HomeMy WebLinkAbout1991-09-05 Minutes Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held a Public Hearing on Thursday, September 5, 1991 at the City Hall. The purpose of the Public Hearing was to hear all persons present regarding the possibility of amending Ordinance #4, Article 2. - ZONING DISTRICTS AND DISTRICT REGULATIONS, Section 24. SCHEDULE OF REGULATIONS. Now Reads: (7) Ali future new dwellings in R-1, R-2A, R-2, R-3, R-4, Single Family Residential Districts shall have an attached double garage of a minimum 440 square feet. Amend to Read: (7) Ali future new dwellings in R-1, R-2A, R-2, R-3, R•4, Singie Family Residential Districts shall have a double garage of a minimum 440 square feet. Chairperson Tourville called the hearing to order at 7:07 p.m. Present: Welk, Vermeulen, Drilling, LaMotte, City Council Liaison Eurgstahler. Chairperson Tourville summarized the proposed amendment to the members of the Planning and Zoning Commission and Liaison Burgstahler. There was no audience members present. Liaison Burgsta}iler noted that he would not have a problem with the proposed amendment as long as a garage is required. Commission member Welk expressed agreement with Liaison Burgstahler, as long as the garage was built at the same time as the home. Commission member Vermeulen stated that she prefers an attached garage, but did not feel it was right to dictate to property owners that they be required to build an attached garage. Oho also suggested that the proposed amendment apply only to approve plats priol to amchdmcnt of the erciinance. Commission member Drilling expressed that in new developments an attached garage is a good requirement. Commission member LaMotte expressed agreement with COMMiSSi011 member Drilling's opinion that attached garages in new developments was a good idea. Chairperson Tourville expressed that R-1 and R-3 Zoning Districts are rural in nature and should not be required to buiid a garage. He also expressed that R-2 should be allowed to have a detached garage. This would eliminate questions in advance for multi- family housing that could possibly have detached garages. Motion by Drilling, second by Vermeulen to adjourn the public hearing, motion carried unanimously. Chairperson Tourville called the meeting to order at 7:26 p.m. Present: Welk, Vermeulen, Drilling, LaMotte, City Council Liaison Burgstahler. Chairperson Tourville welcomed newly appointed Planning and Zoning Commission member LaMotte and thanked him for his interest. Motion by Vermeulen, second by Drilling to approve the August 6, 1991 meeting minutes; Aye - Vermeulen; Aye - Drilling; Aye - Welk; Aye - Tourville; Abstain - LaMotte, motion carried. Motion by Tourville, second by Vermeulen to table the August 27, 1991 special meeting minutes; Aye - Vermeulen; Aye - Drilling; Aye - Welk; Aye - Tourville; Abstain - LaMotte, motion carried. OLD BUSINESS Possibility of amending Ordinance #4. Article 2. - Article 2,- ZONTNG DTSTRTCTS AND DISTRTCT REGUJ1ATTOJS, Section 24. Chairperson Tourville noted that the reason he voted against the above amendment is that he prefers to not to have garages required in the R -1 Rural Residential and R -3 Future Expansion Zoning Districts. NEW BUSINESS Review Ordinance 04 with Regard to the 5,000 Square Foot Building Minimum.‘ 1. - o' -• ' t (- .... H.. .,'f- I. The Centerville Economic Development Task Force requested that the Planing and Zoning Commission discuss minimum square foot building sine and uses permitter, in the Industrial Zoning District. Chairperson Tourville noted that Comfort Pius Heating and Cooling is not in conformance with the minimum square foot building sine. Chairperson Tourviiie also noted that there was a proposed auto repair shop with a minimum of 1,200 square feet. Chairperson f'oixl "V 111:. expressed that the FLrannlI]g and Zoning Commission requires more input from the Task Force as to what they Wan - L. 1 }1e Task Force needs tO make a specific recommendation. Commission member Welk questioned that the City may be asking for too large of- a building in the Industrial Zoning District She suggested that the City of Blaine be contacted as to what their requirements are for their iridu'strial Park west of interstate 35W and south of 85th. Chairperson Tourvilie suggested requesting a copy of the uses permitted in industrial Zoning Districts from other cities. Chairperson Tourville also expressed that in his opinion the tax base from industrial development within the City of Centerville may not be enough to pay back the cost of the extension of utilities to the Industrial Park. Motion by Tourville, second by Vermeulen to table further discussion until more specific direction from the Centerville Economic Development Task Force is given; - and to direct City Staff to research what other cities have for minimum size requirements and uses permitted in Industrial and Commercial Zoning Districts, motion carried unanimously. P &Z Meeting Minutes September 5, 1991 • page four Possibility of Amending Ordinance #4. Section 36.06 TMPROVEMENT AND MATNTFNANCF Discussion on the proposed amendment requiring all driveways abutting City street prior to adoption of this amendment shall construct a driveway apron to extend from the street to the property line (within the street. right -of -way). It was noted that some of the reason for this requirement would be to help reduce debris in the streets. This debris appears to hinder drainage on some City streets. Also certain streets within the City require more street sweeping. Commission member Vermeulen expressed that the proposed ordinance was too restrictive. The City streets are already swept. Commission member Drilling, in his opinion, did not see a need to amend the ordinance. The City does not pay tonnage for street sweeping. Motion by Drilling, second by Vermeulen to recommend to the City Council that Ordinance #4, Section 36.06 IMPROVEMENT AND MAINTENANCE not be amended as proposed citing the following reasons: - the current Section 36.06 is acceptable as is; - the proposed amendments are toorestrictive; - the new developments are required to have a hard surface driveway, motion carried unanimously. A copy of the proposed amendment is attached to and made a part of these minutes. Adjourn Motion by Welk, second by LaMotte to adjourn the meeting, motion carried unanimously. Meeting adjourned 8:45 p.m. Respectfully submitted, Sanna E. Buckbee Assistant City Clerk ORDINANCE 34, ARTICLE 3, SECTION 36.06 NOW READS: IMPROVEMENT AND MAINTENANCE. Required parking and loading spaces, together with driveways, aisles, and other circulation areas, shall be improved in such a way as to provide a durable and dust -free surface. All parking and loading areas shall provide for proper drainage of surface water to prevent the drainage of such water onto adjacent properties or walkways. The owner of any parking or loading area shall maintain the area in good condition without holes and free of all dust, trash, and other debris. AMEND TO READ: IMPROVEMENT AND MAINTENANCE. 36.06 -1 Required parking and loading spaces, together with driveways, aisles, and other circulation areas, shall be constructed of bituminous or concrete and meet the specifications of the City Engineer. The driveways shall be completed prior to issuance of a certificate of occupancy, weather permitting. 36.06 -2 All parking and loading areas shall provide for proper drainage of surface water to prevent the drainage of such water onto adjacent properties or walkways. The owner of any parking or loading area shall maintain the area in good condition without holes and free of all dust, trash, and other debris. 36.06 -3 All driveways abutting City street prior to adoption of this amendment shall construct a driveway apron to extend from the street to the property line (within the street right -of -way). The apron shall be constructed of bituminous or concrete and shall meet the specifications of the City Engineer. Construction of the driveway apron will be the responsibility of the abutting property owner. The property owner shall be allowed a period of three (3) years after adoption of this amendment to construct the apron. If after a period of three (3) years the apron is not installed, the City shall initiate construction and asses the cost to the abutting property owner.
