HomeMy WebLinkAbout1992-03-10 Minutes Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held a public hearing on
Tuesday, March 10, 1992 at the City Hall. The purpose of the
hearing was to hear all persons present regarding the possibility
of rezoning the following property legally described as follows:
Lots 1 and 2, Block 5, Centerville except the North 10
feet of said Lot 2; subject to easement of REC.
The proposed rezoning will be frolri Commercial (B -1) to Single
Family Residential - Sewered (R -2). Chairperson Tourville called
the public hearing to order at 7:09 p.m. Present: LaMotte,
Vermeulen, Welk. Absent: Drilling.
Chairperson Tourville summarized the request for rezoning to the
Planning and Zoning Commission and audience members.
Dennis Wegan, 1310 Birch Street, Lino Lakes, was present. Mr.
Wegan is the owner of the property. Mr. Wegan noted that he has
owned the vacant lot for 4 - 5 years. He is paying approximately
$1,000.00 a year in taxes and would like to make use of the
property. He would like to build a home on the lot and sell it.
In Mr. Wegan's opinion the lot is to small for a commercial use.
Mr. Wegan also expressed that by building a home on the lot it
will help with the complaint: every year about the weeds on the
vacant lot.
Bob Knabe, 7089 Centerville Road, was present. Mr. Knabe noted
he was present to listen and had no comments.
Paul Montain, Trio Inn, 7082 Centerville Road, was not present
but had come to City Hall to express that he is not opposed to
the rezoning, but was concerned about the possible repercussions
to his commercial business from the rezoning to a residential
property. Some the possible conflicts could be the noise and
parking.
Commission member LaMotte asked if the proposed rezoning would
have a negative effect on the tax base.
Commission member Vermeulen asked as to what the size of the lot
is.
Mr. Wegan noted that the lot size is approximately 150 x 90.
Motion by Vermeulen, second by Welk to adjourn the public
hearing, motion carried unanimously. Hearing adjourned 7:18 p.m.

on Tuesday, March 10, 1992 at the City Hall. Chairperson
Tourville called the meeting to order at 7:17 p.m. Present:

until the next meeting.

NEW BUSINESS
Rezoning Request - Dennis Wegan
Chairperson Tourville asked Mr. Wegan if it would be necessary
for any variances from the Zoning Ordinance in order to build a
single family home on the property.

Chairperson Tourville asked Mr. Wegan if he had spoken with the
Building Inspector about his plans to build a single family home.
Committee member Welk noted that the proposed size of the single
family home should meet the setback requirements.
Chairperson Tourville suggested that it may be simpler to grant a
• variance to the zoning district (C -1) to allow for a single
family home.
Sauna Buckbee, Assistant City Clerk, noted that in her opinion, a
variance can not be granted to a zoning district as to the use.
Chairperson Tourville noted that this area of the City is not a
highly travelled area. The location may be more appropriate for
a business similar to Rivard Electric. It appeared to
Chairperson Tourville that it may be years before a commercial
use would work in the older downtown area of Centerville.
Committee member LaMotte noted that he would be in favor of
recommending to the City Council the rezoning of the property.
Committee member Vermeulen noted that she would not be opposed to
the rezoning.

Committee member Welk suggested that it may be logical to rezone
the house to the north to residential also.
Chairperson Tourville noted that it would be appropriate to
contact the property owner before considering rezoning of the
property.
Committee member Welk noted that it may be okay to keep the
property to the north of the proposed rezoning as commercial, in
case Rivard Electric should ever want to expand.

Chairperson Tourville noted that the rezoning of the property to
Residential would make use of the vacant land.
Committee member Welk noted that the lot is too small for a
commercial use. There appears to be no room for parking.
Chairperson Tourville suggested to Mr. Wegan that he may want to
consider some type of privacy fencing.
Mr. Wegan noted that he may want to sell 10 -20 feet to the owner
of the Trio Inn for parking expansion and snow storage.
Motion by LaMotte, second by Vermeulen to recommend to the City
Council that the following property legally described as follows:
Lots 1 and 2, Block 5, Centerville except the North 10
feet of said Lot 2; subject to easement of REC,
be rezoned from Commercial (B -1) to Single Family Residential -
Sewered (R -2), motion carried unanimously.
OLD BUSINESS
Beyond the Basics - Seminar
It was discussed that Chairperson Tourville and Committee member
LaMotte would like to attend the Beyond the Basics Seminar on
Thursday April 9, 1992. City Staff is directed to register
Chairperson Tourville and Committee member LaMotte and to order
one book on the duties of the Planning Commission.
Ba.g_ular Schedule Meeting - Agenda Items - Updating Ordinance
Chairperson Tourville questioned the Committee members present if
they would like to meet if there are no formal agenda items.
Committee member Vermeulen noted that the Commission could work
on updating Ordinance #4 and that it also appeared UiicU the City
Council would like for the Planning and Zoning Commission to
meet.
Chairperson Tourville rioted that he would like to wait for the
Attorney's comments on suggestions for updating Ordinance #4.
Chairperson Tourville expressed that the Attorney s
responsibility to review the ordinance and make recommendations
to the Planning and Zoning Commission. It is the responsibility
of the Planning and Zoning Commission to adopt or disregard the
Attorney's recommendations.
Committee member Welk noted that she preferred waiting for the
Attorney's opinion before spending the time reviewing Ordinance
#4.
Committee member Vermeulen left at 8:05 p.m.

The Planning and Zoning Commission's direction to the City Staff
for the updating of Ordinance 04 is as follows:
- Present suggested changes,
- Present ideas for areas for changes,
- and provide a brief description of what would be
appropriate changes.
Chairperson Tourville noted that he did not wish to repeal the
present Ordinance 04 as there are grand- fathered rights to be
considered. •

Motion by Welk, second by LaMotte to adjourn the meeting, motion
carried unanimously. Meeting adjourned 8 :15 p.m.
