HomeMy WebLinkAbout1995-07-11 Minutes CITY OF CENTERVILLE PLANNING & ZONING COMMISSION TUESDAY, JULY 11, 1995 Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held two public hearings and their regular meeting on Tuesday, June 11, 1995, at the City Hall. Chairman Tourville called the meeting to order at 7:06 p.m. Present: Welk, Vermeulen, LaMotte; Absent: Drilling. Acorn Creek H, Preliminary Plat Public Hearing Rehbein stated that the City Council wanted more park property so he deleted some lots to accommodate the Council. An additional change that Rehbein will have made will be changing Lot I, Block 1 by adding 10 feet and minus the 10 feet from Lot 3. Rehbein also stated that in trade of the trail easement from Acorn Creek I, he would put a sidewalk on 74th Street. And when the Moore's property is developed that will provide another access to the park on the other side. Tourville asked Rehbein about the issues addressed the MSA's letter dated July 6, 1995. Q: A 20 -foot utility and drainage easement will be required along one of the lot lines in both Block 2 and 3 for a proposed storm sewer line. A: It will be addressed in the finalized plans, the sewer and water plans are not done yet. Q: Blocks 2 and 3 exceed the maximum 620.00 foot length and will require a variance. A: Feels it is not needed and that that is MSA's opinion. Q: A temporary cul -de -sac will be required at the end of 74th Street until the property to the north is developed and the proposed street is extended. A: Is indifferent to a T or cul -de -sac. Q: A portion of Outlot B, shown as a park in the Acorn Creek First Plat, it should not be included in Acorn Creek Second Addition. A: Will make the change on final plat. Q: It is unclear what the purpose of Outlot A is and who will receive ownership of the parcel. 1 Planning & Zoning Commision, 7 -11 -95 A: Will go to Bob Burgstahler in property trade for easement. Patrick Fruth, 7384 Old 11 Road, questioned the road easement that is currently going to the back of his property. Rehbein replied that would not change, Bob Burgstahler, 7381 Old Mill Road, asked if the grading has been re- looked at. Burgstahler's concern is with Lot 3, Block 1; is there going to be an 80 foot retaining wall on the edge of the creek. Rehbein stated that MSA sent a letter to the city requiring the lot to have a retaining wall and the specifics of it. Burgstahler would like to see where the wall would be and also that the wall be installed before a building permit is issued for the lot. Burgstahler also questioned if Rice Creek and/or the DNR have requirements for a retaining wall on the creek. Patrick Fruth, 7384 Old Mill Road, questioned the watershed drainage. Rehbein stated that there will be a storm sewer between Block 3, Lots 5 & 6 from the back of the house across the street to the back of the house on Block 2. Bob Burgstahler stated that the holding pond was originally approved to drain the whole development therefore there should be no problem. Motion by Vermeulen, second by Welk to close the public hearing for the preliminary plat of Acorn Creek II at 7:28 p.m., motion carried unanimously. Little Rascal Public Hearing Little Rascal Public Hearing was called to order at 7:29 p.m. Tourville stated that the building at 1724 Main Street would require a special use permit in order to make fishing lures. The type of work is considered light industrial and the building is in a commercial zone. Scott Raschke stated they manufacture fishing lures; it is light industrial work. Some of it is subcontract and some they make ready for retail sale. Here is an example of steps taken when centrifugal molding is done: hooks are put in the mold, lead is poured in the mold (new or clean lead is used only), it is then racked in styrofoam, dipped in paint, then broken down and bagged. Little Rascal has been operating in the building since February 8, 1995, the previous occupants (Noble Welding) also required a special use permit. They did not know that the permit was issued to each company and therefore that they could not operate under the same permit. Tourville addressed the concerns outlined in a memo from the Fire Chief, Milo Bennett. 2 Planning & Zoning Commision, 7 -11 -95 Paint Booth: Raschke stated that they use epoxy paints. There is very little overspray and they are also putting in a new filter system which will take care of the overspray and also the odor. Most of the painting is done by dipping and there is no odor in that process. Additional exit: There will be a swinging service door installed next to the garage door. Employment: They currently have 6 employees from Centerville and 12 from surrounding communities. Ages range from 17-45, most are in their early 20's. Parking: They run a 5 hour shift, twice a day therefore not creating a problem for the employees to park. Chemical Waste: They are in the process of obtaining a permit to have Safety Clean take away cleaning chemicals used. They have less paint on the premises than most households have in them. They use 1.5 - 2 gallons of paint a week. There is no lead waste therefore no disposal or storage is needed. Fire Hazards: They have adequate extinguishers on hand. Public Utilities: They have no problems with them. Motion by Welk, second by Vermeulen to close the public hearing for Little Rascal's Special Use Permit at 7:40 p.m., motion carried unanimously. APPROVAL OF MINUTES Reg,Jir Meeting of June 7, 1995 Line 145 amend to read: there should be no problem in any Line 174 amend to read: back to 32 units won't hurt the community. Line 225 amend to read: Pole Barn Line 293 add: motion carried unanimously. Line 305 amend to read: turned back to Planning and Zoning for approval. Motion by Vermeulen, second by LaMotte to approve the meeting minutes of June 6, 1995, with the above amendments. AYE - Tourville, Abstain - Welk, Motion carried. OLD BUSINESS 3 Planning & Zoning Commision, 7 -11 -95 Tourville stated he would like to eliminate the 620 foot maximum length of the road from the ordinance. He has no objection to granting a variance. Tourville also added that a sidewalk is a good solution to the trail easement for the park property. Motion by Vermeulen, second by LaMotte to recommend to approve the preliminary plat for Acorn Creek Second Addition with the contingency that Rehbein complies with the items listed in the MSA letter dated July 6, 1995. Motion carried unanimously. 1.ittle Rascal Flak Special Use Permit Recommendation Mayor Wilharber stated he spoke with Paul Raschke on May 26 and 27, 1995. Mr. Raschke has been a Hugo resident for 22 years. Paul plans to retire from his full time job and work with Little Rascal Bait full time. Wilharber said this it is a real good use of the building and good for the future of Centerville. Raschke stated that he plans to utilize all of the floor space in the future. He also noted that he has talked with the neighbors and no complaints have been expressed to him. Raschke stated that the door is always open if you want to see the operation. Tourville stated that he shares the same concerns of the Fire Chief. He also added that it behooves the community to work with businesses. Reasons to grant Special Use Permit: - No problem with location of the building - Previous Owner has Special Use Permit - Concerns of the Fire Chief will be addressed - Parking is not a problem for the employees - Hazardous Wastes will be disposed of properly. Motion by Welk, second by Vermeulen to grant a Special Use Permit to Little Rascal Bait with the contingency that the Fire Chiefs recommendations will be met, and also for the reasons noted above. Motion carried unanimously. Gaiden Meadows Gerald Rehbein stated that Lonnie Komovich want to put his project on hold. Rehbein also has a potential developer for the same type of project using the whole 12 acres, but that the units would be for sale. He also has an interest for an industrial building. Mayor Wilharber stated when he talked with Minnesota Housing Finance Agency (MHFA) they stated Komovich had been turned down and the factors that made an impact on that decision are: transportation and the petition from the residents. Komovich now has to wait two years before re-applying. 4 Planning & Zoning Commision, 7 -11 -95 Rehbein would like to wait 60 days before making a decision as to who is going to develop the property. Tourville asked the residents present how they felt if the industrial building doesn't go through, what about the project with the units being for sale. Residents: Lisa Atkinson, 1970 S. Robin Lane Pam Burns, 7169 W. Robin Lane Catherine Rodgers, 7175 W. Robin Lane Craig Borowitz, 7214 Unity Avenue None of the residents seemed to have a problem with the project. The only concern expressed was for the school district. Tourville stated that they have not received a plat proposal and Kornovich was not present to discuss the project and Rehbein said it was a dead issue. Committee Member Vermeulen - absent as of 8:25 p.m. Ordinance 44A The ordinance is open to interpretation therefore P &Z have no problem re- writing it if Council wishes. Mayor Wilharber said he had done some driving around and doesn't feel Centerville wants pole barns. Welk stated the City needs to stick with what they want and be selective to the type of construction being used. Tourville stated they should specifically state in the ordinance that no steel siding or pole barns are allowed. Mayor Wilharber stated he has a meeting on Friday, June 14, 1995, with a business that may want to put up a pole barn, but believes that with the newly created TIF district it may provide companies the extra edge to build concrete or wood to comply with the City's standards. Planning and Zoning would appreciate direction from City Council as to Ordinance 44A and also have City staff research other cities ordinances relating to this. 5 Planning & Zoning Commision, 7 -11 -95 Motion by Tourville, second by Welk to table Ordinance 44A, motion carried unanimously. Pawn Shops & Adult Entertainment Craig Borowitz, 7214 Unity Avenue, questioned if there had been someone interested in putting a building up for this type of business. Tourville said no, that they just wanted to get an ordinance in effect before someone came before them with a proposal. He also stated that it would be a lengthy discussion and to table until next meeting. Motion by Tourville, second by Welk to table Pawn Shops & Adult Entertainment Ordinance, motion carried unanimously. NEW BUSINESS Sodding .ra ing Poi y Tourville stated that currently the front and sides need to be sodded and the back can be seeded. He questioned the proposed policy from Paul Palzer whether the escrow of $1000.00 is enough, it should be 1.5 rimes the cost. Mayor Wilharber stated that it should be in the development agreement to sod the entire lot. He also added that in the policy proposal Paul is referring to the backyard. Welk stated she thinks a year is to generous and a deadline of sod installation should be July 1, 1995, to stop erosion all summer. Tourville said that drainage is very critical in this community. If the property is not sodded the city will do it for cost plus 50 %, hopefully this will encourage an early accomplishment. Wilharber stated it should be the builders responsibility to sod and not the resident. Tourville said that would be a better solution due to the fact that they are the ones moving the dirt around during construction. OTHER DISCUSSION Tourville stated that Council would be awarding the Comp Plan project at the next City Council meeting. 6 Planning & Zoning Commision, 7 -11 -95 Welk said she is glad to see Tom Thumb on Main Street. It is good to see the buildings being used and just like Little Rascal also offer employment opportunities.
