HomeMy WebLinkAbout1992-06-09 Minutes Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, June 9, 1992 at the City Hall. The purpose of the hearing was to hear all persons present regarding a request for an eleven foot variance from Ordinance #4, Section 34.01-3 - "Any principal structure situated on lands contiguous to or abutting any portion of the public lakes in Centerville shall maintain yard setbacks of seventy -five (75) feet from the lake. Where adjacent structures have yard setbacks different from these requirements, the minimum setback from the lake shall be the average setback of such adjacent structures to a minimum of fifty (50) feet." The request for variance is to construct a single family home approximately thirty nine (39) feet from the lake. Chairperson Tourville called the hearing to order at 7:05 p.m. Present: Drilling, LaMotte, Vermeulen, Welk. Chairperson Tourville summarized the request for variance to the Planning and Zoning Commission and members of the audience. Steve Marcello, 1588 Peltier Lake Drive, was present. Mr. Marcello noted that he is requesting the variance to build a single family home thirty nine feet versus fifty feet from the lake. Mr. Marcello expressed that he did not feel that he would be asking for any special privileges. Mr. Marcello's proposed single family home would be built in line with the adjacent properties. Mr. Marcello has received a permit from the Rice Creek Watershed District. Chairperson Tourville asked what comments were received from the Rice Creek Watershed District. Mr. Marcello noted that the Rice Creek Watershed District appeared to feel that his request was within reason. The Rice Creek Watershed District Engineer Peter Fryer appeared to not express concern with Mr. Marcello's proposed building site. Chairperson Tourville noted that the lot is not as deep as required in an R -2 Single Family Residential - Sewered lot. The lot in question appears to be 125 feet deep. The lot was platted and deeded prior to the current zoning ordinance requirements. Mr. Marcello noted the proposed building is in compliance with all the other setback requirements (side /front). Richard Thompson, 1657 Peltier Lake Drive, was present. Mr. Thompson noted that he did not have any objections to Mr. Marcello's request to build 39 feet from the lake. Mr. Thompson expressed that his home is located approximately 40 feet from the lake. Norman Fritchie, 1637 Peltier Lake Drive, was present. Mr. Fritchie noted that his home is two lots west of the lot in question. Mr. Fritchie asked if it was the size of the lot that P &Z Meeting Minutes June 9, 1992 page two made this parcel unique. Mr. Fritchie noted that his home is located approximately 55 feet from the lake. Mr. Fritchie asked questions about the Vermeulen property located at 1645 Peltier Lake Drive. Mr. Fritchie noted that it appeared the proposed building would be in line with the adjacent properties, therefore he sees no problem with granting the variance. Chairperson Tourville noted that the purpose of the public hearing was to consider the issue before the Planning and Zoning Commission. The issue being the granting of a variance to construct a single family home approximately 39 feet from the lake. Motion by Vermeulen, second by Welk to adjourn the public hearing, motion carried unanimously. Hearing adjourned 7:28 p.m. Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, June 9, 1992 at the City Hall. Chairperson Tourville called the meeting to order at 7:29 p.m. Present: Drilling, LaMotte, Vermeulen, Welk. Motion by Vermeulen, second by Drilling to approve the May 12, 1992 meeting minutes, AYE - Vermeulen; AYE - Drilling; AYE- ' Tourville; ABSTAIN - LaMotte; ABSTAIN - Welk. NEW BUSINESS Bequest for Variance - Steve Marcell° - 1588 Peltier Lake Drive - to construct a single family home approximately thirty nine (39) feet from the lake Motion by Drilling, second by Vermeulen to recommend to the City Council that Steve Marcello's request for an eleven foot variance from Ordinance #4, Section 34.01 -3 - to construct a single family lake be granted e e versus fit home thirty nine feet Y feet from the 1 based on the following criteria: - special conditions and circumstances exist which are peculiar to the land involved and do not result from actions of the petitioner. The lot is only 125 feet deep; - literal interpretation of the provisions of this ordinance would deprive the petitioner of rights commonly enjoyed by other properties in the same district under the terms of this ordinance. The neighboring properties enjoy the same setbacks; g g P ro P - granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or building in the same district; P &Z Meeting Minutes June 9, 1992 page three the proposed variance will not impair an adequate supply of light and air to adjacent property or unreasonably diminish or impair established property values within the surround area, or in any other respect impair the public health, safety or welfare of the residents of the city, motion carried unanimously. OLD BUSINESS Review of Ordinance *4. Section 33.03 through 34.11 The Planning and Zoning Commission members discussed possible changes to Ordinance *4, Section 33.03 through 34.11. It appeared to be in consensus that at the next meeting Ordinance #4, Section 34 though 37 would be reviewed. City Staff shall keep on file notes of the discussion on Ordinance #4.
