PLANNING AND ZONING COMMISSION OF THE CITY
CENTERVILLE, MINNESOTA HELD ON TUESDAY,
APRIL 13, 1993 AT 7:00 P.M.
IN THE COUNCIL CHAMBERS
Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held their regular meeting
on Tuesday, April 13, 1993 at the City Hall. Chairperson
Tourville called the meeting to order at 7:07 p.m. Present:
LaMotte, Vermeulen, City Council Liaison Mayor Buckbee,
Clerk /Administrator Siebenaler. Absent: Drilling, Welk.
APPROVAL OF MINUTES
Motion by Tourville, second by LaMotte to table approval of the
March 2, 1993 meeting minutes, motion carried unanimously.
OLD BUSINESS:
Possibility of Amending Ordinance #4. Section 34.06 AMOUNT OF
YARD OCCUPTRD.
Chairperson Tourville summarized the history of the proposed
amendment to Ordinance #4, Section 34.06 AMOUNT OF YARD OCCUPIED.
The Planning and Zoning Commission reviewed the definition of
height of building from the Uniform Building Code.
Chairperson Tourville suggested adding an addendum that states
the accessory building should not exceed the height of the
primary building to the proposed amendment.
It appeared to be the consensus of the Planning and Zoning
Committee members present that per the recommendation of Gunnar
Pettersen, Building Inspector, that the proposed amendment of
sixteen feet in height may be on the high side.
Pam Harare, 7181 West Robin Lane, was present and made comment
regarding the proposed amendment.
Chairperson Tourville questioned if the height of the building is
not to exceed fourteen feet would cause any hardship.
The percentage of rear yard not to exceed was discussed.
Pam Harare, 7181 West Robin Lane, noted that rear lots in the R -4
zoning district are larger because the front yard setbacks
requirement is less than the other residential zoning districts.
Chairperson Tourville suggested having the percent of rear yard
not to exceed be the same in all sewered residential zoning

districts. Chairperson Tourville expressed concern regarding the
R -5 zoning district. Chairperson Tourville suggested a maximum
square footage not to exceed.
Mayor Buckbee made comment regarding limiting the size of a
building.
Motion by LaMotte, second by Vermeulen to recommend to the City
Council the approval of the amendment to Ordinance 44, Article 3
as follows:
Now Reads: 34.06. AMOUNT OF YARD OCCUPIED. A detached
accessory building not over one story and not
exceeding twelve (12) feet in height may
occupy not to exceed ten (10) percent square
footage of the area of any rear yard.
Amend to Read: 34.06. -QI AMOUNT OF YARD OCCUPIED. Tn the
R2A. R -2 and R -5 zoning districts a detached
accessory building not over one story and not
exceeding fourteen (14) feet in height may
occupy not to exceed ten (10) percent square
footage of the area of any rear yard.
34.06. -07, AMOUNT OF YARD OCCUPIED. In t,h

building not over one story and not exceeding
fourteen (14) feet in height may occupy not
to exceed fifteen (15) percent square footage
of the area of any rear yard.
motion carried unanimously.
Possibility of Amending Ordinan T A IE
ACCESSORY BUIT.DTNrng - to allow for only one Acceasnry Building
(storggp shed) per Lot.
Chairperson Tourville suggested dividing the allowed number of
accessory buildings into zoning districts. Chairperson Tourville
expressed concern about limiting the number of accessory building
in the R -1 and R -3 zoning districts.
Commission member LaMotte questioned the storage of ice houses.
Chairperson Tourville noted that there could be a problem with
enforcement regarding ice houses. Chairperson Tourville noted
that it could be incorporated that if the ice house is not used
for its intended purpose, the ice house must be removed or
dismantled.

Motion by Vermeulen, second by LaMotte to recommend to the City
Council the following addition to the proposed amendment to
Ordinance #4, Article 3:
Amend to Read: 34.06. -Q1 AMOUNT OF YARD OCCUPIED. In the
R2A. R -2 and R -5 zoning districts a detached
accessory building not over one story and not
exceeding fourteen (14) feet in height may
occupy not to exceed ten (10) percent square
footage of the area of any rear yard. The
height of the accessory building shall not
exceed the height of the primary building.
34.06.2 AMOUNT OF YARD OCCUPIED. In the
R -4 zoning district, a detached accessory
building not over one story and not exceeding
fourteen (14) feet in height may occupy not
to exceed fifteen (15) percent square footage
of the area of any rear yard. The height of
the accessory building shall not exceed the
height of the primer _building.
motion carried unanimously.
Chairperson Tourville requested that City Staff contact the City
Attorney for a legal opinion regarding the latitude regarding the
above addition which was not included in the public hearing
notice.
Motion by Vermeulen, second by Tourville to table the possibility
of amending Ordinance #4, Section 34.05 ATTACHED ACCESSORY
BUILDINGS and review of Ordinance #4, Article 7 for further
review at a future meeting, motion carried unanimously.
Possibility of Rezoning - Peltier Take Hills. Second Addition.
The Planning and Zoning Commission reviewed a letter dated April
5, 1993 from Greg Hellings, City Attorney, regarding Peltier Lake
Hills Second Addition.
A copy of this letter is on file with the City of Centerville_
Chairperson Tourville questioned if the normal procedures for
rezoning would need to be followed, since the City appears to
have made the error. Chairperson Tourville suggested the
proposed rezoning public hearing be held in conjunction with
another public hearing.
Chairperson Tourville requested City Staff to ask Greg Hellings,
City Attorney, for his opinion regarding the steps necessary to
rezone Peltier Lake Hills, Second Addition, in view of the fact
that the property is already sewered residential.

Motion by Vermeulen, second by Tourville to adjourn the meeting,
motion carried unanimously. Meeting adjourned 8.56 p.m.
