HomeMy WebLinkAbout1993-09-07 Minutes PLANNING AND ZONING COMMISSION MEETING MINUTES TUESDAY, SEPTEMBER 7, 1993 - 7:00 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, September 7, 1993 at the City Hall. Chairperson Tourville called the meeting to order at 7:10 p.m. Present: LaMotte, Vermeulen, Welk, City Council Liaison Mayor Buckbee. Absent: Drilling_ MINUTES: April 13. 1993 Regular Meeting Minutes Motion by Tourville, second by Vermeulen to approve the April 13, 1993 regular meeting minutes, AYE - Tourville; AYE - Vermeulen, AYE - LaMotte; ABSTAIN - Welk, motion carried. June 1. 1993 Regular Meeting Minutes Motion by Tourville, second by Welk to approve the June 1, 1993 regular meeting minutes, AYE - Tourville; AYE - Welk, AYE - Vermeulen; ABSTAIN - LaMotte, motion carried_ July 6. 1993 Regular Meeting Minutes Motion by Welk, second by Tourville to approve the July 6, 1993 regular meeting minutes, AYE - Welk; AYE - Tourville, AYE - LaMotte; ABSTAIN - Vermeulen, motion carried. August 3. 1993 Regular Meeting Minutes Motion by Tourville, second by Vermeulen to table the approval of the August 3, 1993 regular meeting minutes until a majority of the Commission member in attendance at the meeting are present to approve, motion carried unanimously. NEW BUSINESS: Prnpnspd T,nt Split - T,1 nyd and Di Hansen - Sketch Plan Lloyd Hansen was present. Mr_ Hansen noted that the owner of the lot is presently Kevin Mullins_ The lot is located on Centerville Lake to south of the Sorel Street extension_ The Planning and Zoning Commission reviewed a written request from Lloyd and Diane Hansen summarizing their proposal. A copy of this proposal is attached to and made a part of these minutes. The Planning and Zoning Commission questioned if the current owner, Kevin Mullins, had been granted a previous variance from the side yard setback requirements_ Chairperson Tourville noted that if Sorel Street is vacated to Centerville Lake it would not necessarily be returned to one P &Z MEETING MINUTES SEPTEMBER 7, 1993 PAGE TWO property owner. The Church of St. Genevieve is also an abutting property owner. The Planning and Zoning Commission discussed the proposed sketch plan submitted by the Hansens_ Some of the items discussed were: - The width of the proposed split lots abutting Centerville Lake appear to be less 100" feet; - If the parcel was split, the square footage requirements for single family dwelling in the R2 Zoning District would be meet; The shared access; Setback requirements for the proposed homes; Creation of non - conforming lots which could lead to additional variances in the future_ Mayor Buckbee questioned if there were other areas in the City with shared driveways_ The Planning and Zoning Commission gave as examples: LaValle Drive and the Lundblad /Schoberlein properties_ Chairperson Tourville noted that the buildable terrain of the lot may be limited. Commission member LaMotte expressed concern with the width of the lots not meeting the minimum requirements, although the square footage requirement is met_ Chairperson Tourville noted that there are 75' lots within the R2 Zoning District and gave the properties at: 7082 Progress Road and 7086 Progress Road as examples. Commission Welk questioned how wide the street right -of -way is on the unimproved portion of Sorel Street. Commission member Welk noted that if Sorel Street was vacated it may lessen the need for variances. Chairperson Tourville noted that it could be an opportune time for the City to vacate that portion of Sorel Street. Commission Welk noted that if the City had a need for that portion of Sorel Street it would have been paved. Sanna Buckbee, Assistant City Clerk, noted that Gunnar Pettersen, Building Inspector, had expressed concerns regarding the Hansen's proposal_ Mr. Pettersen appeared to be concerned with what portion of the lot is to be considered the rear, front and side yards. Mr. Pettersen expressed that if the Planning and Zoning Commission appeared to be in favor of the lot split, that there should be specific direction given to the Building Inspector_ P &Z MEETING MINUTES SEPTEMBER 7, 1993 PAGE THREE Mayor Buckbee noted to Mr. Hansen that there are no guarantees that the lot split will be granted by the city Council. Sanna Buckbee, Assistant City Clerk, noted that City staff will research the street right -of -way for that portion of Sorel Street and whether a variance has been granted in the past to the property. Ms_ Buokbee also noted that if Mr_ Hansen would like to pursue the vacation of Sorel Street, that the City of Centerville will prepare the petition for him. Po sibili v of Amending_ Ordinance #4 Article 3 Section 34.01 GRNERAT, REQUIREMENTS. The Planning and Zoning Commission discussed at length the possibility of amending Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS_ Jeff Godwin, 1581 Peltier Lake Drive, was present_ Mr_ Godwin noted that he was present to support an amendment to Ordinance #4 to allow for some type of averaging of front yard setbacks_ Motion by LaMotte, second by Welk to schedule a public hearing for Tuesday, October 5, 1993 at the City Hall for the purpose of hearing all persons present regarding the possibility of amending Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS as follows: Now Reads: 34.01 GENERAL REQUIREMENTS. The minimum depth of front yard, rear yard and side yard for each district shall be as defined in the Schedule of Regulations and conform to the following regulations; Amend to Read: 34.01 GENERAL REQUIREMENTS. The minimum depth of front yard, rear yard and side yard for each district shall be as defined in the Schedule of Regulations except where adjacent structures have front yard setbacks different from these requirements, the minimum frnnt yard setback shall be the average front yard setback n such adjacent structures to minimum frnnt yard setbacks of twenty (25) feet, and conform to the following regulations, motion carried unanimously. OLD BUSINESS: Foundation Size versus Minimum Living Area and Minimum Trot Size Requirements in Ranh of the Residential Zoning Districts. Motion by Tourvillo, aeoond by LaMotte to table discussion on the P &Z MEETING MINUTES SEPTEMBER 7, 1993 PAGE FOUR foundation sizes versus minimum living area and minimum lot size requirement in each of the residential zoning districts until Chairperson Tourville contacts Tim Rehbine, Chairperson Centerville Economic Development Task Force, for additional input, motion carried unanimously. Ordinance 04, Article 7 - DRFTNTTIONS_ Motion by Tourville, second by Vermeulen to table discussion of Ordinance #4, Article 7 - DEFINITIONS until the next appropriate Planning and Zoning Commission meeting, motion carried unanimously. NEW BUSINESS: Possibility of Amending Ordinance #4, Article 3, Section 39 SPORTING, ATHT,RTIC AND MUSIC RVENTS, Subdivision 39.01 and 39.01- , zs Motion by Tourville, second by Vermeulen to schedule a public hearing for Tuesday, October 5, 1993 at the City Hall for the purpose of hearing all persons present regarding the possibility of amending Ordinance #4, Article 3, Section 39, Subdivision 39.01 and 39.01-2 as follows: NOW READS: 39.01 Sporting, athletic, and music concert events, as defined herein, shall be permitted by special use permit in the residence districts of the City of Centerville, subject to the following requirements: AMEND TO READ: 39.01 Sporting, athletic, and music concert events, as defined herein, shall be permitted by special use permit in the* City of Centerville, subject to the following requirements: NOW READS: 39.01 -2 Such activities shall be considered a special use within all residential districts of the City and shall require a permit therefore. The City shall have the right to make provisions in such permit for insuring public health and sanitation, traffic regulation, noise and litter control and regulation on the number of events that may be conducted on specific site. The City shall have the right to make provisions in such permit for insuring public health and sanitation, traffic regulation, noise and litter control and regulation on the number of events that may be conducted on specific site. * Indicates deletion, motion carried unanimously. 1994 Budget Motion by Welk, second by Vermeulen to recommend to the City Council the following budget for the Planning and Zoning Commission for 1994 as follows: Salaries $600.00 Seminars $400.00 Saving (for $500.00 Codification of Ordinance 04, and miscellaneous expenses) TOTAL $1,500.00, motion carried unanimously_ ADJOURN: Motion by Vermeulen, second by LaMotte to adjourn the meeting, motion carried unanimously.
