HomeMy WebLinkAbout1993-11-02 Minutes PLANNING AND ZONING COMMISSION MEETING MINUTES TUESDAY, NOVEMBER 2, 1993 - 7:00 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, November 2, 1993 at the City Hall. Acting Chairperson Welk called the meeting to order at 7:06 p.m. Present: Drilling, LaMotte, Vermeulen. Absent: Tourville. APPROVAL OF MINUTES: August 3, 1993 meeting minutes Motion by Vermeulen, second by Drilling to approve the August 3, 1993 meeting minutes: AYE - Vermeulen; AYE - Drilling; AYE - LaMotte; ABSTAIN - Welk, motion carried. October 5, 1993 meeting minutes Motion by Vermeulen, second by Welk to approve the October 5, 1993 regular meeting minutes with the following correction: Page Two, Paragraph Eight: Now Reads: "Motion by LaMotte, second by Vermeulen to recommend to the City Council approval the an amendment to Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS as follows: NOW READS: 34.01 GENERAL REQUIREMENTS. The minimum depth of front yard, rear yard and side yard for each district shall be as defined in the Schedule of Regulations and conform to the following regulations: AMEND TO READ: 34.01 GENERAL REQUIREMENTS. The minimum depth of front yard, rear yard and side yard for each district shall be as defined in the Schedule of Regulations except where adiacent structures have front yard setbacks different from these requirements, the minimum front yard setback shall be the average front yard setback of such adiacent structures to minimum front yard setbacks of twenty (25) feet, and conform to the following regulations: motion carried unanimously." OLD BUSINESS: Foundation Sizes versus Minimum Living Area and Minimum Lot Size Requirements in each of the Residential Zoning Districts. The Planning and Zoning Commission briefly discussed foundation sizes versus minimum living area. It was noted that Tim Rehbine, Chairperson of the Economic Development Committee, is to supply additional information for the Planning and Zoning Commission to • consider. Acting Chairperson Welk noted that she has heard many people comment that they wish they would have moved to Centerville because the lots are larger. It appeared to be the consensus of the Planning and Zoning Commission members that they would like to maintain larger lot size minimums in Centerville. The Planning and Zoning Commission tabled further discussion until additional information is received. • P &Z Meeting Minutes November 2, 1993 Page Three Ordinance #4, Article 7 - DEFINITIONS. The Planning and Zoning tabled discussion of Ordinance #4, Article 7 - DEFINITIONS. Possibility of Amending Ordinance #4, Article 3. Section 34.01 GENERAL REQUIREMENTS to exclude new development plats. It was noted that the City Council at their October 13, 1993 meeting requested the Planning and Zoning Commission to consider an amendment to the previous amendment to Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS. The previous amendment allows for averaging of the front yard setback if the adjacent structures have front yard setbacks different from the • requirements. The City Council expressed concern regarding the possibility of new construction being allowed to average of front yard setback by utilizing existing structures. It appeared to be the consensus of the Planning and Zoning Commission members present that the intent of the original amendment was to not include new development plats. Motion by Drilling, second by LaMotte to schedule a public hearing for the next Planning and Zoning Commission regarding the possibility of amending Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS to exclude new development plats, motion carried unanimously. NEW BUSINESS: One Year Time Limit on Building Permits - Taking into Consideration some Commercial Properties may take longer. The Planning and Zoning Commission discussed the possibility of placing a one year time limit on building permits. It appeared to be consensus of the Planning and Zoning Commission members present that remodeling of the Creamery Apartments is taking some time, however the property owner appears to be • conscientious and the work being done is a substantial improvement compared to the condition of the Creamery Apartment building before the current property owner purchased the property. The Planning and Zoning Commission expressed concern that if a time limit is placed on building permits the quality of work may deteriorate. Sanna Buckbee, Assistant City Clerk, noted the City Attorney has expressed concern that a city may not be allowed to place a time limit greater than that allowed in Uniform Building Code. The City Attorney is being asked for his opinion. It was also noted the permittee signs a statement agreeing to commence the work • P &Z Meeting Minutes November 2, 1993 Page Four covered by the permit within sixty (60) days of the date hereof and to complete all such work by six months. However, the City Attorney did not feel this agreement is binding. Motion by Vermeulen, second by Welk to table discussion of the possibility of a one year time limit on building permits, taking into consideration that some commercial properties may take longer until an opinion from the City Attorney is received, motion carried unanimously. ADJOURN: Motion by LaMotte, second by Drilling to adjourn the meeting, motion carried unanimously. Meeting adjourned 7:55 p.m. ANNEXATION HEARING UPDATE: Sanna Buckbee, Assistant City Clerk, noted that the preliminary decision of the Minnesota Municipal Board was to deny the annexation request. It appeared to be the consensus of the Planning and Zoning Commission that if the annexation request is denied, the decision should be appealed.
