HomeMy WebLinkAbout1983-07-12 Minutes Planning and Zoning Meeting Tuesday - July 12, 1983 PRESENT: Dan Tourville Michael Ayers Melvin Dupre Kathy Welk (arrived later) Walter Prachar ABSENT: Bob LaMotte Bob Lindgren Elmer Murray Meeting was called to order at 7:15 PM. Clerk advised P & Z that Mr. LaMotte has resigned as chairman because of health reasons. Mr. Earl Kieffer, 1594 Peltier Lake Drive appeared before committee to present plans for garage on his lot. Mr. Kieffer did not need an okay from P & Z. Messrs. Reed Arcand and Al Schrader appeared before P & Z with preliminary sketch of manufactured home park for area. Discussion was held on the park land dedication and consensus of P & Z was for developer to dedicate the land for a tot park and put in equipment before the city tkes it over for maintenance. Mr. James Frishmon and two other parties appeared before P & E with plans to erect a multi - family dwelling on Lots 7 & 8, Block 12, and Lots 4, 5, 6, Block 13. Discussion followed and they will appear later when plans are finalized. Mr. Randy Zarbok, 1745 Heritage Street appared before P & Z requesting variance to Ordinance #4, previously turned down by City Council. This request would require a 4'1" variance on the side yard because of garage construction of 22 x 24 instead of 24 x 24. Motion by Tourville, second by Ayers to grant variance to Ordinance #4, TABLE B- SCHEDULE OF DISTRICT REGULATIONS -LOT AND YARD REQUIREMENTS, R -2 SINGLE FAMILY RESIDENTIAL (sewered) side yard setback, motion carried. Variance granted because P & Z felt this was an older area of the community and Mr. Zarbok has a smaller lot than ususal in the city. Motion by Prachar, second by Tourville to adjourn, motion carried. Meeting adjourned at 9:40 PM. Listed below are our comments: 1. GENERAL - The lots as laid out appear to be of adequate size. - The east half of this property is outside the urban service district and could not be served with sanitary sewer unless the council enlarged the urban service district. - Any utility installations should be inspected and approved by the City Engineer. 2. SANITARY SEWER - The property within the urban service district should be served with sanitary sewer. - The proposed lots should be filled to provide the necessary cover over the sanitary sewer. 3. WATERMAIN - - If the Industrial Park, Gardner Estates and the Manufacturer Home Park all developed this summer, the Council may want to consider having them install a municipal well and pumphouse and start a municipal water system. 'City of Centerville RE: Prel. Plat Ind. Park - Glen Rehbein - Listed below are some advantage of Municipal Water - Two municipal wells and elevated tank would eliminate the need for t 300 private wells and pressure tanks. Municipal wells are normally better quality water requiring " less softening. Steadier and higher pressure causes more efficient operation of automatic dishwashers, washing machines and etc. - Better fire protection because of hydrants - lower fire insurance. 4. DRAINAGE - The developer should supply our office with a proposed grading plans showing drainage swales, Rice Creek Watershed Ponds, building site elevations and arrows indicating direction of drainage. - Rice Creek Watershed approval will be required before final plat approval. - After the site is graded, all disturbed areas will be seeded and mulched. Hay bales will be installed in critical locations to prevent sediment from entering Clearwater Creek. - While grading the site, the Contractor shall regrade the ditches along Main St. and County Road 54 to assure proper drainage. 5. STREET - The 33' -0" right -of -way is required for 21st Street. - 21st St. will be constructed as a 9 ton road. - 21st St. should be installed to the full 36' -0" width before any development is allowed on lots 8 and 9. - Proposed street grades should be shown on the site grading plan. Before we could recommend approval of the preliminary plat, we should have additional information showing the sanitary sewer extensions, the proposed lot elevations and a more detailed drainage plan. Anyone wishing to be heard on the above amendments should be in attendance at hearing. CENTERVILLE 1 LU PRACHAR, CITY CLERK AMENDMENTS TO ORDINANCE #4 ARTICLE 1. GENERAL PROVISIONS - 13. DEFINED WORDS is amended to read: Words used in a special sense in this ordinance are defined in ARTICLE 7. ARTICLE 2, ZONING DISTRICTS AND DISTRICT REGULATIONS - 21. ZONING DISTRICTS is amended to read: R -4 Single Family Manufactured Housing District - sewered. ARTICLE 2 ;\ SCHEDULE OF REGULATIONS is amended to read: The attached "Schedule of Regulations" applying to land and buildings as indicated for the various districts established by this ordinance is hereby adopted and declared to be a part of this ordinance and may be amended in the same manner as any other part of this ordinance. In addition to the regulations established in residential dwelling units which are constructed within the R -1, R -2, R -3 and R -4 single family residential districts: ARTICLE 2. 24. SCHEDULE OF REGULATIONS (3) is amended to read: Single family dwellings other than approved earth sheltered homes shall have at least a 3/12 roof pitch and shall be covered with shingles or tiles. ARTICLE 2. 25. GENERAL REQUIREMENTS. 25.03. RESIDENTIAL DENSITY is amended to read: All future residential densities greater than those permitted under the R -2 and R -4 District shall be developed under the planned unit development section of this ordinance. ARTICLE 2. 25. GENERAL REQUIREMENTS. 25.06. MANUFACTURED HOMES is amended to read: Manufactured homes permitted in residence districts if they meet the design criteria for such districts. Any manufactured home which does not meet the requirements imposed for such home by this ordinance shall not be permitted to be located within the City of Centerville. All other manufactured homes shall be located only in designated manu- factured home districts which meet the requirements of this Ordinance. The general intent of this district is to provide for manufactured housing in subdivided developments, in safe, attractive residential neighborhoods with all urban services and desired amenities as other residential areas. No person shall erect, establish, extend or enlarge a manufactured housing development within the limits of the City of Centerville without first obtaining site plan approval from the City Council upon receipt of the recommendations of the Planning Commission. Approval shall be granted only upon complia ce with all the following: (1) Compliance with all other 'of this Ordinance #4, Centerville Zoning Ordinance; (2) Compliance with all the terms of Ordinance #8, Centerville Subdivision Ordinance; . (3) The proposed development must be located in the City's urban service area as shown in the Comprehensive Development Plan, and must be served by required public utilities. • ARTICLE 2 - 25. GENERAL REQUIREMENTS - 25.10. FINAL GRADING AND LANDSCAPING. 25.10 -4 is added: Within a year from the effective date of this amendment to the ordinance, all existing occupied lots shall be brought to finished grade and shall be sodded or seeded to prevent soil erosion. also, addition of 25.10 -5: Every manufactured housing development shall provide for perimeter screening, consisting of a vacant strip of land ten (10) feet in width along all boundaries of the site. Each perimeter screen will consist of' deciduous and evergreen trees, shrubs and bushes so as to form a screen to adjacent properties and streets. Plans for plantings shall be approved by the Planning Commission and Council, and included in any bond required as a part of the development contract. The perimeter screening may be placed under the control of a homeowners association or be included in individual platted lots. Deed restrictions requiring the permanent reservation of material shall be recorded along with the final plat. ARTICLE 3. SUPPLEMENTARY REGULATIONS. 33. HEIGHT - 33.01 DWELLINGS is amended to read: In the R -1, R -2, R -3 districts no dwelling or other structure may be erected to a height exceeding thirty -five (35) feet.
