MEETING MINUTES
TUESDAY, AUGUST 3, 1993
Pursuant to due call and notice thereof, the Planning and Zoning
Commission of the City of Centerville held their regular meeting
on Tuesday, August 3, 1993 at the City Hall. Acting Chairperson
Vermeulen called the meeting to order at 7:10 p.m. Present:
Drilling, LaMotte, City Council Liaison Dario. Absent:
Tourville, Welk.
MINUTES:
The approval of the following meeting minutes were tabled:
- April 13, 1993;
- June 1,1993;
- July 6, 1993,
until a majority of the Commission members in attendance at the
meetings are present to approve.
OLD BUSINESS:
Request for Variance - 1581 Peltier Lake Drive
It was noted that Ordinance #4, Section 34.03 AVERAGE SETBACK
could not be applied to the proposed addition at 1581 Peltier
Lake Drive. Gunnar Pettersen, Building Inspector, noted that it
could not be applied due to the front yards on the lots varying
in depth to an extent greater than six (6) feet.
Jeff Godwin, 1581 Peltier Lake Drive, requested that if the
request for variance is denied, that he be given the perimeters
of buildable space, and he will change his plans accordingly.
Commission member Vermeulen noted that she was in the same
situation about six year ago. Commission member Vermeulen noted
she had applied for variance to do addition to her home.
rnmmigsion member Vermeulen noted that they had to change their
plans to build within the setbacks.
Commission member Drilling noted that Godwins may have to change
their plans to conform to the buildable area. Commission member
Drilling noted that the Planning and Zoning Commission is
responsible to see that the criteria of the ordinance is upheld.
Commission member Drilling also expressed that in order to grant
a variance there has to be exceptional reasons given. Commission
member Drilling stated that, in his opinion, the Godwin's request
for variance does not meet the standards for the granting of a
variance.
Jeff Godwin noted that he can expand in the rear to the existing
porch. Mr. Godwin also noted that Rice Creek Watershed District
has approved a variance to build his addition. Mr. Godwin
expressed that he can not come up with a reason why the variance

should be granted. Mr. Godwin noted that his plans could be
changed and the third stall of the proposed garage addition to
the would be removed. Mr. Godwin questioned if a six foot
variance from the front yard setback could be granted. Mr.
Godwin noted the only reason he could think of is that a variance
has been granted to others applying the concept of the average
setback.
City Council Liaison Dario asked if the Godwin's home being
located on the curve of Peltier Lake Drive would make a
difference.
The Planning and Zoning Commission discussed the request for
variance granted to the owners of 1567 Peltier Lake Drive to
extend the present structure six feet closer to the street.
Commission member LaMotte asked what the justification would be
for denying the Godwin's request for variance, if the owners of
1567 Peltier Lake Drive were granted a variance.
It was noted that the reason the Planning and Zoning Commission
recommended that the City Council grant the owners of 1567
Peltier Lake Drive a variance was because the lot already had
house on it and because of the square footage of the existing
structure did not conform to the minimum square footage
requirements, special conditions and circumstances exist which
are peculiar to this property and were not the result of the
actions of the petitioner.
Commission member Drilling stated that he has not heard anything
to convince him to vote in favor of granting the variance.
City Council Liaison Dario requested City Staff to research the
conditions regarding the request for variance for 1567 Peltier
Lake Drive.
Motion by Vermeulen, second by Drilling that the City Council
consider the request for variance at 1581 Peltier Lake Drive
without a recommendation from the Planning and Zoning Commission;
- that a Planning and Zoning Commission member attend the
August 11, 1993 City Council meeting;
- that the City Staff research the conditions regarding
the request for variance for 1567 Peltier Lake Drive;
- that Building Inspector re- measure the distance from
the setback for 1567 Peltier Lake Drive;
- that Gunnar Pettersen, Building Inspector, be asked to
attend the August 11, 1993 City Council meeting,
motion carried unanimously.

Commission member Vermeulen asked that City Staff research
examples from other cities regarding average setback.
Motion by Vermeulen, second by Drilling to table discussion of
the following Agenda items:
- Foundation Sizes versus Minimum Living Area and Minimum
Lot Size Requirements in each of the Residential Zoning
Districts;
- Ordinance #4, Article 7 - DEFINITIONS,
motion carried unanimously.
ADJOURN
Motion by Vermeulen, second by Drilling to adjourn the meeting,
motion carried unanimously. Meeting adjourned 8:20 p.m.
