PLANNING AND ZONING COMMISSION OF THE CITY
CENTERVILLE, MINNESOTA HELD ON TUESDAY,
MARCH 2, 1993 AT 7:00 P.M.
IN THE COUNCIL CHAMBERS
PUBLIC HEARING
Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held a public hearing on
Tuesday, March 2, 1993 at the City Hall. The purpose of the
public hearing was to hear all persons present regarding the
possibility of amending Ordinance 04, Article as follows:
Now Reads: 34.06. AMOUNT OF YARD OCCUPIED. A detached
accessory building not over one story and not
exceeding twelve (12) feet in height may
occupy not to exceed ten (10) percent square
footage of the area of any rear yard.
Amend to Read: 34.06. -Q1 AMOUNT OF YARD OCCUPIED_ In the
R2A. R -2 and R -5 zoning districts a detached
accessory building not over one story and not
exceeding sixteen (1n) feet in height may
occupy not to exceed ten (10) percent square
footage of the area of any rear yard.
34.06. -02 AMOUNT OF YARD OCCUPIED_ Tn the
R - zoning district a detached accessory
building not over one story and not exceeding
sixteen (16) feet in height may occupy not to
exceed fifteen (15) percent square footage of
the area of any rear yard.
Chairperson Tourville called the public hearing to order at 7:30
p.m. Present: Drilling, LaMotte, Welk. Absent: Vermeulen_
Chairperson Tourville summarized the proposed amendment to the
members of the Planning and Zoning Commission. It was noted that
this proposed amendment is the result of a request for variance
to build a garage in the R -4 Zoning District which would exceed
the ten (10) percent square footage of the area of their rear
yard. Upon further investigation, it was discovered that
accessory buildings have been allowed to be built which exceed
the ten (10) percent square footage of the area of any rear yard
in the R -4 Zoning District.
Chairperson Tourville noted that there no persons present in the
audience_

Motion by Drilling, second by LaMotte to adjourn the public
hearing, motion carried unanimously. Hearing adjourned 7:40 p.m.
REGULAR MEETING
Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held their regular meeting
on Tuesday, March 2, 1993 at the City Hall. Chairperson Tourville
called the regular meeting to order at 7:41 p.m. Present:
Drilling, LaMotte, Welk. Absent: Vermeulen.
MINUTES
Motion by Drilling, second by Welk to approve the February 2,
1993 meeting minutes, AYE - Drilling; AYE - Welk; AYE -
LaMotte; ABSTAIN - Tourville, motion carried.
OLD BUSINESS:
Possibility of Amending Ordinance 44. Section 34.06 AMOUNT OF
YARD OCCUPIED,
The Planning and Zoning Commission discussed the possibility of
amending Ordinance #4, Section 34.06 AMOUNT OF YARD OCCUPIED.
Chairperson Tourville noted that Gunnar Pettersen, Building
Inspector, has expressed concern regarding the proposed amendment
to increase from twelve (12) feet in height requirement to
sixteen (16) feet in height. Mr. Pettersen expressed that this
may allow some larger buildings on larger lots. Mr. Pettersen
noted that the height is the average of the sidewall plus one
half of the sidewall to the peak of the roof. Mr_ Pettersen
noted that this is based on the Uniform Building Code.
Chairperson Tourville expressed that is seemed to contradictory
to allow the R -4 zoning district to occupy fifteen percent of the
rear yard and to allow the larger lot districts to occupy only
ten percent of their rear yards. Chairperson Tourville suggested
making it fifteen percent across the board.
Commission member Welk expressed agreement with Chairperson
Tourville.
Commission member Drilling expressed that the reason for
separating the R -4 district was to make the present non-
conforming buildings conforming. Commission member Drilling
expressed that he preferred to leave the proposed amendment as
is.

Chairperson Tourville expressed concern about including the R -1
and R -3 zoning districts. Chairperson Tourville noted that the
R -1 and R -3 zoning districts have a ten (10) acre minimum lot
size. Chairperson Tourville also noted that many of the forms of
buildings allowed in the R -1 and R -3 zoning districts do not fall
under the Uniform Building Code.
Commission member Drilling asked if the Planning and Zoning
Commission would be creating a problem. Commission member
Drilling asked if there were residents lining up from the R -1 and
R -3 zoning districts for variances from the current ordinance.
Commission member Drilling noted that all the Planning and Zoning
Commission is doing is separating the R -4 zoning district from
the present ordinance.
Chairperson Tourville was adamant about separating the R -1 and R-
3 zoning districts.
Commission member Welk noted that as long as the Planning and
Zoning Commission is considering amending the current ordinance
now we could prevent problems in the future.
Chairperson Tourville noted that in the past a variance has been
granted to the R -1 zoning district regarding this section of the
ordinance.
The Planning and Zoning Commission discussed at length the
proposed amendment.
It appeared to be the consensus of the Planning and Zoning
Commission to table further discussion of the proposed amendment
to Ordinance #4, Section 34.06 AMOUNT OF YARD OCCUPIED to allow
staff to ask Gunnar Petterssn, Building Inspector, for a
definition of height and how it is determined according to the
Uniform Building Code.
The Planning and Zoning Commission also requested City staff to
investigate the public hearing requirements.

The Planning and Zoning Commission discussed at the length the
proposed amendment to allow for only one accessory building per
lot.
Chairperson Tourville requested to meet with City staff and
interested Planning and Zoning Commission members to re -draft the
proposed amendment and to investigate the examples from other
cities.

Motion by Tourville, second by Drilling to table discussion of
the possibility of amending Ordinance #4 to allow for only one
accessory building (storage shed) per lot until the next meeting,
motion carried unanimously.
Nnmtnatinn of Chairperson and Actin, Chairperson
Chairperson Tourville noted that Ordinance #37 setting forth the
Planning and Zoning Commission was adopted in May of 1983. There
have been two amendments to the ordinance. Chairperson Tourville
noted that there is no mention of an Acting Chairperson in the
ordinance or its amendments. Chairperson Tourville asked the
Commission members if there was any amendments or other changes
they would like to see to Ordinance #37.
It appeared to be the consensus of the Planning and Zoning
Commission members present that they did not have a problem with
how the current Ordinance #37 reads.
Motion by Drilling, second by Welk to appoint Dan Tourville as
Chairperson of the Planning and Zoning Commission, AYE -
Drilling; AYE - Welk; AYE - LaMotte; ABSTAIN - Tourville,
motion carried.
Motion by LaMotte, second by Drilling to appoint Kathy Welk as
Acting Chairperson of the Planning and Zoning Commission, AYE-
Drilling; AYE - LaMotte; AYE - Tourville; ABSTAIN - Welk,
motion carried.
Review of Ordinance #4, Article 7.
Motion by Tourville, second by Welk to table discussion of the
review of Ordinance #4, Article 7, motion carried unanimously.
Goals And Priorities.
Chairperson Tourville noted that the City Council held a meeting
to establish Goals and Priorities for the City of Centerville.
Chairperson Tourville noted that the Planning and Zoning
Commission should set its own goals and priorities. Chairperson
Tourville noted the Planning and Zoning Commission is progressing
on the review of Ordinance #4. Chairperson Tourville also noted
that the Planning and Zoning Commission has been setting aside
money for codification of Ordinance #4.
NEW BUSINESS:

Chairperson Tourville noted that this a area is serviced by
sewer. It may be appropriate to rezone the eight residential

properties from R -1 Rural Residential to R -2 Single Family
Residential.
Motion by Tourville, second by Welk to consult the City Attorney
• as to the deposition of the Peltier Lake Hills, Second Addition
•
rezoning, AYE - Tourville; AYE - Welk; ABSTAIN - Drilling;
ABSTAIN - LaMotte, motion failed.
DISCUSSION:
Bnnrn Creek Suh- Cnmmittee
The Planning and Zoning Commission discussed the Acorn Creek Sub-
Committee set -up by the City Council. The Planning and Zoning
Commission questioned why the City Council set up the Acorn Creek
Sub- Committee. The Planning and Zoning Commission questioned if
the City Council has lost confidence in the Planning and Zoning
Commission. In past it has been the procedure to send back
proposed developments to the Planning and Zoning Commission for
further review. The Planning and Zoning Commission questioned if
the City Council thought the Planning and Zoning Commission
neglected to research or if there was a lack of argument
presented for approval of the proposed Acorn Creek development.
The Planning and Zoning Commission expressed concern that this
may happen again.
The Planning and Zoning Commission suggested that in the future
joint meetings of the Park and Recreation Committee, Planning and
Zoning Commission and City Council could be held to eliminate the
need for extra meetings.
It was noted that Developers have expressed concern in the past
about the City of Centerville being difficult to work with.

Motion by Welk, second by Tourville to adjourn the meeting,
motion carried unanimously. Meeting adjourned 10:05 p.m.
