operated a business on that property for approximately 4 years before
W & G Rehbein obtained ownership. There had been no previous problems
that directly affected my family. Indirectly the constant dumping of
debris; filling the pond has been a concern along with sludge (e.i.
which is sewage hauled from the Pig's Eye sewage plant) being dumped
on the property approximately 3 times creating an atrocious oder
causing nausea and the question, "Why are my neighbors choosing to
create this obnoxious situation for me ?" It was at that time pointed
out by the Minnesota Pollution Control Agency (MPCA) that W & G
Rehbein have never had a permit or temporary permit of any kind at
any given time to dump sewage sludge on the property in question. It
is obvious, W & G Rehbein have very little respect for the law or sludge
would have never been dumped. Those inconvenience and problems have
past.
The present request for rezoning if allowed has serious ramifications
for all adjoining property owners to some degree, through the effects
of sanitation from debris created through the manufacturing of plastic
products; noise pollution from the manufacturing process of their
products; the noise created by the night shift workers when leaving
in their automobiles; devaluation of property which occurs any time
a parcel is rezoned to industrial and the adjoining property owners
have made an investment based on a residential status and even more
destructive devaluation occurs when the adjoining property owners
have a home next to the property that maybe rezoned industrial.
I have specifically pointed out the general problems that would be
created for the adjoining property owners if the rezoning was to be
granted. I will now try to describe the specific affects the rezoning .
will have on my property.

As the adjoining property owner to the south, our house is only 157
feet from the southwest corner of Rehbein's building and Sunrise
Plastics operators. The noise factor is a problem in general. On two
occasions during city meetings, I have made special reference to the
noise made at approximately 4:00 in the morning when the second shift
leaves from Sunrise Plastics. The Planning and Zoning Committee was
made aware of this constant disturbance on November 8, 1984. The city
council was also made aware of it on November 13, 1984. It's now
December 3, 1984. There has been no action taken by the Planning and
Zoning Committee or the city council to correct the problem. This is
also a perfect example of the rude and blatant disregard that Sunrise
Plastics and W & G Rehbein have for adjoining property owners. The
noise continues. The noise from cars, the grinding machines, the
compressor, the machines, the garbage trucks, the debris in our yard
each week, working and running the grinder on Saturday.
I requested that plans be submitted for my review by Sunrise Plastics
describing the new construction of the building and landscrape improve-
ments - Not -Done. I asked that the south wall of the building be insul-
ated to cut machine noise - Not -Done. I asked that a temporary wall be
constructed south of the grinder to enclose debris. All it would have
taken is five pieces of plywood and 2 x 4's. It's Not -Done. Clean up
the debris as it blows around their property - Not.Done. Remove a
piece of metal from the roof of the building that blows back and forth
from time to time making noise - Not -Done. Clean up the east end of
the property in general. Remove debris, washing machine and old wood
crate - Not.Done.
In the month of November we have been awakened by Sunrise Plastics'
employees from 3:45 A.M. to 4:00 P.M. seven times. I asked that some-
thing be done this summer with no satisfaction.
There is no person on the city council that can approve the rezoning
request assuming they will not justify or tolerate accepting increased
city revenues over destruction of my home and property value along
with other adjoining properties. For the city to approve the rezoning
' request is a direct and blatant decision to destroy the value of my
home and all adjoining properties that are now residential. The
individual tax payer's largest investment in most cases is his home
and land. He uses it to build equity which later allows him to use
that equity for an addition or to purchase a new home. He used it as
colateral to borrow funds. When he retires, that home is sold at some
point to provide for income. All the above options would be drama-
, tically affected if any home were put in the situation of residential
property now adjoining an industrial setting with around the clock
noise, debris, etc. None of the council members would be excited about
purchasing the property under the present conditions and obviously the
owners of Sunrise Plastics are not excited about purchasing my home.
Maybe that is the answer. The President of Sunrise Plastics, Rod
Herdina, is required to purchase my home if the rezoning request is
granted. A second option, Mr Herdina, Owner and President, along with
Owner, Mr. Gordy Rehbein can purchase my home.

The city and the council members will be held accountable for their
decision.
I ask you please follow your Comprehensive Zoning Plan. Set a spec-
ified length of time allowing Sunrise Plastics to build a new struc-
ture and stop operating illegally under the present zoning plan. Have
them build in an area now designated industrial in the town of Center-
ville. I can only hope you are God fearing Americans and believe in
the constitution and equal rights for everyone. To approve the re-
zoning would be to disrupt my life and the lives of adjoining pro-
perty owners and destroy the value of my home and the properties
of all individuals involved. Show some compassion for your fellow
man over the almighty dollar.
Imagine yourself and your home in the situation before you. Whether
it's you, I or another fellow American, why cause frustration, incon-
venience, hardships, financial anguish or any harm of any kind, that
should not be what life is all about. Life is caring and sharing among
people. It's disrupted and destroyed by money, selfishness, and greed
everyday. Let's not allow this to be one of those days.

and Sunrise Plastics, it is my understanding that a special
use permit needs the approval of the Planning and Zoning
Commission and the City Council. Please notify me of the day
and the time this issue will come before these government
bodies. The outcome will directly affect my home and property;
therefore, I must be given appropriate notice of the meeting
and time to express my discontent and concerns.

Dear Councilman:
Sunrise Plastics, Inc. has made a decision to abandon their
need and request for rezoning. They were scheduled to attend
the last council meeting with appropiate drawings and descrip-
tion of the proposed addition. They did not attend the meeting.
In the last week of December, Sunrise Plastics moved their
entire operations from Centerville to Arden Hills and obviously
have no intention of pursuing their operation in the City of
Centerville.
In lieu of Sunrise Plastics' decision to permanently mode to
Arden Hills, the need for industrial zoning is no longer a
necessity.
I respectfully request that the City of Centerville rezone
the property described below back to its original commercial
zoning classification. "East 740 feet of the south 265 feet of
the SE a of the SE ; of Section 23, Township 31, Range 22."
This process would eliminate the most crucial concerns of the
adjoining property owners, which is the devastating devaluation
of home and properties.
