Pursuant to due call and notice thereof, the Planning and Zoning Commission held their regular meeting on Tuesday, April 5, 1994 at the City Hall. Chairperson Tourville called the meeting to order at 7:20 p.m. Present: Drilling, LaMotte, Vermeulen, Welk. MINUTES: March 1, 1994 meeting minutes. Motion by Welk, second by LaMotte to approve the Tuesday, March 1, 1994 meeting minutes; AYE - Welk; AYE - LaMotte; AYE - Tourville; ABSTAIN - Drilling; ABSTAIN - Vermeulen, motion carried. OLD BUSINESS: Lot Split /Variance Request - Lloyd and Diane Hansen. Lloyd Hansen, property owner, was present. Mr. Hansen noted he had attended the March 2, 1994 Park and Recreation Committee meeting. Mr. Hansen noted there was very little discussion at the meeting concerning the vacation of Sorel Street and its planned use as park land. Mr. Hansen noted he had mailed a letter to the Planning and Zoning Commission and City Council stating his reasoning why the lot split /variance request should be granted. A copy of this letter is on file with the Clerk /Administrator. Mr. Hansen acknowledge the Planning and Zoning Commission's concern regarding setting a precedent. Mr. Hansen noted he received a list of property owners on Centerville Lake and contact the property owners. Mr. Hansen explained he spoke with Richard DeFoe and Harold Liebel regarding their plans to subdivide their property. Mr. Hansen stated that both property owners had no intention of subdividing their properties. Mr. Hansen stated that Mr. Liebel informed him that his property has sewer stubs every 100 feet and has no doubt the lots, when subdivided, would be 100 feet. Mr. Hansen noted he has had nothing but encouraging words from the neighbors, and many want to see the property developed. Commission member Drilling noted that if a variance is not granted, Mr. Hansen could be a multi- family dwelling. Mr. Hansen noted he spoke with John Williamson, Building Inspector, regarding a twin home. Mr. Williamson explained to Mr. Hansen that a twin home requires a common wall. The common wall can be the garage wall, but he prefers not to build a twin home. P &Z MEETING MINUTES APRIL 5, 1994 PAGE TWO Chairperson Tourville noted he had a local developer /builder look at the property. Chairperson Tourville noted the builder stated a twin home is not nearly preferably as single family homes. Chairperson Tourville expressed that a twin home may cause more problems for the City than single family homes. Chairperson Tourville noted that what happens with one twin home has a bearing on the other (i.e. paint, shingles). Chairperson Tourville stated that two single family homes may be better than a twin home, however it still does not address how to justify the granting of the variance. Commission member Drilling thought it would be a mistake for the Planning and Zoning Commission to grant the lot split /variance request. It does not meet the standards for granting a variance. Commission member Drilling noted there may problems down the road if it is granted. Mr. Hansen noted the land is peculiar due to its shape and this is not a result of his actions. Commission member Drilling explained that Mr. Hansen bought the lot aware of the shape and square footage. Commission member Drilling noted he has a 100 x 300 lot and he would not be able to subdivide the parcel because it would not meet the frontage requirements. Mr. Hansen expressed he felt his lot was also unique because it is a lake lot. Mr. Hansen felt that lake lots are traditionally not as wide. Mr. Hansen feels that literal interpretation of the ordinance deprives him of rights enjoyed by others. Mr. Hansen noted there are 75 foot lake lots on Peltier Lake Drive. It was noted the Burque Addition No. 1 was platted in 1954, prior to the adoption of Ordinance 10 (adopted April 1961, repealed July 1982) and the adoption of the current Zoning Ordinance 4 (adopted July 1982). Chairperson Tourville expressed, in his opinion, lakeshore lots present a different set of problems than inland lots. Commission member Vermeulen expressed concern regarding setting a precedent by taking a conforming lot and splitting the lot into two non - conforming lots. Commission member LaMotte noted that if Sorel Street was vacated the variance request would be lessen. Commission member LaMotte questioned if the City Council would reconsider their decision P &Z MEETING MINUTES APRIL 5, 1994 PAGE THREE regarding the vacation of Sorel Street if the City would be able to obtain land on Centerville Lake from the St. Paul Water Department to use as park land. Commission member Welk suggested sending the request to the City Council without a recommendation and ask the City Council to reconsider the vacation of Sorel Street. Commission member Welk questioned what the appropriate use of the lot down the line is. Commission member Drilling suggested denying the variance and asking the Hansens to come back with another plan. Motion by Drilling, second by Vermeulen to pass the Lot Split /Variance Request of Lloyd and Diane Hansen to the City Council without a recommendation for denial or approval based upon the following reasoning: - to request the City Council to reconsider the possibility of vacating Sorel Street and to investigate the possibility of obtaining lakeshore property from the St. Paul Water Department to be utilized as park land versus Sorel Street; - the lot is has a two sanitary sewer stubs; - the irregular shape of the lot; - the lot has a total square footage of 33,000 square feet; - two single family homes would be more of an advantage to City versus twin homes; - the Circle Pines /Lexington Police Chief and the Centennial Fire District Chief do not have a problem except appropriate for signage; - there may be another creative way of re- aligning the lot lines and changing the lot frontage, motion carried unanimously. Star City Committee Representative. Motion by Drilling, second by Welk to table discussion of a Star City Committee Representative, motion carried unanimously. Ordinance #4, Article 7 - DEFINITIONS.
