Commission of the City of Centerville held a public hearing on
Tuesday, September 8, 1992 at the City Hall. The purpose of the
public hearing was to hear all persons present regarding a
request to rezone the following properties:

142.29 feet, then south 63 degrees 44 minutes 20 seconds
west 95.56 feet, then west 165.04 feet to east R/W line of

The requested rezoning of the above combined properties is as
follows:
- south 400 feet from R -1 Rural Residential to R2A Single
Family Residential;
- middle 420 feet from R -1 Rural Residential to R2 Single
Family Residential;
- north 500 feet from R -1 Rural Residential to R5 Single
Family Estate.
Chairperson Tourville called the public hearing to order at 7:07
p.m. Present: Drilling, LaMotte, Welk, Vermeulen.
Chairperson Tourville summarized the request for rezoning to the
Commission and audience members.
Gerald Rehbein, Developer of the proposed Acorn Creek
Development, was present. Mr. Rehbein noted, in his opinion, the
requested rezoning meets the Centerville Comprehensive Plan. The
third phase of the proposed development was not included on the

Preliminary Plat for the following reasons:
- the Park and Recreation Committee has not yet made a
decision about the park land,
- and the issue of a regional detention pond.
Mr. Rehbein explained the Acorn Creek sewer lines are proposed to
move the sewer from Center Hills Third Addition to Mill Road.
Chairperson Tourville noted that Mr. Rehbein is requesting three
different zoning districts.
Ken Vanderbeek, 6892 Centerville Road, was present. Mr.
Vanderbeek is a representative from Edina Realty. Mr. Vanderbeek
will be marketing the development. Mr. Vanderbeek noted he feels
Centerville needs to change the type of development that has been
done in the past. The R -5 Single Family Estate Zoning District
allows for the change. He noted, in his opinion, Centerville
needs to improve the type of housing. Mr. Vanderbeek stated the
proposed housing value for the Acorn Creek Development would be
in the $85,000.00 to $110,000.00 price range.
George Haberman, 7288 Mill Road, expressed disagreement with Mr.
Rehbein's comment that the requested rezoning meets the City of
Centerville's Comprehensive Plan. Mr. Haberman noted the
property north of the proposed 73rd Street should be zoned R -2
Single Family Residential versus R -2A Single Family Residential.
Mr. Rehbein noted the approximate acreage of the proposed
development is 36.9 acres. Mr. Rehbein is proposing approximatly
63 lots for the Acorn Creek Development. Mr. Rehbein expressed
that he feels this does meet the density requirements outlined in
the Comprehensive Plan.
Roger Fenton, 1841 Prairie Drive, was present. Mr. Fenton
expressed the following concerns:
- the proposed development will increase the run -off onto
his property;
- increase in traffic flow.
John Stewart, City Engineer, was present. Mr. Stewart presented
the Planning and Zoning Commission with a Preliminary Grading
Plan and "Exhibits 1 -7 ". Mr. Stewart noted a Feasibility Study
was ordered for the proposed Acorn Creek Development. The
Feasibility Study will be presented to the City Council at their
September 9, 1992 meeting.
A copy of the Preliminary Grading Plan is on file with the City
office.

A copy of the "Exhibits 1 -7" are attached to and made a part of
these minutes.
Roger Fenton, 1841 Prairie Drive, asked whose responsibility is
it to insure proper grading of the development. Mr. Fenton noted
his biggest fear is that the drainage problem he is experiencing
would be aggravated.
Greg Sievert, 7254 Mill Road, was present. Mr. Sievert noted the
Centerville Heights Development has increased the amount of water
draining onto the back of his lot. Mr. Sievert is concerned his
property will also collect water from the proposed Acorn Creek
Development.
Mr. Stewart noted the Acorn Creek Development should not make the
drainage problem worse. The proposed Grading Plan suggests
capturing the water run -off and taking it away to the north of
the development.
Scott Goeltl, 1844 Prairie Drive, was present. Mr. Goeltl
questioned if a sidewalk is proposed for the development.
Mr, Stewart noted that a sidewalk is proposed for the north side
of 73rd Street. The sidewalk would extend from Mill Road to 20th
Avenue North.
Mr. Goeltl questioned if the tree line is to be preserved.
Mr. Rehbein noted he could improve the drainage by removing the
trees or the trees could remain and the water run -off drained
north to the streets.
Commission member LaMotte expressed the following concerns:
- access to the park,
- sidewalks.
Motion by Drilling, second by Vermeulen to adjourn the public
hearing, motion carried unanimously. Hearing adjourned 8:52 p.m.

The proposed zoning for the development is R2A Single Family
Residential, R2 Single Family Residential and R5 Single Family
Estate. The proposed use will be to construct Single Family
Homes. Chairperson Tourville called the public hearing to order
at 8:15 p.m. Present: Drilling, LaMotte, Welk, Vermeulen.
Gerald Rehbein, Developer of the proposed Acorn Creek
Development, was present. Mr. Rehbein noted that 73rd Street is
proposed to be constructed as a nine (9) ton road. The grading
plan should address the drainage concerns, Mr. Rehbein is
waiting for the Park and Recreation Commission to make a decision
on the park land. He is proposing 62 - 66 lots. A decision
regarding the regional detention pond is also needed.
Chairperson Tourville reviewed the Preliminary Plat Checklist
completed by Maier, Stewart and Associates. It appeared there
may be items not included with the submittal of the Preliminary
Plat.
A copy of the Preliminary Plat Review Checklist as completed by
Maier, Stewart and Associates is attached to and made a part of
these minutes.
George Haberman, 7288 Mill Road, was present. Mr. Haberman
expressed, in his opinion, the proposed split of the zoning
districts shown on the Preliminary Plat above 73rd Street to the

north boundary is not consistent with the Comprehensive Plan.
Mr. Haberman noted the City Council, Planning and Zoning
Commission, Park and Recreation Committee and the Centerville
Economic Development Task Force worked very hard on the
Comprehensive Plan. Mr. Haberman expressed the City should not
deviate from the Comprehensive Plan. Mr. Haberman also expressed
concern about the drainage.
Chairperson Tourville noted it is assumed the Engineer will
design a drainage plan to have the water drain properly.
Mr. Haberman noted the drainage easements are shown on the
Preliminary Plat. Mr. Haberman questioned if the City has a
drainage easement requirement that states property owners can not
build within the easement area.
Chairperson Tourville noted the Final Plat will show all
necessary easements. Chairperson Tourville requested City Staff
check to see if the City has a policy regarding restrictions
regarding construction within an easement area.
Motion by Vermeulen, second by Welk to adjourn the public
hearing, motion carried unanimously. Hearing adjourned 8:45 p.m.
Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held their regular meeting
on Tuesday, September 8, 1992 at the City Hall. Chairperson
Tourville called the meeting to order at 8:49 p.m. Present:
Drilling, LaMotte, Vermeulen, Welk.

Motion by Welk, second by LaMotte to approve the August 11, 1992
meeting minutes, AYE - Drilling; AYE - LaMotte; AYE -
Tourville; AYE - Welk; ABSTAIN - Vermeulen, motion carried.
OLD BUSINESS
Acorn Creek Development - Gerald Rehbein - Request for Rezoning -
Acorn Creek Development
Chairperson Tourville noted there did not appear to be any
arguments against the development expressed at the public
hearing. The main concern expressed was how the development
would be completed.
Commission member LaMotte expressed, in his opinion, the proposed
zoning meets the intent of the Comprehensive Plan. Commission
member LaMotte noted he liked the proposed phasing in of the
larger lots.

Commission member Drilling noted the traffic appears to flow more
easterly. Commission member Drilling also expressed that the
density appears to be within the spirit of the Comprehensive
Plan. He also noted there did not appear to be any "major
league" objections to the proposed development, besides the
drainage.
Bob Burgstahler, 7381 Mill Road, was present. Mr. Burgstahler
noted the Centerville does need to improve its housing standards.
Mr. Burgstahler expressed this appears to be the best plan
presented. Mr. Burgstahler also noted the plan does appear to
meet the intent of the Comprehensive Plan.
Commission member Vermeulen expressed it was her recollection
that the lots north of 73rd Street were to be rezoned R2 versus
R2A. Commission member Vermeulen questioned Mr. Vanderbeek what,
in his opinion, made him a better builder.
Mr. Vanderbeek noted the least expensive home will be $85,000.00
with a brick front. The soil is not the best and the lack of
trees does hurt the marketability of the development. The
different zoning districts allows to fill the gap in the housing
prices in Centerville.
Chairperson Tourville noted, in his opinion, the intent of the
Comprehensive Plan is to phase in the zoning districts to the R -5
zoning district.
Commission member Vermeulen noted that it would be a shame to
take the trees out. Commission member Vermeulen also noted that
the drainage concerns needed to be addressed.
Commission member Welk expressed, in her opinion, the property
north of 73rd Street should be zoned R2. Commission member Welk
noted frustration with the Park and Recreation Committee not
being able to make a decision about the park land. Commission
member Welk also questioned were the access to the park land
would be.
Chairperson Tourville noted the park land is proposed to be
located in Phase III of the proposed development.
Chairperson Tourville questioned why the "mid" section of the
development is proposed as Phase I.
Mr. Rehbein noted this appears to solve the problem with the
issue of sewer service to the Center Hill Third Addition. Mr.
Rehbein also noted that if the development sells it can be
marketed either north or south.

Chairperson Tourville noted the drainage and power line easements
need to be addressed.
Bob Burgstahler noted that the Comprehensive Plan is rather
general. Mr. Burgstahler, expressed that in his opinion, the
proposed Preliminary Plat meets the concept of the Comprehensive
Plan. Mr. Burgstahler expressed more concern over were the
zoning line would be drawn.
Motion by Drilling, second by LaMotte to recommend to the City
Council the rezoning request of Gerald Rehbein, Developer Acorn
Creek Development be approved as follows:
- south 400 feet from R -1 Rural Residential to R2A Single
Family Residential;
- middle 420 feet from R -1 Rural Residential to R2 Single
Family Residential;
- north 500 feet from R -1 Rural Residential to R5 Single
Family Estate,
AYE - Drilling; AYE - LaMotte; AYE - Tourville; NAY -
Vermeulen; NAY - Welk, motion carried.
It appeared the reasons for Commission members Welk and Vermeulen
voting nay on the proposed rezoning are as follows:
- They would prefer the re- alignment of the R2 zoning
district north of 73rd Street;
- the rear lot lines appear to be uneven. The concern
would be if one home owner planted shrubs or placed a
privacy fence there would be a "gap ".
Motion by Vermeulen, second by Drilling to recommend to the City
Council the approval of the Preliminary Plat as presented
contingent upon the inclusion of:
- existing zoning of tract and properties within 350 feet
of proposed plat boundaries;
- location, widths and names of all existing or
previously platted streets or other public ways,
showing types of improvement, if any, railroad and
utility right -of -ways, parks and any other public open
spaces, permanent buildings, structures, easements and
section and corporate lines within the tract and within
350 feet of the tract;
- name and addresses of owners of property (as shown on
county tax records) within 350 feet of proposed
subdivision boundary;
- existing and proposed streets and right -of -way,
including widths and purposes within 350 feet of
proposed subdivision boundary;
- existing and proposed easements, including widths and

utilities, including size, capacity, and location of
sanitary sewers, storm sewers, drainage facilities,

- areas subject to periodic overflow of flood or storm
waters within 100 feet of the proposed subdivision
boundary;
- location and widths of easements;
- location and area of parcels of land to be dedicated or
reserved for schools, parks, playground, or other
public or community uses;
and that the drainage concerns be addressed properly, motion
carried unanimously.
Construction within frainace Easements
City Staff noted that the City does not have a policy regarding
construction within drainage easements. There is a State Statute
that regulates this.
Review of Ordinance #4, Article 4, 5 and 6
Motion by Tourville, second by Drilling to table discussion of
Ordinance #4, Article 4, 5 and 6 until the next meeting, motion
carried unanimously.
