2 MEETING MINUTES

5 Pursuant to due call and notice thereof, the Planning and Zoning
6 Commission held their regular meeting on Tuesday, March 7, 1995
7 at the City Hall. Chairperson Tourville called the meeting to
8 order at 7:06 p.m. Present: Drilling, LaMotte, Vermeulen, Welk.

10 Approval of Minutes
11 Chairperson Tourville stated that P &Z did not have quorum in
12 February or December and did not meet in January, therefore the
13 last meeting of record is November.

15 Motion by Vermeulen, second by Welk to approve November, 1994
16 meeting minutes. Aye - Tourville, Abstain - Drilling, LaMotte.
17 Motion carried.

19 APPEARANCES:

21 Bill Bisek - Central Business District
22 Bisek, owner of Kelly's Korner, appeared before P &Z requesting
23 they review Ordinance #4 and consider amendments that may be more
24 applicable to the unique downtown situation. Bisek also
25 expressed that he would like to expand Kelly's Korner, a 25 x 25
26 addition for games, to bring back family dining to the community.
27 According to the current ordinance, as the building stands now it
28 is non - conforming, secondly he cannot add to a non - conforming
29 building and finally, the parking issue.

31 Tourville stated the City has received copies of other cities
32 ordinance, Elk River, Stillwater and White Bear Lake, to look at
33 their downtown zoning.

35 P &Z concluded to meet with City Council regarding Comp Plan and
36 set up another time for future discussion.

38 PUBLIC HEARINGS:

40 Jack Lehtinen - Rezoning of Industrial Land
41 Tourville called the public hearing to order at 7:17 p.m.

43 Gordon Rehbein withdrew request has no further interest to
44 rezone.

46 Motion by Drilling, second by LaMotte to adjourn public hearing.
47 Motion carried unanimously.

49 Lloyd Hansen - Variance Request
50 Tourville called the public hearing to order at 7:20 p.m.

52 Hansen stated that a variance is needed for set back line, it
53 currently sits at 24.7 and should be at 25.0. Therefore the

59 purpose of the public hearing is a 3" variance.

61 Tourville question if the building inspector okayed the
62 foundation. Eric Marshall stated that it had been approved.

64 Vermeulen expressed embarrassment and frustration that a 3"
65 variance has been brought before the P &Z committed and the cost
66 the Hansen's have put into it.

68 LaMotte suggested P &Z recommend to Council to grant 3" variance.
69 Vermuelen also suggested the variance be granted and also that
70 the $150.00 should be refunded to the Hansen's.

72 Motion by Welk, second by Vermeulen to adjourn public hearing.

79 Gerald Rehbein - Golden Meadows Preliminary Plat
80 Gordon Rehbein stated that he believes that the plot was approved
81 a few years ago and was then tabled by the new Council for a two -
82 year study, during which time he lost potential buyer.

84 Lonnie Kornocich, potential developer for property, showed the
85 committee pictures of buildings similar to what would be built.

87 Dawn Olson, 7228 Unity Avenue, questioned what kind of housing it
88 would be and if it was low income. Kornocich stated it is
89 moderate income housing. Some federal funding would be used from
90 Minnesota Housing Finance and tax credits.

92 Lisa Atkinson, 1970 S. Robin Lane, expressed concern for housing
93 project because of the current problems they are experiencing
94 with HUD home occupants across the street.

96 Kornocich stated that the for this program the renter must make
97 60% of the average income level, which is, $30,000 a year or less
98 in order to live in the housing project.

100 Gary Bland, 1971 S. Robin Lane, stated that he does not want
101 housing project to go up, believes it will be nothing but
102 trouble. Bland requested that the City protect the current
103 residents.

105 Tourville questioned that if it is rental property would it be
106 one property owner or management company for the whole complex or
107 each individual building. Kornocich answered that it would be
108 one owner /management for the whole complex.

113 Atkinson added that the problems in the neighborhood include
114 smoking, drugs, drinking, swearing from kids to adults and other
115 kids, loud noises and destruction of property.

117 Councilmember Helmbrecht stated that this issue should be brought
118 before the City Council and that she was not aware of all the
119 trouble going on on S. Robin Lane.

121 Rehbein stated that they are also looking at park equipment to
122 put next to each building and /or purchasing additional property
123 for a park for that community. Councilmember Helmbrecht
124 questioned whose responsibility it would be to do the upkeep on
125 the equipment. Kornocich answered that it would be the
126 owner /management company.

128 Gerald Rehbein stated the project is already zoned and they are
129 paying assessment for water and sewer and if they can't develop
130 the property they should be refunded assessments and interest.

132 Motion by Vermeulen, second by Welk to schedule a public hearing
133 for Golden Meadows project for April 4, 1995, 7:00 p.m. Motion
134 carried unanimously.

136 J.R.V. Automotive - Joseph Vadnais
137 Joseph Vadnais stated that he would like to build a general
138 repair automotive repair business in Centerville. It is a 30 x
139 50 butler building, similar to the Swenson building with a wooden
140 material to look like a stone front, similar to the Veterinary
141 Clinic. Vadnais also added that he did not know where to start
142 and what the next step would be.

144 Tourville stated the property is currently zoned industrial and
145 Vadnais's proposal meets the business criteria although the
146 minimum square footage is 5000 and he is only proposing a 3000
147 square foot building.

149 Welk expressed concern of it being a pole barn versus a butler
150 building. Vadnais stated that a butler building is a steel
151 framed building bolted together and a pole barn is a cement pour
152 with the frame in the ground.

154 Drilling stated that Vadnais will have a major problem with the
155 square footage. Tourville added that a variance couldn't be
156 granted because the lot is vacant and there is no reason he
157 couldn't comply with the ordinance. Tourville suggested to
158 Vadnais to come up with site plan for proposal to City Council.
159 Welk stated concern with the amount of steel allowed and what
160 kind of materials would be used on the exterior and front of the
161 building.

167 A copy of Ordinance 4, Appendix B was given to Vadnais with the
168 suggestion to take the following steps: propose a site plan to
169 City Council, the City would asked City Engineer for approval and
170 then the next step would be the building permit.

172 Discuss Joint Meeting with City Council
173 P &Z suggested to meet with City Council to discuss the proposal
174 to rewrite the Comp Plan on Thursday, April 6th or Thursday,
175 April 20th. Helmbrecht stated to keep the cost down to rewrite
176 the Comp Plan as a City or using a college program.

180 Golden Meadows
181 Welk asked if more policing can be requested in the problem area
182 of S. Robin Lane. Drilling stated that it won't change the
183 problem and that the City should put pressure on the County to
184 put better people in the houses.

186 Councilmember Helmbrecht stated that HRA is being asked to buy
187 these houses from HUD and that HRA is locating homeless people
188 throughout Anoka County. Helmbrecht also added that she would
189 like to see seniors move into Centerville.

191 Mayor Heineman
192 Councilmember Helmbrecht stated that Mayor Heineman has verbally
193 resigned.

195 Lloyd Hansen Variance
196 Motion by Welk, second by LaMotte to grant a 3" variance and to
197 request a refund of the money for the variance. AYE -
198 Vermeullen, AYE - Tourville, NAY - Drilling. Motion carried.

200 Noble Welding
201 Tourville stated Noble Welding wants to expand as long as they
202 meet the ordinance they would not have to appear before P &Z. And
203 also added, Noble Welding would have to speak with the Building
204 Inspector to clarify zoning and drainage requirements.
205 Councilmember Helmbrecht stated he should obtain the required
206 permits.

208 Chairperson for 1995
209 Motion by Drilling, second by Vermeulen to re -elect Tourville as
210 Chairman for the Planning and Zoning Committee. Motion carried
211 unanimously. Drilling expressed appreciation to Tourville for
212 all the work he has done for P &Z and the City of Centerville.

214 Meeting Attendance
215 Tourville stated that attendance has been good in the past and is
216 good training and background for community activities. Tourville

221 suggested that the committee members notify the City if they will
222 be absent, to let them know if a quorum will be met or if the
223 meeting should be cancelled.

226 Tourville stated he would discuss and set agenda with Roger
227 Winberg, Clerk /Administrator.

230 Motion by Welk, second by Drilling to adjourn meeting at 9:52.
