I wish to express my continuing concern over the development Mr. Rehbein has purposed. I did not favor any developement in this area of Centerville. I moved to the country to be in the country. The fact that houses are appearing everywhere disturbs me. It slowly alters our previous way of life and community, not for the better. Mr. Rehbein has purposed small lots, rezoning, increased traffic and now moving Mill Road for no other reason but his commercial success. The city over years has given in little by little. Has the city gained any benefit? I think not. Instead the city open space disappears, never to be reclaimed in the event of error. A road was planned to border Mr. Fruth's property on his south lot line. This would allow for the future expansion of the area next to and in the rear of his and my homes. Mr. Rehbein has disregarded this and placed homes along this lot line. This will in effect block our lots from any future use. He takes opportunity now, but denies Mr. Fruth and myself the same opportunity in the future. Lot size is of great importance. In a rural area, density is to be avoided. More is not better, except to Mr. Rehbein. I have invested my life into my house and property. If homes are coming, and they are, I wish them to be upper bracket homes like mine. If I can not prevent this expansion blitz I look to my elected officials to temper it with everyones best interest in mind. The idea of vacating Mill Road to allow Mr. Rehbein to sell 4 creek lots is absurd. It denies the creek to every Centerville resident that walks, jogs, bikes or drives by this section. This is probably the most scenic portion of Mill Road in the city. If Mr. Rehbein has his way, it will be a backyard. He further wishes drivers to make four corners and drive thru a dense residential area, when we now have a direct route. Traffic on Mill Road, particularly foot traffic, near County 14 is very dangerous. Nov Mr. Rehbein would send us again thru a neighborhood, just as Mill Road begins to enter an area of fewer homes. The fisherman, snowmobilers, and sportsmen with their equipment are to be routed into this intended mess. I have heard some say this is a dangerous portion of Mill Road. More dangerous than adding corners and traffic to a dense residential neighborhood? January 28, 1993 Page 2. Please consider these arguments and the overall impact ve bring to our community. Mr. Rehbein must justify his demands in terms of benefit to our city, lack of impact on present residents, and environmental and aestetic values. We do not have to yield any item or condition that is not to our collective benefits. Please show the courage and spirit that grows from a proper decision. M. eye February 2, 1993 To: The City of Centerville, Planning & Zoning Commission, The purpose of this letter is to tell you what we think about the proposed vacating and rerouting the northerly 660 feet of Mill Road by the owner and developer, Gerald Rehbein. Most of the residents who live in and around this particular area of Mill Road know that this section of Mill Road is used numerous times every day, (even in bad weather) by people who like to walk and bike up to Lake Peltier and beyond. For this main reason we would not be in favor of this proposal unless there was a wide asphalt, (or other smooth hard surface) path- way behind the proposed lots that would take the place of this section of Mill Road; built and paid for by the developer, NOT the taxpayer. We realize this may be difficult in some parts of this stretch because the creek winds very close to Mill Road, and the path would need to be elevated in some spots due to the high water level at certain times of the year. None the less, this is what we would want provided for us and the many others in our wonderful city. Thank you for considering our input on this issue. Mill Road presently functions as a collector street to service the present residents of Centerville and Lino Lakes. As the area develops in the future this street will be expected to carry a much greater traffic load. The proposed vacation of existing Mill Road and the rerouting will severely damage the functionality of Mill Road as a collector street and cause safety problems as this traffic is awkwardly forced to travel through the residential neighborhood. The rerouting resembles a detour in that there are several 90 degree or near 90 degree turns required to carry through traffic. Stop signs will most likely be necessary to control traffic movements on the intersections. Acceleration and deceleration of automobiles and truck traffic will generate noise in the residential neighborhood. The seemingly unexpected 90 degree turns at the entrances to the rerouting of Mill Road traffic from the north and the south would be a serious safety concern. If there are maintenance problems with the existing Mill Road, it would seem to be most effective to reconstruct the street than to build a longer street as a substitute to the more direct alignment of present Mill Road. The vacation of Mill Road would also seem to cause internal circulation problems for streets such as Peltier Lake Drive which depends upon Mill Road for continuity. Vre L• a ell hneider, P. . Mr. Schneider makes the following points, our comments follow. Final The proposed 60 foot right -of -way of Ojibway Road °would be a restriction on the future establishment of this street as part of the state aid system ". MSA COMMENTS A. The Municipal State Aid system rules state that a 60' right-of-way is acceptable in a municipality (see section 8820.2500). We represent several communities which have urban roadways that are on their State Aid system with right -of -ways of 60'. B. If Mr. Rehbien's proposal to vacate Mill Road is approved, we envision that Ojibway Road will be considered to be a local collector. As such a 36' wide roadway will be required (complys with section 8820.9935 of MSAS) and a 66' wide right -of -way will be required by city code. The State Aid system is quite definite as to what criteria is to be applied in designating an MSAS route as follows. Subp. 3. Municipal state -aid street. A municipal state -aid - street may be selected if it: A. is projected to carry a relatively heavier traffic volume or is functionally classified as collector or arterial as identified on the urban municipality's functional classification plan as approved by the urban municipality's governing body; B. connects the points of major traffic interest within an urban municipality; and C. provides an integrated street system affording, within practical limits, a state - aid street network consistent with projected traffic demands. These criteria do not apply to Mill Road North of Peltier Lake Drive because, it does not originate or terminate on a County State Aid Highway (CSAH) within the corporate limits of the City of Centerville. MSAS designation is possible for communities over 5000 population. The most recent met council projections for full development within Centerville is 4200 people. Therefore, Mr. Schneider's point is valid only if the two cities were to consolidate. Further MSAS designation is possible for communities over 5000 population. The most recent met council projections for full development within Centerville is 4200 people. RECOMMENDATION The Lino Lakes letter provides comments and opinion to Centerville in the planning process. We do not perceive any facts or issues that should be given much weight during the City of Centerville's deliberation process. Please advise if you require any further information on this subject. Centerville, MN 55038 � RE: Vacation and Routing of Mill Road Center of the S 1/2 Section 14 Proposed by Owner and Developer Gerald Rehbein Dear Mr. Siebenaler: We discussed the future MNDot Municipal State Aid street aspects of this proposed vacation and realignment last week. Mr. Schumacher has shown me the revised drawing of this proposal that you FAX'd to him this morning. Mill Road right of way is 66 feet wide in Centerville, and to the North into Lino Lakes. 73rd Street also has a 66 ft. right of way. The section proposed to be realigned as "Ojibway Road" is shown to be only 60 feet wide. This narrowing would be a restriction on the future establishment of this street as part of the State Aid System. This proposal is certainly an improvement over the previous proposal upon which I commented to you on 29 January 1993 as the two 90 degree turns on the north end of the original proposal have been eliminated. The problems yet remain with the south end. Future Municipal State Aid Street considerations are complex, and at this time speculative, but basically the MSA system is intended to provide a continuous network of collector street that provide for safe, efficient traffic flows. An MSA street can not be an isolated segment. I am not familiar with any details of the Centerville Transportation System priorities, or when Centerville would anticipate developing an MSA System. As a general consideration however, it would seem that the 73rd Street - Mill Road South loop would have to be established on the future Centerville MSA system before Centerville and Lino Lakes could jointly consider designating Mill Road to the north of 73rd Street as part of our MSA Street Systems. 1189 MAIN STREET. IN THE COUNCIL CHAMBERS Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, February 2, 1993 at the City Hall. The purpose of the public hearing was to hear all persons present regarding the possibility of vacating and rerouting the northerly 660.00 feet (approximately) of Mill Road. The approximate 660.00 feet of Mill Road is located north of the intersection of Peltier Lake Drive and Mill Road. Acting Chairperson Welk called the public hearing to order at 7:04 p.m. Present: Vermeulen, LaMotte, Drilling, City Council Liaison Brenner. Absent: Tourville. Acting Chairperson Welk summarized the purpose of public hearing and asked for comments from members of the audience. The Planning and Zoning Commission noted receipt of the following written comments: - Darrell F. Schnieder, P.E., City of Lino Lakes, - Michael and Tina Scheller, 7267 Mill Road, - Lyn Gulsvig, 7246 Mill Road, - Fred Fischer, 7396 Mill Road. A copy of the above written comments is attached to and made a part of these minutes. Bob Surgstahler, 7381 Mill Road, was present_ Mr. Burgstahler noted that he liked the basic concept of having one road fronting the proposed lots, versus having a road abutting the front and rear of the proposed Iota. Mr. Burgstahler expressed that there appears to be a oa;ety problem with the current Mill Road. Mr. Burgstahler expressed that someday there may be an accident. Mr. Burgstahler noted that the northerly section of Mill Road will need to be reconstructed. Mr. Burgstahler communicated that he aces not like the right angle corners and suggested that an curve be incorporated. Mr_ Burgstahler, in his opinion, feels that the vacating and rerouting of Mil_ Road makes good sense in the long term. Larry Aubin, 7261 Mill Road, was present_ Mr. Aubin expressed concern: that car lights will shine directly into his living room from the proposed 73rd Street and Mill Road intersection. Mr. Aubin also exressed concern that if the intersection is slippery, he could end up with cars in hie front yard. Seth Zeug, 7294 Mill Read, was present. Ms. Zeug noted that she likes the concept of having the read dead end north of her ::roperty_ Ms_ Zeug explained that area residents have expressed eencern to her about the preserving of the trees. The residents have expressed that they are happy the trees are being preserved. • P&Z MEETING MINUTES FEBRUARY 2, 1993 PAGE TWO Ms. Zeug further explained that many area residents have expressed a desire for a walkway along the creek. Ms_ Zeug noted she would like to have a drainage easement east of her home included in the plan_ Ted Erkenbrack, 7377 Peltier Circle, was present. Mr. Erkenbrack explained that they have spent a lot of time and money on the placement of their home along Clearwater Creek. Mr. Erkenbrack has windows that face Clearwater Creek Mr. Erkenbrack expressed that by vacating and rerouting Mill Road, the City will be putting people "down their back door ". Mr. Erkenbrack expressed that he likes the tree line. Mr_ Erkenbrack noted that the issue of safety has been expressed at the meeting. Mr. Erkenbrack questioned the safety of rerouting Mill Road through a more densely populated residential development_ Mr. Erkenbrack noted that he is opposed to the vacating and rerouting of Mill Road. Pat Fruth, 7384 Mill Road, was present. Mr. Fruth expressed concern regarding the accessibility for the Centerville and Lino Lakes residents located to the north of the proposed Mill Road vacation_ Mr. Fruth expressed concern about emergency vehicles l access. Mr. Fruth stated that because the northerly portion of Mill Road only services a few homes, does not make the vacating and rerouting right. Jim Carlson, 7389 Mill Road. was present_ Mr. Carlson, asked that the reason for vacating and rerouting of Mill Road be explained. Mr. Carlson also asked what the projected costs for reconstructing Mill Road may be. John Stewart, City Engineer, was present_ Mr. Stewart noted that it was his recollection that the reason for the City considering the vacating and rerouting of Mill Road was based upon the road being a poor use of land. Mr_ Stewart noted that in 1987 the estimated cost for reconstruction was approximately $40.00 per square foot. yr. Stewart also noted that another barrier is required at an approximate cost of $5.000.00. Mr_ Stewart further noted that this section of Mill Road is net the most stable piece of ground. There is concern with the drop off. Mr. Stewart noted there also appears tc be a sight problem with the incline on Mill Road. Mr_ Stewart explained that Mill Road would require a flatter grade_ Mr. Stewart also noted that Mill Road is a collector street, but i3 not built to City collector street standards of 36 feet wide_ Mr. Stewart noted that Mill Read is only 22 feet in wide in that area Mr. Stewart noted that there are significant engineering issues with Mill Road. 1 Bob Burgstahler noted that an alternative could be to approve the _, C Mr-7ETING C C 2S FEBRUARY 2, 1993 ?AGE THREE development as originally proposed_ Mr. Eurgstahler noted the originally proposed development had lots with streets abutting the front and rear yards. This is not allowed under City Ordinance. Mr. Burgstahier noted that if Mill Road was moved, to new homes accessing on Mill Road could present a safety hazard also. Marilyn Erkenbrack, 7377 Peltier Circle, was present_ Ms. Erkenbrack noted that it makes a big difference to her }property were the houses and traiiway are placed in the proposed development. Commission member D"' " ing noted that increased traffic on Mill Road has been an issue in the past. Commission member Drilling noted that residents and fisherman will still want to be able to get to Peltier Lake_ These people would be rerouted through a residential area. Commission member Drilling suggested looking into not having right angles. John Stewart, City Engineer, noted that Mill Road can be resurfaced every seven years or so. Carol Pelton, 7178 Mill Road was present. Ms_ Pelton noted that Mill Road is breaking up and there is a severe drainage problem. The road is starting to slide down the bank. Another guard rail is necessary. Ms. Pelton noted the structure of Mill Road is a concern. If the rear property lines abut Mill Road they could not be assessed for the improvement of Mill Road. Ms. Pelton noted that she lives on Mill Road and there appears to be a lot of traffic. Ms. Pelton noted that a lot of children live on Mill Road. Ms. 'Pelton noted that Centerville presently has east /west collector streets to service the proposed development_ Ms_ Pelton noted that there is a lot of vacant land in Lino Lakes to be developed_ Ms. Pelton asked if Centerville taxpayers want to Say for the upgrading of Mill Road to facilitate future Lino Lakes development. Ms. Pelton noted that if Mill Road is vacated and rerouted, the City would need to come up with a good trail system plan. Mr_ Rehbein noted that 73rd Street is a east /west eoliector street to 20th Avenue, Petersen Trail is a collector street to Main Street and Mill Road is a collector street to Main street. Mr. Rehbein noted that Mill Road is not built to collector street standards. Mr. Rehbein noted that development for the northern half_ of the propcsed Acorn Creek is approximately three years away. Dick Pringle, Trippel's Market, 1801 Main Street, was present. Mr. Pringle noted that the rerouting of traffic from Mill Road could have an adverse effect on his business. Ted Erkenbrack suggested that the park land dedication be along Clearwater Creek. Gerald Rehbein noted that the by placing the park land in the north east corner, the City could expand the park area as other properties in the north east area develop. Bob Burgstahler noted that there appears to be three options. The first option would be to work with the original plan, the second option would be to work with the proposed sketch plan and the third would be to have the proposed Ojibway Road feed to the east, with no access to Mill Road. Commission member Drilling expressed that a sidewalk system should be incorporated on the east side of Mill Road_ Acting Chairperson Welk closed the public hearing at 7:39 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, February 2, 1993 at the City Hall. Acting Chairperson Welk called the regular meeting to order at 7:40 p.m. Present: Vermeulen, LaMotte, Drilling, City Council Liaison Brenner. .Absent: Tourville. APPROVAL OF MINUTES: Motion by Vermeulen, second by Drilling to approve the January 12, 1993 meeting minutes, motion carried unanimously. NEW BUSINESS: Prnpomed Acorn Creek Development - Pnggihility of vanatinv and rernuting the northerly 660 00 feet. (aogrnximately) of Mill Rnarl The Planning and Zoning Commission discussed at length the proposed vacation and rerouting of Mill Road. Motion by Vermeulen, second by Drilling to recommend to the City Council the approval of the concept of the Sketch Plan for the proposed Acorn Creek Development with following changes if the northerly 660.00 feet (approximately) of Mill Road is to be vacated and rerouted: P &Z MEETING MINUTES FEBRUARY 2, 1993 PAGE FIVE - a twenty - thirty foot walkway /trailway easement along the ditch area be incorporated into the plan; - a sidewalk along the west side of Ojibway Road on the northern section of the plan is included; - that the City develop the twenty - thirty foot walkway /trailway easement be developed simultaneously with the planned Regional Detention Pond; - that an "S" curve (Ojibway Road and Mill Road) be incorporated on the northern section of the plan; - an easement between Lots 4 and 5, Block 3 of the southern section of the plan be included for access to the proposed park land; - and a 60 foot easement with a "T" turnaround between Lot 9, Block 1 and Lot 1, Block 2 be included, motion carried unanimously. Motion by Vermeulen, second by LaMotte to recommend that the Preliminary Plat Public Hearing be scheduled at the City Council level, motion carried unanimously. The Planning and Zoning Committee noted that at a previous meeting a recommendation was made regarding the rezoning of the proposed Acorn Creek development_ `fir. Renbein noted that bigger lots do not guarantee 'larger homes. Mr. Reiibe ii expressed that the City can nec have both_ Acting Chairperson Welk noted that many people have expressed that their reason for moving to Centerville was the open space and larger lots. Acting Chairperson Welk and Commission member Vermeulen noted that the larger home requirement shou ld be addressed in the Developer's Agreement. Buckbee r Assistant City Clerk January 28, 1993 City of Centerville Planning and Zoning Commission Dear Commission Members, I regret that I am unable to attend this meeting. I wish to express my continuing concern over the development Mr. Rehbein has purposed. I did not favor any developement in this area of Centerville. I moved to the country to be in the country. The fact that houses are appearing everywhere disturbs me. It slowly alters our previous way of life and community, not for the better. Mr. Rehbein has purposed small lots, rezoning, increased traffic and now moving Mill Road for no other reason but his commercial success. The city over years has given in little by little. Has the city gained any benefit? I think not. Instead the city open space disappears, never to be reclaimed in the event of error. A road was planned to border Mr. Fruth's property on his south lot line. This would allow for the future expansion of the area next to and in the rear of his and my homes. Mr. Rehbein has disregarded this and placed homes along this lot line. This will in effect block our lots from any future use. He takes opportunity now, but denies Mr. Fruth and myself the same opportunity in the future. Lot size is of great importance. In a rural area, density is to be avoided. More is not better, except to Mr. Rehbein. I have invested my life into my house and property. If homes are coming, and they are, I wish them to be upper bracket homes like mine. If I can not prevent this expansion blitz I look to my elected officials to temper it with everyones best interest in mind. The idea of vacating Mill Road to allow Mr. Rehbein to sell 4 creek lots is absurd. It denies the creek to every Centerville resident that walks, jogs, bikes or drives by this section. This is probably the most scenic portion of Mill Road in the city. If Mr. Rehbein has his way, it will be a backyard. He further wishes drivers to make four corners and drive thru a dense residential area, when we now have a direct route. Traffic on Hill Road, particularly foot traffic, near County 14 is very dangerous. How Mr. Rehbein would send us again thru a neighborhood, just as Mill Road begins to enter an area of fewer homes. The fisherman, snowmobilers, and sportsmen with their equipment are to be routed into this intended mess. I have heard some say this is a dangerous portion of Mill Road. More dangerous than adding corners and traffic to a dense residential neighborhood? January 28, 1993 Page 2. Please consider these arguments and the overall impact we bring to our community. Mr. Rehbein must justify his demands in terms of benefit to our city, lack of impact on present residents, and environmental and aestetic values. We do not have to yield any item or condition that is not to our collective benefits. Please show the courage and spirit that grows from a proper decision. February 2, 1993 To: The City of Centerville, Planning & Zoning Commission, The purpose of this letter is to tell you what we think about the proposed vacating and rerouting the northerly 660 feet of Mill Road by the owner and developer, Gerald Rehbein. Most of the residents who live in and around this particular area of Mill Road know that this section of Mill Road is used numerous times every day, (even in bad weather) by people who like to walk and bike up to Lake Peltier and beyond. For this main reason we would not be in favor of this proposal unless there was a wide asphalt, (or other smooth hard surface) path- way behind the proposed lots that would take the place of this section of Mill Road; built and paid for by the developer, NOT the taxpayer. We realize this may be difficult in some parts of this stretch because the creek winds very close to Mill Road, and the path would need to be elevated in some spots due to the high water level at certain times of the year. None the less, this is what we would want provided for us and the many others in our'wonderful city. Thank you for considering our input on this issue. Sincerely, nc e L i ' al- Michael & Tina Schelier 7267 Mill Road, Centerville 7 , 44 , wile C 1 T Y O F INO ACES L L City of Centerville January 29, 1993 Mr. Ray Siebenaler, City Administrator 1694 Sorel Street Centerville, MN 55038 RE: Vacation and Routing of Mill Road Center of the S 1/2 of Section 14 Proposed by Owner and Developer Gerald Rehbein Dear Mr. Siebenaler: We have received a notice that the Centerville Planning and Zoning Commission will be holding a public hearing on the vacating and rerouting of the northerly 660 feet (approximately) of Mill Road at City Hall on Tuesday, February 2, 1992 at 7:00 P.M. Mill Road presently functions as a collector street to service the present residents of Centerville and Lino Lakes. As the area develops in the future this street will be expected to carry a much greater traffic load. The proposed vacation of existing Mill Road and the rerouting will severely damage the functionality of Mill Road as a collector street and cause safety problems as this traffic is awkwardly forced to travel through the residential neighborhood. The rerouting resembles a detour in that there are several 90 degree or near 90 degree turns required to carry through traffic. Stop signs will most likely be necessary to control traffic movements on the intersections. Acceleration and deceleration of automobiles and truck traffic will generate noise in the residential neighborhood. The seemingly unexpected 90 degree turns at the entrances to the rerouting of Mill Road traffic from the north and the south would be a serious safety concern. If there are maintenance problems with the existing Mill Road, it would seem to be most effective to reconstruct the street than to build a longer street as a substitute to the more direct alignment of present Mill Road. The vacation of Mill Road would also seem to cause internal circulation problems for streets such as Peltier Lake Drive which depends upon Mill Road for continuity. /Crely- ll F. hneider, Pr City Engineer CC: D.
