HomeMy WebLinkAbout1991-02-06 Minutes Pursuant to due ca11 and notice thereof the Planning and Zoning Commission of the City of Centerville held their regular meeting on Wednesday, February 6, 1991 at the City Hall_ Chairperson Tourville called the meeting to order at 7:08 p.m. Present: Wilharber, Vermeulen, Welk, Liaison Pelton. Absent: Drilling. Motion by Vermeulen, second by Welk to approve the December 4, 1990 meeting minutes, motion carried unanimously. Orin MISTRESS Preliminary Plat Review Checklist Chairperson Tourville updated the Planning and Zoning Commission on the recommendations of John Stewart, City Engineer, in a letter dated September 27, 1990 regarding Preliminary Flat Checklist. The letter addresses the concern of the Planning and Zoning Commission that some of the requirements in the previously submitted Preliminary Plat Review Checklist could cause the developer to incur major expenses in the earlier stages of a proposed development. Mr. Stewart has separated the Preliminary Plat Review Checklist, into what he felt would be the most logical. This letter is on file with the Clerk /Administrator. It appeared to be the consensus of the Planning and Zoning Commission that a Preliminary Plat Review Checklist would be helpful for developers to realise what the requirements and expectations would be of a preliminary plat. Liaison Pelton expressed concern on sketch plans being not dimensioned. She feels that this makes it difficult for the City Council and the Planning and Zoning Commission to analyse. She feels it is very important to have a sketch plan that is to scale. Chairperson Tourville noted that Ordinance #8, Article 4, Section 42, SKETCH PLAN, is an advisory meeting with the Planning and Zoning Commission to see if the idea may be feasible. In his opinion this step is to save money for developers ar,d the City. Committee member Welk noted that some of the items on the forms duplicated each other. The forms should not duplicate each other, since all items would be necessary for preliminary plat approval, but at different stages using the checklists. Chairperson Tourville questioned if the wording of Ordinance #8 would need to be amended. The Preliminary Plat Review Checklist is only a breakdown of the requirements of Ordinance #8, Article 4 - PLAT SPECIFICATIONS AND PROCEDURE. Motion by Vermeulen, second by Welk that the Preliminary Plat Review Checklist be broken down into three (3) stages; all duplications of requirements in the three (3) stages be deleted; P &Z Meeting Minutes February 6, 1991 page two a notation shall be added that the previous steps must be completed before preliminary plat approval, motion carried unanimously. A copy of the Preliminary Plat Review Checklist, brokers down into three (3) stages, is attached to and made part of these minutes. Amendment to Ordinance #8 Section 1 05 RRSTRTCTTONS ON T IN AND RECORDING CONVEYANCES Motion by Wilharber, second by Welk to recommend to the City Council that Ordinance #8, Section 21.05 RESTRICTIONS ON FILING AND RECORDING CONVEYANCES be amended as follows: ADD: 21.05 -1 EXCEPTIONS. The following land divisions are exempted from the provisions of Ordinance #8, Section 21.05 and upon request, the City Clerk shall within ten (10) days, certify that this subdivision does not apply to such land divisions; (1) Divisions of land where the division is to permit the adding of a parcel of land to an abutting lot and the newly created property line will not cause the land or any structure to be in violation of this Ordinance or the Zoning Ordinance, and that the proposal would not have an adverse impact on the subject property or surrounding properties. (2) Said division and addition of land will not be large enough to allow for the creation of an additional lot for the purpose of building. (3) In the case of a request to divide a base lot upon which a two family dwelling, townhouse or a quadraminium which is a part of a recorded plat where the division is to permit individual private ownership of a single dwelling unit within such a structure and the newly created property lines will not cause any of the unit lots or the structure to be in violation of this Ordinance or the Zoning Ordinance. (4) If the Clerk /Administrator makes a negative determination or the applicant wishes to appeal the decision, the case shall be sent to the Planning and Zoning Commission for recommendation to the City Council. motion carried unanimously. It is the City Council's intent to make this section of the Ordinance to be more specific. The City Council's intent is not to make the Ordinance more restrictive. The City Council would like to have these items addressed in time for the ..spring rush ". Liaison Pelton expressed that the intention of the Planned Unit Development section of the Ordinance is to add more character. It would be an advantage to develop under the Planned Unit Development. The Planned Unit Development section applies to all zoning districts. Liaison Pelton also expressed that high density needs to be more defined. Chairperson Tourville noted that Ordinance #4 does not define • density. Motion by Tourville, second by Vermeulen to schedule a special meeting of the Planning and Zoning Commission on Thursday, February 21, 1991 at City Hall for the purpose of discussing the Planned Unit Development and High Density Zoning sections of Ordinance #4, motion carried unanimously. • Adjourn Motion by Vermeulen, second by Welk to adjourn the meeting, motion carried unanimously.
