HomeMy WebLinkAbout1993-06-01 Minutes PLANNING AND ZONING COMMISSION MEETING MINUTES TUESDAY, JUNE 1. 1993 PUBLIC HEARING - REQUEST FOR VARIANCE - LOTS 7, E AND 9 BLOCK 2, CENTERVILLE. • Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, June 1, 1993 at the City Hall. The purpose of the hearing was to hear all persons present regarding a request for variance from Ordinance #4, SCHEDULE OF DISTRICT REGULATIONS MINIMUM AREA OF STRUCTURES to allow a single family home to be relocated into the R2 Single Family Residential Zoning District that is less than 1,050 square foot minimum ground floor area requirement_ The proposed structure to be relocated is 768 square feet of minimum ground floor area. The property -is legally described as follows: The West third of Lots 7, 8 and 9 Block 2 Centerville, subject to easement of record_ Chairperson Tourville called the public hearing to order at 7:13 • p.m. Present: Vermeulen, Welk. Absent: Drilling, LaMotte. Chairperson Tourville summarized the request for variance to members of the P.Lannir.g and Zoning Commission and persons present in the audience. Building inspector • ske bh t buildable area i illustrating b'�il. it r� attached to and made a part o1 this minutes_ • Ralph Wanless:, 1073 Humboldt Avenue, West St_ Paul, was present_ Mr_ Wanless noted that he proposes to relocate a 23 x 32 home onto the lot_ Mr_ Wanless will also be constructing a garage_ Mr. Wanless has not yet decided if the garage will be attached or • detached. Mr. Wanless noted that to meet the square footage requirement, the house would be long and skinny_ Mr_ Wanless noted that the home would - gutted". Mr_ Waniess will bring the house up to code, new wiring and plumbing will be installed_ The proposed house to be relocated is one story_ Mr_ Wanless noted that the basement will depend on the water table. Mr. Wanless would like to move the home on to the lot as soon as possible_ Mr. Wanless has purchased the lot and the home with the contingency that a variance is granted_ • • P &Z MEETING MINUTES JUNE 1, 1993 PAGE TWO Chairperson Tourville noted that there are several old fifty (50) foot wide lots in the City_ The current ordinance requires that if two or more lots are under the same ownership, they must be • combined_ Chairperson Tourville noted that Table B -- SCHEDULE OF DISTRICT REGULATIONS -- MINIMUM GROUND FLOOR AREA OF STRUCTURES was amended in 1990 increasing the minimum ground floor area requirement to 1050 square feet_ Chairperson Tourville noted that sooner or later the City may need to address the older fifty (50) foot lots within the City. Chairperson Tourville noted that some variances will need to be granted_ Chairperson Tourville noted that a variance was granted on June 11, 1986 regarding the setback of the west property line (off Progress Road; of the west one third of lots 7, 8 and 9, Block 2 in Centerville be no closer • than. sixteen (16) feet to that property line_ Commission member Vermeulen noted that she did not have a big • problem with granting the variance. Ms. Vermeulen expressed that • it was her opinion that the intent of the amendment to the ordinance was to be more directed towards new developments. Ms_ Vermeulen noted that the older existing lots should be handled on a case by case basis. Commission member Welk noted that in her opinion that it may be more appropriate for a small lot to have a smaller house versus a larger house. Ms. Welk noted that all of the older lots are not necessarily the same, and should be handled on a case by case basis. Chairperson Tourville noted that some exceptions need to be applied to the lots platted fifty or so years ago_ Chairperson Tourville noted that Mr_ Wanless is meeting the setback requirements, the twenty four (24) foot width minimum and appears to have plenty of room off of the County Road. Chairperson Tourville noted that a letter from Mary Jo Helmbrecht, 1745 Main Street, opposing the variance was received. A copy of the letter from Mary Jo Helmbrecht is attached to and made a part of these minutes. Motion by Tourville, second by Welk to adjourn the public hearing, motion carried unanimously_ Public hearing adjourned 7 :40 p.m. CALL TO ORDER REGULAR MEETING: Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, June 1, 1993 at the City Hall. Absent: Drilling, LaMotte_ APPROVAL OF MINUTES: Motion by Vermeulen, second by Welk to approve the May 4, 1993 meeting minutes, motion carried unanimously. Motion by Welk, second by Vermeulen to table the April 13, 1993 meeting minutes, motion carried unanimously. NEW BUSINESS: Request for Variance - Went, third of Dots 7. St and aRlQck2 Centerville, subject.._tn easement of record. Motion by Vermeulen, second by Welk to recommend to the City Council approval of the request for variance from Ordinance #4, SCHEDULE OF DISTRICT REGULATIONS MINIMUM AREA OF STRUCTURES to allow a single family home to be relocated into the R2 Single Family Residential Zoning District that is less than 1,050 square foot minimum ground floor area requirement. The proposed structure to be relocated is 768 square feet of minimum ground floor area. The property is legally described as follows: the West third of Lots 7, 8 and 9 Block 2 Centerville, subject to easement of record, based on the following standards: - special conditions and circumstances exist which are peculiar to the land, the lot size is 50 x 150 feet, the lot is small, long and narrow and does not result from the actions of the petitioner; - literal interpretation of the provisions of this ordinance would deprive the petitioner of rights commonly enjoyed by other properties in the same district under the terms of this ordinance since there are other fifty foot lots located within the R2 Zoning District that have structures that are less than the 1050 square foot of living space requirement; that by granting this variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district; - the proposed variance will not impair an adequate supply of light and air to adjacent property or unreasonably diminish or impair established property values within the surround area, or in any other respect impair the public health, safety or welfare of the residents of the city; - sanitary sewer is installed and available to service this lot; • • • P &Z MEETING MINUTES • JUNE 1, 1993 PAGE FOUR • the proposed home to be relocated meets all the setback requirement with the previous variance grant on June 11, 1986, motion carried unanimously. Motion by Tourville, second by Vermeulen to schedule a public • hearing date of July 6, 1993 to consider the possibility of amending Ordinance #4, Section 34.05 ATTACHED ACCESSORY BUILDINGS, motion carried unanimously. • OLD BUSINESS: • Foundation Sizes_.Yergus Minimum Living Area and Minimu _Qt_Size Reguirements__in each of the Residential.Zoning_L xi ts_ Chairperson Tourville summarized the Centerville Economic Development Task Force request that the Planning and Zoning Commission consider researching the foundation sizes versus minimum living area and the minimum lot size requirements in the • residential zoning districts_ • Tim Rehbine, Chairperson of the Centerville Economic Development Tail. Force, was present. Mr. Rehbine presented an overview of data regarding lot size in relation to the value of homes in • surrounding communities_ Commission member Welk noted that many people have expressed that • their reason for moving to Centerville was the larger lots_ Mr. Rehbine noted that Centerville has its share of entry level housing. • • Chairperson. I have a concern regarding the variance from Ordinance #4. I would not be in favor of a variance allowing a structure of 768 square feet of living space to be relocated to this lot. Without knowing the size of this lot I do not know what other options this person has but I do feel this structure is too small. Thank You.
