HomeMy WebLinkAbout1995-06-06 Minutes 1 2 3 PLANNING AND ZONING 4 JUNE 6, 1995 MEETING MINUTES 5 6 Pursuant to due call and notice thereof, the Planning and Zoning 7 Commission of the City of Centerville held their regular meeting 8 on Tuesday, June 6, 1995, at the City Hall. Chairman Tourville 9 called the Golden Meadows Public Hearing to order at 7:08 p.m. 10 Present: Vermeulen, LaMotte, Absent: Drilling, Welk. 11 12 Tourville stated he will open the public hearing once again for new 13 information only. 14 15 Mary Capra, 1810 Fox Run, stated she received calls from residents 16 regarding when the Minnesota Housing Finance Agency (MHFA) will 17 make their decision on his application and that the date was June 18 22, 1995. 19 20 Kornovich presented his new proposal of the project of 4 buildings, 21 32 units on 5.54 acres. This does include 10% for parks, and each 22 unit has a two car garage. 23 24 Sanna Buckbee, 7381 Peltier Circle, asked if this was the public 25 hearing for the preliminary plat approval. Kornovich replied that 26 he would not be required to have a public hearing for lot split. 27 Tourville stated, "Let's not put the cart before the horse, let's 28 hear the proposal first." 29 30 Kevin McGowen, 1980 Cardinal Drive, asked if the parks are going to 31 be public or private? Kornovich replied that he hasn't heard the 32 recommendations from the P &R committee. 33 34 Sanna Buckbee, 7381 Peltier Circle, questioned the proposed living 35 space. Kornovich gave the following requirements and proposed: 36 No. of Bedrooms Required Proposed 37 Square Footage 38 1 Bedroom 680 700+ 39 2 800 832 40 3 1040 1150 41 42 and garages are 452 square feet. 43 44 Dawn Olson, 7228 Unity Avenue, asked if they are still going to 45 provide a tornado shelter. Kornovich replied, no. 46 47 Rod and Lorraine Henslin, 1967 - 73rd Street, questioned the 48 driveways and the dumpster facilities and recycling centers. 49 Kornovich replied that the driveways still need to be defined and 50 there will be separate dumpsters for each recyclable. 51 52 53 Planning and Zoning 54 June 6, 1995 55 Page 2 56 57 Sanna Buckbee, 7381 Peltier Circle, asked if he would object to 58 putting concrete curb and gutters. Kornovich replied that they 59 would be. 60 61 Lisa Atkinson, 1970 S. Robin Lane, asked Kornovich why is he so 62 determined to build the project with a community that is so against 63 it. Kornovich replied that he is trying to compromise with the 64 city and residents and that is why they have changed the plans. 65 66 Tourville asked for comments regarding the proposed downsizing of g g 67 the project. 68 69 Lorraine Henslin, 1967 - 73rd Street, stated she does not want 70 rental, why can't they be for sale ?. 71 72 Dawn Olson, 7228 Unity Avenue, stated the Better Business Bureau 73 doesn't have anything on Metes and Bounds. 74 75 Kevin McGowen, 1988 Cardinal Drive, stated the no one person has 76 been to White Bear Township, Hugo, Lino Lakes meetings regarding 77 their low income tragic; and it's because the residents of 78 Centerville cares about their neighborhood. McGowen also requested 79 they address the issues of policing, schools, and taxes. 80 81 Sanna Buckbee, 7381 Peltier Circle, stated it would be non - 82 homesteaded tax, therefore the city would receive double the amount 83 on a homesteaded house. 84 85 Rod Henslin, 1967 - 73rd Street, stated the cost of policing would 86 still increase. 87 88 Mary Capra, 1810 Fox Run, stated that only 1/3 of the applications 89 are granted and also added that there are several things they look 90 at when making their decision. 91 92 Kornovich stated that MHFA is whom recommended he downsize the 93 project due to the concerns they received from the citizens. All 94 four units would go in at the same time and that would be the 95 maximum size of the project because Rehbein plans to rezone the 96 remaining property. 97 98 Kevin McGowen, 1988 Cardinal Drive, asked if the property can be 99 rezone before the start of construction. 100 101 Catherine Rodgers, 7175 W. Robin Lane, asked if the special use 102 permit is still required. Tourville responded, that it is required 103 for use of the property but the contents of it has not been 104 addressed yet. .05 Planning and Zoning .06 June 6, 1995 .07 Page 3 .08 109 Mary Capra, 1810 Fox Run, stated that Susan at MHFA said they would 110 never fund 96 units due to the impact on the city. 111 112 Sanna Buckbee, 7381 Peltier Circle, questioned the laundry 113 facilities. Kornovich responded that there would be one general 114 per building. 115 116 Pam Burns, 7169 W. Robin Lane, stated that there is not an in and 117 out for the fire and rescue to get through. Kornovich replied that 118 they are no longer streets they are driveways /parking spaces and 119 that with the parking lot they would have enough turn around room. 120 121 Sanna Buckbee, 7381 Peltier Circle, stated that it is the 122 responsibility of the city to provide housing for those who cannot 123 afford a down payment. 124 125 Motion by Vermeulen, second by LaMotte to adjourn the public 126 hearing at 7:56 p.m., motion carried unanimously. 127 128 Tourville called the regular Planning and Zoning meeting to order 129 at 7:57 p.m. 30 _31 APPROVAL OF MAY MEETING MINUTES 32 133 Tourville stated he would like future meeting minutes to include 134 reasons for decisions in the motion. 135 136 Motion by Vermeulen, second by LaMotte to approve the May 2, 1995, 137 meeting minutes, motion carried unanimously. 138 139 OLD BUSINESS 140 141 Feasibility Study 142 143 The new feasibility study was done in reference to 96 units. Items 144 that were updated: Waterflow, wetlands evaluation, utilities. 145 According to the new study, there should be no problem in any 146 areas. Kornovich feels it was a good thing to have it re -done and 147 hope it helps in the decisions. 148 149 Downsize of Golden Meadows 150 151 LaMotte stated he was surprised with the downsize and that it was 152 nice to see. LaMotte also added he did check into Metes and Bounds 153 and heard only good things from their employees. He also said that 54 even wealthy people do not want to buy houses, they want to rent so 55 they don't have to do lawn care and upkeep. 56 157 Planning and Zoning 158 June 6, 1995 159 Page 4 160 161 Vermeulen expressed concern about the maintenance of roads (plowing 162 and lighting) and also added that the downsize is good. 163 164 Kornovich stated that the management company will address any 165 problems immediately because they want the program to work. 166 167 Tourville asked what the percent or chances of elderly /seniors 168 living in the project. Kornovich answered that one of the highest 169 demands are for handicapped. Only 1 unit per building is required 170 but may have more because of the demand. 171 172 Bill LaLonde, 1687 Westview Street, stated when he first heard 173 about it he was upset, thought the size was to big. Feels the 174 scaling back to 32 units won't hurt the community. LaLonde is 175 still concerned with the ownership of the project. 176 177 Kornovich replied that the management company keeps it for 18 years 178 before it can be sold. 179 180 Kornovich stated that Metes and Bounds has a good reputation for 181 maintaining of their properties. Kornovich stated he can't believe 182 the concern of the upkeep of the properties when some of the houses 183 in Centerville are not kept up. Some need painting, missing 184 siding, need roof improvements, etc. 185 186 Mayor Wilharber stated that building rental property is new to the 187 city and has brought concerns to the residents. He asked Kornovich 188 if he would continue to build if turned down for financing. 189 Kornovich replied no. There is two more drawings for credits and 190 1 out of 3 receives them. Tourville stated that even if the city 191 gives approval the project may not be done if credits are not 192 obtained. Wilharber added that Kornovich has a 981 approval rate 193 so therefore must be doing something right. 194 195 Vermeulen stated she would like to wait until there is a full 196 commission before acting on. 197 198 LaMotte believes that if they hold off and let things settle, the 199 idea might be better accepted. 200 201 Wilharber stated that with the change in the plat it has to be 202 looked at by the Building Inspector. Kornovich stated that he was 203 not going to spend $10,000.00 for a preliminary plat if the project 204 won't even be accepted. 205 206 Motion by Vermeulen, second by LaMotte to table recommendation on 207 the sketch proposal of Golden Meadows until there is a full panel, 208 Nay - Tourville, motion carried. :09 Planning and Zoning :10 June 6, 1995 :11 Page 5 :12 213 Reschedule of July Meeting 214 215 Kornovich requested a special meeting to decide on Golden Meadows 216 before the next deadline for MHFA applications. 217 218 Catherine Rodgers stated she opposed to P &Z even considering a 219 special meeting. 220 221 Consensus on the Commission to query other members to find a date 222 to fit all of the schedules. 223 224 225 Building Construction (Pole Barn - Ord. 44A) 226 227 Tourville stated he did not feel the ordinance was specific enough. 228 He has talked with other Industrial property owners, some are 229 opposed to pole barn building, others aren't as much if they are 230 dressed up. 231 232 Vadnais was present and stated that there is two options for the 233 property: 34 1 - he will put a 5000 square foot building on the property 35 and be sole owner - this is what he would prefer happens. 36 _37 2 - he would keep his building at the original 3000 square 238 foot, and Jerry Peterson would have a 6000 square foot 239 building also on the property. 240 241 LaMotte asked what would happen if one of the property owners 242 wanted to sell? Vadnais answered that he would have first option 243 to buy but would prefer to go into this by himself. 244 245 Tourville believes the community would like to avoid pole barn 246 construction and appearance of a building. Believes the intent 247 behind Ordinance 44A is concrete construction. 248 249 Mayor Wilharber stated he also has talked with other industrial 250 property owners and they weren't granted pole buildings years ago. 251 He also believes the intent of the Ordinance to be concrete 252 construction. 253 254 LaMotte asked, if two buildings go up, how are they going to be 255 arranged on the lot? Vandais answered, North and South. He also 256 added that the second building would be the same construction as 257 his but with more stone and wood in the front. 58 59 Tourville questioned is it the overall appearance that makes the 60 difference. Vermeulen questioned if the ordinance was on the 261 Planning and Zoning 262 June 6, 1995 263 Page 6 264 265 construction or the appearance. 266 267 Tourville feels the ordinance should be changed to read more 268 explicit. Tourville asked audience member, Gerald Rehbein what his 269 opinion is. Rehbein responded that people have come and gone but 270 buildings will always be here and that previous buildings had to 271 change to concrete. Rehbein said he sees a problem being created 272 if accepted. He also added that the tax base for concrete is three 273 times as much. 274 275 LaMotte stated the city would be turning down 2 businesses if they 276 say concrete only and also losing tax base, but also there is not 277 a lot of industrial land therefore maybe it should be turned down. 278 279 LaMotte asked Vadnais if he can hide the sides with landscaping, or 280 disguise the building with brick. Vadnais replied that he would be 281 willing to brick 4 feet up on the sides to disguise the building. 282 283 Vadnais stated that he would be conducting business in Centerville 284 not elsewhere and that the customers would be Centerville residents 285 and not so much other cities. 286 287 Mayor Wilharber questioned the estimated market value for a 5000 288 square foot building, Vadnais answered $125,000.00 without the 4 289 feet of brick on the sides. 290 291 Motion by LaMotte, second by Vermeulen to recommend to grant an 292 initial 5000 square foot building to be designed and landscaped and 293 the use to be in accordance with the ordinance. 294 295 Pawn Shops /Adult Entertainment 296 297 Motion by Tourville, second by Vermeulen to table this issue for a 298 future meeting, motion carried unanimously. 299 300 Acorn Creek 2nd Addition 301 302 Rehbein stated he had a preliminary plat approval then went to City 303 Council, they only approved the bottom half, they wanted more parks 304 so therefore he has removed lots to make more park space. Because 305 of the change made on the plat it was turned back to Planning and 306 Zoning for approval. 307 308 Rehbein stated the dirt work has been done for the streets. 309 Rehbein added that the trail easement problem may be eliminated 310 with the Street. the would be a 7 ton road therefore not requiring 311 sidewalks, but Rehbein would put sidewalks in to give a safe access 312 to the park.
