HomeMy WebLinkAbout1992-04-14 Minutes Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held their regular meeting on April 14, 1992 at the City Hall. Chairperson Tourville called the meeting to order at 7 :05 p.m. Present: Drilling, LaMotte, Vermeulen, Welk, City Council Liaison Burgstahler. MINUTES Motion by LaMotte, second by Drilling to approve the February 11, 1992 meeting minutes, motion carried unanimously. Motion by Vermeulen, second by Welk to approve the March 10, 1992 meeting minutes with the following amendment: Page 3, paragraph 9 Now Reads: '...It is the responsibility of the Planning and Zoning Commission to adopt or disregard the Attorney's recommendation." Amend to Read: "...It is the responsibility of the Planning and Zoning Commission to adopt or discuss the Attorney's recommendation." motion carried unanimously. OLD BUSINESS Jim and Joyce Stevens - Request to Construct Driveway within the Flood Plain Area - through Conditional Use Permit through Ordinance #33 -A FI,000PI,AIN Motion by LaMotte, second by Vermeulen to recommend that the City Council grant a Conditional Use Permit to Ordinance #33 -A FLOODPLAIN to bring in fill and build a driveway as proposed by James and Joyce Stevens on the land described as the South 662.45 feet of the Northwest Quarter of the Southwest Quarter of Section 24, Township 31, Range 22 except RD; subject to easement of record, contingent upon the following: - compliance with Ordinance #33 -A, Sections 5.23, 5.44 and 5.54; - compliance to the recommendations of the City Engineer in a letter dated February 11, 1992 regarding topographic survey and proposed driveway design for James and Joyce Stevens; - upon receipt of a written permit granted by the Rice Creek Watershed District for the proposed fill and driveway, motion carried unanimously. Motion by Drilling, second by Vermeulen to add to the Conditional Use Permit that it shall be a requirement that the sand and fill from the original location at 7007 20th Avenue South, which is in violation of Ordinance #33 -A in the floodway, be removed, motion carried unanimously. P &Z Meeting Minutes April 14, 1992 page two Updating Ordinance #4 It appeared to be the consensus of the Planning and Zoning Commission members present that the Commission members shall review Ordinance #4 from the beginning through Section 34.11. It also appeared to be the consensus of the Planning and Zoning Commission members present that Commission comments will be used to re -draft Ordinance #4, to include staff comments, and then be forwarded to the City Attorney for comments and review regarding legality. The Planning and Zoning Commission shall direct Staff to research appropriate areas of concern. Annexation The Clerk /Administrator noted that the Annexation Hearing has been re- scheduled from April 15, 1992 to May 28, 1992. Beyond the Racine Seminar Commission member LaMotte updated the Planning and Zoning Commission regarding his attendance at this seminar. He noted that the seminar was very educational and "eye- opening ". He noted that the seminar involved case studies. He will forward the book used in the class to the Planning and Zoning Commission to be rotated among the Commission members.
