PUBLIC HEARING - Vacating that part of Sorel Street that is unimproved and abuts the following: Lots 5, 6 Block 13- Centerville; Lot 7, Block 12 - Centerville; Lot 12, Block 11- Centerville and lying east of Centerville Lake. Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, December 7, 1993 at the City Hall. The purpose of the hearing was to hear all persons present regarding the possibility of vacating that part of Sorel Street that is unimproved and abuts the following: Lots 5, 6 Block 13 - Centerville Lot 7, Block 12 - Centerville Lot 12, Block 11 - Centerville and lying east of Centerville Lake. Chairperson Tourville called the public hearing to order at 7 :08 p.m. Present: Drilling, LaMotte. Absent: Welk, Vermeulen. It was noted that the property owners, Kevin Mullins and Father Richard Wolter, St. Genevieve's Church, have petitioned for vacation of the west end of Sorel Street. Mr. Lloyd Hansen, potential buyer of the Kevin Mullins property, was present. Mr. Hansen noted the Church of St. Genevieve and the Mullins property would split the 50 foot street right -of -way. Mr. Hansen noted Mr. Mullins petitioned for the vacation at his request. Mr. Hansen would like to split the lot after the purchase agreement is final. Mr. Hansen appeared before the Planning and Zoning Commission at their September 7, 1993 meeting regarding the proposed lot split. Mr. Hansen presented a sketch plan of the proposed split and it was noted that the front footage (lake side) does not meet the 100 foot minimum width requirements. Mr. Hansen noted that if the street is vacated he would still require a variance for the front footage, but no other variances would be necessary. A copy of Lloyd Hansen's sketch plan and proposed lot split is on file with the City. Chairperson Tourville questioned Mr. Hansen about the shared driveway. Mr. Hansen noted a permanent easement would be recorded with the property. The Planning and Zoning Commission asked Mr. Hansen if he is aware of the potential drainage problem that may exist with this property. Mr. Hansen noted he has spoken with the Minnesota Pollution Control Agency (M.P.C.A.) about the problem. Mr. Hansen noted is appeared the M.P.C.A. is not going to pursue the issue. Motion by Tourville, second by Drilling to adjourn the public hearing, motion carried unanimously. Public hearing adjourned 7 :20 p.m. PUBLIC HEARING - Possibility of amending Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS. Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, December 7, 1993 at the City Hall. The purpose of the hearing was to hear all persons present regarding the possibility of amending Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS as follows: NOW READS: 34.01 GENERAL REQUIREMENTS. The minimum depth of front yard, rear yard and side yard for each district shall be as defined in the Schedule of Regulations except where adiacent structures have front yard setbacks different from these requirements, the minimum front vard setback shall be the average front yard setback of such adjacent structures to minimum front yard setbacks of twenty five (25) feet. and conform to the following requirements: AMEND TO READ: 34.01 GENERAL REQUIREMENTS. Public hearing adjourned 7:25 p.m. REGULAR MEETING: Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, December 7, 1993 at the City Hall. Chairperson Tourville called the meeting to order at 7:26 p.m. Present: Drilling, LaMotte. Absent: Vermeulen, Welk. APPROVAL OF MINUTES: Tuesday. November 2. 1993 Meeting Minutes. Approval of the Tuesday, November 2, 1993 meeting minutes were tabled until a consensus of the Planning and Zoning members present at the meeting are in attendance. NEW BUSINESS: Possibility of vacating that part of Sorel Street that is unimproved and abuts Lots 5. 6 - Block 13. Lot 7 - Block 12. Lot 12 - Block 11 Centerville. Chairperson Tourville noted that if there is a problem with drainage in the future, the City of Centerville will have to deal with the problem then. Chairperson Tourville expressed he did not feel is should prohibit the development of the parcel. Motion by Drilling, second by LaMotte to recommend to the City Council the approval of the petition to vacate that portion of Sorel Street that is unimproved and abuts the following: Lots 5, 6 Block 13 Centerville Lot 7, Block 12 Centerville Lot 12, Block 11 Centerville and lying east of Centerville lake, motion carried unanimously. OLD BUSINESS: Possibility of Amending Ordinance #4. Article 3. Section 34.01 GENERAL REQUIREMENTS to exclude new development plats. Motion by LaMotte, second by Drilling to recommend to the City Council the approval of the amendment to Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS as follows: NOW READS: 34.01 GENERAL REQUIREMENTS. Ordinance #4. Article 7 - DEFINITIONS., Chairperson Tourville asked the Planning and Zoning Commission to make an extended effort to finish reviewing possible amendments to Ordinance #4. Motion by Tourville, second by Drilling to table discussion of Ordinance #4, Article 7 - DEFINITIONS, motion carried unanimously. City staff will include a new copy of Ordinance #4, Article 7- DEFINITIONS in the January packets. Fence Permits. Chairperson Tourville suggested that the City Council consider fence permits for residential districts only. One Year Time Limit on Building Permits. Motion by Drilling, second by Tourville to recommend to the City Council that in view of the fact that the City of Centerville has adopted the Uniform Building Code the City should not become more stringent than what the requirements of the Uniform Building Code, motion carried unanimously. NEW BUSINESS: Star City Committee Chairperson Tourville encouraged the members of the Planning and Zoning Commission attend the December 13, 1993 Star City meeting at the City Hall. Chairperson Tourville noted that a marque placed outside the City Hall would help with communication of meetings, etc. to residents of the City. Chairperson Tourville noted this would be worthy cause for a fund raiser. ADJOURN: Motion by Drilling, second by LaMotte to adjourn the meeting, motion carried unanimously.
